City Administrator Kevin Lahner gave a presentation on the proposed redevelopment projects including two new developments, the Department of Commerce Remediation Grant and the possible formation of an Environmental Tax Increment District. Lahner discussed the proposed acquisition of seven properties: 400-416 North Dodge Street; 221, 241, 249 and 261 E. Chestnut; 216 and 224 E. Washington. The development would include a 52-unit hotel constructed by Lexington Development Group; a three-story parking complex by the City of Burlington and a retail/commercial complex by Core Upgrades Corporation. Mayor Miller stated that the additional parking will be a good addition for the downtown and will serve the Veteran’s Memorial Terrace as well. Vos stated that it would double the parking available in the downtown area.&lt;br /&gt;

The Lexington Group gave a presentation on their proposed hotel. It will have an indoor swimming pool, small boardroom but will not have a restaurant or bar. Simenson questioned whether the proximity of the train tracks would be a problem as far as noise. Mr. Bob Campbell of the Lexington Hotel Group stated that with new soundproofing methods this would not be an issue. Rauch questioned that once the hotel was built if it would be sold to other investors. Mr. Campbell stated that they would be remaining as the owners.&lt;br /&gt;

Mayor Miller spoke about this further renovation of the downtown as a validation of the Riverfront Project.&lt;br /&gt;

* An expansive interpretation of eminent domain was reaffirmed in Berman v. Parker (1954), in which the U.S. Supreme Court reviewed an effort by the District of Columbia to take and raze blighted structures, in order to eliminate slums in the Southwest Washington area. After the taking, held the court, the taken and razed land could be transferred to private redevelopers who would construct condos, private office buildings and a shopping center. Justice Kennedy's concurring opinion observed that in this particular case the development plan was not "of primary benefit to . . . the developer" and that if that was the case the plan might have been impermissible. In the dissent, Justice Sandra Day O'Connor argued that this decision would allow the rich to benefit at the expense of the poor, asserting that "Any property may now be taken for the benefit of another private party, but the fallout from this decision will not be random. The beneficiaries are likely to be those citizens with disproportionate influence and power in the political process, including large corporations and development firms." She argued that the decision eliminates "any distinction between private and public use of property—and thereby effectively delete[s] the words 'for public use' from the Takings Clause of the Fifth Amendment". A number of states, in response to Kelo, have passed laws and/or state constitutional amendments which make it more difficult for state governments to seize private land. Takings that are not "for public use" are not directly covered by the doctrine,[8] however such a taking might violate due process rights under the Fourteenth amendment, or other applicable law.&lt;br /&gt;
The exercise of the police power of the state resulting in a taking of private property was long held to be an exception to the requirement of government paying just compensation. However the growing trend under the various state constitution's taking clauses is to compensate innocent third parties whose property was destroyed or "taken" as a result of police action.[9]&lt;br /&gt;

“With today’s economy, it’s just very difficult to keep projects moving. It’s a benefit to keep this project moving,” said Lois, *(who is a member of the group working to build the retail/office project). That project is expected to happen after the hotel is completed.&lt;br /&gt;
The city will tear down the existing building on the site of the future hotel. The city is waiting to see if it will be awarded a state grant to help cover the cost of environmental remediation of the Cooperative Plus Inc. property in the 400 block of Dodge Street. That work could begin this winter and work on the hotel could begin as soon as the spring.&lt;br /&gt;

Why would the ex -Mayor be a broker for the deal, when he has financial gain because he is a member of Core Group (conflict of interest)&lt;br /&gt;
