Just look around you, big real estate developers are doing it. They buy big tracts of land (some of them are bank <a href="http://www.foreclosurephilippines.com/foreclosedproperties" style="" target="_blank"  onmouseover="self.status='http://www.foreclosurephilippines.com/foreclosedproperties';return true;" onmouseout="self.status=''">foreclosed properties</a>), build their projects, and sell them for a huge profit.</p>
<p>You might be thinking <em>&#8220;Sounds great Jay, but I am not a real estate developer, build and sell is for the big boys, and I don&#8217;t have that much capital, resources, expertise, blah, blah blah..&#8221;<span id="more-10948"></span></em></p>
<p>Well, I have to admit that building and selling real estate requires more capital, resources, and expertise (especially with the building part). But think about it, these developers were not as big as they are now when they started right?</p>
<p>Anyway, I believe that a real estate investor should aim to become a real estate developer, and it really is possible. He just needs to dream big, start small, and learn as much as he can from someone who has also done it, and take action! <h2><em>LECTURER’S  PROFILES</em></h2>
<p><em><strong>ENGR. ENRICO S. CRUZ</strong> has more than 40 years of working experience in the field of engineering, construction, real estate and education. As a Civil Engineer, he taught after graduation for five years in his alma mater, Central Colleges of the Philippines and at the same time, he manages his own construction company, Enrico Engineering and Management Services.  He was the Vice-Dean for Engineering for two years.</em></p>
<p><em>He placed 1st in the real estate appraisal board examination in 1994 and 8th in the real estate broker’s board examination in 1988. He is also a licensed real estate consultant and a real estate fellow.</em></p>
<p><em>His past membership in real estate organizations includes the Chamber of Real Estate and Builders Associations, Inc. (CREBA), Real Estate Brokers Association of the Philippines (REBAP), where he was past president of the Marikina Chapter; Philippine Council of Real Estate Educators (PHILCORE) and Philippine Association of Realty Appraisers (PARA).</em></p>
<p><em>At present, he is the President of URBAN Institute of Real Estate engaged in real estate education; United Realty Brokers and Appraisers Network, engaged in realty brokerage, appraisal and consultancy. He is also the former Chief Operating Officer of First Amson Realty Development Corp. that was involved in housing and land development.</em></p>

<h2><em>Introduction: Build and Sell Mentoring Program</em></h2>
<p><em>This program is not a college-diploma course.</em></p>
<p><em>This is simply directly learning the practical and applicable but extensive knowledge needed so that the participants can immediately go into the business of real estate Build and Sell and come out successful.</em></p>
<p><em>This program shall consist of at least 18 once-a-week lectures of 4 hours or more and 7 Sundays of visits to proposed, ongoing and completed BUILD &amp; SELL construction site, and related activities.</em></p>
<p><em>All lectures will  be conducted at the Jose Yulo Caseroom, Asian Institute of Management,Makati, Saturdays, 1:30 to 6:00 PM from June 9 to October 6.</em></p>

Also there would be group discussions, group presentation to the class, and group and individual assignments which shall be done days before the scheduled lecture hour.</em></p>

