LESSONS FROM OUR EXPERIENCES

Postal Trade Union movement has always been in the forefront of the struggle against the anti-labour and anti-people policies of the ruling class. During the Britishraj it fought many a battle against imperialism and for the freedom of our great nation. Many Postal leaders and workers sacrificed their entire life for the nation and for the workers. Right from freedom struggle, the Postal trade union movement has been a part and parcel of the progressive forces of our country and always solidly stood with the mainstream of the working class upholding the traditions of progressive, democratic, socialist and secular forces and also for the principles enshrined in the Constitution of India. We are proud that NFPE still keep up this tradition.

After Independence we have been fighting for the cause of the working class in general and Postal employees in particular. In that saga of struggle many of our comrades lost their lives, many dismissed from service and severely punished for participating in strikes against the policies of the Government. We learn lessons from our past experiences and move forward uniting the entire postal employees including Departmental employees, Gramin Dak Sevaks and Casual, Part-time, Contingent and Contract workers. We always fought for changing the policies of the Government and are still in the battle field.

All of us are aware that unless and until we succeed in our attempt to change or defeat the neo-liberal globalisation policies of the ruling class, the future of the Central Government Employees including five lakhs postal employees will be in danger and ultimately the private sector may take over major portion of the service sector and Government functions, just as it happened in Telecom sector.

It is a fact that we have defeated the attempt of the Government to close down 9797 Post offices and about 300 RMS offices by putting up stiff resistance under the banner of Joint Council of Action. We succeeded in compelling the Government to lift the ban on recruitment and to fill up all the direct recruitment vacancies and promotional quota vacancies. But we should not forget that the policy of downsizing, outsourcing, contractorisation and privatisation is still hanging as a democles sword over our head. The draft bill for amendment to the Indian Post Office Act to grant licence to the multi-national private couriers is still kept pending and not dropped. Our demand for inclusion of Gramin Dak Sevaks under the purview of Seventh Central Pay Commission is not accepted, though the recognised GDS Union leader has signed an agreement with the Department of Posts accepting separate committee for GDS thereby admitting that GDS are not Government employees (Civil Servants). Our demand for DA merger, Interim Relief etc. are also pending. Revision of wages of casual labour is long overdone. The New Pension Scheme introduced by NDA Government and legalised by UPA Government has snatched away the right for statutory pension to those employed on or after 01-01-2004.

When it comes to the question of implementation of imperial neo-liberal globalisation policies, those supporting the capitalist class join together to protect their class interest. Our past experience has taught us that change of Government alone cannot change the plight of the working class and common people and it is the change of policies that matter. We believe that only those forces which oppose the anti-labour, anti-people neo-liberal imperialist gloablisation policies can safeguard the interest of the working class and the common people of our country. Let us strengthen those progressive, democratic and secular forces and strive hard for a better tomorrow along with the manstream of the working class.

Department of Posts issued orders to keep in abeyance the orders on abolition of posts for the years 2005, 2006, 2007 & 2008.

The All India Unions of AIPEU Postman & MSE/Gr.D, AIPEU GDS (NFPE) & NUPE P-IV filed a case in Principle CAT, Delhi (during May 2012) praying not to abolish the vacant posts (DR) of Postman & Gr.D (MTS) of the years 2005, 2006, 2007 & 2008. The Pr. CAT issued stay orders (in OA No.1736/2013) on the issue and now the Department of Posts issued orders to all Chief Postmasters General to keep the orders in abeyance on abolition of posts in the circles.

WE ARE ON THE STRUGGLE PATH

By the time this issue of “Postal Crusader” reaches your hand, an eventful year 2013 will be over and a new year 2014 is born. From our experience in the past, especially during the last year, we can definitely say that the year 2014 shall be an year of struggle for betterment of the living conditions of the common people of our country and the toiling masses including the Central Government Employees & Postal employees.

General election to the Parliament is scheduled to be held in the year 2014. The ruling class and also the corporate media have started their campaign, well in advance, in support of those who are ready to carry forward the rigorous implementation of neo-liberal globalisation policies. We have witnessed that when it comes to policy of liberalisation, privatisation and globalisation, both UPA and NDA Government are two sides of the same coin. Concerted efforts are being made by the corporate media to relegate the issues raised by the working class in February 20,21 All India Joint Strike and 2013 December 12th massive Parliament March to the background. We should identify our friends and foes from our own experience and shall frontload the working class issues and conduct intensive campaign against those who are in favour of neo-liberal policies and also in support of those who are opposing the anti-people, anti-labour policies of the ruling class. Remember, in democracy ballot is more powerful than bullet. Let us use this weapon prudently and discreetly and move forward in our struggle by further strengthening those forces who are continuously fighting against this neo-liberal policies and for the cause of working class.

Eventhough the Government has announced constitution of 7th Central Pay Commission (CPC), the terms of reference and appointment of chairperson etc. are yet to be finalised. The unanimous proposal on terms of reference submitted by the staff side includes date of effect from 01-01-2014, DA merger, Interim relief, inclusion of GDS, statutory pension to those employed after 01-01-2004, minimum wage as per 15th ILC formula, settlement of anomalies and cashless, hassle free medical facilities. Now the ball is in the court of Government. In case the Government deliberately delay the appointment of CPC or reject the terms of reference submitted by the staff side, confrontation shall become inevitable.

Postal employees have put up stiffest resistance to the Government’s policy, to privatise the Postal sesrvices by amending Indian Postoffice Act 1898 for granting licence to private couriers, to close down 9797 departmental post offices, to merge about 300 RMS sorting offices and also to continue the ban on recruitment. Postal department is the only department where mass-scale recruitment and promotion through departmental examinations has taken place. The united struggle under the banner of JCA has prevented the Government to a great extent from implementing the neo-liberal policies in the Postal Sector.

Regarding 7th CPC, Postal employees have every right to get a better deal from Pay Commission and Government. The pay scales of each category of Postal and RMS employees including Gramin Dak Sevaks should be upgraded taking into consideration the fact that the cadre of PA, SA, Postmen, Mail guard, MTS exchanging mails and clearing letter boxes, Gramin Dak Sevaks are all unique to the Postal Department. Further IT modernisation project will be rolled out in full swing in 2014 and the skill of the postal employees including GDS in dealing with high technology will be further enhanced. Due to non-creation of additional posts in commensurate with the increase in workload due to introduction of new schemes and procedures and also due to abnormal delay in filling up of vacant posts, the workload of the Postal and RMS employees have increased manifold and this factor of extra-productivity should be taken into account while deciding the pay scales of postal and RMS employees including GDS.

