Well, today president Obama signed it.&lt;br /&gt;&lt;br /&gt;&lt;a href="http://www.google.com/hostednews/ap/article/ALeqM5hZg_pvAKDYQV-RYmrmcBrJTaJ5CAD9BQ5KT80"&gt;Here is an article from the Associated Press.&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;&lt;a href="http://www.myacaronline.com/Resources/Docs/Upload/2009%20NAR%20Issue%20Brief%20Homebuyer%20Tax%20Credit%20Changes%201104%201107.pdf"&gt;Here is a comparison of the previous tax credit &amp;amp; the new tax credit&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;Below are some Frequently Asked Questions that Ada County Association of Realtors has answered:&lt;br /&gt;&lt;br /&gt;November 5, 2009&lt;br /&gt;&lt;br /&gt;By a vote of 403-12 the House just passed the Unemployment Extension Bill which contains the Home Buyer Tax Credit.&lt;br /&gt;&lt;br /&gt;President Obama will get it...and sign it...tomorrow.&lt;br /&gt;&lt;br /&gt;Here's NAR's latest FAQ on the extended and expanded tax Credit.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Question:&lt;/strong&gt; Existing homeowner credit: Must the new house cost more than the old house?&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Answer:&lt;/strong&gt; No. Thus, for example, individuals who move from a high cost area to a lower cost area who meet all eligibility requirements will qualify for the $6500 credit.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Question:&lt;/strong&gt; I am an existing homeowner. On October 25, 2009, I signed a contract to purchase a new home. I have lived in my current home for more than 5 consecutive years and am within the new income limits. I will go to settlement on November 20. If President Obama has signed the bill by the time I go to settlement, will I qualify for the new $6500 tax credit?&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Answer:&lt;/strong&gt; Yes. The existing homeowner credit goes into effect for purchases after the date of enactment (when the bill is signed). There is no reference to the date of contract for the new credit. The provision looks solely to the date of purchase, which is generally the date of settlement.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Question:&lt;/strong&gt; I am a firsttime homebuyer but was not within the prior income limits at the time I&lt;br /&gt;entered into my contract to purchase on October 30, 2009. I will be covered, however, by the new income limits. If the new rules have been signed into law by the time I go to settlement, will I be eligible for a credit?&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Answer:&lt;/strong&gt; Yes. The new income limitations go into effect as soon as the President has signed the bill. The income limit and other eligibility rules will look to your status as of the date of purchase, which is the settlement date. So if the new rules have been signed when you go to settlement,&lt;br /&gt;you should be eligible for the credit (or a portion of the credit if you're within the phaseout&lt;br /&gt;range).&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Question:&lt;/strong&gt; I am an eligible existing homeowner. I have a fair amount of equity in my home. I&lt;br /&gt;have found a home with a nonnegotiable price of $825,000. Will I be able to use any of the $6500 tax credit?&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Answer:&lt;/strong&gt; No. The $800,000 cap on the cost of the purchased home is firm at $800,000. Any amount above $800,000 makes the home ineligible for any portion of the credit. The $800,000 is an absolute ceiling.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Question:&lt;/strong&gt; I owned my home for 10 years, but sold it two years ago year and have been renting since. If I purchase a home, will I be eligible for the $6500 tax credit if I meet all the other eligibility tests?&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Answer:&lt;/strong&gt; Yes. Because you lived in the home for more than 5 consecutive years of the previous 8, you will qualify for the $6500 credit. For example, Say John and his wife bought a home in 2000 and lived there until 2008 when he got a divorce. Whether John has been renting or bought in the interim, he WOULD INDEED be eligible for the credit because he owned a home and occupied it as his principal residence for 5 consecutive years out of the last 8 years. The keyword here is "consecutive." As long as he lived in that house for 5 years straight what he did since 3 years doesn't impact eligibility.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Question&lt;/strong&gt;: I am an eligible first time home buyer. I entered into a contract to purchase on November 1, 2009. Do I have to go to closing before December 1? How does the extension date ffect me?&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Answer:&lt;/strong&gt; You do not have to close before December 1. Once the legislation has been signed, it will be as if the Nov 30 date had never existed. But they weren't just any scrapbooks. They were custom made with care. And since I am no &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_0"&gt;scrapbooker&lt;/span&gt;, someone else was going to have to do it. Well, my good friend, Amy, is quite talented in this department. So, I commissioned her to do the work for me. And boy did she do a good job. My mom has since had her make another one for her and referred one of her friends who is also having Amy make a couple of them. They are awesome, I'm telling you. As a client of a Realtor your agent is responsible to "protect and promote the interests of their clients." We are also required to "treat all parties honestly." This is important, and in my opinion is just good business and moral practice anyway.