	<p class="wp-caption-text">Everyone needs a break!</p>

<p>I love writing! It’s my passion. I feel so alive when I write. I remember a time when I didn’t leave the house for a couple of days because I was so glued to the book I was writing.</p>
<p>Last year, I took a two month (unpaid) vacation from work so I could write some books. I wrote from 7am until past 1am only to wake up very early again the next day because I was excited to resume writing.</p>
<p>Yes, that was how addicted I was to my passion. The result? <strong>Burnout</strong>.</p>
<p>I believe that while we love what we’re doing, perhaps our job or our business, it’s very important to <strong>take a break and rest</strong>. If you don’t enjoy your job, the more that you need to take a break and re-charge.</p>
<h2>Take a break and rest&#8230;</h2>
<p>What is rest? Rest doesn’t mean not doing anything. According to Saint Josemaria Escriva, rest means doing something different. For instance, rest may mean playing badminton, watching TV, praying, bonding with your family and friends, visiting the sick and the poor, playing with children, or reading by the beach.</p>
<p>Have you noticed that when you are too tired and your mind is preoccupied, you oftentimes end up making irrational decisions and actions? You easily get irritated. You are panicky.</p>
<p>When I am tired, my mind is so slow. One time, my friend was talking to me but I just stared at her with a blank face, trying to digest what she’s asking even if her question then was as simple as <em>“what do you want to order?”</em> When I am stressed out, my defenses are also down and I easily get affected by what’s happening in my surroundings. Thus, I make it a point to take a<strong> rest and relax</strong> so I always feel refreshed and in top shape for work.</p>
<h2>Rest and relax&#8230;</h2>
<p>I love taking vacations to rest my tired body and to re-energize my mind to think creatively.</p>
<p>Perhaps one of the best vacations I had was when I went on a pilgrimage to Europe for two weeks. My friends and I visited three European countries and 8 cities. We toured Paris, Versailles, Lourdes, Barcelona,  Madrid, Catalonia, Rome, and Milan. It was a surreal experience for me to see The Eiffel Tower, Vatican City, and the Lourdes Grotto, among others.</p>
<h2>&#8230; while you earn passive income!</h2>
<p>When I came back to the Philippines, I read an email that told me I had earned something while I was on vacation. The income I earned is called<strong> passive income.</strong></p>
<p>I wanted more people to know more about passive income so I wrote the eBook <strong><em><a href="http://seminarphilippines.com/2011/09/how-to-earn-while-on-vacation/ " target="_blank">How to Earn While on Vacation with a Foreword by Bo Sanchez.</a></em></strong></p>

<p>I attended the 40th <a href="http://www.foreclosurephilippines.com/2012/05/the-next-rcbc-savings-bank-foreclosed-properties-auction-may-19-2012.html" target="_blank">RCBC Savings Bank foreclosed properties auction last May 19, 2012</a> and noted that there were a lot of properties left unsold. Interested bidders can still submit offers for the remaining unsold properties, which you can find in the post-auction listings below.</p>
<p>I have included listings of unsold properties from RCBC and Jose P. Laurel Bank, whose foreclosed properties were also included in the auction.</p>
<h2>How do I submit an offer?</h2>
<p>Interested bidders may submit their offers for the remaining unsold properties through a Purchase Proposal form. I will send a copy of the form to those who will inquire by filling-up the inquiry form below.</p>
<h2>What are the payment terms?</h2>
<p>The payment terms fort RCBC Savings Bank foreclosed properties are still the same which I have quoted below:</p>

<h3><em>Minimum Downpayment</em></h3>
<ul>
<li><em>10% for vacant lots</em></li>
<li><em>20% for properties with improvements.</em></li>
</ul>
<p><em>*Note: 25% downpayment is required to occupy a property.</em></p>
<h3><em>Payment Term</em></h3>
<ul>
<li><em>The balance is payable up to 10 years at 12% annual interest rate. A shorter payment term can mean a lower interest rate.</em></li>
</ul>
<p><em>*For installment payment, winning bidders are required to submit financial documents (usually within 5 working days after the auction) so that the bank can proceed with their credit investigation. Once the winning bidder passes the credit investigation, he/she will receive a Notice of Approval/Written Conformity from the bank, and the full downpayment should be completed approximately within 5 to 7 days from the Notice of Approval/Written Conformity.</em></p>

