By now, everyone knows that way too many Americans are overweight or obese. Having worked in public health for almost a decade, I witnessed in great detail this national phenomenon happen in warp-speed. From a societal perspective, this is as big as a problem gets. And it should be just as big a deal for those who fall into the obese category as it is for society as a whole, although that doesn’t appear to be the case.

There are many reasons for our collective girth, with the two most obvious ones to me being the food industry convincing regulators, retailers and the public that their processed goods are what the public wants, and our own behaviors that include buying into that myth (with vigor); the second being that too many people are sedentary. But all is not lost because we, as individuals, can do something about our own situation. Even the food industry realizes this, as evidenced by some of the better choices now available due to public demand.

Last year, on my flight back from the National Bike Summit in Washington, D.C. I sat next to a lobbyist for the processed food industry. Since I had just been doing some lobbying of my own, we had something in common to talk about. The message the industry rep told me they convey to our elected officials when confronted about the many ills of processed and fast food is that “there really isn’t any bad food, just bad choices.” Listening to him, I realized I’ve made some good choices over the years, including having sworn-off fast food a long time ago.

Undoubtedly, I could be doing much more for my health and well-being, having an even better diet being one. But those two basic aspects of my life — engaging in regular, sustained physical activity and staying away from foods I know are no good for me the majority of the time — might just be a starting point for anyone to stop the weight gain and associated ills that are otherwise coming.

Admittedly, neither engaging in regular exercise nor sticking to a decent diet is always convenient or possible, but making both part of daily life has become just as addictive as doing the opposite, with the benefits of the former far outweighing whatever pleasures come from sitting around eating food we know isn’t good for anyone. And there are plenty of programs and resources available to help make such a change happen. All you have to do is choose to make your move.

This and that
First, a correction: Contrary to my statement in a prior column, Gov. Rick Scott did proclaim March as Florida Bicycle Month in Florida this year. Of course, May remains National Bike Month.
There were three Rides of Silence in Lee County this year, with the Fort Myers ride attracting almost 100 cyclists who rode through downtown, along U.S. 41, and back via McGregor Boulevard. As part of pre-ride remarks, Lisa Buolher, a world-class runner and cyclist who was struck by a distracted driver while on her final training ride before competing in the World Duathlon Championships, spoke of her serious injuries, remarkable recovery and thoughts on the crash. The message to drivers: We need to keep our attention on the task at hand so we don’t put anyone in Lisa’s position — or worse.

Tragedy mounts in the case of Tracey Kleinpell
Someone who wasn’t as lucky as Lisa is Tracey Kleinpell. A little over a year after Tracey was killed on the Sanibel Causeway by Theresa Shirley, the truck operator who drove across the centerline and into the breakdown lane, striking Tracey and sending her into the water to her death, the state’s attorney announced only a slap on the wrist is warranted in the case. Even though prescribed muscle relaxers and pain relievers were found in Shirley’s system — and she admitted falling asleep at the wheel — she’ll face a minimal charge of failure to remain in a single lane. FHP, the investigating agency, didn’t even conduct a field sobriety check, although emergency personnel at the scene indicated Shirley appeared sleepy and lethargic. If there’s ever been a case that requires FHP to take a hard look at the way it conduct investigations involving bicyclists and pedestrians, this is it. For the many others who’ve experienced similar injustice, I hope Tracey’s death will serve as the tipping point for reform to happen.

Review of New Horizon 2035 Lee Plan elements continues

BikeWalkLee has been participating in this year-long process of updating the Lee Plan to ensure that the complete streets/sustainability focus in the EAR is carried through in the actual Comp Plan amendments.

Background: Horizon 2035 is a comprehensive review and update of the Lee Plan through the year 2035. The Evaluation and Appraisal Report (EAR) adopted by the Commissioners in early 2011 resulted in a sustainable vision for growth and development. The County is now using this vision as the basis to update the Lee Plan’s goals, objectives and policies. Over the past 8 months, the staff developed and committees reviewed a series of issue papers. Starting in March, the staff began presenting draft Comp Plan language for each of the elements in the Plan.

The next two elements were presented to the LPA on Thursday, May 31st (8:30 a.m. in BoCC Chambers). The two elements are:
1. Capital Improvements--This element addresses the public services and infrastructure systems, including transportation and includes the transportation concurrency issue.
2. Historic Preservation

The two elements will also be discussed at the June 20th CSAC meeting at 6:00 p.m. in the County Administration conference room. At the beginning of both committee meetings, the agendas include an opportunity for public comment. We encourage you to participate in this process.

