<p>Unfortunately, you are likely liable for the debt. You could file an affidavit with your credit card company in which you attest that you did not make the charges and that these charges were unauthorized.  If you timely file such an affidavit, you may not be liable for those charges. However, this might cause criminal charges to be brought against the individual using your card.</p>

			<content:encoded><![CDATA[<p>One radio advertisement I heard over and over again during the holidays was for <strong>International Star Registry</strong>, a company that offers the ability to “name a star after someone” for a low fee of $54.00.  In addition to having the star’s new name “registered at the US Copyright office,” you get a certificate, a star chart, and a map of your star circled in red.  However, you cannot get a star named after you and claim copyright to it.</p>
<p>Names are not protected by copyright law.  Publishers of publications such as a star registry copyright the text of a book containing the names the registry has assigned to stars but the registration does not extend protection to any of the individual star names appearing therein and does not confer any official or governmental status on any of the star names included.</p>
<p>The International Star Registry admits in its own fine print that “star naming is not recognized by the scientific community” and that “your star’s name is reserved in International Star Registry records only.” So for Valentine’s Day, don’t buy your loved one a star, your hard-earned money is better spent on a nice steak dinner or some flowers.</p>

<p>Certainly the Car Allowance Rebate System (CARS) and the <strong>Cash for Clunkers</strong> program has not only increased automobile sales, created great dealership and automaker profits, stimulated the stagnant economy, and provided monetary relief too many consumers such as you and me. It is becoming increasingly apparent that the CARS and the Cash for Clunkers law was written without comprehensive vision and contains several pitfalls, the losses of which dealerships are trying to force on us the consumers. Our law firm now is receiving calls daily concerning the application of the CARS and the Cash for Clunkers program, and as of today we have already been retained by two clients with regard to the application of the law.</p>
<p>The main problem with CARS and the Cash for Clunkers program is when you purchase a new vehicle from a local dealership with the understanding that you will receive either the $3,500.00 credit or $4,500.00 credit from the federal government&rsquo;s CARS program for the destruction of your &ldquo;clunker&rdquo; and then you enter into a contract with a 3rd party financier for the balance (or pay the balance in cash), drive off the lot in your new car, your &ldquo;clunker&rdquo; is then crushed, and then the federal government denies credit because the vehicle is in some way ineligible. CARS and the Cash for Clunkers programs do not consider this scenario. The legislature&#8217;s comments concerning the law seem to indicate that the loss would fall upon the dealership. However, this has not stopped dealers running promotions they should have known were not going to receive the credit from bullying consumers, wrongfully holding up transfer of title on your new vehicle, leaving harassing messages on your phone, and threatening lawsuits when the $3,500.00 credit or $4,500.00 credit from the federal government&rsquo;s CARS program even though your &ldquo;clunker&rdquo; has already been destroyed.</p>
<p>Don&#8217;t let your automobile dealership bully you into reimbursing them $3,500.00 or $4,500.00 for a mistake they made regarding the eligibility of your clunker. <p>Some dealerships burned by CARS and the Cash for Clunkers program now require individuals to sign a contingency agreement concerning the reimbursement of the credit should your clunker be rejected by government under the program. One thing is certain- a consumer does not have to sign the contingency arrangement in order to participate in the CARS program. In most cases, if you do not take care of a traffic ticket, your driver’s  license will be suspended.</span></p>

Each time you are convicted of a traffic violation, you will have to  pay certain court fines and costs.  In addition, points may be posted  to your driver record.  Under Michigan’s point system, each traffic  violation has a point value, which is set by law in the Michigan Vehicle  Code.  Points are placed on your driver record only after you have been  convicted or found guilty of or responsible for a civil infraction.  The Secretary of State cannot set aside a court conviction or the points  for it.  The following list shows the points for some traffic violations: </span></p>

<p align="justify"><span style="font-size: small; font-family: Calibri;">A garnishment is a  means of collecting on a money judgment against an Individual by ordering  a third party (the garnishee) to pay money, otherwise owed to the Individual,  directly to the plaintiff. There are three common types of garnishments,  Wage Garnishments, Bank Garnishments, and Tax garnishments. Wage garnishments  can be a shocking and traumatic event; suddenly 25% of your income disappears.  Worse yet this can inconvenience your employer or others with whom you  are dealing. Tax income Refund/Credit Garnishments, as with wage garnishments  too can be taken to help satisfy a money judgment. Bank garnishments  are also likely to be effective against many individual debtors, and  as such your bank account can be taken to help satisfy a money judgment.</span></p>
<p align="justify"><span style="font-size: small; font-family: Calibri;">If you have been served  with a writ of garnishment and object to the writ, </span><span style="font-size: x-small; font-family: Arial;">Once  a writ of garnishment has been awarded, it is very hard to undo, but  not impossible,</span><span style="font-size: small; font-family: Calibri;"> we can file an  objection with the court however an objection must be based on the one  or more of the following: </span></p>

<li><span style="font-size: small; font-family: Calibri;">garnishment is precluded    by the pendency of bankruptcy proceedings</span></li>
<li><span style="font-size: small; font-family: Calibri;">garnishment is barred by    an installment payment order</span></li>
<li><span style="font-size: small; font-family: Calibri;">garnishment is precluded    because the maximum amount permitted by law is being withheld pursuant    to a higher priority garnishment or order</span></li>
<li><span style="font-size: small; font-family: Calibri;">the judgment has been paid</span></li>
<li><span style="font-size: small; font-family: Calibri;">the garnishment was not    properly issued or is otherwise invalid</span></li>
</ul>
<p align="justify"><span style="font-size: small; font-family: Calibri;">It should be noted  that your wages, paycheck or bank account can <span style="text-decoration: underline;">only</span> be garnisheed  if a judgment is taken against you. If you are garnisheed, it is not  necessary too late to protest the original debt or other obligation,  if you are unaware of a judgment, or failed to defend a lawsuit in a  timely manner, you should consult with an attorney immediately.</span></p>
