The next meeting of the Saratoga County Aging and Disability Network will be held on Tuesday December11th from 2-330pm at the Saratoga County Office Building, 152 West High Street, Ballston Spa in the Cafeteria on the 2^nd Floor. All are welcome and encouraged to bring a colleague who may be interested in joining. This will be our annual networking meeting and you are encouraged to bring business cards and agency information to share. Today’s Presenters and Topics: Cheryl Lawyer- Outreach and Community Education Coordinator, Northeastern Association of the Blind; and Blaise Bryant- Community and Outreach Associate, Consumer Directed Choices, presenting “What Is a Service Dog and What is NOT.”

Accompanying Blaise was his Service Dog, Flash; accompanying Cheryl was Therapy Dog and NABA Ambassador Clive.

The presenters felt this was a timely topic, as we are seeing more and more incidents of people and businesses struggling with the definition.

What is a service animal?

A service animal is not a pet. The Americans with Disabilities Act (ADA) defines a service animal as any guide dog, signal dog, or other animal individually trained to provide assistance to an individual with a disability.

Service animals perform some of the functions and tasks that the individual with a disability cannot perform for him or herself. "Seeing eye dogs" are one type of service animal, used by some individuals who are blind. But there are service animals that assist persons with other kinds of disabilities in their day-to-day activities. Some examples include: Alerting persons with hearing impairments to sounds; pulling wheelchairs or carrying and picking up things for persons with mobility impairments; assisting persons with mobility impairments with balance.

Under the ADA, privately owned businesses that serve the public, such as restaurants, hotels, retail stores, taxicabs, theaters, concert halls, and sports facilities, are prohibited from discriminating against individuals with disabilities. The ADA requires these businesses to allow people with disabilities to bring their service animals onto business premises in whatever areas customers are generally allowed.

Despite this, there is currently no centralized registry for Service Dogs. Service dog owners do have identification but do not have to show it.

A public accommodation provider cannot ask about the nature or extent of a person’s disability and may not demand proof that the animal is certified. If it is not readily apparent that a dog is a service animal, they may ask:

1. Is the animal a service dog?

2. What medically necessary task does he perform for you?

Emotional Support Animals (ESAs)

To consider an animal an ESA, a person must get a note from their medical doctor that states the animal is with them for emotional support. ESAs are NOT required to be allowed to go wherever their handler goes. However, with the MD note, ESAs are recognized as necessary in housing and the FAA. The ESA must be well-behaved and fit within guidelines of the airline while traveling.

Therapy Dogs

A therapy dog is a dog that might be trained to provide affection, comfort and love to people in hospitals, retirement homes, nursing homes, schools, hospices, disaster areas, and are defined but not covered or protected under the Federal Housing Act or Americans with Disabilities act. They also do not have public access rights with exception to the specific places they are visiting and working. Typically, the dog would be granted rights by individual facilities only.

Therapy dogs, International is an organization that certifies therapy dogs are well-behaved and trained to provide these kinds of services. The therapy dogs that complete the certification process are also insured by TDI.

If an individual states that he has a therapy dog, you can ask for their therapy dog identification.

**There are websites that offer certification for Therapy Dogs. These are NOT legitimate. You cannot go online to certify any animal for Service, Therapy, or as an ESA.

November 13 at St Edwards Church, Clifton Park- The program “What is a Service Dog and what is NOT” will be presented by Cheryl Lawyer, Outreach & Community Education Coordinator from the Northeastern Association of the Blind at Albany (NABA). “With all the media coverage about animals claiming to be service dogs or emotional support animals, there is a lot of confusion about the differences, their rights to public access, the services they provide as well the abuse by owners illegally passing their pets off as such.). As a long-time puppy raiser/trainer for pups bred to be guide dogs and her work with individuals with service dogs, Ms. Lawyer will present the differences between service, therapy and emotional support animals. The Americans with Disabilities Act (ADA) has special laws governing service animals and many states are making it a crime to fraudulently present a pet as a service animal. Attendees will learn how to tell the difference and what questions to ask (or not) when encountering what appears to be a service animal.”

Today’s Presenter and Topic: Deputy Jason Lang of the Saratoga County Sheriff’s Office – an overview of the Project Lifesaver Program.

The mission of the Project Lifesaver Program is to target at-risk individuals that are at risk of wandering due to Alzheimer’s or some form of developmental disability such as autism or Down Syndrome.

The program uses a transmitter tracking device which is worn on the individual’s wrist or ankle to aid in the search efforts for that individual. The Sheriff’s Office has a receiver that is able to pick up the frequency from the tracking device.

