Stay Home and Save Lives: Prevention is Better Than Cure from the Corona Virus Lead Disease of COVID-19

It is challenging to know at early stages when you are infected by the novel coronavirus that causes the COVID-19 disease. There is a most common and rare symptom loss of smell that could signal you must be tested. According to Harvard T.H. Chan School of Public Health epidemiologist Marc Lipsitch, the virus could ultimately infect between 40% and 70% of the population worldwide. Some people might show no symptoms at all but many of those cases would be mild, while the prospect of being infected with a new virus can be devastating. The most symptoms, as per the Centre for Disease Control and Prevention (CDC), are fever, coughing and shortness of breath. These symptoms usually appear between two days and two weeks of exposure to the virus. Doctors recently added "loss of smell" as a potential symptom that may show up alone without any other symptoms, Live Science reported.

As per the Journal of the American Medical Association, as many as 98% of COVID-19 patients who were hospitalized had a fever, between 76% and 82% had a dry cough, and 11% to 44% reported exhaustion and fatigue. As per the current WHO ( World Health Organisation ) reports the coronavirus pandemic has killed more than 21,000 people worldwide, most of them in Europe. Most affected nations have called for complete lockdown to stop spread of the deadly virus.

The WHO said on 25^th March, 2020 that countries which have locked down their populations to prevent the spread of the coronavirus need to use the time to find and attack the virus. With 7,503 deaths, Italy is the most affected country ahead of Spain with 3,434 and China with 3,281, the country where the initial outbreak occurred. The United States has also seen over 900 deaths and some 60,000 infections.

Coronavirus has now spread to over 190 countries across the world affecting billions of people. "Asking people to stay at home and shutting down population movement is buying time, and reducing pressure on health systems. On their own these measures won't extinguish epidemics," said WHO Director-General Tedros Adhanom Ghebreyesus*. *As per the Reports from India Today.

Physicians work with state health departments and the CDC to determine who should be tested for the new virus. However, the CDC also recommends that people with COVID-19 or any respiratory illness monitor their symptoms carefully. If you become ill with the said symptoms and think you have been exposed to the virus, the CDC recommends calling your doctor first rather than traveling to a clinic Worsening shortness of breath is reason to seek medical care, particularly for older individuals or people with underlying health conditions. The CDC information page has more information on what to do if you are sick.

The disease appears to become more severe with age, with the 30- to 79-year-old age range predominating the detected cases in Wuhan, where the outbreak began, according to a study in JAMA. Children seem to be at less risk of suffering noticeable symptoms of the disease. However, a recent study of 2,000 children confirmed or suspected to have COVID-19 found that 6% developed severe or critical illness. The study is detailed in the March 16 issue of the journal Pediatrics.

In more serious cases of COVID-19, patients experience pneumonia, which means their lungs begin to fill with pockets of pus or fluid. This leads to intense shortness of breath and painful coughing.

Ultimately, the decisions about who should be tested are left to the discretion of state and local health departments, according to the CDC. However Govts in various countries have taken right decision to lock down. This is one of the best strategy to control the further spread of the Corona Virus. But the problem is that few people in general not observing it seriously and taking it casual.

If we could stop for a minute to solve real problems facing humanity, instead of imaginary problems mystified with complex mathematics and vocabulary, we may be convinced to realize that education would have been one of the most luxurious adventures of mankind. If we don't have time to read a book in the New Year 2015, at least let us read and inculcate the thoughts of this message. It may make us think, to think is to expand, to expand is to gain and the thought process goes on. If we look on the bright side of things, we shall find enough to make us cheerful and happy. The most powerful thing in life... is our thinking, which has ability to change any situation. We often make two mistakes in our search of inner peace... focusing on things we cannot change, and ignoring things we can change.

