An additional problem is that Fair Isaac, Trans Union and Equifax are not clear about WHICH dates they are using to age collections and charge-offs.

I would greatly appreciate any letters from collection agency and creditor executives in support of changes to credit scoring and reporting practices.

I'm planning to go to Dallas this weekend (Sept 16th-18th) to attend the Richard Cornforth Seminar which will be held at the Holiday Inn Select Central.

I'll be leaving Oklahoma City on Friday about 8 a.m. and should get into Dallas in about 4 to 5 hours depending on lots of things I can't foretell. (LOL)

Its about 3 hours 45 minutes actual driving time so not counting possible flat tires or whatever, I'd ought to make it about noon or so.

There is a group supper at the motel Friday night so I'll be attending that as well.

Most of you won't even know I'm gone because I'll be available by phone at all times and I'll be on the internet via cellphone or wireless network at least some of the time.

I'm hoping to meet anyone coming to the seminar or living in the Dallas area that would like to visit with me while I'm there.

Don't know where I'll be staying as of yet. Might not know until I get there.
I really can't afford to spend the $89 a night to stay at the Holiday so will probably look for something cheaper than that.

CORNYN FILES SUIT TO CLOSE DEBT COLLECTION AGENCIES
Three Houston-Area Companies Cited for Illegal Solicitations and Services

HOUSTON - Texas Attorney General John Cornyn received a temporary restraining order (TRO) to close three fraudulent Houston-area debt collection agencies. The petition for TRO, which cites individuals affiliated with the companies, also requests the freezing of certain bank accounts and the forfeiture of funds.

Involved in criminal search warrants in this cooperative enforcement case were the Harris County District Attorney's office and the Federal Bureau of Investigation.

The defendants named are Rudolph Stearnes III, William Ficka III and Kyle Holder, with their respective companies - Campbell, Campbell, Drexler & Gates; Thomas, Thomas, Alexis & Lynn; and Ashton, Ashton, O'Riley & Schwartz.

"The allegations in this case paint a picture of three people who brazenly harmed numerous individuals and businesses in Texas and all across the country using fraudulent and empty debt collection promises," said Attorney General Cornyn. "We contend that they passed themselves off as attorneys in legitimate law firms, then proceeded to collect money from debtors without returning this money to the creditors."

According to allegations in the petition filed today, these companies sent unsolicited faxes across the country in an effort to attract debt collection business from creditors experiencing problems with collections. State law requires that debt collection agencies be bonded, while these were not. Also, sending unsolicited faxes violates federal law.

Representing themselves as attorneys, the individuals named in the suit allegedly solicited companies for credit files. When they obtained these, they used extreme methods of telephone intimidation to coerce the debtors into payment, then once they collected this debt, they allegedly never reimbursed their clients, the creditors. In turn, the defendants quickly changed addresses and phone numbers to avoid detection.

The Attorney General's Consumer Protection Division has alleged that the companies committed numerous violations of the Deceptive Trade Practices and Consumer Protection Act, including causing confusion or misunderstanding about sources or affiliations of goods or services, and representing that goods or services have approvals, sponsorships or standards, when in fact they do not.

The companies also are charged with several violations of the Debt Collection Act, including prohibitions against harassment and profanity, according to the petition.

I call all debt collectors n*gg*rs too. That is not because of the color of their skin but rather the blackness of their hearts and minds. I also call them scumbags, thieves and liars. That is what this conversation is all about, not Billie Bauer or creditwrench or any of the stuff you holler about.

Stay on topic fool. The conversation isn't about Magna Carta or the Queen of England either. The topic is about abusive debt collectors and their sleaze bag operations which they call a "business" or a "profession" and which you want to defend but which you cannot do so you turn to slurs, slams, harassemt and other such garbage in an effort to keep the conversation from going where it is supposed to be going.

The topic is about sleazebag debt collectors who abuse people such as this poor woman left to raise 5 kids and fighting dirtbag debt collectors who attempt to tell her she can be thrown in jail and her kids sent to foster homes, driving her to the point of contemplating suicide.

