			<content:encoded><![CDATA[<div class='snap_preview'><br /><p class="copete" style="text-align:justify;margin:auto 0;"><span style="font-size:small;font-family:Times New Roman;">New economic measures have been approved into law with the purpose of benefiting small and medium size businesses, with the purpose of assisting in the development and strengthening of the local industry.</span></p>
<p class="copete" style="margin:auto 0;"><span style="font-size:small;font-family:Times New Roman;">Among the excellent measures is Law Núm. 147 of August 1, 2008, known as the Law of Incentives for the Development of Small and Medium Size<span> </span>Companies.<span>  </span>This law includes a series of amendments made to a series of laws, among which are the Puerto Rico Internal Revenue Code, Workmen’s Compensation Law, Municipal Patent Law and others, in order to create a model of incentives that stimulate the development and growth of medium and small companies of local capital.<span>  </span>These companies are generally seen as the creators of economic activity which in turn support the economic development of the Island.</span></p>
<p class="copete" style="margin:auto 0;"><span style="font-size:small;font-family:Times New Roman;">As an example, a corporation or partnership with annual income not in excess of $5.000.000, will be able to choose a 25% tax rate if it maintains an average of 7 employees per year or 30% rate otherwise. The cost of equipment of computer systems and other equipments could be adjusted towards the gross income with two years depreciation, including transportation and environmental conservation equipment among others. </span></p>
<p class="copete" style="margin:auto 0;"><span style="font-size:small;font-family:Times New Roman;">Puerto Rico is aggressively pushing for the strengthening of small and medium size business.<span>  </span>Hence, it is important to keep abreast of the changes affecting this sector of the economy.</span></p>

<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES-PR"><span style="font-size:small;"><span style="font-family:Times New Roman;">Nuevas medidas económicas se han convertid en ley con el objetivo de beneficiar a las empresas locales y al consumidor, fomentando el desarrollo y el fortalecimiento de la industria local. <span> </span></span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES-PR"><span style="font-size:small;font-family:Times New Roman;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES-PR"><span style="font-size:small;"><span style="font-family:Times New Roman;">Entre las medidas más relevantes se encuentra la Ley Núm. 147 del 1 de agosto de 2008, conocida como la Ley de <span>Incentivos para el desarrollo de Pequeñas y Medianas Empresas. El cuerpo de dicha ley consiste en una serie de enmiendas realizadas a un grupo de leyes (Código de Rentas Internas, Ley de Compensación por Accidentes del Trabajo, L</span>ey de Contribución Municipal sobre la Propiedad y Ley de Patentes Municipales) con el propósito de crear un modelo de incentivos contributivos y no contributivos que estimulen el desarrollo y crecimiento de empresas medianas y pequeñas de capital local como creadoras de empleos y de actividad económica para fomentar así el desarrollo económico del país. </span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES-PR"><span style="font-size:small;font-family:Times New Roman;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES-PR"><span style="font-size:small;"><span style="font-family:Times New Roman;">A modo de ejemplo, gracias a ésta ley una corporación o sociedad cuyos ingresos anuales no excedan de $5,000,000.00 podrá optar por una contribución de un 25% si mantiene un promedio de 7 empleos anuales, o como alternativa una contribución de 30% sin estar éstas sujetas a imposición de contribución adicional. Se podrá deducir del ingreso bruto el costo de equipos de sistemas de computadoras y su instalación, y se podrá determinar dicha deducción utilizando una vida útil de dos años para el equipo de transportación terrestre y equipo de conservación ambiental. </span></span></span></p>
<p class="copete" style="margin:auto 0;"><span lang="ES-PR"><span style="font-size:small;"><span style="font-family:Times New Roman;">Es importante conocer y entender todas las medidas que se están adoptando día a día en el país con miras a lograr una estabilidad económica dentro de un sistema que sea estable y seguro. Estos incentivos están dirigidos no solo al desarrollo y fortalecimiento de la industria local, si no también a la protección y el beneficio del consumidor como parte del colectivo social. <span> </span></span></span></span></p>

			<content:encoded><![CDATA[<div class='snap_preview'><br /><p>On September 15, 16 and 17, the Department of Tourism will be delivering seminars on improving the quality of service in the Tourism Industry.  As I read the description of the seminars, the firt day is for the general public and it is meant to raise public awareness of the importance of tourism and how everyone can become involved and help this industry.</p>
<p>On the 16th and the 17th, they have a &#8220;superhost&#8221; seminar which appears to be addressed at business and employees directly serving the tourits.  Apparently, the same seminar will be delivered on the 16th and on the 17th.</p>
<p>Below is the Spanish version of the announcement we received.  I like the fact that the promotion is addressed at keeping Vieques as the number 1 spot in the Caribbean.  That is a worthy goal to pursue.</p>

