<p>	&ldquo;In addition to establishing HUD&rsquo;s responsibilities under the SAFE Act, through this rule, HUD proposes to clarify or interpret certain statutory provisions that pertain to the scope of the SAFE Act licensing requirements, and other requirements that pertain to the implementation, oversight, and enforcement responsibilities of the States. HUD solicits comment on the proposed clarifications and on the regulations proposed to be codified.&quot;</p>
<p>	<strong>History:</strong></p>
<p>	As you may recall, we lobbied hard last year to maintain the right for individuals to make up to five seller financed transactions per year before being subject to mortgage originator licensing, etc&#8230; However, that law was passed subject to the Department of Housing and Urban Development&#39;s (HUD) approval of the law as &quot;compliant&quot; with the intention of the federal law. If any state does not have a compliant law, the SAFE act allows HUD to implement licensing for the state. HUD has since issued proposed rules.</p>
<p>	In a nutshell, seller financing would no longer be allowed for non-owner occupied homes.</p>
<p>	<strong>How YOU can help:</strong></p>
<p style="text-align: justify;">We learned about the publishing of the rules very late in the process&#8230; and the deadline for comment is upon us on February 16. However, we desperately need for thousands of REIA members across the country to go on record with HUD on this issue. We will be working to try to affect this law in other legislative ways, but cannot hope to gain traction unless our members have clearly communicated that they are opposed to this portion of the rules.</p>

<p>	The message should include that you would like the definitions in the proposed rules to be changed so that private individuals can originate and service loans on properties they personally own. Some ideas from others:</p>
<p>	&bull; bank loans are not available on some types of properties</p>
<p>	&bull; the tight lending climate has made bank financing &quot;out of reach&quot; for many</p>
<p>	&bull; seller financing is an &quot;age old&quot; tradition based on private property rights</p>
<p>	&bull; these rules would prohibit even partial seller financing &#8211; i.e. a &quot;seller second&quot;</p>
<p>	&bull; according to HUD&#39;s &quot;Residential Finance Survey&quot; in 2001, roughly 40% of all non-farm residential properties in the US are owned free and clear</p>
<p>	&bull; an estimated 6 million Americans own a property other than their own primary residence</p>
<p>	&bull; an estimated 4.5% of Americans own three or more properties, many purchased solely as investment properties</p>
<p>	&bull; 40% of non-owner occupied residences are mobile homes which are more difficult to sell with bank financing</p>
<p>	&bull; approximately 5% of homes in US are for sale or for lease&#8230; seller financing may be key to liquidating this inventory</p>

			<content:encoded><![CDATA[<p style="text-align: justify;">One of the newest forms of  hype information &#8220;gurus&#8221;  are  pushing is for real estate  investors to use Web 2.0 .  This basically means they want real estate investors to be marketing on social networking websites to connect with prospective clients.   The problem that many of these investors are running into, is that they are not able to effectively generate the leads, or when they do, they are not convert these interested parties into actual clients.</p>
<p style="text-align: justify;"><strong>Yes, Web 2.0 can be used as part of a larger marketing strategy</strong>,  <strong>BUT it is not a &#8220;miracle&#8221; pill!!</strong> Web 2.0 and marketing thereupon still has some inherent factors that you must realize.  Firstly that many people who get involved,  quickly lose interest !!   There are a few things that you should avoid that will give you a much better chance of succeeding using Web 2.0.  Many of these gurus have not even figured out yet!  (It never ceases to amaze me how  small their social networks are as information gurus, yet the  pump you full of their expertise??  Would you not want to follow someone who has &#8220;mastered&#8221; marketing? )</p>
<p style="text-align: justify;">The first thing that you must do is make sure that you commit to a schedule each and every day. You must publish your listings and pictures at the same time every day so that interested parties will know when to look. The problem with releasing this information at random times is that most people have hundreds, if not thousands, on connections on these sites. Therefore, they are receiving an overload of information every day, so they have to filter through this information and pick out the things that they are truly interested in. All it takes is for someone to miss your listings once for that person to move on to someone else, so it is well worth your time to make these posts. Also, make sure that you monitor your company on a consistent basis, as this will allow you to answer any questions that potential clients might have immediately. By actually communicating with people by using Web 2.0, you can bring your services into these peoples&#8217; worlds, which will make you much more accessible for them.</p>
<p style="text-align: justify;">When you are making your daily updates or posts, make sure that you provide value for your followers. If these people feel as though reading what you have to say is a complete waste of time, you will not have a whole lot of success. Even if you do not have many new listings on that particular day, you can still provide these people with information that they can use. You do not have to write a whole lot, but it will be well worth your while to provide these potential clients with some information that can help them going forward.</p>
<p style="text-align: justify;">One statistic to remember is that if you are unable to convert people to visit your site within the first 30-days, these people probably will never become a customer of yours. People who are joining your social networking sites are likely interested in purchasing a home right now. Therefore, they are following you because they believe that you can be of service to them. Once a certain amount of time has elapsed, these people will no longer be interested or will have found someone else to give them a similar service. They will probably get tired of visiting your site as well, since they obviously do not like what you are offering.</p>
<p style="text-align: justify;">The truth about Web 2.0 strategies is that they can work, but you must be committed to making them a useful part of your selling routine. It is not as simple as signing up for an account and inviting people to join, as you must be prepared to convert these people into sales in the same manner you would over the phone. This is not a way to put your business on auto drive, but is rather a method of connecting with your clients in a new and exciting way. By being able to instantly connect with many different people who are interested in what you have to offer, you can definitely increase your chances of success. Make sure that you are active on a daily basis on many different social networking websites, as this is how solid leads are generated online.</p>
<p style="text-align: justify;">Another thing to keep in mind is that Web 2.0 sites should look as professional as possible. You do not want to look like someone who has never used a computer before, so it might pay to have someone help you out with the design. Also, remember that this technology should be used to build up actual leads. When someone shows interest on one of these sites, make sure you follow up in the same way you would a phone call. This is the way that an increasing number of people are expressing their interest in homes and you are selling yourself short if you do not at least follow up. I have seen some companies charge 1,000&#8217;s of dollars saying they have &#8220;created&#8221; miracle money pumping squeeze pages for use with Web 2.0 (or Web 3.0) that provide no such results. The fact is that these companies cannot possibly provide the daily work that needs to be done to generate leads. Honestly, ask yourself, how many leads do you convert into sales from companies such as these companies?</p>
<p style="text-align: justify;">By being able to learn and utilize these sites efficiently will definitely put yourself ahead of the other investors in your city, as many of them have not yet figured out how to use Web 2.0. There is a very good chance that social networking will be the next big boom in advertising, so get involved today, and be at the forefront of this new method of selling homes.</p>

