Type of Taxation In Lao Law System

Taxation structure and rules are governed by a 1995 Tax Law, which has been four times amended, in 1998, 2001, 2003 and in 2005 and completed by an Implementing Decree and other separate provisions. The 2004 Foreign Investment Law also contains certain tax provisions which apply to foreign investors. Together, these laws and decrees create a single tax regime applicable to all organizations and persons conducting business or working in Laos. The tax regime of the Lao PDR is comprised of direct and indirect taxes. Indirect taxes are business turnover tax and use tax. Direct taxes are profit taxes, income taxes, de minimus taxes and fees.

The regular modifications have not affected the overall taxation system. They were mainly directed on "luxurious" imports, among which tax rates have been increased and new taxes imposed.

Business Turnover Tax ("BTT")
The turnover tax shall be collected upon imports, first time sale of imported goods or domestically produced goods and services. Initially, there were four rates of BTT in Laos. Under the new system as resulting from the latest amendment, two rates are applicable, 5% and 10%, plus a 0% rate for the exempted goods as they are listed in the Tax Law.

For imports, the business turnover tax is paid at the point of importation, while, for domestic transactions of goods/services, it is declared and paid monthly to the tax authority, the month following the collection. The basis of taxation for imported goods is the customs value, plus customs duties, plus excise tax. Tax on services shall be calculated after the completion of the work. All purchases and sales must be substantiated by tax invoices. Importers of goods for resale are allowed to deduct the business turnover tax paid at the point of importation from the monthly business turnover tax transactions assessment. Importers of goods for re-exports are exempt from the business turnover tax.

Excise Tax / "Use" Tax
The excise tax (often referred to as "use tax") is collected on the importation or domestic supplies of petroleum products and selected consumer goods. Like the turnover tax structure, the excise tax structure was also recently modified. The excise tax on these goods ranges from 5% to 90%, depending on the type of goods and on the value declared upon importation or on the ex factory value, if it was produced domestically. Like turnover tax, excise tax is declared to the tax authority either at the point of importation or monthly following the month of production.

Profit Tax
Profit tax is levied on annual net profits derived from business operations, unless the Tax Law or specific agreements with the Lao Government specifically provides exemptions. The annual net profit is calculated on the basis of the difference between the total income and the total deductible expenses of the year. It is payable in advance on a quarterly basis. As an example, at the profit tax rate applicable to Lao-owned companies is of 0% for the incomes not higher than Kip 2,400,000, at rates of 10% to 35% on net profits derived from professional services and of 35% on net profits derived from business operations. The profit tax rates applicable to foreign invested companies vary, subject to the incentives as granted under the 2004 Foreign Investment Law, from 0% to 20%.

Minimum Tax
A minimum tax (also called the "de minimus tax") is applicable to gross turnover of the previous year of those enterprise who do not make a profit, or who make a profit that would create a lower profit tax payment to the Government than the application of minimum tax. Minimum Tax is payable on an annual basis. Even if the year-end financial statement states that the company had losses in its business operations in the previous year, the company must pay its de minimus tax. These minimum rates are:

For the domestic producer: 0.25% of total revenue of whole year,
For the trading and general services businesses: 1% of total revenue of whole year.

Certain foreign and domestic investors who are exempted from annual profit tax may also be exempted from the minimum tax. Exemption of the minimum tax is also applicable when losses as shown in the company's financial statements are certified by external auditors recognized by the Lao Government.

Income Taxes
Taxes on incomes are comprised of the following:

Personal Income Tax levied monthly on wages, salaries, bonuses and other emoluments derived from employment in the Lao PDR, at a rate varying from 0 to 25% for Lao employees and at a flat rate of 10% for foreign employees employed by entities licensed under the Foreign Investment Law, which the employers are responsible to collect and to declare to the tax authority;
Tax levied on the incomes generated by licensed intellectual property rights, at a fixed rate of 5%;
Tax levied on the incomes arising from the property of movable capital, including dividends, profits from the sale of shares, interests on loans and guarantee fees at a flat rate of 10%;
Tax levied on the incomes arising from by the property of immovable capital, including lease of constructions, land and other material properties, at a flat rate of 15%; and
Tax on the incomes perceived from non-business entities, such as the mass organizations, at a flat rate of 10%.

