<p>Job offers are sometimes NOT what they seem! Tough times and a difficult job market have resulted in numerous shameless job scams by dodgy companies out there.</p>
<p>However thanks to the diligence of some of our members, below are some examples of what these illegitimate advertisements look like and how they operate:</p>

		<td class="column-1">Scam Example #1 “Marketing/Customer Relations Executive”</td><td class="column-2">By using an “official” letterhead, the job seeker is informed that he or she will be working overseas. But before that, job seekers are requested to pay for the processing, procurement and acquisition of their necessary permit clearance documents with an "appointed" travel agent. The employer of course mentions in the letter that all these fees will be “reimbursed later”. To seal the deal, the letterhead also includes an “official’ signature by a legal advisor.</td>
	</tr>
	<tr class="odd row-3">
		<td class="column-1">Scam Example #2“Home-based Typist”</td><td class="column-2">This company asks job seekers to pay a “fully refundable” deposit of $380 for copy-typing jobs. The company emails the applicants directly and takes desperate measures to explain in great detail why they are legitimate. Once the deposit is paid the contact person becomes very difficult to reach on the phone. To make it more convincing, the person signs off with a “Dr” designation in the name.</td>

		<td class="column-1">Scam Example #3“Data Entry/ Filing Clerk</td><td class="column-2">The employer typically confirms and calls applicants (part-time) in for an interview but will request a payment of around $185 for administration or consultation fee. Once they have signed the "job agreement" and payment is made, the company will give excuses on why the applicant can’t be hired. Excuses such as how the client’s company has not made their selection or how they have been robbed and are under police investigation are not uncommon excuses. This might go on for a month or so and eventually, the applicant would be left jobless and $185 poorer.</td>

<p>These job scams are very real and we would like to advise you to be EXTRA careful with your job applications. Should you find advertisements that resemble those stated below, BEWARE!</p>
<ol>
<li>Advertisements that require payment for applications.</li>
<li>Advertisements that promote pyramid selling or similar schemes.</li>
<li>Advertisements that are untrue or misleading (e.g. misleading job title, job description or company description).</li>
<li>Advertisements with dubious ethical credentials (e.g. social escorts, etc.)</li>
</ol>
<p>If you are suspicious of the nature of the job advertisements you see on JobStreet.com, email the advertisement to policy@jobstreet.com. Provide them the Company Name and Position Title.</p>

			<content:encoded><![CDATA[<p>KUALA LUMPUR: The Social Security Organisation (Socso) will soon launch a programme to help its contributors who are disabled due to occupational injuries to return to work.</p>
<p>Under the <strong>“Return To Work”</strong> rehabilitation programme, the members would be retrained for new employment opportunities apart from being provided with other support.</p>
<p>“This way we will also be able to change their mindset to not depend solely on their Socso disability pension,” said Human Resources Minister Datuk Dr S. Subramaniam to reporters after handing over Socso compensations here yesterday.</p>
<p>Dr Subramaniam said participants of the programme would receive a monthly allowance of RM500 for bachelors, and RM800 for those with families and dependants.</p>
<p>Socso has appointed 10 case managers to carry out the programme and to study each participant’s case.</p>
<p>At the ceremony, Dr Subramaniam handed over cheques worth RM466,000 to 34 of its contributors in the Klang Valley. The recipients were either temporarily or permanently disabled.</p>
<p>Also present were Socso chairman Datuk Abu Huraira Abu Yazid and its chief executive K. Selvarajah.</p>

