        <![CDATA[<a href="http://www.loudoun.gov/Default.aspx?tabid=990">The Loudoun County Board of Supervisors (LCBOS)</a>&nbsp;will decided on Tuesday, July 21st on whether to support&nbsp; 
<span class="mt-enclosure mt-enclosure-file" style="DISPLAY: inline"><a href="http://dullesarea.net/governmentalaffairs/Item%2B%2315a-CIF%5B1%5D.final.pdf">proposed changes to the county's Capital Intensity Factor (CIF) policies</a></span>that will raise the amount of money the county seeks from developers to pay for the impact of new homes.&nbsp;The proposal for higher proffers for new homes in Loudoun County will rank among the state's highest with levels, for example, in the Ashburn, Potomac and the Sterling planning areas increasing from $47,846 to $59,470 for single-family detached homes, from $30,575 to $40,385 for single-family attached homes and from $18,904 to $23,785 for multifamily homes.]]>
        <![CDATA[<p>These amounts, if approved, would have to be paid by developers for each home they construct on rezoned land that is above the number of homes that could have been built by right or without a rezoning. For example, if 10 homes could be built by right on a parcel and a developer successfully rezones the land to build 20 homes, he would pay proffers on the 10 additional homes he builds.<br />In comments&nbsp;presented by DAAR Government Affairs Chair Beckwith Bolle at last month's public hearing on the matter, DAAR questioned the rationale behind the changes and raised concerns over the proposal's impact on housing affordability.&nbsp; DAAR explained that the combination of increased proffers and housing pressure created by a projected increase in population will send future housing prices through the roof - especially for the county's workforce.&nbsp; If the proposal is approved, developers may account for an increase in the proffer amounts by moving to a high-end, high cost housing product that better allows the cost of the fee to be passed along to the purchaser.&nbsp; In turn, this will diminish the number of low-moderate income homes created and adversely impact the county's ability to attract key commercial sector businesses reliant upon employees that need affordable housing in a location close to work.&nbsp; Further, the County will also face challenges attracting and retaining county school teachers, paid firefighters and sheriff deputies necessary to provide adequate public services.&nbsp; For more information, read the

        <![CDATA[<p>In message to state and local association of REALTORS® leadership and staff, NAR CEO Dale Stinton and Chief Lobbyist Jerry Giovaniello provided an update on the recently passed American Clean Energy and Security Act (HR 2998): "The recently passed American Clean Energy and Security Act has been met with much interest by our members.&nbsp; As is usually the case with controversial legislation, some are fanning a few flames.</p>]]>
        <![CDATA[<p>However, much of the fuel feeding the fire is simply incorrect.&nbsp; Jerry and I are writing not to debate, rather simply to provide you with a brief description of how we got here and what steps we will be taking as we move forward.</p>
<p>NAR dropped its opposition to the American Clean Energy and Security Act when we successfully eliminated provisions that would have had a significant and adverse affect on the real estate industry.&nbsp; Once these provisions were stripped from the house bill our advocacy efforts in the House of Representatives efforts ended.&nbsp; NAR achieved the primary goal outlined by the Presidential Advisory Group on Climate Change and the Land Use, Property Rights and Environment Committee.&nbsp; As the bill moves to the Senate, NAR will maintain a 'neutral' position while monitoring the situation. NAR&nbsp; will OPPOSE any attempts to insert anti-REALTOR provisions into the Senate legislation.</p>
<p><strong><u>NAR's Climate Change History</u></strong><br />NAR's involvement in the Climate Change issue goes back more than 18 months.&nbsp; NAR appointed a Presidential Advisory Group (PAG) on Climate Change to develop policy guidelines.&nbsp; NAR Climate Change policy supports: commercially reasonable and incentive-based approaches to reduce energy use and greenhouse gases; solutions that are guided by market and smart growth principles of protecting private property rights and maintaining real estate affordability and availability; and educating property owners and consumers about the benefits and importance of energy efficiency.&nbsp; Additionally the PAG outlined legislative provisions that NAR would oppose:&nbsp; requirements which impose undue economic burdens on property owners or managers; triggering such requirements especially at the time when residences or buildings are sold; and expanded application of existing laws or regulations that are not suited to address climate change</p>