			<content:encoded><![CDATA[<div class='snap_preview'><br /><p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;"><span style="font-family:Arial;">The Municipality of Vieques has been sending letters making certain offers to individuals with properties in Bravos de Boston.<span>  </span>Though this event is not new for many of our readers, I am nonetheless surprised at the number of individuals who have not researched the significance of these letters or the various alternatives and possible consequences which may result from this initiative by the Municipality.<span>  </span><span> </span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">The letters contain an “offer to purchase title” from the Municipality.<span>  </span>The prices quoted in these letters vary from lot to lot and do not necessarily relate to the amount of square meters the lot may have, its proximity to the beach, its views or any other factors which the market generally associates with value.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">From the outset, I want to quash any attempts to interpret what I have written in the previous paragraph as reflecting or signifying a problem.<span>  </span>In general terms, the appraisals are very favorable to those who have properties in Bravos de Boston.<span>  </span>Moreover, this article is not about the appraised value of these properties, but rather about the legal aspects related to these letters, and the alternatives and potential consequences affecting those who receive them.<span>  </span>I also want to emphasize, that the appraisals for these proposed transactions were prepared with a different purpose in mind when compared to appraisals done for mortgages or with the intention to sell the property in the open market.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">These letters are simple, mostly one pagers inviting the individual to contact the Municipality if they are interested in “acquiring title.”<span>  </span>What I want to briefly cover in this article is some of the information not contained in the letters, information that I strongly recommend you obtain and which you need to be aware of while undergoing the decision making process.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;"><span style="font-family:Arial;">There are a series of “ordenanzas municipales” or what I will call “town laws” or “regulations” which grant the Mayor of Vieques the authority to make these offers and to execute the title deeds.<span>  </span>These town laws have far more information than the one contained in the letters being sent out.<span>  </span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">In general terms, I am not in disagreement with the letters being short and to the point, but I also believe that the Municipality should include with the letters the regulations related to the proposed transaction, and perhaps should include a brief statement which gives the reader notice of their existence.<span>  </span>This will give the individual sufficient notice of what the Municipality is offering and the terms under which the transaction must be executed as a requirement to comply with these regulations.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">Here is one example of a noteworthy omission.<span>  </span>The Municipality’s letter offers the person the opportunity to purchase a “title” if he/she pays the amount announced in the letter.<span>  </span><span> </span>Nevertheless, the letter fails to state&#8211;or at the very least hint&#8211;that there are certain restrictions applicable to the proposed purchase and sale of a title: restrictions that for some individuals could be deal breakers or make the proposed deal unappealing.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">On this regards, in an article I published on this blog on July 17, 2007, I presented the question if waiting was the answer.<span>  </span>Now more than ever I have to respond: no, waiting is not the answer, not any more.<span>  </span>If you own property in Bravos de Boston, you need to learn the facts, understand what is going on and then decide if you want to pursue this alternative or not, or what you need to do to protect your rights over your lot.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">I do want you to take note of the following:<span>  </span>to decide to do nothing without learning the facts would not be prudent.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="color:#000000;"><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="color:#000000;"><span style="font-size:large;"><span style="font-family:Arial;">The purpose of this article is not to discourage you from considering the offer by the Municipality.<span>  </span>To the contrary, I am trying to encourage you to seek and acquire the knowledge, and to learn the full spectrum of the proposed deal prior to committing yourself to a position.<span>  </span>In this regards, please remember or refer to my writings on Adverse Possession posted on this blog.</span></span></span></p>

