Florida is a “no fault” state, so everybody has $10,000 of PIP coverage, and there’s no questions:&amp;#160; if you’re injured, PIP pays. &lt;/p&gt;  &lt;p&gt;This article is to give you some of the basics, next time, I’ll get into more detail on specific proposals.&lt;/p&gt;  &lt;p&gt;Unfortunately, there is some PIP fraud in Florida, but we don’t know how much. FCAN published &lt;a href="http://fcan.org/Press/Evaluation%20of%20FLOIR%20PIP%20Data%20Call.pdf" target="_blank"&gt;a study by Dr. Lore Medders of FSU&lt;/a&gt; looking at the numbers, and that’s what she said. There may be rings of criminals staging accidents in cahoots with clinics just to collect as many PIP payouts as possible. However much fraud there is, everyone would be better off with less fraud.&lt;/p&gt;  &lt;p&gt;PIP is an important safety net for consumers in ways you may not realize. PIP is sometimes &lt;em&gt;the only insurance a driver has&lt;/em&gt; for injuries, because health insurance is expensive. PIP dollars help keep hospital trauma centers going and help make sure doctors and hospitals get paid.&lt;/p&gt;  &lt;p&gt;$10,000 isn’t much in today’s expensive medical world, but it makes a big difference.&amp;#160; Why change something that works?&lt;/p&gt;  &lt;p&gt;Fraud is a problem because law enforcement is usually more focused on violent crimes and does not have the resources to focus on complex white collar crimes. Insurance companies don’t like to harass their customers with investigations, so they often just pay. &lt;/p&gt;  &lt;p&gt;FCAN belongs to the &lt;a href="http://www.insurancefraud.org" target="_blank"&gt;Coalition Against Insurance Fraud&lt;/a&gt; and works with insurers and law enforcement against fraud. One thing we’ve heard again and again is that the most effective tool against fraud is &lt;em&gt;dedicated fraud prosecutors&lt;/em&gt; and law enforcement units. That costs money.&lt;/p&gt;  &lt;p&gt;The Legislature funded prosecutors in Miami, Tampa, and Orlando and it works, but we need more prosecutors. The Legislature is pledged not to raise taxes, even if more prosecutors would save consumers money. Taxes, you know, they’re not popular these days. &lt;/p&gt;  &lt;p&gt;So, that leaves insurers and consumers to pay for the prosecutors, and that would mean higher auto insurance rates, maybe. I say maybe, because if they drive down fraud enough, we’ll actually save money!&lt;/p&gt;  &lt;p&gt;Naturally, the Legislature believes trial lawyers are the problem.&amp;#160; And chiropractors and maybe even some other medical providers. The Legislature &lt;em&gt;always&lt;/em&gt; thinks lawyers are the problem, mainly for political reasons. They want to limit their fees, meaning you won’t be able to get a lawyer to take your case because they can make more money elsewhere. That’s the market at work. But while this may increase insurer profits, there’s no evidence it would stop fraud, and it also leaves consumers without medical care when they need it. It means hospitals would get stuck with more bills that don’t get paid.&lt;/p&gt;  &lt;p&gt;It is true that some lawyers, some chiros, and even some other providers, I could mention massage therapists, are taking advantage of the system.&amp;#160; If they’re committing fraud, they should be prosecuted. But most of these professions serve consumers, and help us deal with sometimes very difficult problems. &lt;/p&gt;  &lt;p&gt;The Legislature sometimes just throws up its hands, saying, “The heck with this, let’s just get rid of PIP.”&amp;#160; Then people with no health insurance might not get medical treatment after an accident or the health care providers who treat them may not get paid.&lt;/p&gt;  &lt;p&gt;Florida’s Chief Financial Officer Jeff Atwater, recently said that more prosecutors were the best way to fight fraud. He’s right. We can’t just ignore this crime because it’s hard to fight and let consumers pay the bill. The Legislature has to find a way to pay for the law enforcement that’s needed. In the end, it will pay off. Fraudsters will need to find another state. &lt;/p&gt;  &lt;p&gt;Write your state senator or representative and demand more fraud prosecutors. Don’t let the criminals win. Let’s have real justice, not just political vendettas. Do your job, legislators! Currently Florida law provides for a very reasonable fee for debt settlement services like this.  But the national debt settlement industry would like to be able to charge much higher fees in Florida.  The industry needs higher fees, paid as soon as they can get them, since most consumers are unable to meet the payments on their debt and the high fees, so after a few months of high fees and paying on their debts, they are unable to continue.  Consumers end up worse off than they were before.  The FTC recently passed new regulations to try to control this industry since nationally their have been so many complaints.  SB 336 and HB 67 have been filed for the 2012 Florida legislative session.  These bills should not pass.  SB 336 will be heard in Florida Senate Banking and Insurance on Wednesday, December 7. The means of expression is to peaceably occupy publicly owned land 24 hours a day 7 days a week, for instance, holding a constant vigil at Curtis Hixon Park. &lt;/li&gt;    &lt;li&gt;The park is public property where the rights of citizens to peaceably assemble, and to petition the Government for a redress of grievances is protected 24 hours a day, 7 days a week by the Constitution and should also be protected by the City of Tampa. &lt;/li&gt;    &lt;li&gt;The Constitution and the rights of protesters supersede any and all City of Tampa ordinances as long as the protest is peaceable, and does not endanger public safety. The Occupy Tampa protest has been peaceable and endangers no one. &lt;/li&gt; &lt;/ul&gt;  &lt;p&gt;We request that the City take the following actions:&lt;/p&gt;  &lt;ul&gt;   &lt;li&gt;The Tampa Police Department should protect the rights of the protestors and ensure their safety. The police should not interfere in the exercise of constitutional rights in any way. The police should not arrest peaceful protesters on public property, attempt to control the protestors, awaken the protestors (sleeping in the park is an integral part of the protest) and avoid taking any position on what is or is not an expression of free speech. &lt;/li&gt;    &lt;li&gt;The City of Tampa should provide needed services for the citizens exercising their 1&lt;sup&gt;st&lt;/sup&gt; Amendment Rights at Curtis Hixon Park by providing sanitation (Porta-potties), electricity, trash removal, potable water, and other city services as needed. &lt;/li&gt; &lt;/ul&gt;  &lt;p&gt;In this way, the City protects and serves its Citizens as they exercise their rights, freely express their opinions, and seek redress of grievances. But still, it sticks there.&lt;/p&gt;  &lt;p&gt;It isn’t true, except for one year, 2009, after the recession hit. That was a very tough year, so it’s no surprise that the number of people exempt from income tax because of low income went way up. The info is from the Center on Budget and Policy Priorities’ report, &lt;a href="http://www.cbpp.org/cms/?fa=view&amp;amp;id=3505" target="_blank"&gt;Misconceptions and Realities About Who Pays Taxes.&lt;/a&gt;&amp;#160;&lt;/p&gt;  &lt;p&gt;CBPP points out that there were also some special tax credits that year that pushed the number even higher. According to CBPP, “In a more typical year, 35% to 40%” owe no taxes.&amp;#160; And federal gas taxes aren’t counted.&lt;/p&gt;  &lt;p&gt;According to &lt;a href="http://www.ctj.org/pdf/taxday2010.pdf" target="_blank"&gt;a study&lt;/a&gt; by the Institute on Taxation and Economic Policy, “the bottom fifth of households paid 16.3% of their incomes in taxes, on average, in 2010.&amp;#160; The second fifth paid 20.7%.”&amp;#160; &lt;/p&gt;  &lt;p&gt;Here’s how the recession affected taxpayers:&lt;/p&gt;  &lt;p&gt;&lt;img src="http://www.cbpp.org/images/cms//5-26-11tax-f1.jpg" /&gt;&lt;/p&gt;  &lt;p&gt;&lt;font color="#c0504d" size="5"&gt;&lt;strong&gt;Who Has All the Money?&lt;/strong&gt;&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;No doubt, the top fifth almost have it all.&amp;#160; According to a &lt;a href="http://www.pbs.org/newshour/bb/business/july-dec11/makingsense_08-16.html" target="_blank"&gt;PBS report&lt;/a&gt; in 2011, the top fifth now holds 84% of US wealth.&amp;#160; That’s not a typo, 84%.&amp;#160; The next fifth has 11%, the middle fifth 4%, the next fifth has 0.2% and the bottom fifth has 0.1%.&amp;#160;&amp;#160; And, surprise, it is becoming more uneven all the time.&lt;/p&gt;  &lt;p&gt;“Wealth” is assets minus liabilities, or things like land, stock, bonds, houses, and factories.&amp;#160; It is not the same as income, which is the number usually used by the right-wingers when complaining about taxes.