Debt Super Committee Needs a Hero? I'll be your Huckleberry

This huckleberry certainly can't be as smart of any of you folks in Congress.

And, mind you, this huckleberry doesn't have a clue what the numbers are. There is no transparency in our alleged Constitutionally limited Representative Republic Government. Further, all of this huckleberry’s Freedom of Information Act (FOIA) requests regarding budgets have been denied.

And this huckleberry certainly doesn't have enough information to know who is and who is not paying enough taxes. All of this huckleberry’s requests to put the budget and/or actual revenues and expenses on the internet in layman's terms with no aggregates greater than 100 dollars have also been rejected.

But with all of that forewarning by this huckleberry, here goes.

First, get the politics out of the process as much as possible. All you incumbent ruling class elite politicians are
too busy jockeying to protect your benefactors to make this process intelligent and logical.

Your method of working upon this issue, with all of your hidden agendas, is farcical.

Hennepin County Board of Commissioners Chair Mike Opat, Minneapolis Mayor RT Rybak and Hennepin County Attorney Mike Freeman are addressing the situation of George Washington and his entourage encamped at Valley Forge.

Mr. Washington and his troops must depart from Valley Forge when the weather gets below freezing... The conditions are not healthy for them and their tents and signs violate zoning ordinances...

Mr. Washington and his malcontents must disperse or we will send in others(who are appointed and not elected) and deny all responsibility for making these decisions ourselves. (as it would make it more difficult to rig the next election if we are too wildly unpopular)

Conservative Advice to #Occupy Wall Street (#OWS) and the 99%

To begin with, thank you. Thank you for taking the time to be involved in our country’s politics. For many years, various people have opined about the apathy of the American voter while American Politicians took the occasion of this apathy to ignore the Constitution and Bill of Rights.

To be honest, this author is disappointed with many of my fellow conservatives who talk the talk of Constitution, Bill of Rights and Natural Law. They lay claim to the moral high ground but have forgotten to walk the walk. 1st Amendment Rights are not just those for those who agree with our positions on issues. http://goo.gl/6tibX. To paraphrase (and correct) a prominent Republican:

“Constitutionally-Limited Representative Republic where WE THE PEOPLE are guaranteed certain inalienable Natural Rights is messy.”

This author advises his fellow conservatives, if you are going to claim the moral high ground, you need to walk the talk. If rank and file America adopts the casual attitude of the politicians towards truth, justice, integrity, the Constitution and the Bill of Rights, America is doomed.

CRITICAL THINKING

This author does not presume to “tell” the Occupy Movement anything. This is an exercise in constructive advice. This author places loyalty to Country and WE THE PEOPLE over loyalty to any political party. The Truth knows no loyalty to any political party.

As evidence of this author’s philosophy, the following is a statement this author normally closes his articles with:

PROLOGUE

If you are of the liberal political persuasion and have made it this far, thank you for taking the time to listen and think critically. If you need further motivation to continue reading, use this as an opportunity to get to know your perceived enemy.

For those of you of a conservative political persuasion, this author refuses to be sucked into the duplicity of the Incumbent Ruling Class elite of either the Republicans or the Democrats. This author seeks to break the false political paradigm the incumbent ruling class elite use to enslave the rank and file of WE THE PEOPLE. In the end, much of this article will be as much Enlightenment for conservatives as it is for liberals.

This center-right conservative author is making this effort to advise the Occupy Movement because it appears to be a group of young, politically novice citizens with genuine and legitimate concerns who need some honest, non-manipulative guidance. Since few who should step forward have sought to offer sincere advice, this author feels a responsibility to fill this void for his fellow Americans.

This author believes the force of his logical argument will create a political paradigm shift. And that this paradigm shift will cause rank and file American of both parties to realize that the 2 major political parties are merely an arbitrary categories created by the ruling class elite to divide, conquer and manipulate, WE THE PEOPLE.

CONGRESS SHALL MAKE NO LAW…. ABRIDGING http://goo.gl/bHPo

This author is enraged at the circuitous means the right to free speech, freedom of assembly and the right to petition the government for redress of grievances is being abridged. The first Amendment says “Congress shall make no law…. abridging” these first amendment rights. The definition of abridge from Dictionary.com http://goo.gl/R5DjM:

2. toreduce or lessen in duration, scope, authority, etc.; diminish; curtail: to abridge a visit; to abridge one's freedom.
3. to deprive; cut off.

Yet some how a myriad of zoning laws, permit laws, health code laws, etc. have been erected which effectively abridge WE THE PEOPLE’s Natural Rights of Speech, Assembly and Government Petition. With a wink and a nudge the ruling class elite passes these laws to suppress, repress and oppress WE THE PEOPLE. By using these circuitous rules, the ruling class attempts to plausibly deny that they are abridging the First Amendment. The net effect is to make our Government less accountable to WE THE PEOPLE.

At the same time, this author recognizes and vigorously defends the private property rights of the private property owners. However, if WE THE PEOPLE cannot protest on private property nor freely protest on Public Property, where may WE THE PEOPLE go to protest and/or otherwise make our sentiments known?

Is it not mocking hypocrisy to guarantee WE THE PEOPLE free speech, free assembly and freedom to Petition the Government, and then outlaw the locations where free speech and assembly can be practiced? What is the difference between our elected officials directing law enforcement to mace, hose, rubber bullet and arrest Protesters for alleged zoning and health code violations and dictators and communists directing their law enforcement to use the same mace, hose, rubber bullets and arrests to suppress, repress and oppress political dissent?

What would our Founder’s say if they heard about these circumventions of the 1st Amendment? What would George Washington have said if King George decreed; “No tents or signs at Valley Forge if the temperature drops below freezing?” How do any of our US Government officials make these decrees in good faith, knowing our history, traditions and the intentions of the Founder’s in drafting the 1st Amendment?

Whether we conservatives support the Occupy Movements positions on issues or not, who, if not we conservatives shall defend to the death, their right to protest? http://goo.gl/6tibX Or will we conservatives wait until someday when our right to protest is denied. And then realize there is no Court of Public Opinion to appeal to because we failed to uphold the Constitution and Bill of Rights now?

Political issues must be resolved on the force of logical argument and not brute oppression or America is destined for tyranny and revolution. And yes, it will be messy. Such is the nature of freedom and liberty.

THERE ARE NOT TWO MAJOR POLITICAL PARTIES

There is only one ruling class with two heads (elephant and donkey). They change which head appears to be in charge from time to time to give the appearance of political revolution to circumvent actual violent revolution. However, regardless of which “head” appears to be in control, the people making the decisions behind the scenes do not change.

The Ruling Class uses the illusion of 2 separate major political parties to further its goals. The Ruling Class uses arbitrary definitions of what it means to be Democrat and Republican to divide and conquer WE THE PEOPLE.

The Ruling class exploits the innate human emotional desire to be part of a group to pit WE THE PEOPLE, the rank and file of America against each other, instead of against our elected officials or the incumbent ruling class. Some Issues are deliberately “kept alive” and “emotionalized” so that voter’s vote with their hearts and selfish and primal instincts. Lastly, some persons from both political parties become extremely insistent that there is a philosophical difference between the two major parties. I have listened to them angrily rant on and on. They point to the differences in the platforms, philosophy on government size etc.

The author’s response is this. The author has been to the caucuses. The author has been a delegate. The author has offered resolutions. The author has added planks to a political party’s platform. What difference does any of these things make if the day after the election our elected officials are selling their votes to the highest bidder?

Republicans are supposed to be for Free Markets and Risk and Reward – The freedom to Succeed or Fail.

Democrats are supposed to be for the little guy. Despite this both Democrats and Republicans ignored their platforms and philosophies to bail our Rich Bankers who failed. What is the difference between the parties if just sell out to the highest bidder?