Also on the LPA agenda for May 31st is the county's draft Capital Improvement Program (CIP) for FY 2012/13-2016/17 for review, which includes all the county's infrastructure projects, including transportation.

Greetings –

You are invited to attend a Special P&Z Workshop, which will be held by the City of Cape Coral Planning & Zoning Commission on May 23^rd, 2012. The meeting will begin at 9:00am in Council Chambers at City Hall (1015 Cultural Park Blvd). The purpose of this workshop is to discuss the draft version of the 2012 Evaluation and Appraisal Report (EAR).

The EAR is intended to assess the progress of implementing the Comprehensive Plan, to respond to changes in growth management policy, to reflect changing conditions and trends, and to identify “major issues” that have emerged since the last update of the Comprehensive Plan. Overall, the EAR evaluates the successes and shortcomings of the Comprehensive Plan and helps to identify needed amendments.

Last spring, the City obtained input from the public to identify major issues present in the community. Through a series of public workshops and an online questionnaire, the City identified and evaluated three major issues: increased diversification of the local economy, livability within the City, and natural environment and sustainability. The EAR analyzed each of these major issues and provided an assessment of each element within the Comprehensive Plan.

It’s a travesty that Tracey Kleinpell’s death essentially goes unpunished.

Theresa L. Shirley, 46, of Bokeelia killed her when the truck Shirley was driving drifted out of the lane on the Sanibel Causeway.

Shirley struck Kleinpell as she was cycling with her husband on May 7, 2011.
It took more than a year for the State Attorney’s Office to determine that Shirley shouldn’t face criminal charges. Instead, she’ll be cited by the Florida Highway Patrol for failing to stay in a single lane.

That outcome and that delay are outrageous and cruel, and it has caused tremendous heartache for Kleinpell’s family and led friends and activists to wonder whether that further endangers pedestrians and cyclists who do follow the rules of the road.

However, the law wasn’t on Kleinpell’s side.

And that’s a terrible reality to take.

Shirley wasn’t drunk, according to the evidence. It’s clear she didn’t intend to kill Kleinpell, but Shirley said she fell asleep at the wheel and official accounts say she appeared groggy. It might have been the prescription drugs found in her system, which she was taking to relieve pain and relax her muscles.
And that’s an indication that she should never have been behind the wheel in that condition.

Too many distractions — fatigue, texting, cellphones, keeping your eyes off the road — are causing accidents and hurting and killing people, like Kleinpell.

The federal government has aggressively pushed a campaign to end distracted driving, and sheriffs in Lee and Collier counties are urging citizens to keep focused on the road.

However, efforts have not been so favorable at the state level.

Laws to ban texting while driving have died in the Legislature over the years.

New laws may not be the answer and often have unintended consequences, but too many people are using poor judgment as they get behind the wheel.

A new law won’t bring Tracey Kleinpell back, but wouldn’t it be fitting to have a Tracey Kleinpell Act to help avert another tragedy like the one that killed her.

We urge our legislators to consider that.

For now, citizens can all honor her memory today by making the decision that when they get behind the wheel they are not going be distracted from driving.

Then do it again tomorrow, and the next day, and the next day, and on and on.

No criminal charge in Sanibel Causeway bicyclist's death

Kleinpell was cycling across the Sanibel Causeway with her husband, Gordon, on May 7, 2011, when a truck drifted out of its lane and struck her. Kleinpell was knocked over the guardrail and into the water, from where she was brought to shore by passing boaters. She was pronounced dead after unsuccessful attempts to resuscitate her.

Theresa L. Shirley, 46, of Bokeelia, was driving the truck. After the crash, she told an investigator she fell asleep at the wheel.

“There was not enough evidence there under Florida law to be able to charge Theresa Shirley with vehicle manslaughter,” said Samantha Syoen, spokeswoman for the state attorney’s office.
Instead, the Florida Highway Patrol will cite Shirley for failure to remain in a single lane. She is due in Lee County court at 8 a.m. Monday.

Kleinpell’s father, George Henault of Fort Myers, said the family is devastated by the decision.
“No words can explain how bad we feel about not bringing charges against her,” he said. “She killed our daughter. It’s as plain and simple as that.”

Shirley could not be reached for comment.