The properties on the list that are marked with an asterisk (*) are properties with special concerns (</strong><strong>highlighted in yellow on the list).</strong> These properties may be occupied and/or have legal impediments. If this is your first time to invest in <a href="http://www.foreclosurephilippines.com/foreclosedproperties" style="" target="_blank"  onmouseover="self.status='http://www.foreclosurephilippines.com/foreclosedproperties';return true;" onmouseout="self.status=''">foreclosed properties</a>, I highly suggest you skip these kinds of properties for now, unless you know what you are doing. Please be guided accordingly.</p>
<p><strong>2. If you are interested but are currently outside of the Philippines: </strong>Please keep in mind that you need to have trusted relatives or representatives in the Philippines who can inspect the property for you as part of due diligence, and can sign contracts on your behalf (if you decide to proceed with the purchase), through an authenticated/consularized Special Power of Attorney or SPA.</p>

<p>During the <a href="http://www.foreclosurephilippines.com/2012/04/rcbc-savings-bank-foreclosed-properties-auction-april-21-2012.html" target="_blank">auction last month</a>, it was mentioned that more foreclosed properties from RCBC Savings Bank will be available in their next auction this May 2012.</p>
<p>It&#8217;s official! Their next auction which includes more <a href="http://www.foreclosurephilippines.com/foreclosedproperties" style="" target="_blank"  onmouseover="self.status='http://www.foreclosurephilippines.com/foreclosedproperties';return true;" onmouseout="self.status=''">foreclosed properties</a> will be on May 19, 2012, Saturday, at 9:00am, at the 6th Floor, Development Academy of the Philippines Building, San Miguel Avenue, Pasig City, Philippines.</p>
<p>Aside from their new inventory of foreclosed properties, those left unsold during their previous auction(s) will also be available. The list includes foreclosed properties from the Metro Manila and Luzon areas.</p>

<p>Interested bidders only need to bring government issued ID&#8217;s, show money of Php25,000/property in the form of cash or Manager&#8217;s Check to participate and bid.</p>
<h2>Auction terms</h2>
<h3>Minimum Downpayment</h3>
<ul>
<li>10% for vacant lots</li>
<li>20% for properties with improvements.</li>
</ul>
<p><em>*Note: 25% downpayment is required to occupy a property.</em></p>
<h3>Payment Term</h3>
<ul>
<li>The balance is payable up to 10 years at 12% annual interest rate. A shorter payment term can mean a lower interest rate.</li>
</ul>
<p><em>*For installment payment, winning bidders are required to submit financial documents (usually within 5 working days after the auction) so that the bank can proceed with their credit investigation. Once the winning bidder passes the credit investigation, he/she will receive a Notice of Approval/Written Conformity from the bank, and the full downpayment should be completed approximately within 5 to 7 days from the Notice of Approval/Written Conformity.</em></p>

<h2>Things to remember before you inquire</h2>
<p><strong>1. The properties on the list that are marked with an asterisk (*) are properties with special concerns.</strong> <strong>I have highlighted these in yellow on the list below so you can see them easily</strong>. These properties may be occupied and/or have legal impediments. If this is your first time to invest in foreclosed properties, I highly suggest you skip these kinds of properties for now, unless you know what you are doing. Please be guided accordingly.</p>
<p><strong>2. If you are interested but are currently outside of the Philippines: </strong>Please keep in mind that you need to have trusted relatives or representatives in the Philippines who can inspect the property for you as part of due diligence, and can sign contracts on your behalf (if you decide to proceed with the purchase), through an authenticated/consularized Special Power of Attorney or SPA.</p>
<p><strong>3. If you plan to attend the auction on May 19, 2012 and get me as your real estate broker</strong>, I will give you a briefing on what to expect during the auction, and I will answer most of first-time bidder&#8217;s frequently asked questions. Same goes for those who want to submit offers after the auction for unsold properties. Keep in mind that I myself have purchased properties from RCBC Savings Bank and I am confident my experience will help me serve you better, and this is at no additional cost to you.</p>

