Hi Brent, thanks for the comment. There is Google Analytics and there is Urchin. Typically Urchin is available from your web host when you are using a shared server. Hostway offers it for $5 a month.

It is by far superior to Google Analytics and yes Google owns both. With the full featured version of Urchin, you do not share your stats with Google and the depth of information is better than Analytics.

If you cannot get the full featured version of Urchin, Analytics is your second best bet.

I can completely empathise with this... I had a client recently who was in the wealth-creation industry, bidding on the keyword "rich". ;)

When you say Urchin - I thought Google bought out Urchin's system, and it became Google Analytics?

Conversion tracking is a must-have though.

One quick note, the law on copyrights states that if you do not spell out in your contract that you are working for hire, you own the content. But have you tried to enforce that with a client? Do you know that nearly all clients will assume that they own the content you provided outright? I would prefer to be upfront with the client in writing.

I have to say that if you ask a client who employs you as a blogger if they own the content, they believe they do! They do not understand the copyright law as a professional writer may who is closer to the situation and may deal with it daily.

Why take a chance and have to sue every client you work with, burning bridges in the process? Spell it out and deal with it up front. Don't hide behind jargon and hope the client won't use your content otherwise putting you in a difficult situation. It happens!

Most Indians and Philippine citizens speak English as their second language. However, they speak the language using what they learned about the proper use of grammar. It is said that both of them used better grammar than native Americans does. It is because natives are more used to speaking informal American language and the frequent use of slangs. Seriously, Americans are more comfortable using common informal colloquial jargons.

It means these overseas writers you mentioned are more capable of making formal articles than natives does. Furthermore, most Americans do not care about their spelling and the coherence of thoughts of what they are writing. I've seen a lot of them especially the young ones.

However, it is true than most Indians and Filipinos sometimes attempt to use words that mean differently when read by an American. But ghostwriting firms still prefer these people because it's cheaper and their articles are not that bad. I doubt if one American will be ok with a $5 per 500 word article.

-=M=-

I sure have read it. I am correct in stating that if you are going to do a "work for hire" it should be spelled out in your contract.

You can review more information below on this important rights issue:

“work made for hire” is—
(1) a work prepared by an employee within the scope of his or her employment; or
(2) a work specially ordered or commissioned for use as a contribution to a collective work, as a part of a motion picture or other audiovisual work, as a translation, as a supplementary work, as a compilation, as an instructional text, as a test, as answer material for a test, or as an atlas, if the parties expressly agree in a written instrument signed by them that the work shall be considered a work made for hire. (My note - notice if agreed in a written instrument and this may mean anything that you write and supply to a client.)

For the purpose of the foregoing sentence, a “supplementary work” is a work prepared for publication as a secondary adjunct to a work by another author for the purpose of introducing, concluding, illustrating, explaining, revising, commenting upon, or assisting in the use of the other work, such as forewords, afterwords, pictorial illustrations, maps, charts, tables, editorial notes, musical arrangements, answer material for tests, bibliographies, appendixes, and indexes, and an “instructional text” is a literary, pictorial, or graphic work prepared for publication and with the purpose of use in systematic instructional activities.

In determining whether any work is eligible to be considered a work made for hire under paragraph (2), neither the amendment contained in section 1011(d) of the Intellectual Property and Communications Omnibus Reform Act of 1999, as enacted by section 1000(a)(9) of Public Law 106–113, nor the deletion of the words added by that amendment—
(A) shall be considered or otherwise given any legal significance, or
(B) shall be interpreted to indicate congressional approval or disapproval of, or acquiescence in, any judicial determination,
by the courts or the Copyright Office. Paragraph (2) shall be interpreted as if both section 2(a)(1) of the Work Made For Hire and Copyright Corrections Act of 2000 and section 1011(d) of the Intellectual Property and Communications Omnibus Reform Act of 1999, as enacted by section 1000(a)(9) of Public Law 106–113, were never enacted, and without regard to any inaction or awareness by the Congress at any time of any judicial determinations.

You can read the full information here: http://www.law.cornell.edu/uscode/17/usc_sec_17_00000101----000-.html

The law also states that if you as a client do not specify that you are buying a work for hire in your agreement, the writer retains copyright. We operate transparently with clients and prefer to spell out our rights and their rights to things we create and not have problems farther down the road.

Don't agree?
Some template driven websites do not allow you the designer to access the real source code of your page as really you are working in a content management site.

The meta tags for each page for the title tag and meta description tag in some cases cannot be accessed by you the designer to update to be search engine optimized. It is preferable to have access to these important fields if you want best search engine placement.

Great article!!!!

The pros and cons of using web templates to build the website has been lucidly explained.

The novice webmasters will definitely be very encouraged by this article.

I have come across the line, "Many template driven sites do not allow access to the source code to change meta tags", in the article.

Can you please explain it more to me?

Hi Russ,

If you are tech savvy, and understand how to set up a database then you can install the application anywhere. If you are like me, not a programmer, then to have your blog hosted at Network Solutions is a great idea.

They have a self installer for WordPress and I got up and running in about 10 minutes. It created the database and everything. I still have FTP access to load plug-ins and new themes, but the heavy lifting was all done by the installer.

There are a few other web hosts who do this as well.

If you don’t want to do that, you can pay Bill Downey about $50 at blogsgonewild.net to set up a blog for you on your hosting server. He is a real pro and does wonderful custom templates too.