Lao Law does not make expressly mention of any "withholding tax" as applicable to entities not established in Lao PDR. However, such taxation is applied in practice under the category of the tax to be levied on incomes arising through licensing intellectual property rights, leasing immovable property, dividends, sale of shares, interest on loans and guarantee fees when this tax is payable by an entity outside of Laos (the entity within Laos making the payment will "withhold" the income tax).

Fees
Government divisions collect fees for issuing tax registrations, licenses to conduct activities, approvals, certifications or registrations of other official documents, the use of roads, the entry into and exit from the country, the issuance of visas to enter and exit the country, residency in Laos, the use of radio and television satellite receivers, the use of television, the affixing of signs advertising goods, shop signs, and other services within the territory of Lao PDR.

The fees for the registration documents are based either on an ad valorem or on a fixed rate, depending on the type of document. Fixed registration fees are minimal, and are generally applicable to documents that do not involve transfer of property (e.g., power of attorney, service and manufacturing contracts).

Other Taxes
Import and Export Duties
Under the Customs Law, all goods, imported or exported, are subject to duties, unless contrary exemptions are provided for by law or by specific agreement with the Lao Government. Export goods are declared at their actual value, whereas import goods are declared at their actual value plus insurance, transportation and other costs. Import and export duties must be paid at the point of importation before the goods can be removed from the customs services. Import duties, like export duties, range from 5% to 40% (except for certain types of goods, notably luxurious goods and vehicles). As previously mentioned, for companies which undertake promoted activities, the import duties may be exempted for certain goods to be used in the production.

Goods exempt from import duties include, among others:

goods in transit with enclosed circulation permit;
goods to be re-exported in their initial quantity and conditions;
goods to be processed, assembled, improved or repaired, before being re-exported;
personal property of persons temporarily visiting the Lao PDR;
certain types of inherited property;
samples which are not for sale; and
humanitarian assistance materials.

Countries in this world have caused a fire at all times, Thailand is not out of the way as well.

Several years ago, Dr. Nitipoom NAVARATNA had a presentation and forecasted that Indonesia would be apart into 6-14 different countries, at that time many of professors laughed their lungs out about what he said. Since 2542 (1999) this prediction started becoming true when Indonesia splited itself into Democratic Republic of Timor-Leste, Aceh and following many territories in near future.

Now this time, on December 11th, 2543 (2000), Dr. Nitipoom NAVARATNA gave speech in public and predicted that Thailand would be divided into 4-6 countries indeed!
This was not unexpected situation, but it happened from such a good reason and exact process.

In 2553 (2010) GATTs would be completely effective, free trade is valid. Various agricultural products in huge quantity imported from foreign countries influx to Thailand.
While Thai farmers would not consume their own agricultural products due to it was more expensive than imported products, one reason that they had the factors of producing fertilizer from foreign, combined with the development of Thai agriculture was going very wrong direction which was a single way like: groups of longan farmer only planted longan . . . people also consumed Vietnamese rice . . . rice farmers had to buy garlic and onion from China . . . shallot and garlic farmers would not buy Thai longan, on the other hand they would import from Korea instead. It was a circuit like this over and over again, eventually Thai corp would be dead and not to sell out.
In next 10 years local genetic would be destroyed by GMOs and then 80% of population was farmer could not be survive.

Financial measure would not work out because the banks owned by foreign investors.
Cost of electricity, oil and telephone would be more expensive because these enterprises owned by foreign investors.
The farmers' vast area would be sold in low price to foreign investors as currently it appeared in eastern part of Thailand, either farmers could not take this money to invest in any kind of businesses because Big C, TESCO LOTUS, Carrefour, KFC, Pizzahat, McDonal, Garment Factory . . . all owned by foreign investors as well.

4 southern provinces (Malaysia border) would be the first to separate from Thailand, following by 4 eastern provinces which owned by foreigners . . . it meant buying Thailand just like U.S. Government bought Alaska from Soviet Union.

Now, it's 2009 . . . it seems like his prediction is right. This moment Thai Government is having a really hard time to serve their country, many problems couldn't be resolved including internal politics disaster (yellow shirt VS red shirt), 3 southern provinces crisis, Cambodia conflict. Let see if Thailand is still Thailand in near future.

