BERSIH 3.0: A Report from Paris, France

It all started with a word. BERSIH. Which in turn inspired an idea. Which in turn inspired a nation.

I arrived in France about a year ago. Unlike most Malaysians who live in the
capital,i stay and work in Grenoble, which is 575km from Paris. Nevertheless, I bought my ticket the minute I heard Paris was joining BERSIH3.0. Even though I believed in what the yellow protest stood for, I was always sceptical about how a group of people wearing yellow could ever hope to clean a corrupted election process supported by a government 55 years strong.

Then, came last year’s rally. I was converted. Many people do not realise it but this is an exciting period for Malaysia. Never has there been a time in history where the ground is so fertile for change.

Our generation of Malaysians have in their power to secure a free and democratic future for subsequent generations. This would be our Berlin Wall. It would be our Renaissance. A second coming. The rebirth of a free and democratic Malaysia. And it all started with a word. So, I bought my ticket.

Paris was wet. More than usual. I always thought London was the one with the piping problems but it seems even the fashion capital of the world also suffers from it.

After Saturday’s experience though, I think Paris could also be rebranded as the protest capital of the world. The city does house a lot of “protestation”. As soon as I arrived at the Esplanade du Trocadéro, I was greeted by a group of green men making fun of Sarkozy and Hollande’s ignorant stand on the environment. It was Green Peace.

Shortly after, it was the folks from Guinea-Bissau and their noble cause to eradicate child slavery. Then, when we were painting the Eiffel yellow, another group was waiting at the entrance to paint it red afterwards. France! The land where freedom of speech means something more than just words scribbled on a fancy piece of paper.

I think there is something symbolic about showing dissent in Paris. After all, France inspired modern democracy. It was based on these ideals Malaysia was formed and freed from imperialism. Yet close to 55-odd years or so we find ourselves in an undemocratic fix. Who would have ever thought that demand for free and fair elections is now a cause for protest. Our founding fathers must be rolling in their graves.

Hence the colour yellow. Yellow to clean out the dirty fellows. And thus, more than 60 Malaysians spread out throughout France convened on the capital on April 28, 2012 at 12.22pm with typical Malaysian sense of timing (it was supposed to be at 12pm).

I arrived earlier than anyone else. It was cold, about 9°C, but I didn’t feel it at all. My blood was racing. Despite the biting chill, I unzipped my overcoat and took a seat facing the Green Peace protest and waited. Not for too long. Before I knew it, there was a Malaysian couple beaming at me. It rocked my world when they said they would have gone home if they did not see my yellow T-shirt. We talked about why BERSIH was important to us. They were older and have stayed out of KL for much longer than I have. Age and race also separated us but they echoed my feelings like a mirror. So we stood close together. Now we were three.

Ten minutes later, I received a call from one of the event organisers. She was driving her car and carrying all manner of yellow merchandise. The roundabout in front of the esplanade was busy. She couldn’t stop for more than five minutes. We rushed over to help. All sizes of cars zipped by but it was not hard to spot her. Her car was yellow. It was only natural.

First, we had a picnic. We set up camp on the Jardins du Trocadéro, which was a long field of green leading up to the Eiffel. Some kind souls have sacrificed their night to conjure up various Malaysian dishes. Looking at the briyani and fried mee hoon, my tummy grumbled with appreciation. It was a taste long missed.

Our group swelled in numbers. Some people visited for a short while just to say how proud they were to be part of the movement. Most people stayed and the atmosphere soon turned festive. Diverse would be an understatement. We had Malaysians from each layer of our complex society. Young, old and the numerous races were well represented.

I learned something funny about Malaysians on that day. It seems we lose our bangsa the minute we fly out of KLIA. Instead of being Malay, Chinese, Indian, Kadazan, Bidayuh and so on, we become just Malaysians. It was wonderful.

It was also important to note that Malaysians were not alone. We had support from people from other countries as well. There were passionate supporters from France, Germany, Taiwan, Singapore, Puerto Rico, Vietnam, India and even Iraq.

Looking at those smiling understanding faces, I realise that even though the situation might have been Malaysian but the cause was a definitely global. What we are facing in Malaysia stirs up the same sentiment in all men regardless of nationality or age. We all shared the same desires. And thus we protest.

Once the tummies have been filled with food and the heart with merriment, we set out to do the serious business of dissent. Armed with flags, signboards, puppeteers and drama actors, we were going to share our voices to the thousands in Malaysia who have already made their stand.

The weather was unfortunately against us. It started to rain. The temperature plummeted and the sky kept to a moody grey. Alien weather to tropical Malaysians used to a steady temperature and one-layer clothing. Despite that, we marched out determinately on to the sturdy pavement that Paris is famed for.

Heavy overcoats were unzipped to expose yellow shirts, armbands boldly tied around the upper arms and more than a few donned blazing yellow raincoats. We paid our respects to a postcard background. And finally when all Malaysians young and old were gathered along with our friends from across the globe, we joined our spirits together and chanted the word that kept the Election Commission chairman awake at night.