THE USA IS A CORRUPT PLUTOCRACY MASQUERADING AS

A CONSTITUTIONALLY-LIMITED, REPRESENTATIVE REPUBLIC

Long before caucuses and primaries come along, the Ruling Class elite have already manipulated into place their slate of candidates. By the time caucuses and primaries are held, WE THE PEOPLE usually left to select from a candidate the elite have selected to be the Democrat and a candidate the elite have selected to be the Republican. Therefore, which ever candidate voters select, you are still selecting a candidate loyal to the ruling class elite. And while the Ruling Classes machinations are not 100% effective, they are sufficiently effective to elect a majority to do their bidding.

To get elected, both Republican and Democrat candidates tell their perceived constituencies whatever it takes to get elected. The day after the election they begin selling their votes to the highest bidder (Plutocracy) with little or no regard to their own constituents.

ENLIGHTENMENT VS. RULING CLASS CONTROL

The American constitution was written towards the end of the “1^st Enlightenment” aka “The Age of reason. The Constitution was written incorporating the ideas of unalienable Natural Law and Natural Rights.

The new printing press, books, Coffeehouses, debating clubs and universal libraries greatly accelerated the distribution of these new ideas of the enlightenment throughout the masses. These ideas spread so quickly, that the status quo ruling elite of the time could not suppress them. And with its psychological devices of control rendered useless, the tyrannical ruling class of the time could not withstand people using reason and thinking for them selves, and soon made concessions and adapted or were swept away by violent revolution.

But the ruling class of our time has adapted. With their old psychological devices for controlling WE THE PEOPLE through simple brute force, tradition and superstition, the ruling class pondered a new controlling strategy.

Upon long reflection, the new ruling class determined that they can control us by controlling the information WE THE PEOPLE receive. By controlling the information that WE THE PEOPLE receive; they can only induce WE THE PEOPLE to the decisions and conclusion the ruling class desires while duping WE THE PEOPLE into believing we made our choices of our own free will.

The rise of television, radio and motion pictures were the technological advances that allowed the new ruling class to inflict their new controlling strategy upon WE THE PEOPLE via mass indoctrination, propaganda and censorship. (Unfortunately for the current ruling class and fortunately for WE THE PEOPLE, the internet represents the same technological advance as the printing press, ideas and ideals of natural law and natural rights have accelerated in distribution at a faster pace that the current ruling class can control – hence the ruling classes attempts to control it)

Another way that the Ruling Class controls us is through Public Education indoctrination. For example, we have all heard the fable of George Washington, “I cannot tell a lie, I chopped down the cherry tree”. This and other propaganda are used to instill in young folks the notion of a morality of “absolute right and wrong”. But in the real world, Politicians practice a morality of “plausible deniability”. This practice of teaching a morality to young people which is diametrically opposed to reality in the real world, exposes new generations to being exploited by those who practice a standard of “plausible deniable” morality.

Our corrupt Plutocratic government manipulates and manages us like cattle and/or trained seals by deliberate misinforming and terrorizing WE THE PEOPLE as method of oppression, suppression, repression and manipulation. With the 30 days Winter Holiday Season representing 20% of the American economy, this economic indicator does not bode well for the American economy.
It occurred to this author that the Conservatives spin on would be as the fault of President Obama.

But who is really to blame for the current state of the US Economy?
Perhaps one of these two explanations will allow the reader to determine for themselves upon whom the true blame should be cast.

1) THE USA AS A CORPORATION WITH YOU AS THE SOLE OWNER

The first, and perhaps easiest to understand perspective, is to think of the USA as a company with you personally as the sole owner.

As owner, you have hired a management team to produce superior results.

After years of good results, the current management team has been reporting dismal results, similar to the results the USA Politicians are responsible for.

In the little more than the 20 years since your biggest competitor collapsed (the former USSR) giving you overwhelming market share, your management team has brought your company… your source of money, power, basic needs, superior luxuries and indulgent desires… to the brink of collapse.

Since most Americans are employees and/or sports teams fans, the author presumes you have witnessed how Corporations deal with poor performance. Heads rolls, presidents get terminated, Coaches get fired and employees get laid off.

Minnesota Grand Jury Right Stolen

Greetings,

To the members of the Minnesota Judicial Branch, I have been in contact with you on the telephone about my concern over the restricted access to our Grand Jury.

The following is my research on the subject, as well as the case law that sets forth the right and duty of a judge to convene a Grand Jury open or special venire.

Introduction

Citizens from across the state of Minnesota have repeatedly attempted to bring evidence of corruption of public officials directly to their Grand Juries. Members of the Minnesota Judicial Branch have consistently blocked access by the Citizens to the Grand Jury. The names of the Grand Jury forepersons have been withheld from the Citizens.

In November of 2007, an indictment from the Grand Jury in Ramsey County came down that contained the signature of the Grand Jury foreperson. Christina Becher, foreperson for the Ramsey County grand jury was sent a Criminal Complaint concerning crimes done against a Citizen that is on active military duty. Christina Becher gave the Complaint to Charles Balck of the Ramsey County attorney’s office. Instead of properly handling the matter, by contacting the office of the Minnesota Attorney General, Mr. Balck gave the Complaint to Chief Judge Gregg Johnson of the Ramsey County district court.

Evidence of felonies being committed by certain judges in the Ramsey county district court were contained in the package sent to the Jury foreperson. Then Chief Judge Gregg Johnson buried the Complaint.

Mr. Balck, by his actions of giving the Complaint to the Chief Judge of the Ramsey County district court, compromised any secrecy the Grand Jury would have in investigating the public officials of Ramsey County for their alleged criminal activity.

The Complaint sent to Christina Becher is one of MANY complaints that the Citizens have, supported by evidence, of corruption of public officials in every branch of government.

The Minnesota Constitution

In my telephone discussions with the above named judicial officers, I addressed the issue of whether the Grand Judy is a constitutional right the People secured unto themselves, or a civil right granted by government. I also indicated to you that the Minnesota constitution was unlawfully amended to remove the Grand Jury as a constitutionally secured right.

The distinction between a constitutional right and a civil right is pivotal. A right secured by our constitution is a right that a constitutional officer has the duty to defend, pursuant to his or her oath of office. A civil right is one “granted” by the government and controlled by the government and is akin to a privilege.

The People of Minnesota set forth in our original constitution that the Grand Jury was a right that we secured unto ourselves.

In 1868 a bill was passed to amend the constitution to remove the Grand Jury. The language of the bill is as follows:

“No person for the same offense shall be put twice in jeopardy of punishment, nor shall be compelled in any criminal case to be witness against himself, nor be deprived of life, liberty or property without due process of law. All persons shall, before conviction, be bailable by sufficient sureties except for capital offenses where the proof is evident or the presumption great; and the privilege of the writ of habeas corpus shall not be suspended unless when in case of rebellion or invasion, the public safety may require it.”

“The ballots used at said election by those voting in favor of said amendment shall have written or printed thereon the following words, “against the grand jury;” and the ballots used at said election by those voting against the amendment shall have written or printed thereon the following words, “for the grand jury.”

When brought to the People in 1868, the amendment to the constitution was overwhelming defeated with two-thirds of those voting on the amendment declaring the Grand Jury would remain in the constitution.

A commentary on the amendments to the state constitution speaks to the failure of this amendment to pass in 1868, stating, “As early as 1868 an amendment was made to abolish the requirement of an indictment or presentment of a grand jury as a condition precedent to a trial for felony. The peculiar form in which the question was presented to the voters probably had much to do with the defeat of the amendment.”

