Três afirmam ainda ter sido molestadas após sedação.</div> <div style="border: 0px; padding: 0px; vertical-align: baseline;"> Em agosto de 2008, Abdelmassih foi intimado pelo Ministério Público a depor, mas não compareceu. Mesmo assim, o órgão ofereceu denúncia à Justiça, recusada porque a juíza Kenarik Boujikian entendeu que a investigação é atribuição exclusiva da polícia.</div> <div style="border: 0px; padding: 0px; vertical-align: baseline;"> Um inquérito foi aberto pela polícia, mas desapareceu do Departamento de Inquéritos Policiais em novembro de 2008. Na época, a defesa de Abdelmassih afirmou que ele teve seu direito de defesa cerceado, e que a Polícia Civil descumpriu a determinação do Supremo. O médico afirmou que vinha sendo atacado por cerca de dois anos por um 'movimento de ressentimentos vingativos'. Abdelmassih também chegou a afirmar que as mulheres que o acusam podem ter sofrido alucinações provocadas pelo anestésico propofol, usado durante o tratamento de fertilização in vitro. De acordo com ele, as pacientes podem 'acordar e imaginar coisas'. Segundo sua defesa, o médico nunca ficava sozinho com suas pacientes na clínica, estando sempre acompanhado por uma enfermeira. Apesar da condenação, em novembro de 2010, o ex-médico não foi preso imediatamente em virtude de um habeas corpus concedido pelo então presidente do Supremo Tribunal Federal (STF) Gilmar Mendes, em 2009. Em fevereiro de 2011, porém, o habeas corpus foi cassado pelo próprio STF. Em janeiro de 2011, uma nova prisão foi decretada pela 16ª Vara Criminal da Capital, baseada na solicitação de renovação do passaporte do próprio médico, o que configurava risco de fuga. Ele, no entanto, conseguiu fugir do país e passou a constar na lista de criminosos procurados pela Organização Internacional de Polícia Criminal (Interpol).
