• Va. Code Ann. § 20-124.2(B) provides that a court shall give due regard to the primacy of the parent-child relationship but may, upon a showing by clear and convincing evidence that the best interest of the child would be served thereby, award custody or visitation to any other person with a legitimate interest. Persons with a legitimate interest include a minor child’s grandparents. Va. Code Ann. § 20-124.1. The party seeking visitation bears the burden of proving it is in the best interests of the child. Va. Code Ann. § 20-124.2(B).
• When only one parent objects to a grandparent’s visitation and the other parent requests it, the trial court is not required to follow the standard enumerated by the Court of Appeals of Virginia in its Williams decision.

State interference with a fundamental right must be justified by a compelling state interest. To constitute a compelling interest, state interference with a parent’s right to raise his or her child must be for the purpose of protecting the child’s health or welfare.