In 1903 another bill to amend the state constitution was passed. The language of the bill is as follows:

“No person shall be held to answer for a criminal offense without due process of law, and no person for the same offense shall be put twice in jeopardy of punishment, nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty or property without due process of law. All persons shall before conviction be bailable by sufficient sureties, except for capital offenses when the proof is evident or the presumption great; and the privilege of the writ of habeas corpus shall not be suspended unless when in case of rebellion or invasion the public safety may require.”

“The ballots used at said elections on said amendment shall have printed on them“ Amendment to Section Seven (7) of Article One (1) of the Constitution providing for criminal prosecutions and the rights of the accused.” “Yes—No,” and each elector voting on said amendment shall place a cross mark thus (X) in a space left opposite either the word “Yes” or the word “No” and shall be counted for or against the proposition in accordance with the expressed will of the elector as provided by the election laws of the state.”

Proper Notice to Amend the Constitution

In my research I repeatedly attempted to find the actual ballots for constitutional amendments that were sent to the People. Accordingly, I submitted a written request under M.S. Chap. 13 for the ballots to the Minnesota Secretary of State’s office. Said state office wrote back and told me they were only required to keep records for TWO YEARS, and that any other records had been sent to the Minnesota Historical Society.

I repeatedly attempted to find the ballots at the Minnesota Historical Society and was told each time, that the documents had not been sent to them. I am unable to find authorization within the statutes for the Minnesota Historical Society to maintain the records of the Secretary of State.

Currently, the secretary of state, with approval of the attorney general, prepares a short title to identify each amendment on the ballot. The ballot question specified by the legislature appears under the title. The text of the constitution as it would appear if amended is not printed on the ballot.

It is unclear as to WHAT the People actually voted on in 1903, as the ballots (ballots spanning over the course of 100 years) are mysteriously missing from the public record. It is clear that in 1868, when the People were noticed that the amendment would eliminate the Grand Jury from our constitution, the amendment was overwhelmingly defeated.

Valid argument can be made that the People in 1903 were frauded by the legislature to vote on an amendment to remove the Grand Jury from our constitution, as the amendment failed in 1868 when the People where noticed that the amendment would remove the Grand Jury. In 1903 the legislature specifically excluded this notice to the People.

Equally, argument can be raised that ALL ballots brought to the People that do not contain the original constitution and the proposed amendment to the constitution are null and void on their face as proper notice was not given to the People.

Denial of Access to The Grand Jury

For years I have been working with a group of state Citizens that have been attempting to bring evidence of the corruption of state officials before the Grand Jury. Members of the Minnesota Judicial Branch throughout the state, have blocked every attempt.
M.S. Sec. 628.61 (3) states: “The grand jury shall inquire into the willful and corrupt misconduct in office of all public officers in the county.”

The Minnesota Supreme Court case of Wild v. Otis proclaims the Citizen had the authority to “go around” the county attorney and present evidence directly to the Grand Jury.
Wild v. Otis was written in the same time period that a runaway Grand Jury brought indictments against corrupt public officials in Minneapolis. Curiously, it was in this same timeframe that the “purported” amendment to remove the Grand Jury from the constitution was “passed”.

With the purported removal of the Grand Jury from the state constitution, the Grand Jury was then enacted as a statutorial “right”, as such, a “civil” right granted (and controlled) by government.

Our government then put into place additional restraints to prevent access to the Grand Jury.

The legislature enacted M.S Sec. 480.056, 480.0591 and 480.59 that give the power to supercede statutes to the judicial branch. (Including the statutes concerning the Grand Jury.) The judicial branch wrote the rules concerning the Grand Jury. And, the judicial branch promulgated the Minnesota General Rules of Practice. Rule 1.02 of the M.R.G.P. states: “A judge may modify the application of these rules in any case to prevent manifest injustice.”

There has been a deliberate and methodical process set into place to keep the People from bringing evidence directly before their Grand Jury. Our republican form of government has been wrenched from us by an oligarchy that protects itself by denying the Citizens their Grand Jury and thereby the restraining our ability to expose and prosecute corruption within our government.

The intent of the People concerning the Grand Jury

To those members of our Judicial Branch, I direct you to the following Minnesota and federal court opinions:

The grand jury is not appointed for the prosecutor or for the court; it is appointed for the government and for the people; and both the government and the people are surely concerned, on the one hand, that all crimes, whether given or not given in charge to the grand jury and whether described or not described with professional skill, should receive the punishment which the law denounces, and on the other hand, that innocence, however strongly assailed by accusations drawn up in regular form, and by accusers marshaled in legal array, should, on full investigation, be securely protected. Hale v Henkel, 201 US 43, 50 L ed 652, 26 S Ct 370, disapproved on other grounds Murphy v Waterfront Com. of New York Harbor, 378 US 52, 12 L ed 2d 678, 84 S Ct 1594, motion to retax costs den 379 US 898, 13 L ed 2d 174, 85 S Ct 183.

The power and duty of the grand jury to investigate is original and complete, susceptible of being exercised upon its own motion and upon such knowledge as it may derive from any source which it may deem proper, and is not therefore dependent for its exertion upon the approval or disapproval of the court. People v Polk, 21 Ill 2d 594, 174 NE2d 393; State v Iosue, 220 Minn 283, 19 NW2d 735 citing United States v. Thompson, 251 U.S. 414, 40 S. Ct. 292, 64 L. ed. 342.

The duty of the grand jury is to inquire diligently into all offenses which come to its knowledge, whether from the court, the prosecuting officer, its own members, or from any source. People v Polk, 21 Ill 2d 594, 174 NE2d 393; State v Iosue, 220 Minn 283, 19 NW2d 735.

Provisions within the statutes for the grand jury are intended to secure the same protection that was provided by the common law, through the same kind of grand jury, which was traditional at common law, functioning substantially in the same way. Re Opinion to Governor, 62 RI 200, 4 A2d 487, 121 ALR 806.

Authority to summon Grand Jury open venire or special venire

Courts have taken the view that the authorization of a special grand jury may exist or function contemporaneously with the regular grand jury, and does not violate constitutional provisions guaranteeing the right to presentment or indictment by a grand jury for infamous crimes and felonies. People ex rel. Ferrill v Graydon, 333 Ill 429, 164 NE 832; State ex rel. Doerfler v Price, 101 Ohio St 50, 128 NE 173.

At common law the grand jurors could be summoned by open venire. Rogers v. People, 104 Colo 594, 94 P2d 453.
M. S. Sec. 628.41
Subdivision 2. Venue.

If subject matter of the grand jury inquiry concerns activity, events, or other matters in more than one county, a grand jury may be selected, in reasonable proportion, from the counties in which the activity, events, or other matters occurred. A judge of the district court from any judicial district which includes one of the counties involved in an inquiry may convene a multicounty grand jury, without regard to judicial district boundaries, and may designate which county attorney or county attorneys shall attend upon the grand jury. The judge shall designate where a grand jury drawn from more than one county shall sit.

M.S. Sec 554.05 RELATIONSHIPS TO OTHER LAW.
Nothing in this chapter limits or precludes any rights the moving party or responding party may have under any other constitutional, statutory, case, or common law, or rule.

M.S. Sec.599.04 COURTS TO TAKE JUDICIAL NOTICE.
Every court of this state shall take judicial notice of the common law and statutes of every state, territory, and other jurisdiction of the United States.

M.S. Sec.609.015 SCOPE AND EFFECT.
Subdivision 1. Common law crimes abolished.
Common law crimes are abolished and no act or omission is a crime unless made so by this chapter or by other applicable statute, but this does not prevent the use of common law rules in the construction or interpretation of the provisions of this chapter or other statute. Crimes committed prior to September 1, 1963, are not affected thereby.
Subdivision 2. Applicability.

