Hola, estoy encantado de que hayas seguido este blog hasta ahora. Lo abrí como una ampliación de la sección "Pirata" de mi blog principal Crónicas Subterráneas, sin embargo he decidido que vuelva a donde estuvo originalmente. Por ello, cierro este blog para volver a concentrar sus posts en su lugar original.

BitTorrent Admins Face Six Years in Jail After Spanish Govt. Approves New Bill

From previously being exceptionally lenient on those publishing links to copyrighted files without permission, Spain is now well on its way to cracking down on the problem. Amendments to the country’s penal code approved yesterday means that admins of sites offering links to copyrighted works without the owners’ permission could face jail sentences of up to six years. For individual file-sharers and those operating P2P software, the outlook is much better.

Spain has long been a thorn in the side of United States-based entertainment companies. File-sharing is somewhat of a national pastime and efforts to crack down on the activity have been met with some words and also legislation, but very little action.

In January 2012 it was revealed that the United States had threatened to put Spain on a trade blacklist but just months later the country responded by introduced the so-called Sinde Law which was designed to offer greater protections for copyright holders. However, even though the legislation included provisions to close infringing sites, there was clearly no appetite to do so.

Now, a year-and-a-half on, Spain is having another go at appeasing the United States. Under new measures approved yesterday, operators of file-sharing sites – who up until now have been able to operate fairly freely – could have to face a harsh new reality.

The Government-approved amendments to the penal code target owners and administrators of file-sharing sites that link to content hosted elsewhere. Previously these types of sites remained within the law provided they didn’t profit directly from a file-sharing transaction. Under the new amendments, those making even indirect profit from an infringement (such as via advertising) now face jail sentences of up to six years.

But while the government has signaled a crack down in one area, it insists that flexibility will remain in others, particularly against basic search engines and regular users.

“In no case will we act against regular users, neutral search engines, or against P2P programs that allow the sharing of content,” Minister Alberto Ruiz Gallardón said.

The idea of going after sites and not users was welcomed by local writer Lorenza Silva.

“You can not criminalize the entire population,” he told Elpais. “But making life difficult for the biggest contributor to the problem and going after those who generate the most benefits from it is the right strategy.”

But already questions are being raised over the new amendments. To show that a file-sharing site operator has committed a crime under the law it will be necessary to show that there has been a “significant breach of intellectual property rights” but there are no clear guidelines on what that actually means.

And for Spain, a country in which it is commonplace to buy counterfeit DVDs on the streets and where youth unemployment has reached 56%, there are many who think the government has got its priorities wrong.

“To jail? We’re not going to put anyone in jail for copying a disc or links. It sounds more like a pantomime,” local rock musician Sr Chinarro told Elpais.

Now that the Cabinet has approved the amendments they will head over to parliament for debate. Only time will tell if the government will really follow through with its threats against local sites or whether the population will respond by spending more money on media in any meaningful way. While there is a chance of the former, the latter seems a distant dream.

Las mayores empresas de telecomunicaciones estadounidenses están promoviendo legislaciones más laxas en cuanto a la protección de los datos privados de sus clientes.
Según el diario de negocios británico 'Financial Times', al menos dos compañías de este tipo, Comcast y Verizon, están presionando mediante 'lobbies' para cambiar las normas de regulación estatal de su mercado.

Esta medida les permitiría vender los datos sobre el uso telefónico y de otros servicios que ofrecen, al igual que lo hacen Google y Facebook. El proyecto se está llevando a cabo desde hace más de diez años, bajo el nombre de 'Echelon'. Lo que los norteamericanos están tratando de hacer es beneficiarse del espionaje industrial, es el interés número uno, con la excusa de las medidas contra el terrorismo.

Estas maniobras fomentan la desconfianza entre una buena parte del público, dado que no solo el Gobierno intenta acceder a sus datos, sino también las compañías privadas.

La información ha surgido en medio de debates sobre la amenaza a la privacidad de los estadounidenses provocados por las revelaciones sobre la vigilancia estatal hechas por el extécnico de la CIA Edward Snowden en junio pasado.

Pese a que estas prácticas están saliendo ahora a luz, expertos afirman que se utilizan desde hace varios años.

"El proyecto se está llevando a cabo desde hace más de diez años, bajo el nombre de 'Echelon'. Lo que los norteamericanos están tratando de hacer es beneficiarse del espionaje industrial, es el interés número uno, con la excusa de las medidas contra el terrorismo", comentó el escritor y analista político Charles del Campo.

El sistema Echelon, creado en la época de la Guerra Fría por EE.UU. para controlar las comunicaciones militares y diplomáticas de la Unión Soviética, mantiene bajo su control el 90% de las comunicaciones a nivel mundial. Además dispone de al menos 120 estaciones fijas y satélites geoestacionarios. Al igual que el programa PRISM, el Echelon fue fraguado por la Agencia de Seguridad Nacional (NSA).

La red de espionaje masivo, conocida también como 'Cinco Ojos', es capaz de interceptar al menos 3.000 millones de llamadas telefónicas, emails y faxes cada día. Las bases y satélites están instalados por todo el mundo, empezando por las grandes redes de complejos en EE.UU., Canadá y Reino Unido, hasta Australia o Nueva Zelanda.

El FBI sabe activar a distancia los micrófonos de los 'laptops' y los dispositivos Android

Mientras que la Agencia de Seguridad Nacional de EE.UU. ha sido blanco de la mayor parte de las recientes críticas por espiar a la gente a través de internet y el teléfono celular, el FBI parece tener su propio sistema de ciberespionaje.

