Nebraska the 38th State to Adopt the Uniform Athlete Agent Act

Last month, Nebraska became the 38th state to adopt the Uniform Athlete Agent Act. The Nebraska Uniform Athlete Agents Act was approved by Governor Dave Heineman on April 22. The law will take effect on January 1, 2010 and will be administered by the Secretary of State's office.

In an update to my post on Monday,50 States in 50* Days - Iowa Athlete Agent Regulation, Governor Chet Culver has signed Senate File 199 – an Act relating to the uniform athlete agents act and providing remedies and penalties - into law.

Iowa becomes the 37 State to adopt the Uniform Athlete Agent Act. Nebraska and New Jersey are also considering the UAAA.

50 States in 50* Days - Iowa Athlete Agent Regulation

Iowa has taken the next step in becoming the latest state to adopt the Uniform Athlete Agent Act. Last week, the Iowa Legislature passed the Iowa Uniform Athlete Agent Act, which replaces the current Iowa regulations governing athlete agents. On March 23, SF199 passed out of the House of Representatives on a 98-0 vote and now heads to Governor Chester Culver for a signature.

Until then, the current athlete agent law remains in effect. Here is the current registration form and law in one tidy pdf package. As you can see here, there wasn't a rush to register as an athlete agent in Iowa in the recent past. Of the many reasons that explain why this is so may be the requirements that:

1. ALL nonresident applicants must file with their application and consent, an agreement with an athlete agent who is a resident of Iowa. The agreement must meet the requirements of Iowa Code Chapter 9A, section 4.
2. Nonresident applicants who are CORPORATIONS must also:
a) include a copy of the resolution of the corporation authorizing consent to service of process, and b) possess a Certificate of Authority to Transact Business in Iowa, issued by the Secretary of State pursuant to Iowa Code chapter 490, prior to applying for a Certificate of Registration as an Athlete Agent. The Secretary of State will supply the copy of the applicant's Cerificate of Authority, as required of the applicant by Iowa Code Chapter 9A, if the Certificate of
Authority has been obtained prior to the date the application for Certificate of Registration is received. Applications cannot be processed for nonresident corporations who do not possess a Certificate of Authority to Transact Business in Iowa.

Think that had anything to do with the fact that no one was registered? We'll see because the Uniform Athlete Agent Act adopted by the Legislature repeals those sections.

Also repealed are the sections under current law requiring athlete agents to have on file with the secretary of state a surety bond in the sum of $25,000.

The current filing fee is $300 for the one-year registration. No indication yet on whether that will change under the new laws.

Nebraska Uniform Athlete Agent Act Moves Forward

Legislative Bill 292, the Nebraska Uniform Athlete Agent Act, was advanced by lawmakers today on a 40-0 vote. The Unicameral Update, the Nebraska Legislature's official news source, spread the word with Sports agent regulation bill advances.

The bill was introduced by Senator Steve Lathrop who, in his statement of interest, described the bill like this:

The purpose of Legislative Bill 292 is to adopt the Uniform Athlete Agents Act. The Act, which has been adopted by 38 other states, provides for the uniform registration, certification, and background checks of sports agents seeking to represent student athletes who are or may be eligible to participate in intercollegiate athletics.

The bill's passage was also covered by the Omaha World-Herald in its article - With Chambers gone, sports agent bill runs up the score. Termed-out State Senator Ernie Chambers consistently prevented the passage of similar passage.

Josh Peter and Dan Wetzel, Yahoo! Sports have a must read article if you are interested in how some athlete agents operate in the world of hoops - Agents and AAU: Unrequited Love.

Some highlights or lowlights depending on your perspective:

NCAA rules prohibit college players from accepting anything of value from sports agents, and NBA players association rules prohibit sports agents from giving college stars anything of value. But no rule explicitly prohibits AAU basketball coaches such as Barrett from accepting a $250,000 donation from an agency such as Ceruzzi Sports, and then playing semantics by paying for dinner when the agency’s front man is there to recruit a player such as Love.
Money offered by agents for access to players has empowered AAU basketball coaches and far exceeds sponsorships from companies such as Nike and adidas, both of which have cut back funding in recent years.
Since it isn’t a violation for an agent to recruit players, the presence on campus of people such as Williams and Brown is an awkward modern reality. The relationship between college recruiters and agent recruiters is rarely adversarial. Especially with the one-and-done rule, the college coach can’t afford to anger a runner, who often has connections to potential college recruits.

