The problem that we have is that when new leadership comes in and does not have a good sense of the institution, its history, and the various ecosystem, it puts the FTC under considerable pressure and leads to a number of unforced errors.  Another issue is that none of the three current commissioners have a law practice background and so this means that realities of practice are only understood through interlocutors - some of whom are better than others.  With historic levels of turnover at the FTC and lots of particularly strong senior managers leaving, it makes effecting change that can survive court scrutiny more challenging.  The overall breakdown of trust between the practitioner community and the agencies is particularly strong and that trust is important for a well functioning system.  Without it, you lose transparency and matters get challenged with regard not merely as to substance but as to process.]]></description>
