Topic: Medications with Sexual Side Effects

Medications and Medical Conditions
with Sexual Side Effects :

The intent here is NOT to attempt to justify sex crimes as being caused by a medication or medical condition, but to identify medications and medical conditions with sexual side effects. i.e., Hypersexuality

(Hypersexuality is one of the things that can ruin a bipolar person's marriage or committed relationship. In these days where sexually transmitted diseases can kill, unrestrained hypersexuality can also be deadly. Not every person who has bipolar disorder experiences this, but for those who do, it may be a serious problem. Finding the right combination of bipolar medications to control mania is an essential step toward keeping hypersexuality from becoming destructive.)

Hopefully lawyers will do their homework when they have clients charged with sex crimes and see if there is or isn't a medication or medical condition that may relate to the crime their client is charged with, and explore its relation before pleading a case out.

In closing, the more I research these issues the more I see that, the law needs to look beyond criminal intent before criminally punishing a person for actions, some of which may be normal such as a Romeo & Juliet case, there may be other ways beyond punishment more helpful to society and the people involved. Just me thinking out loud...

Another comment on this: When I was a "patient sitter" in a hospital some years ago, I discovered that brain-injured or delirious men can be sexually inappropriate--I had to call for help when one left his room and tried to get into bed with the patient in the next room (but that might not have been sexual--just disorientaton); a couple made sexual suggestions to me, which didn't bother me because I knew they were not responsible and since they were bedridden I was certainly in no danger; one tried to get me to masturbate him (I moved my chair so I was out of reach), and one called me his "sweet fat little pig," and I have no idea whether he was referring to a prostitute or a barbeque. He, and at least one of the others, were perfect gentlemen once their critical medical conditions came under control. Our daughter, who worked in a nursing home, has similar stories.

Also, I understand that when Washington State passed a law to put sex offenders in a separate nursing facility, and then could not get anyone to bid on providing such, the rape case they used as rationale for the law was perpetrated by a 90-year-old who was NOT a registered offender and died before any legal action could be taken. Keeping registered offenders out of nursing homes won't keep other patients from behaving in the way ill or demented persons do sometimes behave. Every nursing home should have protocols for dealing with such patients and staff trained to prevent problems, and I suspect that most do.

Medicines and Medical Conditions That Sometimes Result in Sexual Behavior.

Discussion:

OK, so that there is no misunderstanding, what is discussed here should not be considered the cause/s of all sexual behavior, instead, what has been known and documented to have sometimes result in sexual behavior. Also, "sexual behavior" does not necessarily mean violations of law.

What we are hoping is that defense lawyers (or defendants who should remind lawyers) will give consideration of what is shown here as possible defenses to charges of sex crimes, not to negate the conduct but to bring understanding to the court and mitigate punishment.

ARTICLE-1: Emotions high during Misty Smith sentencing 1-24-2012 Vermont

Female sex offender faces uncertain future

ST ALBANS – Crying quietly, Misty Smith often took sips of water from her Styrofoam cup and grabbed at tissues as she sat before Judge Robert Mello at Franklin County District Court Monday morning.

To her right was defense attorney Betsy Hibbitts, to her left, investigator Jean Heyer.

Deputy State’s Attorney Diane Wheeler was joined by Cathy St. John of probation and parole, who had written the pre-sentence investigation report (PSI).

There were concerns surrounding sentencing for the female sex offender – who pleaded guilty in August to two counts of sexual assault and two of unlawful restraint.

Would she receive a straightforward three years to life sentence or a sentence to serve three years with the rest on probation? It seemed likely that either way, her time already served would be counted. Smith has been incarcerated for the 14 months since her Nov. 2010 arrest.

To help Judge Mello make his decision, the opposing attorneys called on witnesses to provide information about Smith, her condition, and the case.

St. John took the stand to explain that in preparation of the PSI, she had spoken with Smith and her victims (two pre-teen boys who were friends of Smith’s son); the young victim’s families, and others. Also taken into account was a report from psychiatrist William Nash.

St. John said prison time would give Smith the opportunity to receive one-on-one sex offender treatment. She could also participate in a self-direction program to help with self-esteem issues and other personal problems.

The Department of Corrections did not agree with Hibbitts’ request for a split sentence. It argued that it would be harder to supervise Smith on probation rather than on furlough release, which would be the outcome of a straight sentence.

St. John said that studies had shown Smith was at a 78 percent chance of reoffending.

It was made clear in court yesterday that while elements beyond Smith’s control may have shaped her life, the nature of her crimes were serious.