&amp;#160; So, a look at income.&lt;/p&gt;  &lt;p&gt;&lt;img src="http://upload.wikimedia.org/wikipedia/commons/thumb/0/01/United_States_Income_Distribution_1947-2007.svg/300px-United_States_Income_Distribution_1947-2007.svg.png" width="443" height="187" /&gt;&lt;/p&gt;  &lt;p&gt;Doesn’t look good, does it. What it says, in plain terms, is that the rich get richer and the poor stay poor. And the middle class stays poor too.&lt;/p&gt;  &lt;p&gt;In 1915, the Robber Baron days, the top 1% got 18% of the income.&amp;#160; Today, &lt;a href="http://www.slate.com/articles/news_and_politics/the_great_divergence/features/2010/the_united_states_of_inequality/introducing_the_great_divergence.html" target="_blank"&gt;they get 24%.&lt;/a&gt;&amp;#160; For comparison however, I use quintiles, and offer the following from the US Census for 2010.&lt;/p&gt;  &lt;p&gt;&lt;a href="http://lh3.ggpht.com/-YIXIkCMInP0/TpXrSg23MlI/AAAAAAAAAEA/F59yyXmRdXc/s1600-h/Income%252520Distribution%2525202010001%25255B3%25255D.jpg"&gt;&lt;img style="background-image: none; border-right-width: 0px; padding-left: 0px; padding-right: 0px; display: inline; border-top-width: 0px; border-bottom-width: 0px; border-left-width: 0px; padding-top: 0px" title="Income Distribution 2010001" border="0" alt="Income Distribution 2010001" src="http://lh5.ggpht.com/-3CfERAY-F8k/TpXrSzc80zI/AAAAAAAAAEI/z1XR2TgpPZU/Income%252520Distribution%2525202010001_thumb%25255B1%25255D.jpg?imgmax=800" width="480" height="351" /&gt;&lt;/a&gt;&lt;/p&gt;  &lt;p&gt;The lowdown?&amp;#160; The top fifth gets 50.2% of the income, and the next fifth gets 23.4%.&amp;#160; Income in the fourth quintile was from $61,736 to $100,065 and the top fifth was everyone above that. For the record, the third quintile is $38,044 to $61,735, the second, $20,001 to $38,043. Our families are working harder and getting paid less, falling behind our parents' generation. While &lt;u&gt;our&lt;/u&gt; wages are stuck in place, the super-rich are getting even richer.&amp;#160; And CEO campaign contributors are buying tax breaks from politicians to ship our jobs overseas, while their corporations cut our wages and benefits at home. &lt;/p&gt;  &lt;p&gt;Look, &lt;em&gt;the people who wrecked our economy should be paying for it&lt;/em&gt;, not profiting from it. Deregulating Wall Street and trickle-down tax cuts for the rich didn’t create jobs. Workers who get decent wages and benefits, who can support their families, who shop on Main Street – that’s who create jobs. It’s simple really: Our economy works better when every American who wants a job is working. &lt;/p&gt;  &lt;p&gt;We &lt;b&gt;&lt;i&gt;&lt;u&gt;can&lt;/u&gt;&lt;/i&gt;&lt;/b&gt; create good jobs for everyone in America, now! There is more than enough vital work to be done and Americans stand ready and eager to do it. We can rebuild our crumbling bridges and repair out-dated schools, so that our businesses will be able to get their goods to market and have an educated workforce. We can change the rules so that American manufacturers can compete fairly with China. We can keep America competitive in the 21&lt;sup&gt;st&lt;/sup&gt; Century. &lt;/p&gt;  &lt;p&gt;We &lt;b&gt;&lt;i&gt;&lt;u&gt;can&lt;/u&gt;&lt;/i&gt;&lt;/b&gt; build strong communities. We can put teachers and firefighters back to work. We can help keep our families secure, by protecting Medicare, Medicaid and Social Security. We can make sure that losing you job doesn’t mean losing your home. And we can pay for this by ending giveaways to Big Oil, taxing Wall Street speculation and by raising taxes on millionaires instead of giving them more tax breaks. After all, big corporations are sitting on $2 trillion in cash while laying off workers. If they won’t put Americans back to work, we will!&lt;/p&gt;  &lt;p&gt;The choice today is crystal clear. We stand with working families and the small businesses that create two-thirds of American jobs. They stand with the Wall Street speculators and CEOs who cut our wages, crashed our economy and shipped our jobs overseas. Citizens had asked for a 4,000% rate increase.&amp;#160; It was clear that the Citizens hike wasn’t going to stick, and you had to wonder why they even did it.&lt;/p&gt;  &lt;p&gt;No doubt the free-marketers on the Citizens board, under pressure from industry lobbyists, legislators, and the Governor’s office, decided they needed to dramatically raise rates to push customers into private companies. They couldn’t just serve their customers and try to do a good job, could they?&lt;/p&gt;  &lt;p&gt;Once the decision was made to serve the private companies instead of consumers, the groundwork was laid for a very bad decision indeed. Why would anyone think it is a good decision to raise rates 4,000 percent when people are getting slammed by the worst recession in memory?&amp;#160; Pasco and Hernando are already very hard hit with empty developments and no jobs.&amp;#160; Foreclosure rates are soaring.&lt;/p&gt;  &lt;p&gt;The response from those fronting for industry was that only 20% of people there actually had the coverage. So, I guess, the heck with them, right?&amp;#160; Guess not.&amp;#160; It turns out a lot of people were upset and they made a lot of noise.&lt;/p&gt;  &lt;p&gt;What to do? What to do? Nobody in Tallahassee knows more about insurance that Commissioner Kevin McCarty, soon to be President of the NAIC.&amp;#160; It was predictable that they would ask McCarty to find a way out, and he did. The rate increase request was so full of holes, they had no justification at all for the numbers. &lt;/p&gt;  &lt;p&gt;Citizens needs board members that don’t try to destroy the company with complete disregard for their customers. McCarty won’t always be able to bail them out. We need some competent people in there.&lt;/p&gt;  &lt;p&gt;Sadly, it remains the policy of the Governor to close down Citizens and he appoints board members who agree. He wouldn’t do that with a company he owned. He’s put the best product, at the best price on the market and make some happy customers. Develop an energy efficiency first policy instead of relying on nukes and coal fired plants.&lt;/p&gt;  &lt;p&gt;2. Commit to an Energy Efficiency Portfolio Standard of 22% energy savings by 2025 for all residential, commercial and industrial customers.&lt;/p&gt;  &lt;p&gt;3. Implement energy efficiency “best practices” across the merged Duke Energy operating companies.&lt;/p&gt;  &lt;p&gt;4. Fund programs to help families who cannot afford energy efficiency, ranging from weatherization and insulation to appliances and HVAC systems. &lt;/p&gt;  &lt;p&gt;Included in the coalition are &lt;/p&gt;  &lt;p&gt;NC WARN&lt;/p&gt;  &lt;p&gt;Nuclear Information and Resource Service&lt;/p&gt;  &lt;p&gt;Public Citizen&lt;/p&gt;  &lt;p&gt;Greenpeace USA&lt;/p&gt;  &lt;p&gt;Florida Consumer Action Network&lt;/p&gt;  &lt;p&gt;NC Justice Center&lt;/p&gt;  &lt;p&gt;NC Housing Coalition&lt;/p&gt;  &lt;p&gt;If you’d like to get involved, write to the &lt;/p&gt;  &lt;p&gt;North Carolina Utilities Commission    &lt;br /&gt;DOCKET NO. CWIP is Construction Work In Progress, and utilities aren’t allowed to bill consumers for it because it gives the utility a direct line into the consumer’s pocketbook.&lt;/p&gt;  &lt;p&gt;But in Florida, the Legislature approved Advanced Nuclear Cost Recovery, which is known elsewhere as Super CWIP.&amp;#160; That’s because the utility can bill consumers for CWIP which ISN’T even in progress and, apparently, for plants that may never be built.&lt;/p&gt;  &lt;p&gt;The utilities should find financing in the marketplace, but no investor would fund such a risky speculative venture. None of us could match the campaign money and the army of lobbyists representing big agriculture, theme parks, insurance companies, utilities, and all the rest.&amp;#160; &lt;/p&gt;  &lt;p&gt;Represented by the Chamber of Commerce, Associated Industries, and various trade groups, the corporados swarmed and took what they believe is rightfully theirs :&amp;#160; tax breaks, growth management laws, voting rights, state worker pensions, school money, abortion rights, and more. &lt;/p&gt;  &lt;p&gt;The only real drama came when corporations fought corporations, or corporations fought Republican ideology. For instance, the Tea Parties insisted on immigration laws, including use of the Federal E-Verify system. This caused agriculture, in particular, but many other businesses as well, to dread doing without the big profits they make from cheap immigrant labor. &lt;/p&gt;  &lt;p&gt;So Sen. JD Alexander, the snarky owner of Alico farms, and a wealthy descendant of Ben Hill Griffin, made a show of caring about his workers, and stopped the bill. If he really cared about his workers he would be fighting for the DREAM act so they could become citizens.