After all, it all started with that word. A word so simple yet so profound that it was the cause of hundreds of thousands of Malaysians taking to the streets back in the motherland. One word to unite all Malaysians regardless of age, race or religion. One word to clean them all… BERSIH!

Seberang Prai councillor Bakhtiar dies in road accident

TASEK GELUGOR: Seberang Prai Municipal councillor Bakhtiar Appandi Yahya died after being involved in an accident with a lorry in Taman Desa Sena Indah here Thursday.

The driver, in his 30s, was beaten up by the witnesses, armed with crash helmets, when he came down from his lorry to check on Bakhtiar's condition.
He had to be rescued by a police team. He was then sent to the Kepala Batas Hospital where he was warded with head and body injuries.
His lorry was torched.
The 56-year old two-term councillor, a pest control company branch manager, was said to be heading to his Lorong Desa Sena 11 home on a motorcycle when the incident happened at about 5pm.
He died on the spot due to head and body injuries.
Fellow councillor S. Guanalan said he had just met Bakhtiar in a meeting at the coucil headquarters in Bandar Perda, Bukit Mertajam, at 2.30pm.
“I was chatting with him after the meeting ended at 4pm, and he left for home several minutes later. I could not believe it when I head the tragic news later.”
Council president Maimunah Mohd Sharif said she was shocked to hear of Bakhtiar's sudden demise, noting that fellow council employees and councillors would miss him.

“He was a jovial person and I remember him dancing when I sang a song during the council's Hari Anugerah ceremony in the Bertam Sports Complex recently.”
She added that it would be a sad day at the full council meeting Friday, noting that council secretary Rozali Mohamud would proceed to read aloud the answers to the written questions which Bakhtiar had submitted earlier.
Bakhtiar's remains were buried at Masjid Kampung Bonggol, here at 11pm Thursday night.

DAP Leaders will be at 901, says Guan Eng

KUALA LUMPUR, Jan 7 — Lim Guan Eng said today that DAP leaders will be present at the Monday rally to show support for Datuk Seri Anwar Ibrahim when the court here delivers its verdict on the opposition leader’s sodomy trial.
“For 901, DAP leaders will be present, that’s all. That is our standard response,” the DAP secretary general told reporters today.
But the Penang chief minister refused to say whether members had been mobilised to participate in the demonstration.
PKR deputy president Azmin Ali had announced on Tuesday that PKR had the cooperation of Pakatan Rakyat (PR) partners PAS and DAP to gather over 100,000 people in a show of support for Anwar when the KL High Court finally rules on the two-year-long sodomy trial.
The Gombak MP also guaranteed yesterday the mass rally will be peaceful.
Azmin, however, said earlier today PKR does not accept conditions set by police for Monday’s public rally as they were only outlined after the party had obtained police permission to gather at the Jalan Duta court complex.
Sentul police had issued 10 conditions last night, barring participants supporting Opposition Leader Anwar from “making noise” and disallowing any speeches from being made.
The conditions also bar participants from carrying any banners to support the PKR de facto leader at the gathering which is being held as the High Court here delivers its verdict in the highly-charged Sodomy II trial.
The police had met a PKR delegation yesterday morning before deciding to allow the rally to go ahead in the parking area of the court complex.
No conditions were mentioned by Kuala Lumpur police chief Datuk Mohmad Salleh during a brief, joint press conference with PKR after their meeting.
PKR leaders have also said no conditions were set during the meeting.
Anwar, 64, is charged with sodomising former male aide Mohd Saiful Bukhari Azlan at a condominium in upscale Damansara Heights here in June 2008, a few months before returning from a decade in the political wilderness and winning back his Permatang Pauh parliamentary seat.
This represents the second time he has been prosecuted for sodomy.
If found guilty, he could spend up to 20 years behind bars but will escape the caning penalty as he is over 60. It would effectively spell the end of his political career and his chance to be prime minister.

Kes liwat: 'Perang biologi' atas Anwar?

