Once the application is installed, you will find a sample dictation file already loaded. This will give you the opportunity to play around with the controls and options to set the application up to suit your needs.

From the main interface, click on the Settings button.

Express Scribe allows you to change or set quite a few parameters including Rewind and Fast Forward Speeds, System-Wide Hotkeys (to control the application without using a mouse), set up of a Foot Pedal Control (if you have one), Autoloading of files from a LAN folder or FTP Server, choice of file types to allow (over 20 supported) and set up of a Speech Recognition Engine.

Once you have your options set up you can now load your first audio file. Depending on where you are receiving it from you can either click Load (it will open a dialogue box that will allow you to browse for the file on your PC), Load Now (if you have set up a LAN or FTP connection) or Dock (if you have to digital or cassette dictation recorder with you).

Select the audio file in the main interface window and click the Play button to start. If needed, slow down or speed up the audio playback using the speed control in the far bottom right corner. Above this control you can also adjust the playback volume.

If you would prefer Express Scribe to float above your word processing application, you can choose Scribe Mini from the main interface toolbar. As the name suggests this option provides a miniature version of the application.

Once you have finished transcribing your audio files you can either mark them as "Done" (removing the file from your list) or "Dispatch" (returning an email to the original sender along with your text attachment and removing the audio file from your list.

This website is available to State agencies as an interim solution for complying with Contract Reporting Requirements pursuant to Chapter 216.0111, Florida Statutes.

Chapter 216.0111, Florida Statutes (F.S.), requires that contracts, including direct orders and purchase orders, which exceed the Category II threshold ($35,000) established in Section 287.017, F.S., and which were not awarded by competitive solicitation or purchased from a purchasing agreement or state term contract, be reported to the Department of Financial Services (DFS) within three working days after executing the contract. For the purpose of this reporting requirement, contracts that do not specify a total contract amount must be reported. Additionally, a contract that is less than Category II that is amended to exceed Category II must also be reported. Amendments to contracts must also be reported within three working days after executing the amendment. State agencies, as defined in Section 216.011, F.S., which enter into contracts for the purchase of commodities or contractual services, executed on or after July 1, 2010, will be required to comply with the reporting requirements.

ECF Attorneys-Instructions for Attorneys completing the electronic version of the Eleventh Circuit Transcript Information Form

(The electronic version of this form is available to simplify completion and transmittal)

Step 1: Access the Transcript Information Form [Click here]

Step 2: Complete the form electronically using Adobe Acrobat or other PDF editor. Remember to electronically sign the form by using the s/naming convention (e.g., “s/Jane Doe”).

Step 3: Save the completed form as a PDF document.

Step 4: Email the saved PDF file as an attachment by clicking the email address link next to the Court Reporter’s name listed on the Court Reporter Contact Information page [click here]. Send a copy to each reporter listed on the form. If there is no email addressed listed, send the form to the Court Reporter Coordinator.

Step 5: File the form electronically with the District Court using CM/ECF. From the main CM/ECF menu, go to: Civil or Criminal Events -> Other Filings->Appeal Documents ->Transcript Information Form.

Step 6: After the transaction is completed, print out the PDF located within the Notice of Electronic Filing (NEF) that you will receive via email. This PDF version will contain the case number, filing date and document number in the header located at the top of the document.

Step 7: Mail the printed form to the Eleventh Circuit Court of Appeals at 56 Forsyth Street NW, Atlanta, GA 30303.

Conducting the Deposition: Strategy, Tactics and Style

[1]Introduction

Regardless of how thorough pre-deposition efforts have been, and no matter how knowledgeable the attorney is with regard to the substance of the file and the medical issues involved, all of his efforts will produce few tangible results unless he is also keenly aware of appropriate deposition strategy and tactics. Most of the examination techniques described in this section will be directed at plaintiff’s counsel since he must be prepared to deal with a wide array of problems and witnesses. However, the following sections should also be instructive to defense counsel as well, as awareness of methods of inquiry will allow for more thorough client preparation and the avoidance of damaging admissions.

[2]General Tactical Considerations

[a]Knowing Where the Deposition is Going

There is nothing more disturbing to everyone involved in a deposition than to have an attorney conduct an examination into matters that are unnecessarily detailed and clearly unrelated to the case. It does not serve the case, the attorney, or the client to engage in such practices which are both time consuming and expensive. Of course, during a deposition, particularly of a doctor in a medical malpractice case, there are usually new areas which appear in the course of the deposition which at first were not considered related to the action but warrant further inquiry. Thus, a "fishing expedition" to some extent will always be part of this process, and, indeed, that is one of the intended purposes of the deposition itself.