<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;"><span style="font-family:Arial;">El Municipio de Vieques ha estado enviando unas atrás a individuos con propiedades en el sector Bravos de Boston. <span> </span>Aunque estos envíos no son noticias nuevas para muchos, tengo que comunicar mi asombro ante el hecho de que muchas personas no han hecho investigación alguna sobre lo que significa que el Municipio haya enviado estas cartas, y tampoco sobre las alternativas disponibles ni sobre las posibles consecuencias a esos efectos.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;"><span style="font-family:Arial;">En este sentido, en un artículo que publiqué el 17 de julio de 2007 en este tema, presenté la posibilidad de si valía la pena esperar.<span>  </span>Ahora les tengo que decir, que no tengo duda alguna de que NO pueden esperar y que esa no es la mejor alternativa.<span>  </span>Si eres dueño de una propiedad en Bravos de Boston en Vieques, tienes que conocer los hechos, comprender que es lo que está sucediendo, y entonces tomar una decisión sobre cuál alternativa debes perseguir para proteger tus derechos sobre tu finca.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;"><span style="font-family:Arial;">Te recomiendo y hasta te ruego que NO decidas hacer nada sin antes conocer la verdad sobre lo que está sucediendo.<span>  </span>Ahora regresemos al tema de las cartas.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;"><span style="font-family:Arial;">Las cartas del Municipio expresan una oferta para que la persona que recibe la misma compre el “título” del lote al cual se refiere la carta.<span>  </span>Los precios anunciados en cada carta varía de lote en lote, y el mismo no está necesariamente relacionado con los factores que normalmente se usan en el mercado para asignarle valor a una finca, como el número de metros, la proximidad a una playa, las vistas u otros factores conocidos.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;"><span style="font-family:Arial;">De entrada quiero disipar la posibilidad de que alguien desee interpretar lo que escribí en el párrafo anterior como que describe un problema en las tasaciones.<span>  </span>Por el contrario, al presente me parece que las tasaciones son muy favorables para quienes reciben las cartas.<span>  </span>Además, este artículo no es sobre las tasaciones, sino sobre algunos de los aspectos legales relacionados con dichas cartas y las alternativas o consecuencias que afectan a quienes las reciben.<span>  </span>Para terminar, también es importante señalar que las tasaciones e hicieron con un propósito en mente muy distinto al de conseguir una hipoteca o de valorizar la propiedad para venderla en mercado abierto.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;"><span style="font-family:Arial;">Las cartas son cortas y al grano. <span> </span>En ellas, el Municipio invita a la persona a que tenga conocimiento de la oferta de compra y la cantidad de la misma, y la invita a que pase por el Municipio a llenar los documentos necesarios para darle curso a su interés.<span>  </span>Lo que quiero cubrir brevemente, es alguna de la información que no contiene la carta y que es la información que usted tiene que obtener y considerar.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;font-family:Arial;">Hay una serie de ordenanzas municipales las cuales dan al alcalde la autoridad para realizar dichas ofertas y para otorgar las escrituras de compraventa. <span> </span>Estas ordenanzas tienen información más completa y detallada que aquella expresada en las cartas. </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;"><span style="font-family:Arial;">En términos generales, no estoy en desacuerdo con que las cartas sean cortas, y tampoco con que se estén ofreciendo las transacciones. <span> </span>Ahora bien, si estimo necesario o al menos recomendable que las cartas estén acompañadas de las ordenanzas municipales que rigen la transacción propuesta por el Municipio.<span>  </span>Esta gestión proveerá a la persona con más información para que pueda comprender el alcance de lo que el Municipio ofrece, y cuáles son los términos y condiciones aplicables a la transacción.<span>  </span></span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;"><span style="font-family:Arial;">Para que tengan una idea, aquí un ejemplo de una omisión que vale la pena mencionar.<span>  </span></span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;"><span style="font-family:Arial;">La carta de oferta del Municipio le brinda a la persona la oportunidad de adquirir “título” sobre la propiedad por la cantidad anunciada en la carta.<span>  </span>Sin embargo, la carta omite mencionar y ni siquiera insinúa, que existen ciertas restricciones que son aplicables a la compraventa propiedad en la carta: restricciones que para algunas personas han resultado inaceptables. </span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span lang="ES"><span style="font-size:large;"><span style="font-family:Arial;">El propósito de este artículo no es desanimar al lector a que no considere la posibilidad de aceptar la oferta del Municipio.<span>  </span>Lo que si quiero alentar, es que adquieras la información sobre la realidad y el alcance de lo que está ofreciendo el Municipio antes de comprometer tu posición como dueño de tu finca. En ese sentido, recuerda el artículo que escribí sobre este tema y el cual podrás encontrar en este blog. </span></span></span></p>

<p>Last week I was attending court proceedings at the Vieques Courthouse on an injunction case.  While waiting for our case to be called, I saw some publications by the Administration of the Courts of Puerto Rico on various subjects related to the filing and prosecution of certain claims.  As a public service to you, I collected some of those issues and began the process of having them translated to Englihs for publication in this Blog.</p>
<p>The credit for the publication goes to the Puerto Rico Cour Administration.  I am very glad that they undertook the effort to inform the public on their rights and on how to prosecute claims to protect them.  Accordingly, I decided to promote and support their effort by publishing their materials in this blog.  I am sure that they will not mind, and I hope you find this information useful. </p>

<p class="MsoNormal" style="text-indent:-0.25in;margin:0 0 0 0.75in;"><span style="font-family:Times New Roman;"><em><span style="font-size:14pt;"><span>3.<span style="font:7pt;">    </span></span></span></em><em><span style="font-size:14pt;">The nature of the debt (why the money is owed, and for what).</span></em></span></p>
<p class="MsoNormal" style="text-indent:-0.25in;margin:0 0 0 0.75in;"><span style="font-family:Times New Roman;"><em><span style="font-size:14pt;"><span>4.<span style="font:7pt;">    </span></span></span></em><em><span style="font-size:14pt;">The exact quantity owed and that which is claimed to be collected. </span></em></span></p>
<p class="MsoNormal" style="text-indent:-0.25in;margin:0 0 0 0.75in;"><span style="font-family:Times New Roman;"><em><span style="font-size:14pt;"><span>5.<span style="font:7pt;">    </span></span></span></em><em><span style="font-size:14pt;">Before going to Court, the petitioner must have done all necessary procedures to collect the debt, and declare it as done on record.</span></em></span></p>
<p class="MsoNormal" style="margin:0;"><em><span style="font-size:14pt;"><span style="font-family:Times New Roman;"> </span></span></em></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:14pt;"><span style="font-family:Times New Roman;"> </span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:14pt;"><span style="font-family:Times New Roman;">If the amount indebted is five thousand dollars ($5,000.00) or less, without interest, the person can opt to file filing a debt collection suit under the Puerto Rico Rules of CivilProcedures #60 in the Municipal<strong> </strong>Court where the debtor resides. Such rule provides for a summary proceeding.<span>  </span>The Court will notify the respondent the nature of the claim with a citation, which will take place on the closest date, but never before the 15 days of the notification to the respondent.</span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:14pt;"><span style="font-family:Times New Roman;"><span> </span><span> </span></span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:14pt;"><span style="font-family:Times New Roman;">When the claim is more than five thousand dollars ($5,000), the suit must be filed at the Superior Court where the respondent resides. The debt collection procedure is procured in the following manner:<span>   </span>A copy of the claim should be delivered to the respondent by a person who has no interest in the outcome of the litigation.</span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:14pt;"><span style="font-family:Times New Roman;"> </span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:14pt;"><span style="font-family:Times New Roman;">It is always advised to consult a lawyer before taking any cause of action to court, because the type of action or appeal depends on the specific circumstances of each case. An example of this is being owed rental payments which could lead to an eviction action.</span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:14pt;"><span style="font-family:Times New Roman;"> </span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:14pt;"><span style="font-family:Times New Roman;">The parties in controversy or dispute can attend the Conflict Mediation Center, if they so wish to resolve the affair in a conciliatory manner without the formalities of a judicial litigation.<span>  </span>Individuals that apply for this service must be, preferably, residents of the Judicial Area where the Conflict Mediation Center is located.</span></span></p>

