<h2 class="wp-block-heading">Create and Serve a 3 Day Notice to Pay or Quit</h2>



<p class="wp-block-paragraph">The first step in a successful non-payment of rent eviction in Irvine is to create and serve a proper &#8220;3 Day Notice to Pay Rent or Quit.&#8221; Then, a landlord must wait 3 full days, not including weekends or judicial holidays. If the tenant fails to pay the rent during the 3 day period, then the landlord must file the eviction, known as an &#8220;unlawful detainer,&#8221; at the proper courthouse.</p>



<h2 class="wp-block-heading">File the Unlawful Detainer</h2>



<p class="wp-block-paragraph">The landlord who wants to evict a Irvine tenant for non-payment of rent will need to file an unlawful detainer against the tenant at the courthouse. The eviction case will be asking the court for two things in the judgment. First, the Irvine landlord will be asking for possession of the property. <p class="has-ast-global-color-7-background-color has-background wp-block-paragraph">SB 610 is a new law in California that makes it clear that landlords are responsible for cleaning a property after disaster strikes.</p>



<p class="wp-block-paragraph">SB 610 adds Section 1941.8 to the California civil code. SB 610 says it is the duty of the landlord to do one or both when a disaster* strikes:</p>



<ol class="wp-block-list">
<li>Remove debris caused by the disaster</li>



<li>Mitigate hazards caused by the disaster, including but not limited to, &#8220;the presence of mold, smoke, smoke residue, smoke odor, ash, asbestos, or water damage.&#8221;</li>
</ol>



<p class="wp-block-paragraph">Under SB 610, and Civil Code 1941.8, a landlord is required to clean the property &#8220;within a reasonable time&#8221; after the damage occurs and up to government standards.</p>



<p class="wp-block-paragraph">If the tenant has provided the landlord with a postal or email address, the landlord is required to notify the tenant once to repairs are completed. The tenant has the right to view and receive copies of any &#8220;environmental studies, testing, or reports conducted.&#8221;</p>



<p class="wp-block-paragraph">SB 610 establishes a presumption that a property is uninhabitable while debris remains at the property, until a public health agency or official confirms that the debris does not contain any toxic substances.</p>



<p class="wp-block-paragraph">Once repairs are made, the tenant has the right to return to the rental at the same rental rate that was in effect before the disaster, unless the tenancy was terminated lawfully by either party.</p>



<p class="wp-block-paragraph">* A disaster is defined as &#8220;a natural or manmade emergency resulting from an earthquake, flood, fire, riot, storm, drought, plant or animal infestation or disease, pandemic or epidemic disease outbreak, or other natural or manmade disaster for which a state of emergency has been declared by the President of the United States or the Governor.&#8221;</p>



<p class="wp-block-paragraph">Landlords should start preparing now for the new SB 610 law.</p>

<p class="wp-block-paragraph">Under AB 414, a California landlord will be required to return the security deposit to the tenant electronically, if the tenant paid the security deposit electronically. AB 414 also requires landlords to notify the tenant in writing of the right to receive the security deposit electronically.</p>



<p class="wp-block-paragraph">AB 414 does not prevent both the landlord and the tenant mutually agreeing to transfer the security deposit by a method other than by electronic payment.</p>



<p class="wp-block-paragraph">AB 414 also says that at the end of a tenancy, the security deposit itemization may be sent to the tenant via email if an email address was provided by the tenant and if both parties agree, or mailed to the tenant via first-class mail.</p>



<p class="wp-block-paragraph">Landlords should start preparing now for the new AB 414 law.</p>

<p class="wp-block-paragraph">The Social Security Tenant Protection Act of 2025 relates specifically to non-payment of rent evictions in California. If a tenant stops paying the rent, qualifying tenants will be able to use the Social Security Tenant Protection Act of 2025 (AB 246) as a defense to an eviction.</p>



<p class="wp-block-paragraph">If the tenant experiences a loss of income because of an interruption in Social Security benefits due to an action (or inaction) of the federal government, the tenant can use this interruption as an &#8220;affirmative defense&#8221; to an eviction. The tenant wanting to use this affirmative defense would need to provide to the court evidence that Social Security payments have been terminated, delayed, or reduced due to no fault of the tenant and that this hardship prevented the tenant from paying the rent.</p>



<p class="wp-block-paragraph">If such evidence is provided to the court, the court would be required to put a hold on the eviction until either 1) 14 days after the tenant&#8217;s benefits are restored, or 2) 6 months after the hold took effect.</p>



<p class="wp-block-paragraph">AB 246, AKA the Social Security Tenant Protection Act of 2025, does not relieve the tenant of paying the rent forever. AB 246 requires the tenant to pay all past due rent, or come to a mutual agreement with the landlord regarding the payments, within 14 days of the benefits being restored. If the tenant does this, then the court would be required to either dismiss the eviction or set aside the judgment.</p>

Failing to do so can amount to a breach of the warranty of habitability.</p>

The law is AB 628, and it amends Civil Code 1941.1, which deals with tenant habitability.</p>

<p class="wp-block-paragraph">Effective January 1 ,2026, AB 628 requires a landlord to provide a tenant with &#8220;a stove and refrigerator that are maintained in good working order and are capable of safely generating heat for cooking purposes and capable of safely storing food&#8230;&#8221;</p>



<p class="wp-block-paragraph">A landlord and tenant may mutually agree at the inception of a tenancy that a tenant will provide and maintain their own refrigerator, if the lease does both of the following:</p>



<p class="wp-block-paragraph">First, the lease must contains the following statement &#8211; </p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow">
<p class="wp-block-paragraph">Under state law, the landlord is required to provide a refrigerator in good working order in your unit. By checking this box, you acknowledge that you have asked to bring your own refrigerator and that you are responsible for keeping that refrigerator in working order.</p>
</blockquote>



<p class="wp-block-paragraph">Second, the lease must inform the tenant that they may, within 30 days written notice, tell the landlord that they no longer want to maintain their own refrigerator, and if that happens, the landlord will need to provide a refrigerator in good working order.</p>



<p class="wp-block-paragraph">A landlord will not be required to maintain the tenant&#8217;s own refrigerator.</p>



<p class="wp-block-paragraph"> Landlords cannot condition a tenancy upon the tenant providing their own refrigerator.</p>



<p class="wp-block-paragraph">AB 628 specifically states that a stove or refrigerator that is subject to a recall does not meet the standards required under the law.</p>



<p class="wp-block-paragraph">AB 628 applies to residential tenancies in California entered into, amended, or extended, beginning on January 1, 2026.</p>



<p class="wp-block-paragraph">There are a few exceptions to the law.</p>



<p class="wp-block-paragraph">Landlords should start preparing now for the new AB 628 law.</p>