&lt;/p&gt;  &lt;p&gt;&lt;font size="4" face="Trebuchet MS"&gt;&lt;strong&gt;Insurance&lt;/strong&gt;&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;The insurance companies, savoring the opportunities of a veto proof Republican majority in the House and the Senate, went after everything that they could think of.&amp;#160; FCAN and others bravely fought back, but I cannot tell you that we could match their lobbyists or pubic relations firms. However, we did exploit their one weakness:&amp;#160; Legislators were afraid to raise rates during a difficult economy.&lt;/p&gt;  &lt;p&gt;That proved to be the proper lever, and bills to raise Citizens’ rates by 50%, eliminate sinkhole coverage, and cut mitigation discounts fell by the wayside. It was easier for legislators to risk the 1% chance of a huge storm than to face voters with insurance bills and corporate profit reports in hand.&lt;/p&gt;  &lt;p&gt;&lt;font size="4" face="Trebuchet MS"&gt;&lt;strong&gt;Voting Rights&lt;/strong&gt;&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;Fear did not stop the Legislature from curtailing early voting and voter registration. I’m sure they feel such technical changes are lost on most Floridians and many will never know they’ve been disenfranchised until it’s too late. We’re going to take them on though, with big voter registration drives and GOTV plans. FCAN and its allies have always relished the opportunity to hold legislators accountable at the ballot box. We will not be stopped.&lt;/p&gt;  &lt;p&gt;While it seems that our battle against the powers that run Florida is unlikely, and we are not winning at the moment, things do change. Ideas can carry the day. People can understand what is being done in their name and take action. We will stretch our resources as far as needed. We believe that we must fight for our values, no matter the odds, regardless of the strength of our opponents. To do otherwise would be to abandon our democracy and give up control to corporations, who are not people.&lt;/p&gt;  &lt;p&gt;If you want to help, find the donate button and pitch in whatever you can. The FJA holds a seat on FCAN’s Board of Directors. &lt;/p&gt;  &lt;p&gt;According to Caputo, the current issues are giving “sovereign immunity” to doctors at state universities who work at public hospitals, like Tampa General, regulation of expert witnesses, and auto crash worthiness. Why do these issues matter to consumers?&lt;/p&gt;  &lt;p&gt;If your doctor at Tampa General or Jackson Memorial is negligent and hurts you, now you can’t sue. You can try to ask the Legislature to pass a bill to give you some money, but good luck. Why should these docs be able to hurt consumers and walk away?&lt;/p&gt;  &lt;p&gt;Then, who pays for your health care if you’re injured?&amp;#160; Often these lawsuits are for people who are left paralyzed or need some kind of treatment for life. Without a settlement to pay medical bills, they are going to rely on the taxpayers, instead of the person that did the damage. How is that fair? Do you have to let the same doctor at the same public hospital work on you again?&lt;/p&gt;  &lt;p&gt;The expert witness legislation in &lt;a href="http://flsenate.gov/Session/Bill/2011/0479/Analyses/fzsYlyl8HHF1XK2uHm0mv/hdax4=%7C7/Public/Bills/0400-0499/0479/Analysis/h0479g.JDC.PDF"&gt;H 479&lt;/a&gt; will make it harder for you to get an expert to testify. Your witness may have to be certified by the Department of Health and could be harassed with complaints and subject to disciplinary action.&amp;#160; That’s not because there’s a problem, but to intimidate witnesses.&lt;/p&gt;  &lt;p&gt;The auto crashworthiness legislation reduces the liability of auto manufacturers for building unsafe cars.&amp;#160; Currently, you separately sue the driver and the car manufacturer for their wrongdoing, if any. Now, they must be combined, so each will only be held partly responsible.&lt;/p&gt;  &lt;p&gt;The big picture is that consumers need trial lawyers when we fight big corporations. Corporations have all the advantages, especially teams of highly paid lawyers who specialize in defeating consumers.&amp;#160; When you have to take them on, you are at a disadvantage. Because your lawyer can take your case contingent on receiving part of the settlement, you have a way to get to court.&amp;#160; Court cases can be very expensive, so the trial lawyer could invest hundreds of thousands of dollars in your case, and may get nothing back at all.&amp;#160; Juries today are notoriously stingy and suspicious.&lt;/p&gt;  &lt;p&gt;Then there’s politics. Republicans are attacking lawyers because they often support Democrats and groups like FCAN. Lawyers and unions are two of the biggest supporters of Democrats, so if Republicans take them down, they take their opponent’s resources, a huge advantage.&lt;/p&gt;  &lt;p&gt;However, the lawyers are a clever and resourceful opponent. I have seen insurance companies try to take them on in Tallahassee year after year and end up scratching their heads, wondering where all their money went. &lt;/p&gt;  &lt;p&gt;So, trial lawyers:&amp;#160; keep fighting for us, and keep fighting!&lt;/p&gt;  &lt;div class="blogger-post-footer"&gt;You are subscribed to the FCAN Blog!

That’s the only property insurance bill that survives after the deadline for committees to meet. At this point, a bill would have to be amended on to something else to be passed, and that would need to happen in both houses.&lt;/p&gt;  &lt;p&gt;We are down to the “&lt;a href="http://www.fcan.org/fact_sheets/how_a_bill_becomes_law.pdf"&gt;horse trading&lt;/a&gt;” section of the legislative Session. That’s where powerful people, like the Senate President or the House Speaker, want something really badly, and they’re willing to give something up to get it. That’s Florida politics.&lt;/p&gt;  &lt;p&gt;There could be several reasons for this unexpected outcome, if it holds.&amp;#160; Legislators were more focused on political work such as disenfranchising voters and packing the Supreme Court, rather than insurance. The budget is a huge problem consuming many hours. It is possible legislators plan to raise even more money from insurance interests ahead of next year’s elections.&lt;/p&gt;  &lt;p&gt;&lt;a href="http://flsenate.gov/Session/Bill/2011/408"&gt;S. 408&lt;/a&gt; is still pretty bad. It takes rights away from consumers. For instance, we would be limited to three years to file claims instead of five.&amp;#160; It reduces our benefits – your “replacement cost” policy will only pay in full if you spend the funds to replace and present those to the insurance company.&amp;#160; Of course, you probably can’t or won’t do that, so your payout will be “actual loss” instead. Oh, you will still be able to buy a “true replacement value” policy that works like the one you have now, but, surprise, it will cost more.&lt;/p&gt;  &lt;p&gt;Call &lt;a title="S 408" href="mailto: latvala.jack.web@flsenate.gov"&gt;Senator Jack Latvala&lt;/a&gt; and &lt;a title="S. 408" href="mailto:jones.dennis.web@flsenate.gov"&gt;Senator Dennis Jones&lt;/a&gt; and tell them to fix S. 408. Ask them to vote “YES” on floor &lt;a href="http://flsenate.gov/Session/Bill/2011/0408/Amendment/497744/HTML"&gt;amendment 497744&lt;/a&gt; by Senator Fasano to deal with replacement cost value and &lt;a href="http://flsenate.gov/Session/Bill/2011/0408/Amendment/415180/HTML"&gt;amendment 415180&lt;/a&gt; by Senator Smith on time to file claims.&lt;/p&gt;  &lt;p&gt;The current bill does one good thing – it extends “file and use” ratemaking. That means insurers have to get approval from OIR before raising your rates.&lt;/p&gt;  &lt;p&gt;On sinkholes, insurers will have to offer coverage for complete collapse, but nothing else. Citizens will be &lt;em&gt;required&lt;/em&gt; to offer sinkhole coverage. The effect would be to pile even more policies into Citizens, which I did not think was a goal of the legislature.&amp;#160; But insurers don’t want to offer that coverage and people have to get it somewhere.&lt;/p&gt;  &lt;p&gt;Finally, the bill changes the name of Citizens Property Insurance Company to Taxpayer Funded Property Insurance Company. Now, I don’t think this new name accurately states the situation. It’s just a dig by legislators. And, in fact, Citizens has been making money since there have been no hurricanes for five years. It hasn’t made enough money, but if there are no storms it will continue to make money.&amp;#160; It only become taxpayer funded if there’s a really big storm and it has to assess everyone.&amp;#160; So, should it be named the “Possibly Taxpayer Funded, But Probably Not, Property Insurance Company (With Lower Rates)”?&lt;/p&gt;  &lt;div class="blogger-post-footer"&gt;You are subscribed to the FCAN Blog!