Three lakhs Gramin Dak Sevaks and Casual, Part-time, Contingent employees are the worst sufferers of the Postal department. NFPE & FNPO has already decided to go for indefinite strike, if the Government rejects our demand for inclusion of GDS in the ambit of 7th CPC and revision of wages and regularisation of casual labourers.

NFPE & AIPEU-GDS (NFPE) had filed a writ petition in the Hon’ble Supreme Court of India praying for implementation of the 1977 Supreme Court judgement declaring GDS as civil servants and grant of all benefits of departmental employees to GDS. The Hon’ble Supreme Court has ordered the Delhi High Court to consider and decide the case and the writ petition is accordingly transferred to Delhi High Court. Thus the final legal battle for departmentalisation of GDS has begun and 2014 will be a turning point in the history of GDS

In short, 2014 is going to be an year of struggle and advancement of the working class of India and also the Central Government employees including Postal, RMS & GDS employees. Let us welcome the new year with a pledge to continue our fight for a better tomorrow.

7^th CPC – NO COMPROMISE ON TERMS OF REFERENCE

GET READY FOR STRIKE IF GOVERNMENT REJECTS DA MERGER,

GDS INCLUSION & INTERIM RELIEF

Eventhough Government has announced constitution of 7^th Central Pay Commission, the appointment is yet to take place. In the meanwhile one round of discussion was held with Secretary, DOP&T on terms of reference. Subsequently, the staff side, JCM National Council has submitted a unanimous proposal on the items to be included in the terms of reference of the 7^th CPC, which includes (i) date of effect as 01.01.2014 (2) merger of DA with pay (3) grant of interim relief (4) inclusion of GDS under the ambit of 7^th CPC (5) statutory pension for those entered into service on or after 01.01.2004 (6) settlement of anomalies of 6^th CPC (7) cashless/hassle-free medicare facilities etc.

Government while announcing the 7^th CPC has made it clear that the date of effect will be 01.01.2016. Further nothing has been mentioned about DA merger and interim relief. Regarding GDS the declared stand of the Government is that GDS are not civil servants and in the past also every time when CPC is appointed, the Government refused to include them in the Pay commission. Last time also inspite of the strong protest and agitational programmes conducted by NFPE and Postal JCA, the Government has appointed a bureaucratic committee. Regarding statutory pension to those who entered into service on or after 01.01.2004, the Government’s stand is well known and it may refuse to include this item also in the terms of reference.

This being the position, our past experience shows that unless and until the demands raised in the staff side proposal submitted to Government on terms of reference of the CPC is backed by serious agitational programmes, rallying the entire Central Government Employees and create compulsion on the Government to accept our justified stand, there is every possibility of Government rejecting the above proposal.

Further all of us are aware that the political situation in the country is gradually getting in election mode. This is bringing forth before the working class movement a crucial task of front-loading our class issues in the ensuring political battle. We have to keep in mind that the corporate class and corporate controlled media has started making effort for relegating the working class issues and the economic policy related issues in particular to the background. It is our duty to bring the demands of the working class to the fore-front and conduct intensive campaign against those policies and also against those who are supporting the neo-liberal globalization policies. Confederation of Central Government Employees & Workers and NFPE being the part and parcel of the mainstream of the working class of our country has got an added responsibility to rally the entire Central Government Employees in the struggle against the anti-people and anti-worker policies of the Government which shall ultimately lead to a change in the political equation ensuring implementation of pro-people, pro-worker alternative policy.

It is in this back the National Secretariat of the Confederation of Central Government Employees & Workers met at new Delhi on 28.11.2013 has decided to go for strike if the Government refuse to accept the staff side proposal on terms of reference. Confederation further decided to organize series of phased programme of action and campaign from now onwards so that the employees will be ready to go for strike on short notice.

NFPE call upon all the Postal, RMS and GDS employees to implement the call of the Confederation at all levels and be prepared to go for strike at any time, if situation warrants. We further make it clear that NFPE and Confederation will not go for any compromise on the demands raised in the proposal submitted by the JCM Staff side on terms of reference of 7^th CPC.

IMPLEMENT 1977 SUPREME COURT JUDGMENT

WRIT PETITION IN THE

HON’BLE SUPREME COURT OF INDIA

NFPE & AIPEU-GDS (NFPE) has filed a Writ Petition (Civil) No. 1003 of 2013 in the Hon’ble Supreme Court. The Writ Petition is likely to be listed for “ADMISSION HEARING” before the Hon’ble Supreme Court of India on 13.12.2013 or any day thereafter. Our main submission before the Hon’ble Supreme Court is implementation of the 1977 Judgment and grant of Civil Servant status and all other benefits of Departmental Employees to Gramin Dak Sewaks as per the 1977 judgment. Let us hope that the Writ Petition will be admitted.

REPORT ON 2^ND NATIONAL WOMEN’S CONVENTION

OF CONFEDERATION OF CENTRAL GOVERNMENT EMPLOYEES & WORKERS

2^nd National Women’s Convention of Confederation of Central Government Employees & Workers was held from 25^th November, 2013 to 26^th November, 2013 at Multi purpose hall, Civic Centre, New Delhi. Pro. Usta Patnaik, Professor Emeritus, Jawaharlal Nehru University inaugurated the Convention. Com. Amarajit Kaur, Secretary, AITUC delivered the key-note address. The inaugural Session is presided by Com. Gita Ghosal, Chairperson of the Women’s Committee. Com. C. P. Shobhana, Convenor of Women’s Committee, Com. S.K. Vyasji, Advisor, Confederation of Central Government Employees And Workers, Com. KKN Kutty, President of CCGEW and Com. M. Krishnan, Secretary General, CCGEW were on the Dias. The Convention commenced with progressive songs by West Bengal delegates. Chairperson announced the constitution of the Credential Committee consisting of Com. Seetha Lakshmi (NFPE), Com. Manisha Mazumdar (Printing & Stationery) Com. Jyothi Samal (Atomic Energy) Com. Jaitha (Audit & Accounts), Com. Nirmala (ITEF) and also the Minutes Committee consisting of Com. Mausumi Majumdar (NFPE) and Com. Laxmi Swaminathan (Civil Accounts).