Yes, I have been fixing things up although the site has been always available, at least most of the time, when my web <a href="http://www.foreclosurephilippines.com/hostgator" style="" target="_blank"  onmouseover="self.status='http://www.foreclosurephilippines.com/hostgator';return true;" onmouseout="self.status=''">hosting</a> company is not having problems  of their own. This obviously affects this blog as well, and provides a clue on what is happening and what is coming.<span id="more-10810"></span></p>
<p>Anyway, during this maintenance period, some functionality was disabled and these would definitely affect things like site navigation, etc. Because it might hamper or even annoy people who are looking for listings per bank, or any of the topics I have written about in the past, I have restored these through the &#8220;Topics and Listings&#8221; and &#8220;Read our Archives&#8221; sections in the right-side bar, temporarily.</p>
<p>Rest assured, the site is undergoing maintenance not only to continue, but also to provide better<em> &#8220;public service&#8221;</em> to all our valuable readers and subscribers as I continue to share my listings of <a href="http://www.foreclosurephilippines.com/foreclosedproperties" style="" target="_blank"  onmouseover="self.status='http://www.foreclosurephilippines.com/foreclosedproperties';return true;" onmouseout="self.status=''">foreclosed properties</a>, along with practical real estate investing tips that apply to the Philippine setting.</p>
<p>The site maintenance would also explain why I have not been posting as much as I want and as often as before.</p>
<p>In the meantime please bear with us as things will definitely be better when the maintenance is finished and I would also appreciate any comments and/or suggestions (feature requests) you may have.</p>
<p>For now, I can only say that you will definitely notice it when site maintenance is finished, so please watch for it. Thank you!</p>

<p><em>Anyone who intends to acquire a peace of real estate or who intends to go into any real estate business should be aware of the importance of knowing the different legal aspects of a real estate transaction. This will prevent being swindled or victimized by unscrupulous operators and in other cases avoid misunderstandings that may result to expensive and time consuming judicial court proceedings.</em></p>
<p><em>This lecture will cover the basic laws on Sales and Lease more particularly on contract of sales and contract of lease, legal letters and notices, ejectment and many other legal questions.</em></p>

<h2 style="text-align: center;"><em>TAXATION OF REAL ESTATE SALES AND LEASES</em></h2>
<p><em>In any real estate investment or project, all the revenues and expenses were estimated and pre-determined at its very start or conception, serving as the basis for the acceptance or rejection of the proposed investment. The realization of the projected revenues and expenses can negatively be affected by unforeseen events. One of such is tax penalties and surcharges that can be brought about by neglect, ignorance or incapacity to pay on the part of the investor. Considering that there are frequent changes and issuances of new revenue regulations, new and would be investors and even experienced ones should be knowledgeable and updated on the changes in the taxation rules in order to pay the correct taxes at the right time, thus avoiding penalties. Includes detailed lectures on Capital Gain Tax, withholding Tax, Documentary Stamp Tax, Value Added Tax and all taxes to be paid in connection with buying, leasing and selling real properties. This also includes what taxes to pay in any real estate transaction, basis and how to compute taxes, when and where to pay, BIR forms, exemptions from taxes.</em></p>

