<p><strong>Single-family homes:</strong> These are the most common properties purchased with a VA home loan. They include traditional homes and properties in a Planned Unit Development (PUD).</p>



<p><strong>Multi-unit properties:</strong> These consist of multiple units, each rented to different tenants. Examples include apartments, duplexes, and triplexes. Qualifying buyers can purchase up to a four-plex, provided they occupy one unit as their primary residence.</p>



<p><strong>Condominiums:</strong> Available to eligible borrowers, but they must be VA-approved. Your lender and real estate agent can help you find acceptable units on the VA’s list. <p>We all know that the <a href="https://arizona-va-homeloans.com">VA loan </a>is one of the best loans to help Veterans and their families purchase their dream homes. If you have been paying attention to the news this past year, you probably heard about the big <a href="https://www.housingwire.com/articles/nar-addresses-steering-in-latest-settlement-agreement-update/" target="_blank" rel="noopener">NAR settlement </a>. With this settlement, a lot was left up into the air in regards to a Veteran paying for real estate commissions. The big question: &#8220;Can A Veteran Pay Real Estate Commissions?&#8221; Yesterday, the Department of Veteran Affairs (VA) dropped <a href="https://www.benefits.va.gov/HOMELOANS/documents/circulars/26-24-14.pdf" target="_blank" rel="noopener">VA Circular 26-24-14</a> to address this issue.</p>



<h2 class="wp-block-heading has-text-align-center">Temporary Rules for Veteran Homebuyers</h2>



<p>On June 11, 2024, the VA released a &#8220;Temporary Guidance&#8221; on the topic of whether or not a Veteran can pay for real estate commissions.  Here is my take Fun Take on these Buyer-Broker Charges:</p>



<h2 class="wp-block-heading has-text-align-center"><strong>What’s Up</strong> on this VA Circular and Real Estate Commissions</h2>



<p>The Department of Veterans Affairs (VA) has some juicy news! There&#8217;s a temporary change in the rules about how Veterans can handle real estate broker fees when buying a home.</p>



<h2 class="wp-block-heading has-text-align-center"><strong>The Backstory</strong> on VA Buyers and Real Estate Commissions:</h2>



<p>Usually, the VA has strict rules about what fees and charges can be slapped on Veterans using the VA home loan benefit. Normally, Veterans can&#8217;t pay real estate broker fees. But guess what? The Under Secretary for Benefits (USB) can give a thumbs-up for some exceptions when it makes sense locally. Now, with the housing market going bananas, the VA is saying, &#8220;Hey, let&#8217;s let Veterans pay certain buyer-broker fees for a bit.&#8221; This change aims to keep Veterans competitive in this wild real estate game. The VA is cooking up a long-term policy but, for now, here&#8217;s the deal.</p>



<h2 class="wp-block-heading has-text-align-center">Temporary Changes for Buyer-Broker Fees:</h2>



<p>Veterans can now pay reasonable fees to their buyer-brokers (think commissions and other broker-related stuff) if: a. The home they’re buying is in an area where:</p>



<ol class="wp-block-list">
<li>Listing brokers can&#8217;t set buyer-broker fees via multiple listing postings; or</li>



<li>Buyer-broker fees can’t be set or managed by the listing broker. </li>
</ol>



<ul class="wp-block-list">
<li>These fees aren’t rolled into the loan amount.</li>



<li>The Veteran’s ability to pay these fees will be considered when checking if they have enough cash to close the loan.</li>



<li>No invoice needed, but:</li>
</ul>



<p>3. The total paid by the Veteran should be recorded in the &#8220;Other&#8221; section of the Closing Disclosure.</p>



<p>4.  The buyer-broker agreement should be included with the sales contract when requesting an appraisal and kept in the loan file.</p>



<h2 class="wp-block-heading has-text-align-center">Key Points About VA Buyers and Brokerage Charges:</h2>



<p>a. Veterans, haggle your broker’s fee whether you’re paying or the seller is.<br>b. Sellers can still cover these fees for Veterans.<br>c. If the seller pays these fees, it’s not considered a seller concession by the VA.</p>