De acuerdo con un artículo de 'The Wall Street Journal', el FBI ha desarrollado sus propias herramientas de vigilancia parecidas a las que usan los 'hackers' para recopilar información contra sospechosos, incluyendo los 'troyanos', 'spyware' y 'malware'. Supuestamente, el FBI creó algunos de estos instrumentos internos, mientras que otros fueron comprados.

El FBI "contrata a las personas que tienen habilidades de 'hacking', y adquiere herramientas que son capaces de hacer estas cosas", dijo un exfuncionario de la división cibernética del FBI al diario 'Wall Street Journal'. El funcionario también reveló que estas herramientas solo se utilizan cuando otros métodos de vigilancia no funcionan.

La tecnología más alarmante es una herramienta que supuestamente permite al FBI activar remotamente los micrófonos en los dispositivos Android. Una vez activado el micrófono, la oficina puede grabar conversaciones sin que el propietario del dispositivo lo sepa. Esta herramienta puede hacer lo mismo con los micrófonos de los 'laptops'. Según el periódico, el FBI ha estado supuestamente trabajando con estas herramientas de 'hacking' durante más de 10 años.

El FBI tiene una larga historia de vigilancia de conversaciones en las computadoras y los dispositivos móviles. En 2002, la agencia colaboró con la policía en las escuchas telefónicas, y en 2004 reinició sus esfuerzos para mantener este programa en marcha.

La semana pasada se reveló que el FBI y la NSA estaban buscando desarrollar sus sistemas de vigilancia electrónica aún más. En nombre de estas agencias, el Gobierno de EE.UU. trató de obtener las principales claves que las empresas utilizan en internet para proteger millones de comunicaciones internas.

"Google, Microsoft y Apple se benefician de entregar datos al Gobierno de EE.UU."

Gigantes como Google, Microsoft o Apple seguramente se benefician económicamente al permitir que la NSA obtenga datos de sus redes. Así lo afirmó en RT Pete Ashdown, el fundador de una firma que se negó a facilitar información al Gobierno de EE.UU.

En declaraciones a RT, Ashdown explicó que su compañía, XMission, lleva años protegiendo la privacidad de sus clientes.

Aseguró que, al contrario que los grandes de Silicon Valley como Google, Microsoft o Apple, su pequeña empresa, que cuenta tan solo con unos 30.000 abonados (frente a los cientos de millones de las mencionadas), rechazó numerosas peticiones sin orden judicial de las autoridades locales, estatales y federales, amparándose en la Cuarta Enmienda de la Constitución.

"La mayoría de las solicitudes no son constitucionales, no son órdenes adecuadas, por lo tanto simplemente las rechazo", dijo el fundador de la empresa, ubicada en el estado de Utah.

Asimismo, también desveló que las grandes compañías "seguramente están cobrando" por "abrir sus redes para que la Agencia Nacional de Seguridad (NSA) las inspeccione".

"Para mí no vale la pena. No quiero vivir en una sociedad vigilada, prefiero aferrarme a la Constitución", afirmó Ashdown.

"Estoy dispuesto a ir a la cárcel por proteger a mis clientes del espionaje", agregó.

El fundador de XMission calificó de "héroe" a Edward Snowden, el excolaborador de la CIA perseguido por Washington tras revelar datos sobre un programa ultrasecreto de vigilancia del Gobierno de EE.UU.

"Está haciendo lo correcto", subrayó Ashdown. "Es lamentable que sea tratado como un delincuente por divulgar lo que considero actos ilegales por parte del Gobierno", apuntó.

In recent days, it has become known that the United States National Security Agency obtained a secret court order two months ago requiring the telecommunications company Verizon to hand over vast amounts of data. Under the order issued by the Foreign Intelligence Surveillance Court, the NSA may collect data on calls that include Verizon subscribers; this data includes the phone numbers of those involved in the call, location data, and length. The court order does not provide for the collection of details on the contents of the conversations held by Verizon subscribers and their contacts.

The United States Pirate Party condemns the actions of the Foreign Intelligence Surveillance Court and the NSA for infringing on the privacy of American citizens and peoples abroad. The USPP demands that future FISA court orders are reasonably limited and condemns the secretive operation of FISA, which should, when possible, make public information regarding requests for data relating to American Citizens.

"American citizens as well as individual members of the international community have been robbed of their privacies by the United States Government over the past two decades," says Captain Lindsay-Anne Brunner. "These issues that the mainstream press are suddenly talking about are in no way isolated, random instances, and should not be recognized as such. The American people need to put immense pressure on their legislators to enact laws preventing further gross violation of privacies by this government."

It has also come to light that the FBI and NSA have been indiscriminately mining user data from several websites run by US companies in a series of acts that violate the privacy of millions of people worldwide. This program, known publicly as PRISM, has been going on unchecked by the public eye, and the USPP demands this rampant violation of privacy stop. A government actively spying on its own citizens is unconscionable and not representative of the democratic nature of this country.

The United States Pirate Party calls upon Congress to investigate these crimes carefully and make use of the checks and balances that the Framers gave them by passing comprehensive legislation to stop the systematic practice of the United States Government spying on its own people. We ask that Congress help us re-affirm privacy as a human and constitutional right.