			<content:encoded><![CDATA[<p>In our earlier <a href="http://www.graduan2u.com/2009/07/04/notice-of-termination-of-contract/">post</a>, we cover the Notice of termination as per the EMPLOYMENT ACT. However, there are some reasons that the employer may terminate an employee&#8217;s contract as follows</p>
<ul>
<li>Retirement</li>
<li>Section 14(1) IRA- misconduct</li>
<li>Wilful Breach of Contract</li>
<li>Retrenchment</li>
<li>Criminal Offence</li>
<li>Frustration of Contract</li>
<li>Repudiation of Contract</li>
<li>Effluxion of time [contract of service for specific period]</li>
<li>Termination for poor performance</li>
</ul>
<p>For the employee govern by the IRA 1967, the Act recognizes the management’s prerogative to employ, terminate for reasons of redundancy or reorganization or dismiss an employee with proper cause or excuse. However, the Industrial Court also has “the right to interfere into any management prerogatives and strike down any unfair labour practice or victimization”. But the Court will not interfere with the bona fide exercise of power which is given to the management by the common law and by the contract of service which is inherent in the management.</p>
<p>On the other hand, section 20(1) of the IRA 1967, provides: where a workman who is not a member of a trade union of workmen considers that he has been dismiss without just cause or excuse by his employer, he may within 60 days of the dismissal make representation in writing to the Director-General to be reinstated in his former employment, the representation may be filed at the office of the Director-General nearest to the place of employment from which the workmen was dismissed.</p>
<p>If the workman is a member of a union, his union can file an appeal on his behalf for reinstatement [section 26 of IRA]</p>

<p>I believe unlike other companies Digi got nothing to hide and of course very confident on their action. </p>

<p>We made it a point to share with you what we give and expect from our people. This is the actual document which our employees receive upon joining DiGi.</p>
<p>We believe in doing things simply and smartly. We believe in building diversity in all aspects of our employment, nad in treating all our employees fairly. We believe in encouraging top performance and high commitment and engagement from you. We obey all laws and regulations, both in letter and in spirit. We take our role as a productive and positive corporate citizen of Malaysia seriously. We expect you to believe and do the same. </p>
<p>You&#8217;ll work with DiGi under these terms and conditions:</p>
<p><strong>Your Probationary Period</strong><br />
You&#8217;ll need to serve probation for 6 months, and complete it successfully in order to be confirmed and continue employment. If you don&#8217;t complete that period successfully (or an extension of up to 3 months if you are given one), you may be terminated from employment. </p>
<p><strong>You&#8217;ll Need To Take and Pass a Medical Examination</strong><br />
You&#8217;ll need to do this before joining the Company. It&#8217;ll be at a clinic or hospital appointed and paid for by the Company. </p>
<p><strong>How To Terminate Your Employment</strong><br />
You or the Company may terminate your employment at any point by giving one week&#8217;s notice (if you&#8217;re still under probation, including extension if any), or two months&#8217; notice if you&#8217;ve been confirmed. Or you may pay the equivalent amount of salary in lieu of giving notice. You may also do a combination of both. </p>
<p>If you&#8217;re under a fixed term contract, your notice period after confirmation will be one month instead of two months. </p>
<p><strong>Employee Provident Fund (EPF)</strong><br />
The Company&#8217;ll contribute to the EPF according to the EPF provisions currently in force. The Company&#8217;ll also make deductions from your applicable income. </p>
<p><strong>Enhanced EPF Contributions (EEPF)</strong><br />
The Company&#8217;ll contribue an 3% of your basic monthly salary to the EPF like this:<br />
You&#8217;ll be eligible for this immediately upon joining the Company<br />
However, the contributions will be withheld until you complete three years of service with the Company or upon expiry of your employment contract<br />
Then the amount withheld (including the dividend added to it in line with what the EPF declared during that period) shall be remitted to the EPF<br />

