Famed 'hatchet hitchhiker' arrested in NJ homicide

ELIZABETH, N.J. (AP) — A homeless, hatchet-wielding hitchhiker who became an Internet hero earlier this year was arrested Thursday for allegedly beating a New Jersey lawyer to death inside his home.

Caleb "Kai" McGillvary, whose star turn as "Kai the Hatchet Wielding Hitchhiker" came after he intervened in an attack on a California utility worker, was arrested at a Philadelphia bus station, Union County Prosecutor Theodore Romankow said.

"I believe that everyone is a little safer with this person off the streets," the prosecutor said. Philadelphia police could not immediately be reached for comment.

McGillvary was charged with killing Joseph Galfy, Jr., a Clark, N.J., attorney found dead Monday. Romankow said he will be processed and sent to back to New Jersey, where his bail is set at $3 million.

Galfy's body was found two days after authorities said he met McGillvary in New York City. Galfy, 73, was found wearing only his underwear and socks by police who went to his home to check on his well-being.

Statements posted on McGillvary's Facebook page following the homicide indicated the encounter was sexual in nature, Romankow said, though he declined to go into specific detail.
On his Facebook page, McGillvary's last post, dated Tuesday, asks "what would you do?" if you awoke in a stranger's house and found you'd been drugged and sexually assaulted. One commenter suggests hitting him with a hatchet — and McGillvary's final comment on the post says, "I like your idea."

A hatchet helped give McGillvary a brief taste of fame in February when he gave a rambling, profanity-laced 5-minute interview to a Fresno, Calif. television station about thwarting an attack on a Pacific Gas & Electric employee. The interview went viral, with one version viewed more than 3.9 million times on YouTube. He later appeared on ABC's "Jimmy Kimmel Live!"
Kimmel asked him what people were saying to him since the Feb. 1 incident. "Hey, you're Kai, that dude with the hatchet," he responded.

McGillvary, who said in his TV appearance he prefers to be called "home-free" instead of homeless, traded on his newfound celebrity to meet fans across the country, according to Romankow.

McGillvary met Galfy on Saturday in Times Square, then spent at least two nights at his home on a cul-de-sac in Clark, a quiet community about 20 miles west of New York, Romankow said. His movements after that included two trips to meet a fan in Asbury Park, a trip to Philadelphia and another to Glassboro in southern New Jersey before he took a train bound for Philadelphia, authorities said.

McGillvary swiftly gained notoriety in February after he intervened in an apparently unprovoked attack that led to charges including attempted murder.

McGillvary said he was riding in a car with a man who veered into the worker, got out of the car, then said "I am Jesus and I am here to take you home" before attacking. McGillvary said he then pulled a hatchet from his backpack and struck the driver in the head several times to subdue him, The Fresno Bee reported.
"That woman was in danger," Kai told KMPH-TV. "He just finished, what looked like at the time, killing somebody, and if he hadn't done that he would have killed more people."
Last month, the driver entered a plea of not guilty by reason of insanity, according to The Fresno Bee.

In his television interview, McGillvary also said he'd once intervened in what he called a domestic violence situation.
A man "starts beating up on this woman who he calls his," McGillvary told the television statin. "I started smashing him in the head and the teeth."

McGillvary also goes by the names Kai Lawrence, Caleb Kai Lawrence and Kai Nicodemus, prosecutors said.

Explained they were 'chemical engineers' interested in water supply

Seven people from Pakistan, Singapore and Saudi Arabia – the country of 15 of the 19 Sept. 11 hijackers – were caught trespassing in the middle of the night at a reservoir from which Boston draws its drinking water.

The report by the local CBS affiliate noted that the five men and two women said they were chemical engineers and were in the area because of “their education and career interests.”

Last week, WND reported the FBI alleged a Muslim man who was arrested in a recent terror plot in New York was planning to kill as many as 100,000 people by contaminating the air or water supply in a major U.S. city.

In that case, Ahmed Abassi, 26, was studying chemical engineering at Laval University in Quebec City, reported Canada’s CBC News.

Abassi’s plan did not materialize beyond discussions, but he also has been linked to Chiheb Esseghaier, one of two Canadian residents arrested in the alleged plot to derail a Via passenger train.

