It is unlawful to have an excessive blood-alcohol content (BAC) at the time of DRIVING - not at the time of being TESTED. Since it takes between 45 minutes and 3 hours for alcohol to be absorbed into the system, an individual's BAC may continue to rise for some time after he is stopped and arrested. Commonly, it is an hour or more after the stop when the blood, breath or urine test is given to the suspect. Assume that the result is .10%. If the suspect has continued to absorb alcohol since he was stopped, his BAC at the time he was driving may have been only .07%. In other words, the test result shows a blood-alcohol concentration above the legal limit - but his actual BAC AT THE TIME OF DRIVING was below.&lt;br /&gt;

In Georgia driving with a blood alcohol content of .08 or above is considered under driving influence. The permitted level for minor drivers is .02. For commercial drivers, the limit is .04. Anyone with a blood alcohol level of .15 or more may be subject to higher penalties.&lt;br /&gt;

An Aiken County woman who was involved in a fatal wreck, fled the scene and lied to police in an attempt to cover up her crime was sentenced Wednesday to one year in jail.&lt;br /&gt;
&lt;br /&gt;
Ginger Carpenter of Warrenville was set for trial this week on charges of leaving the scene of an accident involving a death. Instead of facing up to a possible 25 years in jail at trial, she pleaded guilty and was given the minimum sentence.&lt;br /&gt;
&lt;br /&gt;
 Flanked in court by her attorney and about a dozen friends and church members, Carpenter spoke in barely audible tones to Judge Markley Dennis Jr.&lt;br /&gt;
&lt;br /&gt;
The solicitor's office had negotiated a sentence of between one and five years for the crime, Dennis, swayed by the church support behind Carpenter, said "for everything I have heard, this case merits the minimum sentence."&lt;br /&gt;
&lt;br /&gt;
This is a no parole offense, so the defendant must complete more than 10 months before she is eligible for parole.&lt;br /&gt;
&lt;br /&gt;
On May 22, 2008, at about 1 a.m., two collisions happened on Storm Branch Road in Aiken County. Two motorcycles had a minor accident. Then, shortly afterward, Carpenter's 1997 Ford Exhibition hit James Alan Cohrs of Rita Court in North Augusta, killing him. &lt;br /&gt;
&lt;br /&gt;
According to testimony, the victim's blood was later discovered on the offending vehicle, and his heart and other organs were found outside of his body.&lt;br /&gt;
&lt;br /&gt;
At the time, law enforcement said it appeared as if Carpenter's vehicle struck a Harley Davidson driven by Michael Younts, 48, of Coventry Court in North Augusta and then drove 100 yards and struck the Harley Davidson that Cohrs was driving.&lt;br /&gt;
&lt;br /&gt;
Part of Carpenter's car were left behind from the impact, and her vehicle type was identified. &lt;br /&gt;
&lt;br /&gt;
The next day, after a plea from law enforcement, someone called police with information that Carpenter's vehicle had been damaged. She was arrested later that day.&lt;br /&gt;
&lt;br /&gt;
If the case had come to trial, it was said in court it would have come down to a "battle of the experts," according to Carpenter's attorney.&lt;br /&gt;

The “horizontal gaze nystagmus” is a form of field sobriety test. The Field Sobriety Test is a battery of tests administered and evaluated in a standardized manner to obtain validated indicators of impairment and establish probable cause for arrest. These are supposedly tests that are designed to check "divided attention", a critical skill in operating a motor vehicle.&lt;br /&gt;
&lt;br /&gt;
The "horizontal gaze nystagmus" test, a relatively recent development in DUI investigation. The officer attempts to estimate the angle at which the eye begins to jerk ("nystagmus" is medical jargon for eye jerking); if this occurs sooner than 45 degrees, it theoretically indicates an excessive blood-alcohol concentration. The smoothness of the eye's tracking the penlight (or finger or pencil) is also a factor, as is the jerking when the eye is as far to the side as it can go. This field sobriety test has proven to be subject to a number of different problems, not the least of which is the non-medically trained officer's ability to recognize nystagmus and estimate the angle of onset. Because of this, and the fact that the test is not accepted by the medical community, it is not admissible as evidence in many states; it continues, however, to be widely used by law enforcement.&lt;br /&gt;