Prof. Usta Patnaik, in her inaugural address provided a bird’s eye view of the economic model designed by the neo-liberal policies and the resultant misery heaped on the mass of Indian population. In her classic presentation she demolished the arguments of some economists, who glorified the benefits of neo-liberal policies, by quoting the statistics from the database of the National Sample Survey. Undoubtedly top 25% of Indian population enjoyed the goodies as enjoyed by their counterparts in USA and Europe due to the EMI (equated monthly instalments). This is one of the rosy pictures the hegemonists of neo-economic policy present in support of this economic model. If income distribution is analyzed, it will be clear, that majority of the population is exploited for the benefit of the miniscule. The mass of the rural and urban population is pushed to malnutrition. The required calories per day in the rural areas and urban areas are 2200 and 2100 respectively. But the 90% of people living in urban areas are sustaining with below 1800 calories. Compared to the year 1983 the mass of the population is cutting down their food intake of their families and diverting their incomes to meet the raising cost of health, education and transport. This reflects the disgraceful state of affairs even after more than 60 years of Independence. The women employees working in garment factories in the Export Zones are being exploited to the hilt. The daily targets of work are high and hence, the women employees are forced to work for more than 10 hours per day to complete the targets. The toilet break is only for 10 minutes. Frequently drinking of water is not allowed so that no more toilet breaks. No identity cards are given, so that no one establishes the permanency of the job. All these woes came out in a public hearing of women employees who work in garment export zones of Tamilnadu. Agrarian crisis is compounded since the implementation of these neo-liberal economic policies. Compared to the years 2004-05 the economic growth by the year 2009-10 collapsed. Unemployment is in raise. The FRBM Act (Fiscal Responsibility and Budget Management Act) introduced in the year 2003 at the behest of World Bank led to the cut in Governmental expenditure. It is estimated that every Rs.100 less spent by Government will result in Rs.500 less in the income of the people. That means the budgetary support will spurt the economic growth. This was killed by FRBM. Agrarian crisis worsened due to non-availability of easy credit for agriculture. Even the nationalized banks replicated the US model of easy credit to buy the consumer goods. Thus the consumer credit is pushed. It aggravated the crisis. All these policies directly or indirectly affected the common people of rural and urban areas including the women. Prof. Usta Patnaik called upon all the women employees to realize these aspects and fight to stop these policies.

With her fiery and powerful keynote address Com. Amarjit Kaur, Secretary, AITUC made a strong case for more and more participation of women employees in Trade Union activities. Taking the cue from Prof. Usta Patnaik speech, she reminded the participants of the Convention of their role as a privileged class in emancipation of the drudgery of large mass of women employees working in unorganized sectors. The women and children working in the slate-manufacturing units of Andhra Pradesh and Uttar Pradesh are deprived of their basic necessities of life. The children are driven out of schools in search of daily lively hood for the family. The silicosis disease engulfed the prime age of the people of these regions. No health-care for them. No permanent employment for them. The plight of women workers in the Export Zones of Fisheries is horrible. Continuous and untimely work in the saline and cold seawaters has even disturbed the biological order. These contract workers have no rights and even attempt to unionize will not be spared. The women employees working in many such sectors have no maternity leave, not to think of Child Care leave. The crisis in agrarian sector pushed the life of rural population below animal state of living. The “gobar anaj” the grain collected from the dung of the animals for human consumption in areas like Bundhelkhand is the reflection of the shattered Indian economy under the neo-liberal policies of the Rulers. The entire Working Class, keeping the banner inhibitions aside, came together and is waging a battle to defeat these policies. The Women has inherited a rich tradition of fighting spirit from the First Independent battle fought by Rani Jhansi and from the Indian freedom movement. They should assert their role and fight not only for their rights but also fight for the under privileged. Com. Amarjit Kaur exhorted the women employees to take this challenge. She advised the women employees to strengthen the unions and work in the unions. She suggested to organize the women employees by conducting exclusive trade union classes to equip them with the knowledge of the various legislations enacted to safe guard the women employees.

Com. S.K. Vyasji, the Advisor of the CCGEW also opined that the women employees should have the knowledge of all the Acts to defend them selves against the harassment in work places. The grievance cell formation for women in each establishment should be insisted. The unity among the employees is important to fight out the harassment of women employees. He wished the Convention a great success.

Com. KKN Kutty, President, CCGEW has extensively spoken on the charter of demands including the wage revision and merger of D.A. He delved on the situation after the announcement of constitution of 7^th Central Pay Commission. Com. KKN gave a Clarion call to all women employees to unite and participate in the future struggles under the banner of CCGEW to realize the Charter of Demands.

Com. Shobana, Convenor, Women’s Committee submitted her report. She told that the Confederation is a strong organization representing the 13 lakh Central Government employees. The restrictions imposed on the grant of CCL are removed to some extent because of the efforts CCGEW. Whatever achievement so far made is possible because of the united struggles waged under the banner of CCGEW. She narrated how the GDS, Casual and Contract workers in the Postal Department are discriminated. The decisions taken in the first Women’s Convention held at Kolkata have been implemented. She requested all the women employees to participate in large number in the ensuing March to Parliament at Delhi on 12-12-2013 and also in all the campaign and struggle programmes of Confederation.

Com. K. P. Rajagopal, Secretary General, Income Tax Employees Federation, Com. M.S.Raja, Secretary General, All India Audit & Accounts Association , Com. I.S.Dabas, Deputy Secretary General, NFPE, Com. Brigu, Secretary General, Civil Accounts Employees Association, greeted the Convention.

About 117 women delegates representing various Organisations from the nook and corner of the country participated in the Convention. The remarkable feature of this 2^nd Convention as observed by Com. S.K.Vyasji, is that the women representatives have become more vocal and assertive. In the discussions more than 20 delegated participated and given their suggestions and brought the problems to the notice of the leadership. Removal of age restriction of the children under CCL, extension of CCL on remarriage, grant of CCL to look after the grand children, providing basic amenities at the work place, problems of casual, contract and out-sourced women employees, attacks on women employees in West Bengal, enhancement of minimum age of employment, inclusion of two women representatives from casual and contract workers in the mahila committee, posting women in day shifts, apart from the policy demands of reservation for women in all All India Committees, holding of periodical meetings of the Mahila Sub-Committee are some of the issues raised by the women delegates. Many Women delegates emphasized the need for strengthening the unions and need for inculcation of union spirit among the women employees.