In the more recent case, authorities in Belchertown, Mass., told CBS that the seven were trespassing at Quabbin Reservoir, described as one of the country’s biggest man-made public water supplies.

Boston’s drinking water comes from the Quabbin and Wachusett Reservoirs.

Massachusetts state police told the station “there was no evidence that the seven were committing any crime beyond the trespassing.”

Authorities said the FBI was investigating and the inspections of the water supply have been increased. The suspects, who reported addresses from various cities, including Amherst and New York, were being summonsed for trespassing.

Prime Minister Benjamin Netanyahu reportedly warned Russian President Vladimir Putin on Tuesday that Moscow’s sale of a sophisticated missile defense system to President Bashar Assad could push the Middle East into war.

Netanyahu, who flew to meet Putin for emergency talks in the Black Sea resort of Sochi, told the Russian president that the S-300 had no relevance to Assad’s civil-war battles against rebel groups, and urged Moscow not to deliver the systems, Channel 2 reported on Wednesday night.

He said that if acquired by Assad, the S-300

— a state-of-the-art system that can intercept fighter jets and cruise missiles — “is likely to draw us into a response, and could send the region deteriorating into war,” the Channel 2 report said.

Russia’s Foreign Minister Sergey Lavrov, asked last week about possible sales of the S-300 to Assad, said cagily: “Russia is not planning to sell. Russia has been selling for a long time, has signed contracts and is completing deliveries of technology that consists of anti-aircraft systems.”

Lavrov said the weapons were to help Syria defend itself against air attacks. Israel suspects that Russia plans to sell Damascus six S-300 missile batteries, as well as 144 missiles, the Wall Street Journal reported Thursday.

Netanyahu, who flew to meet Putin despite have only just returned from a trip to China, took with him his National Security Adviser Yaakov Amidror and the head of military intelligence in the IDF Maj. Gen. Aviv Kochavi. Deputy Foreign Minister Ze’ev Elkin went too, to help with translations.

Netanyahu also briefed Putin on Israel’s intel assessment of Assad’s alleged chemical weapons use. He also filled the president in on Israel’s information concerning Syria’s transfer of arms to Hezbollah.

At a brief joint press conference, the Russian president said that the only way to resolve the crisis was via “the soonest end to armed conflict and the beginning of political settlement.”

He added: “At this sensitive moment, it’s particularly important to avoid any action that could destabilize the situation.”

Netanyahu, however, said that the volatile situation in the Middle East requires action to improve security. “The region around us is very unstable and explosive, and therefore I am glad for the opportunity to examine together new ways to stabilize the area and bring security and stability to the area,” he said. The prime minister’s bottom line was that “Israel will do whatever it takes to defend its citizens.”

Russia has continued to ship weapons to Syria, despite the civil war there, but it so far has refrained from providing Damascus with the S-300s, which has a range of up to 200 kilometers (125 miles), and the capability to track down and strike multiple targets simultaneously with lethal efficiency.

The weapon would mean a quantum leap in Syria’s air defense capability, including against neighboring countries.

Israel reportedly attacked suspected shipments of advanced Iranian weaponry — the Fateh-110 surface-to-surface missile — in Syria with back-to-back airstrikes this month. Israeli officials signaled there would be more attacks unless Syria refrains from trying to deliver such “game-changing” missiles to Hezbollah. Hezbollah said weapons shipments won’t cease.

On Monday, Israeli Tourism Minister Uzi Landau accused Russia of destabilizing the Middle East by selling weapons to Assad’s regime. “Anyone who provides weaponry to terror organizations is siding with terror,” Landau said.

The sunspot is not particularly large, but it is complex, with many dark cores scattered through its zone of influence. This is a sign of a complicated overlying magnetic field. Magnetic complexity is the source of AR1748's explosiveness: when tangled lines of magnetic force cross and reconnect --bang! A flare occurs.

All by itself, AR1748 has produced more X-flares than every other sunspot of the past year combined. In summary, AR1748 has given us an X1.7 -class flare (0217 UT on May 13), an X2.8 -class flare (1609 UT on May 13), an X3.2 -class flare (0117 UT on May 14), and an X1 -class flare (0152 on May 15). More could be in the offing.