Sepuluh tahun dahulu Setiausaha Pertahanan Amerika Donald H.Rumsfeld telah ditanya oleh wartawan tentang niat Amerika untuk menyerang Iraq. Rumsfeld telah memberi satu jawapan klasik ' There are known knowns ... there are known unknowns... there are also unknown unknowns' — atau ada pekara yang diketahui dan kita tahu... ada pekara diketahui tetapi kita tidak tahu...ada pekara yang tidak diketahui dan kita tidak tahu.
Dua belas tahun dahulu Anwar Ibrahim telah dituduh meliwat pemandu peribadinya Azizan Abu Bakar. Pada tahun 2004 kes liwat ini telah dibuktikan tidak berasas dan Anwar dibebaskan. Fakta pembebasan Anwar ini diketahui dan kita semua tahu. Anwar Ibrahim dipenjara selama 6 tahun bukan kerana meliwat tetapi kerana salah guna kuasa. Tentang fakta salah guna kuasa ini ramai yang tidak tahu dan ramai yang buat-buat tidak tahu.
Pilihanraya ke 12 - Pakatan Rakyat telah mendapat sokongan ramai dan berjaya menafikan Barisan Nasional majoriti dua par tiga di Parlimen. Anwar Ibrahim dilantik menjadi Ketua Pembangkang. Pakatan Rakyat telah menyediakan diri untuk mengambil alih pertabiran kerajaan Malaysia. Pakatan Rakyat juga mencadangkan Anwar Ibrahim sebagai Perdana Menteri Malaysia dalam kerajaan Pakatan Rakyat. Semua ini diketahui dan kita semua tahu.
Pada 28 Jun Saiful Bukhari telah membuat laporan polis bahawa dia telah diliwat oleh majikannya yang bernama Anwar Ibrahim. Ini pekara diketahui dan semua orang tahu.
Pada 1 Julai 2008 Balasubramaniam anak lelaki Perumal telah mengeluarkan Surat Akuan Bersumpah dimana secara terang dan jelas dia mengumumkan kepada dunia bahawa Altantuya Shaariibuu ialah bekas kekasih Najib Razak. Balasubramaniam juga memberitahu kepada dunia bahawa Najib juga telah meliwat Altantuya. Fakta ini ada yang tahu dan ada yang buat-buat tidak tahu. Untuk yang ingin tahu fakta ini ada tercatit - fasal 25 pecahan 2 - dalam Surat Akuan Bersumpah Balasubramaniam. Kalau tidak baca pasti tidak tahu. Susudah membaca jangan buat-buat tidak tahu.
Pada Isnin 9 Januari minggu hadapan Mahkamah di Jalan Duta akan mengumumkan keputusan tuduhan Saiful terhadap Anwar. Ini pekara diketahui oleh semua warga. Tetapi ada pekara-pekara yang ramai warga buat-buat tidak tahu. Banyak juga pekara diketahui umum tetapi ada warga sengaja tidak hendak tahu. Ramai juga warga yang tahu duduk perkara tetapi sengaja buat tidak tahu.
Ramai yang tahu bahawa Saiful telah tidak terberak selama dua hari kerena dalam juburnya ada bahan bukti — air mani Anwar Ibrahim. Ramai tahu bahawa Saiful telah memasukan plastik ke dalam jubur untuk menahan dari terberak. Tetapi ramai juga tidak tahu bahawa umur air mani tersimpan dalam jubur tidak mungkin melintasi 48 jam walau pun air mani itu milik arwah Superman Christopher Reeve.
Ada warga yang tahu bahawa Saifol Bukhari ini telah menemui Najib Razak sebelum membuat laporan kepada polis. Ada yang tahu bahawa Najib mengumumkan Saiful datang ke rumahnya untuk meminta biasiswa sesudah dibuang dari universiti. Tetapi ramai yang tidak tahu bahawa jika ada sesiapa yang gagal dalam peperiksaan mereka boleh melamar biasiswa untuk menjadi pemandu kapal terbang dari Najib Razak sendiri.
Ramai yang tahu Datuk Dr. Mumtaz Jaafar Begum ialah pelari terpantas negara satu ketika dahulu. Tapi ramai yang tidak tahu bahawa Datuk Dr. Mumtaz Jaafar Begum tidak pernah lulus pepereksaan LCE. Ramai yang hairan dan tidak tahu bagaimana Mumtaz Jaafar ini berjaya mendapat ijazah doktor. Masih ramai pula yang tidak tahu bahawa Datuk Dr.Mumtaz Jaafar ialah pembantu kepada Rosmah Mansor — isteri Najib Razak. Paling ramai yang tidak tahu bahawa Dr. Mumtaz Jaafar itu ialah ibu angkat kepada Saiful Bukhari.
Ramai warga tidak tahu apakah yang dibuat oleh Anwar Ibrahim pada 26hb Jun 2008 di Unit 1151 Kodominium Desa Damansara di Jalan Setia Kasih Kuala Lumpur. Warga tidak diberi tahu bahawa pada hari yang berkenaan Anwar Ibrahim sedang mengadakan perbincangan sulit tentang kedudukan ekonomi negara dengan 5 orang ahli ekonomi negara. Perbincangan ini menjadi sulit kerana 5 orang pakar ekonomi ini masih bekerja untuk kerajaan. Fakta ini tidak diketahui umum malah mahkamah pula tidak mahu tahu.
Ramai yang tidak mahu tahu bahawa kes liwat Anwar Ibrahim ini bukan kes lubang jubur Saiful terkoyak. Atau kes Anwar Ibrahim merogol pembantunya dengan ganas. Kes liwat Anwar Ibrahim ini ialah kes politik. Kes politik - pertempuran dua pandangan dunia politik Melayu. Tentang ini ramai yang tidak tahu dan ada yang buat-buat tidak tahu.
Najib Razak mewakili garis politik Ketuanan Melayu. Garis politik ini telah mengajukan Dasar Ekonomi Baru dalam usaha untuk menyelesaikan kemiskinan manusia Melayu dalam negara ini. Selama lebih dari 40 tahun dasar yang dibawa oleh politik Ketuanan Melayu telah berjaya mengkaya-rayakan sekumpulan kecil Melayu manakala majoriti Melayu masih dalam tahap kemiskinan. Fakta sedemikian ini ramai yang tahu dan mustahil ada yang tidak tahu.
Manakala Anwar Ibrahim cuba membuka wacana baru dengan politik Ketuanan Rakyat. Ajenda Ketuanan Rakyat ini amat menarik terutama dikalangan jenerasi muda. Ketuanan Rakyat ini menarik kerana ianya menolak garis perkauman, menolak parti-parti yang berasakan kaum dan membuka wadah politik yang berkemungkinan membawa kesaksamaan derajat untuk anak semua bangsa. Tentang politik baru ini wajib ambil tahu dan jangan buat-buat tidak tahu.
Ketuanan Melayu Najib Razak disokong oleh kaum pemodal dan kapitalis yang besar. Najib juga dibantu juga oleh para cukong China yang luas jaring ekonominya. Dalam masa yang sama Najib Razak mendapat sokongan peniaga-peniaga dan kontraktor Melayu yang besar ekonominya. Para peniaga ini berjaya kerana Dasar Ekonomi Baru tetapi masih bergantung nyawa dan menunggu sokongan kerajaan. Ini semua orang tahu.

