<h2>What Is an Executory Contract?</h2>
<p>An executory contract is an agreement that has not yet been fulfilled. For example, if you agree to purchase an item with payment on delivery, the contract remains executory until the merchandise is delivered and you make payment.</p>
<p>Another type of executory contract involves an agreement where you and the other party maintain ongoing obligations to each other, such as:</p>

<li aria-level="1">Cell phone contracts</li>

<li aria-level="1">Home security services with a monthly subscription fee</li>

<p>Many contracts contain language saying that the agreement terminates immediately if one party declares bankruptcy, but these provisions may not be enforceable. The other party is entitled to seek assurances that you will honor your obligations, so you may need to make a security deposit or get a co-signer.</p>
<h3>Rejection</h3>
<p>You can choose to reject the contract, which means you will no longer be required to perform under its terms. The other party may file a claim for damages with the bankruptcy court, and your outstanding balance would be treated like the other dischargeable debts in your case. But often their last stop right before bankruptcy is debt settlement. There are a lot of companies out there that offer debtors the opportunity to settle their debts with creditors for &#8220;pennies on the dollar.&#8221; Sound too good to be true? Well, many debtors coming to bankruptcy court after going through &#8220;debt settlement&#8221; have found that at least in their case, it is too good to be true. What a lot of debt settlement companies fail to tell their customers is that debt settlement is risky and not guaranteed. The debt settlement companies require upfront fees; but they can&#8217;t guarantee the debtor that the creditor will accept the debt settlement offer. Many debtors go through debt settlement and still end up having to file bankruptcy because their creditors would not accept the debt settlement offer.<br />
The other problem with debt settlement is that many debtors, actually most debtors are not good candidates for debt settlement. The best candidates for debt settlement are people who have so much income and/or assets that bankruptcy is not a viable or easy option. These people can afford to pay debt settlement fees and can afford to pay for the taxes owed on the forgiven debt. Yes, debt settlement leaves a tax bill.<br />

<h2>How Long Does Chapter 7 vs. Chapter 13 Bankruptcy Take?</h2>

Because Chapter 7 basically eliminates all debt quickly, it can take between four and six months after you file the case. <li>Complete secondary counseling within 45 days after the Meeting of Creditors</li>

If you don’t qualify for Chapter 7, you will likely qualify for Chapter 13. Although there are limits on the amount of debt you can have to file Chapter 13, there are no limits on your income.</p>

										<content:encoded><![CDATA[<p><i>Bustle </i>reports that actor Andrew Garfield claims bankruptcy was one of the best things that has ever happened to his family.</p>
<p>His roles in <em>The Social Network</em> and <em>The Amazing Spiderman</em> brought Garfield fame and success, but his family had not always been so financially fortunate. Garfield looks back on those finacial struggles and views them in a somewhat positive light because he and his family were fortunate enough to learn important life lessons came from those struggles.</p>
<p>When Garfield was about 12 years old, his father became bankrupt. Garfield claims it was the best thing to happen to their family because his father &#8220;&#8230;realized all the people he loved were still there&#8230; his wife, his kids, his friends, himself. He was brought to his knees and totally humbled, and then he started doing more of what he was called to do.”</p>
<p>His father then went on to do what he loved: he became a swimming coach at a local club in Surrey, England.</p>
<p>Seeing what his father went through taught Garfield a very valuable life lesson. &#8220;My main goal in this life is to cultivate and rub up against the people, the places, the projects, the practices — that’s alliteration there with the p’s — that make me feel most alive&#8221;. Seeing his father burdened financially and come out of it a happier person is what gave Garfield his drive to take up passion projects.</p>
<p>This passion he accumulated displays in his successful career. In his 15+ year long career, Garfield has obtained hundreds of nominations including two Academy Award Nominations and has won several awards including a Golden Globe award &amp; Tony Award.</p>

<p>&#8220;If you are a renter having trouble paying your rent or a landlord who has lost rental income due to challenges presented by the COVID-19 pandemic, help may be available. Through funding from the U.S. Department of the Treasury’s Emergency Rental Assistance (ERA) program, there are a wide variety of state and local programs that offer assistance—including financial assistance—to those who are struggling to make ends meet. Provided below are links to learn more about ERA programs in your local area, including how they work and who is eligible, as well as other important information to help you navigate these difficult times. ERA programs can vary based on locale since flexibility is given to states to develop programs that best suit the needs of their communities.</p>