Karnataka Women delegates led by Com. Chandramma Linga Raju, AIPAEA, honoured Com. S.K. Vyasji over a standing ovation given by the entire delegates and guests present in the Convention.

Com. M. Krishnan, Secretary General, CCGEW, summed up the entire proceedings and told that the aim of formation of Mahila sub committee is to encourage the more and more women employees to participate in the decision making process. The Chairperson and the Convener of the Mahila Sub-Committee are members of the National Executive of the Confederation and they are part of decision-making body. He assured that in the coming days more and more women members will be included in the Executive Committees of All India Organisations. He touched all the issues raised in the discussion by the delegates and assured that each and every problem and demand raised by the delegates will be discussed in the Confederation and a separate Women Charter of Demands will be prepared along with the Memorandum to be submitted to the Government and 7^th CPC. This Charter and Memorandum will be circulated and published on all the web sites of all organisations and will be given wide publicity and a feedback will be obtained before finalization. He thanked the Delhi CoC for the excellent arrangements made to conduct the Convention in a very good environment.

The new panel for the Mahila sub-Committee has been elected unanimously. Com. Usha Bonepalli, ITEF, Andhra Pradesh has been elected Chairperson and Com. Seetha Laksmi, NFPE, Karnataka, has been elected Convener.

The 2^nd National Convention of Women ended successfully with a resolve to work for the strengthening of the Confederation and mobilize the entirety of women employees in the future activities of the Confederation. The confidence and strong determination generated among the women comrades will go a long way for the success of all the future struggles.

NFPE DIAMOND JUBILEE CELEBRATION-INAUGURAL CEREMONEY

  NFPE Diamond Jubilee Celebration inaugural ceremony was held at M.P. Club , North Avenue , New Delhi on 24.11.2013 from 04 PM under Presidentship of Com. T. Satyanarayana Vice President and Com. Giri Raj Singh President , NFPE respectively .
The Programme commenced with the Welcome speech of Com. R.N. Parashar, ASG, NFPE. He welcomed all the leaders, Guests and participants on behalf of NFPEHQ. Dr. Prabhat Patnaik eminent Economist and Professor, Jawahar Lal University, New Delhi inaugurated the ceremony. In his inaugural speech he appreciated the role of NFPTE and NFPE in the history of Trade Union movement of India. He elaborately described the adverse impact of neoliberal economic policies on the working class and common man of the country. He clearly stated that the wrong policies pursued by the Govt. of India are responsible for the miserable life of common man. He also suggested ways and means to improve the economic condition of the country.

            After inaugural speech of Dr. Prabhat Patnaik Com. S.K. Vyas, Patron, Confederation and living legend of trade union movement of India released the emblem of Diamond Jubilee celebrations of National Federation of Postal Employees. He also addressed the meeting and elaborately described the role of NFPTE in formation of Confederation and building united platform of struggle of the working class. Com. KKN Kutty , President Confederation , Com. V.A.N. Namboodri, President , BSNL Emp. Union, Com. M.S. Raja, Working President, Confederation and Secretary General of All India Audit and Acctts Association, Com. P. Abhimanyu, General Secretary, BSNL Emp. Union, Com. K.P. Rajgopal, Secretary General, Income Tax Employees Federation, Com. Vrigu Bhattacharjee, Secretary General , Civil Accounts Assn , Com. A.K. Secretary General NFPE & General Secretary P-IV, addressed the meeting and thrown light on the glorious history of NFPTE and NFPE thereafter .

Com. M. Krishnan elaborately described the role and sacrifices given by legendry leaders like, Babu Tarapada Mukherjee, Dada Ghosh, Com. K.G. Bose,Com. B.G. Dalvi Com. K. Adinaraya, Com. N.J. Aiyar, Com. O.P. Gupta and Com. K.L. Moza in building the NFPTE and NFPE into a class oriented militant organization which is consistently fighting for the cause of working class He described many successes achieved by the NFPTE and NFPE thereafter for the welfare of Postal Employees and he also stated that this organization has always been on the forefront of struggle for the protection of interests of Postal Workers in particular and entire working class in General.

Delhi State Conference: The State Conference of Postal & RMS Pensioners Conference is just conducted on 19^th September, 2013 in New Delhi in a very grand manner. A panel of Comrades with Comrades Rajendra Prasad as President; N.K.Vashist as State Secretary; Sankarpal Singh as Deputy State Secretary; and Satyaprakash as Treasurer was unanimously elected.

Tamilnadu State Conference: A Steering Committee consisting of 23 Members with Comrade K.Ragavendran as its Convenor has been formed to conduct the State Conference of All India Postal & RMS Pensioners Association for Tamilnadu State. The State Conference will be held on 22^ndDecember, 2013 in which Comrades S.K.Vyas Secretary General NCCPA; D.K.Rahate Chairman and T.Narashimham Vice Chairman of AIPRPA are attending besides some important leaders of Sister Pensioner Organisations.

The following general guideline is given regarding formation:

1. State representatives will take immediate interest in organising a meeting of important Pensioners comrades / friends from various districts of their States to form the STATE STEERING COMMITTEES.

2. The STATE STEERING COMMITTEE will appoint DIVISION / DISTRICT STEERING COMMITTEES according to their conditions and entrust the responsibility to organise membership immediately by visiting the houses of pensioners and or going to different Post Offices on the day Pay / Pension Payment Day.

3. Model Membership Form has been placed in this Website – All are requested to download the same and photocopy the forms to obtain signatures from members. At present an annual membership of Rs.240/- is suggested, but the State Steering Committees may decide about the membership fee for their respective States. It should be borne in mind that from the membership fee collected by Divisions / Districts, a sum of Rs.50/- shall have to be remitted each to the State and All India bodies. However, this quota amount to State and All India will be finally decided as per theConstitution / Bylaws to be finalised at the Special Conference of the All India Association.

4. A Circular in regional language may be printed by the State / District Steering Committee Convenor for circulation among the Postal & RMS Pensioners to give a clear picture about the formation of our All India Association. The First Circular of the All India Steering Committee can be used for necessary materials for printing such Circulars at State / District level.

