he can order this himslf, if you are a "passanger" on the
ship. If you exhibit behavior or file documents in contravention to
the "VOYAGE", he is within his rights, under ADMIRALTY to IGNORE
your claims. However, if he has signed or agreed to a CONTRACT,
which he has BREACHED, causing you "commercial injury" he is subject
to the Admiralty Jurisdiction as a FICTION. And that goes for ANY
Captain or ANY SHIP, for that matter. You cannot appeal to the same
CAPTAIN for RELIEF of the sort afforded by Common Law, when you are
in Admiralty Jurisdiction. You cannot appeal to the OWNER of the
Ship, or the Captains employer, and expect Common Law Relief.
However, you can file a CLAIM in the Admiralty Jurisdiction, for
RELIEF, and it is then the "Admiralty" Court's MINISTERIAL DUTY to
find on the merits of the case, that being the particular "LAW" of
the particular "CONTRACT". If you think that he can or will "FIND"
for his fellow "judges" or "fraternal bretheren", think again. It reaped tens of millions of dollars from people around the country on the basis of poorly documented debts, court investigators found.

The collections continued while an arm of the court that is supposed to protect the public from rogue lawyers investigated a flood of complaints about the firm.

The Appellate Division of state Supreme Court in Rochester called the firm's tactics illegal in a ruling Sept. 22, and suspended partner Danielle Lenahan for two years. Her father and partner in the firm, J. Daniel Lenahan, had turned in his law license in March.

Officials of the court disciplinary unit, called the Attorney Grievance Committee, said the penalty sends a warning to other local collection lawyers.

But critics say the lengthy crackdown exposes a glacial disciplinary system that gives lawyers every break.

"I never expected them [Lenahans] to get as far as they did," said Joel Castle, president of a debt collection company in Amherst. He added that he was disappointed other agencies at federal and state levels failed to act.

"This decision did take a long time," said William N. Lund, director of Maine's office of consumer credit regulation. He complained to the Grievance Committee about the collectors' "consistent pattern of illegal behavior" in the spring of 2004.

The collection outfit took in $20 million to $30 million during a three-year period ending in September 2005, of which the Lenahans received more than $100,000, court investigators said.

The Attorney Grievance Committee in Buffalo started investigating complaints about the firm back in 2003, court records show. It issued a non-public warning letter, the mildest remedy, to J. Daniel Lenahan in February 2004.

When complaints continued to pour in, the Grievance Committee opened another investigation. That eventually led to disciplinary charges against the firm's two partners in November 2005 - 21 months after the initial warning to Lenahan, and more than two years after the initial investigation was opened.

The Grievance Committee lacked the power to come down on the firm sooner, former chief counsel David L. Edmunds Jr. said, despite indications of widespread illegal acts.

"It did not happen as soon as I would have liked it to," Edmunds said of the charge and resulting sanctions, "but ultimately we did get the right result."

Edmunds, a past president of the Erie County Bar Association, supervised the investigation of the Lenahans before going into private practice at Phillips Lytle in Buffalo in June.

High standards for proof of lawyers' wrongdoing blocked the committee from filing a disciplinary charge earlier, Edmunds said, or from suspending the Lenahans' law license on a temporary basis during the investigation.

John V. Elmore, chairman of the Grievance Committee in Buffalo, said that an investigation can rein-in wrongdoing before it is complete. Investigators were preparing to file disciplinary charges when the Lenahans withdrew their name from the collection offices in the fall of 2005.

"I think the public is protected because any time a lawyer becomes aware they're being investigated by the Attorney Grievance Committee, it's like a shock wave," Elmore said. He added that he couldn't comment on any specific case because of confidentiality rules.

The committee's warning letter back in 2004, however, failed to stop collection abuses, court records show. J. Daniel Lenahan promised to fire one abusive collector to end the committee's investigation, but the same collector was rehired and turned up as the subject of another complaint.

How committee works

An arm of the state Supreme Court's Appellate Division, the Attorney Grievance Committee is a volunteer group that investigates complaints of professional misconduct by lawyers, with the help of staff investigators and its chief counsel. The committee covering Western New York is made up of 18 lawyers and three non-lawyers, and meets in Buffalo six times a year.