Now then, let's see how much of a patriot Uncle Normie is. From the following we can easily see that not only does he not know his history, he obviously does not understand the significant role that the GREAT MAGNA CARTA played in shaping our beloved Declaration of Independence and our Constitution nor does he know or understand that the MAGNA CARTA and the rights it guarantees to the citizens of England to this very day but it has also been the foundation stone upon which the rights of all citizens throughout the free world. Every free world nation in existance today has in one way or another incorporated the principles, beliefs and values that the Magna Carta proclaims for all free men everywhere. Drafted by Thomas Jefferson between June 11 and June 28, 1776, the Declaration of Independence is at once the nation's most cherished symbol of liberty and Jefferson's most enduring monument.

The violations of English Common Law in the American Colonies by King George, provided Thomas Jefferson with ample argument in writing his declaration of independence from the monarchy.

Such Revolutionary War era principles as habeas corpus and the wrongness of taxation without representation drew their roots from English Law of the 17th century that was based upon the Magna Carta. King George had violated these laws...in effect placing his decisions above the law of the land, and this gave the Colonists not only the right to seek freedom, but a responsibility to do so.

Not only did the Magna Carta become a "springboard" for Jefferson's revolutionary Declaration of Independence, the concepts of LAW as supreme (above even kings or legislative bodies) were drafted into the United States Constitution by James Monroe. The Bill of Rights, and specifically the 5th and 6th Amendments, find their heart and even their verbiage in the words of The Great Charter. Born in England in the 13th Century, the Magna Carta is arguably American as it is British.

On July 4, 1776, the Second Continental Congress unanimously adopted the Declaration of Independence. The Constitution provides the legal and governmental framework for the United States, however, the Declaration, with its eloquent assertion "all Men are created equal," is equally beloved by the American people. Until such time as the Second Continental Congress convened and adopted the Declaration of Independence, America was a subject of the British Crown.

The Federal Convention convened in the State House (Independence Hall) in Philadelphia on May 14, 1787, to revise the Articles of Confederation. Because the delegations from only two states were at first present, the members adjourned from day to day until a quorum of seven states was obtained on May 25. Through discussion and debate it became clear by mid-June that, rather than amend the existing Articles, the Convention would draft an entirely new frame of government. All through the summer, in closed sessions, the delegates debated, and redrafted the articles of the new Constitution.

On September 25, 1789, the First Congress of the United States therefore proposed to the state legislatures 12 amendments to the Constitution that met arguments most frequently advanced against it.

All of the above are important facts in our great history which Uncle Normie obviously knows nothing about yet he has the temerity to make the following dumb statements and hope to palm it off on his unsuspecting audience as being truth.

CREDITWRENCH CEO Bill Bauer was noticeably absent from internet postings for the last week or so. Quite out of character for him.

My sense is that, because of his recent financial difficulties, his ISP disconnected him. I say this because, as quickly as he left, he came back online the 1st of the month. That's when he gets his social security check.

I was never off line, have never been off line since 1982 and won't be off line until long after I am dead and gone. Count on that. I wasn't off line at all even when I was on a jet airplane headed to the East Coast nor when I was there nor when I was enroute back home.

The truth is that I told you on your holdings message board that I can crank you up on the weekends and you will spit and sputter over it all week long while I do other things. The truth is that I keep pitchin 'em and you keep missin 'em.

The truth is that you wouldn't know the truth if it bit you in your butt. The truth is that all you know how to do is to spam and cybersmear, twisting what someone says into a grotesque misrepresentation of what was actually said or intended.

You are a real piece of work to say the least. You don't know how to build a website, you don't know how to get links, you don't know how to build a website or much of anything else except how to spam 120,000 newsgroups.

Concerned Citizen has just been kind enough to provid me with a link to one of his 120,000 spam messages which he falsely claims he didn't do. I have pretty well cleaned up most of the more offensive language the other members of the newsgroup used in telling him what they thought of him and his spamming of their news group. Had they been able to get a physical hold on the louse they probably would have used something a bit more forceful to teach him that they don't appreciate his looney tunes antics either. Why he was so dumb as to deliberately point me to what I already knew about I don't know but since he did that is now his problem.