The Florida Highway Patrol conducted a review of the case and requested a warrant for DUI manslaughter. The request was sent to Assistant State Attorney Anthony W. Kunasek a few weeks ago, and May 10, Kunasek determined there was not sufficient evidence to grant the warrant.
A screening of Shirley’s blood showed no alcohol, but found several prescription drugs, according to a memo sent by Kunasek. Shirley tested positive for drugs, including a muscle relaxant and a pain reliever. The drugs were prescribed to Shirley, and the levels in her blood fell within the usual therapeutic range, according to a Florida Department of Law Enforcement lab test.

Witnesses who saw Shirley before the crash and at the scene said she did not appear to be impaired. Medical personnel who responded to the accident described Shirley as lethargic, sleepy and groggy.

Shirley was not given a field sobriety test at the time of the crash, which Kleinpell’s mother, Donna Henault, found unacceptable. To be kept waiting a year for justice and then to have no charges come of the investigation is devastating, she said.

“When I look back at things,” she said, “I just feel like they bungled it.”

Shirley was convicted of DUI in Charlotte County in 2009, according to the Charlotte County clerk of court website. According to the state attorney’s office memo, a prior conviction cannot be used to show any inclination to commit a subsequent crime.

“In order for the state to prove vehicular homicide, the state must prove more than a failure to use ordinary care,” Kunasek said in the memo. “The state must prove the operation of the vehicle driven by Ms. Shirley was done so in a reckless manner, likely to cause death or great bodily harm. Falling asleep at the wheel is insufficient to establish vehicular homicide by itself.”

Donna Henault said in the year since she lost her daughter, the pain has gotten worse. She still can’t talk about it without crying. Since their daughter’s accident, George Henault has needed several heart surgeries, including a five-way bypass.

“This accident is slowly killing him,” Donna Henault said. “The doctor said there is such a thing as broken heart syndrome, believe it or not.”

Donna Henault said she no longer travels across the Sanibel Causeway, because seeing the ghost bike placed there in Kleinpell’s memory is too upsetting. She had to leave the area last week, when Kleinpell’s friends gathered on Sanibel Island to commemorate the one-year anniversary of her death.

The Henaults went to Connecticut to visit their other daughter, Tina Peck, and had a small family memorial. To remember Kleinpell’s birthday May 3 and her death May 7, they went to the beach and released balloons adorned with butterflies and rainbows.

Darla Letourneau, of BikeWalkLee, said she is appalled Shirley will not be charged because it seems like an open-and-shut case, with Shirley clearly at fault. These types of cases have set a precedent that result in no consequences for killing a cyclist or pedestrian, she said.

“We have to figure out how to take this outrage and do something positive,” Letourneau said. “Something has to change.”

Lee County commissioners move forward on plans for Del Prado trafficsignal

Good news! After two years of urging by Ryan Santos' mom, Cape Coral City Council and Cape citizens, BikeWalkLee and others to make pedestrian safety improvements, the County has finally agreed to install a traffic light at this dangerous intersection by Burton Park, used by many children.

Lee County commissioners Tuesday unanimously agreed to move forward with plans to install a traffic signal at Del Prado Boulevard and Northeast 3rd Terrace.

The decision comes more than two years after 13-year-old Ryan Santos was struck by a car and killed on his way to Del Prado Park.

While a traffic signal on the street isn’t called for by the Federal Highway Administration, the nearby park makes it a unique situation, according to county officials.

RaceTrac, which has a gas station and store at that intersection, has offered to pay an estimated $300,000 to install the signal.

Lee County proposes revised parking requirements

At the May 7th Management & Planning meeting of the County Commissioners, staff presented the proposed new parking requirements, consistent with sustainability goals. Below is the announcement on Lee County's website:

Lee County is proposing a comprehensive review of commercial parking requirements. In general, the update results in fewer required paved parking spaces for new development. The new codes will also be streamlined and more reader friendly.

Parking regulations for unincorporated Lee County were codified in 1986 as part of the Zoning Regulations. Other than occasional minor amendments, this is the first comprehensive review of these regulations. In addition to a review of nationwide parking trends and studies, this update was prompted by:

Growing national and local interest in sustainable, compact communities
Environmental benefits of requiring less impervious pavement
Inclusion of new trends, such as mixed-use development
Importance of streamlined regulations
Implementation of the Lee Plan update

What would change?

The proposed changes to the parking regulations will, in many cases, result in a decreased number of required parking and in others, it will remain the same. One major change is to provide incentives for mixed-use type developments where the minimum required spaces for each use will, in most cases, decrease.