<p><strong><u>Member Involvement<br /></u></strong>Following multiple consultations with the NAR Climate Presidential Advisory Group, the NAR Land Use, Property Rights and Environment Committee, and state associations who had dealt with energy audit legislation at the state level, the Land Use, Property Rights and Environment Committee, Leadership asked us to concentrate on the real estate provisions in the bill.&nbsp; This is consistent with NAR's long-standing policy to only take a position on legislation, or provisions within legislation, that have a direct affect on real estate.</p>
<p>Working within the parameters established by the PAG and the Land Use, Property Rights and Environment Committee, we began to evaluate the American Clean Energy and Security Act.&nbsp; Staff reported back that the bill contained provisions that would have a significant and adverse affect on the real estate industry.&nbsp; The Land Use, Property Rights and Environment Committee reiterated the need to concentrate on eliminating the anti-REALTOR provisions in the bill.</p>
<p>As the bill moved through the legislative process we continued to work with out Congressional allies to strip the Energy Bill of provisions that would have adversely affected our industry. Once NAR secured the removal of the anti-REALTOR provisions, NAR dropped its opposition to the Energy Bill.</p>
<p><strong><u>Next Steps</u></strong><br />Later this week, the Land Use, Property Rights and Environment Committee will be conducting an after-action conference call to formulate strategic objectives in the Senate and to develop an appropriate tactical response.&nbsp;&nbsp;&nbsp; Following the meeting of Land Use, Property Rights and Environment Committee, the Public Advocacy Advisory Group will meet again (by conference call) to assess the recommendations of the Committee for proceeding in the Senate.</p>
<p><strong><u>Media Myths<br /></u></strong>Much of the information that fuels the fire of opposition to the American Clean Energy and Security Act is just rhetoric.&nbsp; Wrong information about this bill has been told by numerous media personalities and politicians seeking ratings, political support or both. Time and time again our membership has reasserted the need to maintain a focus and confine our legislative advocacy to helping promote and protect the real estate industry.&nbsp; Consequently, our Congressional allies come from both sides of the aisle and are evaluated based on their support and commitment to REALTOR issues.</p>

        <![CDATA[<p>Did you know that you could be fined $2,500 for putting up a temporary sign if you do not get utility lines marked first?&nbsp; DAAR was recently alerted to an investigation that was being conducted by the State Corporation Commission (SCC) regarding a violation of the Virginia Underground Utility Damage Prevention Act.&nbsp; The SCC is charged with enforcing Virginia's Underground Utility Damage Prevention Act, which gives them the authority to investigate alleged violations and levy a fine of up to $2,500 if a violation is found to have occurred.</p>]]>
        <![CDATA[<p>Due to potential damage to gas lines or other utilities, the SCC will be investigating all possible violations including the installation of temporary signs used by real estate agents.&nbsp; </p>
<p>Many of you were already aware that post signs need markings because you are digging a hole in the ground but the SCC is also including the small metal framed signs that you push into the ground with your hands.&nbsp; They feel that the installation of temporary signs falls under the definition of "excavation" which is prohibited without the proper utility markings.&nbsp; However, there is an exemption in the law which allows the homeowner to install the temporary sign him or herself without utility markings.&nbsp; The SCC confirmed this exemption and although they still feel it is unsafe, it is not a violation of the Act.</p>
<p>The SCC is currently conducting random field inspections.&nbsp; Possible violations will be referred to an SCC advisory committee for further investigation.&nbsp; While they are authorized to levy a $2,500 fine, it is also possible to only receive a warning.&nbsp;&nbsp;&nbsp; </p>