Smith was arrested Nov. 9, 2010 after the parents of her young son’s two friends – each 11 years old at the time – did not return home after going to Smith’s residence to play video games. When questioned by a worried mother, Smith said the boys were not there.

But they were.

Smith had, according to court documents, locked the young boys in her son’s room.

They had used a card to jimmy a locking device, and they were found when St. Albans Police later went looking for them.

It was alleged that on various occasions for about a month or two, Smith had supplied the boys with marijuana and pills. Court papers explained that she bound their hands with duct tape and had sexual contact, short of intercourse with them.

It was also alleged that she had taken inappropriate photos of herself with one of the boy’s camera, and had touched the boys inappropriately beneath a blanket.

Smith’s husband was in the home, but not in the same room when these acts occurred, said police.

Smith attempted suicide by ingesting pills after police rescued the boys.

Smith has a prior charge of aggravated assault, as a result of which her child’s leg was broken.

A victim herself

Testimony during Tuesday’s sentencing showed that Smith had been a victim herself, and that she was found to have severe mental deficiencies. More specifically it was reported that she had been involved in abusive relationships, suffers from fetal alcohol syndrome and is borderline mentally retarded.

Psychiatrist Nash took the stand as a witness for the defense.

He said that Smith’s symptoms – problems in school, issues with the law, inappropriate sexual behavior, and employment problems – are consistent with fetal alcohol syndrome, which often causes sufferers to be confused and lack understanding of social norms.

Nash said Smith is a woman who never had a chance; her brain damage occurred in the first trimester of her development.

Smith’s father, Paul Talley, took the stand to provide further background on Smith’s life. He believed fetal alcohol syndrome was a reasonable explanation for his daughter’s deficiencies, and said that his ex-wife had kept his daughter from him during her childhood.

Talley also stated he would be willing to act as a legal guardian for Smith, something he had done in the past, to keep track of her finances and life decisions.

The defense and prosecution agreed that society had failed Smith in dealing with shortcomings.

“That’s the tragedy of the situation,” said Nash, who likened the situation to closing the barn door after the horse has left.

Still, the victims in the case had to be considered.

Those victims’ mothers were present and spoke to the judge as well, with victim advocate Kelly Woodward at their side for support.

Catherine (whose last name is withheld to protect her son), said she wanted Smith to get the help and structure she needs, but serving time was needed as well.

“I want what she did to my son to mean more,” she said, her voice shaking with emotion.

Christina, the second victim’s mother, said she couldn’t believe someone she had known could do this to her son.

“I want closure,” she said.

Hibbitts argued that a straight sentence was not the way to go, because the mentally impaired Smith would have to meet certain requirements to be eligible for furlough and parole. That would be difficult simply because of Smith’s deficiencies, Hibbitts claimed.

“We’re taking a person who is very, very vulnerable, who has mental retardation and we’re subjecting them to the possibility of a life imprisonment for not being able to meet criteria that’s being evaluated by the Department of Corrections,” she said.

Prosecutor Diane Wheeler did not share that opinion.

Focus on victims

“The state’s position is that the crimes she committed on two young boys who were her son’s friends, call for the most intense supervision,” Wheeler said the number of times she assaulted them and their ages warranted a to-serve sentence requiring the provisions of furlough rather than probation alone.

Wheeler said Smith needed structure and supervision as offered by the Department of Corrections through furlough.

“The state is also looking at the impact that this has had on the children,” Wheeler said. A life sentence was sought, she continued, “because these were little guys.”

In the end Mello agreed with the state. He explained his position in great detail, going over the criteria considered in determining Smith’s fate.

The serious nature of the crime involving sexual contact between Smith and two minor boys, as well as the fact that drugs were involved, played a role in his decision, he explained.

Mello also considered Smith’s personal history, but determined that she presented a serious risk to the community and had a high likelihood of reoffending. Mello said she needed significant structure and treatment for the rest of her life.

“The court thinks that the two victims came closest to articulating what is needed here,” Mello said. “What Ms. Smith needs is a structure that she’s never had in her life. They don’t want to see her spend her life in jail, but they realize in order for her to succeed, which they want her to do, she’s going to need very strict supervision; as much supervision as possible.”

In total Smith received three years to life for the two sexual assault charges and three to five years for each count of unlawful restraint.

Prior to any potential for release, Smith must serve the additional 18 months of the minimum sentence and then the requirements necessary for her to obtain furlough.

A restitution hearing is scheduled for Feb. 1 to discuss the defendant repairing financial harm done to the victims, specifically copays for the victims’ counseling.

