            <title>Rumours of £5,000 fines are scaremongering</title>

            <title>BM supporting the VCA's Education period!</title>

            <description>BM Catalysts are delighted that the 103R legislation will soon be implemented, but like the Department for Transport (DfT) and the VCA (enforcement body) we understand that you will need some time to adjust, so support the 3 month education period that the VCA will be implementing for distributors.&amp;nbsp; As part of their education period that runs up until the 13th November the VCA have released a leaflet explaining the regulations.&amp;nbsp; To download the leaflet, follow the link from our Type Approval page.&amp;nbsp;&amp;nbsp;While the EU Directive prevented any sell through period being built directly into the legislation we and other manufacturers supported a sell through period for distributors which the Minister has taken on board by instructing the VCA to provide a 3 month education period for Distributors but not Manufacturers.&amp;nbsp; Please read sections 4.1 to 4.7 of http://www.dft.gov.uk/consultations/closed/devices/responses.pdf for all the information on how we and other manufacturers approached a sell through period for you.&amp;nbsp; In all conversations and contact with the DfT and VCA they have made it very clear that enforcement will be implemented for Manufacturers and importers from 13th August but they will not be directly contacting any distributors for enforcement reasons.&amp;nbsp; After the initial 3 month education period which is expected to finish 13th November the VCA will then be enforcing the legislation with the whole of the market place.&amp;nbsp;Statement released by Toby Massey, Commercial Director.&lt;img src="http://feeds.feedburner.com/~r/BmCatalystsBlog/~4/q6y33MXyrac" height="1" width="1"/&gt;</description>

            <title>103R education period for distributors until 13th November</title>

            <description>The DFT have received the legislation back from the Minister and there are two major developments from how the legislation was first presented.&amp;nbsp;1)&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; Although the implementation date of the 103R legislation for manufacturers and importers is 13th August, distributors, motor factors and garages will have a period of education until 13th November. This means as a distributor you will not be able to purchase non approved product for relevant parts from us after 13th August but the VCA will be focusing on educating the market place of their obligations regarding 103R up until 13th November.&amp;nbsp; After 13th November the VCA will be focusing on enforcing the regulations with all manufacturers, importers, distributors and garages.&amp;nbsp; The relevant extract from the DFT explaining this is below with the important points highlighted.&amp;nbsp;&amp;ldquo;The Vehicle Certification Agency (VCA), as the Department&amp;#39;s enforcement body, will initially focus its enforcement resources on investigating compliance by manufacturers and importers with the regulations in respect of the entering into the supply chain of compliant product.Since, awareness of the regulations amongst retailers and distributors appears to be limited, VCA will, in parallel, undertake a campaign to educate distributors and retailers of their obligations under the Regulations. After a period of 3 months following entry into force of the Regulations, the enforcement policy of the VCA will begin to apply an equal focus on investigating compliance by manufacturers, importers, distributors and retailers in their respective roles.&amp;rdquo;2)&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; The legislation now applies to vehicles first registered 01/03/01 onwards.             <title>The Legislation has now been passed to the Minister</title>

            <description>The DfT have now passed the legislation to the Minister for approval. How long the Minister takes to sign the legislation is dependant on if he requires more information and if he wishes to make changes. The DfT have advised that they don&amp;#39;t expect to receive anything until at least Tuesday (14/07/09). Once the Minister has signed the legislation we will then be informed by the DfT of any changes.             <title>Latest News from the DFT           </title>

The DFT hope that the Minister will receive these on July 3rd although this cannot yet be confirmed. This means that the date for implementation has been put back again and will be August 3rd at the very earliest. We will be in contact with the DFT next week and will update you as soon as we have further information. They have informed us that the draft regulations are still with the lawyers and have therefore not yet been passed to the minister. They hope that the draft regulations will be with the minister by 26th June. With this in mind and the time scales mentioned in previous blogs, the earliest we can expect the legislation to come into force is the 27th July.             <title>Latest News on Type Approval</title>

            <description>Following recent contact with the DFT, it is still unclear as to when the proposed legislation is going to be implemented into the UK market. The draft regulations are still with the lawyers at the moment and have therefore not been passed to the Minister (Lord Adonis). Once he has the draft regulations, he will consider the market feedback on sell through periods and the &amp;ldquo;Y reg&amp;rdquo; debate. Following this, the papers will sit in Parliament for around 3 weeks before a brief administration period prior to the legislation being introduced into the market. Whatever the date of implementation, the market will be given a minimum 4 week notice period which means that the earliest it can now come into force is early July. &amp;nbsp;&amp;nbsp;We are aware that there are a number of different messages coming from other manufacturers and importers which are creating a huge amount of confusion in the market place.             <title>Our online catalogue has changed!</title>

            <description>Over the past few days we have made significant changes to the online catalogue. You&amp;rsquo;ll notice a new layout allowing you to search for all parts related to a particular vehicle, whether it is the DPF, Front Pipe and/or Catalyst you require. The results can then be sorted by a number of different fields, i.e. Part Number, Part Type etc, allowing for a much quicker part selection. If you are still doubtful as to which part you require, we have included a comparison field. All you need to do is tick the boxes and click on compare. Where available, we have now included fitting kit information on the Technical Information screen. The final change to the search page is the edition of &amp;ldquo;H&amp;rdquo; parts for the forthcoming legislation changes; these are easily identifiable by the E9 mark on the search results. Once you click on one of these part numbers, it will show the approval status, i.e. Type Approved or Awaiting Approval. If the part is already approved and available, you can then click on the link to download the certificate.***IMPORTANT &amp;ndash; Please note that we have not yet changed the fitment dates on the non approved parts as we are awaiting the confirmed date from the Government.             <title>Update on Type Approval Implementation date</title>

