Why would I ask this question? For that answer, the former wsa published by the Electoral Commission, whereas the latter, when examined lexically, evidences the obsfucational difference between what was argued as being of no consequence and what was denied examination when the Electoral Commission stymied the Referendum's legislated checks and balances initiated at the Christchurch High Court, by>300 petitioners.

First, the context:

Yes — the conduct of the cannabis referendum was indeed challenged. Here's what happened:

The High Court Petition

A group of more than 330 electors filed suit against the Electoral Commission in the High Court of New Zealand seeking to have the results of the cannabis referendum dismissed.

Under the Referendums Framework Act 2019, groups of 200 or more electors who are "dissatisfied with the result of the referendum" are empowered to petition the High Court to inquire into the conduct of the referendum or those associated with it.

What They Argued

Blair Anderson, one of the petitioners who advocates drug reform, emphasised that "it's not the result of the referendum we're disputing, we're disputing the conduct of that referendum." Professor Andrew Geddis of the University of Otago wrote that "this legal challenge to the referendum stands no chance of success in court" and highlighted vagueness in the petitioners' allegations.

If It Had Succeeded

If the petitioners had been successful in getting the High Court to declare the cannabis referendum void, the Act would have required a new referendum to take place within six months of the declaration.

There's no record of the court ultimately ruling out the petitioners' favour, consistent with the legal commentary at the time that the challenge faced very long odds. 

The "No" result stood, and the government indicated it had no plans for further cannabis law reform.

So.... what is this post really all about?

When an electoral body like the Electoral Commission argues to a parliamentary committee that a simplified phrase ("voting on cannabis") is functionally identical to the formal title ("Cannabis Legalisation and Control") and had no influence on such a tight result, it carries several significant implications for democratic processes:

Given that statutory rights (to review the referendum) exist on paper, expert commentary deems them unviable, procedural barriers prevent a hearing, and the enabling legislation is left with no jurisprudential meaning at all.

How safe is the continuing political discourse that holds that 'No Won, Yes Lost' and no further discussion is warranted as the debate is resolved?

The statement "No Won, Yes Lost debate resolved" is a political proposition dressed as a legal one, and the distinction matters enormously.

Democratically speaking, a binary vote resolves a question at a point in time, under specific electoral conditions, with a specific franchise, on a specific question as framed. It does not and legally cannot permanently extinguish:

The right of political argument (a fundamental democratic liberty)

The right to seek legislative change through subsequent Parliamentary processes

The right to revisit a question where material circumstances have changed

The right to challenge procedural unfairness in the original process

If statutory review rights exist and are rendered meaningless, then the claim that the democratic process is "complete and closed" is actually undermined by the very statute that authorised the referendum, because that statute, by providing for review, acknowledged that the process might not be above challenge.

Crown Law argued the petitioners had failed to meet the security deposit requirement "in time." The ethical dimension here warrants attention.

Crown Law is not merely a private law firm, it acts as counsel for the Crown and must conduct itself consistent with its obligations as an administrator of justice and with the Crown's duty to act fairly.

Where Crown authority is exercised in relation to a statute, the terms of the statute are pre-eminent, and the statutory "real justice" mandate under the Electoral Act bears directly on how the Crown, as respondent, could legitimately run procedural arguments. [Nzlii]

If Crown Law was aware, or ought to have been aware, that the petitioners had received official advice that the deposit was not required, advancing a submission that exploited that exact gap would be difficult to reconcile with the Crown's special obligations as a litigant.

The Crown is not a private litigant entitled to take every advantage.

It has an obligation to assist the Court to do justice, not to ambush lay petitioners with procedural technicalities induced by the Court's own staff.

"A court asked to dismiss a petition for non-payment of a deposit that its own staff said was unnecessary would face serious difficulty doing so without offending basic principles of justice" — is, if anything, an understatement.

A major new study funded by the United States federal government, the largest of its kind, has found that cannabis users demonstrate superior performance across multiple cognitive domains, and that their brains exhibit characteristics typically associated with younger individuals.

The findings, published in August 2025 as a preprint by Nature Portfolio, represent a direct and evidence-based challenge to the narrative of cognitive harm that shaped New Zealand's 2020 referendum on Cannabis Legalisation and Control.

New Zealand, in fifty years of the Misuse of Drugs Act 1975, has achieved the opposite: rising use rates, a more powerful organised crime sector, entrenched racial injustice, and the mass criminalisation of 600,000 otherwise law-abiding citizens whose only distinguishing characteristic is a consumer preference shared by nearly half of all New Zealand adults.