Unless expressly stated otherwise, or the context otherwise requires, the provisions of this chapter also apply to crimes created by statute other than in this chapter. M.S. Sec.611A.85

OTHER REMEDIES PRESERVED.
Sections 611A.80 to 611A.88 do not affect the right of any person to bring an action or use any remedy available under other law, including common law, to recover damages arising out of the use of the individual in prostitution or the coercion incident to the individual being used in prostitution; nor do sections 611A.80 to 611A.88 limit or restrict the liability of any person under other law.

“Under the provisions of section 7, page 186, Session Laws of 1891, the judge of the district court may order a grand jury to be drawn as provided by law for any county of his district. It is not necessary that such order be made by the court. Under the provisions of section 3961 of the Revised Statutes, the court or judge may order an open venire to issue for such number of persons as may be required to appear for service at any term of court in his district. State, v. Charles H. Barber 13, Idaho 65; 88 P. 418; 1907 Ida. LEXIS 14

We are unable to interpret the statutes as limiting the power of the court in calling a grand jury to the [***4] one mode provided in said paragraph. At common law, a court possesses the power of directing the summoning of a grand jury upon an open venire whenever, in the discretion of the court, it be found necessary. The statutes ought not, therefore, unless the legislative intention appears otherwise, to be so construed as to deprive the court of this power. Territory Of Arizona, Plaintiff and Respondent, v. People, 81 Ill. 333; State v. Marsh, 13 Kan. 596

"Courts shall have power to procure juries by an open venire, according to the ancient practice, whenever it may happen that one is not in attendance for the trial of causes under the procedure prescribed by the act." See, also, Babcock v. People, 13 Colo. 515; Beery v. U.S., 2 Colo. 186; Mackey v. People, 2 Colo. 13; Wilson v. People, 3 Colo. 325.

It will be observed that the foregoing is only applicable "in case a grand jury is required," and that it is then selected from "the first panel." In counties like Las Animas the calling of a grand jury [***7] is discretionary with the judge. It often happens that when the first panel is drawn (as was the case here), or when the term opens, no grand jury [**456] has been ordered or decided upon. Hence we have held such acts directory only, and that grand jurors can nevertheless be summoned by open venire as under the common law. Rogers v. The People, Supreme Court of Colorado, 104 Colo. 594; 94 P.2d 453; 1939 Colo. LEXIS 317 citing Imboden v. People, 40 Colo. 142, 151, 90 Pac. 608.

CONCLUSION

Whether by the constitution or the statutes, it is the intent of the People that our Grand Jury investigates the misconduct of public officials.

It is my argument that the amendment to the state constitution that removed the Grand Jury was not validly passed. Accordingly, my assertion is the Grand Jury remains a remedy and right that the People in this state secured unto Ourselves.

Even if my argument fails, the enactment of the Grand Jury within our statutes should be construed as codification of the common law.

Under common law, a judge may summon a Grand Jury open or special venire, and appoint a separate county attorney to attend to the Grand Jury.

The constitutional officers that are reading this memorandum have the power to summon a Grand Jury to hear the evidence of corruption. As well, said officers are bound by their oaths to uphold the rights the People secured in our constitutions. The right of redress is one of these secured rights and presenting evidence of corruption to our Grand Jury is the remedy the People have set forth for redress of corruption.

PETITION

I, Nancy Lazaryan, in propria persona, in sumo jure, as a member of the Sovereign People of the state of Minnesota, under common law and the constitutions of the state of Minnesota and these united States and M. S. Sec. 628.41 Subd. 2 do hereby PETITION the constitutional judicial officers named in the afore attached Memorandum to:

1. Summon a Grand Jury, either open or special venire to hear the evidence of corruption of public officials in various counties within the state (including but not limited to the county said judge presides in), and

2. Appoint a special county attorney to attend said Grand Jury.

Minnesota Citizens demand access to the GRAND JURY

In a FULL PAGE ad in the Sunday May 25, 2008 St. Paul Pioneer Press, the Citizens of the state of Minnesota demanded access to the Grand Jury….

St. Paul, Minnesota
May 25, 2008

The Citizens of Minnesota, frustrated by their attempts to bring evidence of the corruption of certain judicial officers to their Grand Juries, placed a full-page ad in the St. Paul Pioneer Press on Sunday, May 25, 2008.

The Grand Jury is composed of Citizens and is required to investigate evidence of corruption of political officials. But in Minnesota, the Judicial Branch has taken over the Grand Juries and has refused to allow the Grand Juries to hear the evidence that would indict their fellow judges of crimes.

The cover-up is deep and wide.

In the summer of 2007 Citizens demanded to the Chief Judge of the Ramsey County district court (Gregg Johnson), access to the Grand Jury to bring evidence of corruption of public officials. The judge refused.

In November of 2007 an indictment came down from the Grand Jury of Ramsey County on a murder investigation. The indictment was signed by the foreperson of the Grand Jury. A criminal complaint (and evidence) of only one, of over 40 cases was sent to the Grand Jury foreperson. The foreperson, confused, sent the information to Chuck Balck of the Ramsey County attorney’s office. Balck gave the information to Chief Judge Gregg Johnson. Johnson buried it.

Undaunted, numerous Citizens petitioned the Governor (Tim Pawlenty) and the Minnesota Attorney General (Lori Swanson) seeking a special Grand Jury to be convened. Pawlenty and Swanson ignored the Citizens.

The Citizens arrived at the state capital with TV cameras and asked to speak with Pawlenty and Swanson concerning their petition for a Grand Jury to be convened. Instead of responding to the Citizens, the state police were called and threatened the Citizens with arrest, and the police grabbed the equipment of the reporters.

The Citizens also petitioned both the Minnesota Court of Appeals and the Minnesota Supreme Court seeking a writ of mandamus to compel access to the Grand Juries. No response.

Now, a private Citizen has funded a full-page ad in the St. Paul Pioneer Press. This man is not wealthy, yet he dug into his own pockets to bring the message to the People of the state of Minnesota. “We want out GRAND JURY to investigate the evidence of corruption in the judicial branch.”

When will the People understand that it is OUR responsibility to correct OUR government? The Grand Jury is charged with the duty to investigate ALL evidence of corruption of public officials, including the judges.

The Citizens of the state of Minnesota will not stand down. They will be heard, and they will require that ALL public officials are made accountable to the People.

It is the right of the People to bring evidence of corruption directly to the Grand Jury. We demand our rightful access to the Grand Jury.

Our Founding Fathers were determined to see their hard one liberties survive that nature of man.

In writing our Constitution, one of the 1st things they considered was the historic problem of violent and bloody succession of leaders.

The simple formula is this; the more concentrated the power of a people group, the bloodier the succession. In other words the fewer people who hold a nation’s power the greater the chaos as result of its transfer. It is the simplest economics, many grappling for a consolidated, rare resource and you get blood.   The genius of the US founders was their deep insight into history and human nature. They understood this formula and structured the government to avoid this problem. Their solution was so simple it seems surprising. They structured the government to recognize every citizen’s sovereignty and made the leaders servants of those sovereigns. To further hinder the natural tendency for humans to consolidate power, they spread national power to sovereign states, and split the power of the central government to different branches.

In essence they made the resource of national power abundant to all by dispersing it to every citizen sovereign. This article began as a hyper-critical evaluation of elected officials. Upon reflection, it seems voters bear as much responsibility as do the Politicians.

Let's talk about the Vikings Stadium first. Saying that the author is not a proponent of using public money to finance any stadium so billionaire Sports team owners can make a profit paying millionaire sports players to play kids' games is an vast understatement.