<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;"><span style="font-family:Arial;">On the one side, you have widespread reduction of interest rates accompanied by a highly competitive market among lenders. <span> </span>On the other hand, you have and increased level of concern by lenders on the “creditworthiness” of prospective clients. <span>  </span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">Unfortunately, this later aspect of the lending business has discouraged many individuals from investing in the real estate market.<span>  </span><span> </span>The reason for writing this short column on this subject is quite simple:<span>  </span>I am in disagreement with this later point of view, and I want to communicate why with the purpose of encouraging those who are currently not acting on their desire to invest.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">I am in disagreement with the circulation of false or incorrect information, mostly because it is generated by individuals who feed themselves on spreading bad news, or because they have a certain private interest in seeing the market behave in a negative way rather than in a positive, expanding direction. <span>  </span>If you browse through this blog, you will see me constantly stating the need for truthful information, and the field of real estate and property financing is not-less-subject to being victimized by the merchants of chaos.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;"><span style="font-family:Arial;">What I am proposing through this short article is that you study not only the facts, but also the source you are getting these so-called facts from. <span> </span>After you collect your information from someone you have concluded is a reliable and trustworthy source, reach your own conclusions about what you would want to do. <span> </span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">Afterwards, set out and do and accomplish what you decided to do rather than what others believe you can or cannot do.<span>  </span>I want you to give yourself the opportunity to obtain the property you want, but sitting around, listening to lies, and falling victim to the fear others suffer and love to spread around will not buy you that property. <span> </span>Only your desire to make it go right and your all out effort will give you the enjoyment and happiness of having achieve such an important milestone in your life.</span></p>

<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Por un lado, tienes a tu disposición un gran número de ofertas con intereses reducidos y un mercado altamente competitivo entre casas hipotecarias. <span> </span>Por otro lado, tienes a esas mismas casas hipotecarias altamente preocupadas por la capacidad de pago y de crédito de sus potenciales clientes.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Desafortunadamente, este ultimo punto tiene a muchos individuos muy desanimados en cuanto a invertir en el mercado de bienes raíces. <span> </span>Esa es la razón por la cual estoy escribiendo este breve artículo, y es una razón muy simple: Estoy en desacuerdo con este punto de vista y quiero comunicarlo con la idea de entusiasmar a aquellos que actualmente no están actuando en respuesta a us interés de invertir en el mercado de propiedades en Puerto Rico.</span></span></span></p>

<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Siempre he estado en desacuerdo con la diseminación de datos falsos, particularmente aquellos generados por individuos que tiene intereses creados en que el mercado empeore o por el hecho de que éstos simplemente se alimentan de noticias malas y en lograr que el mercadeo se comporte de manera negativa. <span> </span>Si revisas los artículos que he publicado en este blog, encontrarás que siempre enfatizo en la necesidad de que se sepa la verdad, y el campo de financiamiento de propiedades en Puerto Rico no está exento de ser victima por los mercaderes del caos.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Lo que propongo en este corto artículo es que, además de estudiar los hechos, debes estudiar la fuente de la cual vienen esos hechos. <span> </span>Después que obtengas la información proveniente de fuentes confiables, debes llegar a tus propias conclusiones sobre lo que deseas lograr y deseas hacer para alcanzar tus metas.</span></span></span></p>

<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Después de que hayas hecho tu investigación y de que hayas decidio qué quieres lograr, quiero que te des una oportunidad genuina de alcanzar tus metas. <span> </span>En fin, ponte en acción con lo que tu entiendas puedes lograr y no con lo que otros te digan que no puedes lograr. <span> </span>Recuerda que quedándote sentado en una silla nada alcanzarás.<span>  </span>Solamente tu deseo de hacer que las cosas vayan bien te dará la felicidad y el disfrute de haber alcanzado una meta…tú meta.</span></span></span></p>

