The &lt;a href="http://www.nebraskalegislature.gov/FloorDocs/Current/PDF/Slip/LB292.pdf"&gt;Nebraska Uniform Athlete Agents Act&lt;/a&gt; was approved by &lt;a href="http://www.governor.nebraska.gov/index.html"&gt;Governor Dave Heineman&lt;/a&gt; on April 22. Last week, the Iowa Legislature passed the &lt;font style="font-weight: bold;"&gt;Iowa Uniform Athlete Agent Act&lt;/font&gt;, which replaces the &lt;a href="http://www.sos.state.ia.us/pdfs/buspdfs/fillable/ATHAGENT.PDF"&gt;current Iowa regulations&lt;/a&gt; governing athlete agents.  On March 23, &lt;a href="http://coolice.legis.state.ia.us/Cool-ICE/default.asp?Category=billinfo&amp;amp;Service=Billbook&amp;amp;menu=false&amp;amp;ga=83&amp;amp;hbill=SF199"&gt;SF199&lt;/a&gt; passed out of the House of Representatives on a 98-0 vote and now heads to &lt;a href="http://www.governor.iowa.gov/"&gt;Governor Chester Culver&lt;/a&gt; for a signature.&lt;br /&gt;&lt;br /&gt;Until then, the current athlete agent law remains in effect.  &lt;a href="http://www.sos.state.ia.us/pdfs/buspdfs/fillable/ATHAGENT.PDF"&gt;Here&lt;/a&gt; is the current registration form and law in one tidy pdf package.  As you can see &lt;a href="http://www.sos.state.ia.us/pdfs/MiscFilings/AthlAgents.pdf"&gt;here&lt;/a&gt;, there wasn't a rush to register as an athlete agent in Iowa in the recent past.  Of the many reasons that explain why this is so may be the requirements that:&lt;br /&gt;&lt;blockquote style="font-style: italic;"&gt;1. ALL nonresident applicants must file with their application and consent, an agreement with an athlete agent who is a resident of Iowa. The agreement must meet the requirements of Iowa Code Chapter 9A, section 4.&lt;br /&gt;2. Nonresident applicants who are CORPORATIONS must also:&lt;br /&gt;a) include a copy of the resolution of the corporation authorizing consent to service of process, and b) possess a Certificate of Authority to Transact Business in Iowa, issued by the Secretary of State pursuant to Iowa Code chapter 490, prior to applying for a Certificate of Registration as an Athlete Agent. The Secretary of State will supply the copy of the applicant's Cerificate of Authority, as required of the applicant by Iowa Code Chapter 9A, if the Certificate of&lt;br /&gt;Authority has been obtained prior to the date the application for Certificate of Registration is received. Applications cannot be processed for nonresident corporations who do not possess a Certificate of Authority to Transact Business in Iowa.&lt;/blockquote&gt;Think that had anything to do with the fact that no one was registered?  We'll see because the Uniform Athlete Agent Act adopted by the Legislature &lt;font style="font-weight: bold;"&gt;repeals those sections&lt;/font&gt;.&lt;br /&gt;&lt;br /&gt;&lt;font style="font-weight: bold;"&gt;Also repealed&lt;/font&gt; are the sections under current law requiring athlete agents to have on file with the secretary of state &lt;font style="font-weight: bold;"&gt;a surety bond&lt;/font&gt; in the sum of $25,000.&lt;br /&gt;&lt;br /&gt;The current filing fee is $300 for the one-year registration. The Unicameral Update, the Nebraska Legislature's official news source, spread the word with &lt;a href="http://unicameralupdate.blogspot.com/2009/03/sports-agent-regulation-bill-advances.html"&gt;Sports agent regulation bill advances&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;The bill was introduced by Senator Steve Lathrop who, in his &lt;a href="http://www.nebraskalegislature.gov/FloorDocs/Current/PDF/SI/LB292.pdf"&gt;statement of interest&lt;/a&gt;, described the bill like this:&lt;br /&gt;&lt;blockquote style="font-style: italic;"&gt;The purpose of Legislative Bill 292 is to adopt the Uniform Athlete Agents Act. The Act, which has been adopted by 38 other states, provides for the uniform registration, certification, and background checks of sports agents seeking to represent student athletes who are or may be eligible to participate in intercollegiate athletics.