The referendum of 2020 was lost by a margin of 50.7% to 48.4% less than 2 percentage points, often cited as settled democratic authority for continued prohibition. She is a veteran of the United States Air Force and earned her medical degree from Georgetown University School of Medicine. She is a licensed acupuncturist in the state of Maryland where she also serves as an advisory board member to the Department of Health's Prescription Drug Monitoring Program. Her area of academic interest includes perioperative considerations for the cannabis consumer.

Bonni Goldstein, MD

Bonni Goldstein, MD is a leading physician, educator, and advocate in the field of cannabinoid medicine. She is the CEO and co-founder of GoldsteinWellness.com, a free medical cannabis educational platform for healthcare professionals, and the Medical Director of Canna-Centers, a medical practice dedicated to the therapeutic use of cannabis for serious and chronic conditions.

Dr. Goldstein completed her residency at Children's Hospital Los Angeles, where she also served as chief resident. After years in pediatric emergency medicine, she transitioned to cannabinoid medicine upon witnessing its profound benefits in an ill friend. In Memoriam: Professor Rodney W. Skager (1932-2021) A Pioneer Lost: Remembering the Scholar Who Challenged Drug War Orthodoxy

The harm reduction community lost one of its most influential voices on June 2, 2021, when Professor Rodney W. Skager passed away at his home in Salinas, California, at age 88. His death, after a long battle with Alzheimer's disease, went largely unnoticed outside academic circles—a quiet ending for a man whose work challenged the loudest voices of the War on Drugs.

For more than four decades, Professor Skager stood as a rare academic willing to question the "Just Say No" orthodoxy that dominated drug education policy. As a UCLA Professor Emeritus of Education and former Associate Dean of the School of Education and Information Studies, he possessed the credentials that gave weight to his heresy: that honesty, not fear, should guide how we teach young people about drugs.

Skager's most enduring contribution was his development of harm reduction-based drug education curricula, work that directly challenged the ubiquitous DARE program and zero-tolerance policies of the 1980s and 1990s. As founder and co-director of California's Attorney General Student Survey—a biennial assessment of youth substance use—he built an evidence base that exposed the failures of abstinence-only approaches. His research showed what many parents and educators suspected but few dared say: that teenagers needed accurate information and practical harm reduction strategies, not scare tactics and moral panic.

His 2013 book, Beyond Zero Tolerance: A Reality-Based Approach to Drug Education and School Discipline, offered a comprehensive alternative vision. Rather than punishment and exclusion, Skager advocated for interactive learning, compassionate assistance, and restorative practices. His collaboration with Dr. Marsha Rosenbaum on the Safety First curriculum provided the nation's first harm reduction-based drug education program for high school students, a curriculum that has since been transferred to Stanford Medicine's REACH Lab for further development.

What set Skager apart was not just his scholarship but his moral courage. In an era when questioning drug war dogma could end careers, he persisted. He served as a consultant to the Drug Policy Alliance from 2002 onwards, received the Dr. Andrew Weil Award for Achievement in Drug Education, and continued writing and advocating well into his retirement.

Those who knew him describe a man who "relished" working with students, who championed their causes, and who made education "more personal, meaningful and connected." He was, by all accounts, "a wonderful, caring, kind, respectful, humorous man."

Professor Skager's work laid the foundation for a new generation of drug educators who prioritise student safety over political posturing. His legacy persists in every classroom where teachers provide teenagers with honest, science-based information about drugs, treating them as capable of making informed decisions rather than subjects requiring indoctrination.

The drug education landscape has evolved since Skager entered it over forty years ago, but the questions he raised remain urgent: Do our policies protect young people, or merely punish them? Do we serve their well-being, or our own moral certainties? In asking these questions—and daring to answer them honestly, Rodney Skager embodied the principle that should guide all drug education: First, do no harm.

Professor Skager is survived by his children and the countless students and educators whose work continues his mission of reality-based drug education.

I'm sorry I wasn't able to bring Rod to New Zealand. A rather precious member of the NZ drug policy fraternity, with whom I have serious doubts about their good intentions, besmirched me to Rod, For that reason, he chose not to come. His voice would have been valuable here. I did present copies of his book to Canterbury District Health Board's Community and Public Health Library, they declined itbased on 'cannabis is illegal', and copies I donated to the Christchurch Civic Library didn't appear in their catalogue and when I asked, it was reported that 'they fell down the back of the shelf'. FFS!

Both should be very very embarrassed.

MildGreens: “New Organised Crime Ministry Is Just Prohibition Rebranded”

Christchurch, 13 October 2025 -

“You can’t police your way out of a policy failure.” The MildGreens are warning that the Ministerial Advisory Group’s final report on organised crime, now before Associate Police Minister Casey Costello, risks becoming the War on Drugs 2.0; a politically repackaged continuation of failed prohibition policies under the banner of “national security.”