If the committee finds that a complaint has merit, it files a formal charge and petitions the judges of the Appellate Division in Rochester for disciplinary action. The judges may suspend or disbar the attorney, or dismiss the committee's charge.

Edmunds said he chose to take the time to present an airtight case against the Lenahans. Otherwise, having the charges dismissed could have thrown open the door to abuses by other collection law firms.

"We certainly wanted to make sure we had all our ducks lined up in a row," he said.

Victims of the collectors came from far and wide. The investigation records summarize 65 complaints, many involving threats of jail, seizure of property or other outlawed tactics. Kimberly Tipton in Sanford, S.C., said a collector threatened her 14-year-old son that he would "put his daddy in jail if he didn't pay his bills." Michael Lash of Albuquerque, N.M., said he was told to pay debts he had already erased in bankruptcy or face $35,000 in attorney fees and costs.

Rather than prodding the Grievance Committee to act, the volume of complaints actually delayed action against the Lenahans, Edmunds said. Investigators held back from filing a formal charge about initial complaints in order to investigate newer ones, he said.

Such complaints from individuals - although numerous and consistent - usually lacked supporting evidence like tape recordings to refute the Lenahans' denials that the threatening calls took place, Edmunds said.

Other complaints with greater substantiation did come in, such as from courts and regulatory judgments against the Lenahans. Lund, Maine's consumer credit regulator, found the firm acted illegally based on consistent complaints by debtors that were supported by other witnesses. He sent his findings to Buffalo in the spring of 2004, after barring the firm from calling Maine residents.

But the Grievance Committee felt Lund's ruling lacked sufficient weight, because the Lenahans hadn't presented a defense during the hearing in Augusta, officials said. As with many civil court actions against them, the Lenahans failed to appear at the proceeding in Maine.

Due process

Sometime in 2005 the Grievance Committee grew concerned enough about the Lenahan firm's conduct to seek an emergency "interim suspension" of the Lenahans' law licenses, a rare step.

That move was delayed for some period, however, by rules that allow the accused attorney to argue against the measure, Edmunds said. By the time the suspension request was heard by the Appellate Division, the Lenahans had severed their ties to the collection business, and the request was rejected.

"They wanted to defend the case as far as they could," Edmunds said.

Richard T. Sullivan, a former chairman of the Grievance Committee in Buffalo, represented the Lenahans before the committee.

In an interview, Sullivan said he was concerned that debtors were using the disciplinary process to evade paying debts by filing complaints against his clients. Sometime in 2005, however, he recommended that the Lenahans break their arrangement with the operators of the collection offices, he said, which they did about Sept. 1 of that year.

Edmunds said that length of the investigation is the result of a process that must balance potential harm to the public with lawyers' right to defend charges of wrongdoing.

"I strongly believe attorneys have due process rights," he said. Edmunds said he plans to represent attorneys accused of wrongdoing before the committee as early as next year.

But others whose job is to look out for consumers are disappointed that abusive collectors were allowed to operate for so long under the name of New York-licensed attorneys, giving weight to their threats of legal action.

Maine residents continued to be threatened by Lenahan collectors, and by other law firms in Buffalo, while the disciplinary process ground on, Lund said. Maine's legislature went so far as to tighten laws restricting the activities of out-of-state law firms as a result of Lenahan collectors' bullying, Lund said.

"I hope," he said, "subsequent opinions on similar facts could be decided on an accelerated basis."

e-mail: fwilliams@buffnews.com

Michael Stephens hates the Internal Revenue Service

Tax Revolt: Plaintiffs File Coordinated Cases Against IRS

Emma Schwartz
Legal Times
October 13, 2006

Michael Stephens hates the Internal Revenue Service. He believes it steals his money, and he won't stand for it.

"That's all we are, is slaves," says the 49-year-old truck driver from Georgia, who sued the agency. He claims he is entitled to damages through the Taxpayer Bill of Rights for alleged misconduct in tax collection by the IRS.

Stephen's complaint -- which Judge Ellen Huvelle of the U.S. District Court for the District of Columbia dismissed in June -- might simply be a footnote in the flood of pro se cases that pour into the courthouse each year, except that Stephens isn't alone. His complaint is one of 108 nearly identical cases filed since last fall by plaintiffs from Oregon to Florida.