US should return stolen land to Indian tribes, says United Nations

UN's correspondent on indigenous peoples urges government to act to combat 'racial discrimination' felt by Native Americans

A United Nations investigator probing discrimination against Native Americans has called on the US government to return some of the land stolen from Indian tribes as a step toward combatting continuing and systemic racial discrimination.

James Anaya, the UN special rapporteur on the rights of indigenous peoples, said no member of the US Congress would meet him as he investigated the part played by the government in the considerable difficulties faced by Indian tribes.

Anaya said that in nearly two weeks of visiting Indian reservations, indigenous communities in Alaska and Hawaii, and Native Americans now living in cities, he encountered people who suffered a history of dispossession of their lands and resources, the breakdown of their societies and "numerous instances of outright brutality, all grounded on racial discrimination".

"It's a racial discrimination that they feel is both systemic and also specific instances of ongoing discrimination that is felt at the individual level," he said.
Anaya said racism extended from the broad relationship between federal or state governments and tribes down to local issues such as education.

"For example, with the treatment of children in schools both by their peers and by teachers as well as the educational system itself; the way native Americans and indigenous peoples are reflected in the school curriculum and teaching," he said.

"And discrimination in the sense of the invisibility of Native Americans in the country overall that often is reflected in the popular media. The idea that is often projected through the mainstream media and among public figures that indigenous peoples are either gone or as a group are insignificant or that they're out to get benefits in terms of handouts, or their communities and cultures are reduced to casinos, which are just flatly wrong."

Close to a million people live on the US's 310 Native American reservations. Some tribes have done well from a boom in casinos on reservations but most have not.

Anaya visited an Oglala Sioux reservation where the per capita income is around $7,000 a year, less than one-sixth of the national average, and life expectancy is about 50 years.

The two Sioux reservations in South Dakota – Rosebud and Pine Ridge – have some of the country's poorest living conditions, including mass unemployment and the highest suicide rate in the western hemisphere with an epidemic of teenagers killing themselves.

"You can see they're in a somewhat precarious situation in terms of their basic existence and the stability of their communities given that precarious land tenure situation. It's not like they have large fisheries as a resource base to sustain them. In basic economic terms it's a very difficult situation. You have upwards of 70% unemployment on the reservation and all kinds of social ills accompanying that. Very tough conditions," he said.

Anaya said Rosebud is an example where returning land taken by the US government could improve a tribe's fortunes as well as contribute to a "process of reconciliation".

"At Rosebud, that's a situation where indigenous people have seen over time encroachment on to their land and they've lost vast territories and there have been clear instances of broken treaty promises. It's undisputed that the Black Hills was guaranteed them by treaty and that treaty was just outright violated by the United States in the 1900s. That has been recognised by the United States supreme court," he said.

Anaya said he would reserve detailed recommendations on a plan for land restoration until he presents his final report to the UN human rights council in September.

"I'm talking about restoring to indigenous peoples what obviously they're entitled to and they have a legitimate claim to in a way that is not devisive but restorative. That's the idea behind reconciliation," he said.

But any such proposal is likely to meet stiff resistance in Congress similar to that which has previously greeted calls for the US government to pay reparations for slavery to African-American communities.

Anaya said he had received "exemplary cooperation" from the Obama administration but he declined to speculate on why no members of Congress would meet him.

"I typically meet with members of the national legislature on my country visits and I don't know the reason," he said.

Last month, the US justice and interior departments announced a $1 billion settlement over nearly 56 million acres of Indian land held in trust by Washington but exploited by commercial interests for timber, farming, mining and other uses with little benefit to the tribes.

The attorney general, Eric Holder, said the settlement "fairly and honourably resolves historical grievances over the accounting and management of tribal trust funds, trust lands and other non-monetary trust resources that, for far too long, have been a source of conflict between Indian tribes and the United States."

But Anaya said that was only a step in the right direction.

