Fletman&lt;/a&gt;&lt;/strong&gt; participated in a panel at the recent American Bar Association 2010 Annual Meeting in San Francisco. The panel discussion, entitled &amp;nbsp;&amp;quot;One Step Over the Line: The Long Road from Civility to Hardball and Beyond,&amp;quot; examined numerous &amp;quot;sharp practices and hardball litigation&amp;quot; scenarios that litigators may encounter from opposing counsel. Panel members discussed how small incivilities can lead to more aggravation, &amp;nbsp;but also demonstrated that attorneys who take the high road can gain an advantage over opponents engaged in such tactics.

Ms. Fletman chairs the litigation section of &lt;a href="/"&gt;Flaster/Greenberg&amp;#39;s&lt;/a&gt; &lt;a href="/home/practice-areas/by-practice-area/intellectual-property.aspx"&gt;Intellectual Property Practice Group&lt;/a&gt;, and is the co-chair of its &lt;a href="/home/practice-areas/by-practice-area/government-relations--regulatory-law.aspx"&gt;Government Relations and Regulatory Law Practice Group&lt;/a&gt;.&amp;nbsp; She concentrates her practice in commercial litigation, intellectual property litigation and counseling, and represents government entities in complex litigation. For the past two consecutive years, Ms. Fletman has been named one of the Top 50 Female Attorneys in Pennsylvania by Key Professional Media. &lt;/p&gt;
&lt;p&gt;
&lt;em&gt;(August 10, 2010, Cherry Hill, NJ)&lt;/em&gt; -- &lt;a href="/home/our-people/attorneys.aspx?d=1469"&gt;Richard J. Flaster&lt;/a&gt;, the name partner, founder and President of the law firm &lt;a href="/"&gt;Flaster/Greenberg PC&lt;/a&gt;, passed away suddenly on Monday, August 9, at his home in Cherry Hill. He was 67. 
&lt;/p&gt;
&lt;p&gt;
Mr. Flaster was recognized nationally as an authority on &lt;a href="/home/practice-areas/by-practice-area/taxation.aspx" target="_blank"&gt;tax law&lt;/a&gt;, and still maintained an active practice at the time of his death. He provided legal counsel and advice to closely held businesses on matters involving taxation, pensions, estate planning, corporations, partnerships and limited liability companies, negotiation and documentation of commercial contracts, and purchases and sales of businesses.&amp;nbsp;He also provided counsel to public companies. 
&lt;/p&gt;
&lt;p&gt;
In 1972, he left the New York law firm Stroock &amp;amp; Stroock &amp;amp; Lavan LLP, and formed a two-lawyer tax practice with Emmanuel (&amp;quot;Manny&amp;quot;) Liebman. In 1976, shareholder &lt;a href="/home/our-people/attorneys.aspx?d=1370" target="_blank"&gt;Steve Greenberg&lt;/a&gt;, a graduate of Yale Law School, joined the firm. The name of the firm was subsequently changed to Flaster/Greenberg PC. &amp;nbsp; 
&lt;/p&gt;
&lt;p&gt;
&amp;quot;Throughout Rick&amp;#39;s 38+ years with the firm, he was a true visionary,&amp;quot; stated Flaster/Greenberg managing shareholder &lt;a href="/home/our-people/attorneys.aspx?d=1383" target="_blank"&gt;Peter R. Spirgel&lt;/a&gt;. &amp;quot;He was incredibly creative and truly enjoyed helping his clients. Most importantly, he was a mentor to me and many of us at the firm. We were fortunate to have him as our partner and friend. He will be truly missed.&amp;quot; 
&lt;/p&gt;
&lt;p&gt;
A frequent lecturer and prolific writer, Mr. Flaster wrote and edited numerous articles on tax-related subjects for publications in various professional journals. He had authored two books on tax law and contributed to two other books.&amp;nbsp; His first novel, &lt;em&gt;Authority of Thieves&lt;/em&gt;, was published in 2002. &amp;nbsp;Mr. Flaster was profiled in the &lt;em&gt;Wall Street Journal&lt;/em&gt; in July 2003 in a column entitled &amp;quot;Workspaces,&amp;quot; for the extensive collection of hippos on display in his office. At the time of the article, his collection numbered about 1400 hippos of all shapes and sizes. 
&lt;/p&gt;
&lt;p&gt;
Mr. Flaster is listed in the 2005-2010 editions of &lt;em&gt;The Best Lawyers in America for Tax Law&lt;/em&gt;, and was also included in &lt;em&gt;Who&amp;#39;s Who in America&lt;/em&gt;, &lt;em&gt;Who&amp;#39;s Who in the World&lt;/em&gt; and &lt;em&gt;Who&amp;#39;s Who in American Law&lt;/em&gt;. He was voted one of the best tax lawyers in the region for 2005-2010 in &lt;em&gt;New York Magazine&lt;/em&gt;, and by S&lt;em&gt;J Magazine&lt;/em&gt; as one of the top attorneys in South Jersey for 2005-2010. He was voted a New Jersey &amp;quot;Super Lawyer&amp;quot; in Tax Law for 2005-2010. 
&lt;/p&gt;
&lt;p&gt;
Mr. Flaster attended the University of Pennsylvania where he received a B.S. in Economics in 1963. At Penn, he was a member of &lt;em&gt;Beta Gamma Sigma&lt;/em&gt; (the National Business Students Honor Society), &lt;em&gt;Beta Alpha Psi&lt;/em&gt; (the National Accounting Students Honor Society) and &lt;em&gt;Pi Gamma Mu&lt;/em&gt; (the national Social Science Students Honor Society). He earned his J.D. from Harvard Law School in 1966. 
&lt;/p&gt;
&lt;p&gt;
Mr. Flaster is survived by his wife of 40 years, Esther, who is the theatrical director of the Ritz Theatre in Oaklyn, NJ; son Eben, a lawyer at Dechert; daughter Kiva Flaster Barr, also an attorney; and three grandchildren.

