On Friday, the U.S. Department of Justice issued the following statement:

A federal grand jury sitting in the Northern District of Alabama returned an indictment yesterday charging a Crane Hill, Alabama, husband and wife with five counts of failing to pay over payroll taxes, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division and U.S. Attorney Jay E. Town for the Northern District of Alabama.

According to the indictment, Walter Michael Williams and Amy Butler Williams operated Dixie Steel Erectors (DSE), a commercial construction business in Hanceville, Alabama. Walter Michael Williams, president and owner of DSE, and Amy Williams, bookkeeper and office manager of DSE, were allegedly responsible for withholding and paying over DSE’s payroll taxes. The indictment charges that during 2012 and 2013, DSE accrued payroll tax liabilities and that the Williams(es) withheld those taxes from the pay of the business’s employees, but willfully failed to pay over the withheld amounts to the Internal Revenue Service (IRS). The indictment further alleges that, while failing to pay over payroll taxes to the IRS, Walter Michael and Amy Williams used DSE’s funds to pay for numerous personal expenses, including mortgage payments on a lake house and condominium and alimony payments.

If convicted, both Walter Michael and Amy Williams face a maximum of five years in prison for each count of failure to pay over the employment taxes. In addition, they face a period of supervised release, restitution, and monetary penalties.

An indictment is an accusation. A defendant is presumed innocent unless and until proven guilty.

Principal Deputy Assistant Attorney General Zuckerman and U.S. Attorney Town commended special agents of IRS Criminal-Investigation, who conducted the investigation, and Tax Division Trial Attorney Allison Garnett and Assistant United States Attorney Melissa Atwood, who are prosecuting the case.

(Nick Griffin for The Cullman Tribune)

WEST POINT, Ala. – After taking on Decatur in a pair of area games last night, the Bearcats returned to West Point Friday for a doubleheader with the Warriors. West point took a 1-0 lead in the first inning of game one, but Cullman managed to build a 5-1 lead before blowing it open with seven runs in the seventh inning and pulling away to win it 12-1. The ‘Cats scored one in the first, two in the second and three in third to take an early lead in game two and held on to win it 9-0 and complete the sweep.

Cullman 12 – West Point 1

Hunter Persall crossed the plate on a fielder’s choice to make it 1-0 West Point in the bottom of the first, but Cullman had an answer in the second inning. Dylon Wallace scored on a bunt single from Easton Dean to tie the game and an RBI single from Peyton Colvard gave the ‘Cats a 2-1 lead in the top of the third.

Ben Hollis drove a ball to deep center field to score a run and make it 4-1 in the fifth and Brennon Norton brought a run home with a sacrifice fly in the top of the sixth before Cullman blew it open in the final frame.

A bases-loaded walk made it 6-1 for the Bearcats and a bases-clearing double down the first baseline from Niklas Fondren put Cullman on top 9-1 in the top of the seventh. Cooper Beck singled up the middle to stretch the lead to 10-1 and Brady Patterson capped things off by doubling into the left-center gap to score two more and make it a 12-1 game.

Wallace made his way back out to the mound for the final three outs and finished off his complete game effort for the ‘Cats. Wallace allowed just one run on four hits and collected five strikeouts in the win. Fondren was 2-for-4 at the plate with three RBIs and Patterson (two hits), Hollis (one hit) and Dean (one hit) each drove in a pair of runs as well. Rylan Jones led the Warriors at the plate with two hits in the loss.

Cullman 9 – West Point 0

The Bearcats scored on an error to make it 1-0 in the top of the first, but they continued to build their lead in the first few innings. Niklas Fondren scored on a fielder’s choice to go up 2-0 in the second and an RBI single from Cooper Beck stretched the lead to 3-0.

The ‘Cats scored on another error in the top of the third and an RBI double from Ben Hollis along with a Cole Fuller sacrifice fly made it a 6-0 game going into the bottom of the third.

After a pair of scoreless innings, Beck came home to score and put Cullman up 7-0 and in the top of the seventh, Cooper Beck doubled to bring around Fondren and Beck brought Dean home with a sacrifice fly to make it a 9-0 game. Carter Guest picked up the final three outs on the mound for the Bearcats and they completed the Friday sweep with a 9-0 win.

Blake Lambert got the start and the win on the mound for Cullman. Lambert tossed four innings and allowed no runs on six hits while striking out three. Beck led the way at the plate, going 3-for-5 with two RBIs and Hayden Stancil finished with a pair of hits in the win as well.

The Bearcats are now 12-10 on the season with a game against Boaz coming up Saturday Morning and the Warriors (10-14) will try to bounce back and get the bats going when they travel to Hamilton for an area matchup on Tuesday.

(W.C. Mann for The Cullman Tribune)

CULLMAN, Ala. - Theatrical innovation is becoming the norm in the Cullman area: Cullman High School flying characters over its stage, Cullman County Schools launching its first countywide casting call, Wallace State putting on north Alabama’s first sensory-friendly performance. On Thursday evening, St. Bernard Prep School’s theater department took its place in the trend with the first of three public performances of “The Wizard of Oz,” staged in the round to bring the audience and cast face-to-face. Action takes place on both the stage and floor of the Abbey Byre; a multimedia video component sets scenes, helps make the Wizard bigger than life and features footage from the original motion picture.