"These are important steps but we're talking about mismanagement by the government of assets that were left to indigenous peoples," he said. "This money for the insults on top of the injury. It's not money for the initial problem itself, which is the taking of vast territories. This is very important and I think the administration should be commended for moving forward to settle these claims but there are these deeper issues that need to be addressed."

Israel Hints at New Strikes, Warning Syria Not to Hit Back

WASHINGTON – A senior Israeli official signaled on Wednesday that Israel was considering further military strikes on Syria to stop the transfer of advanced weapons to Islamic militants, and he warned the Syrian president, Bashar al-Assad, that his government would face crippling consequences if it retaliated against Israel.

The Israeli official said: “Israel is determined to continue to prevent the transfer of advanced weapons to Hezbollah. The transfer of such weapons to Hezbollah will destabilize and endanger the entire region.”

“If Syrian President Assad reacts by attacking Israel, or tries to strike Israel through his terrorist proxies,” the official said, “he will risk forfeiting his regime, for Israel will retaliate.”

The Israeli official, who has been briefed by high-level officials on the Syria situation in the past two days, declined to be identified, citing the need to protect internal Israeli deliberations. He contacted The New York Times on Wednesday.

The precise motives for Israel’s warning were uncertain: Israel could be trying to restrain Syria’s behavior without undertaking further military action, or alerting other countries to another strike. That would ratchet up the tension in an already fraught situation in Syria, where a civil war has been raging for more than two years.

Nearly two weeks ago, Israeli warplanes carried out two strikes, the first hitting bases of the elite Republican Guard and storehouses of long-range missiles, in addition to a military research center that American officials have called the country’s main chemical weapons site.

A more limited strike on May 3 at Damascus International Airport was also meant to destroy weapons being sent from Iran to the Islamic militant group Hezbollah. The Israeli government did not confirm either of the attacks, which followed one earlier this year.

The Syrian government publicly condemned Israel for the assaults, saying it “opened the door to all possibilities.” The Syrian deputy foreign minister, Faisal Mekdad, declared in an interview with Agence France-Presse, “We will respond immediately and harshly to any additional attack by Israel.” He described the Israeli strikes as a “declaration of war.”

Mr. Assad and Hassan Nasrallah, the leader of Hezbollah, have both said in recent days that the Israeli-Syrian border, which has been relatively quiet despite the more than two years of civil war inside Syria, could become a “resistance front,” in response to Israeli aggression.

On Wednesday, the Israeli newspaper Haaretz reported that several mortar shells, fired from across the Syrian border, had landed in the Israeli-occupied Golan Heights. The newspaper attributed the information to an official with the Israel Defense Forces.

The shells landed on Mount Hermon, in the Israeli-controlled Golan Heights, around 6 a.m. Wednesday. The rockets were the latest in a series of what Israel has generally considered errant fire from internal Syrian fighting across the armistice line that landed in its territory, and did not cause any injuries or damage. Israel did not fire back on Wednesday, as it has on several previous occasions, but the incident did cause the closing of Mount Hermon, a popular tourist site, to the public for several hours, during a Jewish holiday in which hiking in the Golan is popular.

In his comments, the Israeli official noted that “Israel has so far refrained from intervening in Syria’s civil war and will maintain this policy as long as Assad refrains from attacking Israel directly or indirectly.”

“Israel,” he said, “will continue its policy of interdicting attempts to strengthen Hezbollah, but will not intercede in the Syrian civil war as long as Assad desists from direct or indirect attacks against Israel.”

Mark Regev, a spokesman for Prime Minister Benjamin Netanyahu, declined to discuss the meaning of the Israeli official’s statement. “We’re not going to comment on the story,” he said.

American and Israeli political analysts agree that Israel has little motive to intervene in Syria’s civil war, but is deeply concerned about the transfer of advanced weapons, as well as the danger that Mr. Assad’s stockpiles of chemical weapons could be used against Israel.

A new draft nuclear waste management bill released today by four U.S. senators focuses on establishing interim and permanent waste repositories The senators—Lamar Alexander (R-Tenn.), Dianne Feinstein (D-Calif.), Lisa Murkowski (R-Alaska), and Ron Wyden (D-Ore.)—based their draft on President Obama’s Blue Ribbon Commission on America’s Nuclear Future.