<p style="text-align: justify;">In every economy, in every industry, there will always be winners and losers.  Some will analyze their proficiencies and aptitudes so as to select a career or venture that suits them and their tendencies, put in the effort, get the education, and use the resources at their disposal.  They will learn from others&#8217; mistakes rather than making them all on their own and be willing to accept the help and guidance from those who are already successful in their field.  They will embrace the fact that the greatest riches often require the most dedication, and they will pursue their dreams and goals relentlessly.  They will feel assured in their success because they have taken control of their success.  Their efforts, their education, and their expertise will be what propel them to become what they set out to be.</p>

<p style="text-align: justify;">In the midst of the current real-estate debacle, there will be many of these winners.  Unfortunately there have been, and will continue to be, those who do not prosper.  Aside from the individuals who are victims of the market crash, there are those seeking to profit from the market downturn who will undoubtedly fail.  They see the potential for making what they perceive to be easy money and decide to start their own real estate investing business.  Unfortunately, most of these individuals have not assessed their aptitudes, have not gotten the proper training or education, are not willing to do the hard work that is actually required, and are not prepared to make use of the many resources they have at their disposal.  They expect quick, easy money, and a lot of it, with minimal effort invested.</p>
<p style="text-align: justify;">Instead of realizing that hard work may in fact be required, that some planning and education would help them achieve their goals, they look for yet another quick fix.  This is where new real estate investing management software comes in.  In response to people&#8217;s desire to make quick money in real estate without the research and marketing required, some savvy business men and software developers have created a program that claims to take the work out of real estate investing.  The claims made are enough to tantalize even the savviest investor-  that somehow a set of software will do all the work for you and all you&#8217;ll have to do is sit back and watch the money come rolling in.</p>
<p style="text-align: justify;">Upon more careful analysis, however, the various claims made seem less and less believable.  The most glaring of these unsupported claims, the very selling point of the entire system, is that human knowledge and ability is imperfect, so therefore a machine that takes the human element out of the process of real estate investing is the answer to every prospective investor&#8217;s difficulties.  Unfortunately, what they do not acknowledge is that the computer software itself was created by humans.  If human knowledge and ability is so fundamentally flawed, how can a software program created by humans remove the human element from the real estate investment process?  The answer is: it can&#8217;t.</p>
<p style="text-align: justify;">The only thing a software system like this really does is attempt to remove <em>your </em>human element and replace it with the human element of whoever created the software.  Any real businessperson or entrepreneur serious about being successful would do well to put faith in him or herself, in his or her ability to make good decisions, in the effort and marketing that he or she is willing to do, rather than allowing a software program, created by some other person with other motivators, who may work in a different market, catering to a different demographic, make those decisions for them.  If the assumption that a person does not want to be in control his or her own business is true, then perhaps a system like this would be useful, but for those confident in their own abilities, with the intent to create and manage their own wealth, real estate software like this is far to invasive and controlling.</p>
<p style="text-align: justify;">Certainly there is another appeal to this sort of system- if it works, the investor gets to enjoy a lot of easy money, and if it doesn&#8217;t, he or she can blame the system, thereby avoiding taking personal responsibility for the results.  But someone who is willing to do the work, with the right education and the right research, will trust no one as much as he trusts himself.  A disorganized, inexperience person looking to make a quick buck might make more using this type of program or software than he would on his own because of his lack of training, education, and experience.  But, a person with training, education and experience who is hardworking and organized doesn&#8217;t need a computer or internet system to take over his business.  He or she just needs to work the market.</p>
<p style="text-align: justify;">Having an electronic program do everything for you in an automated manner may seem like it saves you time, but it also takes your expertise, preferences, and instinct out of the equation.  A system like the one advertised is like a proficient administrative assistant at best, and at worst, it can be compared to a micro-managing supervisor.  Most people capable of making their own fortunes and paving their own futures appreciate the freedom to make their own decisions- that&#8217;s why they chose to leave the standard work-force to begin with.  Having a software system take the work out of your work also takes away the freedom that is so coveted.</p>
<p style="text-align: justify;">When it comes to real estate investing, there is no substitute for hard work and good research.  A person serious about real success will be willing to market, make offers, create a monthly and yearly plan, and stick to it.  Trusting the strategy of a single individual or group of people who developed a software system is no way to ensure that the success of your business, in your market, with your particular demographic.</p>
