However, also for several years, the European Commission has argued that the UK is breaching an EU Directive applying to VAT. On 4th June 2015 the Court of Justice of the European Union (ECJ), upheld a complaint that the UK’s reduced rates of VAT for professionally installed energy saving measures is contrary to relevant EU law.

This ruling places the reduced rate VAT at risk. Please note: nothing is likely to change until March 2016 (subject to confirmation.)

R22 Replacements underway

Any Commercial or Residential air conditioning over 10 years old probably uses R22 refrigerant, an ozone-depleting CFC which is now banned in new systems across the EU.
By law R22 systems are now unserviceable as at the end of 2014, meaning that it is illegal to repair them in the event of any failure.

The cost, time and potential upheaval of replacing out-dated R22 air conditioning equipment can be reduced in some cases by the use of Replacement Technology. This enables only the primary indoor and outdoor units to be replaced, whilst the existing pipe work and electrical supplies are retained. Many equipment manufacturers have introduced products specifically designed for this purpose, which can greatly simplify the installation process, reducing disruption to building finishes and the activities of the occupiers.

New air conditioning is also far less likely to suffer a breakdown and the associated costs of downtime and repairs, and will commonly benefit from a manufacturer backed warranty. A less well known further benefit is that, because almost all modern air conditioning systems incorporate heat pump technology as standard, the same system that provides comfort cooling in the summer will also deliver clean, highly energy-efficient heating in the winter.

From the 1st January 2015 there will be a ban on the topping up of all HCFC systems across the UK. Hydrochlorofluorocarbons or HCFCs contribute to climate change, damaging the ozone layer and affecting global warming, it’s these findings that drove European Legislation to ban the use of HCFCs. In just a few months’ time it will be illegal to use any equipment that contains HCFC refrigerants, no matter how small or insignificant the equipment may be.

This will mean huge numbers of equipment that cannot legally be used until the HCFC components have been replaced, the most common systems that will be affected are:

• Air conditioning units
• Close control units
• Air handling units
• Commercial chillers
• Industrial refrigeration units

What Are Businesses Expected to Do?

Businesses will be expected to replace the soon to be illegal systems with legally compliant alternatives. Whilst the penalties of not complying with the European Legislation is unclear at this point, it’s important to remember that you will not be able to gain replacement HCFC refrigerants or top up your system as these products and services will no longer be available on the market.