Estimado miembro de Pirates de Catalunya desde hace dos años,

Lamento que no veas ningún problema ético, y más aún que no seas el único que no lo vea. Seguro que tampoco viste problema ético alguno cuando Kenneth Peiruza en representación de Pirates de Catalunya chantajeó a la mesa de la Asamblea General de PPI en Praga, ni cuando la Corte de Arbitraje de PPI se inventó que España y Cataluña eran dos "country" diferentes y no detectó que lo que presentaron los compañeros australianos no era una moción, ni que la Asamblea no tenía derecho a decidir dar calidad de miembro a nadie por mera votación, y hasta falseó un artículo de los estatutos para hacer aparentar que si se podía, para darle a Pirates de Catalunya la condición de miembro de pleno derecho que hasta ahora usurpa. ¿Quien piensa en la ética cuando algo, por injusto que sea, le beneficia?

Para ser los campeones de la DEMOCRACIA DIRECTA en España... lo dices también tú... vuestra Asamblea Permanente NO ha tenido la ocasión de ratificar que PdC aceptaba hacerse cargo de ese servicio a The Pirate Bay.

Poco importa cuánto se ha estudiado el tema, supuestamente por un grupo restringido. Poco importa lo que decidiera la Junta. Lo cierto es que la Asamblea se ve chantajeada y habrá de votar que SI... para evitar el ridículo para PdC de tener que justificar un NO después de haberse apuntado a toda la publicidad cosechada.

De hecho, poco importa ya incluso que la Asamblea vote SI... lo importante es que AÚN NO HA VOTADO... y que los sucesos condicionarán su voto próximo. Un No-Go para cualquier campeón de la Democracia Directa.

Mira, comprendo perfectamente lo que ha pasado. Los piratas se han tomado como de costumbre más tiempo que el disponible para organizar la consulta a la Asamblea, y les ha pillado el toro con la fecha de vencimiento del ultimatum, con lo cual Pirata Internacional no ha tenido más remedio que publicar la noticia con lo que tenían, y decir que el Partido Pirata de Noruega toma el relevo del Partido Pirata Sueco. De hecho, el primer comunicado mencionaba al PP de Noruega con un enlace al mismo, y, oh sorpresa, al Partido Pirata de España con un enlace al mismo. Por eso mi primera reacción, como miembro de la Junta General Central de Pirata España... ha sido pedirles explicaciones a los míos. Lo segundo, preocuparme por saber por qué se nos menciona en un artículo en relación a un asunto con el que no tenemos nada que ver.

Lo tercero, lamentarme de que la culpa sea de una chapuza de Pirates de Catalunya por apuntarse a la gloria sin haber sido capaces de prestar el servicio. Pirata Internacional cometió el error de querer haceros un favor... y hacerlo mal, poniendo un enlace hacia Pirata de España sin consultarnos para nada, en lugar de ponerlo hacia Pirates de Catalunya.

La corrección correcta, si hubiera interesado, habría sido quitar el enlace hacia Pirata de España, y puesto que vuestra Asamblea no había tenido la ocasión de votar el tema, ni estabais prestando el servicio... dejarlo ahí. Por haber tardado demasiado en el proceso de toma de decisiones, y en la puesta en línea de la infrastructura técnica habíais perdido una ocasión de figurar. Siempre podría ser una oscura noticia complementaria posterior sacar un comunicado sumándose al servicio prestado a The Pirate Bay una vez que si, la Asamblea hubiera tenido la ocasión de votar el asunto, y si, también después de ponerse al día para efectivamente prestar el servicio.

Pero no, alguien cuya radicación territorial solo puedo adivinar se preocupó por que se corrigiera el enlace en la noticia para que apuntara hacia Pirates de Catalunya, y nada más.

Alguien decidió que la verdad no tiene por qué estropear una buena noticia y la oportunidad de gozar del estrellato mundial.

La Democracia Directa, tan cacareada por Pirates de Catalunya... para cuando no estorbe.

Y el comunicado y el apañón de vuestra Junta... solo aparece por necesidad cuando empieza a salpicar la mierda, y no cubre de forma creíble los aspectos lógicos ni éticos de la situación.

Yo si que quisiera que todos los piratas trabajasen por crear un MOVIMIENTO PIRATA GLOBAL (que no un PIRATENPARTEI, que se os va la olla), y cuando unos piratas de barrio que se declaran altivamente independientes meten la pata hasta el fondo... pues no quiero que la mierda que generan nos salpique.

Por favor, si queréis seguir llamándoos piratas... no juguéis más con la lógica ni la ética que se nos ha de suponer a todos.

The Pirate Movement is growing. This world map was created at the end of 2012 to give an overview on the pirate movement. As can be seen from the map, the Pirate Movement is still fairly euro-centric but steadily spreading out. Australia just managed to get registered as an official party and there is a lot of activity brewing in South America.
Currently there are more than 600.000 people following pirate parties around the world. More basic information about different pirate parties (website, fb, twitter, contact) can be found by clicking on the countries in the map. All this information and some other parts will be released in the form of an API on Pirate Times in the near future.