Wasteful Costs Related to Charges of
Failure to Comply with a Registry Law -OR- Failure to Register

The graphic above shows, pictorially, examples of things that are happening in the world of sex offender laws, in states shown, and very likely others! Are "Failure to Register," "Failure to update information" and "Other registry technical violations" synonymous? If so, are the penalties for violating them reasonable or wasteful, or worse a manifest injustice?

High MICHIGAN Registry & Prison Costs Caused By:
Improper Handling of Deceased Persons' Registry Records /
Improper Inclusion of Incarcerated Persons' Records /
Questionably Reported Statistics /
Insane Criminal Charge for Failure (Forgetting) to SIGN a Form:

Number of people on the registry: Deceased Individuals: "individuals who are deceased are removed from the PSOR following the submission of a death certificate." Sounds logical? What happens when someone lives alone and has no family? Its hard to expect a dead person to submit a death certificate or even obtain one! They stay on the registry which bloats the registry. Are other states like this?

Sex offenders who are incarcerated: Here is something which is hard to see. anyone convicted of a sex offense who has been incarcerated, is automatically listed on the registry, and through an option, the general public can see who these folks are. They are not in the public so why put them on the registry? Your guess is as good as mine. Now there is a cost to maintain these records? Yup, and folks in prison might be there for 5-10-20-30 years before being released. While I do not know what the cost of maintaining a registry record is, lets say $.01 per day, $3.65 per year, $36.50 for 10 years and so on, get the picture? BTW: The costs for prison are shown below.

Fail to sign a form: Look closely at the pic below, a mere "Fail to sign a registration, notification, or verification form," makes some subject to arrest. Is the registrant guilty of anything? When someone registers or verifies their information, it is in front of a Registering Official. Wouldn't you think it mandatory that such official check what is being submitted AT THAT MOMENT? No, they wait till the registrant leaves then charges him/her with a crime. Justice or Entrapment?

Costs attached to above examples:Above are two examples, do you think there are costs attached to these? Yup, registry maintenance costs (The US Dep't of Justice issues grants annually for such costs) and Michigan also charges registrants a one time fee of $50.00 (Up from $35.00 in 2011) for maintaining the registry system. Profiteering? Your guess is as good as mine.

Now lets see what the public pays through their taxes, arrest someone, and there is the cost of jail, prosecution, and if the person goes to prison, that cost as well.

In 2008: It estimated states spent a record $51.7 billion on corrections in fiscal year 2008 and incarcerating one inmate cost them, on average, $29,000 a year. But the average annual cost of managing an offender through probation was $1,250 and through parole $2,750.

Note: Just released in 2012 by the Vera Institute "The Price of Prisons: What Incarceration Costs Taxpayers." Using the by state option, look at Michigan's costs; is it really worth that for Failure to Sign a Form which the State official should have caught?

Is it worth this to taxpayers for someone who forgot to sign a form? Only a idiot would say yes, but we have idiots in high places whose only goal is self-serving, make me (Lawmaker) look good!

BTW: Given many on the registry, and many do not have jobs because they have been legislatively prohibited from working, who do you think pays these bills? Right, the public. So when you hear that politician claiming s/he is going to protect the public with some new law, start asking questions? Or do not vote for them!

Troop leaders keep eye on scouts after sex offender spotted mingling among them 1-21-2012 North Carolina:

SNOW HILL — Troop leaders in Greene County are keeping a watchful eye on their Girl Scouts after a registered child sex offender was spotted mingling amongst the young explorers last week during a celebration to kick off the 2012 cookie season.

Christopher Adams Czyzewski, 31, “watched” and then “interacted” with Girl Scouts from as many as four troops in Greene County for at least 30 minutes while attending the campaign opener held at the Greene Ridge Racquet Club with his daughter, said Jessica Byrd, a Girl Scout parent and assistant troop leader. “It is frightening to think a sex offender was around my child,” Byrd said.

Czyzewski, of 300 Davis Grove Church Road, Snow Hill, turned himself in at the Greene County Sheriff’s Office Jan. 14 at 12:55 p.m. upon hearing Maj. Doug Stocks had taken out a warrant against him for a felony charge of a sex offender on child premises. Detective Bryant Obriant served Czyzewski and placed him in Greene County Jail under a $5,000 secured bond. Czyzewski, who has since made bail, is set to make his first appearance in Greene County District Court Feb. 10.

The father, listed as a sex offender until June 1, 2019, by the state Department of Justice, was initially reported for violating the terms of the registry on Jan. 11, when a parent spotted him making a drop-off and pickup at a Girl Scout Troop 153 event, Obriant said. “He cooperated fully during the arrest,” Obriant said. “In his opinion, he said he did nothing wrong but to take his girl to her scout meeting.”