Another bill (&lt;a href="http://flsenate.gov/Session/Bill/2011/1330"&gt;S 1330&lt;/a&gt;) would raise Citizens' rates 25% and allow insurance companies to take your policy out of Citizens and charge you another 24.9%.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;S 408 is return of last year’s major insurance bill, and nominally relates to sinkholes, but does much more. It is currently to be heard on the floor of the Senate and there are many amendments.&amp;#160; The House version &lt;/font&gt;&lt;a href="http://flsenate.gov/Session/Bill/2011/803"&gt;&lt;font size="2"&gt;(H 803)&lt;/font&gt;&lt;/a&gt;&lt;font size="2"&gt; passed out of Insurance &amp;amp; Banking, and has two other committee stops.&amp;#160; Here’s what S 408 would do:&lt;/font&gt;&lt;/p&gt;  &lt;ul&gt;   &lt;li&gt;&lt;font size="2"&gt;Requires insurers to have $15 million in surplus funds to pay claims, up from $5 million;&lt;/font&gt; &lt;/li&gt;    &lt;li&gt;&lt;font size="2"&gt;Reduces the insurer’s written notice of nonrenewal, cancellation, or termination to 90 days;        &lt;br /&gt;&lt;/font&gt;&lt;/li&gt;    &lt;li&gt;&lt;font size="2"&gt;Modifies replacement cost coverage so you only get “actual cash value” and get the replacement value when you produce receipts. You could still get the full replacement value policy you have today, but it will cost more.        &lt;br /&gt;&lt;/font&gt;&lt;/li&gt;    &lt;li&gt;&lt;font size="2"&gt;Requires windstorm and hurricane property insurance claims to be brought within three years and sinkhole loss claims to be brought within two years;        &lt;br /&gt;&lt;/font&gt;&lt;/li&gt;    &lt;li&gt;&lt;font size="2"&gt;Mitigation discounts are still in the bill, but watch out for amendments;        &lt;br /&gt;&lt;/font&gt;&lt;/li&gt;    &lt;li&gt;&lt;font size="2"&gt;Repeals the requirement that the Consumer Advocate prepare an annual report card for personal residential property insurers;        &lt;br /&gt;&lt;/font&gt;&lt;/li&gt;    &lt;li&gt;&lt;font size="2"&gt;Limits your ability to hire a public adjuster to help with your claim. Apparently, Citizens customers will still be allowed to use one.&lt;/font&gt; &lt;/li&gt;    &lt;li&gt;&lt;font size="2"&gt;Insurers will not have to offer sinkhole coverage and probably won’t. But another bill &lt;a href="http://flsenate.gov/Session/Bill/2011/1330"&gt;(S 1330)&lt;/a&gt; requires Citizens to offer the coverage. That means a lot more policies in Citizens, but legislators said they wanted to do just the opposite. ???&lt;/font&gt; &lt;/li&gt;    &lt;li&gt;&lt;font size="2"&gt;Revises what constitutes a sinkhole loss to make it much harder to collect.&amp;#160; This part is probably actually needed;        &lt;br /&gt;&lt;/font&gt;&lt;/li&gt;    &lt;li&gt;&lt;font size="2"&gt;Limits the authority of the Office of Insurance Regulation (OIR) to disapprove rates for sinkhole insurance, but they’re probably not going to offer it anyway, and if they do, the price will be sky high. Too bad for anyone living in Pasco or Hernando.        &lt;br /&gt;&lt;/font&gt;&lt;/li&gt; &lt;/ul&gt;  &lt;p&gt;&lt;font size="2"&gt;There’s a lot here and that’s only one bill. There’s lots of drama too, as amendments put things like “file and use” back in the bill. Their efforts led the the passage of HB 1A, which effectively reined in rates both in the private market and at Citizens.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;The new law also had a downside. It signaled a mass exodus by the private market, which claimed it needed more money to do business here. That forced even more homeowners into Citizens, which now has about 1.3 million policyholders.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;It looks like we may need to pay a call on Tallahassee again. This time, the Legislature is planning to force homeowners out of Citizens or dramatically raise the rates of those who stay.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;So far, this has been a one-sided discussion. The insurance industry donated more than $7 million to lawmakers last year, and their wallets are open again this year. Citizens, however, is a state-run insurer and donates nothing. So already the deck is stacked.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;What the private market wants is Citizens book of business, which represents hundreds of millions of dollars in premiums. But only if the price is right - which means forcing a 50-percent rate hike on Citizens' customers.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;Here's an unspoken truth: This is a case where the state is actually doing something reasonably well. Citizens has flaws, but it's working. And most importantly, it's allowing people to remain in their homes.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;But since Citizens doesn't write checks to politicans, all that is going to change.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;Think of Citizens this way. The reason it was created, and the reason it still exists, is because the private market refuses to insure most of the areas along the coast. And I'm not talking about only the million-dollar homes on the water. Those are usually insured by a company like Chubb or Lloyds, and at a five-figure yearly premium.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;I'm talking about the vast majority of homes in places like Miami-Dade, Monroe and Broward counties, homes in the $75,000 to $250,000 range. Pinellas County is a prime example. Citizens is the only company that writes affordable new policies in the county, yet 75 percent of the homes in Pinellas are valued under $250,000.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;And those homeowners can look forward to a 50-percent rate hike?&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;Right now, Citizens policyholders are paying competitive rates that are well above the national average. Imagine what will happen when a yearly $3,000 insurance premium goes up to $4,500 a year?&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;And that's the key point. Property insurance is not a discretionary purchase like a new TV or a boat. We have to have it. It's a condition of a mortgage, and more than 5 million Florida homeowners have mortgages.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;But we also have to have homeowners policies that will allow us to keep our homes. We had such policies before 2004. But then we were hit by eight hurricanes in two years, and instead of spreading the risk across the state and the country, the insurance companies isolated and eliminated the risk.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;They left us with Citizens.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;And now they want that, too.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;To be sure, this is not about punishing private insurance companies. We all want to see them do well and make a profit. This is about spreading risk and keeping rates affordable in a state where the risk is enormous.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;If the private market wants to be a partner, come on board. But if the State Farms and Allstates and&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;Nationwides are unwilling to do that, let Citizens do the job it was intended to do. It already insures the lion's share of the state's risk.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;Remember one last thing.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;The odds of a major hurricane (category 3 or higher) making a direct hit on Florida is about 4 percent a year. In all the years when there is no major damage (we're in our 5th non-hurricane year now) Citizens should be allowed to stockpile its reserves so it has the cash on hand to pay its bills when a big storm hits. The company was set up to do just that - and with complete transparency.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;And the more policyholders that are in Citizens, the more risk is spread and the greater chance for those reserves to grow. It's a formula for success.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;But the insurance lobby and the lawmakers they fund don't want that.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;It's time to let them know what's at stake. Send an e-mail, write a letter or make a phone call to your legislator and ask them not to force us out of our homes.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;Bruce Douglas, the retired chairman of Citizens, knew that the company had to raise rates. But he instituted a glide path. Alan Hays (R Umatilla) whose name you probably recognize from hearing about his other bills. The goal of SB 1714 is the destruction of &lt;a href="https://www.citizensfla.com/about/generalinfo.cfm" target="_blank"&gt;Citizens Property Insurance Company&lt;/a&gt; because Senator Hays and many others in the Legislature believe in the “free market” which means Floridians must pay whatever insurance companies demand, no matter the consequences.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;But it is not solely on the basis of ideology that Hays and others pursue their goals.