Some specific highlights include:

A new "multiple-use" category

Would replace current, cumbersome shared parking provisions
Would reduce required spaces based on the theory that parking demand varies with different uses, so spaces can be shared

Options to further reduce the amount of required parking administratively – including proximity to transit, boat parking, connection to bicycle and pedestrian facilities, golf cart parking, availability and proximity of parking facilities, and parking demand studies
A maximum parking rate for commercial, industrial and mixed-use parking lots of 80 or more spaces
Streamlining the codes so they are more user-friendly

How will changes be considered?

After reviewing the proposed changes for Lee County Commissioners during a Management and Planning meeting, zoning staff will outline the proposed update to the County’s review committees:

Land Development Code Advisory Committee
Executive Regulatory Oversight Committee
Local Planning Agency

Commissioners will hold public hearings at a later date on proposed changes before they are adopted into the Land Development Code.

Implications of youth driving trends on Florida future

Last month, we reported on the groundbreaking national study, called "Transportation and the New Generation: Why Young People are driving less and what it means for transportation policy", prepared by the U.S. PRIG Education Fund and the Frontier Group. This week, there was an article in the South FloridaSun-Sentinel.com that translated these findings into what it means for Florida. We hope that the various state and local agencies, committees, organizations, and elected bodies in Florida will begin to take actions in response to this new reality. Read the article below.

Keeping Florida competitive means appealing to youth

My son doesn't have his driver's license, which should concern the state of Florida.
It's not because he's my kid. Of course I'm biased. I think my son's great, but that's not the point. What should matter is he's part of a growing number of young adults who seem to be shying away from the rush to get behind the wheel of a car. It seems that young people are driving less, and that has big ramifications for the Sunshine State.

From 2001 to 2009, the average annual number of vehicle miles traveled by people between the ages 16 and 34 decreased from 10,300 miles to 7,900 miles per capita, a drop of 23 percent, according to a study by the Frontier Group.

The trend isn't exactly a momentarily blip, or necessarily a boon to those who may think that our streets and highways would be better off without young motorists. We're looking at a new pocketbook issue here, one that could one day spur government officials in Tallahassee to rank quality of life issues right up there with tax breaks to make Florida a better place for business growth and jobs.

Higher gas prices, tougher driving licensing laws, new technologies and a shift in values are all cited as reasons young adults are driving less. They're walking more frequently and relying more on public transit, the Transportation and the New Generation study found. They're more concerned about preserving the environment, and they prefer living in places where they can easily walk, bike or take public transportation.

It's that last point that should serve as a wake-up call to a car-crazed state that simply couldn't function without the automobile. Florida, like many American communities, has developed a set of road building policies that assume driving will continue to increase at a rapid pace. What young adults seem to be saying is many of those policies are simply out of touch with a new reality.

"Driving is really important to a lot of the kids in the culture, but it isn't the central focus like it was 25 years ago," the study quoted an administrator at a Washington, D.C.-based drivers education program. It seems spending time on extracurricular activities, social media, even studying has greater priority.
Imagine a new generation that would rather hop a bus, bike or walk to nearby destinations as part of a new demand for a better quality of life. The problem facing Florida is that if government officials don't move fast enough to address what will become a new wave of competition for economic and human development, they may see the state's best talent vote with their feet and leave Florida for more desirable communities, and jobs. In fact, some believe this trend has already begun.

"Young adults have begun leaving their parents' homes to move into vibrant, compact and walkable communities full of economic, social and recreational activities," according to the Brookings Institution, which estimates 77 percent of young people between 18 and 35 plan to live in urban centers.

Mason C. Jackson, president and CEO of Workforce One, was ahead of the trend. Years ago, he noticed several studies that indicated young adults – and ultimately employers — would gravitate toward communities that were affordable, vibrant, socially diverse and "green," as in environmentally friendly. He often wondered how well the Sunshine State would fare in such a trend.

"Unlike the good ol' days, the reality is that work now moves around the world at the click of a mouse, which means increasingly talent is choosing where they want to live and good employers with good jobs will follow the talent," Jackson wrote in a 2009 Sun-Sentinel column. "Our task is both to invest in our talent base and to have the quality of life which attracts and keeps that talent and therefore the kind of employers we would like to see here."

What began ten years ago in Dallas as a spontaneous outpouring of grief for a friend and fellow rider, struck and killed by the mirror of a passing vehicle, has rolled across the globe to become an international annual event memorializing and honoring cyclists who have been injured and killed while riding.

The many hundreds of events share the same goals: “To honor fallen cyclists, to promote road safety, and to make a difference.”