Director Michael Kastner explained, “I think it’s more exciting for the audience, especially if they get there late and they’re in row Z, and their kid’s about this big, clear to the other end of the world. And I love doing in the round, especially the kid zone (the front row all the way around the floor section of the stage). That’s third grade and below.

“So, little kids, what do they do? They like television: they want to be as close to the action as they can. What happens is, when the munchkins and everything come out, the munchkins are going to dance with the little kids in the front row. It’s very interactive; it puts you right in the middle of the action. In this setting, there’s a lot of things on the stage and in the middle, and at this end (near the entrance); we’re trying to use the entire space, the entire building, just to give everybody ‘I wanna be this close to it.’ I don’t think anybody down here’s done theater in the round before.”

This is Kastner’s first production as the new theater director at St. Bernard.

He shared about the experience: “This is my first year here at St. Bernard so, at the beginning of this school year, it was kind of like they were trying to figure out who I was and I was trying to figure out who they were. And they all sang for me at the beginning of the year, and I thought, ‘Wow, I have some really nice voices here.’ Then I started thinking: it’s also the 80th anniversary of ‘The Wizard of Oz,’ so that’s another thing, we should celebrate what happened in 1939. That’s really part of the excitement.

“Those main six leads, they’re very, very talented. They make me look like I know what I’m doing, really! And the stage crew people: I’ve got a couple of stage managers that I haven’t told them anything. They just have kind of said, ‘Come here, little’--I call them puppies: younger kids, seventh and eighth graders--‘Come here; I want to show you this. This is how we do this.’

“It’s really been a great teaching moment, for me and for them. I’ve told them, ‘You’ve got to be a sponge.’ Any scenario that I think is going to happen, I’ve tried to put that at them: ‘What happens if somebody misses a costume change? Okay, what are you going to do to cover for that person until they get in?’ I’m very proud of them. They really have done well.”

St. Bernard Headmaster, Fr. Linus Klucsarits, OSB, temporarily traded his monk’s tunic and hood for overalls and a straw hat to play Dorothy’s Uncle Henry.

Before Thursday evening’s performance, Klucsarits shared, “It’s such a joy to work with such talented people. Over a third of our student body is in the show, so it’s really a blessing that Mr. Kastner brought all these students together. I think it’s going to be a fantastic show, and I hope that everybody comes out and sees it.”

The council passed the resolution to notify the Cullman County Board of Education (CCBOE), Superintendent Dr. Shane Barnette and Hanceville Board Member Kenny Brockman that the City of Hanceville is against the construction of the multi-use sports complex ("Project X"), which is to be paid for by the recently-passed half-cent sales tax. (Christy Perry for The Cullman Tribune)

HANCEVILLE, Ala. - The Hanceville City Council on Thursday night passed a resolution to notify Cullman County Board of Education (CCBOE), Superintendent Dr. Shane Barnette and Hanceville Board Member Kenny Brockman that the City of Hanceville is against the construction of the multi-use sports complex ("Project X"), which is to be paid for by the recently-passed half-cent sales tax.

The Cullman County Commission voted on March 12, 2019 to approve the new half-cent sales tax to benefit Cullman County Schools, with the money earmarked for facilities and safety upgrades for all county school campuses, as well as "Project X," the details of which were not revealed until March 20, 2019. The tax will be imposed for 15 years. The commission’s vote was in a response to a request from the CCBOE, which had voted earlier that same morning in a special-called meeting to approach the commission with the request.

On March 19, 2019 Barnette revealed “Project X” as a multi-use sports and event venue to be located in Cullman, on Alabama Highway 157 near its intersection with I-65. The facility will be located behind Warehouse Discount Groceries, on land donated to the CCBOE by Roy Drinkard. The new half-cent sales tax, along with lodging tax money contributed by the Cullman Area Chamber of Commerce, is to help fund the project, which is projected to reach $30 million.

The resolution passed by the Hanceville City Council Thursday night reads:

Whereas, Shane Barnette, Cullman County Board of Education (CCBOE) Superintendent, Kenny Brockman, Hanceville Board Member, and the other members of the CCBOE initiated a half-cent sales tax for a multi-use sports event venue; and

Whereas, the CCBOE passed this initiative in an early morning special called meeting; and

Whereas, the CCBOE delivered this initiative to the Cullman County Commission the same morning wherein it was improved to be imposed upon the people of Cullman County; and

Whereas, the imposed half-cent sales tax will help fund this project with an estimated cost of $30 million; and

Whereas, the county school facilities located in Hanceville are in need of repair and expansion; and

Whereas, the multi-use sports and event venue will have a detrimental effect on the local schools, local economy, and Wallace State Community College.

