In recent news, the House Judiciary Committee in Colorado just passed Bill 1088. The bill will require the arresting law enforcement agency to notify the district attorney's office and pretrial services if they have probable cause to believe an arrestee is an illegal immigrant.&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;
&lt;/div&gt;&lt;div style="text-align: justify;"&gt;The commercial bail industry is feeling the effect of the immigration laws. Arrestees with immigration holds can't simply use a &lt;a href="http://callforbail.com/"&gt;bail bond service&lt;/a&gt; for their immediate release. Posting a bail bond for the local state case doesn't release them from custody due to the hold, but rather releases them to the custody of the federal government.&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;
&lt;/div&gt;&lt;div style="text-align: justify;"&gt;A common question asked in our office is, "&lt;b&gt;Can I post a bail bond with an immigration hold?&lt;/b&gt;" The answer is yes, but a two part strategy is usually implemented to have the arrestee released from federal custody. Upon posting the bail bond for the local state case, the arrestee will be transferred to federal custody within a day or so. Once in federal custody, the arrestee will be interviewed by an immigration official and a bail recommendation will be made.&amp;nbsp;So, bail or an immigration bond can now be posted and the arrestee released.&amp;nbsp;However, keep in mind that many criminal offenses are not bailable at the federal level, thus keeping the arrestee from being released.&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;
&lt;/div&gt;&lt;div style="text-align: justify;"&gt;A bail bond company should use caution when dealing with immigration holds. Family and friends of the accused wanting to proceed with the two step process need to understand the drawbacks of not obtaining bail or an immigration bond by the federal government. It's best to consult with an attorney who practices these areas of the law for details.&amp;nbsp;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;

Many clients still ask this question even after we have explained the bail bond process and their obligation to the bond. The penal (total) amount of bail posted through a surety bail bond is never paid by the co-signer ( Indemnitor) unless the defendant fails to meet the conditions of their bail. For example, the defendant's failure to appear in court and comply with court orders can result in the co-signers loss of the total amount of bail. However, if the defendant complies with their conditions of bail, the only out of pocket expense should be the premium paid for the bail bond. The judges are displeased when a defendant has no viable excuse for not appearing in court, showing a total disregard for the court and their case. A defendant's record of appearance may also be an indicator of what the judge is willing to do. If they have not failed to appear in the past, the judge is more inclined to reinstate the bail bond, but if they have failed to appear in the past, well, the defendant will be fighting an uphill battle.&amp;nbsp;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;