Before joining &lt;a href="/"&gt;Flaster/Greenberg&lt;/a&gt;, Greenberg was the Philadelphia Chief Deputy City Solicitor for Economic Development and Investments, and in that capacity was involved in many of the area&amp;#39;s most significant recent projects, including the Delaware Avenue waterfront; Philadelphia Wi-Fi; the Art Museum facility capital projects and improvements; relocating the Barnes Museum; and introduction of casino gaming to the region.&amp;nbsp; A former general counsel for a software company, Greenberg is regularly involved in technology development and licensing, copyright, trademarks, start-up funding and telecommunications

His prior experience also includes senior staff and advisory roles for major national and regional officials and political campaigns.&amp;nbsp; He was a national policy advisor to the Obama campaign on technology, media and telecommunications, and served as a senior advisor on innovation and national priorities for the Obama Transition Team.

Greenberg received his J.D., &lt;em&gt;cum laude&lt;/em&gt;, from the University of Pennsylvania School of Law, where he was a senior editor of the &lt;em&gt;Law Review&lt;/em&gt;. &lt;em&gt;(Philadelphia, PA - July 13, 2010) &lt;/em&gt;&amp;nbsp;A Federal judge in the U.S. District Court for the District of Delaware yesterday (July 12, 2010) granted class action status to a lawsuit filed by Delaware State University (DSU) equestrian team members suing DSU for violating Title IX by eliminating the women&amp;#39;s equestrian team at the conclusion of the 2009-10 academic year, and failing to provide equal athletic opportunities for female students. &amp;nbsp; 
&lt;/p&gt;
&lt;p&gt;
The Court certified a class of &lt;em&gt;&amp;quot;all present, prospective and future DSU female students, including currently enrolled students, students admitted for the 2010-11 academic year, and prospective students who participate, seek to participate, or have been deterred or prevented from participating in or obtaining the benefits of, intercollegiate athletics sponsored by DSU. &lt;/em&gt;The Court&lt;em&gt; &lt;/em&gt;approved the eight named plaintiffs as representatives of the class, and designated &lt;a href="/home/our-people/attorneys.aspx?d=1365" title="/home/our-people/attorneys.aspx?d=1365"&gt;Abbe F. Fletman&lt;/a&gt; of &lt;a href="/" title="/"&gt;Flaster/Greenberg PC&lt;/a&gt; and Terry L. Fromson of the Women&amp;#39;s Law project as class counsel.

&amp;quot;Certification of class action status is significant because it allows the plaintiffs, all of whom are enrolled DSU student-athletes, to represent the interests of current and future DSU female students,&amp;quot; stated Fromson.&amp;nbsp; &amp;quot;We are pleased with the ruling,&amp;quot; stated Fletman, &amp;quot;because we are seeking to achieve long-term gender equity in sports at DSU.&amp;quot;&amp;nbsp;

&lt;p&gt;
The student-athletes brought the lawsuit in February of this year under Title IX of the Education Amendments of 1972, the federal law that prohibits sex discrimination in federally funded educational programs, and specifically applies to athletic programs. Title IX requires equity in scholarships, accommodation of athletic interests and abilities, and treatment.&amp;nbsp; In April, the Court entered an order continuing the women&amp;#39;s equestrian team through the end of the 2010-11 academic year.&amp;nbsp; Trial is scheduled to commence on October 18, 2010.