<p>Understand that you have basic entitlement, but you also have bonus entitlement.&nbsp; If a Veteran used up their basic entitlement in purchasing their first home, they can now tap into the bonus entitlement to purchase their second home using the VA loan benefit. &nbsp;</p>



<h2 class="wp-block-heading has-text-align-center" id="do-i-have-to-put-money-down-on-the-second-va-loan">Do I have to put money down on the second VA loan? &nbsp;</h2>



<p>Maybe or maybe not.&nbsp; This is where working with a great lender that specializes in VA loans comes in handy.&nbsp; With getting to confusing with the math, let’s just say that the Veteran has enough bonus entitlement to buy another home at $400,000.&nbsp; This would mean that the VA will not require any money down for a down payment for a home up to $400,000. &nbsp;</p>

<p>No.&nbsp; The VA will only guarantee the lender up to that amount.&nbsp; If the Veteran wishes to purchase higher, then he/she would have to put down 25% of the difference between the max&nbsp; the VA will guarantee and the higher purchase price.&nbsp;</p>



<p>Back to the example:&nbsp; You can only go to $400,000 on your new VA loan with no money down, but you want to buy a home that is $440,000.&nbsp; In this scenario, you would have to bring in 25% of the difference of $440,000 and $400,000… which would be $40,000 x .25% or $10,000 down payment. &nbsp;</p>



<h2 class="wp-block-heading has-text-align-center" id="do-va-loans-have-to-be-owner-occupied">Do VA loans have to be owner occupied?</h2>



<p>Yes.&nbsp; The VA clearly states that:&nbsp; The law requires a veteran obtaining a VA-guaranteed loan to certify that he or she intends to personally occupy the property as his or her home. As of the date of certification, the veteran must either • personally live in the property as his or her home, or • intend, upon completion of the loan and acquisition of the dwelling, to personally move into the property and use it as his or her home within a reasonable time. <p>A reasonable time is 60 days, but there are some exceptions.</p>

<p>I have come across Veterans that have been told they can’t use their VA home loan benefit because they foreclosed in past &#8211; or that they have to pay all of it back to use it again.&nbsp; Just simply not true!&nbsp;</p>

<p>What are the top 9 VA Loan Myths?  Over the past two decades, I have worked with 1000’s of Veterans and active-duty service members by helping them buy a home using their VA home loan benefit.&nbsp; During this time, I have heard some of the biggest misconceptions about using the <a href="https://arizona-va-homeloans.com/va-loan-programs/">VA loan programs</a>.&nbsp; Here is a list of just a few:</p>



<ul>
  <li> I already used my eligibility once, so I didn’t think I could use it again. </li>
  <li> I was never told about my VA benefit.</li>
  <li> It was only for Veterans and I am still on active-duty. </li>
  <li> I thought my eligibility was expired.</li>
  <li> I didn’t pick up my certificate, so I didn’t think I could use my VA loan benefit.</li>
  <li> I have VA entitlement, so I automatically quality for a VA loan.</li>
  <li> The $36,000 listed on my Certificate of Eligibility won’t buy a house in my community.</li>
  <li> It is only for military on active-duty and I got out after four years.</li>
  <li> I thought it was harder to qualify for a VA home loan. </li>

<p>The Department of Veterans Affairs is concerned with your selection of a condominium community, as the extensive shared spaces within these complexes play a significant role in determining the worth of your individual unit. So what is the VA looking for to get an approval?</p>



<h2 class="wp-block-heading has-text-align-center"><strong>VA Condo Approval Checklist</strong></h2>



<p>To be approved by the VA, the condo your condo development must meet these requirements:</p>



<ul>
  <li>At least 50% of the units must be occupied by their owners. In other words, less than 50% of the units can be rented out to tenants.</li>
  <li> Less than 15% of the unit owners are behind on their Homeowners Association dues. </li>
  <li> For newly constructed condo developments, or projects recently converted from apartments, at least 70% of the units must be sold. </li>
  <li> The project must consist of more than one unit.</li>
  <li> No single entity (individual, investor, or company) may own more than 10% of units in the development. This is a big one.