In Georgia, field sobriety tests are optional but police officers are unlikely to tell you this. You are perfectly free to politely refuse to take the field sobriety tests in their entirety. There are a wide range of field sobriety tests (FSTs), including heel-totoe, finger-to-nose, one-leg stand, alphabet recitation, modified position of attention, fingers-to-thumb, hand pat, etc. Most officers will use a set battery of three to five such tests. Unlike the chemical test, where refusal to submit may have serious consequences, you are not legally required to take any FSTs. The reality is that officers have usually made up their minds to arrest when they give the FSTs; the tests are simply additional evidence which the suspect inevitably "fails". Thus, in most cases a polite refusal may be appropriate.&lt;br /&gt;
&lt;br /&gt;
Be careful before refusing a breathalyzer test. The Intoxilyzer 5000 is the most commonly used breathalyzer in Georgia.You risk revocation or suspension of your license if you refuse to take a breathalyzer test.  If you refuse, the police officer must read out to you an Implied Consent Form informing you about the consequences. &lt;br /&gt;

GAINESVILLE - Two unrelated shootings, one of them deadly, occurred within two hours of each other on Gainesville's Southside Monday night.&lt;br /&gt;
&lt;br /&gt;
According to Gainesville Police Lieutenant Carol Martin, officers went to Atlanta Street Apartments off E.E. Butler Parkway around 7:30 p.m. following reports a person had been shot.&lt;br /&gt;
&lt;br /&gt;
On the scene officers found a male victim in the apartment parking lot. He was taken to Northeast Georgia Medical Center where he was pronounced dead minutes after arrival. &lt;br /&gt;
&lt;br /&gt;
Martin said investigators are pursuing several leads, but as yet there are not arrests. Martin urged anyone with information to contact the Criminal Investigations Division at 770-534-5254. &lt;br /&gt;
&lt;br /&gt;
Then, around 10:30 p.m. two men were shot on Old Athens Road near Floyd Road.&lt;br /&gt;
According to Sheriff's Colonel Jeff Strickland, the victims were walking down the road when they became involved in an altercation with several other men and were shot; the shooting suspects fled in an unidentified vehicle. &lt;br /&gt;
&lt;br /&gt;
Both men were taken to Northeast Georgia Medical Center, where one man is listed in critical condition; the other man's injuries are described as non-life threatening. &lt;br /&gt;
&lt;br /&gt;
Strickland also urged anyone with information about the Old Athens Road shooting to contact the Hall County Sheriff's office at 770-536-8812. &lt;br /&gt;
&lt;br /&gt;
No arrests have been made in either incident.&lt;br /&gt;
&lt;br /&gt;
Victims in both shootings remain unidentified pending notification of relatives.&lt;br /&gt;

AUGUSTA, Ga. - Neighbors in one Augusta community say they are tired of the crime and took their complaints to the Richmond County Sheriff’s Office.&lt;br /&gt;
People who live in the Harrisburg community and deputies are working together to create a list of homes where they say crime is an every day occurrence.&lt;br /&gt;
“When we speak of chronic nuisance, we are talking about drug dealing, prostitution, harassment, discharge of weapons. This goes on in Harrisburg,” said Lori Davis, Harrisburg resident.&lt;br /&gt;
Richmond County's Crime Suppression team has a list of homes they are constantly watching.&lt;br /&gt;
“When we can make cases, we do. We do as much as we can where ever we can to fix the problems,” said Deputy Gabe Garner, Richmond County Sheriff’s&lt;br /&gt;
NBC Augusta 26 News was there as deputies searched a home on Tuesday. They arrested two people for drug paraphernalia.&lt;br /&gt;
According to the county's license and inspection office, the house is being used as a boarding house, but that's illegal because it's zoned for a single family home.&lt;br /&gt;
"He builds fake walls, builds plumbing for six rooms, when the inspection is done they are open for business,” said Davis.&lt;br /&gt;
Tenants say they pay 80 dollars a week to live here. Now, there's a sign saying they're going to have to leave. Inspectors say they're looking into five more homes just like this one that could be running illegally.&lt;br /&gt;
Neighbors say more needs to be done. Lori Davis, homeowner association president says she hardly sees any deputies at the newly opened substation.&lt;br /&gt;
"We have what they are calling a substation. But I have yet to see an officer there,” said Davis.&lt;br /&gt;
The sheriff's office says they’ve increased patrols in the area, with several teams driving through neighborhoods every day.&lt;br /&gt;