&amp;#160; Insurance interests &lt;a href="http://www.followthemoney.org/database/StateGlance/contributor_details.phtml?s=FL&amp;amp;y=2010&amp;amp;b%5B%5D=F3100&amp;amp;b%5B%5D=F3000&amp;amp;b%5B%5D=F3400" target="_blank"&gt;contributed over $7 million&lt;/a&gt; to the legislature in 2010. And let’s not forget that insurance companies are &lt;a href="http://www.floridainsuranceblog.com/2011/02/articles/admin/florida-office-of-insurance-regulation-release-annual-insurers-profits-report-it-aint-what-you-think/" target="_blank"&gt;making lots of money&lt;/a&gt; using &lt;a href="http://www.propertycasualty360.com/2011/01/18/near-term-models-misjudge-hurricane-losses-by-bill" target="_blank"&gt;discredited&lt;/a&gt; “black box” models.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;Let’s look at some of the provisions of SB 1714 and gauge the impact.&amp;#160; Citizens is now limited to 10% rate increase per year, something we call the “glide path” to actuarially sound rates. SB 1714 would not only allow 25% rate increases, but would actually &lt;em&gt;prohibit&lt;/em&gt; rate decreases. How many of us can afford that additional money each month? How will this affect businesses where those funds would have been spent? How many jobs will be lost?&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;The bill would prohibit Citizens customers from hiring a public adjuster to help them with their claim. That means you would have no choice but to accept Citizens assessment of your claim, although it is unclear if your contractor could also adjust the claim. I suppose you could always sue Citizens if you’re unhappy with what they’re paying you.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;There’s more. The Legislature intends to try to force more people into Citizens by changing the eligibility requirement from 15% to 25%. That means you won’t be able to buy Citizens less expensive coverage unless it is more than 25% less than the private market. You can add that to your 25% increase from Citizens.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;Another provision limits Citizens ability to insure homes valued over $500,000. Now, you might think that there’s no reason Citizens should be insuring them, but wait a minute. Those are the best customers because high value homes are newer and safer, and they buy more coverage. That helps lower the cost for everyone else in Citizens. But the insurers want these lucrative customers back. I was surprised they ever let them go. &lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;What you will see if this bill becomes law, is rate increases of 50% if you are in Citizens and a private company decides it wants you; 25% if you manage to stay in Citizens. But if you stay, good luck with your claim, although Citizens claims service has actually been pretty good.&lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;SB 1714 also removes “bad faith” liability from Citizens. That means if Citizens intentionally screws you over, there’s nothing you can do. This fits with the Legislature’s rigid ideology – you’re on your own. &lt;/font&gt;&lt;/p&gt;  &lt;p&gt;&lt;font size="2"&gt;Is there any way to stop this from happening? The Legislature isn’t listening to you, they are listening to insurance companies and free market necromancers. But legislators may fear the wrath of voters holding premium notices. Legislators may be in less gerrymandered districts next year due to Amendments 5 and 6. They don’t care about you, but maybe they care about themselves. Chairman Garrett Richter had planned to move the bill out of committee today, but the other Senators seemed moved by public testimony from an enlisted man and his wife from Pasco County and two &lt;a href="http://www.fairinsuranceratesinmonroe.com/" target="_blank"&gt;FIRM&lt;/a&gt; members who traveled from the Keys. &lt;/p&gt;  &lt;p&gt;Hearing the problems these people were having motivated the Committee to allow more comments and more debate next week.&amp;#160; This means there will be time for Sen Fasano’s other 9 amendments and lots of public testimony at the next meeting, probably in one week, next Monday, Feb 14&lt;sup&gt;th&lt;/sup&gt;.&lt;/p&gt;  &lt;p&gt;It’s interesting that major legislation can be voted on when the Legislature is not even in session. I think they like to keep controversial stuff out of sight, and Committee weeks are usually only attended by professional lobbyists, creating a cozy situation, if you will.&lt;/p&gt;  &lt;p&gt;During the hearing, Senator Fasano said that he knew all his amendments were “preordained” not to pass because of “orders” from leadership. Sen. Negron (R – Palm City) denied this, but he has voted against every one of Fasano’s amendments. Fasano is doing a great job of pointing out the problems with the bill – that no insurer will cover sinkholes if it passes. He has proposed many fixes to problems, but they fall on deaf ears.&lt;/p&gt;  &lt;p&gt;The enlisted man testified that he had attempted to obtain insurance from Citizens, but that Citizens would not include sinkhole coverage. Sen. Bennett seemed puzzled at this, and commented he didn’t think Citizens could turn anyone down. That implies he expect everyone in sinkhole areas to end up in Citizens, as consumer advocates are predicting. Do the Senators really intend for the state government to take on all sinkhole risk? And if sinkhole coverage is extremely limited, as suggested, then homes will not be repaired, and local governments will be stuck with the abandoned homes. &lt;/p&gt;  &lt;p&gt;While consumers have few supporters on this committee aside from Fasano, Sobel, and maybe Margolis, it did appear that Vice Chair Chris Smith (D – West Palm Beach), who seems to usually vote with the insurance companies, might be weakening a bit and responding to the emotional testimony. People should call his office. Unfortunately, Sen. Margolis doesn’t seem engaged on the bill. Since she is a former Senate President, I would think she could put up quite a fight if she wanted to. Maybe not.&lt;/p&gt;  &lt;p&gt;The rest of the Senators are dead set against consumers. Committee Chair Garrett Richter has a banking background and admits he doesn’t understand insurance.&lt;/p&gt;  &lt;p&gt;The most outspoken advocate for the insurance companies is JD Alexander, the rich grandson of Ben Hill Griffin Jr, who was on the Forbes 400 list of the wealthiest Americans. Ironically, Griffin was a Democrat, but JD is hard core pro-business Republican. &lt;/p&gt;  &lt;p&gt;JD accused Fasano of running amendments “written by a plaintiff’s attorney”. If you know Fasano, you know that would never happen. JD accuses consumer advocates and their allies of “running the insurance companies out of Florida” but cites no evidence of this, and accuses consumer advocates of overstating and demonizing insurance company profits. &lt;/p&gt;  &lt;p&gt;Let me cite a source on insurer profits, McKinsey &amp;amp; Co, one of the nation’s most respected consultants. In their report, &lt;a href="http://www.propertycasualty360.com/2011/01/14/mckinsey-pc-insurers-on-earnings-trend-that-is-lik" target="_blank"&gt;“The Next Frontier in Property and Casualty Insurance”,&lt;/a&gt; McKinsey said that “from 2003 through 2009, the U.S. Property &amp;amp; Casualty industry produced $99 billion of pre-tax earnings in excess of cost of capital, reversing a cumulative loss of $108 billion from 1988 through 2002.” &lt;/p&gt;  &lt;p&gt;So they’re doing better than ever and I think we know why: &lt;a href="http://www.propertycasualty360.com/2011/01/18/near-term-models-misjudge-hurricane-losses-by-bill" target="_blank"&gt;their models are flat out wrong.&lt;/a&gt;&lt;/p&gt;  &lt;p&gt;As to JD’s claim that insurers are leaving Florida, OIR says we currently have 173 insurers, and Florida is the #1 market for homeowner’s insurance even though we are the fourth largest state. They are SEIU, AFSCME, Equality Florida, Florida Justice Association, Humanists of Florida, and the West Central Florida Federation of Labor AFL-CIO.&amp;#160; &lt;/p&gt;  &lt;p&gt;Nine at-large board members were elected: Cathy Bowers, Sheldon Busansky, Denise Coburn, Mark Ferrulo, Cam Oberting, Lonnie Thompson, Tom Walker, Rosette Walsh, and new board member Tom Zucco.&lt;/p&gt;  &lt;p&gt;In addition, the staff is represented by Tom Krumreich, and the Executive Director, Bill Newton, is also a member of the board.&lt;/p&gt;  &lt;p&gt;After the election, the board reviewed the budget for 2011, a difficult process, and brainstormed ideas for program and fundraising for the year.&lt;/p&gt;  &lt;p&gt;February 7th - FCAN Tampa Bay Member Meet and Greet.&amp;#160; Guest speaker: Former City Councilwoman, and FCAN member, Linda Saul-Sena.&amp;#160; &lt;/p&gt;  &lt;p&gt;Come meet the members and activists of FCAN in the Tampa Bay area.&amp;#160; We'll be speaking about our green campaigns and an upcoming 2012 ballot initiative!&amp;#160; So join us at the Walker Brands building (Tampa's FIRST Gold LEED certified building)    &lt;br /&gt;&lt;/p&gt;  &lt;p&gt;1810 W. We Organize.</title><content type="html">&lt;p&gt;Guest Blog by Jeff Blum, Executive Director, &lt;a href="http://www.usaction.org" target="_blank"&gt;USAction&lt;/a&gt; (FCAN is an affiliate)&lt;/p&gt;  &lt;table border="0" cellspacing="3" cellpadding="0"&gt;&lt;tbody&gt;     &lt;tr&gt;       &lt;td valign="top"&gt;         &lt;p&gt;As anyone near a newspaper, TV or computer knows by now, House Republicans are voting today on whether to repeal the new health-care law.&lt;/p&gt;          &lt;p&gt;For Republicans, it’s largely theater. They know the repeal effort will never survive the Senate or President Obama’s veto pen.