Lower Saxony Elections:
Fellow-Pirate and newest intern at Amelia’s office (Hello world, nice meeting you!) reporting on Hannover weekend.
On Sunday the 20st of January there were the local state parliament elections in Lower Saxony, Germany. Aim: 5% of votes in order to get a parliament seat. Stake: entering the federal parliament in the next national election in September.
The local Pirate Party called in international troops to help out during the last day of campaigning in the run up to the final voting day on Sunday. Belgians, Czechs, Swedes, Dutch and Germans gathered in the cold Hannover for the weekend to discuss, share ideas, campaign and socialize.
Cozily gathered at the Pirate Headquarters, the weekend workshop started with an introductory welcoming briefing by host Justus Römeth of Pirate Party Niedersachsen. Next to coffee and muffins we also enjoyed the cleverly designed promotional material alongside a brief presentation on the past campaigning weeks. Skilfully organized, the Germans are skilfully organized. They have eye-catching posters, billboards, various insightful leaflets structured by topic and purpose, and sword-shaped orange balloons.
The workshop continued with a more practical exercise: the pirates wrapped head to toe in warm clothes and armed with leaflets and optimism have stepped out in the cold to make a last campaigning effort in a trip around town to several of the five Pirate Party Info stands. What an experimental idea it was, to have the international Pirates approach the Hanoverians on a politically-orientated topic. Interesting reactions were generated among passers; none of which however foreign to Pirates that are used to being prompted with surprised and intrigued faces. We always have a wicked smiled prepared to offer in return.
Later in the day when all Pirates declared themselves frozen to the marrow, the group migrated to a conference where Bruno Kramm and Laura Dornheim graced us, among others, with their presence in a discussion (in German) on Copyright and its follow-up implications. Day one gloriously ended with dinner and drinks.
On Sunday, while everyone in Lower Saxony was busy voting, the Pirates were once again grouped at the headquarters to discuss ideas and opinions on the election campaign and on future improvements. International input suggested leaflets glued to give-away books (courtesy of Sweden) and promises of campaign material sharing. Importing international pirates for campaigning was decided to be a good idea and also perhaps helpful to share available resources.
By 18:00 when the election polls were set to be announced, Pirates moved venue and were impatiently watching the huge screens that were due to show the results. Shortly however the room was filled with disappointment sighs as the poll showed lower results than expected. These were disturbing results as they may jeopardise the fall’s federal elections.
Nevertheless, a pirate is a pirate and will not be intimidated by a slippery slope. Lesson learned – assets will be maximised in the future.

EU vill ha rätt att bestraffa media och journalister:
En expertgrupp har på uppdrag av EU-kommissionen tagit fram en rapport om hur EU ska säkerställa mångfald i media (”media pluralism”) i Europa. Det kanske låter bra när man hör det, men vägen till helvetet är som bekant kantad med goda föresatser.
Hax gör en snabb sammanfattning av förslaget.
Det här är inte något skarpt lagförslag ännu, och vi får hoppas att det inte blir det heller.
För att göra en lång historia kort tror jag inte att det är någon särskilt bra idé att inrätta en EU-myndighet med rätt att bötfälla och på andra sätt bestraffa media och journalister som de tycker rapporterar dåligt.
Det känns helt enkelt inte som en idé som hör hemma i en demokrati. Och även om EU med sin icke-valde president i och för sig inte är en demokrati, så finns det ingen anledning att lägga till ännu fler icke-demokratiska strukturer.

Activism – Andrew "K`Tetch" Norton: If we had any doubt of the reason we need to be extra vigilant in our work, this month has provided them in spades. But there is one thing that ties everything together, and that is the matter of integrity, and accountability. Through all the issues, those that take the lead are never held to account. Often, ironically, they do these acts while trying to hold others to account, in some sort of twisted egotistical irony powertrip.

