Forex Dealer's minimum capital requirement reaches 5 million dollars

Further to the NFA's proposal some months ago (Raising Forex Dealers' minimum capital requirements to 5 million dollars), the Commodity Futures Trading Commission ("CFTC") has approved changes to NFA Financial Requirements Section 11 and the Interpretive Notice entitled "Forex Transactions." The amendments increase the minimum net capital requirement for Forex Dealer Members (FDMs) to $5,000,000. They also eliminate the concentration charge and replace it with restrictions on the types of firms with which an FDM may maintain assets and cover its exposure for purposes of CFTC Regulation 1.17. Further to the NFA's proposal some months ago (Raising Forex Dealers' minimum capital requirements to 5 million dollars), the Commodity Futures Trading Commission ("CFTC") has approved a revised version of NFA's Interpretive Notice entitled "Compliance Rule 2-9: Enhanced Supervisory Requirements" ("Interpretive Notice") as well as a technical addition to NFA Compliance Rule 2-9( b ). The changes to the Notice and Compliance Rule 2-9( b ) will become effective on November 1, 2007. Full notice can be found on the link below.

Raising Forex Dealers' minimum capital requirement to 5 million dollars

The NFA (the US regulation body) recently sent this letter to their Forex Dealer Members (FDMs). They still have to present this proposal to their Board of Directors. Once approved by their Board, they will submit a rule submission to the CFTC and would have to await their approval as well. If accepted, this proposal will change dramatically the landscape for all US Forex brokers who will then need a 5 million dollars capital in order to trade. Stay tuned!

National Futures Association publishes new guide to help individuals identify and avoid investment scams

May 9, Chicago - National Futures Association (NFA) announced today that it has published a new investor education booklet entitled "Scams and Swindles: An Educational Guide to Avoiding Investment Fraud." The guide describes common characteristics of investment scams and outlines steps individuals can take to avoid them.

"Fraudulent investment offers are pitched at us every day," says NFA's Senior Vice President of Strategic Planning and Communications Karen Wuertz. "They come by telephone, through e-mails, in newspapers, magazines and late night television programs. We all have to learn how to spot these scams before we lose our money to them."

Characteristics of an Investment Scam
Knowing some common characteristics of a fraudulent investment offer can help you to avoid becoming a victim of a scam. These characteristics include:

� A demand for an immediate decision. Swindlers often insist that you should or must make your decision "right now" before the opportunity for fast profits disappears. In reality, the only thing that will disappear is your money.

� A request for a credit card number other than to make a purchase. A fraudster may ask you for your credit card number "for identification" or some other plausible reason. Whatever the ploy, once a swindler has your card number, you will likely see unauthorized charges appear on your statement.

� An investment that is "without risk". Except for obligations of the U.S. government, all investments have a degree of risk. Think about it. If there were any such thing as a completely risk-free investment with big profits assured, do you think the swindler would want to share that information with additional investors?