&lt;/p&gt;          &lt;p&gt;For us, it’s an opportunity. A chance for us to remind Americans about the urgent need for health care reform. Across the country, &lt;a href="http://www.usaction.org" target="_blank"&gt;USAction&lt;/a&gt; affiliates are doing just that -- a sampling of those activities across the country:&lt;/p&gt;          &lt;p&gt;&lt;a href="http://www.mainepeoplesalliance.org/" target="_blank"&gt;Maine People’s Alliance&lt;/a&gt; delivered 2,600 postcards to the newly elected Tea Party-backed governor, opposing repeal and demanding that the state not join a lawsuit challenging the new law.&lt;/p&gt;          &lt;p&gt;&lt;a href="http://www.tnca.org/" target="_blank"&gt;Tennessee Citizen Action&lt;/a&gt; held a press conference at the state capitol that featured stories of people who desperately needed health care reform. It drew saturation coverage.&lt;/p&gt;          &lt;p&gt;&lt;a href="http://www.progressohio.org/" target="_blank"&gt;ProgressOhio&lt;/a&gt; mounted a spirited defense of health care reform, visiting members of Congress, &lt;a href="http://www.progressohio.org/blog/2011/01/the-gop-repeal-bill-puts-insurance-companies-back-in-charge-of-your-health-care.html"&gt;making aggressive use of social media&lt;/a&gt; to rally supporters of the law and even delivering an inch-and-a-half thick book of comments from &lt;a href="http://www.progressohio.org/" target="_blank"&gt;ProgressOhio&lt;/a&gt; members to public officials’ offices, sharing their personal stories about why the law is desperately needed.&lt;/p&gt;          &lt;p&gt;&lt;a href="http://pennaction.org/pablog/" target="_blank"&gt;Penn Action's&lt;/a&gt; Stacie Ritter was featured on more than 60 NBC affiliate TV stations across the country, while an Associated Press photo of Brian Rothgery of &lt;a href="http://citizenactionwi.org/index.php?option=com_frontpage&amp;amp;Itemid=1" target="_blank"&gt;Wisconsin Citizen Action&lt;/a&gt; appeared in newspapers as far away as Atlanta, Philadelphia, Salt Lake City and San Antonio.&lt;/p&gt;          &lt;p&gt;Indeed, in the approximately 30 states where activists are on the ground this week defending health care reform, almost half of the activities are being led or co-sponsored by &lt;a href="http://www.usaction.org" target="_blank"&gt;USAction&lt;/a&gt; affiliates. We’re asking people to think about what happens if the health care law is repealed.&lt;/p&gt;          &lt;p&gt;It would mean:&lt;/p&gt;          &lt;p&gt;· &lt;strong&gt;Dropping you from coverage because you get sick.&lt;/strong&gt;&lt;/p&gt;          &lt;p&gt;· &lt;b&gt;Denying coverage to children with pre-existing conditions.&lt;/b&gt;&lt;/p&gt;          &lt;p&gt;· &lt;b&gt;Kicking recent college grads off their parents’ plans.&lt;/b&gt;&lt;/p&gt;          &lt;p&gt;· &lt;b&gt;Robbing small businesses of tax credits for offering coverage to workers.&lt;/b&gt;&lt;/p&gt;          &lt;p&gt;· &lt;b&gt;Taking prescription drug money out of seniors’ pockets.&lt;/b&gt;&lt;/p&gt;          &lt;p&gt;There’s more – much more -- but you get the drift.&lt;/p&gt;          &lt;p&gt;But this is not just about health care and the reforms we fought so hard to pass. It’s about our future.&lt;/p&gt;          &lt;p&gt;We know that health care reform will create 250,000 to 400,000 jobs a year over the next decade. We know it will bring down the deficit. We know it will lower the home foreclosure rate – my colleague, Ethan Rome, executive director of &lt;a href="http://www.healthcareforamericanow.org/" target="_blank"&gt;Health Care for America Now&lt;/a&gt;, estimates that repeal would lead to nearly 900,000 Americans a year being forced into home foreclosure because of catastrophically high medical bills.&lt;/p&gt;          &lt;p&gt;But most importantly, we know that health care is a right. As the Rev. Martin Luther King, Jr., famously said: “Of all the forms of inequality, injustice in healthcare is the most shocking and inhumane.”&lt;/p&gt;          &lt;p&gt;We are &lt;a href="www.usaction.org" target="_blank"&gt;USAction&lt;/a&gt;. Crist.&amp;#160;&amp;#160; &lt;/p&gt;  &lt;p&gt;Sinkholes:&amp;#160; you’re having too many of them, so you’re going to have to prove, really prove that that’s what is destroying your home.&amp;#160; Expect this to be part of a trend toward insurance companies not paying claims without a heck of a fight.&amp;#160; No more good neighbor.&lt;/p&gt;  &lt;p&gt;Hurricanes:&amp;#160; you’ll have to figure out your total hurricane damage within two or three years, or tough luck.&amp;#160; And there won’t be as many public adjusters available to you because they’ll be more regulated.&amp;#160; And you’ll have to prove to the insurance company that you’re doing the repairs.&amp;#160; It’s not your money, it’s theirs and you have to spend it the way they say.&lt;/p&gt;  &lt;p&gt;But there could be far worse in store. We expect a proposal to limit “bad faith” law suits against insurance companies.&amp;#160; Bad faith means the company isn’t doing what it should under the contract you have with them.&amp;#160; There are punitive damages, and the damages in your original claim are magnified because the company is trying to cheat you.&amp;#160; Bad faith laws compel the insurer to settle with you in a timely fashion rather than say, sandbag until you are out of money, then force you to accept a lowball offer.&amp;#160; But, tough luck.&lt;/p&gt;  &lt;p&gt;And Gov. Scott says he wants to depopulate Citizens, the state’s largest insurer.&amp;#160; I’m not sure how you do that without driving up insurance rates dramatically.&amp;#160; We don’t need that in the middle of a recession.&amp;#160; I’ll look for more detailed plans and comment as they come out.&lt;/p&gt;  &lt;div class="blogger-post-footer"&gt;You are subscribed to the FCAN Blog!

Possibilities include the Local Jobs for America Act, funding for infrastructure, education, and law enforcement, extended unemployment insurance, and measures to promote investment in domestic manufacturing and green jobs.&lt;/p&gt;  &lt;p&gt;Medicare negotiation with pharmaceutical companies and implementing a public option health care plan.&lt;/p&gt;  &lt;p&gt;Cutting military budget, as the Commission does, but not military pay or health care.&amp;#160; This avoids penalizing rank and file military, and instead cuts expensive unneeded weapons systems.&lt;/p&gt;  &lt;p&gt;Read the rest of the &lt;a href="http://schakowsky.house.gov/images/stories/1202_Schakowsky_Deficit_Reduction_Plan.pdf" target="_blank"&gt;plan here&lt;/a&gt;.&amp;#160; It’s plain there IS an alternative.&lt;/p&gt;  &lt;div class="blogger-post-footer"&gt;You are subscribed to the FCAN Blog!

The part we read about in the news and wrote about in this blog related to property tax exemptions on agricultural lands. The second part allows application of pesticides to state waters, and the third part is the fee increase.&lt;/p&gt;  &lt;p&gt;According to the &lt;a href="http://flhouse.gov/Sections/Documents/loaddoc.aspx?FileName=h981g.GGPC.docx&amp;amp;DocumentType=Analysis&amp;amp;BillNumber=0981&amp;amp;Session=2010" target="_blank"&gt;staff analysis&lt;/a&gt;, “If the rate is     &lt;br /&gt;set at the maximum of three cents per box, approximately $3,000,000 annually would be deposited into the appropriate trust fund, assuming a full year application of the law.”&amp;#160; The “fee” is 1 cent a box now, but we don’t know how much is collected.&amp;#160; Up to $3 million will be collected now.&amp;#160; &lt;/p&gt;  &lt;p&gt;The stimulus funds were accepted by the Legislature to pay for energy efficiency rebates for things like solar panels.&amp;#160; FCAN is all in favor of that.&amp;#160; But the conservatives in the Legislature are not.&amp;#160; According to Rep.&amp;#160; Rick Kriseman of St. Petersburg, “&lt;/p&gt;  &lt;p&gt;&amp;quot;It's striking to me that the first act of this newly elected Legislature is a vote to accept stimulus dollars,&amp;quot; Kriseman said. &lt;/p&gt;  &lt;p&gt;&amp;quot;The argument we heard this entire campaign season from the Republicans was critical of the Obama administration and stimulus dollars and how we needed to avoid doing anything that increases the debt.&amp;quot;&lt;/p&gt;  &lt;p&gt;This won’t be the last contradiction coming out of Tallassee.&amp;#160; Gov-elect Rick Scott said he would create 700,000 jobs, but one of his first acts, he says, will be to fire 8.000 state workers.&lt;/p&gt;  &lt;div class="blogger-post-footer"&gt;You are subscribed to the FCAN Blog!

Repealing HB 545 means homebuyers could walk right into a hazardous home.&amp;#160; Shouldn’t homebuyers know whether basic mitigation, like roof tie-downs, has been done?&amp;#160; Homebuyers would be stuck with repair bills and higher insurance costs thanks to this repeal.&lt;/p&gt;  &lt;p&gt;HB 981 says that speculators can have an “agriculture” tax rate on their land even though the county appraiser knows the land has a much higher value.&amp;#160; Typically, this loophole is used by developers who run a couple cows on the land while working on the sale.&amp;#160; They may have bought the land for a higher price and plan to sell it for a much higher price, but they don’t want to pay tax on the true value of the land. They are tax cheats and the Legislature wants you the pay their taxes for them.&lt;/p&gt;  &lt;p&gt;Gov. Crist was wise to veto both of these bills.&amp;#160; This action by the Legislature is a harbinger of what is to come in the session ahead.&amp;#160; Shouldn’t there at least be a discussion of the impact on homeowners and taxpayers?&lt;/p&gt;  &lt;div class="blogger-post-footer"&gt;You are subscribed to the FCAN Blog!