Simply our policy should be as follows: We do not negotiate with Terrorists, Hijackers, Kidnappers nor billionaire sports team owners who extort taxpayers for publicly financed stadiums.
As for why should everyone oppose publicly financing professional sports arenas:
First, if sports stadiums are economically viable, they are economically viable as private financing concerns.

Second, professional sports are not on the base rungs of Maslov's hierarchy of Needs ( http://bit.ly/q4pIaA ) for the overwhelming majority of Americans. Put another way, if we prioritize the budget items for the Government's Budget, a new football stadium does not make the top 999. (By the way, for the would-be detractors, in the interest of full disclosure the author is an avid football fan and played High School Football)

Thirdly, Public Financing of Stadiums represents a "Transfer of Wealth" from the average taxpayer to a small group of usually wealthy individuals. Put another way, it is unearned income otherwise known as welfare, in this case corporate welfare. Put yet another way, it is the theft of property from producers of value just to give the rewards of their hard labor to someone that has not earned it.

Fourth, if we negotiate with one sports stadium extortionist, soon all states and municipalities must agree to competing extortion demands and the only ones who benefit are the sports teams owners and the politicians they give kickbacks to.

Fifth, given all the budget cuts that must be made, it is foolish even consider another expenditure.
Which brings us to the angering aspect of these two headlines appearing next to each other on the front page, above the Fold, in the local newspaper.

WHAT ARE THESE POLITICIANS THINKING ADVANCING YET ONE MORE DEBT OBLIGATION UPON THE GOVERNMENT WHEN OUR CREDIT RATING AS A NATION HAS JUST BEEN DOWNGRADED?

WHAT ARE THESE MINNESOTA POLITICIANS THINKING WHEN THEY JUST BALANCED THE STATE BUDGET BY BORROWING MORE INSTEAD OF CUTTING EXPENSES OR INCREASING REVENUE?

Are these politicians just disconnected from financial reality?

Is it not clear to every citizen that our elected officials do not have the best interests of WE THE PEOPLE (http://bit.ly/np9lGS) in mind when they make these decisions? Is not this very type of thought process in advocating the Public Funding of a New Football Stadium symptomatic of what has led to the downgrading of the US Credit Rating?

And now we arrive at the matter of Standard and Poor's downgrading the Credit Rating of the USA..."

"First of all, you may ask, who am I to even propose a solution to what all of my state and federal elected officials cannot figure out how to resolve ?
According to my elected officials I am just a subject peasant in the Feudal hierarchy of the USA.

Then, from my personal point of view, I am not even being compensated. Yet, because it bothers me that my fellow Subjects, otherwise formerly referred to as WE THE PEOPLE in the constitution, are caused distress by the uncertainty this mess the Ruling Class has inflicted on us causes.

So, despite my obvious lack of qualifications as determined by the Ruling Class incumbent Politicians, I am going to take a common sense approach to the budget impasse of both the State of Minnesota and the Federal Government. Further, despite the appearance that none of our elected officials abide by the constitution and that they treat WE THE PEOPLE as though they rule us rather than represent us, I am going to give my opinion from the perspective of reality in which WE THE PEOPLE are the Sovereign Citizens of this Country, and where our Elected Officials are Public Servants not Royalty.

First some general observations and premises:

1) Based on previous budget impasses, these budget crises tend to be emotional, and as much emotion should be removed from the process as possible...."

WE THE PEOPLE On this July 4th, 2011, the 235th anniversary of America's Declaration of Independence from the British, announce the formation of a true, non-partisan, grassroots Cultural and Political Movement to restore the Liberties and Freedoms envisioned by the Founding Fathers for WE THE PEOPLE. WE THE PEOPLE seek to restore respect for our Constitution, the Bill of Rights and to restore the Rule of Law to these United States of America.

This Movement shall be known as WE THE PEOPLE TAR. TAR being the Acronym for Transparency, Accountability and Reform. Welcome to the 2nd Enlightenment of mankind. http://amzn.to/93qVP4

At least 3 iterations of this initial document announcing the formation of this WE THE PEOPLE TAR Movement have been written. There are so many thoughts, ideas, philosophizes and issues that seem important that one regrets the need to omit some of them from this initial document. In the end, rather than try to fully explain the reasoning and logic behind our Top six issues and our 9 Principles, we decided to list them with simpler explanations and expound on the reasoning and logic in subsequent articles. In this way we hope to quickly share with you our proposed perspective of reality.

That having been said, let us cut to the chase with our top 6 proposed priorities for the next few elections:

PROPOSED TOP 6 CAMPAIGN AND LEGISLATIVE ISSUES FOR THE NEXT FEW ELECTIONS

Let us vow to not let the political parties, the politicians, the major media, special interest nor big money steer WE THE PEOPLE off topic from these 6 issues. WE THE PEOPLE TAR believes these 6 issues are vital to restoring our liberties, freedoms, our constitution and our Bill of Rights as well as previous levels of economic opportunity for all of WE THE PEOPLE.

WE THE PEOPLE TAR asks you to write about these issues in political surveys, letters to the editor and letters to candidates themselves. Challenge Candidates to reduce their positions on these issues to paper. In Public Forums and Debates, ask all persons running for office what their positions are on these 6 issues. Do not let the political parties, nor any other powers that be, to frame our any elections in the future. WE THE PEOPLE will set the agenda and frame the main issues for all future elections.

On Twitter.com, there is an atmosphere of constructive intellectual exchange that challenges and causes each of us to think about why we believe what we believe. The internet represents a similar component of technological advance as Movable Type did to the First Enlightenment* (1650AD-1800AD). Twitter.com, Facebook.com and MySpace.com are analogous the coffeehouses and debating clubs of First Enlightenment. Through these electronic forums, Information and Ideas are being freely exchanged at a rate too fast for most governments to adapt to (for the purpose of maintaining their own power and the status quo)

One of my fellow Citizens and Patriots, responding to one of my “tweets” suggested that a split was occurring amongst WE THE PEOPLE in general and, in particular, those of us who take a greater interest in Liberty, Freedom and Politics.

My fellow citizen and cohort described this perceived split as "Libertarian" vs "Conservative". Before I say more, I thank my said cohort for bouncing their ideas off from me, so I would be inspired to reflect upon what causes me to believe what I believe in this regard. OPEN YOUR MIND AND PREPARE YOURSELF FOR A NEW, TRUER

PERCEPTION OF REALITY

CHILDHOOD MYTHS AND FANTASIES

"We have a tradition in America of imparting to our children seemingly harmless, fanciful perceptions of reality. The Tooth Fairy, the Easter Bunny and Santa Claus are all fanciful myths aka manufactured false perceptions of reality. Almost all of us Americans fervently believed at least one of these fantasies in our early lives.

Our Parents and teachers and other people in our lives imparted to us a belief in these myths as being true.

And, we believe these stories basically for 4 different reasons:

At that age, we are less sophisticated and less able to discern truth from fiction.
And, regardless of our age, more likely believe something we are told when it told to us by people we trust and/or love.
Circumstantial evidence – Money replacing the teeth. Easter Baskets on Easter Morning. Easter egg hunts at Church. The cookies and milk we set out for Santa were gone the next morning. Jingle bells outside of the house at the appropriate time. Children’s Books dedicated to the subject. TV ads and programs espousing the existence of said Santa Claus, etc.
The fictional perception of reality is more desirable than the alternative. In short, we want to believe because we benefit or perceive benefit from going along with the myth. e.g. money, candy, gifts. And these myths also give us a nebulous, warm fuzzy feeling and sense of security. They made the world seem less harsh and friendlier.

If we are honest with ourselves, we will acknowledge that our youthful “perception of reality” incorporated unquestioning and absolute belief in the Tooth Fairy, the Easter Bunny and/or Santa Claus. Regardless of how easily we can disprove that reality now, and how ridiculous our belief in them seems on retrospection, we believed in these myths at one point in our lives. We accepted these myths as the truth and they were our Reality. Through these myths, almost all Americans share the experience of believing in a perception of reality that was never real, despite our once fervent belief that they were.

