Government Surveillance Crackdown On Internet Goes Into Overdrive

Cyber bills legislate for mass surveillance; Former Cybersecurity Czar calls for Homeland Security data “customs inspections”

In a New York Times editorial, former government cybersecurity czar Richard A. Clarke has called for the creation of customs checks on all data leaving and entering US cyberspace.

Clarke makes the call in relation to Chinese hackers stealing information and intellectual property from US firms.

“If given the proper authorization, the United States government could stop files in the process of being stolen from getting to the Chinese hackers.” Clarke writes.

“If government agencies were authorized to create a major program to grab stolen data leaving the country, they could drastically reduce today’s wholesale theft of American corporate secrets.”

While Clarke may well be coming at this subject well intentioned, the fact that government has a long history of attempting to crackdown on internet freedom and control the web will mean his words are a cause of concern for many.

“Under Customs authority, the Department of Homeland Security could inspect what enters and exits the United States in cyberspace…” Clarke continues.

“And under the Intelligence Act, the president could issue a finding that would authorize agencies to scan Internet traffic outside the United States and seize sensitive files stolen from within our borders.”

We have seen with the recent attempts to pass legislation such as SOPA, PIPA, and ACTA, that the federal government is hell bent on skirting around legal oversight in order to seize more control over web content and communications.

While those particular bills have more of a focus on copyright protection, there is a huge move afoot to use the issue of cybersecurity as a means to crack down on the free internet.

The Obama administration is going all out to muster support in Congress for a bipartisan cybersecurity bill co-sponsored by Republican Senator Susan Collins and Independent Senator Joseph Lieberman and Democratic Senators Jay Rockefeller and Dianne Feinstein.

Critics contend that the bill contains several provisions that represent a sweeping power grab on behalf of the federal government.

A measure recently added to the bill by Collins and Lieberman, and supported by Obama, would empower the Department of Homeland Security to conduct “risk assessments” of private companies in sectors deemed critical to U.S. national and economic security, forcing them to comply with expensive mandates to secure their systems.

ISPs AT&T and Comcast have denounced the provision, declaring that federal oversight will stifle innovation.

“Such requirements could have an unintended stifling effect on making real cybersecurity improvements,” Edward Amoroso, chief security officer for Dallas-based AT&T, said in testimony at a recent hearing. “Cyber adversaries are dynamic and increasingly sophisticated, and do not operate under a laboriously defined set of rules or processes.”

As we have previously reported, the bill originally legislated for an Internet ‘kill switch’ that would allow the President to shut down parts of the Internet in an emergency.

There are a whole host of other cybersecurity bills in the works including a GOP bill, co-sponsored by John McCain known as The Secure IT Act, and a newly introduced GOP bill known as The Cyber Intelligence Sharing and Protection Act (CISPA), sponsored by Michigan Republican Mike Rogers.

All of the bills have the same vague wording and do not clearly define what a cybersecurity threat is. This has prompted groups such as The Electronic Freedom Foundation and The Center for Democracy and Technology to speak out about what they see as legislating for broad information sharing between private companies and the government for ill-defined purposes.

“The Rogers bill gives companies a free pass to monitor and collect communications and share that data with the government and other companies, so long as they do so for ‘cybersecurity purposes,’” the EFF said in a blog post. “Just invoking ‘cybersecurity threats’ is enough to grant companies immunity from nearly all civil and criminal liability, effectively creating an exemption from all existing law.”

Kendall Burman of the Center for Democracy and Technology spoke about CISPA in an interview with RT:

“We have a number of concerns with something like this bill that creates sort of a vast hole in the privacy law to allow government to receive these kinds of information.”

Burman added that the bill, as it stands, allows the U.S. government to involve itself in any online correspondence if it believes there is reason to suspect “cyber crime”, which it does not even clearly define.

Both the EFF and the CDT have noted that CISPA effectively legislates for monitoring and collecting online communications without the knowledge of the parties concerned and funneling them directly to the National Security Agency or the DOD’s Cybercommand.

Essentially all of these bills legislate for moves by the federal government to access and monitor the online communications of all Americans, much like the more open agenda of the British government to snoop on citizens.

With the additional ongoing construction of a city sized secret NSA data collection center in the Utah desert, about which the agency will not even give details to Congress about, it is clear that the powers that be fully expect to go ahead with such plans, with or without the legislation to do so.

An onrush of condemnation and criticism kept the SOPA and PIPA acts from passing earlier this year, but US lawmakers have already authored another authoritarian bill that could give them free reign to creep the Web in the name of cybersecurity. A piece of legislation dubbed the Cyber Intelligence Sharing and Protection Act (or CISPA for short), has been created under the guise of being a necessary implement in America's war against cyberattacks. Kendall Burman of the Center for Democracy and Technology tells RT that Congress is currently considering a number of cybersecurity bills that could eventually be voted into law, but for the group that largely advocates an open Internet, she warns that provisions within CISPA are reason to worry over what the realities could be if it ends up on the desk of President Barack Obama.

Police in riot gear clashed violently with protesters at the end of the anti-NATO summit on Sunday

The clash occurred at 22nd Street and Michigan Avenue.

Police Supt. Garry McCarthy was seen right in the middle of the fray directing his officers.

Police were yelling at the crowd to move back as some of the protesters threw object at the line.