Now, back to work.</title><content type="html">&lt;p&gt;The polls have closed and the votes have been counted. But now it is time for another vote to be taken – for the sake of millions of Americans, for our economy and for our country.&lt;/p&gt;  &lt;p&gt;Members of Congress will return to work in mid-November. They will immediately face a crucial decision: whether to extend unemployment benefits. If they fail to act, it will indeed be a grim holiday season for too many.&lt;/p&gt;  &lt;p&gt;The nonpartisan &lt;a href="http://www.nelp.org/" target="_blank"&gt;National Employment Law Project&lt;/a&gt; (NELP) estimates that two million Americans – including more than 107,000 people in Florida – will lose unemployment benefits by early December if no extension is forthcoming.&lt;/p&gt;  &lt;p&gt;Some may look at the recent election results and argue, “Didn’t the American people just vote against government spending?” No, there were a variety of reasons people voted the way they did this year. And if you look at the polls, Americans favor helping the unemployed, just as they favor ending the Bush-era tax cuts for the wealthiest Americans and just as they favor preserving the safety net for seniors and others in peril during this economic crisis.&lt;/p&gt;  &lt;p&gt;Actually, the number one issue of concern to Americans is not government spending. It’s jobs and the economy. For the sake of the country members of Congress should make restoring the economy their number one priority when they return to Washington, D.C. Democrats should realize that they were elected to do a job – and they should do it. Republicans should realize that with leadership comes responsibility -- and Tuesday’s election was not a referendum on how we should treat people who are unemployed through no fault of their own.&lt;/p&gt;  &lt;p&gt;One could debate the various ways of doing this – but the quickest, most effective way to achieve at least some success would be to extend unemployment benefits immediately, in time to save what otherwise will be another dismal holiday season for retailers.&lt;/p&gt;  &lt;p&gt;Economists argue, and the National Employment Law Project notes, that unemployment benefits stimulate growth. Why? Because unemployed people spend their benefits on necessities – mortgage payments, utilities, food, items at the discount store. NELP says this spending may have created 1.15 million jobs in 2010 alone.&lt;/p&gt;  &lt;p&gt;None of us know when the economy will improve. But government can speed up the process – especially as we enter the holiday season. The U.S. economy depends on the holidays. The retail industry accounts for 13.4 percent of the nation’s private sector workforce. Department stores, electronics chains and discounters count on holiday sales for more than one-fifth of their total annual revenues.&lt;/p&gt;  &lt;p&gt;We’ve seen what happens when unemployed people don’t shop. In 2008, before Congress approved benefits for the newly unemployed, holiday sales dropped nearly four percent from the previous year. It was the first decline in sales we witnessed since the Department of Commerce began tracking retail sales in 1992.&lt;/p&gt;  &lt;p&gt;During the disastrous 2008 holiday season, retailers hired only 231,000 workers – well under half of the 618,000 hired one year earlier. Fewer sales mean fewer jobs. Fewer jobs mean a sluggish economy and more extended unemployment. And the cruel and vicious cycle of the Great Recession continues. Now, back to work." /><author><name>Bill Newton</name><uri>http://www.blogger.com/profile/18335707182963209639</uri><email>noreply@blogger.com</email><gd:image rel="http://schemas.google.com/g/2005#thumbnail" width="16" height="16" src="http://img2.blogblog.com/img/b16-rounded.gif" /></author><thr:total>0</thr:total><feedburner:origLink>http://fcan.blogspot.com/2010/11/votes-are-counted-now-back-to-work.html</feedburner:origLink></entry><entry gd:etag="W/&quot;Dk8NQHczcCp7ImA9Wx5WEE8.&quot;"><id>tag:blogger.com,1999:blog-10352460.post-3056261514019926603</id><published>2010-09-20T18:21:00.001-05:00</published><updated>2010-09-20T18:21:31.988-05:00</updated><app:edited xmlns:app="http://www.w3.org/2007/app">2010-09-20T18:21:31.988-05:00</app:edited><title>Rick Scott’s Insurance Plan</title><content type="html">&lt;p&gt;Rick Scott released his &lt;a href="http://www.rickscottforflorida.com/home/news/press-releases/2010/09/20/rick-scott-lays-out-tax-and-insurance-plans-to-town-hall-in-miami/" target="_blank"&gt;insurance plan&lt;/a&gt; last week, so we thought we’d provide some analysis.&amp;#160; In just a couple words, Scott’s plan would be unlimited rate increases and tort reform.&amp;#160; That’s the result of Scott’s “free market” approach and anti-lawyer ideology.&amp;#160; Now, the details:&lt;/p&gt;  &lt;p&gt;Scott starts off by saying that Citizens Property Insurance could not pay the damages resulting from a Category 2 storm.&amp;#160; He does not say where he got this information.&amp;#160; I checked Citizens site, and they say they can handle up to $14 billion. They’re doing well because there haven’t been any hurricanes.&amp;#160; So I then looked at the &lt;a href="http://www.economics.noaa.gov/?goal=weather&amp;amp;file=events/hurricane&amp;amp;view=costs" target="_blank"&gt;NOAA site&lt;/a&gt; to find out how much in damages a hurricane might generate.&amp;#160; Bear in mind that many insurance companies bear the cost of damage claims and some people don’t have insurance. &lt;/p&gt;  &lt;p&gt;Ike Cat 2&amp;#160; $27 billion in 9 states   &lt;br /&gt;Gustav Cat 2&amp;#160; $4.3 billion in 4 states    &lt;br /&gt;Dolly Cat 2&amp;#160; $1.2 billion in 2 states    &lt;br /&gt;Wilma Cat 3 $17.1 billion in Florida    &lt;br /&gt;Rita Cat 3 $17.1 billion in 4 states&lt;/p&gt;  &lt;p&gt;Looks like Citizens could handle any of these, no problem.&amp;#160; Scott is apparently trying to scare people by suggesting something may happen that probably won’t happen. This is necessary to make sense of the second part of his plan – eliminating assessments.&lt;/p&gt;  &lt;p&gt;Assessments are on your insurance bill, and people don’t like them.&amp;#160; But people don’t understand them, and that’s fine with Scott.&amp;#160; Assessments are what Citizens does in the event it doesn’t have enough reserves. It means that everyone bears some of the risk from hurricanes. Here’s why that’s good:&lt;/p&gt;  &lt;p&gt;Insurance is founded on the idea of “spreading the risk.”&amp;#160; If one person has a fire and has to pay, it’s a problem unless the person has enough savings, which most don’t.&amp;#160; But if everyone pays into a fund and one person has a fire, its not such a disaster. The government could administer such a fund, but private companies say they can do it better, BUT they want to invest our funds and keep the profits they make in exchange to assuming any risks.&amp;#160; Sadly, private companies reneged on this arrangement by no longer taking everyone.&amp;#160; This makes their profits higher, but makes the system fail. &lt;/p&gt;  &lt;p&gt;Assessments return the structure to health, once again spreading the risk to everyone, more or less equally.&amp;#160; Those that choose the private companies can take advantage of possibly better service and help pay for expensive TV ads. If insurance companies would just take everyone, we wouldn’t have a problem. When they stopped doing that, we (you, the government) had to do something. &lt;/p&gt;  &lt;p&gt;Our coastal areas generate a lot of economic activity that supports much of the rest of the state.&amp;#160; Some states have studied this economic benefit and agreed to subsidize insurance costs in return. Not Florida.&amp;#160; People like Scott have got people thinking they are losing something because they can’t see the benefit, but there is the cost right there on their insurance bill. But there is a benefit, and it is a big one. &lt;/p&gt;  &lt;p&gt;Scott says Citizens is driving private insurers out of the state.&amp;#160; It just isn’t true. We had a big game of poker when State Farm threatened to leave last year, but, as I predicted, State Farm didn’t leave after all.&amp;#160; There’s just too much business in Florida to walk away.&amp;#160; Even Allstate ended up staying, but they changed their name.&amp;#160; What’s happening is that insurers are using computer models to avoid the riskiest customers, and forcing Citizens to accept them. &lt;/p&gt;  &lt;p&gt;The insurance companies say they can’t charge high enough rates, yet they continue to make huge profits.&amp;#160; Just a couple years ago they set new records, and so far this year they’ve made $10 billion dollars in the property and casualty market.&amp;#160; That’s good money in a down economy. But they have been having trouble with their investments in this market, and they try to make that up by charging higher rates.&amp;#160; If they can prove to the Insurance Commissioner that they &lt;em&gt;deserve&lt;/em&gt; higher rates, in accordance with industry standards, they are allowed to charge them.&amp;#160; &lt;/p&gt;  &lt;p&gt;Why do we regulate insurance companies?&amp;#160; First of all, almost nobody outside of the insurance business understand policies and how insurance works, so consumers are at a disadvantage.