Of course, spammers, liars or cybersmearers are never too smart to begin with.

Today I am bringing you a small sample of the mad ravings "concerned citizen" puts on his message forum, PCMHOLDINGS.COM and to which he tries to lure the unsuspecting.

Concerned Citizen is obviously a mainiac and easily capable of far more depraved actions than even Michael Jackson is currently on trial for purportedly having done. He is a danger to society and obviously a cyberstalker.

Hang on to your hats and fasten your seat belts because this one is going to be a wild ride indeed. Here is a very small part of a "story" he wrote on pcmholdings.com and desperately wants you to go read all about his great work as an author.

Spinning through the dark dingy center of his/her empire, MayMay began to woolgather thinking of a wonderful time at a special cantina in ole Mexico.

1974 Tijuana

The shrill feedback shocked the senses and rattled the acrid smoky air of the old bar in the crappier section of TJ. “Testes Testes Uno Dos Tres” said a short man in the center of the stage, mildewed torn curtains behind him, micorphone stand 3 feet off the stage,.“Buenos noches amigos” said the MC a dwarf with a club foot wearing a suit he should have abandoned 20 pounds ago. “Hwelcome to our chow” He grinned a piece of spinach lodged in his yellow bicuspid , his full slicked back hair radiant with the spotlights, “ Tonight our Chow ees called “The Bride of the Burrrrrro”

The donkey’s brays could be heard back stage, but it was the sheep’s bah that drew Phil’s attention.

“Hwe need a volunteer amigos to romance DULCITA! At that the spotlight shown on a young lamb wearing a push up bra and “Hanes for Her” probably purchased at a store for muchachas grandes.

Phil was drunk enough and the lamb looked hot, what the hell he thought and throwing caution to the wind he arose and walked toward the stage as a group of sailors on shore leave began to chant “Do It!”

Stumbling out the rank saloon, Phil steadied himself if only to avoid the rain of fists that would befall him if he neared the sailors. The room which previously smelled of sweat, beer, cigarettes, despair, cheap perfume, and livestock now reeked in a twisted potpourri of the previous now spiced with gore and cordite. (Ed Note- Foxy what a twist)

Death awaited the depraved pervert if he stayed a moment longer. His breath smelled like a jet of Binaca sheep scent. A toothless old prostitute spat at his face which only made him grin. He loved this town. His desires unsated he entered an S and M bar next door. "La Painadoria"

Inside a butch bull dike with a leather Nazi officer cap sneered as he entered his eyes now adjusting to the low light. Suspended from the ceiling by his nipples pierced by talons a la Richard Harris in "A Man Called Horse", hung a young man of Phillipino descent spinning in slow arcs. Ordering a cheap beer from a one-eyed waitress, Phil got comfortable and took in the spectacle around him.

CREDITHAMMER relaxed as he took in the scenery. He wasn’t aware of the sailor who had walked in a few minutes later.

The Sailors had watched him as he sulked away from the cantina and snuck into the LaPainadoria. They were talking about what they would like to do with the mean old fool when a young sailor had arrived late on the sceen. He was late, but his buddies filled him in on what had happened.

The particular sailor was from Northern California.

He grew up on a farm which raised sheep for their wool. He had many a lamb as a pet.. He considered them friends. He loved animals and detested the idea of anyone mistreating them. It broke his heart when they told him what had happened.

He was happy to hear that the burro had managed to knock out the MC and push CREDITHAMMER down, before CREDITHAMMER had shot him to death. He swelled with pride for the burro.

He despised the cruel man who had shot the burro and the lamb. He loathed CREDITHAMMER for everything that he represented.. He wanted to revenge the horrible death of the two poor innocent animals.

He was enraged.