Byrd said there was more to the incident. She said Czyzewski came to the party with his wife and daughter and stayed for 10 minutes, until one of the mothers attempted to snap a picture of him with her cell phone. Byrd said Czyzewski covered his face and left, but returned 30 minutes later and stayed for a half hour, first watching the girls and then later interacting amongst them.

The Child Abuse Prevention and Treatment Act (CAPTA) DENIES States Funding if they promote reunification of a child with a registered sex offender parent. Another federal law tucked into the Adam Walsh Act that effects some families of registered former sex offenders. Click to read more about it!

California RSOL will lobby state legislators in Sacramento on January 17 and 18 in support of Assembly Bill (AB) 625 that would create a tiered registry, similar to those found in 46 states, for registrants. The bill is expected to be voted upon by the Assembly this month and must be passed no later than January 31.

During the lobbying effort, volunteers and Board members will educate lawmakers and their staff regarding "sex offender" issues such as low recidivism rates, residency restrictions and the Myth of Stranger Danger.

In addition, California RSOL will make a formal presentation to the California Sex Offender Management Board on January 19. During that presentation, the organization will request the Board to study and report on issues such as vigilante violence and inaccurate profiles on the Megan's Law website. Technical Question: Related to FEES for Sex Offender Registration in ANY state

I've been thinking quite a bit about registration fees because its the start of a new year and registrants are bringing up the topic again. This post will be updated as folks provide input.

My Ques. for everyone:
Excepting State and Federal tax systems which are for the general good and everyone derives some benefit from, and birth or death certificate systems, can anyone think of other governmental systems that a person is FORCED to be part of without asking to be part of (committing a crime is equivalent to asking and related fees excepted), and derives nothing from the system, but are FORCED to pay a fee or other charge for, or to be included in, the system?

Generally one gets something out of a governmental system but first chooses to join, but I cannot find anything equivalent to sex offender registration system and its fees (in some state and city localities), which is why I'm asking if folks can think of something. My mind needs tweaking.

Note: As to any criminal conviction, the person and the State part ways (finality of sentence) when the sentence ends. Therefore anything after that point is not a consequence of the person's actions. We are studying the period after the sentence.

Appreciate any thoughts folks may have.

POSSIBLE EQUIVALENT SYSTEMS:

GPS Fees: If GPS was ordered or part of the law under which the person was sentenced, then these fees are excluded. However, there have been some states that have retroactively applied GPS laws, including their fees, and that may be a system likened to sex offender registration system fees.

DNA Processing Fees: If a person is convicted of a crime DNA processing fees are a likely charge, and possibly assessed, so would be excluded. However, some states have retroactively applied DNA laws, including their processing fees, and that may be a system likened to sex offender registration system fees. Secondly is the issue of requiring DNA samples on arrest, but I haven't yet seen any case of charging fees for that.

DUPLICATE PROCESSING FEES: This was raised and there is value to explore it as a system. Not sure where to take this from here though, any thoughts are helpful.

OTHER SYSTEMS FOLKS HAVE MENTIONED:

Parole and Probation Fees: and fees directly a result of the crime or as part of the sentence would be excluded because these are all a direct result of the person's actions. But, when the sentence ends, so should these fees.

Social Security: As I recall this would fall under a Tax and taxes are a exception since everyone qualifies for a benefit down the road.

Medicare: The person must sign up therefore chooses to participate, so it does not qualify.

Medicaid: While it is a government system and paid for out of general taxes. I have not heard that anyone using it is paying fees for using it, and again if used it is by choice of the person.

Vehicle Registration Fees: No one is FORCED to own a car, therefore these fees are by choice of the person registering car.

Driver's License: The person does not have to drive, s/he makes a choice to drive, therefore these are excluded.

Voting: Requirement to have an ID which one must pay for first. (likely this does not qualify because one is not FORCED to vote, even though they should).

ObamaCare: This is close, but since the person can derive a benefit from it, should they need it, would push this outside of the "does not derive a benefit from it" requirement like sex offender registration.

ME THINKING OUT LOUD:
Normally everyone, including sex offender registrants, pay taxes, federal and state, and that money is used to pay for the operation of anything resulting from an enactment of law. i.e,. Taxpayer money pays for systems that keep everyone safe (Police and likewise things). Given the truth of that, then charging sex offender registrants, through a registration fee, to maintain a system that taxpayers (including the registrant) already pay for, is an unjust enrichment of the state. This should be prohibitive.
