Michigan Personal Identifiable Information (PII) Redaction

Liberty Screening Services has been closely following our national screening association, the Professional Background Screening Association, surrounding changing legislation in the state of Michigan.

We received notification this morning, that Effective July 1st, 2021, new rulings involving the removal of Personal Identifiable Information (PII) MCR 1.109(G)(9) and MCR 8.119(I) are expected to go into effect. Potentially impacted PII may include: DOB, SSN, Address, Driver's License, and Passport Numbers. The courts have been inconsistent regarding how the PII will be removed (older cases first, newer cases first, or all at once). Our national association, as well as various researchers, have been working to oppose the rulings. Official opposition requests have been submitted to the Chief Justice of the Supreme Court and are awaiting further review.

For this reason, beginning on July 1, we will be offering the following immediate solutions for Michigan County Searches:

Option 1: We will conduct a county level search returning all available PII from the court. IF PII returned on the record contains at least two identifiers, Liberty will provide all reportable records. If PII returned on the record does not contain at least two identifiers, Liberty will add a Michigan statewide search to verify the records.

Option 2: We support a Michigan Statewide product which can be ordered in lieu of a county level search, or as a second, separate search to supplement a county search. Please note that the Michigan statewide search will incur an additional fee assessed by the state, and passed on through each order. Court Closures - North Eastern States - Winter Storm

Due to a winter storm that caused large snowfall amounts in the north eastern states, many courts have closed and will not reopen until Monday Dec. 21st.

Please be aware that this may cause delays in retrieving results.

COVID-19 - Delays / Court Closures

Liberty Screening is closely monitoring the court systems, as our court researchers have recently advised that some court systems have again initiated procedures to combat the spread of COVID-19. Some court systems are closed, or are not processing requests at this time. You may experience delays in response times as a result of these closures.

Currently we are aware of closures causing delays in parts of the following states: AL, CT, DC, FL, GA, IL, KY, MI, NH, PA, TN, and TX.

As Liberty Screening Services receives updates on this situation, we will continue to provide updates to our clients.

Work Number pass through fee

We have been informed by the Work Number that the fee for retrieving employment verifications will be changing.

The Work Number pass through fee will increase to $37.50 per verification.

This change will be effective January 1st, 2021

COVID-19 Stanford National Daily Health Survey

Stanford Medicine is conducting a survey to learn and predict which geographical areas will be most impacted by coronavirus based on how you are feeling. This information will be used to inform local and national responses, such as redirecting medical resources or improving policies and public guidance. Given the 9-10 day delay between onset of symptoms and hospitalization, and the 20% hospitalization rate of patients, tools like this will be necessary to truly track and fight the spread.

Effective July 1st, 2019 Oregon MVR state fee increase.

The Oregon Department of Transportation will be increasing the fee for motor vehicle records to $11.83. This fee will be effective for all requests beginning July 1st, 2019.

The Pennsylvania Department of Transportation will be increasing the fee for motor vehicle records to $14.00. This fee will be effective for all requests beginning July 1st, 2019.

New York Office of Court Administration Search Fee Increased effective 4/13/2019

The New York State Budget has passed and as a result the New York OCA fee to increase from $65.00 to $95.00 per search.

This new fee will be effective 4/13/2019.

New York Office of Court Administration Search Fee Increase

News reports show that the New York Legislature has passed their new state budget. The new budget includes a drastic fee increase for the New York Office of Court Administration (NYOCA) search. The fee for an NYOCA search will increase from $65.00 to $95.00 when the Governor of New York, Governor Cuomo, signs the budget, which is expected to happen any day now. The budget was passed despite the protests of many business groups and associations.

CFPB Updates Summary of Rights

The Consumer Financial Protection Bureau (CFPB) recently issued an interim final rule, effective September 21, 2018, regarding the FCRA Summary of Rights notice. The interim rule requires the addition of a new notice to the Summary of Rights as required by section 609 of the FCRA. As part of the interim rule, the CFPB updated their model Summary of Rights to include (1) a notice informing consumers of their right to a security freeze as required by the Economic Growth, Regulatory Relief, and Consumer Protection Act, signed into law in May of 2018; and (2) a sentence immediately preceding the security freeze notice clarifying that the right to a security freeze applies only in regards to nationwide consumer reporting agencies.

The CFPB has stated that consumer reporting agencies and other entities can use the CFPB’s model forms or a substantially similar form. A substantially similar form may include the November 2012 version of the model FCRA Summary of Rights with the mandated security freeze notice either in a different location on the form or on a separate page to be included with the model form.

What This Means to You:

While the interim rule requiring inclusion of the security freeze notice applies to Consumer Reporting Agencies, end-users who provide the FCRA Summary of Rights notice outside of the Liberty Screening system should consult their legal counsel to determine if their documents should be updated to include the revised FCRA Summary of Rights.
If Liberty Screening provides the Summary of Rights through Candidate self entry with an online disclosure and authorization collection program or sends pre-adverse-action and adverse-action notices for you, please be aware of the changes. There is nothing more for you to do.