The effort hasn't seen much success; so far, 40 have been dismissed because of the plaintiffs' failure to exhaust their administrative remedies. But the cases managed to pique curiosity in judges' chambers.

So who's behind this effort?

Stephens won't say. Nor would more than two dozen other plaintiffs, who either did not return calls or declined to answer questions.

Seattle's Heidi Broward, whose husband Paul had his claim dismissed in July, says the suits are a coordinated effort by people who met through "various things over the Web and from years and years of networking."

The complaints are the brainchild of Chicago-based anti-tax activist George Pragovich, Broward says: "He's one of the major coordinators of what we're doing. I just fill out the forms and send them in."

But Pragovich wouldn't talk.

"Let me put it like this: Like they say on TV, I can't discuss pending litigation," Pragovich said before hanging up the phone.

It looks like I'll have to change the calendar button into a subscription button so it will work better.

In the meantime you can also follow me around the net on your cellphones.

You can actually do that if you have a cell phone that can access the web.

Richard Cornforth's November lawschool announcement

For one thing, if lawyers and judges actually admitted to knowing the law, very few legal actions would go forward and most lawyers would be out of a job. In my opinion, the main reason that lawyers and judges seem to know so little about law, is because their legal education was grotesquely inefficient, dwelling in the intellectual morass of political correctness, fine-tuning the art of deception, and learning the art of intentional obfuscation.

A way to avoid this quagmire perpetrated by lawyers and judges is to be knowledgeable in the law and well-disposed to using it as Thomas Jefferson advised.

<p class="MsoNormal" style="border: medium none ; This is true indeed, as most people are lulled into a sense of compliancy, believing that life is good until some fateful day, when through uncontrollable circumstances, they are drawn into the vortex of the monstrous evil of what our institutions have become. Being drawn into the vortex is followed by another stark realization that public officials, with rare exception, lack the intellect and character to make decisions which affect the lives of others.

Now, worthy candidates have the opportunity to become fine-honed agents for change to a new tomorrow when government officials of all levels are held accountable for their acts and suffer consequences for their criminal misconduct. Concisely, "Knowledge is power" but, "Too little knowledge is a dangerous thing".

Armed with powerful knowledge and unhindered by knowing too little, associates of “The Helm Society School”, can be masters of their own destinies. The world as we know it will pass away, but the people who are dedicated to the ideals of “Truth, Justice, and the American Way” achieved by the process of “Facts, Law, and Procedure” can institute a new world order

The TIGTA report found that IRS computer systems holding or transferring private taxpayer information have received the required Privacy Impact Assessment (PIA) only 54 percent of the time. The E-Government Act of 2002 requires a PIA to be filed with the Office of Privacy and Information Protection for each of the IRS’s 240 systems or projects involving personal data.

“The TIGTA findings that privacy has not been adequately maintained by IRS employees remind us why Congress mandated that the IRS engage the private sector to help them fulfill their mission,” said ACA Director of Government Affairs Jenifer Loon. “While the IRS works diligently to address privacy concerns, taxpayers can be assured that private tax collection agencies are using state-of-the-art technology and best business practices to safeguard privacy while helping to reduce the $300 billion tax collection gap,” Loon said.

“Sadly NTEU, the public employees union representing IRS workers, opposes strengthening privacy for taxpayers by relying on private sector resources and has chosen instead to twist the facts in order to purposely confuse and scare taxpayers,” Loon said. An October 5th press release from the NTEU made unfounded and inaccurate claims that the TIGTA report disapproves of the PCA program. “Contrary to NTEU assertions, the TIGTA report says nothing about the PCA program. This is because PCA’s adhere to more stringent privacy standards and do not even receive tax return information from the IRS.”

Private Collection Agencies (PCAs) have been contracted by the IRS to recover delinquent taxes that the IRS—due to a structure that lacks many tools used professionally and effectively by the private sector—is unable to pursue internally. The initial phase of the program began September 7 and is already exceeding expectations, according to congressional testimony last week by IRS Commissioner Mark Everson.

“Already I’m told (hearsay testimony) we have received over a half a million in cash thus far from some 250-odd taxpayers,” (Government speak for "An average of only $2,000 per each person paying up) Everson told the Homeland Security and Government Affairs Subcommittee on Federal Financial Management, Government Information and International Security.