As we all know that if we give smiles, they will be returned to us; if we speak pleasant, cheerful words, they will be spoken to us again. Our own words are the bricks and mortar of the dreams we want to realize. Our words are the greatest power we have. The words we choose and their use establish the life we experience. Therefore let us live our moments for what we are, not for what we may become. Let us always find time to tell those people we love, that we love them, care for them, or whatever they mean to us in our life. Life is precious, and we need to be grateful for each day we are given. We should not have only dreams but set goals and achieve what we would otherwise dream! Let us smile in trouble that can gather strength from distress, and grow brave by reflection. Time heals all wounds, but only wisdom keeps them from reopening.

Making hundreds of friends is not a miracle. The miracle is to make a single friend like you who will stand by our side even when thousands are against us. The limitations of us are our own creation, designed to provide cover for our unwillingness to try. We should never be afraid to change our vision, set new goals, and challenge ourselves. Life is best experienced without boundaries; so let us live each day ceremoniously. In fact we are not bound to succeed, but we are bound to live by the light that we have. Let us stand with those whose stands are right, and remain with them while they are right. Let us seize the present opportunity; work with dedication and sincerity and enjoy it; this is the best reward that we can give to ourselves. As we all came here, into this life, with our own music to play; each of us our own set of notes. Let's all play together nicely so that the world becomes a sweet music along the manuscript of life.

Samsung is trying to get Trademark Galaxy Emerge, Galaxy Stellar and Galaxy Halo under ‘Mobile phones: Smartphones’ category

Samsung has filed trademarks for the names Galaxy Emerge, Galaxy Stellar and Galaxy Halo. The monikers have been filed under the category of mobile phones.

The South Korean giant, had submitted the three trademark applications on March 2, 2012. The trademark filings have been listed with the United States Patent and Trademark Office.

Unfortunately, no other details are out regarding the three new trademarks. There is no word on the specs, features, release dates or anything else at all.

Samsung had recently been the talk of the town owing to its trademark filing of names Galaxy Axiom, Galaxy Awaken, Galaxy Heir and Galaxy Rite in February. Back in January, we heard of Samsung filing for 'Samsung Joy' and 'Samsung Fresh'. We must say it is stocking up some very impressive names.

Samung may not use all of these names eventually, but almost everyone seems to be hoping that one of these is the upcoming name for Galaxy S III.

We feel Samsung is only being pre-emptive and employing a good business strategy by stockpiling names for its future gadgets. It is not only reserving some great names, but also giving rise to quite a bit of speculations.

ICC and INTA Oppose De Minimis Provision in ACTA

The International Trademark Association (INTA) and International Chamber of Commerce have issued a notice on ACTA urging countries to drop the de minimis provision that is designed to allay fears of iPod searching border guards. The two associations argue that the exception "sends the wrong message to consumers."

The Bilski Case is Finally Decided

The court held that the Bilski's application was not statutory subject matter:

Petitioners' remaining claims are broad examples of how hedging can be used in commodities and energy markets. Flook established that limiting an abstract idea to one field of use or adding token post solution components did not make the concept patentable. That is exactly what the remaining claims in petitioners' application do. These claims attempt to patent the use of the abstract idea of hedging risk in the energy market and then instruct the use of well-known random analysis techniques to help establish some of the inputs into the equation. Indeed, these claims add even less to the underlying abstract principle than the invention in Flook did, for the Flook invention was at least directed to the narrower domain of signaling dangers in operating a catalytic converter.

Today, the Court once again declines to impose limitations on the Patent Act that are inconsistent with the Act's text. The patent application here can be rejected under our precedents on the unpatentability of abstract ideas. The Court, therefore, need not define further what constitutes a patentable "process," beyond pointing to the definition of that term provided in §100(b) and looking to the guideposts in Benson, Flook, and Diehr.