5. A copy of the Circular so printed by the State / District Steering Committees shall be sent to the General Convenor by post for information to the following address: “ K.Ragavendran General Convenor, All India Postal & RMS Pensioners Association, 2/44, Muthial Chetty Street, Purasawalkam, Chennai – 600007”.

6. As already circulated it must be our endeavour to complete the formation of Division / District formations at the earliest to enable organising special conference / convention at State level to form the State organisation of All India Postal & RMS Pensioners Association before January 2014.

7. The All India Special Conference will be organised in February 2014 to form the All India Organisation. Therefore State level formation in all States shall be completed prior to the All India Conference.

8. Approach all Divisional Secretaries of Postal Federations in order to enlist their support and solidarity to the formation of All India Postal & RMS Pensioners Association. Keep in mind that NFPE Secretary General Comrade M.Krishnan has already directed all NFPE Unions to extend total support.

Minutes of the meeting held on 23-10-2013under the Chairmanship of Member (O) regarding implementation of MNOP and L-1/L-2 System.

In pursuance of the meeting held on 02/08/2013 under the Chairpersonship of Secretary (P) to discuss the issues raised by Postal JCA, a meeting was held with the staff side under the Chairmanship of Member (O) on 23-10-2013. Following were present in the meeting.

2 On the issue of revised norms for CRCs, it was brought to the notice of staff side that the norms fixed for different operational activities at Speed Post Hubs, Intra-circle Hubs and CRCs are based on the recommendations of work Study Team of the Directorate. The issue of productivity norms as well as establishment norms have also been clarified to all concerned vide Dte. O.M.No. 28-8/2011-D dated 13-08-2013. Therefore, the issues stands settled now. It was decided to supply a copy of Work Study Report to the staff side.

3 The issue regarding shifting /transfer of staff from L-1 office to L-2 office and vice versa was discussed with staff side and the staff side was satisfied with the circumstances under which the staff was transferred from L-1 office to L-2 office in Gujarat Circle. The issue , is therefore, stands settled.

4. The staff side requested that more L-1 offices were needed in some Circle. In response , it was informed that requirement of more L_1 offices was examined and it was felt that any more L-1 offices not needed in view of the following:

(i) All L-1 and L-2 mail offices located within a Circle have been allowed to close bags for each other.

(ii) Circles have been given enough exceptions in terms of closing of bags by mail offices based on volume of mail.

In view of the above, the issue of identification /creation of L-1 /L-2 offices stands settled. It was decided to supply a copy of list of exceptions granted to L-2 offices for closing of direct bags to the staff side.

DRAFT TERMS OF REFERENCE 7^th CPC:

Finalized by the Staff Side at the meeting of 25.10.2013.

A. To examine the existing structure of pay, allowances and other benefits/facilities, retirement benefits like Pension, Gratuity, other terminal benefits etc. to the following categories of employees.

1 Central Government employees – industrial and non industrial;

2 Personnel belonging to All India services;

3 Personnel belonging to the Defence Forces;

4 Personnel called as Grameen Dak Sewaks belonging to the Postal Department;

5 Personnel of Union Territories;

6 Officers and employees of the Indian Audit and Accounts Department;

7 Officers and employees of the Supreme Court;

8 Members of Regulatory bodies (excluding RBI) set up under Act of Parliament.

B. To work out the comprehensive revised pay packet for the categories of Central Government employees mentioned in (A) above as on 1.1.2014.

C. The Commission will determine the pay structure, benefits facilities, retirement benefits etc. taking into account the need to provide minimum wage with reference to the recommendation of the 15^th Indian Labour Conference (1957) and the subsequent judicial pronouncement of the honorable Supreme Court there-on, as on 1.1.2014.

D. To determine the Interim Relief needed to be sanctioned immediately to the Central Government employees and Pensioners mentioned in (A) above;

E. To determine the percentage of Dearness allowance/Dearness Relief immediately to be merged with Pay and pension

F. To settle the anomalies raised in various fora of JCM.

G. To work out the improvements needed to the existing retirement benefits, like pension, death cum retirement gratuity, family pension and other terminal or recurring benefits maintaining parity amongst past, present and future pensioners and family pensioners including those who entered service on or after 1.1.2004.

H. To recommend methods for providing cashless/hassle-free Medicare facilities to the employees and Pensioners including Postal pensioners.

VII CPC - TERMS OF REFERENCE - LATEST POSITION

Dear Comrades,

VII-CPC – Terms of reference-

The members of the National Secretariat of the Confederation available at New Delhi met on 23^rd Oct. 2013 and again on 24^th October, 2013 to discuss and formulate our views on the 7^th CPC terms of Reference. On the basis of the discussions, we prepared a draft terms of reference and submitted it for consideration of the Staff Side. The important points we placed in our draft for the consideration of the staff side were:-

(a) The Commission to examine the present structure of pay and allowances and suggest changes.

(b) To give effect to its recommendations from 1.1.2011 i.e. wage revision must be after every five years.

(d) To determine Interim relief taking into account the erosion in the value of wages over the years,

(e) To include GDS within the ambit of the 7^th Central Pay Commission.

(f) To revise the retirement benefits and accord pension maintaining parity in quantum in respect of past, present and future pensioners.

(g) To extend the statutory defined benefit pension to those who have entered service after 1.1.2004.

(h) To settle the anomalies raised in various fora of JCM on a priority basis and within a specified time frame.

(i) To provide cashless/hazzle free Medicare to employees and pensioners.

The Government of India had convened a meeting of the Staff side representatives on 24.10.2013 to discuss the terms of reference. The meeting took place at 3.00PM on 24^thunder the Chairmanship of Secretary, Personnel. Besides the points mentioned above, the staff raised many other matters connected with the setting up of the CPC. viz. the inclusion of labour Representative as a Member of the Commission; the anomalous situation brought about by the Grade pay based MACP Scheme; the requirement of a mechanism to settle the 6^th CPC related anomalies; the need to allow the proposals of Cadre Review to be examined by the Government independently without referring it to CPC; to have members in the Commission who have gained expertise to impart to the Commission the nuances and functional requirements of various Departments; to relook at the new Pay Structure brought in by the 6^th CPC in the light of the experience between 2008 to 2013 etc. In conclusion the staff side requested the Government to provide it with a draft terms of reference taking into account the views placed by them. It was also proposed by the Staff Side that on exchange of the draft terms of reference prepared by the Staff Side and the Official Side, a meeting with the Secretary, Personnel and Secretary, Expenditure could be arranged to iron out the differences, if any.