Responding to questions from the Subcommittee members, Everson indicated the debt collection program was off to a good start. He also pledged to vigilant oversight of the program. “I’m cautiously optimistic that [the program] is going to supplement and bring in more money to help us, but if there are any warts or problems with it, we’re going to be very transparent about it and make whatever adjustments we have to.”

The Privacy Impact Assessment filed for the PCA program can be viewed online at http://www.irs.gov/privacy/article/0,,id=140507,00.html.

The complete TIGTA report is available at http://www.ustreas.gov/tigta/auditreports/2006reports/200620166fr.pdf.

ACA International, the American Criminals Association , is the comprehensive, knowledge-based resource for success in the credit and collection industry. It is called GOOGLE CALENDAR. And here is what it looks like.

I'm informing the Cornforth strategies group about this new gadget because it will show up every time there is a J-accuse meeting chaired by Richard Cornforth himself every 1st and 3rd Thursday. The meetings start at 7:00 P.M. and are held at the Denny's Restaurant which is located on the I-240 Service road just east of South Pennsylvania Avenue.

I'll be adding a map that you can use to get driving directions to the meetings as well as some other goodies. You can get notifications every meeting night by subscribing to the calendar and I think you can get them on your cellphone as well.

You can right click on the image and drag it to your desktop so you will be reminded of the meeting nights. I wish there were some way to bring the meetings live to you but I have not figured out how to do that yet because there is no internet access available at Denny's and there are no wifi hotspots available that I know of.

Starbucks might be close enough to get in on their system but the problem is that I would have to use my cellphone to access it and if I can't hit Starbucks from Denny's then I would have to use my cellphone as a modem and I don't think a cellphone has enough bandwidth to carry good audio. I'll have to experiment with it some more to figure out how to broadcast our meetings on the internet. I'm sure it can be done but I just have to learn how to do it without broadband access. If there were broadband access it would be no problem.

These Google calendars are pretty neat since they are also searchable and anyone searching for Richard should get the calendar. I'll have to try that and see what happens in a day or two so as to give Google time to start circulating it.

Anyone can do this and have their own calendars as long as they have a blog or a wiki or a website. I'll be adding this Calendar to as many places as I can just as soon as I can get a better grasp on how it will circulate and show up in searches.

Google is adding lots and lots of very cool new goodies to their line. They just bought UTUBE which is a video sharing company for 1.6 billion and that should tell us all just how important video is getting to be on the internet. I have produced several videos and plan on producing quite a few more as time goes on.

Videos can be produce from a series of digital photographs or from powerpoint presentations as well as by camcorder. So now you can use a digital camera, take lots and lots of pictures of your family gathering, birthday parties or other events you might attend and turn them into a movie that can be uploaded to utube, flikr and many other places. They can be public or they can be kept private.

The only real problem with that is that the movies must be short, usually less than 10 or 15 minutes or it takes a horrible amount of time and storage space. I'm sure that will change in time as they figure out how to compress video a lot more than they have been able to do so far and maintain good picture quality.

Yes, Charliegirl, it is obviously a brand new site. That means that at this time, it probably has no clout at all. We don't know who actually runs that site so it might be some actual government entity or it might just be somebody who has no influence at all with anybody.

But look at this group as one of a zillion examples of sites that started out with only a few people and over a relatively short period of time has grown a lot. That site can be made to grow a lot too and if it gets enough posters and enough fame through links pointing to it then in time it can have a lot more clout than it has now.

Enough voices screaming about certain judges in whatever baliwick will end up getting attention sooner or later and could make a difference given enough time and attention.

It is a proven fact that if a website gets enough links going to it then the search engines will start to think it must be a pretty important site and will start to give it top billing. Once it gets enough links pointing to it and the search engines start paying attention to it then maybe some people in government and the various court systems will start to wake up and pay attention to it too.

Links in message boards and egroups don't get all that much attention from the engines but they do get some and every litter bit helps.

One thing you can do that will also help a lot on other message boards is every time you say something about a judge, be it good or bad, make a link to your comments on that site. Let me show you the best way to do that.

