Elemental Discourse Episode 11: An Interview With Carl Olsen

Carl Olsen, founder and Executive Director for Iowans for Medical Marijuana joining us to elevate discourse concerning legal issues surrounding Iowa’s new medical cannabis program. Carl is currently in court against the state of Iowa and is preparing and filing a case at the federal level against the DEA as well. Carl has decades of experience count filing cases and has been to the US Supreme Court multiple times and it was a pleasure to have him on the show. Jackson Lebedun interviews Carl here, make sure to tune in later as we plan on updating and going into more detail by having Carl back to talk some more once Carl’s briefs are filed in federal court, hopefully by end of 2018.

Carl’s lawsuit for religious equal protection against Iowa has a new trial brief filed 12-14-2018. Read his brief at the following PDF link or at the link on his site at the bottom of this post:

05771__CVCV056841_BRIF_6502853(1)Download

Run time: 42 minutes

Highlights:

1′ What got Carl interested in marijuana and activism decades ago

3′ Lawsuits Carl was involved in, Carl gives a history starting in 1976 with the incorporation of a marijuana-based church

5′ Carl’s church on 60 Minutes with Dan Rather doing an hour special
in 1979; Carl goes to prison 1984; prior to prison, filed DEA petition;
managed law library while serving time

6′ Carl leaves prison in 1968, gets paralegal degree at DMACC, gets hired by Polk County Legal Society as paralegal

7′ Religious freedom lawsuit against Iowa 1987; law firm appointed at
either taxpayer expense or pro bono; Hogan and Harlsen law firm, Chief
Justice John Roberts

10′ Federal research program lawsuit by Bob Randall kicks off federal
exemptions for cannabis use nationwide (Carl worked with Bob); legal
religious exemption for psychedelic substance rituals by Native American
tribes actually predated drug prohibition laws

12′ Why Carl stopped smoking pot; Carl files 2008 Iowa Board of
Pharmacy petition over schedule I; history of Iowa’s Schedule I issues

17′ Carl says Iowa marijuana companies have only 633 customers and
the power brokers all know the program here in Iowa will change because
this is a capitalist system and money matters

19′ Carl sues Iowa BOP again in 2018 for a religious exemption to
marijuana laws, currently ongoing, not a simple argument. Judge has
ruled Carl has a valid argument over the objections of the state’s legal
counsel and expects the Iowa Supreme Court to give this argument a lot
of scrutiny after trial which is scheduled for February.

21′ This lawsuit continued, seeks equal access to the medical extract
provided by MedPharm and John Boehner’s company but for religious use
instead of medical or recreational. Access to whole plant access is also
demanded as a civil right in Carl’s upcoming argument

22′ Carl briefly goes over the restrictions that are legally put on
Iowa marijuana card holders during driving or at school and work

25′ Current issues and criticisms of Iowa’s current marijuana industry

26′ “The Bible says it’s good to be addicted to good things,” says Carl

27′ Aaron Schoeneman, medical marijuana patient applicant in
Illinois, has to sign up for medical program there by being forced to
admit to federal law issues

30′ Iowa Code Chapter 124; International Drug Treaties; FAA Regulation 14 CFR 91.19 all say they are exempt

31′ We will hopefully have the lawsuit in Iowa against DEA filed so
everyone can read the argument by the end of the year. “If we don’t
have it by the end of the year I’m going to be really disappointed,”
says Carl, “I think we’ll have it by the end of the year.”

32′ State case filing this upcoming Friday

33′ Somehow the Iowa Speaker of the House and the Minnesota Speaker of the House think they can unilaterally pass fedeal drug policy laws. Something smells here, like we are being set up to fail.

36′ Des Moines $10 million marijuana grow facility

36′ Acreage Holdings granted second grow license; John Boehner,
Speaker of US House; Brian Mulroney, Canada PM for 11 years; and William
Welch, former Governor of Massachusetts all on Board of Iowa marijuana
company Acreage Holdings which was granted 1 of 2 licenses to grow
marijuana for profit in the state of Iowa — these are powerful people,
and there’s money to be made, so Carl says he thinks there’s reason to
believe these guys know something we don’t. Are they making changes to
the marijuana program behind the scenes to get filthy rich off the backs
of the sick and poor rural Iowans or not?

40′ What motivates you to continue?

41′ Thanks for tuning in, highlights, reviews, upcoming episodes

12-19-2018 Update: Carl filed his trial brief in his state case. Read his blog post explaining his equal protection lawsuit here as it moves forward. Carl has been granted standing to make his claim.