Phoenix Mercury star guard Diana Taurasi is expected to be named the WNBA's Most Valuable Player on Tuesday, the Arizona Republic reported.&lt;br /&gt;
&lt;br /&gt;
Taurasi led the WNBA in scoring for the third time and is averaging 23.8 points per game in the playoffs. The Mercury open their best-of-5 WNBA Finals series Tuesday night against the Fever at US Airways Center, where Indiana beat Phoenix earlier this season.&lt;br /&gt;
&lt;br /&gt;
"If you look at the list of people who won it, to be mentioned in that group is pretty special," Taurasi told the newspaper, asked what it would mean to her to win the award. "It's a special moment in someone's career. It would be a great honor."&lt;br /&gt;

Despite another stellar season on the court, Taurasi endured some off-court drama in July when she was arrested for DUI. She faces three drunken driving-related charges in the incident.&lt;br /&gt;

A Phoenix police report showed Taurasi's blood-alcohol level was 0.17 percent, more than twice the Arizona legal limit of 0.08. She is scheduled to appear in court on Oct. 31.&lt;br /&gt;

She was suspended two games without pay by the Mercury for "conduct detrimental to the team" regarding the incident.&lt;br /&gt;
&lt;br /&gt;
Mercury coach Corey Gaines told the Republic that Taurasi didn't let the DUI incident affect her play on the court.&lt;br /&gt;
&lt;br /&gt;
"I think all the humans on this Earth make mistakes," Gaines said. "I know I made many. But instead of saying, 'Woe is me' or worrying about it, [Taurasi] stood up and said, 'I did it. I'm wrong.' And she played through it &amp; and took care of business [on the court]. You can go two ways with that, feel sorry for yourself or stand up and say, 'Hey, I made a mistake' and work from there."&lt;br /&gt;
&lt;br /&gt;
Taurasi was the top pick in the 2004 WNBA draft after leading the Connecticut Huskies to three consecutive NCAA titles.&lt;br /&gt;

Bunnell, Fla. — Authorities say a Georgia man was driving naked on the highway in Flagler County, where he repeatedly flashed a woman and her 11-year-old son.&lt;br /&gt;
&lt;br /&gt;
A woman driving a tractor-trailer on Interstate 95 with her son in the cab Thursday reported that a naked man in a sport utility vehicle had been keeping pace with her and performing lewd acts. She told authorities that the man followed her for about 8 miles, but she was eventually able to get away by pulling into a weigh station.&lt;br /&gt;
&lt;br /&gt;
The woman reported the man and vehicle to the Florida Highway Patrol, and troopers say the caught up with 45-year-old Mark Duffus about 20 miles to the north on the highway.&lt;br /&gt;
&lt;br /&gt;
Duffus was charged with lewd and lascivious exhibition and indecent exposure. He was released Friday on $2,000 bail.&lt;br /&gt;