Several techniques have been proposed for handling: long term above ground storage, geologic below ground storage, space disposal, and transmutation into less harmful radioactive materials.

Disposal by shooting the wastes into deep space or the sun

Cost and the risk of an accident during launch has kept space disposal from being taken seriously. With the current cost of putting objects in orbit at around $10,000 per pound, and given that the U.S. inventory of spent fuel and high-level waste is of the order of 100,000 metric tons, not including the heavy shielding that would be required, the costs with present technology would be prohibitive, even if the risks of radioactive wastes crashing back to earth could be managed somehow.

But if one wanted to dispose of only the very long-lived waste, e.g., technetium-99, cesium-135, iodine-129, and the long-lived actinides, then the amounts are much more manageable, of the order of a few million kilograms for all current U.S. wastes.

The United Nations Relief and Works Agency (UNRWA) launched a German-funded project in southern Lebanon where the area’s Director of UNRWA Affairs, Ann Dismorr, posed with a map devoid of any trace of the State of Israel, instead presenting it as a map of “Palestine.”

Palestinian Media Watch (PMW) captured the UN representatives’ egregious actions and noted that above the map is the Palestinian flag and the inscription: “Arab Palestine.” The text at the bottom of the map also reads just “Palestine.”

Egypt, Jordan,Syria, and Lebanon are all identified on the map by name. Only Israel is erased from the U.N. map. What’s more, The Jewish State’s towns in the Negev desert, along with Be’er Sheva, Hebron, Bethlehem, Jerusalem, Jaffa, Haifa, Acre, Tiberias, and the Dead Sea are allocated to Palestine on the map.

The map was presented at the launch of an UNRWA project to improve the water supply and rehabilitate shelters in the Rashidieh Camp, according to PMW. The map was reportedly a gift from the “Palestinian Women’s Union.”

According to UNRWA’s website, Germany was represented at the ceremony by the Head of Economic Cooperation and Development at the Embassy of the Federal Republic of Germany in Lebanon.

BACKFIRE: ABC, CNN, NBC CALL FOR WHITE HOUSE TO RELEASE BENGHAZI EMAILS

***UPDATE: NBC's senior White House correspondent joined the chorus Wednesday. On his MSNBC show, "The Daily Rundown," Chuck Todd looked into the camera and said, "Attention White House: Release all the emails." The headline has been updated to add NBC.

Assuming they are the ones who leaked to CNN an email written by Ben Rhoades (a Deputy National Security Advisor close to the President), the White House might have been too clever by half Tuesday. An act that was obviously meant to pour water on the Benghazi fire started by an ABC News report, has only ended up being gasoline. Now both CNN and ABC have joined conservative media in calling for the White House to release all the emails surrounding the editing of the CIA talking points.

Friday, in a bombshell report that blew the long-simmering Libya scandal wide open and right into the arms of the mainstream media, ABC's Jonathan Karl reported that an emailwritten by Rhoades specifically mentioned the State Department's concerns about the CIA talking points. Here is how Karl transcribed the Rhoades' email:

We must make sure that the talking points reflect all agency equities, including those of the State Department, and we don’t want to undermine the FBI investigation. We thus will work through the talking points tomorrow morning at the Deputies Committee meeting.

Though this point wasn't the main focus of Karl's report, it was important because it showed that the White House was backing State in pushing inconvenient facts out of the talking points -- this included the fact that terrorists were behind the attack and that State had been negligent when it came to providing security for our diplomatic mission.

In the end, as we now all now know, and apparently due to the prodding of Hillary Clinton's right hand woman at State -- Victoria Nuland, the talking points ended up being completely wrong, which resulted in the American people being misled by the Obama Administration, straight through to a speech the President gave at the United Nations almost two weeks after the attack.

Yesterday, though, CNN's Jake Tapper received what he was told by a source is the actual transcript of Rhoades' email, which reads this way:

What is important about this version is that it does not directly mention the State Department, which gives the White House some cover when it comes to its role in shaping the talking points. And whether they leaked the email to Tapper or not, there is no question the White House was excited about the leak. White House spokesman Jay Carney made sure to mention the news of Tapper's report in yesterday's White House briefing.