<p>First, go check&nbsp;the VA&#8217;s Approved Condo Report&nbsp;to see if the condo unit you want to purchase here in Arizona is on the approved development list. When you go to this page on the VA’s website, you should see this screen:</p>

  <li> First, click the ‘Approved’ box on the first line so you’ll see only condo developments who have earned some level of VA approval. </li>
  <li> If you’re looking for a specific complex, enter the first few letters of the condo name in part 2 of the form. If you’d rather see a list of condo developments in a city or state, leave space 2 empty. </li>
  <li> In part 3 of the form, it’s easiest to leave the default selection “All Offices” unless you’d prefer to work with a specific VA office. </li>
  <li> You’ll have to enter your state. You could put in your county and city if you’d like to narrow the results further. </li>
</ol>



<p>Next, we’ll look at a specific example.</p>



<h2 class="wp-block-heading has-text-align-center">Searching for a VA Approved Condos &#8211; Example</h2>



<p>Let’s say you’d like to buy a condo with a VA mortgage loan in Tucson, Arizona, but don’t already have a specific condo complex in mind.<br>In part 4 of the form, it&#8217;s permissible to input just the city and state.</p>



<p>Upon a successful match with your search criteria, you can expect to view the following screen after your submission:</p>



<p>On this day, the search showed 35 condo complex developments in Tucson on the list. In order to view the status of any specific development, you would have to select the &#8220;Plus&#8221; symbol located in the rightmost column.</p>



<p>Clicking the “Plus” sign for the condo development will show you its approval status:</p>

<p>Not all approved VA condo complexes have the same approval status. So let’s dig in a bit further and explain what each status means.</p>



<h2 class="wp-block-heading has-text-align-center">Different types of <strong>VA Condo Approvals </strong></h2>



<p>In this case, you can see CANYON VIEW AT VENTANA complex has been “Accepted Without Conditions” as of February 20,2003. Even though this has been a few years, this complex meets the VA’s guidelines, and you could buy using your VA home loan benefit.</p>

<p>Accepted with conditions&#8217; indicates that while the VA has given its approval to the complex, it holds reservations regarding one or more elements within the complex&#8217;s application. For example, one person may own almost 10% of the units, or the complex may be approaching the tipping point of tenant-occupied units.</p>



<p>This scenario shouldn&#8217;t hinder your ability to utilize a VA loan; however, you might need to complete additional paperwork, acknowledging your comprehension of the conditions and affirming your decision to continue with the loan regardless.</p>

<p>In the past, the VA would automatically approve any condominium project that had received FHA approval from the Department of Housing and Urban Development (HUD). See below with COUNTRY CLUB MANOR.<br>Over a decade ago, this policy was altered; however, older complexes that secured HUD approval before December 2009 remain eligible for a VA loan.</p>



<p>But this isn’t guaranteed. Working with a knowledgeable VA loan officer that has done a few condos comes in handy. They know where and how to check to see if it still qualifies.</p>



<h2 class="wp-block-heading has-text-align-center"><strong>Unaccepted</strong></h2>



<p><br>Condominiums situated in communities labeled as &#8220;unaccepted&#8221; do not qualify for VA financing. This status applies to those that have either never undergone the VA&#8217;s approval procedure or have been subjected to the process but were subsequently rejected by the VA.</p>



<h2 class="wp-block-heading has-text-align-center">So can you buy a condo with a VA loan?? </h2>



<p>As you can see, you can use your VA home loan benefit to purchase a condo, if it is approved through the VA.  But what if find a condo that you really like, but it is not approved?  Should you just move on and find another condominium project that will accept VA financing?  So what do you do?&#8230;</p>



<h2 class="wp-block-heading has-text-align-center"><strong>What if the Condo is not on the VA Approved List?</strong></h2>



<p><br>Should a condominium project that interests you not appear on the list of VA-approved properties, you have the option to request that your lender submit documentation to initiate an investigation into the property, determining its compliance with the approval criteria.</p>