Oklahoma House Moves to Tighten Athlete Agent Rules

Kfor.com reports that the Oklahoma House votes to tighten rules on sports agent contact with student-athletes. The amendment to the existing athlete agent act prohibits an agent from:

"any and all communication with student-athletes who are ineligible to be drafted, with the exception of general promotional brochures. Communication includes, but is not limited to in-person contact, telephonic and electronic communication."

The bill's author is former University of Oklahoma football player Todd Thomsen. In the Kfor report Thomsen acknowledges the NFLPA "junior rule" that puts similar restrictions on NFLPA certified contract advisors but indicates that the "league" (assuming he meant players' association) doesn't have the resources to enforce it.
The bill will next head to the state Senate for debate and a vote. It will be interesting to see what becomes of the bill if the NFLPA decides to eliminate or modify the "junior rule". The rule is largely panned as ineffective and widely ignored. Agents complain that the rule puts those who follow it at a disadvantage and allows financial advisors and marketing agents to take advantage of the situation.
During the combine, the rule was discussed at a meeting with NFLPA staff members, a group of 20 agents and members of the NFLPA’s Executive Committee. The following day, more than 400 agents were told that possible changes in the rule would be considered at the Board of Player Representatives meeting in March.

Last week, word spread that confidential information contained in the applications of NFLPA certified contract advisors had been improperly released. Here’s a selection of stories about the breach:

Mike Florio of ProFootballTalk.com has a whole bunch of posts on the issue.

It will be interesting to see how this impacts the search for a new executive director, what actually comes out (if anything) from the investigation, and how agents react - especially those whose information was released.

As Kaplan and Mullen report,

"The information in the lengthy agent applications at the NFLPA includes, among other things, the agent’s social security and driver’s license numbers; the names of all the NFL players and other athletes the agent has represented; the ownership structure of the agent’s firm; all of the agent’s employees who deal with athletes; any lawsuits or liens which have been filed against them; any financial advisors they have relationships with and if they are paid for referrals to financial advisors."

As the information is said to have been transmitted to one of Vincent's partners in his financial management firm, I'm also curious how NFLPA certified financial advisors may have been impacted and how they feel about the breach.

On a lighter note, the NFLPA now uses web form for the contract advisor application process. Following a link highlighting web form features you will find this nugget of information:

“Your data are transmitted securely over the Internet. The information you enter is encrypted and secure when you save it and when you send it. Although general data collected on the system may be used in statistical studies and reports designed to assist institutions with planning, any information bearing your personal identification is disclosed only to the department to which you send it.” (emphasis added)

Jack Bechta, NFLPA certified agent and part of the team at The National Football Post, weighs in on the status and results of the "junior rule" in Will The Junior Year Rule Survive? From Jack's post:

"But the fact is that agents and players are still talking, the rule has not reduced the number of juniors who declare for the draft, and the juniors who do comply with the rule are rushed into selecting an agent. The fact that the majority of players are signing within three days after the allowable date for agent contact is evidence that players and agents are communicating regardless of the rule."

The AP is reporting that Judge Tone has ruled in favor of Oklahoma State pitcher Andrew Oliver who argued that the NCAA shouldn't restrict a player's right to have legal help when negotiating a big league contract.

NFLPA Agent Application Deadline Fast Approaching

The NFL Players Association deadline for applying to become a certified contract advisor is January 31st. The NFLPA has posted "So You Want to Negotiate NFL Contracts?" on it's website that gives you the rundown on the process (and there is a process). If you want to represent a player in the 2010 draft, you need to apply now.

50 States in 50* Days - Utah Athlete Agent Regulation

Yeah, yeah, yeah - Utah isn't next on the list and 50 days passed by several hundred days ago. Oh well. As the Utes prepare to face Alabama and as the result of a special request, Utah is up next.

Utah is another state that has adopted the Uniform Athlete Agent Act. The Utah Uniform Athlete Agent Act is administered by the Division of Occupational and Professional Licensing (DOPL).

The DOPL site is loaded with information including all the forms you will need to register and links to laws and rules and more. It will cost you $510 to register and the registration expires for all athlete agents on September 30 every year. It will the cost $510 to renew your registration, which can be accomplished online.

The site also provides information on the Athlete Agent Licensing Board. The Board has five members and consists of one public member and four athlete agent members. Currently, only two of the spots are filled. One thing that caught my attention in reading the Utah Uniform Athlete Agent Act was this:

In addition, the Athlete Agents Licensing Board shall designate one of its members on a permanent or rotating basis to:
(i) assist the division in reviewing complaints concerning the
unlawful or unprofessional conduct of a licensee; and
(ii) advise the division in its investigation of these complaints.

