I’ve been incredibly busy and just found your post last night when I went to delete my factual summary due to the latest contempt motion and threats of having the sheriff pick me up to take me to the Colorado court (I’m in Arizona)

I don’t think that doctor Hollander will go after anyone else because her attorney Johnson knows that he doesn’t have a snowball’s chance in hell of prevailing against another attorney. I’m easy pickings — broke and with no lawyer, unable to access the court’s docket and over 800 miles from the court.

Not to mention that the subjects of my many investigations over the years are starting to threaten with lawsuits and even suing me. I spent Christmas Day DELETING my Wellstone Filters posts. I’m not allowed to post WHY.

I can’t fight everybody — they know that I don’t have the money, time and legal skills to prevail in the corrupt American courts.

All I can do is delete and accept that I live in a fascist country where the TRUTH counts for nothing and scum sucking bottom feeding lawyers control the courts.

On another note, it sounds like Tamara Hollander has managed to pull some real strings in order to get as much has she has gotten, but if she dares try to go after RateMDs because some of our members cited your posts she will have one Heck of a fight on her hands.

Dr. “Jon”, you obviously don’t have much confidence in your doctoring skills.

Just like you, I work with people under a great deal of stress, people who are harassed and sued by debt collectors, depressed and sometimes very frustrating to work with. But unlike you, I am confident that I am doing the best job that CAN be done. I’m an expert and extremely qualified.

Of course I can’t guarantee that I get suits for valid debts dismissed or get legitimate credit reporting deleted, just like a doctor can’t guarantee that cancer will be cured. What counts is that we make the best effort.

When my clients have the “perception” that I’m full of crap and screwed them up, they are certainly free to post all the gruesome details on the web or take out a full page ad in the WSJ or anywhere else. I can say that because unlike you, I have integrity and I’m confident that I do quality work.

And, unlike you, I have the guts to say who I am.

I totally agree that consumers SHOULD submit their complaints as I will submit my complaint against perjurer doctor Hollander, BUT, it must be a PUBLIC complaint.

The medical mafia keeps the complaints secret, just like the lawyer mafia — so that you can CONTINUE with your deplorable conduct, possibly KILLING people with your negligence and malpractice.

It’s up to us to publicize how your misconduct and warn potential victims.

Since there are NO statutory regulations involving this
issue of rating physicians or commenting on their services online in any way.
The only law that applies to publication of untruths is “defamation” And if the statements are NOT proven to be libelous [without fact or truth] then a lawsuit can be thrown out as this one should be.
Any judge who rules that linking to another person’s post that is being accused of defamation should be thrown off the bench.[When CNN reports on a charge of defamation by a person, should CNN be sued for providing a link to that person's blog?]

And you better believe that I’ll take this case to the highest court possible, BUT, to take it to a higher court one of the parties would have to appeal. So, if I don’t find an attorney to my liking, I’ll probably lose and THEN I can appeal.

Although, another possibility is filing a FEDERAL or ARIZONA suit against them (Hollander and possibly her attorney) for malicious prosecution or whatever other claims, I’m not an expert but that has been suggested to me. But I’ll need an attorney for that.

And I hope you sued that collector!

Your thoughts on a connection to credit are interesting, but I wasn’t trapped into this. The Baileys had THEIR site up for over a year and I really do believe that their allegations were true. There was so much DOCUMENTATION at the site, it was extremely specific, not your usual consumer “hate site.” And that’s of course why I recommended it.

Also, I FORTUNATELY have always maintained SEVERAL sites and especially since last year I’ve started NEW blogs like this one for specific purposes or companies.

But, I can hardly write an email or post at Trado without missing CreditSuit. At least 5 times a day I’d like to link to one of my posts there or somebody emails and ask for info that’s been posted at CreditSuit. Over 2,500 posts …

I recently posted at Trado: NY Times WaMu article – FAILS to address the role of the regulators, CRAs and FICO scores — they’re still in lala land.

As far as freedom of speech, so long as the statement is true and the only thing published was the link and verbiage described, I do see this whole incident as a frivilous lawsuit and my first instinct would be to find out what the good doctor is hiding. If someone goes to this extreme over something relatively minor.. you have to remember the old addage “where there is smoke, there is fire”.

As far as the legal pecedent, I would take this to the highest court possible because based on the information above this is a blatant attempt to squelch would be advocates.

People don’t like the mirror held up to their face when they are in the wrong. A precential ruling could truly be damaging on a large scale prohibiting consumer advocacy and various groups/entities that help people with disputes/discrepacies such as the news media groups (i.e. ABC News 7 on Your Side) or “Rip Off Report” or even the Better Business Bureau complaint websites.

My next question would be to the good doctor to investigate and see if the family is tied to the credit industry and being paid off to end consumer awareness. it has come out in recent months that many of the Dept of Banking officials within the States are paid off. It is a well known fact that the Financial industry in general finds lobbyistis that are connected to government officials such as neighbors, college buddies, to manipulate the relationship into passing their agenda. The lobbyists are paid handsomely for prostituting their personal ethics.

Just a few thoughts that come to mind off the top of the head.

I ONCE AGAIN asked for documentation of any specific statements.

I haven’t received a response yet.

Also, about the Baileys’ claims, they did include a couple printouts from their website as exhibits, posted at http://forum.creditcourt.com/discus/messages/14435/14448.html

HOWEVER, they did NOT include the FIVE or so separate pages with extremely specific allegations. Of course they pick and choose what to show the judge.

Which is why they didn’t submit any printout of MY alleged libelous statements. I don’t think a judge would look kindly on an exhibit that contains MY REQUEST for identification of any libelous statements so that I can make corrections.

I ran out of propane last night, had to go to town today and now I have to start the rewrites of the press release. So many other things to do, but I need to get the word out to get a good lawyer.

It would be very cool if a big organization like the EFF took the case and LITIGATED it all the way to jury trial.

SOMEBODY needs to put the lawyers in their place. I know enough about law to know that I can’t do it myself.

I wouldn’t mind hearing that you told her that you can resolve this in writing, that you took being served seriously, and that the complaint can still be resolved without litigation via fax and email.