&lt;/div&gt;&lt;div style="text-align: justify;"&gt;What happens when a defendant fails to appear in court while out of custody on a bail bond? The court (judge) is required to forfeit the bail bond in "open" court as provided in California Penal Code section 1305(A). This usually results in a bench warrant issued for the defendant with a possible higher bail amount.&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;
&lt;/div&gt;&lt;div style="text-align: justify;"&gt;The defendant in a felony case is required to appear at all times as a condition of their bail. In certain circumstances, the court may allow a retained &lt;a href="http://www.cacj.org/"&gt;criminal defense attorney&lt;/a&gt; to appear in court on behalf of the defendant. The court may even hold a bench warrant for a defendant based on the information provided by their criminal lawyer, but a sufficient excuse for failure to appear must be acceptable by the court.&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;
&lt;/div&gt;&lt;div style="text-align: justify;"&gt;In California, the grace period of a &lt;b&gt;bail bond forfeiture&lt;/b&gt; is 185 days, which includes a 5 day period for the mailing of the "Notice of Forfeiture" by the court to the &lt;a href="http://callforbail.com/"&gt;bail bond company&lt;/a&gt; and/or surety insurer. The grace period allows for the voluntary or involuntary appearance of &amp;nbsp;the defendant in court. The defendant may have been hospitalized, which kept them from appearing in court, a justifiable reason for their failure to appear. It may be necessary to locate, apprehend, and surrender the defendant for&amp;nbsp;absconding. In the case of a temporary disability, the court shall toll the 180 day period based on the&amp;nbsp;illness, insanity, or detention by military or civil authorities. Regardless of the circumstances, upon appearance of the defendant, the court shall vacate the forfeiture and re-instate or exonerate the bail bond.&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;
&lt;/div&gt;&lt;div style="text-align: justify;"&gt;In addition, the bail bond company may file a motion with the court to extend the 185 day period. If "good cause" is shown, the courts in California will usually extend the grace period for another 6 months. However, the amount of additional time is up to the discretion of the judge.&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;
&lt;/div&gt;&lt;div style="text-align: justify;"&gt;If the defendant ultimately fails to appear within the prescribed time, the bail bond company and surety insurer will be required to pay the penal amount of the bail bond. Once the grace period has expired, the county in which the bail bond was posted will enter a summary judgement against the bail bond company and their surety insurer. At this point, the penal amount of the bail bond must be paid to the county within 30 days of receiving the summary judgement. &lt;/div&gt;&lt;div&gt;&lt;div style="text-align: justify;"&gt;In a recent blog post called, "&lt;a href="http://blog.callforbail.com/2011/01/everyone-sooner-or-later-has-heard.html"&gt;Bail Bonds - You Get What You Pay For&lt;/a&gt;", we mentioned the serious problems the commercial bail industry is facing due to unethical and&amp;nbsp;scrupulous &lt;b&gt;bail bond&lt;/b&gt; agents. Just yesterday, the Superior Court of Orange County sentenced Ronald Lee Brockway of Respect Bail Bonds in an illegal referral scheme. Mr. Brockway was sentenced to a year in jail, fines, probation, and a six month suspension of his bail license.&amp;nbsp;&lt;/div&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;
&lt;/div&gt;&lt;div style="text-align: justify;"&gt;Unfortunately, this is nothing new to Mr. Brockway. He avoided prosecution in 2005 in exchange for testimony before the Orange County Grand Jury, which helped put away Joseph Cavallo, an attorney. In his testimony, he claims to have received cash monies from the &lt;a href="http://www.avvo.com/"&gt;criminal defense attorney&lt;/a&gt; in exchange for referring clients.&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;
&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;i&gt;California Code of Regulations- Title 10, Article 2&lt;/i&gt;, defines bail transactions as they pertain to a licensed bail agent in the State of California. Section 2071 prohibits directly or indirectly referring / suggesting an attorney to an&amp;nbsp;arrestee for&amp;nbsp;representation. Furthermore, section 2074 prohibits solicitation for bail to any person on the premises of any jail, prison, court, detention facility, and connections to&amp;nbsp;administrations of justice.&amp;nbsp;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;
&lt;/div&gt;&lt;div style="text-align: justify;"&gt;Mr. Brockway didn't take the previous "run in with the law" as a warning, but continued his illegal &lt;b&gt;bail bond&lt;/b&gt; operations. In fact, he posted his own $50,000.00 &lt;a href="http://callforbail.com/"&gt;bail bond&lt;/a&gt; back in July of 2010! It is my assumption that he had a total disregard for the law, which finally led to his arrest and conviction. The truth of the matter is, he will serve only part of his sentence just in time for the reinstatement of his bail agent's license, an ill decision made in part of the California Insurance Commissioner.&amp;nbsp;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;

&lt;/div&gt;&lt;div style="text-align: justify;"&gt;I recently read an article from the &lt;a href="http://www.ocweekly.com/2011-01-20/news/orange-county-jail-deaths/"&gt;OC Weekly&lt;/a&gt; regarding &lt;b&gt;Orange County's Jails&lt;/b&gt; strange deaths, which included suicides. Some of the deaths have even gone by without any public announcements or knowledge? Not till recently did the Orange County Sheriff's Department pass a new policy issuing press releases for deaths in their county jails. Sheriff's officials have acknowledged an increase of suicides, but give little to no&amp;nbsp;explanations on the cause of various deaths. For example, the DA's office investigation report regarding Michelle Gee's death provided very little details as to the cause of death and several inmates have died within a week's time of each other in early 2010, but the &lt;a href="http://ocsd.org/"&gt;OCSD&lt;/a&gt; and DA's office will not comment on how these individuals died.&amp;nbsp;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;
&lt;/div&gt;&lt;div style="text-align: justify;"&gt;Reading the article brought me to many conclusions on how these individuals could of met their demise in custody, but stating my unfounded conclusions would be unfair to the&amp;nbsp;deceased inmates&amp;nbsp;families as well as the other entities involved. However, many of our clients have complained about the deputies running the &lt;b&gt;Orange County's Jails&lt;/b&gt; and how they were treated during their stay. I recall one client who is a serious diabetic, he wasn't given any insulin for two days and the Orange County Jail wouldn't accept the medication from the family. Another client was told by a deputy &amp;nbsp;to, "Keep quite if you know what's good for you", while being processed through the Intake and Release Center (IRC). Lastly, our client is notified that his &lt;a href="http://callforbail.com/"&gt;bail bond&lt;/a&gt; was posted only to be placed in a corner for 4 hours, mocked, and made fun of by deputies as they stood around.&amp;nbsp;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;

