Legal Fees:

Property Tax In Indonesia

The following are taxes usually imposed by Indonesian Government to each property transaction:

1. BPHTB/Bea Perolehan Hak atas Tanah dan Bangunan (Duty on Acquisition of Land and Buildings)
is the duty / tax imposed on all property transactions, whether new or old, purchased from the developer or individual.

The amount of which is 5% of the transaction value or the NJOP (Sale Value Of Tax Object), whichever is highest, reduced by NJOPTKP (Non-Taxable Value of Tax Object).
The value of NJOPTKP varies for each region / city. (Local governments keep trying to reduce NJOPTKP; in Sleman, DI Yogyakarta Rp15 million. In Pekanbaru, Riau Rp30 million. Most of East Kalimantan Rp60 million, Rp22 million Bogor, Tangerang Rp16 million. While Jakarta is set at Rp.60 million.)

Formula: 5% x (Transaction/NJOP-NJOPTKP)
Example: In Jakarta, the Duty on Acquisition of Land and Buildings/BPHTB of Rp.100 Million worth property transaction will be 5% x (Rp.100 Mill – Rp. 60 Mill.)= Rp. 2 Million.

2. Pajak Pertambahan Nilai/PPN (Value Added Tax)
is only charged once when purchasing a new property either from developers or individuals. The amount of which is 10% of the value of the transaction/NJOP (whichever is highest).

3. Pajak Penghasilan/PPh (Income Tax)
Is the tax imposed on individual seller. The amount of which is 5% of the value of the total transaction or NJOP (whichever is highest) with exception on properties which value are below Rp.60 million. For developers, income tax is paid through annual installment.

4. BBN/Bea Balik Nama (Duty on Changing Name Title)
Is a duty imposed during the process changing the name of the property certificate transacted from seller to buyer. The cost of BBN varies for each region, but the average size is 2% of transaction value / NJOP(whichever is highest).

5. Pajak Penjualan Barang Mewah/PPnBM (Sales Tax on Luxury Goods)
Only apply to property purchased from the developer and meet the criteria of luxury goods. Fall under this category are buildings with dimension of more than 150m2 or have selling price more than Rp. 4 juta/m2. Sales Tax rates at 20% of the sale price and is paid upon the transaction. However, this do not applied on transactions between individuals.

6. Pajak Bumi Dan Bangunan/PBB (Land and Building Tax)
Is an annual tax on land and buildings imposed to all taxpayers (property owners). Bill usually comes every March through regional government officials in the form of SPPT (Letter of Information on Payable Tax Returns). The payment must be made no later than six months after SPPT published and can be paid on the nearest Tax Office or to the appointed banks. For every late payment, fines amounting to 2% per month (up to a maximum of 24 months), are applied.