But things aren’t exactly turning out the way the White House likely hoped.

Though he didn’t see the original Rhoades' email and was reporting off what a source told him the email said, Karl stands by his original reporting:

I asked my original source today to explain the different wording on the Ben Rhodes e-mail, and the fact that the words “State Department” were not included in the e-mail provided to CNN’s Tapper.

This was my source’s response, via e-mail: “WH reply was after a long chain of email about State Dept concerns. So when WH emailer says, take into account all equities, he is talking about the State equities, since that is what the email chain was about.”

Karl then called for the White House to release the full transcripts of the full email chain surrounding the shaping of the CIA talking points:

The White House could still clear up this confusion by releasing the full e-mail transcripts that were provided for brief review by a select number of members of Congress earlier this year. If there’s “no ‘there’ there,” as President Obama himself claimed yesterday, a full release should help his case.

On his verified Twitter account, Tapper quickly agreed and added that, "If there's 'no "there" there,' as POTUS said, [this] shouldnt be a problem."

The town is turning on President Obama — and this is very bad news for this White House.

Republicans have waited five years for the moment to put the screws to Obama — and they have one-third of all congressional committees on the case now. Establishment Democrats, never big fans of this president to begin with, are starting to speak out. And reporters are tripping over themselves to condemn lies, bullying and shadiness in the Obama administration.

Buy-in from all three D.C. stakeholders is an essential ingredient for a good old-fashioned Washington pile-on — so get ready for bad stories and public scolding to pile up.

Vernon Jordan, a close adviser to President Bill Clinton through his darkest days, told us: “It’s never all right if you’re the president. There is no smooth sailing. So now he has the turbulence, and this is the ultimate test of his leadership.” Jordan says Obama needs to do something dramatic on the IRS, and quick: “He needs to fire somebody. He needs action, not conversation.”

Obama’s aloof mien and holier-than-thou rhetoric have left him with little reservoir of good will, even among Democrats. And the press, after years of being accused of being soft on Obama while being berated by West Wing aides on matters big and small, now has every incentive to be as ruthless as can be.

This White House’s instinctive petulance, arrogance and defensiveness have all worked to isolate Obama at a time when he most needs a support system. “It feel like they don’t know what they’re here to do,” a former senior Obama administration official said. “When there’s no narrative, stuff like this consumes you.”

Republican outrage is predictable, maybe even manageable. Democratic outrage is not.

The dam of solid Democratic solidarity has collapsed, starting with New York Times columnist Maureen Dowd’s weekend scolding of the White House over Benghazi, then gushing with the news the Justice Department had sucked up an absurdly broad swath of Associated Press phone records.

Democrats are privately befuddled by the White House’s flat-footed handling of this P.R. and legal mess, blaming a combination of bad timing, hubris and communications ineptitude. The most charitable defense offered up on background is that Obama staffers are scandal virgins, unaccustomed to dealing with a rabid press.

Chris Lehane, who spent so much time managing scandals in the 1990s that it inspired him to write a textbook on the subject, is among the contingent of Clinton-era scandal hands that thinks the Obama team has botched its second-term image. “One cannot get caught up with chasing news cycles in a crisis, as that is a prescription for putting out inaccurate information that does not withstand scrutiny or the test of time,” said Lehane, whose book is titled “Masters of Disaster.”

Hundreds of soldiers have been sent to the area in case the Popocatepetl volcano does erupt. The evacuation of up to 11,000 local residents is needed.

The effects of this Have Fallen at the feet of many law enforcement agencies, who are having an extra-hard time finding ammunition Both target and training as well as self-defense ammo.

It has gotten to the point where Police Departments are cutting back on training and rationing Their existing ammunition.

When Proctor, Minn. Walt Wobig chief of police found out That his department would not Be Able to lay hands on ammunition for six to eight months, I put out a call for help, and the people answered.

I was really surprised, let's just put it That Way, " said Wobig to NNCNOW.com .

"I go, 'Do you have 40-caliber qualification rounds?' And [the supplier said], 'Well, no. It's going to take six to eight months, "Wobig continued. "The Citizens were like, 'If you need something, we got plenty here.'"

