Minnesota Supreme Court Says BNSF Not Entitled to New Trial: A Win for Pottroff Law Office

The Minnesota Supreme Court handed down an opinion Wednesday morning that reinstated a jury virdict of $6 million in wrongful death damages for each of the four passengers who were hit by a BNSF train back in 2003. The Court determined that BNSF was not entitled to a new trial and upheld jury instructions that punished BNSF for negligently spoliating evidence.

To punish the railroad, which allegedly began destroying evidence within minutes of the 2003 accident, Judge Ellen Maas awarded $4 million to the victims' families and their attorneys. The award comes on top of $21.6 million from a jury that placed 90 percent of the blame for the accident on Burlington Northern.

BNSF tried to conceal evidence, and as a result the plaintiffs and plaintiff's attorneys (led by Bob Pottroff) are seeking $45 million more in punitive damages for the railroad company's reprehensible actions. Lying and hiding and destroying evidence are unfair and illegal tools in the courtroom which in this case made it impossible for the jury to demand punitive damages.