The Staff Side met again on 25^th at its office and deliberated upon various views presented by different organisations and finalised the draft terms of reference. We shall publish the said draft terms of reference as and when the same is submitted to the Government.

It is obvious that despite the unanimous position taken by all the organisations, the Government may not necessarily agree with many of the basic issues, viz. Date of effect, merger of DA, Interim Relief, Coverage of GDS etc. We appeal to our affiliates/ State COCs to continue the campaign amongst the employees to generate necessary sanctions.

DECISION OF THE NFPE FEDERAL SECRETARIAT MEETING HELD AT NEW DELHI ON 19.10.2013

1. The decision taken by the Postal Joint Council of Action (NFPE & FNPO) to go on nationwide indefinite strike on the following demands is discussed and fully endorsed.

(a) Inclusion of GDS under the purview of 7^th CPC

(b) Revision wages w.e.f. 01.01.2006 and regularization of casual, part-time and contingent employees.

2. Reviewed the arrangement made for conducting the inaugural ceremony of the year long Diamond Jubilee Celebrations of NFPE on 24^th November 2013. The Venue of the function will be MP’s club Hall, North Avenue, Near NFPE office, New Delhi. The function will be arranged at 4 PM. Leaders and other member of NFPE and Leaders of fraternal organizations will be invited to the function.

3. Reviewed the arrangement made for the successful conducting of the GDS Parliament March on 11^th December 2013 under the banner of AIPEU-GDS (NFPE) Decided to extend full support to make the programme a historic success.

4. Decided to ensure participation of delegates as per quota fixed from all the affiliates of NFPE in the All India Trade Union Education Camp organized by Confederation at Mumbai on 15^th & 16^th November 2013. NFPE Circle Union shall raise maximum funds for meeting the expenditure for accommodation of NFPE delegates. For other details please see websites. Delegate fee is Rs. 600/- per delegate.

5. Decided to ensure maximum participation of lady delegates on the All India Women’s convention of Confederation to be held at New Delhi on 25^th & 26^th November 2013. 7. Com. M. Krishnan, Secretary General, Confederation and NFPE will be attending the Trade Union Congress organized by “Southern Initiative on Globalization and Trade Union Rights (SIGTUR)” at Perth (Australia) from 2^nd to 6^th December 2013.

PRESS STATEMENT

Central Government has announced the constitution of 7^th Central Pay Commission. Confederation of Central Government Employees & Workers has been raising this demand before the Government right from 2011 onwards and has conducted series of agitational programmes including Parliament March and one day nationwide strike on 12^th December 2012.

While welcoming the decision of the Government, we are disappointed to note that our demand for five years wage revision w.e.f. 01.01.2011 and merger of DA has not been considered favourably by the Government. When the public sector employees are given five years wage revision and the erosion in real wages has reached an all time high due to steep price rise, grant of five year wage revision to Central Government employees is fully justified. Similarly every time the Government appointed pay commission merger of DA was also granted. This time Government has not acceded the demand for merger of DA with pay now. Thus by appointing pay commission employees will not be getting any financial benefit now. The demand for inclusion of Gramin Dak Sevaks under the purview of the 7^th CPC and grant of merger of DA to GDS is also pending.

In view of the above, the National Secretariat of the Confederation of Central Government Employees and workers urge upon the Government to consider the above demands also favourably failing which the confederation shall be constrained go for further agitational programmes.

180-DAY MATERNITY LEAVE FOR GOVT STAFF MUST: HOUSE PANEL

NEW DELHI: There are no uniform rules for female employees in government departments and organizations and they are treated by varying yardsticks when it comes to essential benefits like maternity and child care leave (CCL).

Dismayed after finding that maternity leave can vary from 90 to 135 days, a Parliamentary panel has suggested that all government departments and organizations should ensure 180 days of leave for their women employees

The panel found many organizations grant 90, 85 or 135 days of maternity leave. It has said child care leave (CCL) of 730 days must be granted with pay to women employees across the board in government.

The committee was also distressed by the low presence of women employees in Government organizations. "It is disheartening to observe that it is significantly low...10.04% as per the 2012 census of Central Government employees," the panel said. The representation is particularly poor in semi-urban and rural areas.

The Standing Committee on Law, Personnel and Public Grievances on the 'status of women in government employment and in public sector undertakings' was unhappy that while a majority of the organizations do grant CCL, but they do so without pay.

For example, Mahanandi Coalfields Ltd gives CCL to female employees working as executives but not for non-executive category. In Cochin Shipyard Ltd, CCL is not granted since there is no specific direction from the department of public enterprises.

The policy has been discontinued in Mormugao Port Trust even though CCL benefits have been extended to all civilian female industrial employees in government since September, 2008. But many women employees hesitate to avail the leave, if granted without pay.

Introduction of "flexible timings" for female employees, especially young mothers, so that organizations can retain talent has been mooted by the committee headed by Congress MP Shantaram Naik as the panel found household responsibilities as a major reason for attrition among women employees.

The government has been asked to explore the policy on "staggered working hours" or "work at home" for female employees. The panel was informed that the recommendation of Sixth Pay Commission regarding staggered working hours was not accepted by the Government.

Single women should be given postings closest to their hometown or places of their choice, the panel said. "It should be mandatorily ensured," it said, adding that this "pertinent factor" should be kept in mind during allocation of postings by department heads.

The provision for giving same station posting to couples may be given statutory backing, the panel recommended as it found the instruction is not always adhered to

Women employees who travel beyond office hours should be provided with security and proper transport by the employer in order to ensure their safety, the Committee said.

The panel also noted that action taken on complaints of sexual harassment at workplace is "not satisfactory". It felt merely transferring a delinquent employee to a different branch or station is inadequate and strict disciplinary action is needed. "The punishment has to be deterrent for prospective offenders," the panel said.

Cabinet is likely to approve GDS bonus ceiling for Rs.3500- in the ensuing meeting:

After clearance of the Department’s proposal of Rs.3500- bonus ceiling to GDS by the Ministry of Finance during 3rd week of August, the process for cabinet approval has started and a note has been submitted by the Department to the Min. of Finance to submit for further approval in the Cabinet meeting. It may be expected in the ensuing meeting of the Cabinet.

