Where to Find Digital Images of Georgia Wills and Estates Online

There are a whopping 156 counties in Georgia! Pretty hefty for genealogists who dig through records searching for relatives. However, this is the surest method of discovery. Here are the options. You can make a trip to one of the court houses in the county where your people resided and examine the records there. This always has pitfalls. For one thing, many court houses have placed the old clerk's record books into storage and many of the originals which were kept in file cabinets have simply been lost. No matter, because the clerk copied in his own handwriting each and every document. That is what you need: the clerk's books of inventories, estates, annual returns, vouchers, receipts and wills (last wills and testaments). If a person died intestate (without making a will), you should still find some record of that estate in the probate office in the form of returns, inventories, receipts, etc. Do not expect the employees to have any expertize whatsoever in the knowledge of where the records are lodged. Sometimes there is a big hassle, as in Chatham County, where you have to make specific requests and then wait 2 or 3 days for the records to arrive from storage. The next option is to go to the Georgia State Archives and examine the records on microfilm. Another problem. Due to budget cuts the archives is only open on Fridays and Saturdays. Watch out for Friday holidays, because they get the following day off. This month, there will be two Saturdays when they are closed. So that draws it down to 6 days for the month. Also, please phone before making the trip as there is discussion as to whether to close the archives to the public.

Searching County Records is Important to all Genealogists

If you are researching your ancestors, every genealogy goes to county records.
You must search in the county where they resided as well as the adjoining counties. Estates: wills, administrations, receipts, vouchers, annual returns, inventories; all things pertaining to estates. Even the slightest notation. Write down the information on all persons of that surname. Then, assemble the data on a family group sheet. This will help you keep the various families in tact and not keep going back to the same records wondering who that person was. All persons of the same surname are suspect for being a relative, whether it is a cousin or what-have-you. Remember what first cousins have in common: they have the same grandparents! This formula goes through the thread of 2d, 3rd, 24th, etc. cousins. Somewhere there is a common ancestor.

Determining When an Ancestor died

So how do we know when someone died? If they had a will, we can use the date of probate as a basis. Every Last Will and Testament has a date of probate. This is found on the page following the will document. It is important to write the probate date down. After a person dies, a family member takes the last will and testament to the county court house where the deceased resided. This is done within 2 or 3 days after the death and is important because it enables the executor to begin the process of administering the estate to the heirs. This process includes creating the annual returns, inventories, distributions and vouchers, etc. and should always be examined by genealogists. If the date that the will was filed for probate was say October 3, 1802, it is safe to conclude that the death occurred several days prior. So now, you know when to search old newspapers for obituaries!

Georgia Estates: Annual Returns and Inventories

Everyone does not make a last will and testament. However, there should be "some" reference to the death in the county where he resided (Probate Court). If there is, it is discovered in the proceedings filed by the administrator. The first thing that happens is the administrator is given Letters of Administration (similar to Letters of Probate except there are no named heirs), and he makes bond. During the process, there may be children under the age of 14 years. In that instance, guardianships are arranged and bonds given to administer the guardianship. Usually, the Letters of Administration, Letters of Guardianship and Bonds are filed in the same record book. However, they can also be part of the many separate books found for estates at the court house. You have to look. The next thing that happens is an inventory is made of the estate; then there is a Sale. The Sale usually contains names of certain relatives, but you have to find them. This is done by looking up those names in the marriage records to discover if any of them were married into the family. Expect to find the widow receiving some of these items. Next, the first Annual Return is filed with the court, a year after the person died. This contains funeral expenses, physicians' expenses, expenses given to the administrator for certain items, to travel to other properties owned by the deceased. If there is a travel entry, you need to determine what State and County that property is located in. Then, search deeds and estate records there. Oftentimes, copies of estate proceedings are forwarded to other such counties.