And nothing in today's opinion should be read as endorsing interpretations of §101 that the Court of Appeals for the Federal Circuit has used in the past. See, e.g., State Street, 149 F. 3d, at 1373; AT&T Corp., 172 F. 3d, at 1357. It may be that the Court of Appeals thought it needed to make the machine-or-transformation test exclusive precisely because its case law had not adequately identified less extreme means of restricting business method patents, including (but not limited to) application of our opinions in Benson, Flook, and Diehr. In disapproving an exclusive machine-or-transformation test, we by no means foreclose the Federal Circuit's development of other limiting criteria that further the purposes of the Patent Act and are not inconsistent with its text.

The judgment of the Court of Appeals is affirmed.

Wipro and Microsoft Join Hands to Deliver Global Legal Process Outsourcing Efficiencies

As per the Businesswire ( A Birkshire Hathaway Company ), WIPRO Technologies, the global IT services business of Wipro Limited , yesterday announced that its Business Process Outsourcing division has partnered with Microsoft Corporation to provide global Legal Process Outsourcing (LPO) for Microsoft's Intellectual Property (IP) portfolio.

In July 2008, Wipro began providing U.S. Patent and Trademark filing and docketing services to Microsoft's Intellectual Property & Licensing group. RMNLU Centre of Cybercrime Laws and Computer Forensics.

The Ram Manohar Lohiya National Law University (RMLNLU) is going to start a center on cyber crime laws and computer forensics. Modalities to this effect are being worked upon by the university administration.

Vice-chancellor, RMLNLU, Prof Balraj Chauhan, is in touch with the respective experts in the two fields -- information technology and law.

There are whole lot of issues pertaining to cyber crimes and computer forensics need to be addressed. Enactment of communication convergence bill which was otherwise mooted in 2001 happens to be one. Secondly, the issue which also needs to be taken is that of centres of learning on computer forensics.

There is a great need of special training to crack various cyber crimes including phishing, bank related frauds and even pornography. It can be claimed that it is no so that any thing can be deleted from the computer. This is a fact that a computer registers each and every thing which is sent to and from it. Virtually, every lost information can be retrieved, provided that new information does not replace it.

But while technical aspects of the subject are being taken care of by the computer engineers, it's the enforcement of the laws which still remains a challenging task. The proper awareness amongst the people needs to be imparted. At times we come up with situation where in people are not aware of even the basic cyber laws and therefore land in trouble. For example, a terrorist casually walks into a cyber cafe and sends a threatening mail anywhere he likes, even as the cafe owner sits unaware of how the computer next to him was used.The mail is traced back and it's the owner who finally lands in trouble.

This is a great step taken by The Ram Manohar Lohiya National Law University (RMLNLU) under the able leadership of the Vice-chancellor, Prof Balraj Chauhan. This will certainly pave the way for the production of specialists in the field of cyberforensics and Cybercrimes.

Call for Worldwide Implementation of the Budapest Convention on Cybercrime

At its 5th annual conference held in Strasbourg, 25th March 2010 on Cybercrime, the Council of Europe called for a worldwide implementation of its Convention on Cybercrime to sustain legislative reforms already underway in many countries and a global capacity-building initiative to combat web-based crimes and enhance trust in information and communication technologies.

'The UN Crime Congress in April 2010 will be an opportunity to reinforce our global response to the global threat of cybercrime and cyberterrorism. I think we will have the best chance to succeed if we unite around one international instrument which already exists – namely the Council of Europe Cybercrime Convention,' said Council of Europe Deputy Secretary General Maud de Boer-Buquicchio, speaking at the opening of the conference.

The conference also highlighted the need to further establish dynamic partnerships between the public and private sectors and their shared responsibility in ensuring security and protecting human rights on the Internet. In this context, the conference proposed the establishment of a contact list for enhanced co-operation between law enforcement and industry.

The Council of Europe will continue to address the issue of 'cloud computing' and intends to ensure that globally trusted privacy and data protection standards and policies are put in place, and that both its Cybercrime Convention and its Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data are applied more widely and efficiently. A human rights and privacy dimension should be brought in the discussions of next year's conference on cybercrime.