<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">I simply cannot resist this one, so here I am with my response to Fernando…and let the fun begin.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">My friends, I simply refuse to use words like “acquire” or “purchase” title as far as this subject goes.<span>  </span>Note that the headline of this article is “title recognition” and it is for one particular reason.<span>  </span>If you or anyone else reading this article claims to be an owner (as Fernando so aptly stated it), then:<span>  </span>Why would you have to obtain title from the Municipality?<span>  </span>Ahh…to be or not to be “owner,” that IS the question.<span>  </span>There are many reasons for this, but the main one is that an “owner” should and must act as an “owner” at all times.<span>  </span>For more information on this, please take a look at my posts about “Adverse Possessions” and if you have any questions go ahead and “blog” me.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">In other words, If I were the Municipality’s attorney (and I am sure not) I would call it “purchase” of titles.<span>  </span>Since at L&amp;A we represent property owners, we intentionally call these processes “title recognition” or “settlement of title claims” processes.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">This may seem semantics to you, but it is not semantics under applicable law.<span>  </span>Now let me begin to respond to Fernando’s request.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">First you need to note that, since Fernando is referring to the “Planning Office” he must be on to property in Monte Carmelo.<span>  </span>If the question was addressed to property on Bravos de Boston or Villa Borinquen, one would not go to the Municipality’s Planning Office, in Spanish “Oficina de<span>  </span>Planificación y Ordenamiento Municipal”.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">WARNING:<span>  </span>Please note that there will be some clear cut cynicism in the following paragraph.<span>  </span>It is NOT directed at you the reader.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">In general terms, the process goes like this:<span>  </span>(1) you complete and file an “application for title” which means that you are applying (“requesting”) something you do not have (do you follow?); the Application is accompanied by a (2) fee to pay for the appraisal of “your” lot; then (3) they give you a list of documents you have to submit, including some very delicate financial information like your income tax returns (yes in plural);<span>  </span>and, after the appraisal is done and your documents have been evaluated, you would receive and (4) offer to purchase “your lot” for a given price to be paid to the Municipality.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">END OF CYNICISM, I hope.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">I have simplified the steps to give it to you as straight as possible.<span>  </span>Unfortunately, there are some underlying legal and procedural aspects akin to each of the areas mentioned above (Bravos de Boston, Villa Borinquen and Monte Carmelo) that go beyond the scope of this article and this blog.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">Yet I would like to state the following:<span>  </span>there so much misinformation about these processes out there that it baffles me and makes me wonder where is all this wrong data coming from and for what purpose.<span>  </span>This also emphasizes that you have to be selective about your sources.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">Some of this so called data may be true, some of it is completely fiction, and most of it is simply frantic speculation from those who are scared and cannot face the truth.<span>  </span>Which truth?<span>  </span>The undeniable truth that “title recognitions” in Vieques are available now, and that now is the time to act, to learn, to evaluate and to decide what do you want or need to do about your lot and about your title.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;"><span style="font-family:Arial;">I am not saying that what the Municipality is doing is wrong, and I am not saying that it is right either.<span>  </span>I have repeatedly stated that each lot has its own particular history, meaning that some of the “owners” may need to run to the Municipality to get title recognition “pronto” while others are better off going to court, and yet some of you can work with the Municipality (if you do it right) and then perhaps avoid going to Court to enjoy official recognition (by the Courts) of your title.<span>  </span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">The possibilities are as varied as the number of lots…and there are 860 at Bravos de Boston, 720 at Villa Borinquen, and 420 at Monte Carmelo, not counting sub-divisions made since the first segregation plans were drawn up starting in the early 80’s.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;"><span style="font-family:Arial;">Well Fernando, I hope this helps.<span>  </span>It is easy for an attorney to babble on, but I am going to stop now.<span>  </span></span></span></p>