Benefits and Limitations:

While Project Lifesaver is an excellent resource to assist in locating an individual who wanders, it is not a guarantee, and not a substitution for constant supervision.

The client must have a caretaker who is able to contact 911 in the event the client goes missing. The transmitter has a range of approximately 1 mile in ideal conditions, so the call should be made as soon as possible. The transmitter is intended to be used to locate clients on foot. It will not be effective for someone who has access to a vehicle.

GPS products are available and sometimes used in conjunction with Project Lifesaver transmitters. At this time, GPS bands must be removed for charging every day, leaving a window of opportunity open for someone to wander without it on. Project Lifesaver transmitter batteries last for 2 months without needing to be removed until the battery change.

The Project Lifesaver transmitter is waterproof and can be worn in showers or while swimming.

If a loved one was to go missing the average search time once the receiver gets on scene is 30 minutes. This is 95% less time than traditional search methods.

Project Lifesaver History:

Project Lifesaver Program is a no-profit organization that originally started in Chesapeake Virginia in 1999. It now has more than 1100 participating agencies spanning across the US, Canada and Australia. The Saratoga County Sheriff’s Office began participating in the Project Lifesaver Program in 2015.

Today’s presenter and topic: Doris Green, Director of the New York State Respite and Caregiving Coalition. “The New York State Caregiving & Respite Coalition, NYSCRC, is a partnership of dedicated organizations and individuals committed to supporting the millions of our state's family caregivers. NYSCRC members understand the unique needs of caregivers. Through training and education, we focus on increasing caregivers' access to respite resources. And, we speak with a unified voice to gain the attention of policymakers for the needs of family caregivers.”

Definition of Respite is different in every system but the Coalition views it as planned or emergency care provided to a child or adult with special needs in order to provide temporary relief to family caregivers who are caring for that child or adult.

With partial funding from federal Lifespan Respite Grant, NYSCRC is training hundreds of volunteer respite providers throughout New York State. Greater availability to respite services will give caregivers more frequent breaks while helping them better manage the physical and emotional stresses that come with caring for an aging and/or disabled loved one.

By supporting important initiatives, like volunteer-based respite, NYSCRC takes an active role in improving the lives of informal caregivers.

Funded with a federal grant for Lifespan Respite awarded by the Administration for Community Living to the New York State Office for the Aging.

4 million unpaid family caregivers of adults provide the majority of all long-term care services to older adults and individuals with disabilities in New York State

The Caregiving Crisis:

Our Nations Caregivers are caring for a variety of populations which include the Aging, Developmentally Disabled, Veterans, as well as people who have terminal illnesses.

REST – Respite Education and Support Tools.

The REST program – an evidence-based respite-training program – provides the skills and tools needed to provide quality respite.

It is a professionally designed ‘Train-the-Trainer’ course that provides respite education to those who will then go out and train others to be REST Companions™, also known as respite care workers or providers.

The ‘Train-the-Trainer’ course is an intensive, interactive two-day program which provides new trainers with materials they need to conduct their own trainings. Representatives from senior services and healthcare organizations, Area Agencies on Aging, faith-based organizations, adult daycare, or other social service organizations are eligible to receive this training and then share this information among their own communities.

Since launching in 2013, REST has Trainers in 29 states and Canada to date.

REST Essentials™ training course, a four-hour program that prepares volunteers or paid respite workers to provide respite in supervised group settings, such as adult daycare, drop-off or camp programs.

Each program is interactive and highly detailed in order to prepare individuals to care for people across the lifespan, who have chronic healthcare needs or disabilities.

Partially underwritten by a private grant, this program was developed by a team headed by Lois Sheaffer, National Director of REST, and a Master Trainer. Having been involved in respite since the early 1980s as a respite worker, respite program manager, and respite worker trainer, she maintained a leadership role in the Illinois Respite Coalition and is a member of ARCH, the national respite coalition.

REST programs can be customized around any organization’s requirements, provided at their facility or an off-site location and delivered in one- or two-day formats.

What is a Pooled Supplemental Needs Trust (SNT)?

A pooled trust is an irrevocable SNT that under Federal and NYS law allows people with disabilities and disabling chronic health conditions to protect excess funds in order to become financially eligible for government benefits like Community Medicaid and/or SSI.

Funds in a trust can be used to provide for quality of life purchases that a person’s benefits do NOT provide.