&lt;/blockquote&gt;The bill's passage was also covered by the Omaha World-Herald in its article - &lt;a href="http://www.omaha.com/index.php?u_page=2798&amp;amp;u_sid=10590462"&gt;&lt;span class="headline"&gt;With Chambers gone, sports agent bill runs up the score&lt;/span&gt;&lt;/a&gt;. But no rule explicitly prohibits AAU basketball coaches such as Barrett from accepting a $250,000 donation from an agency such as Ceruzzi Sports, and then playing semantics by paying for dinner when the agency’s front man is there to recruit a player such as Love.&lt;/li&gt;&lt;li&gt;Money offered by agents for access to players has empowered AAU basketball coaches and far exceeds sponsorships from companies such as Nike and adidas, both of which have cut back funding in recent years.&lt;/li&gt;&lt;li&gt;Since it isn’t a violation for an agent to recruit players, the presence on campus of people such as Williams and Brown is an awkward modern reality. The relationship between college recruiters and agent recruiters is rarely adversarial. The amendment to the existing athlete agent act prohibits an agent from:&lt;br /&gt;&lt;span style="font-style: italic;"&gt;&lt;blockquote&gt;"any and all communication with student-athletes who are ineligible to be drafted, with the exception of general promotional brochures.  Communication includes, but is not limited to in-person contact, telephonic and electronic communication."&lt;/blockquote&gt;&lt;/span&gt;The bill's author is former University of Oklahoma football player Todd Thomsen.  In the Kfor report Thomsen acknowledges the NFLPA "junior rule" that puts similar restrictions on NFLPA certified contract advisors but indicates that the "league" (assuming he meant players' association) doesn't have the resources to enforce it.&lt;br /&gt;The bill will next head to the state Senate for debate and a vote.  It will be interesting to see what becomes of the bill if the NFLPA decides to eliminate or modify the "junior rule".    The rule is largely panned as ineffective and widely ignored.  Agents complain that the rule puts those who follow it at a disadvantage and allows financial advisors and marketing agents to take advantage of the situation.&lt;br /&gt;During the combine, the rule was&lt;span id="ctl00_ContentPlaceHolder1_ctl00_rptStoryContent_ctl00_lblNewsDesc"&gt; &lt;a href="http://www.nflplayers.com/user/content.aspx?fmid=178&amp;amp;lmid=443&amp;amp;pid=2945"&gt;discussed at a meeting with NFLPA staff members&lt;/a&gt;, a group of 20 agents and members of the NFLPA’s Executive Committee. Oh well.  As the Utes prepare to face Alabama and as the result of a special request, Utah is up next.&lt;br /&gt;&lt;br /&gt;Utah is another state that has adopted the Uniform Athlete Agent Act.  The &lt;a href="http://www.dopl.utah.gov/laws/15-9.pdf"&gt;Utah Uniform Athlete Agent Act&lt;/a&gt; is administered by the &lt;a href="http://www.dopl.utah.gov/licensing/athlete_agent.html"&gt;Division of Occupational and Professional Licensing (DOPL)&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;The DOPL site is loaded with information including all the forms you will need to register and links to laws and rules and more. It will cost you $510 to &lt;a href="http://www.dopl.utah.gov/licensing/forms/applications/104_athlete_agent.pdf"&gt;register&lt;/a&gt; and the registration expires for all athlete agents on September 30 every year.  It will the cost $510 to &lt;a href="http://www.dopl.utah.gov/licensing/forms/athlete_agent_renewal_app.pdf"&gt;renew your registration&lt;/a&gt;, which can be accomplished online.&lt;br /&gt;&lt;br /&gt;The site also provides information on the Athlete Agent Licensing Board.  The Board has five members and consists of one public member and four athlete agent members. Currently, only two of the spots are filled.  One thing that caught my attention in reading the Utah Uniform Athlete Agent Act was this:&lt;br /&gt;&lt;blockquote style="font-style: italic;"&gt;In addition, the Athlete Agents Licensing Board shall designate one of its members on a permanent or rotating basis to:&lt;br /&gt;(i) assist the division in &lt;span style="font-weight: bold;"&gt;reviewing complaints &lt;/span&gt;concerning the&lt;br /&gt;unlawful or unprofessional conduct of a licensee; and&lt;br /&gt;(ii) &lt;span style="font-weight: bold;"&gt;advise the division in its investigation &lt;/span&gt;of these complaints.