It is always an admitted fact that every time the GDS issues are resolved with the continuous efforts of NFPE & JCA and at times by Confederation, none can claim on their own or for their own. One can’t deny that the Committee (Shri Alok Saxena Committee) for reviewing the GDS bonus issue only after 12.12.12 one day strike. It is the issue of 2.7 lakh Gramin Dak Sevaks and not limited to a section or a class which claims for their fancy. Information published or conversant to the members explicitly depends upon the context and source but not on the mere exposure. We are not interested to make it another issue to create confusion and things left to the diplomacy of the so called claimants.

PENSION ARREARS FROM 01.01.2006 AS PER COURT ORDER: GOVERNMENT REPLY IN PARLIAMENT

The orders for implementation of the decision taken by the Government on the recommendations of 6th CPC for revision for pension of past pensioners were issued vide this Department’s OM No.38/37/08-P&PW (A) dated 1.9.2008. The provisions of Para 4.2 of this OM were clarified vide this Department’s letter dated 3.10.2008.

The Central Administrative Tribunal, Principal Bench, New Delhi in its order dated 1.11.2011observed that by the OM dated 3.10.2008 the original orders of 1.9.2008 have been modified. Hon’ble CAT directed that the past pensioners may be granted, w.e.f. 1.1.2006, a minimum pension @ 50% of the minimum pay corresponding to the pre-revised pay scale with reference to the fitment table applicable for revision of pay of serving employees.

A Writ Petition was filed in the Hon’ble High Court of Delhi challenging the above mentioned order. In its order dated 29.4.2013, the Hon’ble Delhi High Court has upheld the order dated 1.11.2011. After considering the order of Hon’ble High Court of Delhi and various representations received in this regard, Special Leave Petition was filed by the Department of Pension and Pensioners’ Welfare in the Hon’ble Supreme Court of India.

Post Offices for Women

The objective for opening of all women post offices in the country is to lay focus on women’s empowerment and to achieve Departments objectives and mission to sustain its position as the largest postal network in the world. It is an effort to integrate gender equality and women’s empowerment for good governance by ensuring that women employees working at various levels in the Department have a real voice in the decision making of the Department as well as have a role in the management of post offices in the country. The all women post offices are the post office where all employees are women and they have been given the responsibility of managing the events of the post offices. This is done with a view to promote leadership and managerial qualities in women employees of the Department. These post offices are opened in major cities and at present 34 all women post offices are functioning in the country.These post offices are functioning within the postal network of the Department in the country and not a separate set up of post offices.

Besides this, from customers’ perspective, Post Offices offer products and services like small savings, postal life insurance and other mail related products which are used by the common man. All Women Post Office offers a secured environment to our woman customers from all strata of society to transact postal business with a level of comfort and familiarity with women employees of the Department.

This information was given by Dr. Smt. Killi Kruparani, Minister of State for Communications and Information Technology in a written reply to a question in the Rajya Sabha today.

THE POLICIES THAT FAILED

{Editorial Postal Crusader September, 2013}

In the year 1991 when the New Economic Policy or the Neo-liberal Economic Policy was adopted by the then Narasimha Rao Government at the Centre with much fanfare, it was repeatedly declared that it is a panacea for all the crisis faced by the Indian economy and shall ensure rapid growth of Gross Domestic Product (GDP). After 22 years, it is the very same neo-liberal policies which is leading the country to an economic disaster. The then Finance Minister Sri. Manmohan Singh had brush aside the criticism and opposition of left parties and trade unions and they became a target of concentrated attack by the supporters of the neo-liberal policies. Inspite of stiff resistance from all trade unions the Government went ahead with the rigourous implementation of the anti-people, anti-labour policies of Liberalisation, Privatisation and Globalisation (LPG).

While the UPA Government desperately wooed foreign capital and handed out concessions to big business and corporates, the plight of the people has been worsening because of the economic slowdown, falling industrial production and high inflation. The rupee has steadily depreciated in value, with the exchange rate of the rupee to the dollar breaching the Rs.68 mark last week. The current account deficit (the gap between exports and imports and other remittances) has reached an unsustainable level, there is rising external debt with the bourgeoning short-term debt, posing immediate problem. This financial crisis is accompanied by high inflation. The fact that the creation of two India’s of the rich and the poor, with the gap between them widening alarmingly, is a reality that stares us every moment.

The first UPA Government was not allowed to implement the reforms in the financial sector, pension sector and retail sector etc. by the left parties who supported the Government. It prevented the passing of PFRDA Bill by threatening to withdraw support to the Government. The second UPA Government without the left support, started rigourous implementation of the reforms in all sectors. All barriers for the inflow of foreign capital to the country was removed and the cap of Foreign Direct investment (FDI) in banking, insurance, pension, retail, defence, telecom etc. are either enhanced or removed. Large scale disinvestment of public sector has become the order of the day. Deregulation of petrol pricing has resulted in everincreasing prices of petrol and diesel fuelling inflation which resulted in the increased burden of price rise for the people. Onions,vegetables and all other necessities of life are becoming out of reach of the people. The other outcome of the economic slowdown is the loss of jobs in the industrial and services sectors and rising unemployment.

The UPA Government is seeking to overcome this crisis by attracting more foreign capital and giving more concessions to the multinational companies (MNCs) and Indian big business. The growing dependence on foreign capital flows and FDI has worsened the situation further and the entire exercise has proved futile. The bulk of the capital flows out of the country is from equity, debt markets and Foreign Institutional Investments (FIIs), which the Government cannot control. The neo-liberal policies of the Manmohan Singh Government and the boosting of the economy through Foreign Capital inflows have now come to roost.

During the last three years at least, the tax concessions provided to the corporartes and the rich amount to, according to budget papers, to over five lakhs crores every year. Despite such “incentives”, the overall growth of the industrial production was minus 1.6 per cent in May 2013. If, instead, these legitimate taxes were collected and used for public investments to build over much needed infrastructure, this would have generated large-scale employment. This, inturn, would increase the purchasing power of the people and vastly enlarge domestic demand. This would lay the basis for a turn around in manufacturing and industrial production and put the economy on a more sustainable and relatively pro-people growth tragectory.

What the country needs is an alternative pro-people policies. Such an alternative can be brought about through the intensification of popular struggle of the people and working class in the coming months.