1^st Party Pooled Trust Overview:

· Trustee must be a non-profit organization

· In NYS, a financial institution must act as co-Trustee

· Funds are pooled for investment purposes

· Activity is tracked individually in sub-trust accounts

· Trust is irrevocable and account terminates upon death of beneficiary

· Under Federal statute, any funds not retained by the trust must go to the state that provided Medicaid services.

Benefits of a Pooled Trust:

· Qualify and maintain eligibility for Medicaid to get community health benefits and long- term services

· Protect funds for supplemental needs that enhance quality of life

· Get long term care without a complete loss of resources

· People can get care in the community and afford to live independently

· Helps people transition home following short-term rehab

· Benefits allow people to participate in adult day health and home care services

Using a Pooled Trust for Income Spend -Down:

“Income received by an individual and placed into a pooled SNT in the same month will be disregarded for Medicaid eligibility purposes.”

2018 NY Medicaid Income Limits

· Individual- $842/month(+20)

· Couple - $1233/month(+20)

2018 NY Medicaid Resource Limits

· Ind -$15,150

· Couple- $22,200

Examples of Monthly Income – Social Security, Pension, IRA Distribution, Disabled Adult Child or Survivor’s Benefits

Using a Pooled Trust for Excess Resources (Assets):

For someone on SSI receiving as little as $2000 could jeopardize that person’s eligibility for benefits

2018 NY SSI Resource Limits

· Individual- $2000/month

· Couple- $3,000/month

2018 NY Medicaid Resource Limits

· Ind - $15,150

· Couple- $22,200

Common Resource Examples: Direct Inheritance, Retroactive Social Security benefit, Lump sum or structured settlement, other monetary gifts

Case Study:

· Maria is 80 years old and lives independently in her home

· She has dementia and needs help with activities of daily living

· Her monthly income from her pension and social security is $500 over the limit to qualify for Community Medicaid but she can’t afford to private pay for the care she needs

· If she gives her excess income to Medicaid each month she will struggle to afford her living expenses to stay in her home

How it Works?

1. Transfer/protect resources through planning solutions

2. Obtain determination of disability from DOH

3. Apply for Medicaid

4. Apply for a pooled trust

5. Deposit monthly surplus income (NAMI) into pooled trust

6. Medicaid covers the amount of care per assessed need

7. Funds in the pooled trust will pay for living and other expenses

*The order of these steps may vary

Obtain Determination of Disability:

· County DSS will ask for proof of disability to qualify for benefits

· Show proof with an award letter for wither SSDI or SSI benefits

· If the beneficiary does not receive these benefits or has not otherwise been deemed disabled, you will need to complete some forms and contact DSS for a disability determination

· Forms are available on www.health.ny.gov

Establishing a Pooled Trust:

· NYSARC Community Trusts already established and approved by Social Security Administration.

· Simply submit completed Joinder Agreement, Social Security documentation and initial funding

· Open with as little as $300 (includes $200 one-time enrollment fee

· Joinder Agreement creates sub-trust account and may be signed by individual, POA, Guardian, Parent/Grandparent

Account Approval:

Upon approval of Joinder Agreement and receipt of funds:

· Sub-trust account established

· Executed documents must be submitted by the beneficiary to local DSS office and/or provider(s)

· Trust sends “Welcome Binder” and follows up with introductory phone call

· Beneficiary and/or authorized contact can submit disbursement requests for distributions

Trust Administration:

· All disbursements must be for sole benefit of the trust Beneficiary

· Disbursements are paid directly to third parties (individuals or a licensed business)

· Disbursements must be substantiated by supporting documentation

· Electronic deposits and automated payments can automate the process

· Account terminates upon passing of the trust beneficiary

· No disbursements can be made after death in accordance with federal SSA POMS policy

Eligible Disbursements (non SSI):

· Rent/Mortgage/Property Tax

· Condo Maintenance

· Home/Renters Insurance

· Repairs/maintenance

· Utility bills

· Furniture

· Groceries for beneficiary

· Transportation/Vehicle expenses (owned by Beneficiary)

· Irrevocable pre-need funeral plan

· Uncovered Medical Expenses /OTC Items

· Entertainment/Recreation

· Other personal needs

Prohibited Disbursements:

· Cash to beneficiary or bank accounts

· Items for others (sole benefits)

· Capital improvements to property not owned by beneficiary

· Leases between spouses

· Leases with POA when POA signs as landlord and tenant

· Both rent and mortgage/property taxes, etc.

