I can guarantee they don’t practice protecting that trade mark. I worked there for 5 years in corporate and worked with legal trying to get them to protect it more. They wouldn’t.

You know, I never understood why all the cancers are their own separate venue, Having any kind of Cancer is a horrible thing and all funding and all education and the important of finding a cure for all types of cancer should be the focus. Why must everything alway come down to my cancer is worse than yours or Lung cancer is because you smoke? Do you get breast cancer because you have breast?

it seems rather redundent that any erratic driving because of texting would most likely be covered under careless driving which I believe is a heaftier fine. Is this something the federal government is pushing for highway money or maybe school funds?

The Taco Johns website states that the trademark “has been a registered trademark of Taco John’s Seasonings Limited Partnership Since 1989.” I query why the trademark registration date merits greater import than the date of first use. http://www.tacojohns.com/promos-and-fun-taco-tues.asp

It would be nice if they would acknowledge the disconnect. My guess is that they will just ignore the issue an hope it goes away. It looks like the Twitter account is on temporary, or maybe permanent, hiatus.

It always surprises me when people avoid talking to intellectual property attorneys. It seems like the only time they get in trouble is when they don’t. I have actually seen two companies go under because they went with a regular attorney, rather than an intellectual property attorney.

You’d think the issue of claiming “copyright” in Taco Tuesday would be something else they’d want to avoid (as you pointed out on Twitter this morning); another example of the disconnect between marketing and legal. It’ll be interesting to see if/how Taco John’s addresses this on Twitter, or by any other channels.