I could have posted this Friday, but I didn’t. Saturday was an option too, but I wanted to wait. Above all I felt a need to slowly think about things, before acting, or saying. Many have let their emotions speak, but while they’re good for the short-term, we need a long term look.
The past week or two has been a turbulent one for many like me. The success of the one-year anniversary since SOPA/PIPA was overshadowed by the tragic (and preventable) suicide of Aaron Swartz, and the launch of Mega on the one-year anniversary of the raid (pretty much to the minute)
Then, through it all the irony of the Martin Luther King speech about freedom, being locked down. To cap it, the one man going to be imprisoned for the waterboarding, is the one who alerted the public, and not one who conducted it.
It’s a conflicting and emotional time in many ways, as many of the issues we pirates are passionate about are hitting landmark points all in a week. And overshadowing it all is Aaron, and his tragic final decision.
I was invited on a Huffington Post Live panel Friday night to discuss some of these issues. With me was Tim Lee (ArsTechnica), Trevor Timm (EFF), and Holmes Wilson (Fight for the Future). I don’t think I did that well, but judge for yourself.
It was actually quite an interesting spread too, you had the tech press, legal, activist, and me with the political aspects. I doubt they could have got a better spread if they’d wanted.
But from the talk there, and the pre-show banter, I took away one thing. We all care about this, and we all want the situation to improve. Sure we’re all young men, but we’ve looked at the situation out there, and see massive problems. We’re all intelligent and hardworking (well, those three are, I wouldn’t say that about myself, because I know it’s not true) and could easily making a shedload of money in any private concern of our choosing. Instead we choose to do this.
We’re also all worried. What happened to Aaron could have happened to any one of us. It could have happened to my kids. It was the actions of people who have become unaccountable, and who point to the system and say ‘just following it’ instead of using their brains, and integrity.
But then half a world away, you have the Dotcom saga. A year to the minute (just about) from the raid, he launched Mega. I gave the service a basic look a few days ago (luckily, before the launch, as demand has made it mostly unusable since) and while it’s not great, it’s not bad. But the launch underscored the legal battle that had gone on for a year.
It’s a very similar case to Swartz, in that there’s an excess of prosecutorial zeal, with those behind it trying to hide behind the letter of the law when under scrutiny, but openly milking things for as much publicity, to sell their side of the story otherwise. I never had the chance to know, or talk to Aaron, but I’ve a feeling we were on the same page a lot of the time, and a lot of people I know and think highly of, thought highly of him too. While this is not an adequate eulogy on his life, little will be except the kind of change he believed in. Words are just words, the real measure of someone’s life is how they changed the world. Aaron, he changed it hugely in his works, and will still continue to do so. He was a larger-than-life person, with larger than life ideals, and ones we’re going to be scrambling to aspire to.
Now, I’m not the biggest fan of Dotcom, and to be honest I can take him or leave him really. I have a number of German friends, and there was some distaste for him from them. His actions and attitudes in general had the same sort of nouveau-riche tasteless tackiness you’d expect from a Premiership footballer or a Real Housewives target.
To have taken a man that’s hard to be unsympathetic about, and give him the chance to completely turn around his public image takes a special lot of work, but the US Gov. managed it. From the overblown military assault, to the more recent revelations that the evidence the DoJ used to justify the raid was there because of… the DoJ.
Again a bunch of people working for special interests, and not for the public good, who are quick for boasting of how hard they’re working and that they’re responsible for these prosecutions when it goes well, only to retreat behind the minutiae of communications and the wording of the laws.
Then we come to SOPA/PIPA one year on. I can’t explain in words here adequately what the causes and solutions are (it’d take WAY too long). If you want that, then maybe listen to a panel on the topic I gave back in September (mp3, ogg).
One thing is certain and that is the contempt we were treated with. We had to pass these laws, we were told, or ‘else’. You know, piracy run rampage, and unchecked, companies go bankrupt because no-one buys anything, seas boil dry, the Rapture, another Rebecca Black video, and so on.
Well, the laws didn’t pass. And things didn’t go as claimed – it turned out none of the bad things happened. In fact, the movie studios had (yet another) record breaking year. Music sales were still good. Also it seemed we didn’t need those new laws to do the things in them either. It just made existing things a bit easier, with a little less accountability and a lower burden of proof.
After 15 years of passing every sordid little whim of industries that want power, but no responsibility, people finally said ‘enough’ and warned that accountability would start.
Want an example? How about Martin Luther King Jr.’s “I have a Dream” speech. It was made 50 years ago. He died 45 years ago. It’s still under copyright. No matter how much protection the speech gets, he’s not going to write any more. Yet it’s been taken down repeatedly over the past weekend.
Or the Bradley Manning trial. His military trial found this month that his pre-trial detention broke the rules. As such he’ll get 112 days off any sentence (which assumes he’ll be convicted) but those responsible will get nothing. Nada, Zip, Zilch; for actions which a criminal judge has found to be illegal, no punishment. Did they somehow forget their jobs and go too far on a whim, or is it part of an institutionalized attempt to punish those accused before being convicted?
Or we could mention the CIA and its waterboarding of detainees over the past ten years. Despite the practice being ruled illegal by US courts for centuries (and sometimes recently) it was Okayed. Despite it being against international law and treaty, and against the greater will of the people, and having no substantive value at all, it was approved and performed. And from all these lawbreakers who’s the only one to even be taken to court much less convicted? John Kiriakou, who didn’t perform the acts at all, but confirmed they were used. His crime was bringing some accountability to the government. His sentencing will take place on January 25.
Meanwhile, the man that authorised it (bush) and said it was ok, sits on a ranch in Crawford, Texas. Although his overseas trips and visibility have waned since a group vowed to have him charged with War Crimes, just before a trip to Switzerland in Feb 2011. He cancelled his trip and has had a low profile since.
Tellingly though, is the passing of the American Service-Members Protection Act, which actually prohibits the US, and any US servicemen from assisting the International Criminal Court, to the extent it permits armed action against it (without needing Congressional approval). Thus it gives rise to the informal name of The Hague Invasion Act.
And here we come again to the issue. It’s accountability every time.

EVERY SINGLE TIME

Every time, people act in a selfish or self-serving way. These are people who have a public trust. Legislators, prosecutors, law enforcement, the civil services; they’re the cause of the problem we have today. Every time they’re caught out, they claim they’re ‘just doing their job’.
“Just doing your job” is no excuse to act like vile reprehensible vogons. When you take your job serving the public, you don’t discard your humanity. You’re not stripped of any sense of perspective. You most certainly are not given a right to pursue any action you want just because you can. There is no sign over the door saying “abandon all decency ye who enter here”. The more power and influence you have, the less accountable you are.

And yet, that’s what we now have. All these cases have one thing in common. They put the good to society – the cost of the actions as a whole – and any sense of proportion to one side, because it may help further their careers or goals.
Berman, Smith and the other SOPA/PIPA sponsors were after more campaign funds from a media industry that could be shown ‘they were on your side’. Ortiz was looking for easy headlines, so that a run for the Governor’s office might be attainable, and headlines and a reputation regardless. The DOJ wanted to have a strong don’t mess with us’, and support the media industries (where many of the top cadre of lawyers had come from, and where they presumably will return) for the Dotcom raid.
Only now are we seeing any sort of accountability, and even then there’s resistance. Ortiz has said she has done nothing wrong (TWICE). The DOJ is hiding behind technicalities in the Megaupload case, and despite being comprehensively panned by the citizens, the same sorts of things are still suggested and hinted at.
Now we have the 6 strikes scheme, which again has no sort of accountability for false claims, but acts purely on accusation. Again, no recourse for false claims, but penalties if someone makes a claim against you.
It’s absurd.
And it is all because no-one is held to task for their actions and their motives.
It’s sickening, and it’s time we put a stop to it, once and for all.
Things are now starting to change, but slowly. We all need to get behind it and work hard to make the changes that happen; to push for what is right, not just for us, or for our employer, but for our society, and our future.
Start telling the truth. Tell people when they’re wrong, correct them and point them towards resources so they don’t make the same mistakes again. Hound your lawmakers, and let them know that governance without accountability is tyranny. Most importantly, ask questions and DEMAND answers, REAL answers, based on evidence, citing sources.
It’s only when we as people can start embracing truth, and accepting responsibility, can we move on once again as a civilization.