Dear Comrade,

1. Agenda of the next National Council JCM has been finalized on 27.08.2013 in consultation with DOP&T. Twelve demands raised by the Confederation in the Charter of demands are included (including the GDS employees demand). The letter given by Com. Umraomal Purohit, Secretary, Staff Side, JCM National Council and twelve demands included in the agenda are enclosed herewith. (Annexure I & II) Next meeting of the National Council JCM is expected by the end of October 2013/early November 2013.

2. The controversial PFRDA bill is listed as an agenda items of the current Parliament session. National Secretariat of the Confederation has given a call for two-hours walk out and protest demonstrations when the bill is taken up for discussion in Parliament or on the next day if information is received late.

3. GET READY FOR INDEFINITE STRIKE, MAKE THE STRIKE BALLOT A GRAND SUCCESS

As already mentioned in the previous circular the following campaign programmes shall be implemented in all states demanding realisation of the 15 Point Charter.

(a) Mass Relay Dharna at all important places and State/District Head Quarters from 2^nd to 7^th September 2013.

(b) Holding of state conventions of C-O-Cs and Central Working Commitees/Central Executive Committees of all affiliated Unions/Associations/Federations.

A copy of the appeal for strike ballot and model ballot is enclosed herewith (Annexure III & IV). It may be translated into local languages. Each official should be given an appeal well in advance so that they can take an independent decision before the polling dates. 15 Point Charter may be permitted in the appeal.

On the polling day (25^th, 26^th & 27^th September 2013) ballot boxes should be placed at the premises of offices or at a centralized place (polling booths) as per convenience. Employees may be allowed to vote freely and frankly by ticking “Yes” or “No” in the ballot. It will be a secret ballot. After ticking “Yes” or “No”, the ballot may be put in the ballot box. After polling is over leaders shall count the ballot.

The ballots in favour of indefinite strike (Yes) and against indefinite strike (No) may be counted separately and total figure arrived at may be communicated by the respective C-O-Cs or organizations as the case may be, to the Confederation Head quarters by e-mail or SMS.

Before the poling date intensive campaign should be conducted by all C-O-Cs and affiliates at all places and each and every employee may be contacted and requested to cast his/her vote.

4. All India Trade Union Education Camp:

The Trade Union Education Camp will be held at Mumbai on 15^th & 16^th November 2013. The number of delegates to be participated from each C-O-C and affiliated Unions / Associations / Federations will be intimated before September 1^st Week. The camp is being hosted by C-O-C Mumbai. Delegate fee is Rs. 600/- per head. NFPE, ITEF, Audit & Accounts Associations and Atomic Energy delegates shall be arranged accommodation by their respective Federations.

5. All India Women’s Convention

The All India Women’s Convention of the Confederation will be held at New Delhi on 25^th & 26^th November 2013. Lady Delegates from all C-O-Cs and affiliated Unions/Associations/Federations should participate in the Convention. Number of women delegates to be participated from each C-O-C and affiliated Unions/Associations/Federations will be intimated by first week of September 2013. The Convention is being hosted by C-O-C Delhi. Delegate fee is Rs. 600/- per head.

6. Formation of C-O-Cs at State and District level

As we are heading towards an indefinite strike, we have to gear up our organsiational machinery at all levels. Wherever state level C-O-Cs are defunct or ineffective it should be revived immediately. Where ever District Committee is not formed the major affiliates should take immediate action for preparing their rank and file for the indefinite strike. Circulars, bulletins, posters, boards, banners etc. may be issued and circulated widely among the employees. Don’t wait for the last Minute, Be prepared well in advance.

Dear Comrade,

3. GET READY FOR INDEFINITE STRIKE, MAKE THE STRIKE BALLOT A GRAND SUCCESS

As already mentioned in the previous circular the following campaign programmes shall be implemented in all states demanding realisation of the 15 Point Charter.

(a) Mass Relay Dharna at all important places and State/District Head Quarters from 2^nd to 7^th September 2013.

(b) Holding of state conventions of C-O-Cs and Central Working Commitees/Central Executive Committees of all affiliated Unions/Associations/Federations.

Before the poling date intensive campaign should be conducted by all C-O-Cs and affiliates at all places and each and every employee may be contacted and requested to cast his/her vote.

5. All India Women’s Convention

6. Formation of C-O-Cs at State and District level

PENSION ARREARS FROM 01.01.2006 AS PER COURT ORDER: GOVERNMENT REPLY IN PARLIAMENT

The orders for implementation of the decision taken by the Government on the recommendations of 6th CPC for revision for pension of past pensioners were issued vide this Department’s OM No.38/37/08-P&PW (A) dated 1.9.2008. The provisions of Para 4.2 of this OM were clarified vide this Department’s letter dated 3.10.2008.

This SLP came up for hearing recently on 29.7.2013 before the Hon. Supreme Court and has been dismissed. [click here to see]

PENSION ARREARS FROM 01.01.2006 AS PER COURT ORDER: GOVERNMENT REPLY IN PARLIAMENT

The orders for implementation of the decision taken by the Government on the recommendations of 6th CPC for revision for pension of past pensioners were issued vide this Department’s OM No.38/37/08-P&PW (A) dated 1.9.2008. The provisions of Para 4.2 of this OM were clarified vide this Department’s letter dated 3.10.2008.

This SLP came up for hearing recently on 29.7.2013 before the Hon. Supreme Court and has been dismissed. [click here to see]

Will the Minister of PERSONNEL,PUBLIC GRIEVANCES AND PENSIONS be pleased to state:-

(a) the reasons for inordinate delay in implementation of Hon`ble High Court`s order to give effect to the payment of arrears w.e.f. 01.01.2006 to pensioners retired before 2006;

(b) whether the Government have received representations from employees organizations and other bodies in this regard; and

(c) if so, the details thereof and the reaction of the Government on the representations?

3. GET READY FOR INDEFINITE STRIKE, MAKE THE STRIKE BALLOT A GRAND SUCCESS

As already mentioned in the previous circular the following campaign programmes shall be implemented in all states demanding realisation of the 15 Point Charter.

(a) Mass Relay Dharna at all important places and State/District Head Quarters from 2^nd to 7^th September 2013.

(b) Holding of state conventions of C-O-Cs and Central Working Commitees/Central Executive Committees of all affiliated Unions/Associations/Federations.

Before the poling date intensive campaign should be conducted by all C-O-Cs and affiliates at all places and each and every employee may be contacted and requested to cast his/her vote.