<h2 style="text-align: center;"><em>HOW TO MANAGE AND MAXIMIZE INCOMES OF RENTAL PROPERTIES</em></h2>
<p><em>The common mounting problem of property lessors, who are sometimes forced to sell their properties are, among others, high vacancy, defaulting and problematic tenants, increasing cost of repair and maintenance, increasing property taxes and harsh zoning ordinances and others.</em></p>
<p><em>While these situations provide good business opportunities to other real estate investors who have management skills and know-how to overcome such problems, present owners should also aim to gain more skills and knowledge to avoid such unwarranted liquidation of their properties.</em></p>
<p><em>The seminar will cover the following topics: reasons for property management; the property management functions, objectives, organization and designations; important and must-include provisions in the lease contract; advertising; correct tenant selection; how to retain good tenants; how to solve common problems with tenants; rent escalation clauses; collection techniques; property maintenance; how to avoid unnecessary repair expenses; insurance; budgeting and recording; hiring professional property managers; management contracts; and other related subjects.</em></p>
<h2><em>LECTURERS’ PROFILES</em></h2>
<p><em><strong>ENGR. ENRICO S. CRUZ</strong> has almost 40 years of working experience in the field of engineering, construction, real estate and education. As a Civil Engineer, he taught after graduation for five years in his alma mater, Central Colleges of the Philippines and at the same time, he manages his own construction company, Enrico Engineering and Management Services. He was the Vice-Dean for Engineering for two years.</em></p>
<p><em>He placed 1st in the real estate appraisal board examination in 1994 and 8th in the real estate broker’s board examination in 1988. He is also a licensed real estate consultant and a real estate fellow.</em></p>
<p><em>His past membership in real estate organizations includes the Chamber of Real Estate and Builders Associations, Inc. (CREBA), Real Estate Brokers Association of the Philippines (REBAP), where he was past president of the Marikina Chapter and Philippine Council of Real Estate Educators (PHILCORE).</em></p>
<p><em>At present, he is the President of URBAN Institute of Real Estate engaged in real estate education; United Realty Brokers and Appraisers Network, engaged in realty brokerage, appraisal and consultancy. <p><em>Rex Cruz has a degree in Bachelor of Science in Commerce Major in Legal Management from De La Salle University – Manila. After graduation in 1992, he went to law school and obtained his Bachelors of Laws from San Sebastian College Recoletos. He became a member of Philippine Bar in 1998.</em></p>
<p><em>He first made use of his law degree as professor in prestigious educational institutions such as De La Salle University and East Asia College, where he has been a part-time faculty member for more than 10 years now. He teaches various commercial law subjects and business courses. He is likewise a regular lecturer at the URBAN Institute of Real Estate.</em></p>
<p><em>Among his professional exposure is a stint in the Philippine Senate as a Legislative Staff Officer in the Office of Senator Nikki Coseteng and Freddie Webb and later as Consultant to the President, serving as the Chief of the Legal Division of the Cooperative Development Authority.</em></p>
<p><em>At present, he is one of the Assistant Vice Presidents in the Legal Department of SM Investment Corporation. He also maintains a modest law office and serves as adviser to a number of national and local government officials.</em></p>

Once you have made a reservation to attend a seminar, you may still cancel your reservation seven (7) days before the seminar takes place and this will entitle you to a full refund of your payments. Let me start with the post auction listing for the <a href="http://www.foreclosurephilippines.com/2012/04/184th-unionbank-foreclosed-real-estate-auction-metro-manila-luzon-april-28-2012.html" target="_blank">184th Special Public Auction of UnionBank foreclosed properties</a> held last April 28, 2012.<span id="more-10767"></span></p>
<h2>What is a post auction listing?</h2>
<p>If you have been following this blog early on, you already know what a post auction listing is. But for the benefit of those who don&#8217;t know yet, a post auction listing is simply a blog post where I share an updated listing which includes the foreclosed properties that were <strong>not sold</strong> during the auction, and are still available for negotiated sale.</p>
<h2>What happened during the auction</h2>
<p>I was early this time as EDSA traffic was relatively light. It seems the MMDA and Maynilad decided not to do any road maintenance or diggings unlike past Saturdays&#8230; thank God!</p>
<p>Because I was early, I had a chance to chat with fellow real estate investor friends of mine, who just happened to be there as well, and were about to bid on a foreclosed property.</p>
<p class="alert"><em><strong>Tip:</strong> Always be early when attending auctions. There&#8217;s no point in stressing yourself out because you were late. By being early, you also have spare time to mingle and talk to others who are also present (other bidders, real estate investors, real estate brokers, bank officers, etc.), aside from having ample time to register, review the auction guidelines, and get clarifications if needed.</em></p>
<p>I attended the auction mainly because someone inquired about a couple of properties in UnionBank&#8217;s listing and I was there just in case he decided to attend and would need my assistance. Anyway, he wasn&#8217;t able to make it to the auction, but I hope he gets to read the post auction listing below for his reference.</p>
<p>I also had a guest who attended as an observer to learn how a foreclosed property auction goes. Speaking of observers, I also noticed a number of TRP seminar attendees who were there to observe the auction proceedings.</p>
<p>I noticed this was a very well attended auction, the venue was quite full, and there were a lot of interested bidders. As usual, the auction went smoothly, it was very well organized, and it was finished in less than an hour. Nice!</p>

