This book addresses the field of populisms from a contemporary perspective. The book brings a conceptual, qualitative, culturally sensitive and transformative approach to containing populist governance. The authors set out not only examine and compile the most varied conceptual definitions, but also present a theoretical definition in which they recognize a myriad of variable properties of populisms which are strategies commonly used in specific political contexts.

Furthermore, with its own methodology, the book shows the use of a working method whose analysis was designed to apply the definition of populism applicable in any national context and answer the following hypothesis: the political and normative actions undertaken in the political system could be characterized as a populist movement in its formal and/or informal aspects, directly or indirectly? In this perspective, variable properties are attributes that allow to establish a traceable relationship through a set of specific indicators for its operationalization and empirical tests. The book also applies the definition of populisms in the political and normative actions undertaken by Jair Messias Bolsonaro in Brazil, presenting an extensive repertoire of mechanisms which understanding could contribute to contain populism, with the proper adaptations to the characteristics of each context. Reading Populisms will certainly contribute to the readers having more conceptual tools to analyze this global phenomenon that threatens the building of democratic constitutionalism as well as to understand how the growth of populism is associated with the weaknesses of liberal democracy.

Estamos a viver uma das maiores crises mundiais deflagrada pela pandemia do Novo Coronavírus (COVID-19), que está espalhando sofrimento humano no nível global. Diante disso, as palavras de ordem são a integração, cooperação e solidariedade - no pronunciamento oficial, realizado em 20 de março de 2020, o Secretário-Geral das Nações Unidas Antônio Guterres afirmou que “mais do que nunca, precisamos de solidariedade, esperança e vontade política para enfrentar esta crise juntos”^[1]. De acordo com Guterres, esta é uma crise humana que exige políticas coordenadas, decisivas e inovadoras.

Neste sentido, precisamos, em primeiro lugar, afastar a polarização política, a “guerra política” entre União e os Estados, bem como a “judicialização da pandemia”, buscando estabelecer um laço de coordenação e integração para a contenção e controle do surto pandêmico. “Estamos em guerra contra um vírus e as ações devem corresponder à natureza única da crise - e a magnitude da resposta deve corresponder à sua escala”^[2].

A batalha entre os governos e as instituições democráticas servem de estopim para a deflagração do colapso total do sistema eis que os problemas são estruturais e policêntricos e já estão decantados no sistema brasileiro.

E marcando o ano maravilho de pesquisa e com lindas parcerias, foi publicado na Revista da Faculdade de Direito da Universidade Federal de Minas Gerais (Qualis A1) o artigo escrito em inglês com meu amigo e parceiro Jayme Benvenuto intitulado:

“UNITED NATIONS ASSISTANCE TO CONSTITUTION-MAKING PROCESSES: PRE-CONSTITUENT AND CONSTITUENT PHASES - UNITED NATIONS ASSISTANCE TO CONSTITUTION-MAKING PROCESSES: PRE-CONSTITUENT AND CONSTITUENT PHASES”

The empirical evidences of constitution-making conducted by the United Nations (UN) represent a significant challenge to contemporary constitutional law and to the deeper tradition of modern constitutionalism. By incorporating the ideals that sustain democracy to the UN there was a change of perspective as to its role: the political-juridical structuring of a nation in turmoil. This paper discusses the pre-constituent and constituent stages of the constitutional assistance processes developed by the UN in states that have democratization needs. The focus of the discussion relates to the possibilities and limitations of such processes, led by the UN as an international institutional authority with the aim of being responsible for the appeasement of large areas of turmoil. Whether in the pre-constituent phase, or in the constituent phase, we are addressing political-legal processes in which a global international organization interferes in the adoption or reform of a constitution by a national state. The fact reveals, firstly, the political, economic and social fragility of certain parts of the world - subject to fratricidal disputes that include the violence and the subjection of considerable parcels of their populations. Secondly, the fact reveals the difficulty that the global international system encounters in positioning itself adequately in the face of the problem without the marks of colonization. The problematization, from the subject of study, adopts a dogmatic profile and is promoted through an interdisciplinary approach, guided by the critical-dialectical model. It was undertaken, during the research of qualitative data collected from the real events, with the objective of explaining, exploring and describing current phenomena inserted in the analyzed context. Thus, the research is based in the following elements: doctrine and official documentation issued by the United Nations.

O estudo da identidade vai aproximar à cultura social de um grupo, entretanto esta cultura só vai ter significado para a sociologia do direito constitucional, na medida em ela esteja representada na ideologia daquela constituição. Uma das problemáticas a se enfrentar é optar pelos vários aspectos da realidade, uma vez quem nem todas estarão devidamente representadas no mínimo cultural. E este é um desafio que se pretende aspirar com o ideal do “constitucionalismo democrático, o reforço do signo de legitimidade da carta fundamental para formação da identidade e da cultura constitucional, principalmente em um ambiente constitucional em crise. E neste sentido é preciso compatibilizar a união entre a constituição e a narrativa do universo que rege uma determinada coletividade. A imposição feita exclusivamente pela via jurisdicional, como aposta o neoconstitucionalismo, não é capaz de promover a emancipação das pessoas constitucionais. O “diálogo democrático” é uma ferramenta por excelência para a resolução das questões objetivas e subjetivas, principalmente quando já instaurada a crise. A visão dialética cogitada pelo “constitucionalismo democrático” é essência e construto que decorre da autoridade constitucional, o que pode resultar em nova contestação e novo dissenso. E isso reflete o viver constitucional, que está desconectado da visão juriscêntrica, e que não nega que outras autoridades possam definir e atualizar o significado constitucional.