&lt;br /&gt;&lt;/blockquote&gt;Seems to me that an athlete agent assisting in the review of complaints on other athlete agents, particularly those who are competition and then advising the division in its investigation creates a number of potential problems.  Hopefully the public member is the one who is designated to fill this role.&lt;br /&gt;&lt;br /&gt;The DOPL site allows users to see who is registered and get fairly detailed info on athlete agents who are registered in Utah by going to the &lt;a href="https://secure.utah.gov/llv/llv"&gt;Verify a License&lt;/a&gt; link on the left.  As of this writing, it looks as though most of the agents registered haven't gotten around to renewing as only eight of the 26 agents who have previously registered are listed as "ACTIVE".&lt;br /&gt;&lt;br /&gt;&lt;span&gt;If you plan to recruit student-athletes at the &lt;/span&gt;&lt;a href="http://athleticscompliance.utah.edu/index.php?option=com_content&amp;amp;task=view&amp;amp;id=12&amp;amp;Itemid=28"&gt;University of Utah&lt;/a&gt;&lt;span&gt;, make sure to contact the compliance office first. According to the compliance office website:&lt;/span&gt;&lt;br /&gt;&lt;blockquote&gt;&lt;span style="font-style: italic;"&gt;All athletic agents must receive initial permission from the Compliance Office prior to contacting any student-athlete of the University of Utah. Severe repercussions are possible for violation of this rule, both to the agent and to the student-athlete.&lt;/span&gt;&lt;/blockquote&gt;The &lt;a href="http://utahstateaggies.cstv.com/agents.html"&gt;Utah State Aggies compliance office&lt;/a&gt; requires athlete agents to &lt;a href="http://utahstateaggies.cstv.com/photos/schools/ust/genrel/auto_pdf/agentregistrationform.pdf"&gt;register&lt;/a&gt; before contacting a studet-athlete.&lt;div class="blogger-post-footer"&gt;&lt;img width='1' height='1' src='https://blogger.googleusercontent.com/tracker/28764617-5922631895546588200?l=www.gaarb.com' alt='' /&gt;&lt;/div&gt;

Bad choices have very bad consequences.&lt;/blockquote&gt;&lt;a href="http://www.nationalfootballpost.com/author/andrew-brandt/"&gt;Andrew Brandt&lt;/a&gt; of the &lt;a href="http://www.nationalfootballpost.com/"&gt;National Football Post&lt;/a&gt;, after making it clear that he has no knowledge of the violation, makes an important observation and addresses the reality of the situation in his &lt;a href="http://www.nationalfootballpost.com/2008/12/tuesday-thoughts-5/"&gt;Tuesday Thoughts:&lt;/a&gt;&lt;br /&gt;&lt;span style="font-size: 10pt; font-family: &amp;quot;Arial&amp;quot;,&amp;quot;sans-serif&amp;quot;;"&gt;&lt;/span&gt;&lt;blockquote style="font-style: italic; font-family: trebuchet ms;"&gt;&lt;span style="font-size: 10pt;"&gt;&lt;span style="font-family: georgia;font-size:100%;" &gt;That would not only violate the rule of coach Nick Saban &lt;span style="font-weight: bold;"&gt;but also the NFLPA rule for contact with juniors&lt;/span&gt;.&lt;span style=""&gt;  &lt;/span&gt;Despite those rules, the competition from agents for a player like Smith would be intense and widespread, perhaps leading to improper contact that Saban discovered.&lt;/span&gt;&lt;span style=""&gt;&lt;/span&gt;&lt;/span&gt;&lt;/blockquote&gt;Mike Florio of ProFootballTalk recently posted that &lt;a href="http://www.profootballtalk.com/2008/12/25/junior-rule-violations-run-rampant/"&gt;Junior Rule Violations Run Rampant&lt;/a&gt;:&lt;br /&gt;&lt;span style="font-size:100%;"&gt;&lt;/span&gt;&lt;blockquote style="font-style: italic;"&gt;&lt;span style="font-size:100%;"&gt;A league source tells us that, in its second year of existence, the &lt;span style="text-decoration: underline;"&gt;&lt;/span&gt; NFL Players Association’s rule prohibiting agents from talking to underclassmen prior to their entry into the pool of players who’ll be drafted in April &lt;span style="font-weight: bold;"&gt;isn’t working&lt;/span&gt;.