Bear in mind that interested parties may have already submitted offers the following Monday after the auction. All are advised to confirm availability of the properties on the list.</p>

<p>If you are interested in submitting an offer for any of the available foreclosed properties on the list, you may submit your offer prior to the next auction of UnionBank (I am still waiting for the next auction date). All offers are subject to the bank management&#8217;s approval.</p>
<p>I have a recommended template interested parties can use to submit an offer, but I cannot publish it here as I have not yet obtained permission to do so. If you need assistance with submitting an offer, or if you have any questions, just let me know by leaving a comment below.</p>

More so with foreclosed properties. This is because all foreclosed properties are for sale on an <strong>&#8220;as is where is&#8221;</strong> basis. But what does <strong>&#8220;as is where is&#8221;</strong> really mean?! Yes, I still get a lot of questions asking what this means, so I will try to answer it here.<span id="more-8801"></span></p>
<h2>What does the term &#8220;<a href="http://www.foreclosurephilippines.com/asiswhereis" style="" target="_blank"  onmouseover="self.status='http://www.foreclosurephilippines.com/asiswhereis';return true;" onmouseout="self.status=''">AS IS WHERE IS</a>&#8221; mean?</h2>
<p>In a nutshell, I believe the term <strong>“as is where is”</strong> simply means that the buyer will inherit all of the physical and legal conditions of the foreclosed property they are going to buy, as is! In essence, the <strong>definition of &#8220;<em>as is where is&#8221;</em></strong> can be summarized as, <strong>you get everything that comes with a property, at its present condition, good or bad, when you buy it</strong>.</p>
<p>For example, if a property badly needs repairs, or if it has illegal occupants, or if the title of a foreclosed property has a problem, or if it is located beside a garbage dump or cemetery, etc, the buyer expressly agrees to buy the property in such condition. Any costs related to fixing any of these problems will be for the account of the buyer.</p>
<p class="alert"><em><strong>Tip:</strong> There are banks who shoulder arrears for real property taxes, condo or home owners association dues, electricity, water, etc., up to the date the property was purchased. You just need to verify this before you enter into a binding agreement, or before you make a bid during an auction.</em></p>
<p>This is the reason why banks highly encourage interested buyers to verify the physical and legal conditions of the <a href="http://www.foreclosurephilippines.com/foreclosedproperties" style="" target="_blank"  onmouseover="self.status='http://www.foreclosurephilippines.com/foreclosedproperties';return true;" onmouseout="self.status=''">foreclosed properties</a> before they buy. Banks expect interested buyers to have already done their due diligence BEFORE the auction, or before signing a binding contract.</p>
<p>This leads to another common question:</p>
<h2><em>&#8220;But shouldn&#8217;t the bank just tell me upfront if a foreclosed property has any problems, issues, special concerns, etc?&#8221;</em></h2>
<p>While interested buyers can expect banks to have a full disclosure policy and disclose any information they have about their foreclosed properties for sale, I still believe that a prudent buyer should always do his/her own due diligence to verify if a target property has any pending court cases or lis pendens, liens, encumbrances, physical defects, or any technical problems/discrepancies, etc, just in case the bank was not aware of them, if any.</p>
<p>In other words, while you can expect the bank to tell you things as they really are, you still need to do your part by asking the right questions. <h2>Conclusion</h2>
<p>I hope this has answered the question <em>&#8220;What does <strong>as is where is</strong> mean?&#8221; </em>and has further highlighted the need for due diligence. Remember, it does not matter if you are a real estate investor or if you are just looking for your own home, you still have to do your due diligence. It can help you distinguish a bad deal from a good one.</p>
