The bill provides for a seven-members of whom at least four of them including the chairman and vice-chairman shall only belong to a 'group' (the minority community).

A similar body is intended to be created in the states. Membership of this body thus shall be on religious and caste grounds. The offenders under this law are only the members of the majority community.

The draconian and anti-federal character of the “National Authority” becomes

clear on Page 16 under the “Powers of the National Authority”. Specific anti federal powers include:

– Binding directives to agencies of the State

– Judicial Powers of a Civil Court in running inquiries and investigations

– Power to search any building

- Power to refer cases for trial to the Judiciary under the Criminal code

– Treating proceedings conducted by it as Judicial Proceedings

– Wide investigative powers through any existing agency

– Role on inquiring into the conduct of Armed Forces.

What are the procedures to be followed

The procedures to be followed for investigations under this act are extraordinary. No

statement shall be recorded under section 161 of the CrPC. Victim statements shall be only under section 164 (before courts).

The government will have a power to intercept and block messages and telecommunications under this law.

Under clause 74 of the bill if an offence of hate propaganda is alleged against a person, a presumption of guilt shall exist unless the offender proves to the contrary. An allegation thus is equivalent to proof.

Public servants under this bill under clause 67 are liable to be proceeded against

without any sanction from the state.

The special public prosecutor to conduct proceedings under this act shall not act in aid of truth but 'in the interest of the victim'. The name and identity of the victim complainant will not be disclosed. Progress of the case will be reported by the police to the victim complainant.

This law, if happens is bound to be misused. Perhaps, that

appears to be the real purpose behind its drafting. It will encourage minority

communalism.

We request you to read the proposed act on the website and oppose the proposal as we feel it is against the Majority community and can create danger for the Nation.

The basic premise behind this new bill is deeply flawed and anti-federal.

This draft bill however proceeds on a presumption that communal trouble is created only by members of the majority community and never by a member of the minority community. Thus, offences committed by members of the majority community against members of the minority community are punishable. Identical offences committed by minority groups against the majority are not deemed to be offences at all.

Page 50: Another insight into the communally prejudiced mindset with which this bill was written becomes evident within the section on “Guarantee of non-repetition” “The search for the bodies of those killed or disappeared and assistance in the identification and reburial of the bodies in accordance with the cultural practices of the families and communities.”

This means, NAC have made the assumption that perpetrators will always be Hindus and the victims will always be Muslims or Christians!

Offences which are defined under the bill have been deliberately left vague. Communal and targeted violence means violence which destroys the 'secular fabric of the nation'.

There can be legitimate political differences as to what constitutes secularism. The

phrase secularism can be construed differently by different persons. Which definition is the judge supposed to follow?

Page 10 : The Bill’s anti-federal character becomes clear on when it seeks to

confer on the Central Government the power to intervene. Democratically elected governments will be required by law to explain within 7 days why the National Authority directives were not complied with - The setting up of a parallel structure within the states called the “State Authority” If the proposed bill becomes a law- central government will snatch the jurisdiction of the states and legislated on a subject squarely within the domain of the states.

It is also ironic that the NAC have adopted definitions from the much maligned Maharashtra Organized Crime Act (MCOCA) and TADA despite having opposed similar legislations pending from other non- Congress states.

Thus a sexual assault is punishable under this bill and only if committed against a person belonging to a minority 'group'. A member of a majority community in a state does not fall within the purview of a 'group'.

A 'hate propaganda' is an offence against minority community and not otherwise. Organised and targeted violence, hate propaganda, financial help to such persons who commit an offence, torture or dereliction of duty by public servants are all offences only if committed against a member of the minority community and not otherwise.

No member of the majority community can ever be a victim!

This draft law thus proceeds on an assumption which re-defines the offences in a highly discriminatory manner. No member of the minority community are to be punished under this act for having committed the offence against the majority community.

If implemented in a manner as provided by this bill, it opens up a huge scope for abuse.It can incentivise members of some communities to commit such offences encouraged by the fact that they would never be charged under the act.

Terrorist groups may no longer indulge in terrorist violence. They will be incentivised to create communal riots due to a statutory assumption that members of a jihadi group will not be punished under this law. The law makes only members of the majority community culpable.

Why should the law discriminate on the basis of a religion or caste?

An offence is an offence irrespective of origin of the offender. Here is a proposed law

being legislated in the 21st century where caste and religion of an offender wipe out the culpability under this law.