<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">En respuesta a mi columna reciente sobre propiedad con títulos registrados y títulos no-registrados, un visitante de este blog de nombre Fernando preguntó sobre el procedo ante la Oficina de Planificación de Vieques (Fernando fue muy específico) dirigido a obtener título de parte del Municipio. <span> </span></span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">La verdad es que no puedo resistir este tema, así que aquí está mi elaborada respuesta…y que comience la diversión.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Para comenzar, me rehúso a usar palabras como “adquirir” o “comprar” título en lo que respecta a este tema. <span> </span>Fíjate que el título de esta columna incluye la palabra “reconocimiento” lo cual hago por una razón muy particular.<span>  </span>Si tú o cualquier otra persona lee este artículo reclama que es “dueño” de algo, entonces: Cuál es el propósito de adquirir “título” sobre algo de lo cual ya eres dueño?<span>  </span>Ahh…ser o no ser el dueño, ESA ES la pregunta.<span>  </span>Existen muchas razones para ello, pero la principal es que el “dueño” de una propiedad debe actuar como “dueño” en todo momento. <span> </span>Para más información sobre el particular, revisa mis otras columnas sobre el tema según publicadas en este blog, y si tienes preguntas, me escribes.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">En otras palabras, si yo fuera el abogado de un municipio (y definitivamente no lo soy) yo claramente lo llamaría “compra” de títulos.<span>  </span>Pero, como en L&amp;A representamos dueños de propiedades y personas de negocios, intencional y deliberadamente denominamos estos procesos como de “reconocimiento” o “transacción” de reclamos de títulos.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Esto puede parecerle una cuestión de semántica, pero no lo es desde el punto de vista del derecho aplicable. <span> </span>Ahora paso a responder más directamente la petición de Fernando. <span> </span></span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Primero es importante notar que Fernando se refiere a la Oficina de Planificación, por lo que asumo que se refiere a una propiedad en Monte Carmelo.<span>  </span>Si se estuviera hablando de una propiedad en Bravos de Boston o en Villa Borinquen, estaríamos haciendo referencia a otras oficinas y no a la de planificación.<span>  </span></span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">ADVERTENCIA: Notarán un poco de cinismo en las próximas oraciones, el cual NO está dirigido a usted, nuestro amigo lector.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">En términos generales, el proceso es algo así: (1) llenas una forma de solicitud de título, lo cual significa que estás pidiendo que se te considere para un título que ya podrías tener (¿Me sigues?); presentas la solicitud acompañada de (2) un pago dirigido a cubrir los gastos de tasación de “tú” lote; entonces (3) te entregan una lista de documentos que tienes que presentar para complementar tu solicitud, incluyendo cierta información financiera como tus planillas (si en plural) de contribución sobre ingresos; y, luego de que hayan evaluado tu solicitud y los documentos necesarios junto a la tasación, te extenderán una oferta de compra de título la cual, si aceptas, conllevará un desembolso a favor del municipio.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">FIN DEL CINISMO, espero yo.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Simplifiqué los pasos para poder comunicar un resumen tan breve como sea posible.<span>  </span><span> </span>Ahora bien, desafortunadamente el proceso tiene ciertas consideraciones de índole legal y otras procesales que están fuera del alcance de esta columna y de este blog en general.<span>  </span>Es más, dependiendo de su interés, queriendo decir Bravos de Boston, Villa Borinquen o Monte Carmelo y otras zonas de Vieques, estás ante procesos, personas y oficinas distintas, cada una de ellas con sus particularidades aunque todas muy bien atendidas por personal cooperador y deseoso de ayudar. <span> </span></span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Ahora bien, quiero comentar lo siguiente: me ha llegado tanta información incorrecta y/o falsa sobre estos procesos, que me quedo sorprendido y me tengo que preguntar de dónde vienen tantos datos incorrectos y con qué propósito son circulados.<span>  </span><span> </span>Esto enfatiza el hecho de que debes evaluar cuidadosamente a quien aceptas como tu fuente de información para tomar decisiones sobre estos temas.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Alguna de dicha información es cierta, pero alguna es solamente ficción, y la mayoría son meras especulaciones de individuos que tiene miedo y no pueden dar la cara a la verdad de lo que sucede actualmente.<span>  </span>¿Cuál verdad?<span>  </span>La verdad innegable de que los reconocimientos de títulos han llegado, están ocurriendo en este momento, y que ahora es el momento de actuar, aprender, evaluar y decidir que quieres hacer o no hacer sobre tu finca y tu título. <span> </span></span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Yo no te estoy diciendo que el Municipio lo está hacienda bien, y tampoco te estoy diciendo que lo está haciendo mal.<span>  </span>En muchas ocasiones he manifestado que cada finca tiene su historia, lo cual significa que algunos dueños tienen que salir corriendo a donde el Municipio para obtener su reconocimiento de título, y que otros salen mejor si van a los tribunales para que sean de manera final reconocidos como dueños de sus fincas.<span>  </span>Aun habrá otros que podrán llegar a ciertos acuerdos con el Municipio de manera que puedan evitar tener que ir a un tribunal. </span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Las posibilidades son tan variadas como la cantidad de fincas que hay …que se estiman en unas 860 en Bravos de Boston, 720 en Villa Borinquen, y 420 en Monte Carmelo, y eso sin contra las subdivisiones que se han hecho desde que los primeros planos de segregación fueron creados a principio de los años 80.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>