"I had several other calls from other Citizens That said, 'Hey, if you need more ammunition info we have plenty,'" said Wobig, "i know that if I need ammunition I have Citizens out there That will gladly come forward."

The Chief considers the ammo to "loan" and will replace what the department uses Eventually When They get ammo through standard channels.

And while there's no mystery as to why the public is stockpiling ammo, That does touch on another subject, why is the Department of Homeland Security stockpiling ammo?

To-date, the DHS has not supplied an official reason for Their massive multi-billion-round ammunition purchases, que will be spread out over the next five years.

"With more than 100,000 armed law enforcement personnel in DHS, significant quantities of ammunition are used to support law enforcement operations, quarterly Qualifications, and training, to include advanced firearms training exercises," said Spokesman Peter Boogaard agency to Congress .

Some have Suggested That the DHS was building up a cache to Share with the local law enforcement Should the need Arise, although that Does not Appear to be the case in Proctor, "support" must have another meaning.

May 14, 2013 – GRAY, TN (WJHL) - A Tri-Cities man has video of what appears to be a large chunk of ice that he says fell from the sky on Wednesday (May 8) and landed in a yard in Gray, TN. Andy Miller says his children were playing outside along Keeview Drive off Hales Chapel Road around 4 p.m. when they heard what sounded like a rocket. “They ran into the house shaking,” Miller said. He used his phone to record video of the children inspecting the pile of pure white ice sitting in a gouged out hole in the ground near where they were playing. Miller did a quick web search and found information that lead him to believe it’s a megacryometeor. For what it’s worth, here’s a quick definition we found on line: “A megacryometeor is a very large chunk of ice which, despite sharing many textural, hydro-chemical and isotopic features detected in large hailstones, is formed under unusual atmospheric conditions which clearly differ from those of the cumulonimbus cloud scenario (i.e. clear-sky conditions). WASHINGTON (Reuters) - U.S. Attorney General Eric Holder was likely to face a storm of questions on Tuesday over the Justice Department's controversial decision to seize telephone records of the Associated Press, a move denounced by critics as a gross intrusion into freedom of the press.

The episode has created an uproar in Washington and led to questions over how the Obama administration is balancing the need for national security with privacy rights.

Holder, a frequent target of conservatives, was scheduled to appear at 1 p.m. (1700 GMT) with Health and Human Services Secretary Kathleen Sebelius to discuss Medicare fraud but he was likely to face questions from reporters about his decision on the AP records.

In a decision made public on Friday, Holder ordered federal agents to secretly seize telephone records of AP offices and reporters for a two-month period last year.

The AP on Monday described the seizures as a "massive and unprecedented intrusion" into news-gathering operations.

AP Chief Executive Gary Pruitt, in a letter posted on the agency's website, said the AP was informed last Friday that the Justice Department gathered records for more than 20 phone lines assigned to the news agency and its reporters.

"There can be no possible justification for such an overbroad collection of the telephone communications of The Associated Press and its reporters," Pruitt said in the letter addressed to Holder.

An AP story on the records seizure said the government would not say why it sought them.

But it noted that U.S. officials have previously said the U.S. Attorney's Office in the District of Columbia was conducting a criminal investigation into information contained in a May 7, 2012, AP story about a CIA operation in Yemen that stopped an al Qaeda plot to detonate a bomb on an airplane headed for the United States.

Five reporters and an editor involved in that story were among those whose phone records were obtained by the government, the AP said.

The disclosure threatened to set off a confrontation between free press advocates and the Obama administration, which has aggressively pursued national security leaks.

"It's alarming given the scale of it," said David Schulz, an attorney with Levine Sullivan Koch & Schulz who is representing the AP. "This is a massive intrusion into the news gathering operation of one of the largest news organizations in the U.S. People should be concerned."

The U.S. Attorney's Office in the District of Columbia, which notified the AP of the seizure, issued a statement on Monday saying it was "careful and deliberative" when dealing with issues around freedom of the press.

"We take seriously our obligations to follow all applicable laws, federal regulations, and Department of Justice policies when issuing subpoenas for phone records of media organizations," the office said.