· Items covered by government benefits

· Alcohol, tobacco, firearms, illegal activity, bail, restitution

· Disbursements after death of Beneficiary

Reporting and Tracking Trust Activity:

· Account statements sent monthly- copies to family and services providers as requested

· Track trust activity 24/7 with Online Portal or automated phone line

· Verification of deposits automated to designated agencies upon request

· Full detailed activity history when requested by Medicaid/DSS

· Medicaid may require disbursement documentation, including receipts, invoices, etc.

· Trustee/Administrator handles Trust tax reporting

What happens if a Beneficiary enters a Nursing Home?

· If simply a Rehab period:

· Beneficiary will give monthly surplus to NH during rehab period

· Deposits to Trust restart after return home

· If permanent placement:

· Stop deposits and use balance until funds depleted

· Surplus income now goes to Medicaid to cover cost of NH

What happens once the Beneficiary passes?

· Sub-trust accounts terminate upon the death of the Beneficiary

· In accordance with Federal and State statutes, no disbursements may be made after passing

· Any remaining funds must be paid to the State that provided Medicaid services or retained by the trust to further the purpose of the trust

How NYSARC uses retained funds:

· Retained funds are used to support unfunded guardianship and recreational programs for people with disabilities at The ARC New York chapters across NYS

· Guardianship services support hundreds of people with intellectual and developmental disabilities who would otherwise have no legal guardian or advocate

Meeting Reminder!

The next Aging and Disability Network meeting will be held at St. Edward’s Church in Clifton Park, on Tuesday July 10^th from 2-330pm.

Sarah Szewczyk from NYSARC Trust Services will be presenting on pooled trusts as a way to help people with disabilities and seniors with disabling chronic conditions meet Medicaid’s income limits to qualify for community-based health benefits and long-term care services. This program helps people get the care they need at home while being able to pay bills that allow them to maintain independence in the community.

Introductions and Announcements: The next Aging and Disability Network meeting will be held at St. Edward’s Church in Clifton Park, on Tuesday July 10^th from 2-330pm. Sarah Szewczyk from NYSARC Trust Services will be presenting on pooled trusts as a way to help people with disabilities and seniors with disabling chronic conditions meet Medicaid’s income limits to qualify for community-based health benefits and long-term care services. This program helps people get the care they need at home while being able to pay bills that allow them to maintain independence in the community.

Two Save the Dates were given out – The New York State 2018 Lifespan Respite Sustainability Summit will be held on October 18th at the Hearst Media Center in Albany. This summit brings together policymakers, researchers, families and statewide partners to explore respite options, share knowledge and develop ways to come up with more funding.

From April 30^th-May 2^nd 2019, the National Lifespan Respite Conference will be hosted by the NYS Caregiving and respite Coalition and held in Buffalo, NY.

Today’s topic and presenter- Smart Seniors – Protecting Seniors from Scams and Frauds, presented by Michael Sprague of the NYS Office of the Attorney General.

Anatomy of a Scam

It can be fraud, physical abuse or financial embezzling, most crimes that take advantage of a person’s trust have the same components and most have roots in the basic scam or con.

Scam artists use a “hook.” Chances are good it will be one of these:

• Money or Greed Most of us look for a good deal or dream of sudden riches.

• Love or Good Will Good people want to help those they care about.

• Fear and Desperation Ironically, being afraid can make us less cautious, more open to the promise of a quick fix or unexpected cure.

Common Scams

Sweepstakes or Contests

Sometimes it’s a “Foreign Lottery” or a “Random Drawing” or “Millionth Customer” that entitles you to a cruise, money or new computer. The news might come over the phone, through the mail, or over the internet.

Common Components of the Sweepstakes Scam:

• A request for the “winner” to send a check or to wire money to cover taxes and fees. Sometimes the contest notification includes a check that the winner is to deposit; the winner is directed to send back a percentage of the money. Legitimate contests never ask for money upfront.

• A request for your banking information in order direct deposit your winnings. This is an attempt to steal your identity. They will wipe out your bank account.

• Using a name which sounds like a government agency or official-sounding authority. The name can be invented: like the “National Sweepstakes Bureau,” or “The National Consumer Protection Agency.” Neither of these exists. Sometimes they will use an actual name like the Federal Trade Commission. The scammers claim that the government “oversees” the integrity of foreign lotteries. They do not. This is a scam. Stay Safe, Take Control:

• Never wire money to someone you don’t know who contacts you; it’s the same as handing over cash.

• Never pay to collect prize money, whether they ask you to wire money, or send a check to “cover” the taxes or another form of payment. Legitimate lotteries and sweepstakes deduct the amount you owe the IRS from the winnings, and you will fill out multiple forms directly with the IRS.

• Don’t rely on Caller ID. Scammers use technology to make you believe a call is coming from your area or from Washington, DC.