Countries worldwide have been turning to the Budapest Convention since its adoption in 2001. During the conference, Portugal announced the ratification of the Convention and Argentina has made a request for accession. Participants called on ICANN (Internet Corporation for Assigned Names and Numbers) to strengthen its oversight role of the Internet domain name registration process in order to allow both the protection of private data of individual registrants (in particular in the WHOIS database) as well as the opportunity for law enforcement to use the database to fight cybercrime and cyberterrorism. They also underlined the need to make the best possible use of existing tools, instruments, good practices and initiatives. They recommended that a global action plan be launched by the Council of Europe and the United Nations to get a clearer picture of criminal justice capacities and urgent needs, mobilise resources, provide support and assess progress made.

Digital Economy Bill Changes of UK Threat to File Sharing on Internet

Internet freedom campaigners have reacted with dismay to the proposed changes to the Bill. Supporters of Open Rights Group, warned many websites could be forced offline simply by the prospect of expensive legal proceedings. Individuals and small businesses would be open to massive 'copyright attacks' that could shut them down, just by the threat of action. It is pertinent to mention that the Digital Economy Bill of UK was announced in the Queen's speech in November 2009, with a major section dedicated to how best to deal with illegal file sharing. The Bill, currently in the report stage at the House of Lords before its third reading in the Commons, proposes a solution of several steps, which begins with a warning letter sent to those illegally downloading from their internet service provider and could end with the internet connection being temporarily suspended.

Under amendments to the Digital Economy Bill the High Court could be given the power to issue an injunction against a website accused of hosting "substantial" amounts of copyright-infringing material. It means popular websites, such as YouTube, which often unwittingly carry content uploaded without the permission of copyright holders, could be "blocked" or forced offline if the amendment is upheld.

The Internet Service Providers Association, which represents ISPs, said it was "outraged" by the plans, while TalkTalk said the plans would force ISPs to restrict access to specific sites.

The proposed law do not restrict access to a few sites but only in the most serious cases, for instance those involving child pornography or issues of national security. But more to the point, making the restriction of websites a more widespread policy would be dangerous given its major impact on internet users' human rights, freedom of expression and privacy.

However the changes would be welcomed by content creators. This is going to send a powerful message to the creative industries that the value what they do, is well respected and it is not censoring the internet, but a genuine approach to copyright protection on internet. The companies like Google, which do major file sharing are planning to face the challenges.

Legislating against electronic crimes such as
spam and ID fraud will not reduce the problem;
instead, education for small businesses and
consumers and cooperation between countries is
the answer. Although some legislation is
required to fight internet-based crimes, alone, it
will make no difference unless backed up by
corporation between international law
enforcement agencies and education for
computer users - EURIM, and Institute for
Public Policy Research (IPPR).
As long as people are so easily fooled by
scammers, no amount of legislation will solve
the problem of phishing, where fake emails are
sent to online banking users asking them to
"confirm" their password and username; under
no circumstances are you supposed to reveal the
whole password - nobody at the bank will ask
for more than a few random letters from it - and
yet people have been giving the complete phrase
to the phishers, says Philip Virgo, Secretary
general of EURIM.
The above statement clearly emphasizes the
importance of imparting cyber crime awareness
and education to end users. At the same time
there is also a need to understand cyber crime
from a non-technical approach like
understanding the criminological and
victimological aspects, how it can effect various
affected parties and how we can protect and
prevent malicious and damaging attacks on our
network and business both in private and
government sector. It is with this idea, the
present International Conference on Cyber
Criminology is being organized during 23rd
and 24th of March 2010.
The aim of this conference is to establish a
multidisciplinary forum for information sharing,
team building and the development of
innovative debate on cyber security,
investigations, forensic techniques /technologies
and legal concerns amongst investigators,
criminologists, victimolgists, information
assurance and network security professionals.