Take the case of U.S. Magistrate Judge Bristow Marchant for example." In a court decision rendered by Judge Bristow Marchant in C/A No. 0:04-0295-22BD Judge Marchant falsely accused both Richard Cornforth and myself for teaching and spreading strawman theories about the internet. I wrote about that on my CREDITWRENCH BLOG back on 06-18-04 And of course, I knew that his ruling would probably disappear off the internet for all practical purposes given enough time and I have no intention of ever letting that happen or letting him live down his mistake

So in order to help ensure that Judge Bristow Marchant don't forget his mistake in badmouthing Richard and I and spreading false and misleading information about us I will post my opinion of him on the courthouse forum.

And that brings us to another very important topic which is the use of RSS feeds. I'm sure that all of you have noticed the little red "bricks" with the letters "XML" or "RSS" on them. Some of you may have even clicked on them to see what they are all about and what you saw was not all that readable or interesting so you probably just dismissed it and went on. If so, that was a huge mistake and here is why.

That little icon above is called a feed rotator or headline animator and is designed to let people know when a blog has published new information and when. That is important because you don't want to have to go visit a blog every day to see if new information has been posted. Look at the headline animator and you can tell at a glance whether it has updated or not. That feed does some other important stuff too but it is mostly all behind the scenes stuff like automatically submitting your new articles to all the search engines and much more. You can't do that with an e-group unless the site owner turns on the RSS feed for the group as I have asked Scotsman to do several times but he has never seen fit to do so as of yet for whatever reason.
If he would just do that, this group would grow a lot because it could be given lots more attention simply by posting the animator for this group on other boards and egroups. A simple copy and paste operation does it with no problem.

Now I will introduce you to a rather new development in RSS technology which is totally readable and very, very informative. By clicking on the link above you will immediately see that it is full of very easy to read information but what is even more amazing is that it changes content just about every hour and if not every hour then it changes each and every day for sure. There are two versions of that same feed. One is a short version and one is a long version. I don't post the link to the long version because it is so long that it can take you all day just to read through it.

Now then, the cute trick is that you can either "steal" my signature line above and use it as your own or you can go to feedjumbler.com and build your own and you don't even need to know any of the techno jargon or have any special skills or knowledge to use it and make it work for you.

Furthermore, if you have a "decent" cellphone you can even read what goes on in your favorite egroup or blog, get the latest news, surf the web, do your banking on line and do just about anything you do from your computer right from your cellphone.

I use the HTC-200 cellphone and it will not only do all of the above but it also has a camera which can take movies up to about 4 hours long, play all kinds of games, show live TV and much, much more. Phones like that usually cost about $400 and are a real bitch to get set up and working properly. I bought mine new in the box for $150 at a local pawnshop. Since it took my son and I 3 days to get the durn thing set up and working properly I tend to thing somebody bought it and pawned it when they found out how difficult it is to to get programmed and working correctly.

I guess I have rambled enough but I hope I have at least taught you how to properly imbed links in text messages on forums so the search engines will grab on to them, a little bit about how to use RSS and how important it is to do so. Not hard to do and it can make a big, big difference.

Here is a link that you all might want to use to tell the world what you think of the judges in your home state. Of course, they are supposed to have the latest and greatest credit repair information and all for only $200. Here it is.

https://id317.securedata.net/creditcollectionhelp.com//merchantmanager

But lets look at that URL a wee bit closer. What about that first part? What does it mean? Is that supposed to mean it's on a secure server so you don't have to worry about the personal banking information you provide when you pay for the info?

Well, I'm sure that is exactly what they would like you to believe, but let's just investigate that a bit closer and see who and what is really behind that "secure" website.

Let's just reconstruct the obviously phony link. Let's make it a bit simpler and see what we come up with.

http://www.creditcollectionhelp.com ought to be about right.

And here is what we come up with.

Ok, not much to go on there, but what happens when we view the certificate to see if it is genuine or what??

Here is where the lid comes off the pot.

AhHA Cried the blind woman as she shook her wooden leg, Ah Ha! Our old friend EQUIFAX!

Now then, I must ask just what kind of a fool would it take to give Equifax $200.00 to tell them how to fix their credit? Especially when you are going to have to give up private banking and other information and tip them off that you are in fact trying to fix your credit???????