            <description>We have today received a letter from the DFT regarding the timescales for implementation of the proposed cat legislation. As you can appreciate, we are unable to offer any firm dates for implementation until the Minister has signed the legislation off. The text contained in the letter is shown below and if you would like a copy of the letter emailing to you, please contact our Marketing Department.&amp;quot;We are currently considering the comments received from the public consultation exercise and conducting legal checks on the draft regulations. When this is completed the regulations will be submitted to Ministers for consideration. As part of this process we will set out the views of all consultees and options for Ministers to consider as to how to respond to the views expressed and the impact of any changes on other stakeholders. It will then be for the Minister to make a decision.Unfortunately it is not possible to put a firm timescale on this.             <title>Rumours of June 1st are untrue!</title>

            <description>The Government has now confirmed that the proposed legislation will not be implemented on June 1st despite information being distributed by other manufacturers. The Government has once again confirmed that the consultation recommendations have not yet been passed to the Minister for assessment. The consultation recommendations will include feedback from the market on a sell through period for old stock and the proposal regarding the move from 1/1/01 to 1/3/01 (vehicle registration date that the legislation applies to).&amp;nbsp; As soon as an implementation date is announced, BM will inform the market place. It is likely that at least 1 months notification will be given before the legislation comes into force.             <title>New legislation….it’s coming, but it’s going to cost you.</title>

            <description>Please read below as unless the manufacturers and distributors take action now, it is going to cost the industry huge amounts of resources both logistically and financially.&amp;nbsp;As you are all aware, the legislation requiring the Type Approval of all catalytic converters fitted to vehicles first registered from Jan 1st 2001 will shortly be implemented into the UK aftermarket. BM are 100% behind this legislation and have been investing heavily in the approvals for the past 18 months, both for the UK and European markets. Whilst we are supportive of the legislation, currently the UK government and VCA are proposing that no sell through period be accommodated. &amp;nbsp;We &amp;nbsp;believe that distributors should be allowed to sell through any stock on their shelves that was purchased prior to the legislation being implemented. Without a sell through period, distributors will be put under financial and logistical pressures at a time when economic uncertainty is already causing difficulties in the UK aftermarket. We, along with the ADF, a number of our customers and other manufacturers are lobbying strongly for a sell through period which would enable distributors to navigate their way through these problems.&amp;nbsp;&amp;nbsp; Without a sell through period you can expect to have to retrieve all affected stock from your branches and return them to the manufacturer, if indeed your manufacturer allows you to return them. You will then need to replace this stock with approved products overnight which will be at a significantly higher cost to that you have returned, due to the higher specification that is required for approved cats. We believe that a sell through period will spread the cost by simply replacing a non approved product with an approved version once a sale has been completed. This minimizes the initial outlay at the implementation stage and also prevents the logistical pressures of returning the stock to your supplier, while achieving the aims of the legislation.It appears that a number of manufacturers and importers are not supporting the idea of a sell through period and are actively opposing the concept. This will absolutely be detrimental to your business in terms of cost and logistics. BM urge you to contact your cat suppliers to ask them if they are supporting your need for a sell through period.             <description>BM have been in regular dialogue with both the DFT and VCA and spoke to both bodies last week. It is still very unclear as to when the legislation is going to be implemented. Whilst the DFT are continuing to work towards a mid June deadline, this is looking less likely all the time. BM have been advised that we will have some news from Lord Adonis in around 2-3 weeks time. It must also be said that the consultation notes have still not been published and the industry is awaiting further information as to whether the legislation will affect all 1/1/01 - fitments or 1/3/01 - vehicle applications. BM appreciate that this is frustrating for all concerned but as soon as there is any further news, you will be informed.             <title>New UK Legislation Is Set To Come In Soon</title>

            <description>The consultation period for the forthcoming cat Type Approval Legislation has finally been completed. The government will now decide on an official implementation date which will be announced in the near future. Our expectations are that the date will be somewhere between the beginning and middle of June.We are pleased that the legislation is coming in. It certainly means that the quality of aftermarket catalytic converters will improve, and this can only be a good thing for the industry and the environment. Our investment in meeting the requirements of the legislation has been significant.We have been working aggressively over the past 18 months at testing our products and gaining the required approvals. We are now in a position whereby we have a strong launch range for both cross over and post 2001 only fitments.             <description>Currently manufacturing the UK&amp;rsquo;s largest independent range of Catalytic Converters, BM Catalysts are already doing plenty for the environment. However, always thinking of ways to reduce their carbon footprint, all parts are now dispatched using recycled packaging. The lay-flat tubing is made in exactly the same way as the previous bagging, so quality and strength of the product has not been compromised, but it does mean that less virgin material is being utilised, and therefore oil supplies used to produce the polypropylene last much longer. The Midland based Manufacturers have also recently introduced email invoicing and statements.