• Be a friend. If you suspect a friend or family member is being scammed, try to talk to them about it. Some signs are stacks of “guaranteed winner” mail, packages containing jewelry, wristwatches or so-called “collectibles. “

Grandparent Scam

“Grandma, it’s me…please don’t tell Mom…” Typically, this scam comes in the form of an urgent phone call. The caller claims to be “your favorite grandson” or just says “it’s me”… prompting the grandparent to supply the needed name. While the emergencies vary, the scenario is usually this: the “grandson” is out of town and needs money fast -- to make bail, or to pay for automobile repairs or medical expenses. The caller begs the grandparent not to tell his parents. Just wire the needed money immediately. Scammers know that parents and grandparents fear a call that tells them their loved one is in trouble. Each year, thousands of Americans get caught in the Grandparent Scam. Increasingly, scammers use actual relatives’ names and information gleaned from social media and other internet sites. Don’t fall for it.

Stay Safe, Take Control

• Never wire money to anyone without verifying their identity.

• Don’t rely on recognizing a caller’s voice; verify that you know the person on the other end.

• Tell the caller to give you the name and contact information of the law enforcement agency, hospital or car repair shop they are dealing with, and verify that the story the caller told you is accurate.

• Before sending money, speak to your family to find out if someone is actually out of town and in need of assistance.

Home Improvement Scams

Home contracting schemes are frequently aimed at senior citizens, perhaps because they are home more often, are likely to own their own homes, and own homes that may need repair. Some common approaches are:

The Drive-Bys

The contractor “just passing by” is one of the most common scams. Sometimes they claim to have done work a couple blocks away and have leftover material. Other times they notice something wrong: a tree branch down or some siding loose. In some cases, they actually cause the damage before offering to do the repairs. These offers for quick, cheap repair usually result in low quality work such as watered down stain instead of paint, inferior shingles on only half the roof, or a thin smear of blacktop on the driveway. These scammers typically demand a payment upfront and, if they actually finish the job, it probably won’t last.

Free Inspection Scams

Weather proofing, new windows, chimneys: since keeping our homes weather tight is a high priority, scammers will often offer “free inspections.” They will almost always find a problem that needs an expensive solution: an expensive pump that needs to be installed; excavation work on the foundation to waterproof when cleaning the gutters would work; a new chimney; or new windows when some weather stripping would do the trick.

Stay Safe, Take Control

• Be suspicious about any unsolicited offer to work on your home. Remember, there is no problem so serious it can’t wait a day or two for you to do some research.

• Ask your friends and neighbors about who they would recommend. Remember, the best contractors are found by word of mouth.

• Check out the contractor with the local Better Business Bureau.

• Get references.

• Use local companies whose address you can verify

. • Avoid unlicensed contractors. Some counties and municipalities require contractors to be licensed.

• Get more than one written estimate, and make sure the estimates include details about the work and materials.

• Don’t let a contractor work without the necessary permits and insurance.

• Don’t assume the lowest estimate is the best deal. Check the quality of the materials.

• Get it in writing: a written contract is required by law for work costing more than $500.

• You have the right to cancel the contract until midnight of the third business day after the contract was signed. Cancellation must be in writing.

• Be clear that you won’t pay for any work or changes in the contract unless it’s agreed upon in writing.

• Never pay the full amount up front. Negotiate a payment schedule tied to progress on the job. Make sure the work is done according to the contract before you make the final payment.

• If possible, pay by credit card. Otherwise, pay by check. Never pay cash.

After The Storm Be especially alert following major weather events, like blizzards or floods. Scammers will take advantage of the number of people who need repairs.

“I’m doing work around the corner and have material left over. I can do yours for next to nothing.”

Dealing with Telemarketers

There are legitimate telemarketers and there are scammers, and there are some who fall in-between. The problem is that they all target people who are at home during the day and in the habit of answering their phones. It’s important to keep your guard up when answering the phone. Here are some things to remember:

• Don’t rely on caller ID to let you know who the call is coming from. Scammers often manipulate the caller ID to give you the impression that it is a local call, or from an “official” location, like Washington DC. Make sure you are familiar with the company or charity the caller is working for. If not, give yourself time to check it out before committing to a purchase or contribution.

• Never give out personal information to an unsolicited caller, that is, someone who initiates the contact with you. The information you should withhold includes your birthdate, social security number (even the last four digits), your mother’s maiden name, your first pet’s name or anything that might be used as a password or other identifier. You can never be sure if the caller really is who they say they are.