And we did not easily give up our beliefs in these myths. Even when harsh reality was brought to our attention some of desperately clung to the fantasy... I can remember some kids in the school yard fighting their peers who were the bearer of bad news. Others were more restrained in their responses, waiting to go home and check with a trusted and reliable source, their parents. I did not want to believe that my parents would believe me. And for those that clung to the myth, there was the peer pressure of being ridiculed and being called immature.

But once the individual overcame their desire for their false perception of reality to be true, they very quickly came to realize the discrepancies in the myth. For example, the impossibility of one single person such as Santa Claus delivering gifts to every household in one night… Or the impossibility of reindeer and a sleigh defying the law of gravity. They all seem so obvious in retrospect.

However, other myths and mysteries of life don’t offer the same absolute proof and closure as the false perceptions of reality involving Tooth Fairy, the Easter Bunny and Santa Claus. And these myths, fantasies, deceptions, delusions and duplicities are far more injurious than our childhood fantasies.

PERCEPTION IS REALITY

Essentially, each person’s perception of reality comes only from their daily interactions and cumulative inputs to their senses of sight, sound, smell, taste and touch. http://bit.ly/8c3u and http://bit.ly/aUAj3s
With that in mind, I ask you each to go back to that period of your life when you fervently believed in the Tooth Fairy, the Easter Bunny and Santa Claus...."

Legal Evil? In their own words - Part 1 of 3

This is a teaser from an article I wrote on Examiner.com:

From Public School, to church, to the movies and the major media and elections themselves, the American public is induced to believe that the Judges of America are men of integrity beyond reproach.

So with all of those credentials and long years of propaganda and censorship one faces a mighty steep mountain of indoctrination, propaganda and goodwill in exposing the true nature of Minnesota and the Country's Judiciary.

With the Judiciary's reputation reputation for integrity and honesty firmly embedded in the minds of WE THE PEOPLE, what standing do I have to challenge their reputations. In my estimate, what ever I might say would be easily dismissed, for what is my word to the word of these prestigious Judges.

To overcome this handicap, I will use the American Legal Systems own words to expose the true nature of their character.

Let us begin with the words of former FBI director J Edgar Hoover:

"The individual is handicapped by coming face to face with a conspiracy so monstrous he cannot believe it exists.''

Whatever could the former director of the FBI, with all of the domestic intelligence information at his disposal, have meant by such a statement? I leave it to the reader to reach their own conclusion.

Next, I am going to use the words of Judges themselves. Judges have a strange little way of reaching conclusions allegedly using case law and jurisprudence. This effectively means they theoretically use the findings of previous judges to base their decision on the current case. Most of these rulings are reduced to short citations of a single sentence or a paragraph along with the case caption and where it is publicized (When judges do bad things and don't follow the law, they just don't publish their rulings - You see the secret is, Judges just censor from the general public most of the bad, unjust things they do.)

I recently had cause to research various rulings on immunity for Judges and State Governments. And I was astonished and devastated to learn the liberties they had taken and leaps of logic they had used to write the rules in their favor.

Using their own words, the first case I will cite is Wiggins v Hess (1976, CA8 Mo) 531 F2d 920 and Harley v Oliver (1976, CA9 Ark) 539 F2d 1143

"Judicial immunity applies even when judge acts maliciously and corruptly; judge loses his immunity from liability for damages in violation of 42 USCS &1983 ONLY if he acts in clear absence of jurisdiction."...

Minnesota Injustice: True Court Horror Cases - With Names

Minnesota US Federal District Court to Determine if US Constitution is worth the paper it is written on

For the 6th year now, a loose coalition of Minnesota Citizens and groups have asked to present testimony and evidence of corruption in the Minnesota Judiciary to the Minnesota House and Senate Judiciary Committees. This with the intent of then getting the Legislature to pass bills to reform the Minnesota Judiciary.

For 5 of those 6 years, the Democrats held the majority in both houses. This year the Republicans hold the majority in both houses but appear to be engaging in the same old tactics.

The first amendment of the US Constitution Provides:

"Congress shall make no law..... abridging.... Right to Petition the Government for redress of Grievances."

In this litigation I have moved for a Writ of Mandamus ordering the Minnesota Legislature to hear testimony and evidence of Systemic Corruption in the Minnesota Judiciary. (Please read the attached Memorandum of Law to how fundamental this right to petition our government is to any Representative Republic)

The Proposed Order for the Writ and the accompany Memorandum of Law are attached at the end of this article.

Hundreds of your fellow Minnesota Citizens have tried to exercise their Constitutional Right to Petition for Redress of Grievances before the Minnesota House and Judiciary Committees for years. The Chairpersons for these Committees have denied our Right to Petition and acted offended that we have even asked. For years Citizens and groups in this coalition have been cajoled, misled, attacked, demonized and discredited.

I trust that in watching them you garner two facts.

1) The people testifying are normal, credible, next door neighbor, type folks;
2) The people testifying have some very compelling evidence and testimony of Judicial Corruption and Abuse of Power.

Why would your Minnesota Government refuse to honor these folks 1st Amendment Right to Petition the Government for redress of Grievances?

I allege it is because they have something to hide. Refusing to hear evidence of judicial corruption is part and parcel of covering up the ongoing corruption and abuse of power in the Minnesota Judiciary.

Again, review the video tape of the 2009 unofficial Ad hoc Committee meeting on Judicial Corruption. I understand the desire to not want to believe how corrupt our judiciary is, but the facts are before you.

Again, ask yourselves why for 6 years the Minnesota House and Senate Judiciary Committees would refuse to honor our Constitutional Right to Petition for Redress of Grievances? What must they have to hide?

Censorship and Propaganda are some of the tactics of Tyrants in the Minnesota Judiciary and Government.

But that strategy can be challenged in the age of the internet. As I wrote in the previous article, First Principles, People Are Equal Under Natural Law.

As you will recall from that article:

The fundamental understanding our US Founding Fathers had in drafting our constitution, is People under Natural Law have free will, and are not virtuous by nature. Therefore, governments must be constructed in anticipation of the nature of man. Acting on this knowledge, our Founding Fathers built into our Government and Constitution, various checks and balances.

Amongst these checks and balances were transparency and accountability. All of our problems today emanate from the slow, persistent rolling back of the checks and balances, transparency and accountability our Founding Fathers built into our Government and Constitution.

And so with transparency and accountability in mind, I inform my fellow Minnesota Citizens that I have been unable to get the transcripts from the untying matter.

Judge Yunker, at the direction of the Minnesota Judiciary, fixed a case in which I was the Plaintiff so I would recognize only the smallest of financial remuneration, yet my reputation would be destroyed. This was in retaliation for my 20 years of political dissent in trying to expose the corruption in the Minnesota Judiciary. The unaltered Transcripts will show how Judge Mary Yunker colluded with others to fix this case to my detriment.

The allegedly criminally corrupt Judge Mary Yunker refuses to produce the transcripts I have requested.

I call upon the Judge Yunker to produce these transcripts from on or about 12/29/2010 and 01/07/2011.
If Judge Yunker produces the transcripts I will post them here on the internet for all to see.
If Judge Yunker produces the actual transcripts, you the reader will see how judges fix court cases.
If Judge Yunker produces an altered document, we will have yet one more instance of confirmed alteration of transcripts.

So I am calling on Judge Yunker to participate in the process that the Founding Fathers prescribed for combating corruption and guarding against tyranny.

Send me the transcripts so that my fellow Minnesota Citizens can know your true nature.