Are We Forensically Ready to Face the Challenges of Cybercrimes?

The latest trends in cybercrimes mandates that we have to have at-least Minimum Mandatory Forensic Readiness Policy in place. The new measures should be designed to better manage information risk, protect personal information of citizens and minimise risk surrounding authorised access to protectively marked information.

But how exactly can we become 'Forensically Ready'? The term itself relates to the ability to forensically examine our data estate so that we know where all of our data resides, we know who has accessed, copied or moved individual files, and we are capable of conducting a forensic data audit in the event of a breach. This level of security can't be handled with simple intrusion detection tools. What's needed is a comprehensive cybersecurity platform to deliver the Privacy Impact Assessments.

A simple litmus test can help us to understand whether we are ready and able to face new challenges. Ask ourself these three simple questions:

• Do we know where all your data resides?

• In the event of a breach, can we prove that all the correct processes and procedures are in place?

• Does our agency/department fully understand and follow the elements of good data handling practices?

The ability to audit our data will enable us to track the flow of sensitive data within our organisation and ensure that only authorised movement occurs. For example, employees are going to move around an organisation internally. Are we able to assess whether they have taken data with them when they move? Are they authorised to do so? Is data where it is supposed to be or allowed to be? When unauthorised movement takes place, this can be flagged and corrective action can be taken.

Have we analysed out the financial price of non-compliance with data reporting requirements, e.g. increased legal fees related to the disclosure of an increased number of custodians? Investment in an effective data audit solution can reduce long term spending by eliminating the need for expensive third party consultants.

Are we able to manage the risk to our reputation if a data breach occurs on our watch? Public sector organisations handling data relating to the most vulnerable in society carry a burden of trust. Private sector organisations that suffer a data loss are likely to pay the price in loss of customers and a falling share price; public sector organisations may not suffer such tangible consequences directly, but the risk to their reputation and governance is as real.

Forensic Readiness – Five Key Guidelines

To have a robust Forensic Readiness Plan in place, organisations and departments need to be able to gather evidence on potential criminal activity or disputes legally and without causing disruption to day-to-day business.

This must also be done cost-effectively and in proportion to the incident - don't go spending crores of rupees of taxpayers' money on a simple data access request. On the other hand, don't scrimp on spending if it's a major criminal investigation. Some of the key elements of putting together a Forensic Readiness Plan are:

1. Define the business scenarios that require digital evidence. When is it appropriate to gather evidence and when is it not?

2. Identify sources of evidence and what sort of evidence it is. Make sure you have the resources to hand to look for it.

3. Know what you're looking for before you go and look for it. Don't gather too much or too little. Have a clear idea of what circumstances need to be in place to trigger a fuller investigation.

4. Establish security and storage rules for the handling of evidence. Keep an eye on the evidence once you have it – and make sure staff understand the consequences of not following these procedures.

5. Provide a documented a real-world example that everyone can run through in advance. Ensure that all parties, including legal, are confident that the processes in place are correct.

So there is a real challenge to forensic computing and cyberforensics and these branches are not yet fully developed. But by following the guidelines provided above we may reduce the danger to data protection and cyberevidnece/computer evidence to a greater extent.

A to Z of Cyberlaw, 2009.

The past twelve months in Cyberlaw were exceptionally active, with the amendment in Information Technology Act 2000, Cyberlaw as a field grew tremendously in the year 2009, and faced different battles over various law and technology issues. The struggle between the rights of sovereign nations to preserve national security and integrity vis-a-vis the personal private rights of individuals pertaining to privacy continued to grow and Cyber terrorism as a phenomenon firmly established itself as an important challenge before national governments and sovereign nations. The issue of distribution of content and data over computer resources located in different territorial jurisdictions connected to the cloud managed to gain enough significant recognition. My blogs for e.g Cyberlaw, Technolex, Technolexindia, and, IPLex, take a re-look at 2009 from A to Z:

A. Anti-Counterfeiting Trade Agreement, the secret copyright treaty that generated opposition in India and abroad as details on proposed language leaked out.