The most disturbing aspect of the Bill is under“Defenders for Justice and Reparations” where in the state authority can appoint any random individual and empower him or her with an interventionist role.

In conclusion it must be noted that this Bill stands out for the contempt and disregard with which it holds the Parliament of India by offering NO ROLE to Parliament in the removal of members appointed to the proposed “National Authority”.

The word Parliament occurs exactly 4 times in the entire draft bill. There is no mention in the entire draft bill on how exactly the proposed “National Authority” will be accountable to Parliament for its interventionist conduct beyond the token act of placing its annual report during the monsoon session.

Bottomline : This bill has been written with just one Act of Communal

Violence in mind – Gujarat 2002. It makes a mockery of the Sikh

Victims of the Rajiv Gandhi lead Congress sponsored 1984 riots in Delhi by assuming that all Victims by default are Christian or Muslim. This bill is Anti-Federal and goes against the spirit and grain of the Constitution. It must be junked in toto.

This is not the first time this has been attempted. An effort in the past to pin

down Narendra Modi by invoking a non-existent Command Doctrine failed when it was pointed out that there was no Indian Law on the same. The Communal Violence Bill by trying to invoke the Doctrine of Command Responsibility essentially makes India party to provisions of the Rome Statute despite not being a signatory to it.

The drafting of this bill appears to be a handiwork of those social entrepreneurs who

have learnt from the Gujarat experience of how to fix senior leaders even when they are not liable for an offence.

" इसका अर्थ यह है की राष्ट्रीय सलाहकार परिषद् मान चुकी है की दोषी हमेसा हिन्दू होंगे और पीड़ित हमेसा मुसलमान और क्रिस्चन|" इस विधेयक के तहत परिभाषित अपराध को जान-बुझ कर अस्पष्ट छोड़ दिया गया है| सांप्रदायिक हिंसा और लक्षित हिंसा धर्मनिरपेक्ष राष्ट्र की अखंडता और एकता को तोड़ देता है| क्या वैध राजनितिक मतभेदों के रूप में धर्मनिरपेक्षता का गठन किया जा सकता है|

धर्मनिरपेक्षता का अर्थ व्यक्ति दर व्यक्ति अलग होता है, परन्तु यह अपने ऊपर है की धर्मनिरपेक्षता के कौन से परिभाषा का अनुकरण करते हैं| इस विधेयक का विरोधी संघीय चरित्र तब स्पष्ट हो जाता है, जब केंद्र सरकार इस मुद्दे पर अपने अधिकारों का प्रयोग कर हस्तछेप करे| लोकतान्त्रिक ढंग से निर्वाचित सरकार के लिए आवश्यक हो जायेगा की 7 दिनों के अन्दर कानून का अनुपालन करें और राज्यों के भीतर समान्तर संरचना की स्थापना करें जिसे "स्टेट प्राधिकरण" कहा जाता है|

अगर यह प्रस्तावित बिल कानून बन जाता है तो केंद्र सर्कार राज्यों का अधिकार क्षेत्र छिनने और राज्यों के भीतर कानून बनाने और राज्यों के कार्यक्षेत्र में शासन करेगी|

विशेष लोक अभियोजन पैनलों में धार्मिक और भाषाई अल्पसंख्यकों के अनुपातिक प्रतिनिधित्व के लिए बेतुका प्रावधान की मांग की गई है| यह भी विडंबना है की राष्ट्रीय सलाहकार परिषद् ने महाराष्ट्र में संगठित अपराध कानून मकोका और टाडा जैसे अधिनियम को अपनाया है, जो की गैर कांग्रेसी राज्यों में लंबित है| इस प्रकार यौन उत्पीडन इस बिल के तहत दंडनीय अपराध है अगर वह किसी अल्पसंख्यक समूह के व्यक्ति के खिलाफ प्रतिबद्ध है, परन्तु अगर वही कार्य अगर किसी बहुसंख्यक समुदाय के व्यक्ति के साथ होता है, तो वह दंडनीय अपराध नहीं है|

अल्प्संखयक समुदाय के खिलाफ नफरत एक दंडनीय अपराध है अन्यथा नही| संगठित या लक्षित हिंसा या नफरत और कर्तव्य का पालन करते सरकारी कर्मचारी द्वारा लापरवाही और इन सब अपराधों में अल्पसंख्यक समुदाय के खिलाफ प्रतिबद्ध नहीं है तो ऐसे व्यक्तियों को वितीय मादा दी जाएगी|