So what tells us that something is fishy with this web site before we ever get started?

The very fact that there is no contact information whatever on the web site. That's no different than you stop at some truck stop and some dude in a long trench coat comes up to you and opens up his coat to show you that it is absolutely lined with supposedly expensive watches and asks if you want to buy a Rolex for only $20.00!!! Would you buy one from him? Of course not. You don't know who he is and if those really are Rolex watches then they are probably hot from some jewelry store burglary or the guy is an undercover cop waiting to arrest somebody for trafficking in stolen property. Either way you aren't likely to buy anything from him for the simple reason that he won't give you his name, his address or his telephone number and that is the first sign that a webpage or an email is a scam.

Reputable business people always put their names, addresses and phone numbers on their web pages because they want you to know who they are and how to contact them if you have problems or need help installing their products and making them work. Scam artists won't do that. They just want your money and hope they never hear from you again.

What else tells you its a scam? The fact that the coding was first done on a blog and then copied and pasted into a webpage using dreamweaver or maybe front page or coffeecup or whatever. The coding is all strange looking unless you don't know what html coding looks like. Then you wouldn't know the difference unless you checked out the source coding on that web site and then checked out the coding on a legitimate website.

Believe me, its easy to do.

So what else told me it was a scam? The fact that the link was posted on a debt collector's message board. That's enough to raise your hackles in the first place.

(LOL)

So watch out for these scam artists and don't fall prey to their shennigans.

Bill Bauer FEATURED ON TV TODAY!

Bill Bauer FEATURED ON TV TODAY!

Bill Bauer was featured in a Channel 9 TV news story today, June 20, 2006.

Here is the audio from the original interview and filming.

Bill Bauer is nationally recognized as a consultant in mortgage foreclosure matters as well as many other consumer orientated matters.

His expertise has helped thousands of Americans in difficult straits.

He has been extremely instrumental in helping identify debt collectors as America's most wanted criminals.

Bill Bauer can be reached for consultation at 405-616-7901

Here is the actual Channel 9 news story as it appeared on TV on June 20, 2006

Creditwrench Conference Call for May 25th, 2006

Here are the audio recordings for a part of last night's (Friday, May 25th) conference call. Our callers were having such a great time learning from each other that we let the call go on for a whole hour of overtime. There was also another reason for letting the call go on for an hour of overtime and that was that the recorder messed up and so the entire call did not get recorded.

The first hour was deleted by the recorder so we needed to let the call go on for an extra hour to make up for that time lost.

Here is the first part of what got recorded.

Here is the second part of the show.

Here is the third part of the show.

Mark Moyers Conference calls

Mark Moyers has started doing conference calls on a from-time-to-time basis. Backflips is just one of them. Shrink my link is another great bookmarking system that I use a lot because it lets me know how many people click on any given bookmark and when they clicked on it.

But it too now has so many links that it takes a lot of time to go through them and cull out the information I want at any given time. Here is another great online resource for bookmarking that I have but it too has the same problem. So much valuable information that it is hard to find what one is looking for.

That's called "information overload" and we are all plagued with it these days. Then there is the
problem of computer crashes. Overload your memory and your computer starts crashing. Hard drive crashes and you have to put in a new drive and even the most expensive backup systems fail. You can back up your hard drive and recover as long as it is recovered to the same hard
drive but if it is a different or new hard drive and you had better have a really great backup which costs a lot of money to maintain.

The next point is that one should never trust research done by someone else. Never! They make one little mistake, leave out one little word or misinterpretate one word, sentence or phrase and you get shot out of the saddle. I always tell my students that they should never believe one word I say but rather must go look it up for themselves so that they have their own first hand knowledge. Never, never trust someone else's so-called research. telling a judge that "Richard Cornforth says" or "Bill Bauer says" is about like telling him "Confucious says". (LOL)

Links are important to the "popularity" of this or any other forum or website but only if they are done right and most are worthless in terms of search engine popularity which is important to finding new members for this group. That's a whole different ball game but to make a long story short, a link that tells us nothing also tells the search engines nothing so never gets referenced by them. Research links should be imbedded into the body of the message and not at the end of
a message where they just look like a footnote or something. They should carry meaninngful anchor text and lead to something relevant to the core text of the message. We can't really do that here because the ability to do so has been either limited or denied by Scotsman and I
don't have the authority to change that. As a result, we are not getting the search engine popularity we really need to get more posters and more attendees to Richard's seminars. That's also why I sometimes post to my blog and have it emailed into this forum so links show up and get indexed. But that is a whole different topic.