This here is what Honda hopes is the future of motorcycles. Small, electric and two-wheel drive, the EV-Cub could be ferrying riders around on its retro-styled frame as early as next year.

Like an all-wheel drive car, the 2WD motorcycle offers more stability and traction than its rear-wheel cousins, and may even be easier to learn for the beginner rider. Honda's not alone in the 2WD space, nor is the space really that new—at least for concept vehicles. Big names like Yamaha have also been working on 2WD bikes for the better part of the last decade.

But it's Honda that appears ready to commercialize a 2WD motorcycle, or at the very least an all electric one. The company expects to have an electric bike on the market by the end of 2010, which may or may not be the EV-Cub seen here.

Super Cub was born in Japan in 1958 based on an ideal concept of Soichiro Honda evolving from model "Cub Type F" in 1952 that put an empty bicycle frame installed with running engine as you can see the picture on the left-hand side.

Model History

On August 1958: Sales of Super Cub C100 began (air-cooled 4-stroke, single-cylinder OHV engine, 49cc, 4.5 horse power)

In 1964, two larger engined versions were offered, the CM90 (OHV 87 cc) and C65 (OHC 63 cc) with slight alteration to frame and styling.

In 1966, the whole motorcycle was upgraded, the 50 cc engine going from pushrod 4.5 bhp to SOHC 4.9 bhp (a bored-down C65 engine) called the C50, and similarly the 90 cc was redesigned with an OHC engine called the C90. Though the basic design of Cub remained unchanged, slightly new styling features and improvements were integrated, most visible being the enclosed front forks.

Lao praised for ratifying UN key human rights treaties

The United Nations praises Laos for ratifying the International Covenant on Civil and Political Rights (ICCPR), the Convention on the Rights of Persons with Disabilities (CRPD) and the UN Convention against Corruption (UNCAC).

By doing so, Laos pledges to work against all forms of discrimination and promote equality before the law. The ratification also commits Laos to the promotion of "individual freedom of belief, speech, association, freedom of press, right to hold assembly and the right to political participation as well as to fight against corruption through prevention, criminalisation, international cooperation and asset recovery."

"By ratifying these treaties, Lao PDR further emphasizes its commitment to - among other actions - enact laws and other measures to improve the lives of those living with disabilities such as victims of cluster munitions, and to protect an individual's physical integrity (against e.g. torture and arbitrary arrest), explained the Office of the Resident Coordinator of the United Nations Lao PDR and the Office of the UN High Commissioner for Human Rights in South East Asia," said the UN in a press statement.

"This is a significant moment in the evolution of the country's commitment with the promotion and protection of human rights and the UN Country team stands ready to support the Government in the realisation of these conventions," said Serge Verniau, UN Resident Coordinator in Laos.

"These ratifications herald a momentous step by the Lao PDR in its integration into the international legal framework."
Homayoun Alizadeh, Regional Representative of the United Nations Office of the High Commissioner for Human Rights said the next step for Laos is to move towards implementation and translate the provision of these conventions into national laws.

With the ratification of ICCPR and CPRD, Laos is now a state party to six out of the nine existing core UN human rights treaties.

In South East Asia, Cambodia, Indonesia, Philippines, Thailand, Timor Leste, Vietnam, and now Lao PDR, have ratified the ICCPR. Philippines and Thailand are the only other countries together with Lao now in the region having ratified the CRPD.

The battle is still continuing between iTunes and Palm Pre, Palm has just launched a new version of webOS for the Palm Pre that enables and actually be able to recognize and synchronize with the latest version of iTunes.

Palm webOS 1.2.1 is now available, and it enables Palm Pre users to once again sync their Palm Pre with the latest version of iTunes 9.0.1.
Palm has also made a few tweaks in webOS 1.2.1 that allows media syncing of photos without requiring the full resolution originals, and it now provides a faster display of high quality full screen images.

Following this appearance, on April 6th, 2009, federal prosecutors denied all allegations of fabrications in the motion. That following month, on May 11th, 2009, Vang Pao returned to federal court in Sacramento, California with his lawyers to argue the motion. Judge Frank Damrell stated, after hearing the arguments for the motion, that there was not sufficient evidence from the defense to justify a dismissal. The next hearing is scheduled for October 2009.

(SACRAMENTO, California) -- Charges have been dropped against well-known Hmong leader Vang Pao in connection with an alleged plot to overthrow the government of Laos, federal prosecutors said on Friday.