<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">Linda, here is your response.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">In Puerto Rico we have a Property Registry where most of the real estate property is meant to be registered.<span>  </span>The purpose of the Registry is to provide the general public with &#8220;title&#8221; information about any given lot at any given time.<span>  </span><span> </span>For additional information, please review my posts of July 2, 2007, <span style="text-decoration:underline;">Puerto Rico Property Registry</span> and of July 30, 2007, <span style="text-decoration:underline;">The Puerto Rico Property Registry – How Does it Work</span> posted on this blog.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">In the Vieques market, the term “titled property” is used in reference to real estate property which is registered within the Property Registry.<span>  </span>On the other hand, the term “un-titled property” is commonly used to refer to property for which there are no ownership records within the Property Registry,<span>  </span>This has been a long-term tradition within the Vieques market, but new realities propose that&#8211;perhaps&#8211;these terms need to be either re-defined or at the very least clarified.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">Under Puerto Rico Law, &#8220;title&#8221; over any given property is not exclusively determined by what appears posted within the Property Registry.<span>  </span>For example, a given piece of land may appear within the Property Registry under the name of, let’s say a fellow named Paul, but in reality someone named Gloria may be the legal and good faith &#8220;owner&#8221; of this property in this hypothetical example.<span>  </span>Gloria’s title is not reflected at all within the Property Registry.<span>  </span>The reason for this is that (in this example) when Paul passed away, his heirs did not see through the proper registration of their inheritance rights and Gloria, not knowledgeable of how real estate rights are transferred in Puerto Rico, signed a private purchase and sales agreement with Paul’s heirs.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;"><span style="font-family:Arial;">This does not mean that Gloria’s title is not valid.<span>  </span>It only means that Gloria’s title is not registered.<span>  </span>Do you follow?<span>  </span>In this example, Gloria has an “un-registered title” which is a more appropriate term to describe this situation.<span>  </span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">This appears to be a common occurrence in Vieques.<span>  </span>At Lampón &amp; Associates we have worked on various situations similar to Gloria’s, and just recently resolved an inheritance situation dating back to the early 40’s, hence turning an “un-registered title” into a “registered title.” </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">The term used in Vieques to distinguish &#8220;titled&#8221; versus &#8220;un-titled&#8221; property is actually&#8211;and with all due respect&#8211;a misnomer.<span>  </span>Nonetheless, note that I will publicly continue to use the “titled” vs. “un-titled” names, since these are the names generally recognized by the market (for now). </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">If a property appears in the Property Registry under someone’s name, then that someone has a “registered title.”<span>  </span><span> </span>If the property does not appear within the Property Registry at all, or it appears under the name of someone other than the individual who is publicly claiming to be the owner, then you have an “un-registered title.”</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">There is a variant to the above which is property that does appear within the Property Registry under the name of X or Y person or entity, but in reality (or outside the Registry) is under the control of someone else who publicly claims that he/she is the “owner” of the property.<span>  </span>This type of property is also commonly referred to in Vieques as “un-titled property,” a common phenomenon within the Vieques marketplace, and which in this article we have denominated as property with an “un-registered title.” <span>  </span>Note that we are not referring to Gloria’s example, but rather to what appears to be a “conflict” of titles.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">This later variant of “un-registered title” would be the kind of property that could benefit from an adverse possession claim as otherwise commented on this blog.<span>  </span>The adverse possession process is further described in my posts of January 24 and April 8, 2008.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;">The fact that a property is advertised as being “un-titled” ordinarily means that the person who claims to be the owner of the property has not taken the necessary steps to have his/her title registered within the Property Registry.<span>   </span>In this regards, each lot has a particular and distinctive record which, when examined, should yield a degree of potential success when attempting to turn an un-registered title into a registered one.</span></p>