<p><strong>Social Security (SOCSO)</strong><br />
the Company&#8217;ll contribute to SOCSO in accordance with the SOCSO provisions. The Company&#8217;ll also make deductions from your applicable income. Even if you are not required to contribute SOCSO, you may choose to do, but according to SOCSO rules,&#8221;once in always in&#8221;. </p>
<p><strong>Taxes</strong><br />
You&#8217;ll be responsible for any personal income taxes which may be payable, and any other dues and levies payable in relation to the performance of this Contract. DiGi reserves the right to deduct from your salary for the amount due to you in compliance with the requirement of the Malaysian Inland Revenue Department. </p>
<p><strong>Working Hours, Days</strong><br />
You&#8217;ll work Monday to Friday from 9:00am to 6:00pm. You&#8217;ll have one hour off for lunch. (If you&#8217;re a male Muslim you may take reasonable additional time off to do your Friday prayers). Saturday shall be the &#8220;Off Day&#8221;, and Sunday the &#8220;Rest Day&#8221;. </p>
<p>Alternatively, depend on which state you&#8217;re employed in, you may work Saturday to Wednesday, same hours. Thursday shall be the &#8220;Off Day&#8221;, and Friday the &#8220;Rest Day&#8221;. </p>
<p>If your non working days fall on other days, the last non working day will be your &#8220;Rest Day&#8221; and the rest will be your &#8220;Off Day/s&#8221;. </p>
<p>Depending on the nature of your job and the needs of the Company, you may be assigned different working days and hours. </p>
<p>If you are covered by the Employment Act,you&#8217;ll be paid for working extra hours in accordance to the Act. If you are earning above RM1,500, you will be paid according to Company policy for such work. </p>
<p><strong>Public Holidays</strong><br />
You&#8217;ll enjoy all public holidays gazetted by the federal government, as well as any other ublic holidays gazetted by the state government of the state you&#8217;re working in. </p>
<p><strong>Your Salary Increment</strong><br />
Your salary may be increased from time to time at the Company&#8217;s discretion. </p>
<p><strong>Your Bonus</strong><br />
You may be given a bonus from time to time at the Company&#8217;s discetion. You&#8217;ll still need to be in employment when the bonus is paid out for you to be eligible for it. </p>
<p><strong>Your Paid Annual Vacation Leave</strong><br />
You&#8217;ll get 20 days of annual vacation leave per year of service. </p>
<p>You can only keep a maximum of 30 days of annual leave balance at any time (equivalent to unused annual leave over one and a half years). If the balance exceeds 30 days, the excess leave will be automatically forfeited without you being told. </p>
<p>You may apply for annual leave at any time if you have sufficient balance to cover the days you&#8217;re applying for. </p>

<p>If You Become Disabled<br />

<p><strong>Your Insurance Coverage</strong><br />
If you die due to accident, your beneficiaries will receive 72 times of your last drawn monthly basic salary. If you&#8217;re permanently disabled due to accident, you&#8217;ll receive up to 72 timesof your last drawn monthly basic salary in accordance tothe terms of your coverage. </p>
<p>If you die due to natural causes, your beneficiaries will receive 36 times of your last drawn monthly basic salary. If you&#8217;re permanently disabled due to natural causes, you&#8217;ll receive up to 36 times of your last drawn monthly basic salary in accordance to the terms of your coverage. </p>
<p><strong>Your Retirement Age</strong><br />
You&#8217;ll be required to retire on reaching the age of 55 years. Where your birthday is not stated in your identity card or birth certificate, you&#8217;ll retire on the 31st of December of the year you turn 55. </p>
<p><strong>You May Be Transferred</strong><br />
You&#8217;re subject to transfer or relocation from one work unit or location within the Company to another. You&#8217;ll also be subject to such transfer or relocation to another associated or affiliated company or tot the Company&#8217;s Holding Company. </p>
<p><strong>You and the Comapny&#8217;s Code of Conduct</strong><br />
Any Code of Conduct issued by the Company shall become part of these Terms and Conditions of Service. </p>
<p><strong>The Company May change These Terms and Conditions</strong><br />
The Company reserves the right to change, annul, modify or vary any of the above and when it deems necessary. </p>
<p><strong>General Matters</strong><br />
You must obey and comply with all orders and directions given by the Company, and follow all rules, regulations, procedures and practices. </p>
<p>You must not commit any misconduct or willful neglect whilst doing your job. </p>
<p>You must not be convicted of any offence that in the opinion of the Company affects your job with the Company. </p>
<p>You must not breach any of the terms and conditions of service contained inside here or elsewhere. If you breach any of the above, it may be considered as grounds to terminate your service without notice or payment of salary in lieu. You may also be terminated of your employment if you become unsound of mind. </p>
<p>All the matters listed here are covered in greater details in the Company&#8217;s policies. You must read the provisions here together with those policies. </p>