The sailor thought that his buddies had described the brutal old man well. He spotted him immediately, snickering over a drink and laughing at something. The ‘something’ was a poor helpless young man who was suspended from the ceiling and spinning in low arcs. He could not believe his eyes as he realized that the young man had talons hooked into his flesh. The young man was desperately pleading for someone to help him.

The sailor immediately jumped onto the bar and with his Swiss army knife swiftly cut the young man down. The young man fell to the ground and cried “Thank you. Thank you.. these freaks are crazy.. help me.. help me.. please help me get out of here”. The sailor was in the process of helping the young man up and telling him that everything was going to be okay, when all of a sudden the bull dike with the Nazi officer cap approached them and said “What the hell do you think you’re doing here”?

The sailor could not bear the sight of the bull dike with the Nazi cap. He could care less about her sexual preference, but he would not tolerate anyone wearing a Nazi cap. He had read “Ann Frank” several times while at school, and had great sympathy for all of those who had suffered at the hands of the hateful Nazis. He walked toward her and quickly grabbed the cap off of her head and tore into pieces, and threw them into her face.

The woman shocked.. started screaming obscenities and proceeded to lash out with her big fists in a futile attempt to beat up the sailor. The young man who was cowering behind the sailor had started to scream. The sailor pushed the big woman down and picked up the young man and ran out of the bar with him.

Throughout it all the vile CREDITHAMMER sat in audience. He was thoroughly disgusted with the sailor for interrupting his fun and spoiling what his sick mind considered to be his entertainment.

But some freak intuition of his own told him that he had lucked out.. told him that the sailor had actually come into the bar for him.. told him that if it had not been for the sailor’s timely rescue of the poor tortured soul suspended from the ceiling, it would have been he himself who would have been carried out of the bar.

He was moping about the unbelievable bad luck he was having that day, as he crept out of the bar of ill repute..

The phone rang, bringing him back to the present. Still dressed as MayMay69 Phil couldn't pick up the phone. 6000 visits to his website and not one sale. These idiots didn't know what was good for them. Pensively, he looked up the blog of his arch Nemesis, C. Tormis. Filled with a combination of dread he waved his arms above his head dreamily, like Bette Davis in "What Ever Happened to Baby Jane?" Dancing around the room he turned on his VCR. Richard Simmonds was flouncing and dancing with a crew of whalish housewives. An idea brought forth its own genisis in the surviving neurons in his cranium. "That's it!" "The Credithammer DVD!" He envisioned himself on commercials like the guy that wears the suits with question marks like the Riddler that sells books on getting government grants. I will make a video and at that he danced dervishly like Richard Simmons on amphetimines.

But before I can begin production, Phil proclaimed, I must continue to try and find all the newsgroup postings about me and respond to them like I did yesterday here. Rats, more people finding out the truth about me.

CREDITHAMMER searched stealthily through all of the newsgroup

postings and responded to them as quickly as possible..

He hated C. Toris with every fiber of his being. He couldn’t help the tears that were falling from his eyes and messing up his cheap mascara. As he wiped away the tears, he thought.. “Darn, This guy is going to put me out of business! How can I scam unsuspecting people.. and rip them off with my mis-informed credit advice, when C. Toris is telling them THE TRUTH about me? And how am I gonna get any money from these gullible and trusting people with my fire scam, when C. Toris tells everyone THE TRUTH about it all being a bogus ploy to pilfer money from them"?

CREDITHAMMER resigned himself to yet another task of systematically typing ridiculous and irrationable responses, hoping to salvage himself another "student"..

He climbed into the Ford Pinto, avoiding jagged metal and peeling faux wood trim. He was on his way to Best Buys with one of his two remaining lines of credit. His Mowes card long since toast, but he had that secured Cap One card and a man on a mission would get some fancy AV equipment and voice recognition software with that Best Buy plastic. He envisioned the CreditHammer(TM) program with his face as the spokesman as being a surefire hit. MayMay69, Jeffe, Wagg, and Goosegow1 would certainly want to be in the film. That Jeffe needed to be on a shorter tether by cracky, Phil was alarmed by the Jeffe since he started getting instructions directly from God spoken to him through cats. Entirely different matter.