<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Agradezco a Linda por su petición. <span>  </span>Linda, aquí está tu respuesta.<span>  </span></span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">En Puerto Rico tenemos un Registro de la Propiedad en el cual se pretende que se registren la mayor parte de los títulos en Puerto Rico.<span>  </span>El propósito del Registro de la Propiedad es proveer al público en general información sobre los títulos de las propiedades en cualquier momento dado. Para información adicional debes revisar mi columna del 2 de Julio de 2007, <span style="text-decoration:underline;">El Registro de la Propiedad de Puerto Rico</span> y la del 30 d Julio del 2007, <span style="text-decoration:underline;">El Registro de la Propiedad de Puerto Rico – Como Funciona</span> ambas publicadas en ViequesLaw.com.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">En el Mercado de Vieques, el uso del término “titulada” o “con-título” al referirse a una propiedad, se refiere a una propiedad que aparece registrada en el Registro de la Propiedad.<span>  </span>Por el contrario, una propiedad la cual se describe como “sin-título” se refiere generalmente a una propiedad que no aparece en el Registro.<span>  </span>Esta ha sido una tradición en el Mercado de Vieques, pero quizás los nuevos tiempos y las nuevas tendencias hacen necesario que dichos términos sean revisados o al menos aclarados.<span>  </span></span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Conforme a las leyes de Puerto Rico Law, el &#8220;título&#8221; sobre una propiedad no se determina exclusivamente a base de la información que aparece en el Registro de la Propiedad.<span>  </span>Por ejemplo, un terreno podría aparece en el Registro, digamos que a nombre de alguien llamado Pablo, pero en realidad hay una persona de nombre Gloria quien públicamente y de buena fe reclama ser la dueña de esta propiedad mientras que su “título” no aparece en Registro donde está a nombre de Pablo.<span>  </span>En este ejemplo hipotético, la razón para la discrepancia es que cuando Paul falleció, sus hijos no llevaron a cabo los trámites de herencia y Gloria, quien no estaba informada sobre como se traspasan títulos en Puerto Rico, compró la propiedad sin estar pendiente a registrar su título en el Registro de la Propiedad.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;"><span style="font-family:Arial;"><span>Lo anterior no significa que el título de Gloria’s no sea válido.<span>  </span>Lo único que significa es que el título de Gloria no está registrado.<span>  </span>¿</span>Comprendes?<span>  </span><span>Según este ejemplo, Gloria tiene un “título-no-registrado” el cual es un término más apropiado a la situación descrita.<span>  </span></span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Esta parece ser una situación común en Vieques.<span>  </span>En Lampón &amp; Asociados hemos trabajado en varias situaciones similares a la presentada en esta columna.<span>  </span>Por ejemplo, recientemente resolvimos una situación que data a los años 40, lo cual resultó en que un título No registrado se convirtiera en un título registrado.<span>  </span>O sea, la propiedad pasó de ser “sin-título” a una propiedad “con-título” usando la jerga actual.<span>  </span></span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Los términos “con-título” y “sin-título” usados en Vieques realmente son, con mucho respeto, término incorrectos de acuerdo a la realidad legal.<span>  </span>Si una propiedad aparece en el Registro bajo el nombre de una persona, esa persona tiene un título registrado.<span>  </span>Si la propiedad no aparece en el Registro o aparece bajo el nombre de una persona distinta a su verdadero dueño, entonces esa persona tiene un título no-registrado.<span>  </span></span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Existe un tipo de situación en el sentido de los títulos no-registrados que amerita comentario. <span> </span>Esta es la ocasión en la cual aparecen en el Registro como dueño X ó Y persona o entidad, pero que en la realidad (fuera del Registro) hay una persona quien públicamente manifiesta y entiende que es el titular de la propiedad. <span> </span>Este tipo de situación es a la cual regularmente se refiere en Vieques como una propiedad “no-titulada” y que en esta columna denominamos como “título no-registrado.”<span>  </span>Toma nota de que no nos estamos refiriendo al ejemplo de Gloria, ya que en este ejemplo aparenta existir un conflicto de títulos. </span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">Este tipo de propiedad podría beneficiarse de un proceso de expediente de dominio para reclamar lo que formalmente se reconoce como “prescripción adquisitiva.”<span>  </span>El proceso que tiene que ver con este tipo de situación es objeto de otras columnas que escribí para este espacio, los cuales tienen fecha del 24 de enero y 8 de abril de 2008. <span> </span></span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:large;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;"><span style="font-family:Arial;">El hecho que una propiedad sea anunciada con “sin-título” regularmente significa que una persona quien reclama que es el dueño de cierta propiedad, no ha tomado los pasos necesarios para registrar su título bajo su nombre en el Registro de la Propiedad. <span> </span>En ese sentido, cada propiedad tiene sus características propias, las cuales una vez sean analizadas deben reflejar el potencial de éxito en el caso de que su “titular” desee registrar formalmente su título.</span></span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span><span style="font-size:large;font-family:Arial;"> </span></span></p>

<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:12pt;">I want to go over certain basic information over the Bravos de Boston title situation for the benefit of the general public, meaning those who are not necessarily familiar with the area.<span>  </span>As I develop this series I will provide more specifics to the extent possible. </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:12pt;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:12pt;">Bravos de Boston is a sector of Vieques recorded within the Puerto Rico Property Registry as one piece of land of about 300 “cuerdas” or 11,791.17 square meters, which is 3,930.39 square meters per “cuerda”.<span>  </span>For your information and reference, one “acre” is <span style="color:black;">4,046.90 square meters.<span>  </span>This land or area is named as the Santa María Resettlement Track for Property Registry purposes.</span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:12pt;color:black;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:12pt;color:black;">In contrast to what appears in the Property Registry, Bravos de Boston is divided into more than 860 independent lots varying in size from 140 square </span><span style="font-size:12pt;">meters to lots measuring various thousands of meters.<span>  </span>The history of this sector<span style="color:black;"> and how this “segregation” came about is quite interesting but not the subject of this article.</span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:12pt;color:black;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:12pt;color:black;">Back in the 80’s, the Municipality of Vieques began work on creating records on the Bravos de Boston lots.<span>  </span>These records were prepared by hand and penciled into millimeter paper literally pasted together by scotch tape.<span>  </span>GPS was not available to surveyors and engineers, so everything was done by hand and what today are archaic instruments.<span>  </span>These documents are in surprisingly good condition and worth looking at for anyone wondering about the history of this sector of Vieques.</span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:12pt;color:black;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:12pt;color:black;">The current set of plans is comprised of 20 pages which contain detailed information on </span><span style="font-size:12pt;">every parcel or lot<span style="color:red;"> </span><span style="color:black;">in Bravos de Boston except for those located along the coast line.</span></span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:12pt;color:black;"> </span></p>
<p class="MsoNormal" style="text-align:justify;margin:0;"><span style="font-size:12pt;color:black;">The fact that these lots do not appear in the Puerto Rico Property Registry, does not mean that their occupants are not the rightful “owners” of these lots.</span></p>