"I was pleased that the government finally has recognized Gen. Vang Pao's innocence, as we he," said John Keker, attorney for Pao. "It's taken too long, but they finally got round to the right result."

However, a superseding indictment issued by a federal grand jury names two additional defendants in the case.

"In out measured judgment, and based on the totality of the evidence in the case and the circumstances regarding defendant Vang Pao, we believe that continued prosecution of this defendant in no longer warranted," U.S. Attorney Lawrence Brown said in a prepare statement.

Supporters have rallied in Pao's defense outside the federal courthouse in Sacramento during each of his court appearances.

Twelve defendants, including 10 people charged earlier, were named in the new indictment that was unsealed Friday.

The two new defendants, Jerry and Thomas Yang of Stockton, were arrested Friday morning and made their initial appearance Friday in the U.S. District Court in Sacramento.

All of the name defendants, with the exception of Jerry and Thomas Yang, have been released from custody on bail and other conditions of supervision.

"Today's charging decisions are the culmination of a comprehensive investigation of the charged plot and review of all evidence that has been gathered," Brown said. The original arrests and charges in Summer 2007 were based principally on the then-known English-language evidence, including wiretap conversations and recorded conversations between defendants and an undercover agent. When it had become apparent that many of the defendants had immediate plans to travel to Thailand to execute the plot, arrests were made.

"Agent continued their investigation after the initial charges, including the receipt of additional evidence, the translation and review of voluminous foreign the wiretap and undercover investigation, and the review of some 30,000 documents both in English and foreign languages seized pursuant to search warrants at the time of arrest," Brown added. "This superseding indictment is the result of this continuing investigation."

The new indictment alleges that the defendants conspired to acquire and furnish military arms, munitions, materiel, personnel and money to insurgents in Laos to conduct military operations against the government.

The indictment outlines a series of meeting with an undercover Bureau of Alcohol, Tobacco, Firearms and Explosives agent and conversations among the defendants during which they allegedly outlined plans to buy and ship arms to insurgents in Laos for use against the current government and to get mercenaries to carry out bombing of government buildings in the Lao capital.

VANG PAO Part Ⅰ : 10 charged with alleged Laos plot

(CNN) -- Ten people, including a former general in the Laotian army, were arrested and charged in the United States with an alleged plot to overthrow the Laotian government.

More than 200 federal and local enforcement agents were involved in the raid, which involved six Californian cities, early Monday. Prosecutors described the alleged plan as "audacious" and said it was aimed at obtaining guns, missiles, rockets and explosives.

The suspects include Vang Pao, 77, who emigrated to the United States in 1975 after serving as a general in Laos, and Harrison Jack, 60, a West-Point educated former U.S. military officer, according to the prosecutor's office.

If convicted, the 10 suspects face possible life prison sentences.

"The United States cannot provide a safe harbor to those plotting to overthrow a government with whom we are at peace," said U.S. Attorney McGregor Scott in a statement. "These defendants flagrantly violated numerous federal laws, including the Neutrality Act, in planning to topple the government of Laos."

Most of the alleged conspirators were Hmong, an ethnic minority group in Laos that helped U.S. operatives fight communist insurgents during the Vietnam War. Vang led CIA-backed Hmong forces as a general in the Royal Army of Laos, while Jack was involved in covert operations during the Vietnam War, according to The Associated Press.

After Laos fell to the communists in 1975, Hmong people began emigrating to the United States, and more than 500,000 now live in the country, according to the State Department.

The six cities where the arrest and search warrants were executed were: Los Angeles, Sacramento, Fresno, Chico, Stockton and Woodland.

One suspect, Lo Cha Thao, discussed an operation to send special operations mercenaries into the Laotian Capital, Vientiane, to blow up government buildings, according to prosecutors.

The work of an undercover agent of the Bureau of Alcohol, Tobacco and Firearms foiled the plot, leading suspects to believe he could supply them with the weapons they wanted, prosecutors said. Those included the powerful C-4 explosive, AK-47 automatic rifles and missiles, rockets and mines.

Laos, like neighboring Vietnam, remains a communist country, but the government has liberalized the economy in recent years, allowing more private enterprise. The United Sates normalized trade relations with the Laos in 2005.