For example, if a case involves a suit against a general practitioner for failing to recognize certain pending signs of a heart attack that ultimately led to the patient’s death, the doctor will naturally be asked about his treatment of the patient over the years, and questioned most particularly about the signs and symptoms presented to the doctor at the final examination. However, if an examination of the doctor’s office records show that the doctor had seen the patient for a variety of complaints, it is unnecessary to inquire in any depth about obvious...

Overview of Reporter Edition

Reporter Edition enables you to import transcripts, edit transcripts, attach turn-in sheets to transcripts, sign transcripts electronically, and send them to production departments that use E-Transcript Manager or other reporters who use Reporter Edition, without using a traditional e-mail application. The production department or other reporters can edit transcripts and send them back to you.

Multiple Production Departments Allowed

If you work for more than one production department, each production department can send you a Reporter Edition invitation. The first invitation you receive installs Reporter Edition on your computer when you click the link and sets up a Mailbox for the production department that sent it. The following invitations you receive set up Mailboxes for each department, again, when you click the links in the e-mails.

After multiple Mailboxes are set up, you can choose which production department to send transcripts to.

RealLegal E-Transcript Signatures: E-Transcript Signatures verify the authenticity of RealLegal E-Transcripts. The production department can check the authenticity of signatures. If a transcript is altered after signing, the signature is invalidated. If you need to edit a signed transcript, you can re-sign the transcript. When you send transcripts from Reporter Edition to the production department you have the option to sign or not to sign the transcripts.

How to Obtain Signatures: Contact the production department for which you are signing transcripts. The company might be able to provide signatures. To purchase signatures from My RealLegal: Visit https://sign.reallegal.com/, log in, click Purchase More Signatures, and follow the instructions on the screen.

How You Obtain Reporter Edition: If you subscribe to RealLegal products, you receive Reporter Edition licenses as part of the package; however, in most cases freelance reporters receive Reporter Edition from production departments. Production departments send an e-mail that includes a link to install Reporter Edition software.

Sending and Receiving from Other Court Reporters: You can send transcripts to and receive transcripts from the production department and other reporters who send transcripts to the same production department.

My RealLegal: Becoming a member of My RealLegal is free. My RealLegal (https://my.reallegal.com/) is a central Web site, requiring a single password, from which you can access multiple RealLegal Web-based services, including E-Transcript Reporter Edition and other tools for court reporters.

The user ID and password you create for My RealLegal allows you to log in to the E-Transcript Signatures page as well. You still would need to verify your identity with RealLegal if you intend to sign transcripts electronically, but you can log in with your My RealLegal user ID and password. Likewise, if you do not have a My RealLegal account and go straight to the E-Transcript Signatures Web page (https://sign.reallegal.com/), click Enroll Now and enroll with E-Transcript Signatures, the user ID and password you create works for My RealLegal as well.

The Mailbox: The Mailbox is an administrative tool that processes transcripts and turn-in sheets sent back and forth between reporters and productions departments. For security purposes, the Mailbox is accessible only through RealLegal E-Transcript Manager; outsiders cannot view the Mailbox, and the Mailbox is not listed as an option on the My RealLegal Web site. The Mailbox is not accessible to general users of the World Wide Web.

Reporter Edition interacts with:

E-Transcript Manager.
My RealLegal, where the Mailbox resides that forwards transcripts to the production department.
Other court reporters who use E-Transcript Reporter Edition.

E-Transcript was designed to make delivery of transcripts fast and easy. Court reporters who use the Computer Aided Transcription (CAT) program can deliver functional, easy-to-use electronic transcripts to their clients.

E-Transcript Internet uses Page Image ASCII format. You can generate this format from CAT programs. To create a Page Image ASCII using a word processor, print the finished transcript to a file using a TEXT printer driver.

To create the proper format:

Remove all non-ASCII characters from the file; that is, bold, italics, underlined text, smart quotes and smart apostrophes, superscript, and subscript.

Set font/character spacing to normal (not expanded).

Create the document with the same size and type of font that the text format supports (some text file types do not support certain types of fonts). The standard for ASCII text files is Roman 10cpi.

After creating the text file, view it in a text editor such as Wordpad and verify that it looks similar to the actual printed transcript. This is, in essence, a Page Image ASCII file.

This is not intended to answer all questions regarding the creation of Page Image ASCII files. For detailed information about your software, contact your vendor for technical support.