<strong>The Department of Occupational Safety and Health</strong> (DOSH), under the Ministry of Human Resources, has been assigned the responsibility of administrating and enforcing legislation related to occupational safety and health (osh) to ensure that safety, health and welfare of people at work as well as others are protected from hazards resulting from occupational activities in the various sectors which include manufacturing; mining and quarrying; construction; agriculture, forestry and fishing; utilities (gas, electricity, water and sanitary services); transport, storage and communication; wholesale and retail trades; hotels and restaurants; finance, insurance, real estate and business services; public services and statutory authorities.</p>
<p>The department has taken all necessary actions to ensure excellent delivery system and has achieved MS ISO 9001:2000 certification from the Department of Standards Malaysia. Therefore, it is committed to improve its service to customers through the effective management of its ISO system. The department carries out enforcement activities on industries governed by the three legislations which are <strong>Occupational Safety and Health Act (OSHA) 1994</strong>, Factories and Machinery Act 1967; and Petroleum Act (Safety Measure) 1984.</p>
<p>The National Occupational Safety and Health Excellence Award, which is the highest appreciation by the government, is aimed at giving credit and recognition to organizations which have a good record of achievements for occupational safety and health management at the workplace through the safety and health program audit. Audit is used as a tool for benchmarking a firm&#8217;s safety and health efforts against accepted standards which outlined in the MS 1722:Part 1:2005 OSH MS (Occupational Safety and Health Management Systems - Requirements). This standard was developed by Department of Standards Malaysia and with other agencies collaboration. It provides a means of measuring both documentation and implementation of the safety and health program.</p>
<p><span id="more-330"></span>The Occupational Safety and Health Act (OSHA) 1994 provides the legislative framework to promote, stimulate and encourage high standards of safety and health at work. The aim is to promote safety and health awareness, and establish effective safety organisation and performance through self-regulation schemes designed to suit the particular industry or organisation. The long-term goal of the Act is to create a healthy and safe working culture among all Malaysian employees and employers.</p>
<p><em>OSHA 1994 defines the general duties of employers, employees, the self-employed, designers, manufacturers, importers and suppliers of plant or substances.</em> Although these duties are of a general character, they carry a wide ranging set of responsibilities. The Act provides a comprehensive and integrated system of law to deal with the safety and health of virtually all people at work and the protection of the public where they may be affected by the activities of people at work.</p>
<p>The general duties of employers, employees, the self-employed, designers, manufacturers, importers and suppliers of plant or substances are clearly defined under OSHA 1994. Employers must safeguard so far as is practicable, the health, safety and welfare of the people who work for them. This applies in particular to the provision and maintenance of a safe plant and system of work. Arrangements must also be made to ensure safety and health in the use, handling, storage and transport of plant and substances. Under OSHA 1994, &#8216;plant&#8217; includes any machinery, equipment, appliance, tool and component, whilst &#8217;substance&#8217; means any natural or artificial substance whether in solid, liquid, gas, vapour or combination thereof, form.</p>
<p>Risks to health from the use, storage or transportation of substances must be minimised. To meet these aims, all practicable precautions must be taken in the proper use and handling of any substance likely to cause a risk to health. It is the duty of employers to provide the necessary information, instruction, training and supervision in safe practices, including information on the legal requirements. Employers need to consider the specific training needs of their organisations with particular reference to processes with special hazards.</p>
<p>An employer employing 40 or more persons must establish a safety and health committee at the workplace. The committee&#8217;s main function is to keep under review the measures taken to ensure the safety and health of persons at the workplace and investigate any related matters arising. An employer must notify the nearest occupational safety and health office of any accident, dangerous occurrence, occupational poisoning or disease which has occurred or is likely to occur at the workplace.</p>
<p>Some operation, installation, maintenance and dismantling of equipment and process need competent persons. Thus, during the installation of machinery and equipment such as cranes, lifts and local exhaust ventilation systems, competent persons are compulsory to ensure safe erection, whilst a boilerman and a steam engineer are required to operate high risk equipment such as boilers. Processes that use hazardous chemicals require competent persons to conduct the air quality and personal monitoring, and a safety and health officer and an occupational health doctor are required to ensure the proper surveillance of the workplace.</p>
<p>There are seven regulations under OSHA 1994 that enforced by DOSH. They are:</p>
<ol>
<li>Employers&#8217; Safety and Health General Policy Statements (Exception) Regulations, 1995</li>
<li>Control of Industrial Major Accident Hazards Regulations, 1996</li>
<li>Classification, Packaging and Labelling of Hazardous Chemicals Regulations, 1997</li>
<li>Safety and Health Committee Regulations, 1996</li>
<li>Safety and Health Officer Regulations, 1997</li>
<li>Use and Standards of Exposure of Chemicals Hazardous to Health Regulations, 2000</li>
<li>Notification of Accident, Dangerous Occurrence, Occupational Poisoning and Occupational Disease Regulations, 2004</li>
</ol>
<p>Contravention of some of the requirements can lead to prosecution in court. A person who fails to comply with an improvement or prohibition notice that is served on him is liable to prosecution, with a maximum fine of RM 50,000 or imprisonment for a term not exceeding 5 years, or both.</p>
<p>The objective of the Factories and Machinery Act (FMA) 1967, on the other hand, is to provide for the control of factories on matters relating to the safety, health and welfare of persons, and the registration and inspection of machinery. Some high risk machinery such as boilers, unfired pressure vessels, passenger lifts and other lifting equipment such as mobile cranes, tower cranes, passenger hoists, overhead traveling cranes and gondolas, must be certified and inspected by DOSH. All factories and general machinery must be registered with DOSH before they can be installed and operated in Malaysia.</p>
<p>DOSH enforces 16 regulations under FMA 1967. They are:</p>