&lt;/div&gt;Under California Penal Code Section 1305(A)(5), the purposes of a &lt;b&gt;bail bond&lt;/b&gt; are defeated by the untimely filing of a criminal complaint by the District Attorney's Office. This California penal code section requires that the court exonerate the bail bond 15 business days from the date of arraignment if no criminal (complaint) case has been filed.&lt;br /&gt;
&lt;br /&gt;
This can create an unexpected problem for the defendant in the near future. After all, the defendant was released on the bail bond based on the alleged charges at time of arrest. The defendant expects to appear in court for the underlying criminal charges out of custody, the intended purpose for posting the bail bond.&amp;nbsp;Unfortunately, a bail bond can't be reinstated once the court has exonerated a bail bond. So, if the District Attorney's Office fails to file within 15 days of arraignment, but files the complaint any time after, the defendant is looking at a possible warrant for their arrest and having to post a new bail bond! &lt;br /&gt;
&lt;br /&gt;
&lt;a href="http://callforbail.com/"&gt;Fastrak Bail Bonds&lt;/a&gt; finds this to be more than unfair to the defendant, our client. The process and procedures of posting a bail bond can differ from time to time due to a criminal case's circumstances. Many co-signers, defendants, and criminal defense attorneys misunderstand the requirements and need for a &lt;strong&gt;bail bond rewrite&lt;/strong&gt;.&lt;br /&gt;
&lt;br /&gt;
&lt;div style="text-align: justify;"&gt;A bail bond rewrite would apply to a criminal case in which a bail bond was already posted, but changes in circumstances require additional bail by the court. For example, let's say a defendant was arrested and released on a $15,000.00 bail bond. Upon appearing in court for the underlying criminal charges, the district attorney's office decides to file the case as a felony and/or add more criminal charges to the complaint. The Court (judge) or district attorney's office (DA) asks for a higher bail amount of $50,000.00, based on the current criminal charges and bail schedule. The defendant in now required to make bail in the amount of $50,000.00 or likely be taken into custody.&lt;/div&gt;&lt;br /&gt;
&lt;div style="text-align: justify;"&gt;In the example given above, the defendant would be required to post an additional $35,000.00 in bail . This would require a new bail bond (rewrite) &amp;nbsp;in the amount of $50,000.00 to be posted by the &lt;a href="http://callforbail.com/" target="_blank" title="Fastrak Bail Bonds 1-800-525-5915"&gt;bail bond company&lt;/a&gt;. You might ask, why not post another bail bond for $35,000.00? California state regulations will not allow "stacking" of the bail bonds. In fact, the bail bond is void if more than one power (bail bond) is attached or an additional bail bond is posted on the same case number.&lt;/div&gt;&lt;br /&gt;
&lt;div style="text-align: justify;"&gt;Furthermore, the bail bond company is not obligated to post the larger bail bond amount. The previous transaction was negotiated upon the criminal charges and bail amount at the time of arrest. Depending on the new risk factors, additional collateral or security may be required to underwrite the new bail bond amount. &amp;nbsp;Upon satisfying the requirements for the new $50,000.00 bail amount, the bail bond company may charge the difference in bail premium. The same rate of premium must also be charged for the &lt;strong&gt;bail bond rewrite&lt;/strong&gt; as charged on the original bail bond, usually 8% or 10% percent.&lt;/div&gt;&lt;br /&gt;
&lt;div style="text-align: justify;"&gt;In addition, a bail bond rewrite would not apply to a forfeited bail bond. The defendant's failure to appear in court, having their bail amount raised, and bail bond forfeited does not constitute a bail bond rewrite. A bail bond rewrite also requires that the original bail bond was never forfeited.&lt;/div&gt;&lt;br /&gt;