Pirates ran in 2013 Israeli Elections:
The number of Pirate Parties in the world is constantly growing and in some countries there are more than one. This is the case in Israel but only one, הפיראטים, managed to register and take part in the elections held on 22 January 2013. They did not reach the hoped for 2% hurdle that would bring them a place in the 120 seat Knesset but with, at the time of writing, 2,408 votes and so 0.07% of the votes they have a respectable result for a party of about 300 members.
The Israeli Pirates registered 5 December last year amid a lot of media attention and have obviously been spreading the Pirate message to good effect in such a short time. They managed to gain plenty of air time on Israeli television stations and provided a set of their own videos on their Youtube channel
The Israeli Pirates are also on Facebook and Twitter.

500 Days To European Elections, Pirates Needed More By The Day:

Pirate Parties: Today, on January 23, it is 500 days to June 8, 2014, when the next European Elections are held. Pirates entered Parliament on June 7, 2009, and have since saved Europe from “three-strikes”, ACTA, and many other examples of encroachment on civil liberties. But things are still overall going very much the wrong way – we need to fire more politicians over reckless disregard for civil liberties to drive the message home.

Things are going to hell in a handbasket, and fast. I’ve written before how I consider the Pirate Party movement to be the last line of defense against a very ugly society – just yesterday, there was another example, that I choose to illustrate the overall trend: European politicians want the right to fire uncomfortable reporters.
A society where such a report can be published by the political powers, and even taken seriously, is a society where civil liberties are endangered and verging on extinct – even if the report doesn’t become law. Even if it doesn’t become law this time around.
There are more things in the pipeline, which we must prepare for – preferably by boosting the pirate forces in Brussels. You have the various spinoffs on ACTA, everything from CETA to TPP (even if Europe is not an initial party to the latter) where the monopolistic powers will just go with “more and harder violence, but less vaseline” until things snap. Politicians mostly don’t even try to defend copyright and patent monopolies by claiming they fulfill their stated purpose of encouraging creativity/innovation – having the monopolies and enforcing them is about jobs. Pure protectionism by means of monopolization, at the expense of civil liberties and freedoms of speech and expression.
Speaking of freedoms of speech, the report mentioned above spoke of “removal of journalistic status” as a punishment for people who printed bad stories about the politicians. You will note that there is no such thing as journalistic status today; anybody can publish anything, and this is a good thing. To be able to remove freedom of speech, the European Union must first create a mechanism that grants freedom of speech – and one that does so conditionally.
That language tells us a lot about what is happening right now.
That is not tolerable, not any bit of it.
But we can send them a message. We can do this, we can do this together. We know that it works. We have done the proofs of concept. We know that we can get elected and change the world for the better.
For it is direly needed, it has never been more needed, and it keeps getting more needed by the day.
The polling stations open at oh-eight hundred on June 8, 2014. That’s exactly 500 days from now, and the clock is ticking.

Den absurda upphovsrätten tvingar SVT stänga ute utlandssvenskar:
Sveriges Television tänker lägga ut sina sändningar live på internet. Det är bra, och det var på tiden. Det minsta man kan kräva av ett public service-bolag är att det gör sina sändningar tillgängliga för så många som möjligt.
Men så blir det ändå inte. Upphovsrättsmonopolet leder nämligen till att SVT bara får göra sändningarna tillgängliga i Sverige, inte i resten av världen.
Trots att man använder sig av internet med dess fantastiska möjlighet till omedelbar global kommunikation, så tvingas man alltså strypa informationsflödet – helt i onödan.
Detta innebär att de som skulle ha störst nytta och glädje av SVT på nätet – de hundratusentals utlandssvenskarna – stängs ute.
Så är det redan med SVT Play, där man kan se vissa tidigare sända program. Här är bara SVT’s egenproducerade program tillgängliga för internetanvändare i utlandet. Utländska dokumentärer, serier och underhållningsprogram är blockerade för alla som befinner sig utanför landets gränser.
Detta är konsekvensen av ett upphovsrättsträsk där det är nästan omöjligt i praktiken, eller i vart fall orimligt dyrt, att licensiera tv-program över nationsgränserna. Samma problem drabbar till exempel de företag som säljer musik, film och böcker på internet, och som måste slåss med insamlingssällskap och upphovsrättsorganisationer (typ STIM) i 27 olika länder om de vill ha hela EU som marknad.
Upphovsrätten måste begränsas, rensas upp och anpassas till dagens verklighet. Tills den dag det sker kommer vanliga människor att vara hänvisade till olaglig fildelning för att få tillgång till samma medieutbud som sina vänner i andra länder.
Vad gäller just SVT’s nya livesändningar (och SVT Play) finns det i och för sig en smidig alternativ väg att gå för alla utlandssvenskar: Att anonymisera och kryptera sin internetuppkoppling genom en VPN-tunnel som går ut på nätet med ett svenskt IP-nummer.
Det finns ett antal kommersiella VPN-tjänster att välja mellan, och de brukar typiskt kosta runt en femtiolapp i månaden. Då får man inte bara tillgång till SVT’s sändningar var man än befinner sig i världen, man får också på köpet en anonymisering av sin IP-adress.
Det är i sig något positivt. Fler borde skydda sin kommunikation på internet, till exempel på det här sättet. Dels gör VPN-användning det svårare för våra myndigheter (inklusive FRA) att övervaka folk. Dels kommer ökad kunskap om anonymiseringstjänster att göra fildelning (ännu) mindre riskfylld och därmed också (ännu) mer populär, vilket är en bra sak.
(Risken för en vanlig fildelare att åka fast är i och för sig mindre än att bli träffad av blixten även utan VPN-skydd. År 2012 lyckades den speciella insatsstyrkan mot fildelning, som består av fyra specialåklagare och ett par dussin poliser som fokuserar på fildelning, få tio (10) fildelningsfall till domstol. Men det skadar ju inte att vara försiktig ändå.)
Att utlandssvenskar, som kanske är den grupp som skulle ha allra mest glädje av SVT’s utmärkta nya initiativ att även sända via nätet, ska tvingas fixa och trixa för att kunna titta på sändningarna, illustrerar hur absurd upphovsrätten är.
Även om det rent tekniskt är hur lätt som helst att sätta upp en VPN-tunnel, borde det inte behövas. Själva poängen med internet är ju att allt kan göras tillgängligt överallt i hela världen. Det är inte en svaghet hos internet, det är dess största styrka.
Det är upphovsrättsmonopolet som behöver förändras, inte internet.