Those RSS links are important to the popularity of this forum too. Everyone needs to get and use a good RSS feed reader such as AMPHETADESK or other feed reader and subscribe to this forum via it's RSS feed. but if you don't want to get and install your own RSS feed reader then you can use your and customize that to pick up the RSS feed for this forum. Chisum of Phoenix who was on his way back to his home from Muskogee, Oklahoma where he had been tried and convicted of attempted filing of false tax returns. Mr. Chisum has been an active researcher for many years and has a group of his own in Phoenix which has been meeting regularly for the last 20 years or so.

Mr. Chisum spoke to the group for about an hour and 20 minutes and the following is a video of his speech before our group. This is a pretty large file, about 170 megabytes so if you do not have a high speed internet connection I would not attempt to download it for viewing.

Please expect more videos of our j-accuse meetings in the future. The next meeting will be held on January 5th, 2006. These videos will all be nationally syndicated as well through Magna Carta News Service of Oklahoma City, Oklahoma.

J.C. He reported that, as usual, Richard spoke highly of my Creditwrench and what I do. As most of my readers well know, I highly recommend the works of both men. I'm certainly happy that the two of them finally got to meet each other. Both of them do seminars and are highly regarded as being great public speakers.

The following files are in mp3 format and you will not need any special player. Quicktime or most any of the popular mp3 type players should work just fine. The major drawback is that since they are in mp3 format they are pretty big, running about 28 megabytes each and will take a bit more than 2 minutes to download if you are on DSL or cable and if you are on a 56k modem you can count on the fact that it will probably take a very long time for the files to download.

Creditwrench Conference Call
for Fri. Nov 11, 2005
1st half hour

2nd Half Hour

3rd Half Hour

Creditwrench speaking with Frederick Graves while he was attending the Richard Cornforth seminar in Orlando Florida.

I'm pleased to announce that we should be doing some great vlogging by the end of the month. I know that most of my readers will now be wondering what the heck vlogging is. Vlogging is the "geeky" name for video blogging. I've purchased a top quality professional video casting program that will do just about anything and so when I get the rest of the hardware in that is needed I will be able to grab content from camcorders, VCRS, DVDs or whatever and also do live video casting which can be put on the internet on blogs such as this one or on webpages or wherever I want them to be. Although I can do videos of entire movies if I wanted to the webspace to do that would be very prohibitive but I can easily do short videos of up to maybe 15 minutes with no big problem at all. The content can be anything I want it to be.

It should be fun for all of us.

Banks standing to sue in State Courts.

Bank's standing to sue in state courts

Richard Cornforth was speaking on that very topic in our last J-accuse meeting.

Vinny Tecchio has also discussed that matter in a couple of his conference calls and so I would suggest that you listen to the audio here and check with Richard to see if he can offer you some suggestions along the lines that you are speaking about here.

I'm sure he can offer you some insights as usual. The audio post is in mp3 format so you won't need the Sony player to listen to it. Just click on it and it should start playing immediately.

Folks,

>From my research on credit card banks suing in a foreign state outside of the bank's incorporated state. I've learned that if a bank is a Nationally Associated bank (N.A.) they do not have to register in each state.

You will see many times a credit card bank will only be registered in the state where they have their headquarters or the state where the bank originally incorporated, such as Delaware.

I cannot find any case law stating a Nationally Associated bank is "restricted" from coming into your home county, voluntarily submitting the bank to the jurisdiction of your local court, and bring suit against you.

Been there, fought the fight and lost because I could not find any law to overcome the attorneys claim the out of state bank had standing to bring suit in the local county court where the defendant lives by voluntarily submitting the bank to the jurisdiction of the court.

If anyone has successfully overcome the merits of this issue or has "case" law that contradicts this issue, please shed some light on this issue.

Otherwise, I have not found any law (statute or case) that contradicts this matter.

creditwrench@gmail.com