And if I am lying about your alleged criminal acts Judge Yunker sue me to shut me up.

It is too much to hope that your fellow judges will speak to you about the necessity of you resigning.

And the Corruption is so systemic, that persons and Government Departments charged with overseeing the Minnesota Judiciary, like the Board of Judicial Standards say the Legislature did not give them the authority to deal with Judges fixing Court Cases.

And the FBI directs me to the Board of Judicial Standards, which said Board says the do not have the power. (The Minnesota AG is part of the Problem)

My fellow Minnesotans, does it make any sense that there are no State or Federal agencies charged with investigating allegations of Obstruction of Justice through Court Case Fixing by Judges?

Judge Yunker, please provide the transcripts so the entire state can know your true nature.
If you have nothing to hide, why won't you provide the transcripts.

I can see no way that the Federal Judge can deny the Writ of Mandamus, but most assuredly he will try. 6 years is plenty of notice. But you, my fellow citizens will find out at almost the same time as me, whether the US Minnesota District Court thinks of the US Constitution and Right to Petition the Government for redress as the Cornerstones of our Representative Constitutional Republic or merely instruments of indoctrination and propaganda that can be easily be ignored and discarded by our Government when they find them inconvenient.

In closing, my fellow Minnesota Citizens, let us hope that the weapon of transparency prescribed by the Founding Fathers has the desired effect.

Let us hope hope that the light of day begins to send the cockroaches scurrying for cover.

If I have time, next weekend i will write articles delineating how the Courts fix cases in two case I am away of. I will also write about how any attorney you hire is more loyal to the judge, than he is to you your client and postulate my reasons of why this is so.

1) To ensure that the interests of the Governed and Governed remain the same, and to provide the transparency and accountability the Founding Fathers intended as a check and balance on the power of Government, the Court grants a Writ of Mandamus ordering the entire Minnesota Legislature to hold and attend hearings for the presentation of testimony and evidence of systemic corruption in the Minnesota Judiciary. Said hearings to last up to 5 days (9 hours each day prorated) before the session ends this spring 2011.

3) All of this transparency and accountability being necessary to counteract the nature of man which the Founding Fathers planned for and warned us of.

INTRODUCTION

Plaintiff Don Mashak with his company 1^st National Repossessors, Inc. have brought this complaint which essentially establishes the State of Minnesota and the several other Defendants are engaged in a criminal conspiracy.

For more than 20 years, Plaintiff Mashak has sought Reform in the Minnesota Judiciary resulting from threats of retaliation escalating to death threats (witness tampering) in the wrongful repossession vehicles from 150-200 innocent Minnesota families. (see attached affidavit, exhibits and linked videos)

For more than 5 years now a loose coalition of Minnesota Citizens and organizations have sought to exercise their Constitutional 1^st Amendment Right to Petition the Government for redress of Grievances. (see attached affidavit, exhibits and linked videos)

These grievances being with the Corruption within the Minnesota Judiciary, the Citizens of the State of Minnesota have sought to give evidence and testimony to the House and Senate Judiciary Committees.

Their requests have repeatedly been unconstitutionally denied by the Chair persons of said committees. These chairpersons have cited rules of the Minnesota Legislature which give them absolute control over the agenda of their committees. These rules are unconstitutional in that they clear abridge the 1^st Amendment Right of the People to Petition the Government for redress of grievances. In March 2009, after years of being denied their right to present evidence and testimony of Minnesota Judicial corruption, this loose association of Citizens held an unofficial Ad hoc conference on Judicial Corruption was held. This hearing was held to present evidence and testimony exposing corruption in the Minnesota Judiciary and in support of a bill that was then known as Minnesota Judicial Reform and Accountability Bill HR 1632. What is worse, is that the Minnesota Judiciary has retaliated against Plaintiff Mashak for attempting to exercise his Right to Petition the Government for redress of Grievances.

The Minnesota Judiciary has retaliated by denying Plaintiff Mashak full, fair, unbiased equitable and just adjudication of litigation in which Plaintiff Mashak is a Plaintiff. Plaintiff Mashak has been denied Discovery, Depositions, amended complaints and hearing dates, etc. to address these issues. This is Litigation in State Courts against two former employees who stole property from both Plaintiffs, embezzled money etc while Plaintiff Mashak was out of the Country on vacation. Desperate to avoid prosecution, Defendant Meeks-Hull alleged various baseless allegations of a sexual nature. Plaintiff Mashak took and passed a polygraph test. (see attached affidavit, exhibits and linked videos)

The Court refused to allow Plaintiffs to depose Defendants and hampered Discovery because they knew Defendant Meeks-Hulls allegations were false. However, the Court machinations to frustrate Discovery and evidence were intentional acts in an attempt to demonize and discredit Plaintiff Mashak for daring to exercise his Right to Petition the Government for Redress of Grievances. The Government’s SLAPPS-like (Strategic Lawsuits Against Public Participation) activities are far more egregious that the SLAPPS decried by the courts in Gordon v. Marrone, a 1992 New York case. STANDARD OF REVIEW

On July 4, 1776, our Country’s Founders adopted a famous statement of principles and list of grievances, declaring that:

"In every state of these Oppressions We have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by repeated injury. A Prince, whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free people."

King George III’s crowning wrong, in the end, was his indifference: Those who revolted felt they had no other recourse. In building a new democracy, the Founders avoided the king’s mistake by guaranteeing political receptiveness to public concerns.

In a Representative Republic, public participation is the cornerstone of the system; it is a bedrock principle that connects government to the governed. It legitimizes the system and helps to make government accountable.

The 1^st Amendment of the United States Constitution:

“Congress shall make no law……abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

By virtue of the incorporation doctrine, most provisions of the Bill of Rights now also apply to the state and local governments, by virtue of the due process clause of the Fourteenth Amendment of the Constitution.

Due process is the principle that the government must respect all of the legal rights that are owed to a person according to the law. Due process holds the government subservient to the law of the land protecting individual persons from the state. When a government harms a person without following the exact course of the law it constitutes a due process violation which offends against the rule of law.

Due process has also been frequently interpreted as limiting laws and legal proceedings (see substantive due process), so judges - instead of legislators - may define and guarantee fundamental fairness, justice, and liberty

The Right to Petition the Government for Redress of Grievances was one of the checks and balances the Founding Fathers built into our Constitution and government.

From the Cato Letters Numbers 59-60 approximately:

“man’s freedom is given by God, and that all men are equal in His sight. Men, having been given free will, are not virtuous by nature and, acknowledging their imperfections, create governments so that they may live in safety and harmony together...”

And verbatim:

The only secret therefore in forming a free government, is to make the interests of the governors and of the governed the same, as far as human policy can contrive. Liberty cannot be preserved any other way. Men have long found, from the weakness and depravity of themselves and one another, that most men will act for interest against duty, as often as they dare. So that to engage them to their duty, interest must be linked to the observance of it, and danger to the breach of it. Personal advantages and security, must be the rewards of duty and obedience; and disgrace, torture, and death, the punishment of treachery and corruption.

From the Federalist Papers Number 51:

“If men were angels, no government would be necessary. If angels were to govern men, neither external nor internal controls on government would be necessary. In framing a government which is to be administered by men over men, the great difficulty lies in this: you must first enable the government to control the governed; and in the next place oblige it to control itself. A dependence on the people is, no doubt, the primary control on the government; but experience has taught mankind the necessity of auxiliary precautions.”

The Founding Fathers believed that some of the best means of assuring the interests of the Governors and the Governed remain the same is through checks and balances and transparency and accountability.

Free Speech, Free Press and Freedom of Assembly and the Right to Petition the Government for Redress of Grievances, were among the instruments the Founding Fathers provided the Citizens to ensure and maintain transparency and Accountability.