Bike safety is not a fleeting issue, especially here in Florida which ranks the very worst in the nation for cyclist safety with the highest fatality rate six years in a row.

The Ride of Silence, in memorializing riders injured and killed, seeks to draw motorist’s attention to cyclist’s legal rights to full use of the roadways, to inform motorists that we are here, to watch for us – as if our lives depended on it. Locally there will be three Rides of Silence all departing at 7:00 p.m., so arrive around 6:45 p.m. at the starting point.

Please come out to show your support and send the message that we deserve our right to operate on our own roads. We are not just bike riders but friends and neighbors and we must all Share the Road.

Fort Myers: Caloosa Riders is organizing a ride in downtown Fort Myers . It starts at Centennial Park , 2000 W. First St. , Fort Myers (under the bridge at Heitman and Bay Streets). Work Nearly Complete on Cape Coral Bike Lanes

Kudos to the Cape Coral advocates, City Council and city staff that worked to bring this project to fruition! The additional 1.1. miles of bike lanes mean that there is now more than 17 miles of connected bike lanes. Next week is Bike to Work Week and a perfect time to try out this new biking facility.

Crews are putting the finishing touches on the 1.1 miles of bike lanes on Oasis Boulevard and Agualinda Boulevard. Pending a final review of the work and sign placements next week the Transportation Department is expected to announce the lanes are officially open.

Completing this short but critical missing link means that bicycle riders now have more than 17 miles of connected bike lanes in this west southwest part of the city. For example, riders may now choose to start at Cape Harbour and pedal all the way to the intersection of Veterans Parkway and Pine Island Road at Burnt Store Road. This can be done without encountering a single traffic light, and only a handful of intersections with stop signs. Part of this route is along very scenic Surfside Boulevard next to the South Spreader. A variety of loops is possible for those wishing shorter routes. The new bike lanes have created a 5 mile rectangle route covering portions of Beach Parkway, Sands Boulevard, Eldorado Parkway and Agualinda Boulevard. Many walkers and handicapped persons with mobility aides also use the lanes, particularly in areas lacking sidewalks.

The request for the these lanes was submitted by the SW Cape Coral Neighborhood Association early in 2011. The City Council unanimously approved the request this past February. Board members and BWL volunteers Patricia Young and Steve Chupack helped get the request through the review process. They expressed their appreciation to the Council,the Transportation Advisory Committee, and department staff. A special thanks to the many supporters who signed petitions or in other ways indicated their strong advocacy for these bike lanes.

BikeWalkLee letter to BoCC on Del Prado pedestrian safety options

On Tuesday, May 15th, the Board of County Commissioners considers two options for making safety improvements at the Del Prado Blvd. intersection by the Cape Coral Burton Park, where 13-year old Ryan Santos was killed while crossing the street on his bike two years ago. BikeWalkLee sent a letter today to the commissioners on its views on the two options. Below is an excerpt from the letter.

Dear Commissioners:

BikeWalkLee, a coalition to complete the streets in Lee County, advocates for improving safety for bicyclists and pedestrians. Since the tragic death of 13-year old Ryan Santos on April 27, 2010, BikeWalkLee has been urging LeeDOT and the Board of County Commissioners to take action to improve pedestrian and cyclist safety at Del Prado Blvd. and NE 3^rdTerrace, near Burton Park in Cape Coral. At your May 15th County Commission meeting you will be considering two options for how best to improve this intersection for pedestrian safety and BikeWalkLee would to share its views for your consideration.

You have two options before you--one proposed by the Cape Coral City Council (a full traffic signal) and the other by LeeDOT (pedestrian crossing signal). We would like to commend both parties for agreeing that pedestrian crossing safety is the most important factor in developing a solution. We would like to commend the Cape Coral City Council for its determination and hard work in search of a solution and for its work with RaceTrac to find funding for its preferred solution. We also commend LeeDOT for coming up with a solution that is innovative and proven in other communities to make the intersection safer for pedestrians when traffic signals may not be "warranted" (a technical term meaning not enough vehicles are coming from the intersecting streets).

First, to summarize the two options:

1. Full traffic signal (proposed by Cape Coral): A full traffic signal is the highest form of traffic control and federal standards (MUTCD) exist for determining when this approach is "warranted". The safety benefits at signalized intersections for pedestrians is contingent upon the application of several additional pedestrian safety features, such as marking all legs of an intersection, pedestrian signal heads in all directions, etc. (See Safe Routes to School Guide on Traffic Signals: http://guide.saferoutesinfo.org/engineering/traffic_signals.cfm.) It is not clear what additional pedestrian features will accompany the installation of a full traffic signal under this option.