Manakala Anwar Ibrahim disokong oleh kaum pemodal pertengahan yang nafas mereka turun naik kerana mereka tidak tersenarai atau dinobatkan sebagai kroni United Malay National Organisation. Kaum pemodal dan para kontraktor kecil ini berharap jika Anwar Ibrahim menjadi Perdana Menteri maka perniagaan mereka dapat sokongan untuk membesar. Anwar juga disokong para peniaga kecil, tuan empunya warong dan orang-orang yang tidak dipedulikan oleh United Malay National Organisation. Fakta ini masih ada yang buat buat tidak tahu.
Justeru - Najib dan Anwar ini memiliki sokongan yang luas dan tegar. Penyokong Anwar dan penyokong Najib datang dari latar belakang kelas yang berasingan. Punca-punca ekonomi membezakan penyokong Anwar dan penyokong Najib. Bila membaca ekonomi dijadikan asas menganalisa politik maka ramai penganalisa politik jadi bebal kerana mereka tidak tahu. Selama ini mereka hanya menganalisa watak Najib dan watak Anwar. Ramai yang tidak diberi tahu dibelakang pertempuran dua politikus Melayu ini ialah kaum pemodal yang sentiasa ingin tahu siapa yang wajib disokong.
Kalau bumi retak dan langit runtuh ianya tidak akan mengubah apa-apa keputusan pada hari Isnin depan. Malaysia tahu Anwar Ibrahim akan didapati bersalah. Anwar akan dinafikan hak untuk bertanding sebagai ahli parlimen. Anwar akan merayu. Lima tahun kemudian di mahkamah rayuan Anwar Ibrahim akan didapati tidak bersalah. Ketika ini Anwar Ibrahim telah botak dan berumur 71 tahun.
Ada sesiapa lagi yang tidak tahu apa yang sebenarnya sedang dilakukan oleh Najib? Ini namanya perang bioloji. Kalau Najib tidak memenjarakan Anwar dan mematikan gerak langkah politik Anwar , Najib sendiri akan masuk ke penjara dan United Malay National Organisation akan tutup kedai. Jika ini berlaku barulah seluruh Malaysia tahu bahawa bekas pembantu Anwar Ibrahim yang bernama Saiful Bukhari hanyalah cacing kerawit dalam usus politik perang bioloji Najib Razak.
Berhenti sebentar! Sebelum hari Isnin ini sampai ada satu pekara lagi yang tidak diketahui tetapi masanya telah sampai untuk di ketahui. Pekara tahu yang wajib diketahui oleh seluruh warga Malaysia ini ialah peranan Amerika, United Kingdom, Turkey dan Indonesia. Atau lebih senang lagi apakah peranan Barak Obama, David Cameron, Recep Tayyip Erdogan dan Susilo Bambang Yudhoyono dalam menentukan keputusan kes Anwar liwat Saiful ini.
Apakah pembaca terperanjat apabila tahu ada kuasa luar yang masuk campur dalam kes Anwar liwat Saiful ini? Jangan terperanjat kerana seperti kata Donald H. Rumsfeld "...there are also uknown unknowns..." atau ada pekara tidak tahu dan kita sendiri tidak tahu yang kita tidak tahu.

Penang is one of the most popular tourist destinations in Malaysia. Prosecution finishes closing arguments in opposition leader Anwar Ibrahim’s sodomy trial

KUALA LUMPUR, Malaysia — Prosecutors wrapped up their closing arguments in the sodomy trial of opposition leader Anwar Ibrahim on Tuesday, saying there is evidence beyond reasonable doubt to convict him.
Anwar faces up to 20 years in prison if found guilty of sodomizing a 26-year-old male former aide. A conviction could also prevent him from running in national elections widely expected next year.