• You don’t have to commit to anything on the phone. Ask to see a proposal in writing, give yourself time to research or think about it. Go back to that anatomy of a scam: legitimate sales people will give you time to make a good decision.

Today’s topic and presenter- “How to Die the Right Way,” presented by Jane-Marie Schaeffer, Esq. of the Herzog Law Firm.

Today’s topic covered a variety of end of life plans as well as the reasons why we are not as eager to tackle this part of advance planning- too busy, too uncomfortable to think about, denial, etc…

Some terms and definitions:

Power of Attorney: The principle appoints an agent to manage financial affairs if principal becomes incapacitated.

If there is NO POA and principal becomes incapacitated, the court must be petitioned to appoint a guardian.

Health Care Proxy:

Allows you to appoint an agent to make health care decisions for you if you become incapacitated.

Living Will: This is a separate document that can be signed separately or with your health care proxy that gives your agent your wishes as to the end of life care (need 2 disinterested witnesses, and you don’t need a health care proxy to do this).

Disposition of remains Appointment: Allows you to appoint someone to be in charge of your funeral and burial arrangements. Can specify details of these arrangements as well.

Wills: Approximately 55% of American adults do NOT have a will.

Simple Wills: Provide for spouse and then kids.

-Execution requirements:

The capacity to sign (POA cannot sign for you).

2 adult disinterested witnesses.

Affidavit of subscribing witnesses

No handwritten changes or additions.

Intestacy Law- what if you die without a will? The laws of NYS govern who inherits your property.

If survived by spouse and kids, $50,000and ½ of estate go to spouse, the rest to kids.

If survived by spouse and no children, all to spouse. If survived by children and no spouse, all to children.

If no spouse or kids, then to parents, then siblings, then nieces and nephews.

Trusts:

Living trusts can be a valuable tool for people who want to keep their affairs private, avoid probate, disinherit a family member or protect assets. It is more difficult to challenge a trust than a will.

Revocable trusts: Grantor- the one who creates and funds the trust.

Trustee: person in charge of the trust.

Beneficiary: person who receives the asses of the trust.

Revocable Living Trusts:

-Avoid probate

-Private

-In the event of your disability, the Successor Trustee takes over and manages your trust

Irrevocable Trusts

-Can be used to protect your assets and pass them to your children, if you plan far enough in advance.

-Most commonly used to protect your assets for Medicaid purposes.

Life Insurance Trusts

-Hold life insurance on your life and pass the benefits to your heirs when you die.

-Can be used to keep funds in trust for minors or disabled beneficiaries.

Supplemental Needs Trusts

-Allows you to leave assets to a beneficiary who is disabled and receiving government benefits.

-Assets in trusts are protected, and will not cause beneficiary to lose government benefits.

-Trust assets can be used to supplement needs of beneficiary.

How do I Plan for Long Term Care?

3 questions – Where do you want to receive care? Who will provide it? How will you pay for it?

Long Term Care Costs:

Home Care-

-unpaid home care- spouse, children, family, friends.

Paid home care- average cost $24/hour. Cost will vary, depending on how many hours you need.

Assisted Living-

-costs range from $4000-$7000 per month.

Nursing Home-

Average cost is $12,000-13,000 per month.

Funding Sources for Long Term Care-

-Medicare

-Private Pay

-Long Term Care Insurance

-Medicaid

Medicaid Income and Asset Limits:

Income and Asset limits for 2018

Individual Community Spouse

Income $50. $3,090.

Assets $15,150. $123,600.

Exempt Assets

-Principle residence

-Burial Plot

-Pre-paid irrevocable burial contract

-Life Insurance Policy with a face value up to $1500.

-One automobile

-Retirement Accounts in periodic payment status.

Transfer of Assets

-there is a 5 year lookback period for transfers of assets for a nursing home application.

-any transfers for no consideration-gifts-are counted.

-A penalty period is calculated based on the amount of transfers during the lookback period.

-during the penalty period you are ineligible for Medicaid benefits for nursing home.

Community Medicaid

-There is no lookback period when you apply for Community Medicaid.

-You can transfer assets to a trust this month, and then apply for Community Medicaid next month with no penalty.

