<p><strong>Bei Pferdek&auml;ufen und &ndash;verk&auml;ufen bedienen sich die Parteien immer h&auml;ufiger eines Pferdekaufvertragsformulares. Das l&auml;sst sich locker flockig aus dem Internet runterladen und man f&uuml;hlt sich auf der sicheren Seite. Es ist jedoch ein Trugschluss, dass man sich dadurch das Leben erleichtert. Oftmals widersprechen sich die Regelungen z.B. hinsichtlich der Verj&auml;hrung der M&auml;ngelgew&auml;hrleistungsrechte.</strong></p>

<p>Wenn das Vertragsformular Alternativen aufweist, wird meist keine dieser Alternativen ausgew&auml;hlt, so dass man auslegen und beweisen muss, was zwischen den Parteien denn nun genau vereinbart war. Nicht selten kommt es auch vor, dass laut Vertragsformular der Pferdepass und die Eigentumsurkunde nach Kaufpreiszahlung &uuml;bergeben werden aber dem Verk&auml;ufer gar keine Papiere vorliegen.<br /><br />Die gr&ouml;&szlig;ten Probleme bereiten bei solchen Formularen aber die Regelungen bez&uuml;glich des vollst&auml;ndigen Ausschlusses der M&auml;ngelgew&auml;hrleistungsrechte.<br /><br />Die Rechtsprechung h&auml;lt z.B. folgende Regelung f&uuml;r unwirksam:<br /><br />&bdquo;Das Pferd wird verkauft unter Ausschluss jedweder M&auml;ngelhaftung des Verk&auml;ufers. Von diesem Ausschluss mit umfasst sind auch alle versteckten M&auml;ngel des Pferdes zum Zeitpunkt des Verkaufs, es sei denn, der Verk&auml;ufer habe bestimmte Eigenschaften vertraglich zugesagt oder M&auml;ngel arglistig verschwiegen.&ldquo;<br /><br />Ein solcher vollst&auml;ndiger Ausschluss ist nicht m&ouml;glich, da ein Formularkaufvertrag als allgemeine Gesch&auml;ftsbedingung zu qualifizieren ist. Solche sind immer dann gegeben, wenn eine f&uuml;r eine Vielzahl von Erkl&auml;rungen vorgefertigte Regelung geschaffen wurde. Dies ist bei so einem Mustervertrag der Fall. Denn ein solcher wird gerade zur Verf&uuml;gung gestellt, damit viele Personen diesen nutzen k&ouml;nnen. Unabh&auml;ngig davon, ob der betreffende Verwender diesen einmalig nutzt oder &ouml;fter. In Allgemeinen Gesch&auml;ftsbedingungen sind jedoch Regelungen, die die Haftung auch f&uuml;r K&ouml;rper- und Gesundheitssch&auml;den und f&uuml;r sonstige Sch&auml;den auch bei grobem Verschulden ausschlie&szlig;en, unwirksam. Dies hat zur Folge, dass eine solche Regelung v&ouml;llig entf&auml;llt und das, was man eigentlich nicht wollte, eintritt: Es muss M&auml;ngelgew&auml;hrleistung f&uuml;r zwei Jahre gegeben werden. F&uuml;r den K&auml;ufer nett &ndash; f&uuml;r den Pferdeverk&auml;ufer eine Katastrophe.<br /><br />Der Bundesgerichtshof hat die Rechtsprechung dahingehend ein wenig aufgelockert, dass die Regelungen der Allgemeinen Gesch&auml;ftsbedingungen f&uuml;r die Verwendung von Vertragsformularen unter Privatleuten dann nicht zur Anwendung kommen, wenn es keiner der Parteien wichtig ist, welches Formular konkret verwendet wird, sondern ein solcher nur verwendet wird, um ein bisschen Rechtssicherheit zu haben. Liegt ein solcher Fall vor, ist nach Ansicht des Bundesgerichtshofs also auch ein vollst&auml;ndiger Ausschluss jeglicher Haftung m&ouml;glich und wirksam.<br /><br />Im Ergebnis l&auml;sst sich sagen, dass es immer sicherer ist, einen Kaufvertrag durch einen Rechtsanwalt aufsetzen zu lassen. Dies ist mitunter gar nicht so teuer, wie allgemein angenommen wird.<br /><br /></p>