Full traffic signals usually require high side street volumes, which this intersection does not have. According to Federal MUTCD standards, a signal at this intersection is not warranted. The Cape Coral City Council is asking you to make a policy decision to approve installation of a "unwarranted" traffic signal and to accept RaceTrac's offer to pay for the installation and maintenance costs of this traffic signal.

2. Pedestrian crossing signal (proposed by LeeDOT): When intersections do not meet the MUTCD standards for installing a traffic signal, there are nationally recommended alternative approaches for addressing pedestrian safety, including a midblock pedestrian crossing signal.

Although the type of signal is not mentioned in your blue sheet, the staff has said they are considering the Pedestrian Hybrid Beacon System, known as the HAWK. BikeWalkLee has been advocating the use of HAWK signals in Lee County since 2009, after their successful use in St. Petersburg, FL. While experimental back in the early 2000s when St. Petersburg installed them, they are now approved by FHWA and recommended in the 2009 MUTCD. According to independent studies conducted by the Texas Transportation Institute, the HAWK is nearly as effective as a full traffic signal, with 97 percent motorist compliance.

An important component of pedestrian safety in this option is an intersection redesign that includes a two-step crossing with new islands in the middle of this long, straight, multi-lane stretch of road.

Considerations for the Board:

Both options have merit and the Board may wish to weigh several considerations...

Gary Toth on Complete Streets: One Size Does Not Fit All

This is an excellent video of Gary Toth's presentation at the Complete Streets Forum in Toronto last month. It focuses on how to build communities through transportation. The presentation also includes great slides of examples from across the country. This presentation should provide many useful ideas for Lee County and local jurisdictions as they implement their complete streets programs and redesign how we plan transportation.

Last month Gary Toth spoke at the Complete Streets Forum in Toronto about the symbiotic relationship between the Complete Streets and Placemaking movements. Early on in the talk, posted above in full, Gary points out that a complete street makes travel “safe, comfortable, and convenient” for all modes–but that doesn’t necessarily mean that it overtly provides for each one in its own area.

Complete streets can often include flexible or mixed-mode areas (Salt Lake City’s green lanes are a great example), but the focus should be on creating a street that is welcoming to everyone, no matter the mode of travel.

The question at the heart of Gary’s talk is about how we build community through transportation. When talking about streets, “Complete,” he argues, “has got to be about community-building, not just about taking space away from cars.” Efforts to create more complete streets often bump into opposition that claims bike lanes and bump-outs are part of a “war on cars,” and Gary explains how to re-frame the issue as being about creating neighborhoods that are safer and more inclusive: the kinds of places where you feel comfortable letting your child ride ahead a bit when out biking.

BikeWalkLee sends letter to Florida conferees for federal transportation bill

BikeWalkLee sent a letter today to the Florida members of Congress who are on the conference committee for the transportation authorization bill, urging them to craft a final bill that follows the template of the Senate-passed bipartisan bill. Below are excerpts.

Dear Senator Nelson,

BikeWalkLee is a citizen-based community coalition in Lee County, Florida, that works to raise public awareness and advocate for complete streets and a balanced multi-modal transportation system. We are writing to urge you, as a conferee on the transportation bill, to fight for a final bill that follows the template of the Senate-passed bipartisan MAP-21 legislation.

Lee County elected officials, both at the Metropolitan Planning Organization and Board of County Commissioners, have shown strong support for a more balanced multi-modal transportation system and one that ensures that our roads are safe and accessible for all road users. BikeWalkLee, as well as our elected officials, have written you several times in the past year about this bill, and have also written commentaries in the local papers about the importance to our community of congressional action on this legislation. I have attached an excellent March 21st op ed by Lee County Commissioner, Ray Judah, outlining why the Senate transportation bill is supported in our community.

Specifically, we urge you to include provisions in the conference agreement that represent significant reforms and were the result of a carefully crafted bipartisan compromise in the Senate’s MAP-21 bill. These provisions have bipartisan and bicameral support:

(1) Provide local access to funding for community-based transportation initiatives. Members in both chambers agree that local leaders – who know the transportation, safety, and economic development needs of their constituents – should have more direct control over funds and projects in their communities. MAP-21 contains provisions that will empower local governments to program funds for projects that help revitalize main streets and improve safety and access for everyone, whether traveling by car, transit, bicycle, or foot. MAP-21 helps local communities build out a full transportation network under the “Additional Activities” program by sub-allocating funds to larger regions and offering competitive grants for others. Empowering local communities to program their tax dollars can help renew economic vitality, make areas more attractive for businesses, residents, and private investment while improving health and safety for everyone.