A Justice Department spokesman referred inquiries to the U.S. Attorney's Office.

The White House was not involved in the decision to seize the AP records, Press Secretary Jay Carney said.

"Other than press reports, we have no knowledge of any attempt by the Justice Department to seek phone records of the AP," Carney said. "We are not involved in decisions made in connection with criminal investigations, as those matters are handled independently by the Justice Department."

The seized phone records were for April and May of 2012, and AP bureaus in New York, Hartford and Washington were among those affected, as well as an AP phone at the U.S. House of Representatives press gallery, the AP said.

AP journalists' home and cell phone records were seized by the Justice Department, Pruitt said in his letter to Holder.

The reporters who were targeted included Matt Apuzzo, Adam Goldman and Eileen Sullivan, who were also members of a team that won the Pulitzer Prize for revealing secret New York Police Department intelligence operations targeting Muslim communities.

The AP said it had delayed reporting the Yemen plot story at the request of government officials and disclosed it after officials said it no longer endangered national security.

CIA Director John Brennan, in testimony in February, said the FBI had questioned him but denied being the AP's source.

Reuters reported that on May 7, 2012, Brennan, then Obama's top White House counterterrorism adviser, held a small, private teleconference to brief former counterterrorism advisers who are frequent commentators on television news shows and told them that the plot was never a threat to U.S. public safety because Washington had "inside control" over it.

The original AP story made no mention of an undercover informant or "control" over the operation by the United States or its allies.

'POINTED QUESTIONS'

The AP is assessing options for legal action in response to the government's actions, said Schulz, the attorney.

The Justice Department has issued rules that apply to subpoenas seeking phone records for news organizations. The subpoenas must be approved by the attorney general, drawn as narrowly as possible and used only when other attempts to get the information have failed.

The department is also required to notify the organization and seek to negotiate an agreement before issuing those subpoenas, as long as "such negotiations would not pose a substantial threat to the investigation at issue. Pruitt said that the AP was not notified in advance.

The AP may have little recourse to fight the subpoenas in court, since they were served not on the news organization but, presumably, on phone companies, legal experts said.

David Anderson, a law professor at the University of Texas at Austin and an expert in media law, said there is no prohibition against seeking phone records to pursue potential leaks.

"There's nothing unusual about that, except that it's a news organization," said Anderson, who noted that the subpoenas could have a "terrible effect" by discouraging sources from talking to reporters.

Laura Murphy, director of the Washington legislative office of the American Civil Liberties Union, said the incident was part of a pattern by the Obama administration in going after whistleblowers and leaked information.

"The Obama administration has been one of the most aggressive administrations in history when it comes to going after whistleblowers, and we find their conduct highly disturbing, and this is part of a pattern," she said in a phone interview.

Among at least a half-dozen prosecutions by the Obama White House - more than all other previous presidents combined, according to tallies by multiple news organizations - the Justice Department charged former National Security Agency official Thomas Drake under the Espionage Act with mishandling classified information.

On the eve of his trial, the government dropped the charges in exchange for Drake's guilty plea on a misdemeanor charge.

Republican Representative Robert Goodlatte, chairman of the House Judiciary Committee, said in a statement that the panel intends to ask Holder "pointed questions" about the issue when he testifies on Wednesday at a previously scheduled general oversight hearing.

House Oversight and Government Reform Committee Chairman Darrell Issa, a Republican who has been criticizing the Obama administration on several fronts, including over last year's attacks on the U.S. mission in Benghazi, Libya, faulted the administration for the Justice Department action.

"Coming within a week of revelations that the White House lied to the American people about the Benghazi attacks and the IRS targeted conservative Americans for their political beliefs, Americans should take notice that top Obama administration officials increasingly see themselves as above the law and emboldened by the belief that they don't have to answer to anyone," Issa said in a statement.

Senate Judiciary Committee Chairman Patrick Leahy, a Democrat from Vermont, said he was "very troubled" by the allegations and wants to hear the government's explanation.

"The burden is always on the government when they go after private information - especially information regarding the press or its confidential sources. I want to know more about this case, but on the face of it, I am concerned that the government may not have met that burden," he said in a statement.