&lt;/span&gt;&lt;/blockquote&gt;If this situation is indeed a result of improper contact with an agent, Andre Smith isn't the only one who is going to be punished.  The agent(s) involved could also face punishment. Well, that and more has changed.&lt;br /&gt;&lt;br /&gt;The &lt;a href="http://www.dora.state.co.us/athlete-agents/HB08-1058.pdf"&gt;Colorado Uniform Athlete Agent Act&lt;/a&gt; took effect in July of this year and applies to offenses committed on or after January 1, 2009.  Colorado joins the ranks of states who have adopted the &lt;a href="http://www.law.upenn.edu/bll/archives/ulc/uaaa/aaa1130.htm"&gt;Uniform Athlete Agent Act&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;The Department of Regulatory Agencies (DORA) held a few &lt;a href="http://athleteagent.blogspot.com/2008/10/attention-colorado-athlete-agents.html"&gt;public information sessions&lt;/a&gt; to let Colorado athlete agents know about the upcoming changes.&lt;span style="text-decoration: underline;"&gt;&lt;span style="font-weight: bold;"&gt;&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/span&gt; As of &lt;span style="font-weight: bold;"&gt;January 1, 2009&lt;/span&gt;, you may not practice as an athlete agent in Colorado without holding a certificate of registration.  To register, head to the &lt;a href="http://www.dora.state.co.us/athlete-agents/licensure.htm"&gt;Office of Athlete Agent Registration's site&lt;/a&gt; to get all the information that you need. "&lt;span style="font-style: italic;"&gt;Sources&lt;/span&gt;" informed the &lt;a href="http://blog.al.com/bamabeat/2008/12/updated.html"&gt;Mobile Press Register&lt;/a&gt; that the suspension is &lt;span style="font-style: italic;"&gt;"thought to be tied to an &lt;span style="font-weight: bold;"&gt;improper association with a sports agent&lt;/span&gt;"&lt;/span&gt;.  The &lt;a href="http://www.tuscaloosanews.com/article/20081229/news/812290292&amp;amp;tc=yahoo"&gt;Tuscaloosa News&lt;/a&gt; has confirmed "&lt;span style="font-style: italic;"&gt;that Smith was being investigated by the school about i&lt;span style="font-weight: bold;"&gt;mproper contact with a sports agent&lt;/span&gt;&lt;/span&gt;."&lt;br /&gt;&lt;br /&gt;ESPN.com's Chris Low covers the &lt;a href="http://myespn.go.com/blogs/sec/0-3-155/Bad-news-for-Alabama--Smith.html"&gt;Bad News for Alabama, Smith&lt;/a&gt; and leaves us with this:&lt;br /&gt;&lt;p&gt;&lt;/p&gt;&lt;blockquote style="font-style: italic;"&gt;&lt;p&gt;The bigger question with Smith becomes the specifics of his improper dealings with an agent and when everything occurred.&lt;/p&gt; &lt;p&gt;Saban's message to his team, though, was loud and clear: Messing around with an agent is a quick ticket out of town ... even if you're Andre Smith.&lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;&lt;/p&gt;More on this story will undoubtedly come out on Tuesday. I realize that &lt;strong&gt;Illinois&lt;/strong&gt; should have been up next in the &lt;a href="http://athleteagent.blogspot.com/2007/09/athlete-agent-regulation-50-states-in.html"&gt;50 States in 50* Days Series&lt;/a&gt;, but can you really blame me?  It is one of a handful of states that does not have a state law regulating the activities of its athlete agents.  Cut me some slack while I try to make this post longer than three sentences.&lt;div&gt;&lt;br /&gt;&lt;/div&gt;&lt;div&gt;Northern Illinois University's compliance folks have set up a webpage for &lt;a href="http://niuhuskies.cstv.com/compliance/niu-compliance-agents.html"&gt;Sports Agent / Financial Advisor information&lt;/a&gt;, but the links to the NIU Agent Policy and Agent Registration form aren't links at all.&lt;br /&gt;&lt;p&gt;&lt;img height="187" border=".5" width="124" style="margin: 5px; float: left" class="" alt="" src="http://www.upenn.edu/pennpress/img/covers/14466.jpg" title="" /&gt;Illinois is mentioned in Chapter 7 of &lt;a href="http://www.amazon.com/Business-Sports-Agents-Kenneth-Shropshire/dp/0812240847/ref=pd_bbs_sr_1?ie=UTF8&amp;amp;s=books&amp;amp;qid=1215154368&amp;amp;sr=8-1"&gt;&lt;span style="text-decoration:underline"&gt;&lt;strong&gt;The Business of Sports Agents&lt;/strong&gt;&lt;/span&gt; Second Edition&lt;/a&gt; (&lt;em&gt;review coming soon&lt;/em&gt;), as the authors discuss whether attorney agents are subject to the ethical rules that govern attorneys.  