He pulled in to the first handicapped spot. Not that he was incumbered in any way, he just didn't give a crap. He grinned big thinking of what was to come.

Cybersmears - What they are and how to deal with them

How Cybersmearers Amplify Their Message **

The perpetrators of Cybersmear (or what is referred to as Internet Terrorism), are prone to predictable patterns. Most common among these is the strategy of amplifying a complaint or several accusations in an attempt to lend credibility. This is done largely through what we call “proliferation and amplification.”

The goal of an Internet Terrorist is to inflict harm on the target company or individual. This is done through what must seem to be credible information that also must appear to be large and prevalent.

Here are the consistent tactics of Cybersmearers on-line:

• Anonymous postings on scattered “chat rooms” and/or bulletin boards.
• Look for postings chronicling the “injustices” of the accused company in what appears to be detailed “bashing” or techno-discussion. Look for (amateur, unlicensed) interpretation and conclusions.
. Look for information or quotes taken out of context from the accused, or represented in very small segments as to be presented in a more misleading manner.
• With very few exceptions these basher will claim a concern for “innocent victims” or the “unsuspecting customer”.
• With few exceptions these bashers will claim a “neutral” stance, but will solicit either comments or emails which will predominate in the direction of the Smear (this is key to identifying a smear. True neutral discussions open to the public generally occur with both positive and negative viewpoints equally represented. If the balance is tilted too far in one direction, it is the fingerprint of a smear, and the posted comments can safely be considered false).
• It is common for all of the comments to be anonymously posted by the perpetrator(s) to create the sense of “unified outrage” or “a virtual stampede of individuals who agree” or “surprising public outrage” (all actual quotes).
• Further, perpetrators will anonymously post slightly varying opinions (all in the direction of the smear, of course), so a “discussion” can occur on finer points of the smear, all the while creating the impression of a larger complaint field.
• Among what is usually a small circle of smear perpetrators (generally ten or less individuals behind the largest and most famous smears), automatic posting notifications are sent out whenever one individual places new content on the Internet. This allows the others to rush to the scene with their anonymous postings, again, providing amplification and a false impression of the scope of the complaint.
• The band of smear perpetrators will carefully interlink their sites (to a controlled result, over linking is punished by search engines) so that their websites receive high ranking in search result pages.
• Key words, many times the company or personal name of the accused, will be used in the bashing of titles, body of text, and Meta tags so that someone searching for the accused will automatically find the Cybersmear websites. In this way, the smear is made known to those searching for the accused company or individual.

Our spammer has really been at it hard and heavy today as always. He's been spamming all the msn and yahoo groups he can find that will let him post his messages. Here is a good sample of his footprints. He is boiling over worse than a 1918 Ford Tin Lizzie
trying to cross the desert.

Folks, the list of spam messages this joker puts out is absolutely endless. More than 120,000 of them and still we keep on getting more from this spam monkey. The best I can do is try to make everybody aware of his false and misleading posts and information and let him ruin every message board, newsgroup, egroup and the entire web with his garbage.

He is in violation of every terms of service agreement he ever agreed to and is in violation of the United States Code that is called the Computer Decency Act or CDC and one of these days they will catch up to him and put him behind bars where he belongs.

	DEBT COLLECTORS ARE THIEVES AND HERE IS HOW AND WHY.

Why do debt collectors fear the truth? Because if everybody understood what happens when you pay them they woud never collect a crying dime. They will never give a receipt for any money you pay them and that is because the money they get cannot be easily traced or tracked and it is much easier for them to steal from their clients, turn the debt over to another collection agency who will attempt to collect from you again even though you paid the debt already. They also will be less likely to get caught at their thievery. But that is why most states have licensing laws in place to help protect the creditors who trusted them to collect the money.

Debt collectors will never take it off your credit reports either. Makes no difference whether you pay them or not. So never pay a debt collector thinking that is going to help your credit ratings. While it might give you a very small boost because your debt to income ratio will be improved that won't overcome the negative effect of having debt collector skunk spray all over your credit reports.