&lt;strong&gt;&lt;em&gt;Atlantic City, NJ (July 7, 2010)&lt;/em&gt;&lt;/strong&gt;&lt;strong&gt; &lt;/strong&gt;- &amp;nbsp;A Superior Court Judge in Atlantic County has ruled against the Bank of New York and dismissed its foreclosure action, for failing to prove that the bank owned the defendant&amp;#39;s promissory note on the date the case was filed. The ruling, announced on June 29, indicated that, while no New Jersey cases had addressed this issue, dismissal of the complaint was appropriate since the bank simply could not show the court that the bank had the ownership interest to enforce the defendant&amp;#39;s debt when the bank filed its complaint. The court also indicated that, in the event a loan being foreclosed was assigned as part of a large package of many loans, i.e, &amp;quot;securitization,&amp;quot; a bank whose right to bring suit was challenged, would be required to produce the documents which show the title transfer chain from the party who originally made the loan, to the party foreclosing the mortgage. Because the majority of foreclosure actions go unchallenged by borrowers, such proof is seldom demanded of a foreclosing plaintiff.

&lt;p&gt;
&amp;quot;What this ruling means,&amp;quot; stated &lt;strong&gt;&lt;a href="/home/our-people/attorneys.aspx?d=1315"&gt;Eric C. Garrabrant&lt;/a&gt;&lt;/strong&gt;, a shareholder with the law firm &lt;u&gt;&lt;a href="/"&gt;Flaster/Greenberg PC&lt;/a&gt;&lt;/u&gt;, and the attorney for the defendant who challenged the bank&amp;#39;s action, &amp;quot;is that the party bringing suit must establish, with definiteness never before articulated by New Jersey courts, that the borrower owes the money to the party filing the law suit,&amp;nbsp; on the date they file suit.&amp;nbsp; Furthermore, because the process of securitization is so complex, and involves so many loans being transferred among so many entities, gathering that proof in future cases may not always be easy.&amp;nbsp; Hopefully, the ruling will help borrowers who have been trying in good faith to work out the terms of their loans, by allowing the borrower to be assured that the party asking for the money is really owed the money.&amp;quot;&amp;nbsp; 
&lt;/p&gt;
&lt;p&gt;
With the number of foreclosures surging, the ruling may renew hope for borrowers who legitimately question whether they owe money to the party demanding payment.&amp;nbsp; In many such cases, the loans have been conveyed to the point where borrowers cannot ascertain with certainty exactly what entity is the real holder of their loan.&amp;nbsp; But it may present a new challenge for lenders seeking repayment, as they traverse the same convoluted paper trail to prove they own the note and the mortgage on a particular property.&amp;nbsp;

Tomasco&lt;/a&gt;&lt;/strong&gt; have joined &lt;a href="/"&gt;Flaster/Greenberg&lt;/a&gt; as associates in the &lt;a href="/home/practice-areas/by-practice-area/litigation.aspx"&gt;Litigation Department&lt;/a&gt;, resident in the Cherry Hill office of the firm, effective May 18 and June 7, respectively.&amp;nbsp;&amp;nbsp;&amp;nbsp; Mr. Satchell focuses his practice on commercial litigation matters including antitrust, re-insurance, bankruptcy and complex commercial litigation; and Mr. Tomasco focuses his practice on commercial litigation matters.

Prior to joining &lt;a href="/"&gt;Flaster/Greenberg&lt;/a&gt;, Mr. Satchell was associated with a large national law firm, where he represented a major bank, a Fortune 500 company and a multinational corporation in complex litigation matters.&amp;nbsp; Prior to the private practice of law, he was a legal intern with the Philadelphia District Attorney&amp;#39;s office and also served as a summer intern in the United States Attorney&amp;#39;s office.

&lt;p&gt;
Mr. Satchell graduated &lt;em&gt;magna cum laude&lt;/em&gt; from Temple University and later earned his J.D. in 2008 from the University of Pennsylvania School of Law.&amp;nbsp; At the University of Pennsylvania, he was senior editor of the &lt;em&gt;Journal of Law and Social Change&lt;/em&gt;; a Max Rosen Scholarship recipient from 2005 to 2008; and a captain of the Frederick Douglass Moot Court Competition team.

Prior to joining &lt;a href="/"&gt;Flaster/Greenberg&lt;/a&gt;, Mr. Tomasco was an associate at a national law firm, where he concentrated his practice on the defense of pharmaceutical manufacturers in products liability actions and government investigations.&amp;nbsp; He previously was a Legal Intern in the Office of the City Solicitor in Waltham, M A. Prior to his legal career, he was a research analyst with a real estate development firm in Washington, D.C.