        <![CDATA[The Virginia Housing Development Authority (VHDA) is launching a new program to allow first time homebuyers to use the Federal First Time Homebuyer Tax Credit to finance down payment and closing costs on a VHDA mortgage.&nbsp; This loan has a built in second mortgage with zero interest and no payments for the first 12 months. Eligible buyers have the following three payment options:<br />]]>
        <![CDATA[<p>1. Pay off the second mortgage with the Federal First Time Homebuyer Tax Credit. <br />&nbsp;&nbsp; <br />2. Pay off the second mortgage over 29 years - and save the tax credit to pay for future emergencies, make home improvements, or pay off/pay down existing debt.<br />&nbsp;&nbsp; <br />3. Make principal payments on the second mortgage before the repayment period begins; this will reduce the required monthly payments for the remaining 29 years on the second mortgage.</p>
<p>The maximum loan amount for the first mortgage is the maximum FHA mortgage, and the maximum loan amount for the second mortgage is up to 5% of the sales price (no cash back). VHDA does not guarantee borrowers' eligibility for the Federal First Time Homebuyer Tax Credit. Borrowers can file an amended tax return after closing, and should consult a tax advisor or the IRS for complete eligibility criteria. <p>The release of VHDA's program follows <a href="http://dullesarea.net/governmentalaffairs/2009/05/first-time-homebuyer-tax-credi.php">HUD's May 12 announcement </a>that FHA approved lenders are permitted to "monetize" the Federal First Time Homebuyer Tax Credit through short-term bridge loans. HUD's program DOES NOT allow a buyer to use a conventional lender to monetize the tax credit to reach the 3.5% down payment, although they CAN use it for closing costs and pre-paids.&nbsp; The only way a homebuyer can use the tax credit for down payment (to reach the FHA 3.5%) is if the buyer uses an FHA-approved non-profit or instrumentality of government.&nbsp; For more information, click here to read HUD's mortgagee letter. <br /></p>]]>

        <![CDATA[<p>In an effort to educate and inform REALTORS® about the rules governing the placement of real estate-related signs and the volunteer group authorized to collect signs, Loudoun County zoning officials made a <a href="http://dullesarea.net/new_website/2009/05/07/presentation.pdf">presentation</a> and answered questions during a well-attended meeting this week.</p>
<p><a href="mailto:keith.fairfax@loudoun.gov">Keith Fairfax</a>, Enforcement Program Manager, explained that the Board of Supervisors 
<span class="mt-enclosure mt-enclosure-file" style="DISPLAY: inline"><a href="http://dullesarea.net/new_website/2009/05/07/Vote.pdf">voted</a>&nbsp;</span>earlier the year to enter into an 
<span class="mt-enclosure mt-enclosure-file" style="DISPLAY: inline"><a href="http://dullesarea.net/new_website/2009/05/07/agreementBS.pdf">agreement</a></span>, modeled after Chesterfield County,&nbsp;with the Commonwealth Transportation Commissioner that allows the County to collect illegal signs within the VDOT right-of-way per the Code of Virginia (<a href="http://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+33.1-375">33.1-375</a>).&nbsp; Owners of the signs are subject to civil penalties of $100 for each sign collected per the Code of Virginia (<a href="http://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+33.1-373">33.1-373</a>).&nbsp; Members of the County's volunteer group, who are authorized to collect signs until&nbsp;June 30th when the BOS will assess the effectiveness of the program, were instructed to only collect signs within the VDOT right-of-way which is typically five feet from the edge of the roadway.</p>
<p><a href="mailto:Marsha.Keim@loudoun.gov">Marsha Keim</a>, Zoning Permit Manager, explained the options real estate professionals have for the placement of open house, directional signs and temporary signs within the County per the sign ordinance.&nbsp; She reiterated that to place signs on property in the County, brokers need to apply for a $50 sign 
<span class="mt-enclosure mt-enclosure-file" style="DISPLAY: inline"><a href="http://dullesarea.net/new_website/2009/05/07/permit.pdf">permit</a>&nbsp;</span>by March 31st of each year which covers their agents.&nbsp; Once the permit is obtained, agents can place signs on private property only by permission&nbsp; and are subject to&nbsp;the&nbsp;<a href="http://www.dullesarea.net/governmentalaffairs/signordinance.html">provisions</a> of the