We were able to name our competitors in the past, but in the last decade we have seen a flood of bail bond companies in the local market. Our recent inquiry showed over 70 bail bond companies in Orange County, California alone!&lt;/div&gt;&lt;br /&gt;
&lt;div style="text-align: justify;"&gt;The standard 10% percent rate seems to have followed the dinosaurs into extinction. A recent caller shopping for rates told us someone quoted them 2% percent for the bail bond! It doesn't stop there, no collateral is being taken on high risk bail. The public is being&amp;nbsp;enticed into a bait-n-switch with false advertisement. People are being&amp;nbsp;harassed by unlicensed individuals in front of the county jails while trying to visit a friend or loved one.&lt;/div&gt;&lt;br /&gt;
&lt;div style="text-align: justify;"&gt;What does all of this mean&amp;nbsp;for the defendant, co-signer(s), and criminal attorney on the case? Well, defendants are being surrendered without "just cause" and the co-signer(s) terms and agreement with the &lt;a href="http://callforbail.com/" target="_blank" title="24 hour bail bond service 1-800-525-5915"&gt;bail bond company&lt;/a&gt; are now different (bait-n-switch) than originally agreed to causing a conflict to the bail transaction. The unethical bail agent is using "strong arm" tactics to get ALL their money now or threatening to throw the defendant back into custody. The criminal attorney's work just got harder, having to deal with their client in custody and possibly getting less of favorable case disposition. Hopefully the criminal attorney had not referred the client to the unethical bail bondsman?&lt;/div&gt;&lt;br /&gt;
&lt;div style="text-align: justify;"&gt;The &lt;a href="http://www.insurance.ca.gov/" target="_blank" title="California Dept. Of Insurance"&gt;California Department of Insurance&lt;/a&gt; regulates the rate of premium and licensing for bail agents in the State of California. The&amp;nbsp;&lt;strong&gt;bail bond &lt;/strong&gt;company transacting bail has a specified rate filing through their surety insurer (insurance company). The standard rate premium in California is 10% percent of the total bail amount. The LOWEST rate premium in the State of California is 8% percent. The 8% premium &lt;span style="text-decoration: underline;"&gt;ONLY&lt;/span&gt; applies to individuals that meet the following requirements: attorney referrals, AARP members, and Union members.&lt;/div&gt;&lt;br /&gt;
&lt;div style="text-align: justify;"&gt;Unfortunately, the general public is unfamiliar with the regulated fees and many times are exposed to an illegal bail transaction. Lets face it, most people are not thinking clearly when a loved one or friend was just taken into custody, they want them out as soon as possible. So, they contact a bail bond company and do very little to no research on the &lt;a href="http://www.la.bbb.org/Business-Report/Fastrak-Bail-Bonds-Inc-100063614" target="_blank" title="A+ Rated Bail Bond Company"&gt;company's standing&lt;/a&gt; with the insurance commissioner, public, and professional associations. The circumstances seem to overshadow a person's rationale or logic if you will. If time is not of the essence, please inquire and investigate with whom you are willing to do business with. The short amount of time spent on your due diligence can make a difference between a good and bad experience.&lt;/div&gt;&lt;br /&gt;

Under California Penal Code Section 1275.1 a peace officer, judge, or prosecutor may place a no bail hold on an arrestee. A declaration must be filed by one of these individuals showing "probable cause" to detain the arrestee without bail and until a bail hearing is scheduled.&lt;br /&gt;

The allegations related to such no bail holds are usually financial crimes, drug trafficking, etc.. It is a common practice in the commercial bail bond industry to charge a renewal premium to a client. Just like many other forms of insurance, this is paid yearly. The bail bond renewal premium is also disclosed in the surety bail bond agreement, the contract used to secure the defendant's release from custody. The section of the contract specifying the bail bond renewal premium may read something like this:&lt;br /&gt;
&lt;br /&gt;
&lt;i&gt;"To pay Second Party ( Bail Bond Company) $ premium amount &lt;u&gt;per annum&lt;/u&gt; for this bail bond. The premium is fully earned upon the release of Principle (Defendant). The fact the Defendant may have been improperly arrested, or his bail reduced or &amp;nbsp;his case dismissed, shall not obligate the return if any portion of said premium. This bond is renewal each year. First Party (co-signer) agrees to pay Second Party (Bail Bond Company) a renewal premium in the amount stated above, twelve months after the date on which this Bond was executed. If said renewal premium is not paid upon written demand therefor. Second Party (Bail Bond Company) or Surety has the right to surrender Principal (Defendant), as provided in the California Penal Code, Section 1300, and exonerate the Bond."&lt;/i&gt;&lt;br /&gt;
&lt;br /&gt;
The surety bail bond agreement and state law clearly indicate that a &lt;b&gt;bail bond renewal premium&lt;/b&gt; may or will be charged to the client. However, the bail bond renewal premium is charged by the bail bond company (Second Party), not the surety insurer as indicated above. Thus, the surety insurer can care less if the bail bond company charges the client the renewal premium or not! This is where most clients and criminal defense attorneys have been mislead or misinformed by some bail bond company they have dealt with in the past.&lt;br /&gt;
&lt;br /&gt;
For example, &lt;a href="http://www.callforbail.com/"&gt;Fastrak Bail Bonds&lt;/a&gt;, finds it an unfair business practice to charge a client a renewal premium because the case has been delayed or continued due to&amp;nbsp;unforeseen&amp;nbsp;circumstances.