Prime Minister Najib Razak has denied Anwar’s allegation that the government cooked up the charge to crush his political career.

Government prosecutor Yusof Zainal Abiden told the Kuala Lumpur High Court that Anwar had failed to adequately dispute DNA evidence and claims by the prosecution that he was present at a condominium where the incident allegedly occurred in June 2008.

Anwar’s former aide, Saiful Bukhari Azlan, has testified that Anwar forced him to have sex in an apartment. Prosecutors presented DNA samples from semen found on Saiful’s body that allegedly matched Anwar’s.
Yusof rejected the defense’s insistence that the DNA samples could have been illegally obtained from Anwar and planted on Saiful, and that the samples had been mishandled during the process of gathering evidence.

“The offense of carnal intercourse against the order of nature committed by (Anwar) has been proven beyond reasonable doubt,” Yusof said. “We urge (the court) to find him guilty as charged.”

Hearings are expected to conclude Thursday with final statements from the defense.

Anwar’s lawyers have called Saiful a liar, saying it was unimaginable that he did not attempt to flee Anwar’s alleged advances.

The defense also says Anwar, 64, has back problems that would have prevented him from committing the act as Saiful had described. Yusof said a government doctor who examined Anwar disagreed.

Anwar, a married father of six children, was charged with sodomizing Saiful soon after the opposition clinched control of several Malaysian states in 2008 general elections. He claimed the government was trying a second time to ruin him through sex charges.

Anwar lost his post as deputy prime minister in 1998 after being charged with sodomizing his family’s ex-driver and abusing his power to cover up his actions — both of which he denied. Malaysia’s top court quashed the sodomy conviction and released him in 2004.

Sodomy II: Testimony of defence witnesses trashed

The prosecution's submission in the Kuala Lumpur High Court today caps the long-running sodomy trial involving Anwar Ibrahim.