“Framing organised crime as a security threat rather than a policy failure is exactly how we got here,” said a MildGreens spokesperson and recent Christchurch mayoral candidate, Blair Anderson, today. “You can’t police your way out of a black market that government itself has created.”

The yet-to-be-released report, chaired by former Crown prosecutor Steve Symon, calls for a new Minister for Organised Crime and a three-year trial structure to combat emerging threats such as cyber fraud, migrant exploitation, and a potential influx of fentanyl.

However, the MildGreens argue that this approach overlooks the root cause.

“Prohibition is the engine room of organised crime,” the group says. “Each decade we get a new scare: meth, fentanyl, gangs, ever stronger pot, and each time the political reflex is more enforcement, more ministers, and more moral panic. Meanwhile, the social drivers of harm go untouched.”

The MildGreens argue that genuine national security depends on sustainable social policy, not securitised bureaucracy.

They point to alternatives that would do far more to undermine criminal networks: (a) Regulating low-risk substances like cannabis under a Class D framework to remove illicit revenue streams. (b)Addressing poverty and housing insecurity, which feed recruitment into gang economies. (c) Improving digital literacy and consumer protection to prevent cyber fraud through education, not punishment. (d) Ensuring public access to evidence, including the immediate release of the full advisory report for democratic scrutiny.

“It’s not fentanyl that threatens our borders, it’s policy inertia,” the MildGreens said. “Organised crime adapts to whatever the law bans. The more we prohibit, the more lucrative we make it.”

The group warns that creating a new ministerial apparatus will simply reinforce institutional silos and divert resources from community-level harm reduction and justice reform.

“If this government truly wants to get ahead of organised crime,” Anderson concludes, “it must shift from prohibition to prevention, from criminalising supply to regulating safety. Until then, this is just the same old War on Drugs with a new business card.”

Google Gives Blair’s Brain Back

Way back when the internet still felt like the Wild West, Google summarily deleted my blog, Blair’s Brain on Cannabis. No warning, no right of appeal — just a curt message about “breaching community standards.”

In an instant, over 1,200 posts — years of drug policy analysis, community engagement, political advocacy, and content from my weekly Plains FM radio show — were gone. It wasn’t just data; it was a record of reform and public conversation erased without due process.

I tried everything — emails, phone calls, digital forms that felt like shouting into a void. The only response was that same faceless phrase: “breached some community standard.” It was the virtual equivalent of “because we said so.”

After months of frustration, I decided if the mountain wouldn’t come to me, I’d go to the mountain.

The Mountain

In Los Angeles, visiting a friend’s storage unit, I noticed a detail in a photo I’d just taken — a distant flag fluttering atop a building. It bore a familiar logo: Google.

The next morning, on the way to meet my friend Jack Herer — the legendary cannabis activist — we passed that same building. I told my friend to drop me off. I had a new plan, half protest, half performance art: if I couldn’t get their attention digitally, maybe I’d “liberate” their flag to make my point.

Clad in my red beret, red jacket, black shorts, and red backpack, I looked like an eccentric mix of activist and cartoon character. I approached the unmarked door that staff were quietly filing through and knocked. Then knocked again.

Eventually, a man appeared — security, I assumed. I handed him my business card and said evenly, “Someone inside needs to know I’m out here.”

“Why are you here?” he asked.

I nodded to the card in his hand. “That,” I said, “is above your pay grade. Google me.”

He blinked, uncertain, then told me to wait.

The Door Opens

About half an hour later, another man appeared — an executive type, all smiles and calm authority. He introduced himself and said, “Your blog will be restored within twenty minutes.”

He explained there’d been a “security issue” with some code I’d uploaded. Possible, maybe, but I wasn’t in the mood to quibble.

I thanked him, stepped back into the California sun, and checked my phone. Sure enough — Blair’s Brain on Cannabis was live again.

The Headline

I sent a press release to The Dominion, New Zealand’s most political daily. The next morning, the headline ran in the computer pages:

“Google Gives Blair’s Brain Back.”

Cute, indeed.

A new report highlights the economic impacts of cannabis legalization in Canada and Ontario.

The cannabis industry contributed CA$76.5 billion to Canada’s gross domestic product (GDP) and $23.1 billion to Ontario’s GDP between legalization in 2018 and 2024, according to a new report from the Ontario Cannabis Store (OCS) and Deloitte.

Additionally, the legal cannabis sector sustained approximately 98,200 jobs annually across the country, with about one-third (31,900) located in Ontario.