<h3><strong>Was gilt es dabei zu beachten? </strong></h3>
<p>Ein Pferd zu kaufen ist immer eine spannende Erfahrung und jedes Mal aufs Neue aufregend. Wie muss es einem dann gehen, wenn man sein Traumpferd im Ausland findet? <br />Zahlreiche Gedanken, &Uuml;berlegungen und teilweise auch Vorurteile und/oder &Auml;ngste kommen auf. Man ist leicht unsicher, ob man es wagen soll oder lieber die Finger von dem Vorhaben lassen sollte.<br />Und &uuml;berhaupt: wie funktioniert die Organisation beim Pferdekauf aus dem Ausland? Kann man das Pferd einfach so nach Deutschland holen? Was muss man genau tun, was braucht man evtl. f&uuml;r Papiere / Bescheinigungen und wie kommt das Pferd &uuml;berhaupt in den heimischen Stall? Ist das Pferd gesund und wie kann ich das &uuml;berpr&uuml;fen? Hier m&ouml;chten wir ein wenig Aufkl&auml;rung schaffen und grunds&auml;tzliche Informationen zum Thema an sie heran tragen.<br /><br />Pferde werden in der Regel vor dem Import von einem Tierarzt untersucht. So wird festgestellt ob sie gesund sind, die lange Reise aushalten und keine Verletzungen haben. Nat&uuml;rlich kann man in R&uuml;cksprache mit dem Verk&auml;ufer, ebenso wie beim Pferdekauf im Inland, eine genaue Ankaufsuntersuchung des Pferdes in Auftrag geben.<br />Je nachdem, ob das Pferd in der EU steht oder aus einem Drittland kommt, werden verschiedene Unterlagen f&uuml;r den Import ben&ouml;tigt. <br /><strong></strong></p>
<h3><strong>Innerhalb der EU:</strong></h3>
<p>Man beantragt eine Gesundheitsbescheinigung des betreffenden Pferdes, bei der f&uuml;r den Herkunftsbetrieb zust&auml;ndigen Veterin&auml;rbeh&ouml;rde. Wie schon oben geschrieben, wird das Pferd daf&uuml;r tier&auml;rztlich untersucht. Nach dieser Untersuchung wird die Gesundheitsbescheinigung ausgestellt. W&auml;hrend des Transportes m&uuml;ssen die Gesundheitsbescheinigung und der Equidenpass des Pferdes vorliegen Der Transport muss im Einklang mit den einschl&auml;gigen tierseuchen- und tierschutzrechtlichen Bestimmungen erfolgen.</p>
<p>F&uuml;r Transporte, die in Verbindung mit einer wirtschaftlichen T&auml;tigkeit stehen, gelten besondere Bestimmungen. <h3><strong>Import aus Drittl&auml;ndern in die EU:</strong></h3>
<p>Beim Import aus Nicht-EU-L&auml;ndern gelten je nach Herkunftsland unterschiedliche Regelungen.<br />Es ist ratsam, bei einem konkreten Fall die Grenzkontrolle zu kontaktieren, &uuml;ber welche die Einfuhr in die EU erfolgt.&nbsp; Allgemein ist zu beachten, dass die Importkosten i.d.R. auf den Kaufpreis des Pferdes aufgeschlagen werden.<br />Die Importkosten setzen sich wie folgt zusammen:</p>
<ul>
<li>Fahrtkosten</li>
<li>Zollgeb&uuml;hren</li>
<li>Tierarztkosten&nbsp;</li>
</ul>

				<p>Together with the photos and the title, an informative description of
 your horse is crucial for the success of your advert, since it allows 
the potential buyer to get a detailed impression of your horse. So pay 
special attention to the content and the wording of your ad - it will 
pay off!<br /><br />Here are a few tips on how to use the descriptive part of your ad to your advantage:
</p>
<ul>
<li><strong>Start off with basic information.</strong> First describe 
your horse with its key features, e.g. colour, height, age, breed and 
gender. If your horse has a name already, mention it as well &ndash; it ads a 
personal touch.<br /><br /></li>
<li><strong>Describe the personality of your horse.</strong> Use 
well-worded sentences to characterise your horse. Is it calm and placid 
or rather spirited? Think about its attributes and always keep in mind 
that the potential buyer does not know your horse.<br /><br /></li>
<li><strong>Mention your horse&rsquo;s strenghts and weaknesses.</strong> 
Highlight the positive attributes of your horse, like a strong trot or 
its reliable cross-country riding. Try to be precise and descriptive.<br /><br />Also
 mention your horse&rsquo;s shortcomings. Is it difficult to transport? Does 
it have any allergies? Although there is no need to elaborate on your 
horse&rsquo;s weaknesses in great depth, it is good to mention them in order 
to avoid unpleasant surprises. This will also make your description 
appear honest and trustworthy.<br /><br /></li>
<li><strong>Which experiences has your horse made?</strong> Depending on
 the age of your horse, its previous development can be very informative
 and important. For example, mention with how many owners the horse has 
been, where it has been stationed and in which areas it is used.<br /><br /></li>
<li><strong>To what extent has your horse been trained?</strong> You 
should dedicate a few concise sentences to where the horse currently 
stands in its training. The statement &bdquo;The Gelding can jump and has 
received dressage training&ldquo; is not particularly informative. Instead, 
try using qualifications and tournament results to allow for an 
objective assessment of the horse&rsquo;s skills and training.<br /><br /></li>
<li><strong>Where and when can prospective buyers view the horse?</strong>
 Include&nbsp; the horse&rsquo;s location into the description, i.e. by giving a 
postal address, the country and the region. This will avoid unneccessary
 inquiries. Also, mention when the horse can be viewed &ndash; are you only 
free on weekends, or can you be flexible?<br /><br /></li>
<li><strong>State your price!</strong> One of the most important 
criteria that lead to a purchase decision is the price of the horse. If 
you know the price you want to ask, state it in the description of your 
advert. Also mention whether this is a firm price or whether there is 
room for negotiations.<br /><br /></li>
<li><strong>Structure your text!</strong> Make sure your text is clearly laid out and well-structured. Make use of paragraphs and of the scope for design.<br /><br /></li>
<li><strong>Last but not least: be honest!</strong> Honesty is the best 
policy. Most riders are not looking for the perfect horse and will 
probably not fall for an advert that portrays a horse as flawless. </li>