Last Friday West Georgia traffic enforcement, along with Alabama traffic enforcement officers and highway safety advocates, gathered at the Georgia Welcome Center on I-20 in Haralson County to hold a briefing about progress on the last day of the campaign. At that time, local officers shared a traditional handshake with Alabama officers in a pledge of their recommitment to reduce crashes, fatalities and serious injuries on the state roadways. As part of the collaborative initiative, officers on both sides of the state line conducted sobriety checks in various locations that led to numerous arrests throughout the day and night. &lt;br /&gt;
&lt;br /&gt;
With help from public safety partners from bordering states including Florida, North Carolina, South Carolina and Tennessee, Georgia saw a sharp decline in fatalities on Georgia roadways around the holiday this year. According to the GOHS, the state defeated predictions that 18 deaths would occur in Georgia this year. However, that number was reduced by half with a total of only nine deaths this year. GOHS Special Division Director of Special Operations Ricky Rich said results from this year show drivers are taking heed of the state’s “Operation Zero Tolerance” policy for drunk driving in order to make Georgia roadways safer. &lt;br /&gt;
&lt;br /&gt;
Meanwhile, the coordination of all the agencies was deemed a major undertaking, according to Haralson County Sheriff Eddie Mixon. He noted the number of public safety officers from Haralson County who participated in the effort was great enough to have a “meaningful impact” during the highway initiative.&lt;br /&gt;
&lt;br /&gt;
“The investment of manpower was significant enough to have meaningful impact on the highways. The goal is not only to save lives with the actual traffic stops, but to also spread the word that Georgia has Zero Tolerance when it comes to driving under the influence,” he said.&lt;br /&gt;
&lt;br /&gt;
In addition, the last night of the campaign was held in Bremen, yielding positive results.&lt;br /&gt;
&lt;br /&gt;
“There were a total of 28 arrests, six drug cases and 77 citations. Seven of those citations were for DUIs,” reported Carroll County Sheriff’s Office Srgt. Greg Holcomb, who also served as Western Regional Traffic Enforcement Network Coordinator for neighboring counties that participated in the campaign. “There were 136 people who did roadblocks in Bremen from 28 different agencies in Georgia.”&lt;br /&gt;
&lt;br /&gt;
While the campaign numbers still pour in with overall impressive results, the GOHS stressed alcohol-related deaths tend to be high during summer holidays wherein people drink and leave barbecues and other celebrations without a designated driver. In 2007, the agency reported more than 13,000 people died in highway crashes involving drivers with a blood alcohol concentration of .08 or higher. Furthermore, the GOHS contends Georgia’s accident data calendar also showed the summer travel period in the state is one of the most dangerous times on the highways.&lt;br /&gt;
&lt;br /&gt;
Therefore, GHOS emphasized the importance of spreading the word about safe driving, and before summer festivities begin, always designate a sober driver. In addition, the agency encouraged people to keep in mind that a buckled seat belt is the best protection against drunk drivers and other traffic accidents. &lt;br /&gt;

BRUNSWICK, Ga. — A 22-year-old man acted alone when he bludgeoned his father and seven others to death inside a coastal Georgia mobile home, police said Tuesday, though they would not give what weapon was used.&lt;br /&gt;
Guy Heinze Jr., who cried "my whole family's dead" when he reported the slayings in a frantic 911 call Aug. 29, was charged Friday with eight counts of murder. Arrest warrants showed each victim had been beaten with a blunt object. None had been shot, Glynn County police Capt. Jay Wiggins said.&lt;br /&gt;
Clint Rowe, an uncle to four of the dead, said he found it hard to believe they were all beaten to death unless they were drugged, especially with several grown men among those killed.&lt;br /&gt;
"They would've fought until the end," Rowe said. "Wouldn't you think one person would've had a hard time killing eight people with a blunt object without someone giving them a fight?"&lt;br /&gt;
Hours after the slayings were discovered, police jailed Heinze on charges of drug possession, evidence tampering and lying to police. He was released on bond but charged with the killings nearly a week later.&lt;br /&gt;
His attorney, Ron Harrison, said Heinze was not involved in the slayings.&lt;br /&gt;
"He's upset and aggravated at being placed back in jail and is totally distraught over the whole situation," Harrison said.&lt;br /&gt;
Police have released few details about the brutal attack, including a possible motive, saying they don't want to reveal anything that could jeopardize the case.&lt;br /&gt;
The dead included the suspect's father, 45-year-old Guy Heinze Sr., and six members of an extended family the Heinzes lived with in a 980-square-foot mobile home just north of the port city of Brunswick, midway between Savannah and Jacksonville, Fla.&lt;br /&gt;
Also killed were Rusty Toler Sr., 44; his sister Brenda Gail Falagan, 49; and Toler's four children: Chrissy, 22; Russell Jr., 20; Michael, 19; and Michelle, 15.&lt;br /&gt;
Chrissy Toler's boyfriend, 30-year-old Joseph L. West, was also killed. Her 3-year-old son, Byron Jimerson Jr., survived the attack with serious injuries — for which Heinze has been charged with attempted murder.&lt;br /&gt;
District Attorney Stephen Kelley said he won't make a decision on whether to seek the death penalty until after Heinze is indicted.&lt;br /&gt;