&lt;/em&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="font-size:130%;"&gt;Duties to Clients and Customers&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;&lt;strong&gt;Article 1&lt;/strong&gt;&lt;br /&gt;When representing a buyer, seller, landlord, tenant, or other client as an agent, Realtors® pledge themselves to protect and promote the interests of their client. This obligation to the client is primary, but it does not relieve Realtors® of their obligation to treat all parties honestly. When serving a buyer, seller, landlord, tenant or other party in a non-agency capacity, Realtors® remain obligated to treat all parties honestly. (Amended 1/01)&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;• Standard of Practice 1-9&lt;/strong&gt;&lt;br /&gt;The obligation of REALTORS® to preserve confidential information (as defined by state law) provided by their clients in the course of any agency relationship or non-agency relationship recognized by law continues after termination of agency relationships or any non-agency relationships recognized by law. As a client of a Realtor your agent is responsible to "protect and promote the interests of their clients."  We are also required to "treat all parties honestly."  This is important, and in my opinion is just good business and moral practice anyway.&lt;/em&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="font-size:130%;"&gt;&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="font-size:130%;"&gt;Duties to Clients and Customers&lt;/span&gt;&lt;br /&gt;Article 1 &lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;When representing a buyer, seller, landlord, tenant, or other client as an agent, Realtors® pledge themselves to protect and promote the interests of their client. This obligation to the client is primary, but it does not relieve Realtors® of their obligation to treat all parties honestly. When serving a buyer, seller, landlord, tenant or other party in a non-agency capacity, Realtors® remain obligated to treat all parties honestly. (Amended 1/01)&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;• Standard of Practice 1-1&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;Realtors®, when acting as principals in a real estate transaction, remain obligated by the duties imposed by the Code of Ethics. (Amended 1/93)&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;• Standard of Practice 1-2&lt;/strong&gt;&lt;br /&gt;The duties imposed by the Code of Ethics encompass all real estate-related activities and transactions whether conducted in person, electronically, or through any other means. The duties the Code of Ethics imposes are applicable whether Realtors® are acting as agents or in legally recognized non-agency capacities except that any duty imposed exclusively on agents by law or regulation shall not be imposed by this Code of Ethics on Realtors® acting in non-agency capacities. As used in this Code of Ethics, “client” means the person(s) or entity(ies) with whom a Realtor® or a Realtor®’s firm has an agency or legally recognized non-agency relationship; “customer” means a party to a real estate transaction who receives information, services, or benefits but has no contractual relationship with the Realtor® or the Realtor®’s firm; “prospect” means a purchaser, seller, tenant, or landlord who is not subject to a representation relationship with the Realtor® or Realtor®’s firm; “agent” means a real estate licensee (including brokers and sales associates) acting in an agency relationship as defined by state law or regulation; and “broker” means a real estate licensee (including brokers and sales associates) acting as an agent or in a legally recognized non-agency capacity. (Adopted 1/95, Amended 1/07)&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;• Standard of Practice 1-3&lt;/strong&gt;&lt;br /&gt;Realtors®, in attempting to secure a listing, shall not deliberately mislead the owner as to market value.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;• Standard of Practice 1-4&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;Realtors®, when seeking to become a buyer/tenant representative, shall not mislead buyers or tenants as to savings or other benefits that might be realized through use of the Realtor®’s services.(Amended 1/93)&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;• Standard of Practice 1-5&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;Realtors® may represent the seller/landlord and buyer/tenant in the same transaction only after full disclosure to and with informed consent of both parties. (Adopted 1/93)&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;• Standard of Practice 1-6&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;Realtors® shall submit offers and counter-offers objectively and as quickly as possible. (Adopted 1/93, Amended 1/95)&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;• Standard of Practice 1-7&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;When acting as listing brokers, Realtors® shall continue to submit to the seller/landlord all offers and counter-offers until closing or execution of a lease unless the seller/landlord has waived this obligation in writing. Realtors® shall not be obligated to continue to market the property after an offer has been accepted by the seller/landlord. Realtors® shall recommend that sellers/landlords obtain the advice of legal counsel prior to acceptance of a subsequent offer except where the acceptance is contingent on the termination of the pre-existing purchase contract or lease.