<p><strong>What are the British Chevening Scholarships?</strong></p>
<p>Chevening is the UK government’s premier scholarship scheme, aimed at future leaders, opinion formers and decision makers. <p>Someone emailed me last week asking what kind of action can be taken by the future company if we have signed the acceptance of their offer of employment and later on decided to decline the offer.</p>
<p>No matter whether you got a better offer, the current company counter offer or for whatever reason you don’t have to worries so much but still you have to properly and professionally communicate your intention to decline the offer.</p>
<p>So the issue now is whether the Company can take legal action for those who has fails to fulfill their promised to join the Company.</p>
<p>Based on my experience, I never encountered any cases where the Company take legal action to the employee eventhough the have the rights to file a lawsuit against the employee as they have agreed and promised to join by signing the offer letter. By rejecting the offer which already signed will cause a problem to the company in many ways (i.e disruption of works, find replacement) especially for those who very last minute decline the offer.</p>
<p>However, I strongly believe that most companies will not pursue this as any lawsuit will cost a lot on time and money and need extra manpower to focus on this alone.</p>
<p>If you decided not to join make sure you professionally inform them in writing on your decision and and to put a “reason” is not necessary. It is important also to know that if you possesses  special skills which is very hard to find in the market and in very niche market, there is a possibility for them to contact you back in the future. So, to maintain good relationship is important. Please also take  note, some companies will be likely to blacklist candidates who has rejected their offer for whatever reason.</p>
<p>The conclusion here is before you accepted any offer please think twice and its good if you can communicate to your superior first, who know any counter offer can come before you sign the new offer.</p>