B. Barring a few offences, almost all cyber crimes in India have been made as bailable offences where the accused is entitled to bail as a matter of right.

C. Cyber terrorism was declared as a heinous crime punishable with life imprisonment and fine under the terms of the amended Information Technology Act 2000.

D. Deviation from stringent punishment for cyber criminals by enacting the Information Technology Amendment Act.2009.

E. Electronic evidences have been destroyed by some cyber criminals after released on bail. They have gone ahead of the Information Technology Amendment Act 2009.

F. Facebook, agreed to make significant privacy changes following a well-publicized investigation by Privacy Experts.

G. Google Street View, which launched, but not before a House of Commons committee probed the likely impact of the new mapping feature.

H. Harassment is specifically brought within the ambit of the Indian Cyberlaw.

I. i4i, the tiny Toronto firm that scored a big patent victory over software giant Microsoft, Identity theft continued to be a major cyber crime mover in various jurisdictions.

J. Jonathan Zitterain, chair Professor of Internet Law and Society, has done good contribution to growth of cyberlaw.

K. K is for CRTC chair Konrad von Finckenstein, who was in the spotlight with hearings on regulation of new media, Internet traffic management, and broadcast fees.

L. Legislative initiative, recently taken by the Govt. of India although laudable in its objectives, is likely to have counter-productive consequences if it is not regulated properly.

M. Misuse of confidential data and information is have good recognition under IT Amendment At 2009.This subject was continuously engaged the attention of the relevant stakeholders in different jurisdictions.

N. Notification and implementation of Information Technology (Amendment) Act 2008, defamation, cyber and nuisancenow specifically brought within the ambit of Cyberlaw in India.

O. One-click, the controversial Amazon.com business method patent that was denied validity by the Canadian Patent Appeal Board.

P. Psion, the Toronto-owned firm that threatened Dell over the use of the term "netbook."

Q. Queen v. Vasic, a criminal case in which an Ontario court ruled that combining Internet provider customer name and address information with IP address data could render the information sensitive.

R. Reduction of the quantum of punishment of cyber crimes by the Information Technology Amendment Act 2008, gives virtually a signal to cyber criminals to come and explore the fertile soils of India for perpetuating the cyber criminal designs and intentions.

S. Statistics of cybercriminal convictions are against India. A country of more than a billion populations and only a couple of cyber crime convictions is a question mark on the way cyberlaw in India being implemented.

T. TV Tax and Local TV Matters marketing campaigns that irritated various peoples from coast to coast. Tremendous improvement in cyberlaw over the earlier cyberlaw yet it brought forward its own practical peculiar problems and drawbacks.

U. Unwanted telemarketing calls that kept coming despite the existence of a various national do-not-call list.

V. Veit Joanne, an Alberta judge who ruled that Alberta Information and Privacy Commissioner Frank Work was wrong when he concluded the City of Edmonton can't force pawnshops to upload personal client details to an outside company's database.

W. WindMobile, the operating name of Globalive, a new wireless carrier that was told by the CRTC that it did not comply with foreign control restrictions, only to have the federal Cabinet overrule the regulator weeks later.

X. "X" on electronic voting technologies, which Election authorities of various countries reportedly considering.

Y. YouTube, which received a video takedown demand. The crown corporation objected to a union-inspired video about the mail carrier's CEO.

Z. Zoocasa, the real estate search site that was sued by Century 21 for scraping listings from its website.

After going through A to Z developments in the field of cyberlaw in 2009, it is evident that Information technology issues are growing faster than expected. These developments are posing challenges before cyberlaw policy makers at international level in general and national level in particular. Let us just not wait and watch but be ready with better regulation, control, protection and management of rights and liabilities in fast growing digital world to have better knowledge economy.