Seems to me that an athlete agent assisting in the review of complaints on other athlete agents, particularly those who are competition and then advising the division in its investigation creates a number of potential problems. Hopefully the public member is the one who is designated to fill this role.

The DOPL site allows users to see who is registered and get fairly detailed info on athlete agents who are registered in Utah by going to the Verify a License link on the left. As of this writing, it looks as though most of the agents registered haven't gotten around to renewing as only eight of the 26 agents who have previously registered are listed as "ACTIVE".

If you plan to recruit student-athletes at the University of Utah, make sure to contact the compliance office first. According to the compliance office website:

All athletic agents must receive initial permission from the Compliance Office prior to contacting any student-athlete of the University of Utah. Severe repercussions are possible for violation of this rule, both to the agent and to the student-athlete.

The Utah State Aggies compliance office requires athlete agents to register before contacting a studet-athlete.

Tony Barnhart of the Atlanta Journal Constitution wrote about why Smith's suspension will be good for Alabama. In it he had these pearls of wisdom:

As a college athlete you have every right to talk to an agent and attempt to do what is best for your future. But you don’t have a right to keep playing college football. Choices have consequences. Bad choices have very bad consequences.

Andrew Brandt of the National Football Post, after making it clear that he has no knowledge of the violation, makes an important observation and addresses the reality of the situation in his Tuesday Thoughts:

That would not only violate the rule of coach Nick Saban but also the NFLPA rule for contact with juniors. Despite those rules, the competition from agents for a player like Smith would be intense and widespread, perhaps leading to improper contact that Saban discovered.

Mike Florio of ProFootballTalk recently posted that Junior Rule Violations Run Rampant:

A league source tells us that, in its second year of existence, the NFL Players Association’s rule prohibiting agents from talking to underclassmen prior to their entry into the pool of players who’ll be drafted in April isn’t working.

If this situation is indeed a result of improper contact with an agent, Andre Smith isn't the only one who is going to be punished. The agent(s) involved could also face punishment. As Darren Heitner of SportsAgentBlog.com recently covered, Alabama might not be the best place for an agent to get into trouble. Stay tuned.

50 States in 50* Days - Colorado (UPDATED)

The last time we looked at Colorado's athlete agent regulation, I noted that Colorado did NOT have a registration requirement. Well, that and more has changed.

The Colorado Uniform Athlete Agent Act took effect in July of this year and applies to offenses committed on or after January 1, 2009. Colorado joins the ranks of states who have adopted the Uniform Athlete Agent Act.

The Department of Regulatory Agencies (DORA) held a few public information sessions to let Colorado athlete agents know about the upcoming changes.

As of January 1, 2009, you may not practice as an athlete agent in Colorado without holding a certificate of registration. To register, head to the Office of Athlete Agent Registration's site to get all the information that you need. Registration will set you back $435 and compliance will be a yearly effort as all registrations expire on November 30 every year.

Did Improper Contact with a Sports Agent Lead to the Suspension of an All-American?

As several outlets have reported, All-American tackle Andre Smith has been suspended by Alabama for the Sugar Bowl. "Sources" informed the Mobile Press Register that the suspension is "thought to be tied to an improper association with a sports agent". The Tuscaloosa News has confirmed "that Smith was being investigated by the school about improper contact with a sports agent."

ESPN.com's Chris Low covers the Bad News for Alabama, Smith and leaves us with this:

The bigger question with Smith becomes the specifics of his improper dealings with an agent and when everything occurred.

Saban's message to his team, though, was loud and clear: Messing around with an agent is a quick ticket out of town ... even if you're Andre Smith.

Going International? - Player Agents and FIBA

Will 2009 be the year you take your representation practice global? If so, make sure you know what you're getting into. For those representing basketball players, FIBA provides a wealth of information on their website.

Earlier this year, FIBA Assist Magazine interviewed FIBA Secretary General Patrick Baumann about the role of player agents in FIBA's structure. The interview covers a ton of info on what FIBA's goal is with their agent regulation progam. Here are some highlights:

"FIBA certified agents will be the only ones allowed to make business for international transfers of players."
"...if you want to deal with international transfers, you need to become a FIBA-certified agent."
Yes, there is a test. Upcoming tests will be held in San Juan, Puerto Rico and in Geneva, Switzerland.
"In about three years we will not have a single person operating in the international scale and dealing with international transfers who is not a FIBA licensed agent."
FIBA originally estimated that about 200 people would end up becoming certified, but they already have over 130.
Info about who is required to become certified, what is will cost and on the Arbitral Tribunal (FAT) is also covered.