The intent of the Founding Fathers was to prevent the abuse of WE THE PEOPLE by a tyrannical government that ignored the Constitution and Bill of Rights.

Through transparency and accountability enabled by Free Speech and the Right to Petition the Government for Redress of Grievances, the interests of the Governed and the Governed remain closely aligned. And by these same processes, accountability for corruption and treachery is also enabled and enhanced.

Clearly, the Right to Petition the Government for redress of grievances is not a right that can be ignored nor alienated from WE THE PEOPLE. The Founding Fathers intended for Government to be Transparent and Accountable to counteract the nature of individuals. To deny the Citizens the Right to Petition the Government for Redress of Grievances is diametrically opposed to the Transparency and Accountability the Founding Fathers intended.

Plaintiff Mashak and all Minnesota Citizens who were unconstitutionally denied their right to petition the government for redress of grievances through the offering of evidence and testimony of abuse of power and corruption of the Minnesota Judiciary through the Minnesota House and Senate Judiciary Committees, should immediately be given that opportunity.

ARGUMENT

In United Mine Workers of America v. Illinois State Bar Association (1967), the U.S. Supreme Court exalted the right to Petition as "among the most precious liberties safeguarded by the Bill of Rights" and implicit in "the very idea of government." The Court had earlier affirmed the right to engage in such activity; it thus deemed it a fundamental liberty, protected against encroachment by federal, state and local governments.

The following cases also speak to the importance the Supreme Court places upon the Right to Petition and also, the illegality of retaliating against citizens for lawfully exercising their Right to Petition. Professional Real Estate Investors, Inc. v. Columbia Pictures Industries, Inc., 508 U.S. 49 (1993) McDonald v. Smith, 472 U.S. 479 (1985) | California Motor Transport Co. v. Trucking Unlimited, 404 U.S. 508 (1972) | United Mine Workers v. Pennington, 381 U.S. 657 (1965) | Eastern Railroad Presidents Conference v. Noerr Motor Freight, 365 U.S. 127 (1961) | United States v. Harriss, 347 U.S. 612 (1954) | Hague v. C.I.O., 307 U.S. 496 (1939)

For about 20 years, Plaintiff Mashak has sought to petition the Government for redress of grievances. All of his original requests from 20 years ago were denied. (This original Petition relating to witness tampering and death threats to Plaintiff Mashak from employees of 1^st National Bank of Anoka which subsequently was bought Norwest Bank, NA, involving the wrongful repossession of vehicles from 150-200 innocent Minnesota Families– More about of this will come in later pleadings) And after a couple years, Plaintiff Mashak just gave up trying to be heard. (see attached affidavit, exhibits and linked videos)

About 6 years ago, a group of Minnesota Citizens began requesting that they be able to present evidence of Corruption to the Minnesota House and Senate Judiciary Committees.

The Chairs of these committees refused. They cited the rules of the Minnesota Legislature that gave the Chair persons absolute control of the agenda of their Committees.

Clearly, the Minnesota House and Senate Judiciary Committees were the correct Government bodies to seek Redress of their Grievances with the Minnesota Judiciary.

Clearly, it is unconstitutional for the Minnesota House and Senate to write rules allowing the Judicial Committee Chair-persons to refuse any Minnesota Citizens Right to Petition the Government for Redress of Grievances. This is an unconstitutional abridgement of the Right to Petition. The U.S. Supreme Court has incorporated the petition clause of the First Amendment as part of the 14th Amendment’s guarantees against the states. The petition clause applies equally to state and local governments and protects petitions directed to the judicial, executive and legislative branches.

As we all understand that the intent of the Founding Fathers was to protect WE THE PEOPLE from the Governed through transparency, it is clear on its face that the intent of Legislature in writing the rules abridging the Right to Petition for redress of Grievances was intended to aid, abet and conspire to protect the criminal practices of the Minnesota Judiciary.

Further, it is clear on its face that the act by each House and Senate Judiciary Chairperson to abridge the Right to Petition and prevent the presentation of evidence and testimony of Corruption in the Minnesota Judiciary was again an act to prevent discovery of the criminal activities of the corrupt organization.

Plaintiff Mashak’s life has been destroyed by two separate instances of Minnesota Judicial corruption. As the Right to Petition provides immunity to in SLAPSS actions as in Gordon v. Marrone, a 1992 New York case, Plaintiff Mashak must be granted protection from SLAPPS-style activities by the Government itself.

Having paid the price in full, Plaintiff Mashak seeks to expose the Corruption in the Minnesota Judiciary by Petitioning the Minnesota Legislature for Redress of Grievances. Further, it is necessary to give all other Minnesota Citizens who have been denied the same constitutional right, the opportunity to present testimony and evidence of corruption in the Minnesota Judiciary.

The Minnesota Legislature has intentionally, maliciously and unconstitutionally denied Plaintiff Mashak’s and hundreds, if not thousands, of other State Citizens’ Right to Petition for Redress of Grievances. They did this by writing laws and rules that unconstitutionally abridged the 1^st Amendment Right to Petition for Redress of Grievances.

The Minnesota Legislature has done this in furtherance of a criminal conspiracy which cause the interests of the Governors to be different from the interests of the Governed.

The Minnesota Judiciary has intentionally, maliciously, unlawfully and unconstitutionally retaliated against Plaintiff Mashak for lawfully exercising his Right to Petition the Government for Redress of Grievances. The acts of the Minnesota Judiciary in attempting to “fix” a case in which Plaintiff Mashak began as a Plaintiff, was solely to demonize and discredit Plaintiff Mashak and were intended to further the interests of the criminal conspiracy.

In Closing, our country is on the brink of collapse. Many are confused over the myriad of issues and afflictions compromising our country. Most Citizens are overwhelmed when trying to chart a course back to strength and prosperity.

Plaintiff Mashak is not. The single most effective and quickest way to restore the health and vitality of our Representative Constitutional Republic is to restore the transparency and Accountability our Founding Fathers acknowledged were necessary to prevent Governors from giving into their nature and incorporated into our Constitution and Government at its Founding.

In the Interest of restoring America to its former greatness, this Court must set the tone by reinstating the transparency and accountability the Founding Fathers intended. And its 1^st Order should be to require the entire Minnesota Legislature to hear the petitions for redress of grievances by WE THE PEOPLE in the form of testimony and evidence of systemic corruption in the Minnesota Judiciary.

CONCLUSION

The Right to Petition the Government for redress of grievances is guaranteed by the Constitution and Bill of Rights. The Minnesota Legislature and the Chairpersons of the Respective Judiciary Committees had no authority to abridge the Petitioning the Government for redress of grievances in the form of presenting testimony and evidence. In fact, abridgement of this Right is prohibited by the 1^st Amendment.

To ensure that the interests of the Governed and Governed remain the same, and to provide the transparency and accountability the Founding Fathers intended as a check and balance on the power of Government, this Court must grant a Writ of Mandamus ordering the entire Minnesota Legislature to hold and attend hearings for the presentation of testimony and evidence of systemic corruption in the Minnesota Judiciary. Said hearings to last up to 5 days (9 hours each day prorated) before the session ends this spring 2011.

Further, going forward, the Minnesota House and Senate Judiciary Committees shall be required annually to hold joint hearings for up to 5 days (9 hours per day prorated) to allow citizens to present evidence and testimony of corruption in the Minnesota Judiciary upon the request by any 5 citizens.

All of this transparency and accountability being necessary to counteract the nature of man which the Founding Fathers planned for and warned us of.

More importantly, this air of transparency and accountability shall lead to the revitalization of our State and Country. Such revitalization resulting from a Government’s business being conducted in the light of day.