Having safe places to walk and bike is particularly important for Florida because our state is the most dangerous state in the nation for pedestrian and bicyclist fatalities. The citizens of Lee County as well as our elected officials strongly support investments in walking and biking facilities and providing local control over these funds needs to be protected in conference. It is also important to protect the "Safe Streets" policy in the Senate bill, that will require federally funded road projects in Florida to meet federal standards for safely accommodating all road users. We know the importance of Lee County's complete streets policy and welcome a federal policy that complements and enhances our local efforts.

Today's release by America Bikes of the findings of a recent Princeton survey are a clear message to Congress--more than 80 percent of Americans favor maintaining or increasing federal funding for sidewalks and bike lanes. The results show that Republicans, Democrats, residents in every region of the country, and every age group strongly support these investments. Americans want safe places to bike and walk and the bill coming out of this conference needs to respond to the desires of American citizens.

America Bikes Survey: Americans Support Biking/Walking

America Bikes Releases 2012 Survey Results

Overwhelming public support for federal biking and walking funding

Today at a press conference on Capitol Hill, America Bikes announced the findings of a recent Princeton survey, which shows that more than 80 percent of Americans favor maintaining or increasing federal funding for sidewalks and bike lanes.

The survey results are astounding - and bipartisan:

83 percent of all respondents support maintaining or growing federal funding for sidewalks, bikeways, and bike paths.
80 percent of Republican respondents and 88 percent of Democrat respondents think Congress should maintain or increase federal funds for biking and walking.
85 percent of Northeastern respondents, 79 percent of Midwesterners, 84 percent of Southerners, and 84 percent of respondents from Western states reported support for maintaining or increasing funding for sidewalks and bikeways.
91 percent of respondents between the ages of 18 and 29 support continuing or increasing biking and walking funds.

These survey results add critical perspective to a pressing national debate about transportation, especially as some members of Congress propose eliminating dedicated funding for biking and walking. We have been saying that people want safe places to bike and walk, and this survey supports that claim.

Dan Moser Column: May is National Bike Month: Get out and ride with purpose

This week's column focuses on activities to mark National Bike Month, the Ride of Silence, some upcoming runs, and an update on the Burton Park/Del Prado pedestrian safety issue.

It’s May and it’s getting hot, but the daily thunderstorms won’t begin for a while. Before they do, get out and ride your bike. And make it a trip you’d usually take by car. If you’ve been doing that as part of “Taking it to the Streets,” keep it up. Combine transit and cycling to maximize the benefits.

Unfortunately, National Bike Month takes place at a time of year that isn’t quite as attractive as it might be up north for first time bike commuters or others who don’t regularly ride, but it’s still decent enough to give it a shot. (the Florida Bicycle Association and other organizations had previously been able to get March designated as Florida Bike Month but our current elected leadership doesn’t seem interested.) The Lee County Board of County Commissioners recognized National Bike Month in a resolution at its May 1 meeting, something they do each year, as do other local governments.

Some area activities during the month include Ride of Silence, a slow and quiet ride meant to commemorate those who died or were seriously injured while cycling. Rides of Silence take place throughout the world on Wednesday May 16. There are a few being held in Southwest Florida, with the Fort Myers ride beginning at Centennial Park at 7 p.m. Sanibel and Bonita Bay also take part. The League of American Bicyclists (www.bikeleague.org) has designated Friday, May 18, as the official “Bike to Work Day.” The idea is to encourage everyone to give it a shot that day, especially those who already make some trips on their bikes and who are thinking about taking the next step: commuting to work by bicycle. Other events
After my last column about trail running I received an e-mail from the executive director of the Corkscrew Regional Ecosystem Watershed, who informed me of the organization’s inaugural 10K Adventure Trail Run to be held on Nov. 3. It’ll be a bare-bones event with no T-shirts or other usual race paraphernalia so it is being billed as a “back to nature” event. In fact, there’ll only be water refill stations for runners to re-supply their own bottles so litter and the expense of cups isn’t an issue. It’s also noted that the term “adventure” really means wet and muddy. I like it! Plan to support this event and cause. CREW is located near the Lee-Collier line not far from Immokalee. Another run that takes place off the pavement that’s coming up much sooner is the annual Memorial Day Run on the Green. The race is run on the back nine of Eastwood Golf Course, next to the Calusa Nature Center. And since runners will be right next door, why not visit the nature center’s trails, boardwalks, rescued wildlife facility and other offerings? If you haven’t been there for a while, or, for that matter, ever visited, Memorial Day would be a great time to experience this oasis of nature and calm in the middle of the prime example of major suburban sprawl that is the Colonial/ Ortiz/Six Mile/I-75/Forum area.