Infopolicy: Swedish Public Television will start demanding license fees from every Swedish person connected to the Internet. They claim that since people on the net have the ability to see their webcasts, that counts as a television set. This is a technophobic overreach that will call the existence of public service TV as such into question.

In most states in Europe, there are governmentally-run television channels that are funded by license fees on television sets. The British BBC would probably be the most well-known example worldwide. It works like this: if you own a television set, you pay the public service channels a fee every month or year, and this money goes to produce independent, noncommercial programming. For the UK, the fee for owning a TV set is about €150 per year that goes to the BBC.
Thus, the funding of the public television channels is funded by the theoretical ability to receive them, whether you actually watch them or not. This has been under fire for some time, but has general acceptance, mostly because of lack of an alternative.
Now, as the Swedish Public Television SVT starts webcasting, they have decided to take this to a whole new level by reading the law text that says that they can collect fees from anybody with a theoretical capability to watch their programming, and demand fees from everybody connected to the Internet – all computer owners, as well as owners of pads and tablets. How’s that for a paywall?
There’s a significant amount of craniorectal interaction in this re-interpretation of the law. The television set is a one-purpose device – it can receive television programming, and that’s it. The general-purpose device is just that – a general-purpose device. It can be instructed to receive, process, store, distribute, and display any type of information. While it lies in its nature that it can receive and display any type of TV programming available to it, that doesn’t make it primarily intended to do so. A television set, by contrast, can do little else.
While the SVT’s interpretation of the law would subject people worldwide to their desire for funding, the laws enabling them to collect TV license fees are only in force up until the Swedish borders, so this would just apply to Swedish residents.
This is dumb greed, and just dumb, for three reasons:
First, this amounts to an innovation tax. By requiring €150 from every household that wants to have a computer, you are stifling the economy in a way that hinders innovation where it’s needed the most – on the long tail in small scale, where the successful enterprises start: never forget that Apple and Google both started in garages less than half a human lifetime ago. Allowing the public service television to externalize this friction on the overall economy is not acceptable.
Second, it’s plainly not reasonable to equate a general-purpose computer or tablet with a dumb TV. It paints the entire public service television staff as technoretards in a time when a need for independent and critical reporting is actually quite significant.
Third, public service funding has been under fire for some time, which makes it doubly important to appear reasonable and balanced. This is neither, risking the public service funding as a whole for a few extra theoretical per cent of licenses from households that have no TV set but do have broadband.
This move is bound to bring about a discussion whether we need public service television at all, and if so, what for.
For myself, I will be blocking the SVT in my firewall as of right now, making my computer incapable of receiving its programming. (I haven’t owned a TV set in 15 years.)

Lower Saxony Pirates Fail to Gain Seats in State Parliament:
Hundreds of Lower Saxony Pirates, together with Pirates from other Germans states and many from at least 14 other countries, gathered in Hanover to watch the results come in. As stated in our earlier article, the polls were showing 3-4% of the conservative leaning Lower Saxon voters were intending to vote Pirate.This was down from the 8% in May 2012 but hearts were hopeful. Pirate faces dropped in disbelief and tears began to flow as the first estimates gave the Pirate Party a mere 1.8%. As the results came in their share of the vote rose to 2.1% but not enough to pass the 5% hurdle that guarantees parliamentary seats.
The run of victories, enjoyed by the regional Pirate Parties in Germany had been stopped or at least slowed. The reasons why can be varied and many and it is important that those Pirates of the regional and national Parties look into what happened in a scientific, unbiased and transparent way as possible, so that Pirates in Germany and the rest of the world can learn from this experience.
The voter participation was, despite the biting cold, about average for Lower Saxony at 57.1%. The result was a very narrow defeat by the ruling Conservative-Liberal coalition by the combined efforts of the Socialists and the Greens. Tactical voting on both sides was in evidence and it will be interesting to see if that squeezed the Pirate vote, as well as the far Left Party, which lost all its seats in the state legislature. We will have to wait until late September of this year to see what effect this will have on the national elections.
The shock of the moment wore off as the crowd realized that for their first ever election this result was not bad at all! Many Pirate Parties would give up their right legs not to be listed in the “others” groups but have their own column in the televised graphics. Also the Pirate vote hardened to 2.1% which means they would be entitled to substantially more government financial assistance and to ensure campaign funding for future elections. The tears dried and the beer flowed allowing the Pirates to party long into the night.