A 1980 advisory opinion of the Illinois State Bar Association concluded that "when an attorney engaged in the private practice of law represents a client in contract negotiations and general business counseling, these activities constitute the practice of law."  Pretty interesting considering that not many courts or governing bodies have even opined on the issue that in one state that has there isn't a law governing agent activity.  &lt;/p&gt;&lt;p&gt;Not that attempts haven't been made.  The Illinois Legislature has introduced the Uniform Athlete Agents Act a couple of times over the last several years, but obviously to no avail. &lt;/p&gt;&lt;p&gt;There is hope - Colorado recently passed the UAAA after some failed attempts -  stay tuned for an update on the happenings in &lt;a href="http://athleteagent.blogspot.com/2007/09/50-states-in-50-days-colorado-athlete.html"&gt;Colorado.&lt;/a&gt;&lt;/p&gt;&lt;/div&gt;&lt;div class="blogger-post-footer"&gt;&lt;img width='1' height='1' src='https://blogger.googleusercontent.com/tracker/28764617-8503506972991375448?l=www.gaarb.com' alt='' /&gt;&lt;/div&gt;

In addition, an athlete agent who is guilty of violating provisions of the act may face civil penalties of up to $25,000 per violation.&lt;/div&gt;&lt;div&gt;&lt;br /&gt;&lt;/div&gt;&lt;div&gt;Athlete agents are required to file a &lt;a href="http://www.in.gov/attorneygeneral/contact/RegAtheleteAgent.pdf"&gt;registration form&lt;/a&gt; with the Indiana Attorney General. North Carolina is a &lt;a href="http://www.law.upenn.edu/bll/archives/ulc/uaaa/aaa1130.htm" target="_blank"&gt;Uniform Athlete Agent Act&lt;/a&gt; state. &lt;/p&gt;  &lt;p&gt;The &lt;a href="http://www.secretary.state.nc.us/athlete/ThePage.aspx" target="_blank"&gt;Athlete Agent Registration Office&lt;/a&gt; within the Department of the Secretary of State is responsible for the administration of the &lt;a href="javascript:__doPostBack('ctl00$ctl00$SosContent$SosContent$WucDocuments1$GridView1','$0')" target="_blank"&gt;North Carolina Uniform Athlete Agent Act&lt;/a&gt;.  &lt;/p&gt;  &lt;p&gt;The Office provides a useful &lt;a href="http://www.secretary.state.nc.us/athlete/athfaq.aspx" target="_blank"&gt;FAQ&lt;/a&gt;  for athlete agents and every conceivable form that an agent could want (and one that  they might not want to see with their name on it) . &lt;/p&gt;  &lt;p&gt;The eleven page &lt;a href="javascript:__doPostBack('ctl00$ctl00$SosContent$SosContent$WucDocuments1$GridView1','$1')" target="_blank"&gt;registration form&lt;/a&gt; is available online and registration will set you back $200.  Luckily, the &lt;a href="javascript:__doPostBack('ctl00$ctl00$SosContent$SosContent$WucDocuments1$GridView1','$0')" target="_blank"&gt;renewal application&lt;/a&gt; is only four pages, but you still have to pay $200. &lt;/p&gt;  &lt;p&gt;An &lt;a href="javascript:__doPostBack('ctl00$ctl00$SosContent$SosContent$WucDocuments3$GridView1','$0')" target="_blank"&gt;Athlete Agent Complaint Form&lt;/a&gt; is available on the Office's website.  In addition to its intended use , the four-page complaint form also provides a good checklist for agents (and aspiring agents) on behaviors to avoid in their practice.   &lt;/p&gt;  &lt;p&gt;Finally, the Athlete Agent Registration Office also provides a handy &lt;a href="http://www.secretary.state.nc.us/imaging/docfinder.aspx?PItemId=5463965&amp;amp;Misc=List" target="_blank"&gt;listing of registered athlete agents&lt;/a&gt;.&lt;/p&gt;  &lt;p&gt;The University of North Carolina's Athletic Department requires athlete agents to register annually by filling out a &lt;a href="http://www.fansonly.com/photos/schools/unc/genrel/auto_pdf/unc-agent-registration-form.pdf" target="_blank"&gt;registration form&lt;/a&gt; or &lt;a href="http://www.fansonly.com/photos/schools/unc/genrel/auto_pdf/unc-agent-renewal-form.pdf" target="_blank"&gt;renewal form&lt;/a&gt;.