October 9 at Saratoga Springs United Methodist Church - The program “What is a Service Dog and what is NOT” will be presented by Cheryl Lawyer, Outreach & Community Education Coordinator from the Northeastern Association of the Blind at Albany (NABA). “With all the media coverage about animals claiming to be service dogs or emotional support animals, there is a lot of confusion about the differences, their rights to public access, the services they provide as well the abuse by owners illegally passing their pets off as such.). As a long-time puppy raiser/trainer for pups bred to be guide dogs and her work with individuals with service dogs, Ms. Lawyer will present the differences between service, therapy and emotional support animals. The Americans with Disabilities Act (ADA) has special laws governing service animals and many states are making it a crime to fraudulently present a pet as a service animal. Attendees will learn how to tell the difference and what questions to ask (or not) when encountering what appears to be a service animal.”

Today’s presenter and topic- Sarah Legnard, presenting information from New York Senior Medicare Patrol- their mission, and facts we need to know to help prevent Medicare fraud.

The New York Senior Medicare Patrol (SMP) is part of a nationwide education and assistance program working to empower seniors and caregivers to prevent, detect, and report Medicare fraud and waste. You can report suspected problems to SMP. Our staff and trained volunteers work to correct errors and report abuse of the Medicare system to government authorities.

The NY Senior Medicare Patrol advises you to Protect, Detect, and Report...

Protect your personal information to shield yourself from identity theft and financial scams. Guard your Medicare card and Social Security card just like your checkbook and credit cards. Don’t carry them with you unless you expect to need them that day. Identity theft can lead to Medicare fraud.

Detect mistakes or potential fraud in Medicare payments by tracking your medical services in a Personal Health Care Journal and look for:

Something billed twice
A service you did not receive
A medical provider you didn’t see or wasn’t involved in your care

Most Medicare audits are done after payment is made to the medical provider. By reading your Medicare Summary Notice you are in the best position to identify and report errors early. Report by asking your doctor, clinic or hospital to explain the Medicare payment showing on your Medicare Summary Notice. Don’t be shy to ask; you pay for your Medicare coverage and you want the payments to be right! If you aren’t satisfied with the assistance you receive, contact the SMP hotline at 1-877-678-4697.

Starting in April 2018 through April 2019, Medicare recipients will be receiving new Medicare cards! The new cards will NOT have social security numbers on them! All benefits will remain the same and the change will be automatic. However, this rollout will take at least a year, and people will receive their cards at different times.

SCAM ALERT: Scammers posing as Medicare reps will call asking for your current Medicare number and offer to send you a new card. NEVER give your information to anyone over the phone- Medicare will never call you.

The next Aging and Disability Network Meeting will be held on Tuesday 3/13/18 from 2-330pm at the at Saratoga Springs United Methodist Church, 175 Fifth Avenue, Saratoga Springs. Theresa Alger from Young Living Essential Oils will speak on the benefits of essential oils.

Today’s Presenter and Topic: Michael Prezioso, PH. D., Director of the Saratoga County Mental Health Center. This presentation is an overview of the programs offered under the umbrella of the mental health center.

The mission of Saratoga County Mental Health Center is to provide outpatient mental health and alcohol/drug treatment services that are accessible and responsive to the needs of persons suffering from mental illness and/or alcohol/drug problems, their families, and the community. These services will assist them in living, whenever possible within the community in ways that are acceptable to the community and that are personally satisfying and productive. Services are provided regardless of age, race, color, sex, marital status, ethnicity, national origin, creed, or sexual orientation.

Goals:

To provide treatment for individuals suffering from serious mental illness and alcohol/drug abuse;
To protect both the public and individuals from the manifestations and consequences of mental illness and from the impairments related to alcohol/drug abuse;
To be responsible stewards of limited public resources.

Mental Health Clinic: The Saratoga County Mental Health Clinic provides outpatient treatment designed to reduce symptoms of mental illness and emotional disturbance, to improve daily functioning, and to provide ongoing support. Services includes emergency and crisis intervention, screening and referral, individual, family, and group counseling, medication education and management, and symptom management. In addition to the main clinic in Saratoga Springs, the Clinic maintains a satellite in Mechanicville.

Youth Services provides treatment for emotionally and behaviorally disturbed children and adolescents up to the age of eighteen, who, together with their parents, often require intensive interventions. Youth Services provides community-oriented consultative activities in conjunction with community-based interventions.

Adult Services provides treatment for mentally ill adults, particularly those who are seriously and persistently mentally ill. For the seriously and persistently mentally ill, a long-term disease management approach to medication management and supportive therapy is utilized.

We can refer to Mobile Crisis, and have 24-7 on-call for emergencies as well.