There were a few intense moments has protesters clad in black began shoving. Police responded by striking them with clubs.

Police Supt. Garry McCarthy said Sunday that a group of out-of-town protesters attacked a police van while hundreds of protesters were wandering around downtown Chicago for about 10 hours.

Around 9:30 p.m., while protesters were marching along Jackson Boulevard in the Loop, a police van was trying to push its way through the crowd. Several protesters standing in front of the van tried to push it back, but the van continued going and drove several feet as a number of protesters clung to the front of the vehicle.

McCarthy said Sunday the incident started when several protesters from New York attacked the van, which had only one officer in the cab. McCarthy said that officer suffered a concussion after he was punched through the window. The tires on the van were also slashed, and McCarthy said the officer drove the truck through the crowd to get to safety.

TSA Toddler Terror: Family Marched Off Plane; 18-Month-Old On No Fly List

TSA agents at Fort Lauderdale Airport ordered a family to get off a plane they had already boarded, saying that their eighteen-month-old child was on a no fly list as a terror suspect.

The child’s parents said they believe they were flagged up and ordered to leave the JetBlue flight because they and their daughter are of Middle Eastern descent.

“It’s absurd. It made no sense. Why would an 18-month-old child be on a no-fly list?” the girl’s father told ABC affiliate WPBF News.

The parents, who wish to remain anonymous, are both US citizens, born and raised in New Jersey, which is where they were headed before being ejected.

The family said that after they were “humiliated, embarrassed and picked on” they were marched off the plane, and ordered to stand in the terminal for half an hour by TSA agents.

“We were put on display like a circus act because my wife wears a hijab.” the father said, referring to his wife’s traditional head scarf.

The TSA agents then eventually said that the family could re-board the flight without offering further explanation as to what had occurred. The family declined the offer and left the airport, saying they felt too ashamed to get back on the plane after the incident.

The parents say that even though they are US born citizens, they now fear that if their identities were revealed, their safety could be threatened because they have been associated with terrorists by the TSA. They plan to contact an attorney and possibly pursue legal action.

When WPBF contacted JetBlue for an explanation they were told that it was a TSA issue. However, when the TSA were contacted they said they were not investigating the incident and that it was the airline’s responsibility.

The secret government “no fly list” of suspected “terrorists” who are banned from flying to or within the United States more than doubled in 2011.

The figures, revealed three months ago, highlighted the fact that the list now contains around 21,000 names, close to 11,000 more than it did just one year ago.

The exponential growth in names added to the list is said to have been sparked by the failed underpants bombing incident on Christmas Eve 2009.
An anonymous U.S. counterterrorism official told the AP that after the 2009 incident, a new standard was set meaning someone no longer has to be considered a threat only to aviation to be placed on the no-fly list. People who are considered a broader threat to domestic or international security can also be added, the official stated.
The government has refused to reveal details of who is on the list and the reason they have been flagged.
“The news that the list is growing tells us that more people’s rights are being violated,” said Nusrat Choudhury, a staff attorney working for the ACLU’s national security project. “It’s a secret list, and the government puts people on it without any explanation. Citizens have been stranded abroad.”
In lawsuit against the government, the ACLU is representing American citizens who believe they have been put on the no fly list without explanation. Currently, those who submit a letter to Homeland Security asking to be removed from the list have no way of knowing if their request has been reviewed without attempting to board another flight, according to the ACLU.
The ACLU also contends that huge numbers of Americans are opposed to the measures employed by the DHS and the TSA in the nations airports and train stations, but that many have not registered official complaints for fear of being placed on the watch list.
The no-fly list and the CAPS II system used by airlines pales in comparison to the separate government master “terrorist watch list” that reportedly now has over one million names on it.
Reports have confirmed that the watch list contains the names of thousands of innocent Americans, including children, lawyers and even a retired Air National Guard brigadier, now a commercial pilot for a major airline.
In some cases credit reports have been used in calculating the risk score, while the list has also been used to target political activists opposing the death penalty and the Iraq war. Some, including former White House Chief of Staff, Rahm Emanuel have suggested restricting the constitutional rights of those placed on the list.
We have previously highlighted the fact that a miniscule amount, less than 0.01% of Homeland Security cases are terrorism related.
Once again we are reminded that the terrorist threat to America is vastly over hyped and is being used by a criminally controlled government as an excuse to police the world and foment a domestic police state to crush any dissent amongst the American people.
The watch list represents a subversion of the first and fourth amendments, is inherently flawed and, it can be argued, is harmful to the security of the nation.
The chairman of a House technology oversight subcommittee warned in 2008 that the database used to produce the government’s terror watch lists is “crippled by technical flaws,” and the system that eventually replaced it may be even worse.
In a letter to the inspector general at the Office of the Director of National Intelligence, Rep. Brad Miller (D-NC) warned that the upgrade “if actually deployed will leave our country more vulnerable than the existing yet flawed system in operation today.”
Despite this and the fact that it is already far too expansive to be in any way effective, there have been calls to apply the watch list to Amtrak trains as well as checkpoints at subways, malls and sports stadiums.
As we have consistently highlighted, restricting the movement of more innocent Americans and implementing more draconian police state measures will do nothing to increase security and serves only to foster a constant state of fear and unease.