The report, Six Years of Legalization: The Economic and Social Impact of Canada’s Cannabis Sector, was released on August 13, 2025, and was prepared by OCS in collaboration with Deloitte Canada. It is a follow-up on a similar report in 2021 that looked at the first three years of the legal cannabis industry in Canada and Ontario.

The report also looks at the economic impact in Mississauga, one of Ontario’s largest cities, which began allowing retail cannabis stores in 2023. Furthermore, it highlights some of the socioeconomic impacts of legalization and the industry.

Fellow Christchurch residents,

Our community spoke clearly when we voted for drug policy reform. We chose compassion over criminalization, health over punishment, and evidence over ideology. Yet too often, our voices are drowned out by outdated systems that refuse to listen.

We know better because we live it. Every day, our whānau, our neighbors, our workmates are affected by policies that treat addiction as a moral failing rather than a health condition. We see people pushed to the margins instead of being supported toward recovery. We watch resources poured into enforcement while treatment services remain underfunded.

But here's what systemic prejudice misses: Communities that embrace drug policy reform aren't "soft on crime" – we're smart on solutions. We understand that when someone struggling with addiction gets treatment instead of a criminal record, our whole community benefits. When we provide safe spaces and support services, we reduce harm for everyone.

The evidence backs us up. Every jurisdiction that has moved toward health-based approaches has seen reduced drug-related deaths, less crime, and stronger communities. Not because they ignored the problem, but because they addressed it honestly.

I have a problem with the integrity of the reasoning surrounding
today's announcement regarding the Federal Bureau of Investigation and
New Zealand sovereignty. (Remember Edgar Hoover's manifestation of
'the drug problem' when the FBI lost relevance post the prohibition of
the alcohol era)

The media is short on specific details about the FBI's office, which
FIRST OPENED IN AUCKLAND in 2022 also focusing on NZ's gang-drug
linkages. Now they want a deep dive, but are short on operational
details, so accuracy is crucial.

First, "Where": It's in the US Embassy complex in Central Auckland.
It's not just a liaison desk but a physical office opened (June 2022),
and note, it is the FBI's first permanent Pacific outpost beyond
Australia.

"Who?" the key agencies involved – FBI obviously, but also NZ Police's
National Organised Crime Group, including the Police National HQ Drug
Intelligence and Customs. [The FBI agents were likely embedded with NZ
counterparts; it's not unilateral; the "joint" aspect is likely a bit
too politically sensitive and likely above most media's pay grade in
NZ.

"Why" has layers: We heard today that it is to combat meth supply
chains (Pacific PIPE) and money laundering.
Looking a bit deeper: China's influence in Pacific islands creates a
vacuum the US wants to fill via security cooperation.

The Gang angle: NZ gangs now work with transnational cartels, making
this an FBI priority. (That's what happens when they hear better
stories; it validates the deficit-funded budgets. Itself a terrible
way to manage policy efficacy.

Ah, did the media ask? I didn't hear it ask that question? But might
it wonder – is this controversial? Yes, but I am yet to hear any NZ
politicians call it "sovereignty infringement."

Did the FBI aid Operation Trojan Shield to show impact? Stats on
seizures (200kg meth in 2023) might make it credible. But that might
reveal more than PoliceHQ wants us to know.

Could that be the geopolitical tension with China? The previous FBI
Director Wray publicly framed it as countering "malign influence," but
NZ media downplays that angle. Tricky, but relevant. (I recently
toured Samoa and have gained my own intel on it and Fiji)

Here's my breakdown of the FBI's establishment of an office in
Auckland in 2022, and the latest visit to Parliament by the FBI,
addressing the Where, Who, and Why:

(My thoughts on Judith Collins I'll reserve sine die)

1. Where: Location and Context
Physical Location: The NZ FBI office is housed within the U.S. Embassy
complex in Central Auckland (23 Customs Street).

Jurisdiction: It serves as the FBI's first permanent physical presence
in the Pacific Islands region (beyond Australia), reflecting New
Zealand's strategic role in transnational crime networks.

Timeline: Announced in 2021, officially opened in June 2022.

2. Who: Key Agencies and Personnel
Lead Agency: The FBI's International Operations Division, with agents
specialising in organised crime, cyber threats, and counterterrorism.

Engaged Partners:

NZ Police: National Organised Crime Group (NOCC),

National HQ Drug Intelligence,

Police Financial Crime Group,

Ministerial Inter-Agency on Drug Policy,

Ministry of Internal Affairs, [ironically a primary driver of 'P' policy]

Leadership: The Auckland office is staffed by FBI legal attachés
("Legats") that are embedded with NZ authorities. Operations are, I
suspect, coordinated by/with the FBI's Honolulu Field Office
(responsible for the Pacific).