This is also expected to be the last appearance for prosecution head Yusof Zainal Abidin (left) as Solicitor-General II.
His third application for optional retirement since 2009 has been accepted and he will retire on Jan 1 or Feb 1, 2012 regardless of the trial outcome.
Yesterday, Justice Mohamad Zabidin Mohd Diah had heard a three-part submission by the defence team which called for an acquittal on grounds of reasonable doubt.
Central to its argument was the credibility of star prosecution witness and complainant Mohd Saiful Bukhari Azlan.
The submissions attemped to place him at the "epicentre of the conspiracy web" involving Anwar's "nemeses" - then deputy premier Najib Abdul Razak, then police chief Musa Hassan and SAC Mohd Rodwan Mohd Yusof.
Lawyer Sankara Nair also called Saiful a "consummate liar" .
Saiful’s alleged romantic affair with DPP Farah Azlina Latif, who was on the prosecution team until the allegations arose, was brought to the fore with lead defence lawyer Karpal Singh calling for an adjournment to recall Saiful and to summon Farah Azlina to disprove claims about the relationship.
Counsel Ram Karpal cited unchallenged evidence on the lack of degradation in the DNA samples from Saiful's rectal swabs, despite these being held for about 96 hours without preservation before testing.
He submitted that this casts doubt that the samples, which were never proven to be from sperm cells, had indeed come from Saiful's anus.
LIVE REPORTS
1.35pm: The public gallery is filling up. Both the defence and prosecution teams have arrived, but some have yet to enter the courtroom.
1.45pm: Anwar arrives with an entourage of family members and PKR leaders.
1.47pm: Solicitor-General II Yusof Zainal Abidin begins his submission.
1.48pm: He says the defence has tried to raise the points that the offence never happened, could not have happened, and that the DNA specimens collected by Hospital Kuala Lumpur had degraded in quality.
"(And) No 4, that even if these have degraded, they did not come from sperm cells," he says.
1.50pm: Yusof says the court "may wonder why (Anwar) chose not to make a statement under oath".
"Was he afraid there would be unfair cross-examination? That wouldn't be true...as the court can protect him from unfair statements."
He contends that the court can draw any inference from Anwar's hesitance to be cross-examined.
1.51pm: Yusof submits that Anwar's statement from the dock "does not dispute" the facts of the case.
"I didn't do it, and that was all," he says.
Anwar's statement, Yusof submits, does not dispute the CCTV recording placing complainant Mohd Saiful Bukhari Azlan at Desa Damansara on the day of the alleged incident, or that the documents were sent by Saiful to Anwar there, on the instructions of the latter's chief of staff.
"(Without dispute) it amounts to an admission, and must be taken as corroborative evidence against (the accused)," he says.
1.54pm: He submits that Anwar must explain why sperm was found on Saiful's rectal swabs.
"Failure to explain would amount to failure to enter a defence."
1.56pm: The defence submissions on the credibilty of Saiful and the two Chemisty Department chemists have already been considered in the prima facie finding, he points out.
2pm: Referring to the alleged conspiracy involving then deputy premier Najib Abdul Razak, as submitted by defence counsel Sankara Nair, Yusof says: "The meeting took place on June 24, 2008, the offence was committed June 26 and the (police) report was lodged June 28. What conspiracy are we talking about?
"Neither Saiful or Najib could have forced (Anwar) to do what he is supposed to have done. It would have involved willing participation of the accused."
2.05pm: On the testimony of Saiful's college-mate Mohd Najwan Halimi, Yusof said the witness said Saiful had "leadership qualities, principles and (is) firm".
"But suddenly in the next hour, (they) say this man cannot be trusted," he says.
Mohd Najwan had testified that he had emailed Anwar to say that Saiful cannot be trusted as he is a BN stalwart and believes that Anwar is munafik (hypocrite).
Yusof submits that Mohd Najwan feels a "tinge of jealousy", as Saiful - and not he - was hired as Anwar's aide.
Mohd Najwan now assists Anwar in the latter's capacity as Selangor economic advisor.
2.10pm: Yusof refers to the statement by Dr Mohd Osman Abdul Hamid, that Saiful claimed that plastic had been inserted into his anus.
Saiful had testified that he did not know this was written in the medical report, nor did he say it, says Yusof.
"It is my submission that (the doctor) is not credible or truthful."
2.15pm: He submits that the defence had concluded that Saiful is a younger and stronger man, so could have fended off Anwar's overtures.
"In regard to the act itself...(Anwar) never said I could have done it because physically I am not capable.
"Dr (Thomas) Hoogland (left) was brought in to say this. He had operated on Anwar...in 2004...and between 2005 and 2007 (Hoogland) did not see him."
Yusof submits that Hoogland "did not really know the state of Anwar's physical health" and was "speculating".
2.22pm: Selangor Menteri Besar Abdul Khalid Ibrahim is spotted in the public gallery.
2.26pm: Referring to CCTV footage of Anwar picking up his coat in a lift, Yusof says the real-time footage shows he was "not troubled" by any back pain.
2.30pm: HKL doctor Dr S Jayeindran, who had examined Anwar on July 16, 2008, had testified that the politician was not in pain.
"This was about a month after the alleged incident, compared with Hoogland who has not seen Anwar since 2007.”
2.31pm: "We have the direct evidence of Saiful, the findings of the chemists, the CCTV and Jayeindran, as opposed to Hoogland who was speculating...his opinion is of some dispute," Yusof submits.
Yusof says Hoogland is "trying his luck" as he was going beyond what had happened "outside of his operating theatre".
2.35pm: Yusof refers to defence witness Dr David Wells' (right) testimony that it is unlikely to find sperm cells in the anus after 65 hours.
"What you think cannot happen is not the same as what happens. (Government chemist) Dr Seah (Lay Hong) found sperm heads," Yusof says.
2.40pm: There is literature stating that sperm cells can be found in the anus, even after defecation, the court is told.
"(Our) case was 56 hours without defecation. We have the literature and the finding, so what is the problem?" he asks.
2.50pm: DNA expert Dr Brian McDonald was "speculative" in saying that a sample would have degraded after approximately 96 hours if it had not been preserved before testing.
Yusof cites literature to show it is possible to develop DNA profile even if degradation occurs.
2.55pm: On the risk of contamination of, and tampering with, samples, Yusof says: "We should not talk about possibilities...but (of the) probability (this could) happen".
On the 18 alelle which appeared in two different samples and in separate analyses, he says this does not show that someone had planted the sperm.
One of these specimens was not collected by investigating officer Jude Blacious Pereira, so he could not have planted anything, Yusof points out.
2.55pm: Yusof submits there was no evidence that Anwar had come in contact with the specimens.
"The possibility that (Anwar's) DNA had 'contaminated' the specimen does not arise," he says.
Yusof then applies for a 15-minute break, which is granted.
3.30pm: Yusof continues with his submission.
Other than saying that Anwar was hampered from performing the (sex) act, he says, the defence has failed to show that the accused had sought medical treatment other than in 2004 and 2005.
3.45pm: Yusof goes into the details of the Chemistry Department's laboratory accreditation.
He submits that the two chemists who testified, Seah (right) and Nor Aidora Saedon, have undergone competency tests. This is to rebut the defence assertion that they had not analysed the specimens thoroughly.
"(They) are more competent than McDonald who last sat the test in 2004 and is not involved in (conducting) the tests, as robots do it for him," he says.
3.50pm: "Seah conducted the test to detect the presence of semen on the swab...and (she) confirmed the presence of sperm and semen.
"She made a slide, and what she observed were sperm cells, non-sperm cells and bacteria."
4pm: Yusof submits that the DNA of the accused only appeared in the section which came from the sperm cell.
If the DNA had been planted, then it would have been seen in the non-sperm cell section of the specimen, he says.
4.15pm: A third contributor's profile (18 alelle) was only found in one specimen, and it did not form a peak in the graphs from the analyses.
4.20pm: Reverting to Anwar's chosen mode of defence and citing case law, Yusof says a statement from the dock should not be given the same weight as one which can be cross-examined.
4.25pm: "Even if a denial is made under oath, the court will judge accordingly ...."
Yusof submits that Wells' evidence is neutral at best, McDonald's evidence is "flip flop" as he was "bent" on favouring the accused while Hoogland was "speculative".
He ends his submission by saying the prosecution has proven beyond reasonable doubt that Anwar had committed the crime.
4.41pm: The proceedings are adjourned to 9.30am on Thursday, when the defence team will reply to points raised by the prosecution.
The judge is expected to then set a date to deliver the verdict.

