Arizona’s Anti-Deficiency Statute: An Overview

Homeowners who choose short sales as alternatives to foreclosure often wonder if they will be held responsible for the difference between the amount their house sold for and the amount owed on the mortgage. In most cases, the Arizona Anti-Deficiency Statute will protect homeowners from having to financially answer for the deficiency between the selling price and the amount owed on the mortgage. Arizona’s Anti-Deficiency Statute

When a homeowner defaults on their mortgage, the lender will generally begin the foreclosure process to “repossess and sell” the house with the expectation (or hope) that it can turn around and sell the home to pay off the mortgage that has not been paid by homeowner. This amount will generally include the amount of the mortgage, as well as any late payments, lawyers’ fees, and administrative costs incurred during the foreclosure process. In some cases, particularly in today’s real estate market, a lender may only be able to sell the property at a fraction of the outstanding mortgage obligation. The lender generally loses money on the foreclosure.

An example:

A mortgage company loans a home buyer $150,000 to purchase a home. Two years later, the homeowner fails to make the payments and the lender is forced to foreclose. When the lender sells the property, it is only able to sell it for $100,000. This results in a $50,000 loss for the lender.
In some states, the lender may be entitled to sue the ex-homeowner for the difference ($50,000 in the example above) and receive a deficiency judgment through the courts. Thankfully, in Arizona, there are limitations to a deficiency incurred during foreclosure.

According to Arizona law, there exists an “Anti-Deficiency” statute that essentially prevents a lender from suing the homeowner for any losses on a home after foreclosure provided certain criteria are met. Generally, a homeowner may not be sued by his or her lender if the property in question is located on 2.5 acres or less and is a single family residence or duplex. However, this statute only applies if the decrease in value is not due to the homeowner’s neglect. (Source: Title 33, Chapter 6.1)

Does my property qualify for the anti-deficiency statute?

Is your home located on 2.5 acres of land or less?
Is your home fully built and is a dwelling for one or two families?
If your home occupied (at least occasionally) by you or a tenant?
Was the decrease to the value of your property the fault of the market (as opposed to neglect on your behalf)?
Was the mortgage(s) used for the original purchase of the home, or at the very least, for improvements made to the property?

If you answered yes to all of the above questions, it is likely that your property IS protected by Arizona’s anti-deficiency statute – and your lender may be prevented from pursuing you for its losses from the foreclosure . However, this may not be the case in all situations even if you meet the above criteria. Your individual factors may affect the outcome and qualification under Arizona’s anti-deficiency statute.

Mumbai, July 9th, 2009: Monsoon is the time when the rains are pouring, gentle winds are blowing, romance is blooming and your skin, it is just not behaving! During monsoons, we tend to ignore our skin and hair. There is no visible sun, hence sunscreen is not used; due to increased humidity we do not find it necessary to moisturize our skin and protect our hair. And our skin takes its own sweet revenge on us by behaving badly.
Summer is the season for growth - our skin cell turnover increases; this leads to piling up of dead layers of skin by the time monsoon begins. Also, the UV rays that harm the skin are invisible but do penetrate the clouds and harm the skin. Without right skin care, our skin starts looking dull and lifeless in the monsoon. Acidic water adds to our woes and hair tends to get rough and frizzy.
Here are a few tips from Dr Snehal Sriram (MD), Kaya Skin Clinic on taking care of your skin and hair this monsoon:
Skincare:
- Cleanse your skin daily using a soap free cleanser. Also make use of a gentle scrub (with uniform mild beads) once a day to get rid of dead cells.
- Cleansing should be followed by toning using an alcohol free toner, since increased humidity could open up your pores
- Use a sunscreen even on a cloudy day since the harmful UV radiations are capable of penetrating the clouds
- Use a light lotion based moisturizer or serum with a lightening agent as well as lactic acid – this will gently rehydrate your skin and also brighten it up
- Avoid heavy makeup and use waterproof make up when necessary
- Remember to nourish your skin - eat salads blanched in boiling water to disinfect them. Vegetable soup, consumed regularly, will also keep you warm and healthy.
- Just because it is raining, don’t reduce consumption of water. Drink your usual 8-10 glasses of water. Your skin is always thirstier than you are!

Care of Feet

- Effective cleansing of feet is very important as they would be exposed to lot of grime and muck
- Do not forget to completely dry your feet so as to prevent fungal infections
- Avoid wearing boots as these would hold water for longer duration sogging your feet
- Effective cleansing of the inside of your nails using orange stick dipped in hydrogen-peroxide would help prevent nail infections
- Home pedicure should be done once a week. It would consist of soaking feet in warm water to which you can add 3-4 drops of Savlon, for 15-20 minutes, followed by cleansing the inside of the nails with orange stick dipped in hydrogen peroxide and scrubbing the feet with foot scrapper. Complete the pedicure by applying light glycerine based moisturizer
- When you go for pedicure to a beautician, ensure that the instruments used are sterilized/ cleansed with disinfectants. If possible use your personal instruments. Also instruct your beautician to avoid pushing of the cuticles as toe nail fungal infections are very common in monsoons.

Hair

- Good and effective cleansing using a volumising shampoo, twice or thrice a week is a must as hair tends to go limp in this season
- Post-shampoo do use a volumising conditioner, once a week or as required
- If you need to blow dry your hair, apply a leave-on conditioner prior to it
- Avoid application of styling products, as this could make your hair very greasy due to increased humidity
- Do not tie-up wet hair
- Oiling once a week would help
- Incorporate milk and milk products, nuts, soya products into your diet as they help hair stay healthy