The data protection reform in the European Parliament is taking unexpected turns. After 20 years of studies, academic research, European research projects, evaluation by national data protection authorities and their collaboration organisations, and more money spent on proper, impact-assessed and evidence based policy making, the Commission put forth an interesting proposal in January of 2012 to update the data protection of the European citizen. However, it appears that the regulatory process is hijacked by a few corporate actors who are targeting the European institution of weakest means to defend itself against the onslaught: the Parliament. But it doesn’t even end there….

Studies of €250 000 discarded

Various parliamentary committees have commissioned studies on the topic of data protection during the current, and 7th, legislature. It turns out that in the last three years alone, the parliamentary committee for internal market and consumer protection, as well as for industry, research and energy, have spent a total of €250 000 on such studies. These studies conclude that we need better enforceable, more robust data protection legislation. European industries persistently show innovative leadership in privacy enhancing technologies because of the existing European data protection framework. Consumers are uncomfortable with what they perceive as a lack of enforcement of the current data protection framework. Small and medium sized enterprises are concerned that the abuse of data protection rules by larger actors will lead them to lose control over their own data. But many of the deputies in the European parliament – more upsettingly, those who belong to the two committees mentioned above – have not yet found it in them to internalized the knowledge from the studies they themselves have ordered.

Industry associations represent American interests

Out of 11 industry associations that have sent me e-mails in November or December 2012, all have American members. Furthermore, I’ve personally met with people from Business Software Alliance and AT&T+Oracle, and I have had planned meetings with TechAmerica, Adobe and Sky who´ve got cancelled. Individual position papers transmitted to me during November or December come from Opower, a company which has been championed by the American government. Also eBay and Amazon have been in touch with me. Google and Facebook have been more active lamenting the law proposal in media than any other law proposal ever made by any institution. And this bearing in mind that I belong to one of the least lobbied MEPs with some form of formal responsibility for this dossier (I am shadowing for the Greens in ITRE).

1827 amendments tabled in three opinion-giving committees

The committees for the internal market and consumer protection, industry, research and energy and legal affairsare making supporting opinions for the main committee on the work on data protection. They have tabled a total of 1827 amendments on the regulation, many of which are picked straight out of lobby documents that don’t even make the effort of tying the concerns presented with actual scientific or factual basis.
The European Union needs your voice heard to fairly protect your privacy and your personal data. There are good examples from both Sweden and Romania of projects from citizens that help them raise their voice towards the parliament. We hope that similar projects will arise in other member states, so that all the knowledge we share, as a community, does not have to fall victim to an essentially badly hijacked political process.

Els candidats heu d’apuntar el vostre nom i a quin càrrec opteu com a solució (poseu una solució per cada càrrec si opteu a més d’un) i una explicació de la vostra experiència prèvia, motivació, etc.
La votació s’obrirà el proper 19 de gener de 2003 i es tancarà el 2 de febrer de 2013. Cada candidat optant a un càrrec és una votació separada i es pot votar positivament, negativament o abstenint-se. Els candidats quedaran ordenats per la suma total de vots negatius i positius (el número que es veu al costat del nom), i en cas d’empat tindrà preferència la persona amb més vots (es a dir, l’opció amb més participació).
Els candidats que no entrin a la junta quedaran de reserva per si algun dels membres de la junta ha de renunciar durant l’any poder substituir-los.
Per optar al càrrec o a la reserva els candidats hauran d’haver tret com a mínim el doble de vots positius que negatius.

Pirate Party Australia is pleased to announce that its application for registration as a federal political party passed all tests by the Australian Electoral Commission and is now on the register of political parties[1].

The Party quietly submitted its application in late 2012, and objections to the Party’s registration closed on the 14th of January this year.

“Organising and validating a membership database to then submit to the AEC for the purposes of registration is a daunting task. Fortunately, we had a team of volunteers who were prepared to spend many weekends ensuring that the list we sent to the AEC was entirely valid, and I thank them for their effort,” said Brendan Molloy, Secretary of Pirate Party Australia.

The Party will now turn its attention towards developing policies and the pre-selection of candidates for the upcoming federal election.

“With this milestone reached, refinement of our policies will become the focus of our development teams leading up to pre-selection of our candidates later this year.” said David W. Campbell, President of Pirate Party Australia.

The Party thanks all those involved in the process leading to registration, particularly those who spent vast amounts of time ensuring member details were up to date.

“More than ever before there is a necessity in Australia for a Party that holds empowerment, participation, free culture and openness as its central tenets. A Party that understands the modern emerging information society and the imperative for political transparency that ensures meaningful engagement.” said Rodney Serkowski, the Party’s founder.

“A Party that respects fundamental rights and freedoms. As the Prime Minister condemns whistleblowers and publishers without trial, the spectre of data retention looms, policy is laundered and Australia’s interests are sidelined by faceless diplomats and bureaucrats through ill-considered trade pacts there has never been more reason to put pirates in parliament” he concluded.