"बहुसंख्यक समुदाय के लोग कभी पीड़ित नही हो सकते|" इस कानून के मसौदे इस प्रकार के धरना पर परिभाषित किया है जिसमे अपराध को भेदभावपूर्ण तरीके से दिखलाया गया है| इस कानून के तहत ऐसा भी कहा गया है की यदि अल्पसंख्यक समुदाय बहुसंख्यक समुदाय के खिलाफ कोई अपराध भी करते हैं तो उसे अपराध नही कहते|

अगर ये कानून इस प्रकार से ही लागु किया गया तो इसका अधिक दुरूपयोग होगा| इस प्रकार के अधिनियम कुछ खास समुदाय के लोगों को अपराध करने को प्रोत्साहित करेंगे क्योकि उन्हें दंड नही मिल सकता| आतंकवादी संगठनों को अब आतंकवादी हिंसा में लिप्त होने की जरुरत नही पड़ेगी क्योकि इस कानून को पारित होने क्ले बाद वह सिर्फ सांप्रदायिक हिंसा ही करवाएंगे क्योकि उन्हें इस कानून का संरक्षण मिलेगा| क्यों एक धर्म और जाती के अधर पर कानून में भेदभाव होना चाहिए? अपराध-अपराध है इसमें अपराधी की मूल क्या जरुरत है| यह प्रस्तावित कानून 21वी सदी में कानून बनाया जा रहा है जहाँ एक अपराधी से जाती और धर्म पुच कर दोषी करार दिया जायेगा|

इस विधेयक का सबसे ज्यादा परेशां करने वाला पहलु है की न्याय और मुआवजा राज्य को देना है जिसके लिए वह किसी भी याकछिक व्यक्ति को नियुक्त कर सकते हैं और उसे हस्तछेप करने की सशक्त भूमिका है|

अंत में इस विधेयक को अवमानना के लिए बाहर खड़ा करना चाहिए और इसे संसद में प्रस्तावित करने के लिए राष्ट्रीय प्राधिकरण द्वारा नियुक्त सदस्यों को हटाने में कोई भूमिका नही देकर भारत की संसद की उपेक्षा नही करनी चाहिए| इस विधेयक को टायर करते समय 4 बार संसद शब्द का प्रयोग हुआ है| इस बिल को संसद में कैसे संचालित किया जायेगा मानसून सत्र में इसका कैसे जिक्र होगा इस पर कोई ध्यान नही दिया गया है|

इस बिल में सिर्फ एक सांप्रदायिक हिंसा को मनन में रख कर लिखा गया है- वह 2002 के गुजरात दंगे| जो सिख दंगो का मजाक बनता है, जो 1984 में राजीव गाँधी के सरकार के शासन में दिल्ली में हुए साथ ही यह बिल यह भी दर्शाता है की डिफाल्ट रूप से हर वक़्त पीड़ित किर्स्चन और मुस्लिम होते हैं| यह बिल संघीय भावना और संविधान के स्वभाव के खिलाफ जाता है| इस विधेयक को पूर्ण रूप से अस्वीकार कर देना चाहिए

What Mamata Banerjee swore as her priorities while coming to power in 2009:

i. Maximum viability and profitability for the railway.

ii. Maximum passenger comfort.

iii. Adequate and appropriate safety for both crew and passengers.

What Mamata Banerjee manifested after coming to power in 2009:

Bankruptcy: The railway’s poor financial health is an open secret today. Despite her blames directed towards the pay commission, the last couple year’s figures reveal that Lalu Prasad Yadav’s budget (2007-08) was superior. It presented a surplus of Rs. 25000 crores, which steadily declined to Rs. 17400 crores (2009-10); followed by Rs.1328 crores (2009-10) and finally, to a deficit of Rs.4000 crore (2010-11). This is not assisting the Nation’s economy, as the railway is supposed to. The union government subsidized the railway to stabilize the situation, but also granted Mamata Banerjee Rs.20000 crores, which is half the amount (Rs.40000 crore) she asked for.

Should we see this as the UPA government granting an inefficient person another chance at the expense of people’s money?