3. Why:

Strategic Objectives.
Primary Motivation: Combat Transnational Organised Crime
Methamphetamine ("P"), Cocaine, Heroin, LSD, MDMA, and Cannabis Supply
Chains: inc Laundering

NZ gangs (e.g., Mongrel Mob, Head Hunters) source meth (and less so
precursors) from Mexican cartels (Sinaloa, Jalisco) and Asian
syndicates (China, Myanmar). Yep... been there too!

The FBI currently tracks money laundering, shipping routes, and
chemical suppliers feeding NZ's meth market (est. worth NZ$1.3+
billion annually, small bananas on a global scale, where the drug
trade is bigger than textiles).

Beyond just 'some' Drugs: Policing Cybercrime and Fraud:

Disrupt ransomware groups and scams targeting U.S./NZ businesses, also
linked to Russian [or North Korean] actors using Pacific
infrastructure.

Gang-Cartel Integration:
We know there are ties between NZ gangs and global networks (e.g.,
Australian bikie gangs, U.S. prison gangs).

Geopolitical Factors:
Pacific Pivot: Part of the U.S. "Pacific PIPE" (Pacific Islands
Partnership Initiative) to counter China's influence in the region.
Organised crime in a prohibition paradigm exploits weak
governance/communications/distances in Pacific islands (e.g., Tonga,
Samoa, Fiji) for trafficking.

Intelligence Gap: Prior to 2022, the FBI relied pretty much on
intermittent deployments. Its permanent office enables real-time data
sharing with NZ agencies AND access to NZ's extensive camera and
cellular network, enabling pattern matching and interagency

No Referendum, but the resolution of drug policy is pending, its election time in the country!

It is true that the illegal drug trade generates significant revenue globally, and it often surpasses the turnover of legal industries like gambling. The exact numbers related to the drug trade are difficult to determine with precision due to its clandestine nature. While it is widely acknowledged that the illicit drug market is substantial and lucrative, the value of seizures or intersection effectiveness are often inflated beyond credibility.

The lack of accounting and security in the black market drug trade is a result of its illegal nature. Criminal organizations involved in drug trafficking operate outside the boundaries of the law and evade government regulations and oversight. This absence of regulation and oversight enables them to amass profits and assets without having to adhere to legal obligations like quality control, fit for purpose, age of consent, employment conditions and tax obligations.

Efficiency within the illicit drug trade can be attributed to criminal organizations that employ efficient networks and methods to transport and distribute drugs. The more 'condensed' the drug (ie: hash, crack, fentanyl) the easier it is to transport, disguise and distribute clandestinely.

As high demand for illicit drugs provides a strong incentive for these organizations to streamline and innovate their operations it should not be forgotten that the bulk of trade occurs at a much more personal one-on-one transactional level where consumers subsidise their own consumption by trading within their own networks. The drug trade may be efficient in certain aspects, it still perpetuates suspicion, violence, exploitation, and other harmful, often unintended, consequences including but not limited to a legacy of unaccounted mistruths and manufactured consent.

New Zealand's Law enforcement agencies, despite having deficit funding (spend it and account later) and technological advantages, often face challenges in combating the drug trade due to its clandestine nature and the tight networks involved. Efforts to disrupt the drug supply chain and apprehend those involved require significant resources, time and coordination all of which lacks accountability save the end justifies the means and allocated resources. These are resources that would be better invested in what works and what delivers.

Overall, the illicit drug trade represents a complex and multifaceted issue, to which addressing it requires a social ecology approach that embraces human rights, credible and enabled education, media that ceases to trade on if it bleeds it leads and electorates that see past dog whistle politics.

Critically, New Zealand plays its part in the global manifestation of drug policy failure that on a scale of harms, makes Apartheid look good.

We have an election pending. Make it work for every Kiwi. Ask hard questions at every opportunity. Call media and demand an accounting.... and an earnest debate. It is the most effective reform 'action' we can take.... your media is a mere phone call, text and email away.

Gee, an oldie but a beauty, even got a mention in the Hansard for being so 'silly' as to think cannabis was going to save the nation's bees and all that means for agriculture.

The odd thing was, just 24 hours after the varroa incursions were made public, I was in Bowen House in Wellington with my 'let's try this'.

What was amazing to me at the time was these crucial decisions about 'elimination' over 'management' were made when the Ministry didn't even have a lifecycle of the Varroa. (But I did)

This perhaps evidences a skill in reductionist science no other mayoral candidate brings to the table...