Personalized Recovery Oriented Services: Saratoga County PROS operating as Reflections PROS (Personalized Recovery Oriented Service) is a comprehensive, individualized, recovery based program that offers rehabilitation, support, and treatment services under one roof. Reflections PROS serves adults (over 18) with a mental illness diagnosis who have a functional disability that interferes with their ability to live a fulfilling life. The purpose of PROS is to help participants take control of their own lives by teaching the skills necessary to overcome the mental, emotional, behavioral, and social barriers resulting from mental illness and addiction and to effectively negotiate life’s challenges. PROS services are person-centered and include group and individual sessions, medication management, health screenings, family education and support, as well as vocational services and supports for participants who are interested in obtaining and maintaining competitive employment in the community.

Alcohol and Drug Program: Saratoga County Alcohol and Substance Abuse Services is a medically supervised outpatient program providing treatment for individuals suffering from an alcohol and/or drug program and for family members trying to cope with the presence of alcohol or drug problems within the family. Treatment is designed to promote abstinence, to improve community integration, and to improve daily functions. Services include: Screening, referral, assessment, and individual and group counseling.

Today’s Topic and Presenter: Overview of the Albany Med Center for Excellence in Alzheimer’s Disease (CEAD), presented by Mary Moller, MSW, CAS, Program Specialist.

The Alzheimer's Center at Albany Med, established in 2002, provides diagnostic services and treatment, participates in national clinical research studies, and offers resources through the Anne B. and Leon J. Goldberg Alzheimer's Resource Program to thousands of patients and their families.

Currently there are over 48 million people living with dementia globally. This number will increase by 281% in 2050, to over 131 million.

Currently in NYS 390,000 individuals living with AD, will grow to 460,000 by 2025.

In 2015, NYS response was the implementation of a $25 million Alzheimer’s Disease Support Initiative, the first of its kind in the nation to support people with AD and their care partners.

CEAD Services:

Interdisciplinary and comprehensive medical services for the diagnosis of AD/D (Alzheimer’s disease and other dementias).

Coordinated treatment and care management for individuals living with AD/D.

The interdisciplinary team is available to assist providers, practitioners and community partners.

Provide public awareness of AD/D for the importance of early screening and diagnosis

Provide diagnosis and assessment support services for patients (ones that are complicated), become a partner in providing care in local communities.

Social Work staff can assist case managers with case management functions, linkages to resources

Education and training

Expert training for the detection, diagnosis, treatment and management of AD/HD

This training is available to:

· Physicians

· Healthcare professionals

· Allied health professionals

· Community providers

· Students

Types of Dementia:

Vascular dementia

•Dementia with Lewy Bodies (LBD)

•Mixed Dementia

•Parkinson's Disease

•Frontotemporal Dementia (FTD)

Potentially Preventable

Cerebrovascular dementia (multi-infarct)

Lewy body dementias (LBD) - are the second most common form of degenerative dementia

• LBD can have three common presentations:

• Movement disorders :

• Tremors, stiffness, slowness and difficulty walking

• Cognitive/memory disorder:

• Fluctuations in cognition, attention or alertness

• Impaired thinking, such as loss of executive function (planning, processing information), memory, or the ability to understand visual information

• Neuropsychiatric symptoms:

• Visual hallucinations (seeing things that are not present)

Fronto-temporal Degeneration (FTD) –

• Onset of FTD often occurs in a person’s 50’s and 60’s

• Affects behavior/personality changes, language difficulty, and motor change

• Memory usually relatively preserved

• Difficulty to plan or organize activities, behave appropriately in social or work settings, interact with others, and care for oneself, resulting in increasing dependency on caregivers.

• Symptoms can be misinterpreted as depression, anxiety or normal aging

• Diagnosis is often delayed

• Importance of proper evaluation

Vascular Dementia:

• Vascular dementia is a decline in thinking skills caused by conditions that block or reduce blood flow to the brain, depriving brain cells of vital oxygen and nutrients.

• Formerly called multi-infarct dementia because it was thought to only be caused by small strokes

• Vascular dementia often occurs alongside AD, resulting in mixed dementia

• Risk factors for Vascular Dementia include heart attack, stroke, high blood pressure, diabetes and high cholesterol

Benefits of early diagnosis for family members and care partners:

• Can increase opportunities to learn about the patient’s current and upcoming symptoms, deficits, challenges, behavioral changes and safety issues associated with disease progression

• Contributes to better informed decision making regarding optimal in home care and long-term placement options

Benefits early detection and diagnosis for the patients:

• Gives patients an opportunity to better understand their diagnosis and what to expect

• Allows patients the ability to make choices about treatment options including potential access to the latest experimental treatments and clinical trials

• Gives patients more time to make future plans regarding employment, financial and legal arrangements, healthcare directives and long-term planning before cognition further declines.