<p>While there is no standard solution to phrasing titles and headlines, we&rsquo;ll give you a few useful pieces of advice:</p>
<ul>
<li><strong>Describe your horse.</strong> Descriptive adjectives and 
useful information allow key facts to be conveyed at first glance. With 
young horses it is advisable to include the breeding.<br /><br /></li>
<li><strong>Use clear and concise wording.</strong> Narrow your sentences down to the essence. Try to highlight the key features of your horse without much ado.<br /><br /></li>
<li><strong>Highlight the strengths of your horse.</strong> Breed, height, age &ndash; these features are pointed out in every ad. What makes your horse stick out?<br /><br /></li>
<li><strong>Be creative.</strong> An informative title does not 
automatically attract attention. The headline &bdquo;Beautiful Haflinger for 
sale&rdquo; does not make your ad stick out. The viewer knows that your horse 
is for sale because it is offered on a horse market, and the photos of 
your horse give an impression of the looks of your horse. So try and 
include attractive details that appeal to the viewer; for example 
&ldquo;Well-behaved Haflinger, fond of children, for leisure riding&ldquo; or 
"Well-versed jumper with versatile qualifications&rdquo;.<br /><br /></li>
<li><strong>Make good use of space.</strong>&nbsp; Until recently you could 
use up to 50 characters for your headline. However, since we know how 
important the title of your advert is, we extended the available space 
to 65 characters. Take advantage of that!</li>

<h2>What is a vet check and when should it be carried out?</h2>

<p>Through a vet check, an equine veterinary assesses the health of your horse. A vet check should always be carried out before buying/selling a horse. <br />There are two different types of vet checks &ndash; the clinical and the radiographical check.</p>
<h3>The clinical vet check</h3>
<p>With a clinical vet check, the veterinary assesses mainly the general state of health of the horse. In addition, he/she checks the pulse and breathing rate, the condition of the heart and the lungs and inspects the horse&rsquo;s skin, its coat and its teeth. <br />These checks will first be carried out while the horse is rested, either in its box or in the stable aisle, as well as after the horse has been physically active. Thereby the vet can assess how quickly the horse regenerates. <br />An important aspect of the vet check is also the inspection of the horses&rsquo; extremities and its back. This is first done through palpating, before the horse is walked around on solid ground, first in straight lines, then in small turns. Thereby the vet can detect any possible lameness.<br />An important component of the clinical vet check is inspecting the flexibility of the horse&rsquo;s legs. This check allows the vet to see whether the horse will respond to such a check with lameness. If this is the case, a radiogram can be taken to investigate the causes.</p>
<h3>The radiographical vet check</h3>
<p>With a radiographical check, the diagnostic findings are based on usually ten radiograms, which are taken of the ankle joints, the fetlocks and the hooves. If requested, further radiograms can be taken of other skeletal features of the horse, for example the back. <h2>The vet check &ndash; which aspects should I pay attention to?</h2>
<h3>Are you looking for a horse for competing or for leisure riding?</h3>
<p>Think about the kind of horse that you are looking for. A sport horse should be in excellent physical shape, as it will be exercising heavily. However, when buying a horse for leisure riding, minor physical defects can well be accepted.</p>
<h3>Which vet is right for you?</h3>
<p>Choose a vet whom you trust. If possible, try to be present at the vet check, so that you can discuss the findings with the vet. If the vet check is not carried out by your regular vet, it is advisable to send the diagnostic findings to your regular vet who knows your horse better, so that he/she can assess the results from his/her view point.</p>
<h3>How much does a vet check cost and who should pay?</h3>
<p>Talk to your vet in advance about what the check will entail. This will allow for a realistic estimate of costs. The price of the vet check can vary, depending on the extent of the check and where you live. The small vet check usually costs between 100&euro; and 250&euro;, the large vet check can cost up to 1,600&euro;. <br />Who pays for the vet check needs to be decided. Often, the side who commissions the check pays, which is usually the potential buyer.</p>