			<content:encoded><![CDATA[<p>This could be another good example on how to success in the job interview, this may be not suitable for fresh graduates but you can image what will the panel of interviews will say if you could perform or display similar effort.  Anyway, read Zagorski Way</p>
<p>In the April 2000 issue of the Reader’s Digest magazine, Nick Corcodilos, a famous headhunter, recounts how Zagorski, a professional seeking a new job, wowed an interviewer at a big corporation and got the job.</p>
<p>Zagorski went for an interview at AT&#038;T. At the outset, even before Zagorski could settle in his seat, the interviewer told him that he had only 20 minutes to spare. Instead of feeling belittled or nervous, Zagorski got up and walked up to the marker board. He then started writing down the challenges faced by the company. Fifteen minutes later, he wrote down his estimate of what he would add to the bottom line. When he paused to take a look at the interviewer, he found him completely dazed. The next thing he heard was interviewer telling him that there was no need for any further interview. The interviewer called in his team, introduced Zagorski to everybody and they began a working meeting, which lasted for two hours.</p>
<p>Most people go to interviews hoping to be questioned and assessed by an interviewer (s). They go anxious and worried, wondering whether they would get the job. People like Zagorski approach an interview with a completely different mind-set. They go well-prepared to demonstrate how they would fit into an employer’s needs and bring value to their business. They go as a value provider, not as a job seeker.</p>
<p>Would you also like to impress your would-be employer just like Zagorski? If yes, the next time when you get an interview call, do not lose any time and get down to preparing a powerful presentation. Here is a road map:<br />
<strong><br />
Know the employer</strong><br />
Go to the company’s website and learn about its products and services. What initiatives this company is taking? Who are their competitors and what challenges are they facing? Read the “news” section to pick up the latest happenings there.<strong></p>
<p>Review the job</strong><br />
Next, zero down to the job that you are pursuing. What are the employer’s expectations in terms of responsibilities, actions and goals? Also note the job requirements – qualifications, experience and skills – that the employer is expecting the right candidate to satisfy.</p>
<p><strong>Review yourself</strong><br />
Look at your resume and review the assets you have: your experience, education, achievements, skills, knowledge and strengths.<br />
<strong><br />
Prepare a presentation</strong><br />
Having done the homework, now it is time to prepare a short PowerPoint presentation. The presentation should essentially comprise the following parts:<br />
<em><br />
Part 1: About yourself</em><br />
Prepare a short introduction to yourself in terms of education, experience and achievements.<br />
<em><br />
Part 2: Employer’s business</em><br />
This part is about showing your understanding of the company’s business: products, services, markets, competition, etc.<br />
<em><br />
Part 3: Employer’s needs</em><br />
In this part, list all of the employer’s expectations – responsibilities, actions and goals – you will be expected to meet. Also talk about the challenges you will be facing in the job.<br />
<em><br />
Part 4: How would you deliver</em><br />
This is the heart of your presentation. Demonstrate how you would tackle the challenges and go on to show how not only you can meet the employer’s expectations but exceed them. To make it credible, share actual examples from your past experience and use quantitative information.</p>
<p>On the whole, keep your presentation limited to 10 slides and 15 minutes long.</p>
<p>Practise<br />
The last and final step is to practise delivering the presentation. The more you practise, the more relaxed, confident and convincing you will be during the interview.</p>
<p>Zagorski would not have been able to make that job-winning presentation if he had not done a thorough preparation. Now, it is your turn to follow his way and enjoy success at the interview.</p>

			<content:encoded><![CDATA[<p>KUANTAN: Prime Minister Datuk Seri Najib Tun Razak has launched the country’s first Special Economic Zone that aims to bring in RM90bil worth of investments and create 220,000 jobs by 2020.</p>
<p>The SEZ, which would cover an area measuring 25km by 140km from Kertih in Terengganu to Gambang and Pekan in Pahang, would attract more investments to the East Coast Economic Region (ECER), he said on Tuesday.</p>
<p>He said the SEZ would be the biggest such economic zone in all of Asia.</p>
<p>Investors in the zone will enjoy many special incentives, including a 10-year tax exemption, 100% investment tax allowance, and exemptions from import and export duties.</p>
<p>“For the first time, investors will be offered incentives that can be customised specially for them,” Najib said.</p>
<p>The Prime Minister added that the ECER SEZ is part of the new economic model his administration has promised for a fairer distribution of wealth, to ensure that the region’s rapid growth is enjoyed by all.</p>