So you want to know what agents are certified? FIBA's got you covered with their database, searchable by name or country. As of today, 21 agents in the US are registered with FIBA.

Reggie Bush and Attorney David Cornwell Go Their Separate Ways

Jason Cole and Charles Robinson of Yahoo! Sports and Liz Mullen of the Sports Business Journal (via SportsBusinessDaily.com - subscription required) have reported that Reggie Bush and attorney David Cornwell have parted ways. Depending on who you believe, this either had to do with the lack of progress being made in the case or with Cornwell's desire to become the next head of the NFLPA.

NBPA Suspends Athlete Agent Andrews

50 States in 50* Days - Illinois Athlete Agent Regulation

Okay, okay. I realize that Illinois should have been up next in the 50 States in 50* Days Series, but can you really blame me? It is one of a handful of states that does not have a state law regulating the activities of its athlete agents. Cut me some slack while I try to make this post longer than three sentences.

Northern Illinois University's compliance folks have set up a webpage for Sports Agent / Financial Advisor information, but the links to the NIU Agent Policy and Agent Registration form aren't links at all.

Illinois is mentioned in Chapter 7 of The Business of Sports Agents Second Edition (review coming soon), as the authors discuss whether attorney agents are subject to the ethical rules that govern attorneys. A 1980 advisory opinion of the Illinois State Bar Association concluded that "when an attorney engaged in the private practice of law represents a client in contract negotiations and general business counseling, these activities constitute the practice of law." Pretty interesting considering that not many courts or governing bodies have even opined on the issue that in one state that has there isn't a law governing agent activity.

Not that attempts haven't been made. The Illinois Legislature has introduced the Uniform Athlete Agents Act a couple of times over the last several years, but obviously to no avail.

There is hope - Colorado recently passed the UAAA after some failed attempts - stay tuned for an update on the happenings in Colorado.

50 States in 50* Days - Indiana Athlete Agent Regulation

Trying to restore some order around here - the next stop in the 50 States in 50 Days Series is Indiana. Indiana, home to the NCAA, is another Uniform Athlete Agent Act state and agents are governed by the Indiana Uniform Athlete Agent Act .

Athlete agents who violate provisions of the Act may be liable for a felony and educational institutions may have a right of action against the agent as well as former student-athletes. In addition, an athlete agent who is guilty of violating provisions of the act may face civil penalties of up to $25,000 per violation.

Athlete agents are required to file a registration form with the Indiana Attorney General. Registration will cost you $700.00 and is good for two years.

The Indiana University Athletic Department Compliance office has developed a Guide for Athlete Agents and a questionnaire and registration form. Purdue also requires athlete agents to register with the athletic department.

Kudos to Ball State's Compliance office for putting out a ton of information regarding athlete agents and for making it clear to agents that registering with the athletic department does not mean that the agent has complied with Indiana's Uniform Athlete Agent Act registration requirements. The Ball State Athletic Department puts out its own Agent Policies and Procedures, Agent Questionnaire, Agent Terms and Conditions, and Guidelines for Agents. If agents are unsure about what is expected of them after reading these materials, then it might be time to find a new line of work.

50 States in 50* Days - North Carolina Athlete Agent Regulation

By special request, North Carolina leaps ahead of the list in the 50 States in 50* Days series. North Carolina is a Uniform Athlete Agent Act state.

The Athlete Agent Registration Office within the Department of the Secretary of State is responsible for the administration of the North Carolina Uniform Athlete Agent Act.

The Office provides a useful FAQ for athlete agents and every conceivable form that an agent could want (and one that they might not want to see with their name on it) .

The eleven page registration form is available online and registration will set you back $200. Luckily, the renewal application is only four pages, but you still have to pay $200.

An Athlete Agent Complaint Form is available on the Office's website. In addition to its intended use , the four-page complaint form also provides a good checklist for agents (and aspiring agents) on behaviors to avoid in their practice.

Finally, the Athlete Agent Registration Office also provides a handy listing of registered athlete agents.

The University of North Carolina's Athletic Department requires athlete agents to register annually by filling out a registration form or renewal form. North Carolina State also requires athlete agents to fill out a registration form.