Advocacy update
The city of Cape Coral and many residents and safety advocates continue to press the Lee County Department of Transportation to make crossing Del Prado safe for pedestrians using Burton Park. LCDOT is balking at installing a full-fledged traffic signal at the intersection that’s closest to the park, citing lack of warrant (a technical term meaning not enough vehicles are coming from the street intersecting Del Prado). But its latest offer to install a mid block signal designed specifically to accommodate pedestrian crossing — a HAWK — looks promising. BikeWalkLee’s online blog (bikewalklee.blogspot.com) is the place to go for updates on this and other such matters.

News-Press: Memorial held for Fort Myers cyclist killed on Sanibel Causeway

A small memorial held Monday to mark the one-year anniversary of the death of the Fort Myers cyclist killed while riding over the Sanibel Causeway, also served as a painful reminder to some that after a full year, no one has been held responsible for her death.
Tracey Kleinpell was struck and killed May 7, 2011 while riding with her husband Gordon to Sanibel Island.

“There were tears, but it was a joyful celebration, because that is who she was,” said family friend Mary Dahl. “The whole theme of the day was about how she was a very special person.”

Dahl, one of about 25 people who attended the ceremony, said Kleinpell’s death continues to take a toll on her father and mother, George and Donna Henault. “They are having a horrible time with it,” Dahl said.

The Henaults, who were out of town Tuesday, declined to be interviewed for this story, but they previously told The News-Press they hoped the driver of the truck, Theresa L. Shirley, of Bokeelia, would face charges in their daughter’s death. They also said they were concerned about the length of time the death investigation was taking.

The Florida Highway Patrol said Shirley was traveling north when she veered across the road and struck Kleinpell, sending her over a waist-high guardrail and into San Carlos Bay.
She was pulled out of the water and brought to shore by passing boaters but was pronounced dead after attempts to resuscitate her were unsuccessful.

Shirley was not injured, and she wasn’t cited for the crash at the time. Since that day, there has been an ongoing death investigation but there has been no word if charges are expected to be brought against Shirley.

The perceived lack of action has some in the cycling community afraid there won’t be a resolution in the case.

“I’m really disappointed and frustrated,” said Darla Letourneau with BikeWalkLee, a community group geared toward raising public awareness about safe travel on the streets in Lee County. “It’s been a year, and it’s been total silence.”

The investigation has progressed during the past year with the Florida Department of Law Enforcement working with FHP to gather information including toxicology reports.

In recent weeks, FHP handed over results of the investigation to the state attorney’s office, the agency that will ultimately determine if charges will be filed in the case.

State attorney’s office spokeswoman Samantha Syoen said the case is currently under review, but she said there is no timetable as to when a decision might be made.

“Since it took Florida Highway Patrol one year to investigate, it will take us time to go through everything they handed in,” she said. “We don’t set a timetable to do a thorough review.”

Syoen added the state attorney’s office recently had to request additional elements from FHP for the review, and the office is still waiting for that information.

Letourneau said the lengthy investigation has people concerned no charges will ever be filed.
“I’m very worried it’s going to end up as nothing,” she said. “This case was clear cut. There was no doubt the driver was at fault, and if they can’t bring charges in a case like this, they will never bring charges.”

Letourneau said there is a pattern state and nationwide of charges not being filed against at-fault drivers who hit bicyclists and pedestrians, which has promoted a culture of distracted driving.

A white ghost bike, which was placed on the causeway as a memorial to Kleinpell after her death, serves as a daily reminder of the loss of a woman, who would have celebrated her 47th birthday last Thursday.

Ghost bikes are traditionally placed as roadside memorials where a cyclist has been killed or severely injured. They are also intended to remind motorists to share the road.

Letourneau said she’s glad the bike is still there and hopes it prevents future tragedies like
Kleinpell’s. “For people who come off Sanibel, it is a sober reminder every day,” she said.

A small memorial held Monday to mark the one-year anniversary of the death of the Fort Myers cyclist killed while riding over the Sanibel Causeway, also served as a painful reminder to some that after a full year, no one has been held responsible for her death.