Najib wanted to end his political career

KUALA LUMPUR, Dec 12 — Datuk Seri Anwar Ibrahim’s lawyers today accused Datuk Seri Najib Razak of being responsible for the current sodomy charge against the PKR de facto leader, claiming that the prime minister’s “fingerprints” were “all over” the case.

Anwar has repeatedly accused Najib of being involved in the Sodomy II trial, and has called it a conspiracy to destroy his political career.

Lead defence counsel Sankara Nair today reiterated Anwar’s claims, pointing out that complainant Mohd Saiful Bukhari Azlan had admitted to meeting Najib in 2008, when the latter was still deputy prime minister, days before the alleged sodomy act took place.

The lawyer also argued that there were many “inconsistencies” with the prosecution’s case, and questioned not only Saiful’s credibility, but that of other prosecution witnesses as well.

“It is as clear as daylight that the fingerprints of Datuk Seri Najib Razak are all over this sordid plot notwithstanding the desperate attempts by various quarters to smudge them,” Sankara said during his closing submission of the defence’s case.

The lawyer said the meeting between Saiful and Najib at the latter’s official residence back in June 2008 gave rise to a “suspicion of some foul play at the very least and at worst some nefarious machination at work.”

Sankara charged that the prime minister gave “contradictory” answers to the media when asked about the matter, first stating that Saiful had come to see him about obtaining a scholarship and, later, changing it to a public statement that Saiful went to see him to complain about “alleged misdeeds” by Anwar.

“Why did Najib not come clean the first time he was asked about this? What was there to hide? Why did he have to resort to lies?” said Sankara.

Adding to the suspicions of a conspiracy, said Sankara, were SAC Datuk Rodhwan Ismail’s and former Inspector-General of Police Tan Sri Musa Hassan’s “involvement” in the case.

The lawyer questioned the reason behind Rodhwan meeting Saiful just before he lodged a police report against Anwar, as the former was not the investigating officer at the time.

“One story that defies us here is how SP1 (Saiful) got hold of TS Musa’s number. Apparently he overheard a conversation between Datuk Khairil Anas or an aide and Najib where Musa’s number was mentioned and he saved it in his handphone upon overhearing the conversation.

“This, again, is an insult to one’s intelligence,” said the lawyer.
Sankara also pointed out the fact that Najib and his wife Datin Seri Rosmah Mansor had applied to set aside a subpoena to appear in court as defence witnesses, saying that they should not have done that if there was “nothing to hide.”

“If the premier and Rosmah had no relevance to this case, why then did investigating officer DSP Jude Pereira record their statements? This is not just our conclusion. It is also the conclusion of the public and at large,” he said.

Another defence lawyer, Ramkarpal Singh, said there was no evidence to confirm that the DNA from Male Y found on rectal swabs taken from Anwar came from sperm cells.

Ramkarpal said the DNA could have been easily obtained from the mineral bottle, toothbrush and “Good Morning”-brand towel retrieved from Anwar when he was detained overnight on July 16, 2008 at the Kuala Lumpur police headquarters.
Saiful accused the PKR de facto leader of sodomising him at the upmarket Desa Damansara Condominium in Damansara Heights here on June 26, 2008.
Anwar has repeatedly denied this, and opened his defence case by calling the sodomy charge a trumped-up allegation masterminded by Najib.

The former deputy prime minister said Najib wanted to end his political career and hopes of Pakatan Rakyat (PR) taking over the federal government.

His lawyers had named 25 witnesses who included Najib, Rosmah and Musa.
The trial resumes tomorrow afternoon.

The (outgoing) Yang di-Pertuan Agong Tuanku Mizan Zainal Abidin said the government under Prime Minister Datuk Seri Najib Razak rule had given excellent cooperation throughout his term of office as the King.

“It enabled me to discharge the trust placed on me as the head of state in the best manner possible in the interest of our beloved nation,” said Tuanku Mizan in his address at the state banquet in appreciation of his reign as the 13th Yang di-Pertuan Agong at Istana Negara, on Saturday night. Also gracing the function was the Raja Permaisuri Agong, Raja Tuanku Nur Zahirah.

He said that the Yang di-Pertuan Agong had a vast role in serving the nation through efforts and opinion whether directly or indirectly to generate and forge solidarity among the people, support the efforts of the government towards bringing progress to the country and promote the sanctity of Islam in Malaysia.

“The experience gained from the services of (Tun) Abdullah (Ahmad Badawi) and Najib had made me realise how fortunate Malaysia and the people were because the power transition process between the two leaders went smoothly.

“I wish to call on the national leadership and Malaysians to continue to strive to forge, preserve and strengthen the existing solidarity and I am concerned about the inclination of certain parties in raising sensitive and racial issues and to politicise matters which should not be politicised,” said Tuanku Mizan.