Now therefore, be it resolved by the City Council of the City of Hanceville that the Hanceville CCBOE Member, Kenny Brockman, the CCBOE Superintendent, Shane Barnette and the rest of the Cullman County Board of Education Members be notified that the City of Hanceville is in opposition to the construction of the multi-use sports facility.

It is further resolved that the City of Hanceville calls upon the Hanceville CCBOE Member, Kenny Brockman, to oppose this project and stand firm for this community, as he was elected to do, by petitioning for the half-cent sales tax to be used to improve our local school facilities.

Read and adopted this the 28th day of March 2019.

Councilwoman Kim Brown voted no on the resolution; she is an employee of the CCBOE.

After Thursday night’s meeting, Hanceville Mayor Kenneth Nail said, “I thought it was important for this mayor and this council to come out with a strong statement. We’re not trying to be ugly, not trying to be mean to (any)body, but we wrote this this proclamation today and consulted several people about this proclamation. We wanted a strong proclamation that left no doubt how we feel about it.”

Nail said he requested a meeting with Barnette and Brockman to voice his concerns, including the age and condition of the Hanceville schools, mold problems and lunchroom issues were a few he listed as high priority.

He asked, “Why (are) there children, they go up there and eat breakfast at 7:30 in the morning and they’re back in there at 10 o’clock eating lunch? Then some of our kids are eating at and after 1 o’clock in the evening. We (don’t have) money to do anything about that, but we got money to build a $30 million sports complex?”

Nail said Hanceville has sought to separate its elementary school for many years. He described the way the buildings have been added throughout the years and the condition of the buildings as creating a campus that “looks like hell.”

He added, “I told the superintendent, ‘I think you’re trying to put the icing on the cake before you bake the cake.’”

Nail made it clear that the decision by the Cullman County Commission to add a half cent to the sales tax for the schools was not the issue. The decision to use the money for the sports complex rather than the schools’ immediate needs is what Hanceville is against.

“They never asked our opinions, no public hearings, no community input. There was no nothing! We’re just going to make a decision and that’s how it’s going to be. That’s pretty much how the community feels.”

The plan by the CCBOE to use part of the tax money for campus security Nail described as “ a good spend.” However, Nail said, after speaking to many of other mayors in Cullman County, he felt that each community has its own needs that haven’t been addressed.

The economic impact to the Hanceville community is another major concern the mayor and council hope Barnette and the CCBOE will consider. He said Barnette has suggested that each county school would play one or two football games at the proposed complex each season. This is an idea Nail does not support.

Nail explained, “These little towns and these little communities need that economic impact. On Friday night, it’s a big impact for a local community to have that football game in their town.”

For Hanceville, the threat to the economy could be especially significant if events were moved away from Wallace State Community College.

Another meeting is planned next week at which Nail and other community leaders will voice their opposition to the CCBOE. Nail was adamant about standing up for both the city and Wallace State.

He stressed, “We’re going to fight for our high school and we’re going to fight for Wallace State. We’re going to fight them tooth and nail.”

He continued, “I’ll say this, you go ahead and build this. There’s going to be an election one of these days, and you can be looking for another job, and you can quote me on that.”

The City of Hanceville is the first city to make a public proclamation in opposition to the proposed sports complex. Nail’s hope is that this strong statement will result in the CCBOE reconsidering. If not, Nail said he will not rule out future action by the city.

“’I have a dream.’ I think that’s what the superintendent said, ‘I have dream.’ Well, I’ve had a nightmare for years, actually,” he said. “My nightmare is why are these kids still going to these old buildings? Why do we have the crappiest campuses in the county? Why are we eating lunch at 10 in the morning? I’m all about people having dreams, but let’s get real. Let’s fix real problems first.”

The formalized program, ContinuUM, offers Wallace State students guaranteed admission to UM and eligibility for scholarships after earning an associate degree or 45 transferable credit hours.

“We are thrilled with the success of our ContinuUM program and are excited to partner with Wallace State,” said Audrey Crawford, director of admissions at UM. “We feel it is important to eliminate barriers and create opportunities to support transfer students in their transition to a four-year university.”

“The University of Montevallo has long provided outstanding transfer opportunities for Wallace State students, and we are excited to embark on this new opportunity to enhance that partnership,” said Wallace State President Dr. Vicki Karolewics.

The transfer pathway program allows students the opportunity to better plan for their future careers through pre-transfer advising at UM based on intended major. In addition to the ease in transferring and career services, the ContinuUM program also provides Wallace students with other resources at the University of Montevallo.

Students accepted into the ContinuUM program are issued a Montevallo student ID giving them access to online services including digital library resources through Carmichael Library. The student ID also allows Wallace students to utilize the McChesney Student Activity Center workout areas and to attend UM athletic and student life events. The Montevallo Career Development Center is also available to guide Wallace students through career assessment, internship resources, resume writing and interview skills.

All public colleges and universities in Alabama are participants in the national model STARS statewide articulation system, which was established by an act of the Alabama legislature in 1994, and guarantees seamless transfer of credit from community colleges to baccalaureate institutions.