Decline in operating ratio: Operating ratio is defined as the amount spent to generate every 100 rupees. Lalu Prasad brought it down to Rs. 75; as of now, according to Ms. Mamata Banerjee, it stands at Rs 95. This is the highest amount ever recorded in the history of the Indian railways.
Unpaid bills: The bills generated in the last financial year had been carried over to the next year, a trick that imposes a false sense of satisfaction of keeping operational cost within Rs.100. Indian Express’ estimates the operating ratio around 115 for 6 railway zones, while the other 10 imposes not a single speck of doubt regarding the operating ratio surpassing Rs.100.
Lack of railway safety, amenities & facilities: From starting behind the schedule to passenger securities, Indian railways today bear a declining status in the public eye. The first half of February 2011 shows 700 trains of the South-eastern railway running later than the scheduled arrival and departure time; the lack of cleanliness, proper hygiene and food has added to the sufferings of the common people. And we still didn’t speak about the number of unauthorized travelers in the reserved compartments; of male passengers traveling in coaches strictly reserved for the ladies and the passive role of the Railway Police Force in reinforcing safety and security standards.
Safety and Security: The last two years witnessed the 574 deaths in a total of 250 railway accidents, a figure that surpasses any such railway calamities so in the Lalu Prasad regime. That bigger damages avoided is solely the credit of the drivers, who could make it because of a good fortune. Although Mamata Banerjee claimed such incidences to be sabotages (e.g. Sainthia), but such cases are not similar to the Gnaneswari Express derailment incident, for which, the Maoists were responsible. However, Mamata Banerjee’s sympathy for the Maoists has increased since then and her blame goes towards the Leftists. Her joint rally at Lalgarh with the People’s Committee against Police Atrocity (the organization, according to the judiciary, is a frontal organization of the Maoists) showcased a scot-free. Ashit Mahato, the chief accused in the Gnaneswari Express massacre. It is the general callousness and the laid-back attitude that costed more than 500 lives. And using the same trains for multiple routes is adding further risks to general safety of passengers, the practice depriving the vehicles of their required maintenance. One such example is the Agnibina Express; it starts from Howrah at 18.20, reaches Asansol at night and returns to Howrah in the morning, only to start for Bolpur (as Shaantiniketan Express; 10 AM) and back in the afternoon. From here onwards, it continues as Agnibina Express again in the evening. Overusing machineries without proper maintenance schedules is a direct call to accidents; the same applies for the metro railway, if we take out from this discussion the metro stations as the hotspots for them with suicidal tendencies.
Existence of Vacant posts: It is since 2009 that 90 thousand vacant posts (those related to safety and security of the railways) are deliberately been ignored due to an ideological paradigm of the Ministry of Railways tuned with the neo-liberalism of the union government, while the number of trains increased massively (from 13 lakhs to 16 lakhs; 1991 onwards). The situation has been tried covering up through an over-usage of skilled man power (some have worked for even 48 hours at a stretch), which proved all the more detrimental towards overall safety and security of the railways.

Does this justify the claims of Mamata Banerjee regarding creating a million jobs in 2 years?

Others:

Promises for laying down new tracks: Flopped because her policy backfired; new train tracks require an eviction of land owners, who must be compensated and rehabilitated accordingly. Can this be expected from a person unable to fill up even the regular vacancies in her ministry and only been able to construct 59 kms of rail tracks as opposed to the promised 1000 kms?
Are Promises meant to be broken: What does Shalimar Automobile Hub, Kanchrapara EMU Coach Factory, Kishan Vision Project at Singur, Railway Excel Factory at Jalpaiguri, Dankuni Industry for Manufacturing of Petrol and Diesel Components, Noapara Metro Rail Coach Factory, Purulia Anara Factory and Adra Power Project speaks of? None progressed beyond laying the foundation stone. None received approval either from the Planning Commission or from private undertakings supposed to form a joint collaboration with the railways. This brings forth a question on the practicality and substantiality of the projects.

The outcome of Mamata ruling the state of WB

It’s surely a never before ridiculous and retrogressive period for the Indian railways borne out of whimsical brainwaves. Mamata Banerjee’s target is becoming the CM for Bengal, a dream that made her ignore the Rail Bhavan for the greater part of her tenure as the Railway minister and make it run at a deficit of an additional Rs11 lakh per month; this is the cost of transport for the files from Delhi to Kolkata and back. According to Nitish Sengupta (former MP, TMC), nothing less than 40 years will allow to implement the budgetary allocations, a time by which – “We would all be dead” (quoted by John Maynard Keynes; English economist who advocated the use of government monetary and fiscal policy to maintain full employment without inflation).