Meanwhile, Najib in his speech said the institution of the Yang di-Pertuan Agong as the Supreme Head of State is unique to Malaysia and should be defended by the people.The Prime Minister said the institution belonged to all without any exception. “No one should try incite sentiment to challenge it.”

Najib expressed his gratitude to Tuanku Mizan for having successfully completed his term as the Yang di-Pertuan Agong. “Personally I wish to convey that it was most pleasant to deal with Tuanku in all matters. Under your reign, all matters went smoothly. This fact was most appreciated by members of the cabinet who were most comfortable with the role played by Tuanku as the head of state,” he said.

The banquet was also attended by Deputy Prime Minister Tan Sri Muhyiddin Yassin, the Prime Minister’s wife Datin Seri Rosmah Mansor, Deputy Prime Minister’s wife Puan Sri Norainee Abdul Rahman, former Prime Ministers Tun Dr Mahathir Mohamed and wife Tun Dr Siti Hasmah Mohd Ali as well as Tun Abdullah Ahmad Badawi and wife Tun Jeanne Abdullah.

The Sultan of Kedah, Sultan Abdul Halim Mu’adzam Shah was chosen as the 14th Yang di-Pertuan Agong to succeed Tuanku Mizan, with effect from December 13, for a five-year term.

About 200 mat rempit held a noisy demonstration at the historic Clock Tower near the Penang state legislative assembly building today, demanding a 'racing track' for their use.

The group, led by Shahabuddin Ahmad - a representative of Pertubuhan Islam Gabungan Amal - lined the area with their motorcycles about 1pm and honked noisily for about 15 minutes before the police dispersed them.

Their mission appeared political as most of the bikers were wearing yellow T-shirts with the words ‘LGE racist’ - a reference to Chief Minister Lim Guan Eng - and ‘Save Penang’.

They also unfurled banners reading Mahu litar lumba (We want a racing track).
Five protestors, including Shahabuddin, were detained by the police who had been trailing some members of the group from Komtar, the state's administrative building.

It is learnt that the mat rempit had proceeded from Penang Road to the state legislative assembly building along Light Street.

During the arrests, a minor scuffle broke out between the police and several protestors who were shouting. One threw his helmet on the ground.
Parts of the Komtar building had earlier been defaced with graffiti reading Guan Eng tipu Melayu (Guan Eng has lied to the Malays), but it is not known if the group was behind this.

Georgetown OCPD Gan Kon Meng said the group had planned to hand a memorandum to Lim over several issues affecting them.

"We allowed them to submit the memorandum because we are a democracy. But if (any gathering) is not peaceful, it can create chaos and cause lost of property," Gan said.

Those held will be investigated for illegal assembly under Section 27(5) of the Police Act.

Told of complaints of police violence during the arrest, he said it was probably because the protestors had resisted enforcement action.'Political agenda'

However, Komtar assemblyperson and Lim's political secretary Ng Wei Aik ( right ) was upset with Gan for not doing his work professionally.Ng said Gan should explain why he allowed the 'illegal' protest when this was clearly "a politically-oriented rally"."Asking for a racing track was merely an excuse. I do not think it is related. All demonstrations (here) are easily linked to Umno," he alleged.

"Someone sold Umno's agenda to them. If it is not political, why do they say ‘LGE racist,’ when mat rempit are only mostly interested in racing?"

In a related development, Teluk Bahang assemblyperson Dr Helmi Yahya denied that Umno is in any way connected to the mat rempit .He said he had merely been invited to launch Pertubuhan Islam Gabungan Amal at Universiti Sains Malaysia in July, and had advised them to organise charity programmes for the benefit of the people.Helmi declined to comment on the protest, saying he had not witnessed the incident.

"At that time, I was resting. When I came to know about the protest, it was already over," added the former Penang deputy chief minister.

Tun Abd Rahman bin Abbas is the seventh Yang Dipertua Negeri of Pulau Pinang. He was born at Permatang Pauh, Pulau Pinang on 15th May 1938.

He was appointed as the Yang Dipertua Negeri of Pulau Pinang on 1st May 2001. He was the first born penangite to hold the office of Yang Dipertua Negeri.

He has been reappointed to the post for three times in 2005, in 2009 and in 2011.

Tun Dr Mohd Hamdan bin Sheikh Muhammad Tahir Jalaluddin al-Falaki was the sixth Yang Dipertua Negeri of Pulau Pinang. He was born at Kuala Kangsar, Perak on 26th April 1921. He was appointed as the Yang Dipertua Negeri of Pulau Pinang on 1st May 1989. He left office on 1st May 2001. He died on 20th January 2005.

Tun Dr Awang bin Hassan was the fifth Yang Dipertua Negeri of Pulau Pinang. He was born at Muar, Johor in November 1910. He was appointed as the Yang Dipertua Negeri of Pulau Pinang on 1st May 1981. He left office on 1st May 1989. He died on 23rd October 1998