&amp;#160; Most of us have no idea what’s in our insurance policy and we can’t effectively comparison shop.&amp;#160; We just pick the TV ads we like.&amp;#160; But there’s another special reason for regulation:&amp;#160; insurance companies say they need to exchange data so they can set prices accurately.&amp;#160; That way, a small new company without years of experience in the market, could compete against the big boys.&amp;#160; In other businesses, that would be called collusion or price fixing, but in insurance its legal.&amp;#160; So, we regulate them in exchange for this benefit and to protect consumers who cannot make price comparisons on this product.&amp;#160; This worked for years and years, up until the insurers decided to stop insuring everybody.&lt;/p&gt;  &lt;p&gt;Scott’s plan says “I want to open the property insurance market back up in Florida so that financially solvent private insurers can compete, allowing consumers to choose what they want from a free market.”&amp;#160; This is code for deregulation.&amp;#160; He means he wants to end price regulation, and leave consumers on their own to understand their policies.&amp;#160; That would mean drastic rate increases which would shock the already damaged Florida economy.&amp;#160; When he says “allow consumer to choose” that means the insurance companies can put whatever they want to into your policy and you have to compare that against another policy.&lt;/p&gt;  &lt;p&gt;Regulation means that each company must offer a standard form, or policy that meets the same minimum standards.&amp;#160; That way consumers can make price comparisons.&amp;#160; The other benefit is that society is protected.&amp;#160; If some consumers decided to save money by buying no fire insurance, but their home burns down, who is going to pay?&amp;#160; You can say no one, but that is not how society works. We usually take care of people after a disaster, whether it is the Red Cross or a church or neighbors.&amp;#160; Somebody pays.&amp;#160; Maybe it is the Federal government if it is a big disaster.&amp;#160; This is a problem because we are being forced to pay someone else’s bills.&amp;#160; Sound familiar?&amp;#160; That’s exactly what Scott is complaining about, except he is pandering to a group more likely to vote for him.&amp;#160; That’s politics as usual.&lt;/p&gt;  &lt;p&gt;One more thing is rather ironic about Scott’s proposals.&amp;#160; He seems to be running against the Tallahassee establishment.&amp;#160; But he is a Republican, embraced by the Republican establishment including the Chamber of Commerce and Associated Industries and, surprise, the insurance companies.&amp;#160; Republicans have been in charge in Tallahassee for the last 16 years, so electing another Republican from a corporate background with corporate money isn’t going to make any difference.&amp;#160; Instead, and more moderate voice that might temper our extreme legislature might be in order.&lt;/p&gt;  &lt;p&gt;Finally, Scott rails at length for tort reform.&amp;#160; That has to wait for another post.&amp;#160; But just let me say I know he hates lawyer, like most corporate types, because lawyers are one of the few things big corporations fear. They certainly don’t fear the government, which they can buy and influence at will. But consumers still have rights in the legal system and insurance companies would love to see us lose our right to trial by jury. &lt;/p&gt;  &lt;p&gt;I hope you see through Rick Scott’s rhetoric and analyze what he’s saying.&amp;#160; Many people want to believe him, but that doesn’t make it true.&amp;#160; People want simple solutions to complicated problems, but that often creates worse problems.&amp;#160; Think this through, Florida. Well, it might interest you to know that while most working families are in the economic struggle of their lives, the wealthy are asking for a double dip, and it's not of chocolate ice cream.&lt;/p&gt;  &lt;p&gt;Despite what you might have heard in the media, the tax debate in Washington is not about a tax increase on working and middle-income families. It is about whether the wealthiest Americans will receive not one but two huge tax cuts.&lt;/p&gt;  &lt;p&gt;Let's take a minute and look at how this works. Although some in the U.S. Senate are balking, most observers think that sometime between now and the end of the year, Congress will vote to make the 2001 and 2003 tax cuts for working, middle-income Americans permanent.&lt;/p&gt;  &lt;p&gt;If Congress does this, it's also a tax cut for the wealthiest 1 percent of Americans. That's because the middle-income tax cut applies to the first $200,000 in income for individuals and the first $250,000 for married Floridians filing jointly.   &lt;br /&gt;&lt;/p&gt;  &lt;h3&gt;More for the richest 1 percent&lt;/h3&gt;  &lt;p&gt;In Florida, for example, the wealthiest 1 percent -- an individual making more than $1,710,102 -- will receive an average of $37,173 in 2010 as a result of middle-class tax cuts being made permanent, which President Obama has proposed.&lt;/p&gt;  &lt;p&gt;But if the upper-income tax cuts are extended as well -- something almost all Republicans and a few Democrats favor -- the upper 1 percent of Floridians will receive a total tax break of $115,684 -- a difference of $78,511 between the Obama approach and the Republican approach.&lt;/p&gt;  &lt;p&gt;Interestingly enough, even rank-and-file Republicans are weary of this proposed largess. A recent CNN poll found that exactly 50 percent of Republicans surveyed oppose giving those who make more than $250,000 this huge break. (Among independents, it was 65 percent; among Democrats, 87 percent. Overall, 69 percent want the wealthiest Americans to pay their fair share.)&lt;/p&gt;  &lt;p&gt;By contrast, almost everyone favors continuing the middle class tax cuts -- 82 percent overall, 80 percent of Democrats, 78 percent of independents, 90 percent of Republicans. And remember: The wealthiest Americans still will benefit under Obama's proposal -- an average of $37,173 each for the wealthiest Floridians.&lt;/p&gt;  &lt;p&gt;Robin Hood in reverse&lt;/p&gt;  &lt;p&gt;Florida Consumer Action Network, like President Obama and like most Democrats, supports making the wealthiest Americans pay their fair share. The network is a member of Americans for Responsible Taxes, a coalition of more than 80 national groups. This coalition represents concerned communities and working families united to repeal the Bush-era tax cuts for the wealthiest, reinstate the estate tax to at least 2009 levels, close tax loopholes, and protect working families by rewarding their work with tax relief.&lt;/p&gt;  &lt;p&gt;Those Republicans who oppose responsible taxes say they are concerned about the deficit. But the Robin-Hood-in-reverse approach of making permanent tax cuts for the rich actually would add almost $1 trillion to the deficit.&lt;/p&gt;  &lt;p&gt;When the debate over taxes returns to Washington, D.C., don't be fooled by the terms of debate. Tax breaks for working and middle-income families are responsible and necessary, but the extra tax break for the wealthiest Americans is like giving some folks two dips of ice cream while everybody else gets one.&lt;/p&gt;  &lt;p&gt;Timothy Heberlein is an organizer for the Florida Consumer Action Network (fcan.org). Wayne Huizenga and Dallas philanthropist Peter O'Donnell.”&lt;br /&gt;
People need to know what these people are up to. Big Sugar means US Sugar, which gave McCollum $1.1 million.&amp;nbsp; Sugar companies are using land just above the Everglades and release pollution into the park. It is an appalling situation with corporate profits trumping a national treasure. Not only that, but sugar is federally subsidized.&lt;br /&gt;
Progress Energy just finished a buy out of the Public Service Commission, which “regulates” utilities. Progress and its ally FPL used heavy legislative donations to dump commissioners that voted against rate increases. Only Gov. Charlie Crist got in their way and now they want to buy the last obstacle.&lt;br /&gt;
Wayne Huizenga, billionaire owner or former owner of Republic waste disposal, the Miami Dolphins, and Auto Nation comes out of an industry mired in unsavory political connections.&amp;nbsp; Now he seeks to clean off the muck by association with prominent Republicans. Yuck!&lt;br /&gt;
The courts have thrown out our campaign finance laws and now these corporate titans seek to consolidate their control of our governing institutions. Is anybody else out there upset by this?&lt;br /&gt;
At least you can try to vote for politicians that seem at a distance from these people and you can avoid patronizing their institutions. Congress is going to have to pass new laws on campaign finance reform, and possibly a constitutional amendment. &lt;br /&gt;
Your vote for President matters greatly because the current conservative majority on the Supreme Court recently decided that corporations were equal to people and that campaign contributions are equal to free speech. Hell no!&amp;nbsp; Only the very wealthy (Scott, Green) can equal the power of the corporations and that presents us with an ugly choice:&amp;nbsp; government by the rich or their corporations.&amp;nbsp; &lt;br /&gt;
